The main objective of this work is making evident that the Spanish legislation does not regulate, forgets and even harms many of the rights of Trans people. For that, this research performed a study of the resolutions, recommendation and reports of the international organization, as well as the international norms and jurisprudence. As a result of this, the research was able to prove that Spain is far behind countries such as Argentina in matters of gender identity. One of the conclusions of this work is that the Spanish State should approve a new gender identity law that regulates this right from a de-pathologizing perspective, and apply gender studies in all of its laws. ; El objetivo principal de este trabajo es poner de manifiesto que la legislación española no regula, olvida o, incluso, vulnera muchos de los derechos de las personas trans. Para ello se realizó un estudio de las resoluciones, recomendacionese informes de los organismos internacionales, así como de la normativa y la jurisprudencia internacional. Como resultado de lo anterior se pudo comprobar que España se encuentra muy por debajo de países como Argentina en materia de identidad de género. Una de las conclusiones a las que se llega es que el Estado español debería aprobar una nueva ley de identidad de género que regule este derecho desde una perspectiva despatologizadora, y aplicar los estudios de género en todas sus leyes. ; Este trabalho tem o objetivo principal de demonstrar que a legislação espanhola não regulamenta, esquece ou, ainda, viola muitos dos direitos das pessoas trans. Para isso, foi realizado um estudo das resoluções, recomendações e relatórios das organizações internacionais, bem como das leis e jurisprudências internacionais. Como resultado disso, foi possível comprovar que a Espanha se encontra muito abaixo dos países como a Argentina quanto ao tema de identidade de gênero. Chega-se à conclusão, entre outras, de que o Estado espanhol deveria aprovar uma nova lei de identidade de gênero que regulamente esse direito sob perspectiva despatologizadora e aplicar os estudos de gênero em todas as suas leis.

This article introduces the photography as a structure of meaning from which to analyzes the real-literal and subjectivity. This peculiarity has been constituted as an ideal language in dealing with the specificities in the field of cultural practices, the construction of memory and gender identity discourse within the African context. We have analyzed the similarities generated by the first anthropological photo reports with the colonial continuum and posterior segregationist regimes such as apartheid in South Africa, exerting a hegemonic gaze away from the cultural and social particularities as well as race, gender, sex and sexuality differences. This has led us to the exploration and interpretation of the activist side of the current African photography, which analyzes the identity from all streams related to gender and racialist issues: racial control as biopower and social and political power over the body, sexual difference and sexuality. Under that rejection of the normative, photographs of Santu Mofokeng, Samuel Fosso and Zanele Muholi are visual demonstrations that articulate the conflicting nature of identity and gender in a scenario like the African which, rooted in a precarious political and economic order, carries systemic violence that manifests itself in terms of criminalization, marginalization and exclusion. ; Este artículo introduce lo fotográfico como una estructura de significación desde la que se analiza lo real-literal y lo subjetivo. Esta peculiaridad ha hecho que se constituya como un lenguaje idóneo en la especificidad del ámbito de las prácticas culturales y la construcción de la memoria y el discurso identitario de género, en este caso, en Sudáfrica. Hemos analizado las concomitancias que generan los primeros fotoreportajes con el continuum colonial, ejerciendo una mirada hegemónica alejada de las particularidades culturales y sociales, de las diferencias de raza, clase, sexo o religión. Hasta llegar a la vertiente activista de la actual fotografía sudafricana, la cual y desde un análisis discursivo coincidente con posiciones críticas como la de Judith Butler sobre el género o Gayatri Spivak y el sujeto post-colonial, cuestiona asuntos relativos al control social y patriarcal sobre el cuerpo de las mujeres o el transfeminismo, la identidad y las teorías queer.

This article approaches the construction of the feminine representations -from a gender perspective- in the Colombian soap opera field, which as a cultural format has reached the frontier of the Latin-American identity. A historical tracking of how the characterization of the feminine in the national tele drama answers some logics in which the social rights and the self-portraits work as a synergy, pushed more from the feminine routine than from "favors" or political revendications staged in the media. This will allow us to locate in a given space the gender-identity problem, and at the same time it will enable to have a look at the incidence reached by the battles between men and women in the cultural-mediatized products. Which are the transformations of the feminine in the mediatized culture and how they appear there? What places take on contemporary social transformations? ; El presente artículo aborda la construcción de las representaciones de lo femenino desde la perspectiva de género en el ámbito de la telenovela colombiana, que como formato cultural ha alcanzado las fronteras de la identidad latinoamericana. En él se hace un rastreo histórico de cómo la caracterización de lo femenino en el teledrama nacional responde a unas lógicas en las que los derechos sociales y las autorepresentaciones operan como una sinergia empujada más desde lo cotidiano femenino, que como "favores" o reivindicaciones políticas escenificadas en los medios. Esto nos permitirá ubicar en un espacio determinado el problema de la identidad de género, a la par que posibilitará una mirada a la incidencia que las luchas por la igualdad entre hombres y mujeres alcanzan en los productos culturales mediatizados. ¿Cuáles son las transformaciones de lo femenino en la cultura mediatizada y cómo aparecen allí? ¿Qué lugares ocupan en las transformaciones sociales contemporáneas? This text intends to approach the question of sexual identity as it has been defined in queer theory, and particularly in Judith Butler's work. The notion of performativity, closely related to a conception of the social as an open field of power relations where all identity is a contingent and precarious stabilization, leads to a politicization of identity that implies a second step further from its denaturalization. Identity is the place from which we can articulate a resistance politics, and its open and incomplete character is what allows its resignification.
