ПРИНЦИП КОМПЛІМЕНТАРНОСТІ ТА ЙОГО ЗНАЧЕННЯ ДЛЯ ІСТОРІЇ МІЖНАРОДНОЇ ПРАВОСУБ'ЄКТНОСТІ (СЕРЕДЗЕМНОМОРСЬКО-ВІЗАНТІЙСЬКИЙ АСПЕКТ)

COMPLIMENTARITY PRINCIPLE: IT'S IMPORTANCE FOR THE HISTORY OF INTERNATIONAL LEGAL PERSONALITY (MEDITERRANEAN-BYZANTINE ASPECT) The article covers an important issue of legal history and philosophy of law - theoretical and methodological principles of studying the imperial forms of government from the standpoint of the principle of complementarity. In essence, the author understands the principle of complementarity as an independent research approach, favorable primarily for a wide range of imperial studies. The study of empires involves, first of all, the characteristics of coexistence and interaction of peoples and territories. The Byzantine and Persian empires (the early Middle Ages period) are considered to be the most important imperial associations, whose cultural heritage still influences the political map of western Eurasia. The principle of complementarity, as a methodological approach that reflects the correlation of Hegelian thesis and antithesis, allows us to establish the boundaries of the spread of Byzantine (Eastern Roman) political traditions within Central Asia and, conversely, the limits of perception the basic values of the legal culture of Sassanian Iran by the Mediterranean peoples. Political and legal complementarity understood by the author as a collective system of beliefs. These kinds of systems needs an object of complementarity like the Hegelian antithesis needed its thesis. At the same time, the principle of complementarity states, if a certain community is in the cultural orbit of another community - it just explain its mental and cultural coexistence (even if this particular community is fighting against a conditional "other" community). After all, the historical neighbors-enemies are most often turn into friends-adherents of the hostile communities. Mutually complementary communities unite among themselves into civilized super-communities that legally take on imperial forms. So, in many cases, mercilessly criticized by positivist historiography, the identification of civilizations and empires is fair. The mutual frontier complementarity of Sassanian Persia and the Eastern Roman Empire (Byzantium) is the best proof of this. ; Стаття висвітлює важливе питання юридичної історії та філософії права - теоретико-методологічні засади вивчення імперських форм державного устрою з позицій принципу компліментарності. По суті, автор розуміє принцип компліментарності як самостійний дослідницький підхід, сприятливий насамперед для широкої сфери імперіологічних студій. Вивчення імперій передбачає насамперед характеристику співжиття та взаємодії народів і територій. Найбільш важливими імперськими об'єднаннями, культурний спадок яких досі справляє вплив на політичну мапу західної частини Євразії, визнаються Візантійська та Перська імперії доби раннього середньовіччя. Принцип компліментарності як методологічний підхід, що відображає кореляцію тези й антитези Г.-В.-Ф. Гегеля, дає змогу встановити межі розповсюдження візантійських (східноримських) політичних традицій у межі Середньої Азії та, навпаки, грані сприйняття середземноморськими народами базових цінностей правової культури Сасанідського Ірану. Політико-правова компліментарність розуміється автором як колективна система переконань. Така система потребує об'єкта компліментарності так, неначе гегеліанська антитеза потребує своєї тези. При цьому принцип компліментарності стверджує: якщо певна спільнота знаходиться в культурній орбіті іншої спільноти (навіть якщо ця певна спільнота веде бойові дії проти умовної «іншої» спільноти), то вона залежить від її ментально-культурного поля. Врешті-решт, саме історичні сусіди-вороги найчастіше перетворюються в друзів-адептів поборюваних спільнот. Взаємно компліментарні спільноти об'єднуються між собою в цивілізаційні надспільноти, котрі юридично набувають імперських форм. Здебільшого нещадно розкритиковане позитивістською історіографією ототожнення цивілізацій та імперій є справедливим. Взаємна фронтирна компліментарність Сасанідської Персії і Східної Римської імперії (Візантії) - найкращий цьому доказ.
