Le celebrazioni per i 150 anni dell'Unità d'Italia offrono anche l'occasione per interrogarsi sulla storia e lo sviluppo di questo Paese, in particolare in riferimento alla cultura del mare e al sistema dei trasporti via acqua. In un paese peninsulare come l'Italia, con i suoi 7.500 chilometri di fronte d'acqua, la presenza dei porti è sempre stata elemento determinante per la crescita economica e per la sua affermazione sui mercati internazionali. Ma, dalla seconda metà del Novecento, le città e i loro porti sono andati progressivamente separandosi, determinando situazioni di forti contrasti e di continue tensioni. Solo più recentemente – a seguito della legge n. 84 del 1994 – nuove forme di 'dialogo' hanno consentito, in talune occasioni, di riavviare politiche di concertazione sui piani di sviluppo delle aree portuali e sul miglioramento della situazione delle zone urbane prossime ai porti. Per tutti questi motivi, l'occasione del 150esimo anniversario dell'Unità d'Italia può rappresentare un momento significativo per riprendere la riflessione sul ruolo dei porti italiani nella storia del nostro paese, ed, eventualmente, sul potenziale rafforzamento che essi possono subire, alla luce dei dati positivi ed incoraggianti dell'intero cluster marittimo in questi ultimi anni, almeno fino alla crisi congiunturale del 2008.Al tempo stesso, si può analizzare la complessa relazione porto-città, in un'ottica di mutuo riconoscimento delle rispettive esigenze e della volontà di sviluppare le proprie attività in un quadro di concreto ed efficace spirito di collaborazione, che richiede sia una maggiore conoscenza reciproca, così come una più efficace definizione degli obiettivi per il raggiungimento di una qualità urbana sostenibile e duratura.La progressiva globalizzazione dell'economia e la liberalizzazione del mercato hanno determinato una generale crescita degli scambi commerciali a livello mondiale e in particolare il bacino del Mediterraneo è diventato un centro di flussi di traffico Est-Ovest e Nord-Sud. L'Italia, posta al centro del bacino del Mediterraneo, è tornata ad essere oggi il crocevia delle più importanti direttrici di collegamento mondiale di merci e passeggeri, vivendo una stagione di intensa crescita nei traffici marittimi. Ad eccezione per quei porti caratterizzati da una forte presenza del segmento crocieristico che ha registrato livelli di crescita interessanti, la crisi congiunturale e globale del 2008 ha avuto effetti molto pesanti anche in questo settore (traffico merci su mezzi pesanti e traffico container). Si pagano alcune lacune storiche della portualità del Mediterraneo, e di quella adriatica in particolare, quali la mancanza di collegamenti terrestri via ferrovia da e per i porti, anche se le Autorità Portuali stanno cercando di colmare il ritardo sia dal punto di vista infrastrutturale che di sostenibilità ambientale, attraverso politiche di condivisione e convivenza tra il porto e il territorio circostante e in una rinnovata e diffusa 'cultura del mare' e del ruolo attivo e 'creativo' dei porti. Solo attraverso un approccio culturale e una reciproca educazione potrà emergere una nuova percezione del porto in città e della città nel porto. In realtà, esistono già segnali incoraggianti di una recente appropriazione – o ri-appropriazione – del porto in chiave positiva e di un recupero della cultura del mare in alcune città portuali italiane. Attraverso un processo lento e complesso, articolato in eventi diversi, sta maturando un nuovo 'sentire' nei confronti dei porti, visti in chiave di risorsa e di parte integrante di una città, purché essi rispettino alcune regole necessarie per una vita urbana sostenibile. ; The celebrations for the 150th anniversary of the Unification of Italy also offer the opportunity to question the history and development of this country, particularly in reference to the maritime culture and the system of water transport. In a peninsular country like Italy, with its 7,500 km of waterfront, the presence of ports has always been crucial to economic growth and its success in international markets. But the second half of the twentieth century, cities and their ports have been gradually separated, resulting in situation of conflict and ongoing tensions. Only recently – following the Law 84, 1994 - new forms of 'dialogue' have allowed, on certain occasions, to restart political consultation on the development plans of the port areas and on improving the situation of urban areas close to ports. For all these reasons, the occasion of the 150th anniversary of the Unification of Italy can be a significant moment to resume the debate on the role of Italian ports in the history of our country, and possibly increase the potential that they may have, according to the positive and encouraging data of the entire maritime cluster in recent years, at least until the economic crisis of 2008. At the same time, the complex relationship port-city can be analyzed, with a view to mutual recognition of their needs and to the development of their activities in a framework of practical and effective, cooperative spirit, which requires both a greater mutual understanding as well as a more effective targeting to achieve a lasting and sustainable urban quality. The gradual economic globalization and market liberalization have led to a general increase in trade globally and in particular the Mediterranean has become a centre of traffic flows East-West and North-South. Italy, located in the middle of the Mediterranean basin, is now once again become the crossroads of the most important lines of goods and passengers connected world, experiencing a period of intense growth in maritime trade. Except for those ports with a strong presence of the cruise segment, which recorded growth rates of interest, the global economic crisis of 2008 has had very heavy in this sector (freight traffic to trucks and containers). This is also due to some historical gaps of the Mediterranean ports, such as the lack of rail connections to and from the ports, although Port Authorities are trying to bridge the gap both in terms of infrastructural interventions and environmental sustainability, through policies of sharing and coexistence between the port and the surrounding area and through a renewed and widespread 'culture of the sea'. Since only through a cultural approach and mutual education will emerge a new perception of the port in the city and the city in the port. In fact, there are already encouraging signs of a recent appropriation of the port in a positive light and of a recovery of marine culture in several Italian port cities. Through a slow and complex process, articulated through different events, is gaining a new 'feeling' in relation to ports, seen in the key of a resource and as an integral part of a city, provided they respect certain rules necessary for sustainable urban living.
Oggi e oltremodo importante sperimentare metodologie didattiche innovative volte a facilitare l'acquisizione di una competenza comunicativa globale in Lingua Straniera (LS)/Lingua Seconda (L2), anche in considerazione delle piu recenti politiche linguistiche europee. L'ipotesi di partenza del presente lavoro di ricerca e che il coinvolgimento emotivo dell'apprendente e l'utilizzo di vari codici espressivi, in aggiunta al codice verbale, favoriscano risultati piu efficaci. Si vogliono pertanto dimostrare i vantaggi della glottodidattica teatrale in contesti specifici. Negli ultimi anni, abbiamo assistito, in tutta Italia, a significativi mutamenti dovuti da un lato alla globalizzazione e dall'altro, a livello "glocale", all'ondata migratoria che ha coinvolto l'intera nazione e che trova in Sicilia, vista la posizione geografica, uno sbocco obbligato. Si deve quindi ripensare ad una organizzazione del processo di insegnamento-apprendimento dell'Italiano L2 in chiave sociolinguistica, pragmatica e interculturale e prevedere percorsi inclusivi a piu ampio raggio che agiscano innanzitutto sulla motivazione e sull'abbassamento del filtro affettivo. Perche allora investigare sulla glottodidattica teatrale? Proprio perche quest'ultima risulta la combinazione vincente per conseguire obiettivi anche al di fuori delle scuole, in ambito sociale. Attraverso pratiche laboratoriali e strategie cooperative, si promuove una continuita educativa a spirale in termini di crescita e autonomia personale che si aggancia ai prerequisiti per ampliare e potenziare competenze trasversali in situazioni sempre nuove e differenziate. In ambienti educativi rilassanti si svolgono attivita dinamiche ed espressive a partire dal linguaggio del corpo e dalle azioni fisiche; contestualmente si attivano processi cognitivi e metacognitivi anche a stadi iniziali di interlingua. Si facilita cosi un piu rapido adattamento degli stranieri nel Paese di accoglienza. Il coinvolgimento fisico e plurisensoriale consente infatti una esperienza comunicativa intersemiotica che nell'uso della L2 significa apertura valoriale alla Cultura Seconda (C2) e confronto tra le peculiarita sociocomportamentali e pragmatiche delle due lingue in un'ottica di convivenza democratica. Il lavoro teorico prevede obiettivi generali e si concretizza in una serie di obiettivi specifici per i quali viene condotta un'analisi delle questioni in campo circoscrivendo infine la ricerca al territorio siciliano, precisamente quella parte della provincia di Messina che va da Capo d'Orlando a Milazzo. In particolare, si e voluta intraprendere una ricerca-azione sulle potenzialita del metodo Glottodrama in contesti migratori. ; Hoy es muy importante experimentar con métodos de enseñanza innovadores para facilitar la adquisición de una competencia comunicativa global en Lengua Extranjera (LE) / Lengua Segunda (L2), también en consideración de las políticas lingüísticas europeas más recientes. La hipótesis de partida de este trabajo de investigación es que la participación emocional del alumno y el uso de varios códigos expresivos, además del código verbal, consiguen multiplicar la eficacia de los resultados. Por lo tanto, nos proponemos demostrar las ventajas de la enseñanza de idiomas a través del teatro en contextos específicos. En los últimos anos, hemos asistido, en toda Italia, a significativos cambios debidos, por un lado, a la globalización y, por otro, a nivel "glocal", a la ola migratoria que ha implicado a toda la nación y que tiene su mayor impacto en Sicilia. La isla, por su posición geográfica se convierte en vía de paso para un número importante de inmigrantes. Por lo tanto, es necesario repensar una organización del proceso de enseñanza-aprendizaje del italiano como L2 en clave sociolingüística, pragmática e intercultural, y prever caminos inclusivos más amplios que actúen principalmente sobre la motivación y la reducción del filtro afectivo. . ¿Por qué entonces investigar la enseñanza de idiomas a través del teatro? Precisamente porque esta última es la combinación ideal para lograr objetivos también fuera de las escuelas, en ámbito social. A través de prácticas de laboratorio y estrategias cooperativas, se promueve una continuidad educativa en espiral en términos de crecimiento personal y autonomía que integra los requisitos previos para expandir y fortalecer las habilidades transversales en situaciones siempre nuevas y diferenciadas. En entornos educativos relajantes, se realizan actividades dinámicas y expresivas a partir del lenguaje corporal y las acciones físicas; al mismo tiempo, los procesos cognitivos y metacognitivos se activan incluso en las etapas iniciales de la interlingua. Esto facilita una adaptación más rápida de los extranjeros en el país de acogida. La participación física y multisensorial permite una experiencia comunicativa Inter semiótica que, en el uso de la L2, significa apertura a los valores de la Cultura Segunda (C2) y comparación entre las peculiaridades pragmáticas y la realidad social de la que los dos idiomas se hacen portadores en una perspectiva de coexistencia democrática. El trabajo teórico prevé objetivos generales y se concretara en una serie de objetivos específicos para los cuales se quiere realizar un análisis de las cuestiones en el ámbito, circunscribiendo finalmente la investigación al territorio siciliano, precisamente esa parte de la provincia de Messina que va desde Capo d'Orlando a Milazzo. En particular, queríamos proceder aplicando una investigación-acción sobre las potencialidades del método Glottodrama en contextos migratorios. ; Nowadays it is extremely important to experiment innovative teaching methodologies aimed at facilitating the acquisition of a global communicative competence in a Foreign Language (FL)/ Second Language (L2), also taking into account the most recent European language policies. The starting hypothesis of this research work is that the learner's emotional involvement and the use of different expressive codes, in addition to the verbal code, promote more effective results. We therefore want to demonstrate the advantages of learning and teaching a language by using drama/theatre techniques in specific contexts. In recent years, we have witnessed, throughout Italy, significant changes due on the one hand to globalization and, on the other, at "glocal" level, to the migratory wave that has involved the whole nation e that finds in Sicily, because of its geographical position, a forced outlet. It is therefore necessary to rethink the organization of the learning-teaching process in Italian as L2, in a sociolinguistic, pragmatic and intercultural way and to plan inclusive and wider educational paths that act primarily on motivation and on the lowering of the affective filter. Why then investigate drama/theatre techniques applied to language teaching? Precisely because they represent the winning combination to achieve objectives even outside of schools, in the social sphere. Through laboratorial practices and cooperative strategies, a spiraling educational continuity is promoted in terms of growth and personal autonomy which are linked to the prerequisites for expanding and enhancing transversal skills in ever new and differentiated situations. Dynamic and expressive activities are carried out in relaxing educational environments, starting from body language and physical actions; at the same time, cognitive and metacognitive processes are activated even at early interlanguage stages. This facilitates a more rapid adaptation of foreigners in the host country. In fact, the multi-sensorial, physical involvement promotes an intersemiotic communicative experience which, related to the use of the L2, means opening to the Second Culture (C2) values and comparing the socio-behavioral and pragmatic peculiarities of the two languages in a perspective of democratic coexistence. Theoretical work includes general objectives and takes concrete form in a series of specific objectives by carrying out an analysis of the topics at issue, finally narrowing the research to the Sicilian territory, namely that part of the province of Messina which goes from Capo d'Orlando to Milazzo. In particular, it was decided to undertake action research on the potential of the Glottodrama Method in migratory contexts.
The research opens a new chapter about the studies conducted until now on the traditional architecture of the smaller towns in Sardinia, which I have been part from 2007 to 2010 and has been completed with the editing of Manuals Retrieval of the historical centers of Sardinia. The research started from a socio-anthropological knowledge of the characters, urban and technological centers and from the study of the traditional Sardinian architecture. Furthermore, having the opportunity to meet the Mediterranean architecture on the same viewpoints, the research investigates the archetypal elements of traditional architecture under the aspect of composition. It looks at the ways in which the contemporary design strategies, released by ideological references, take them over elaborating them, comparing with the memory of places, beyond of every stylistic affiliation. Belonging to minimalist positions, regionalist or post-modern resuming solutions, contextualizing and reinterpreting them in a practical and empirical way, even trying to see which characters and modes could be identified as typical and recurrent. This kind of research, which specifically aims to verify the composition and some elements of the experience of this project, needs to be based on the knowledge of the culture and the debate which marked the activity of designers in the near past, from the first modernity trying to recognize which characters were conditioners, which continue to influence the present and which are typical and original in the actuality. For this reason, the research has an introductory part which incorporates some emblematic moments of the debate on the architecture of the twentieth century, referring to reality and figures of the Mediterranean. One is the myth of modernity celebrated from the first rationalism, especially in Italy and Spain, the other one is the debate about the historical centers of the late twentieth century, still typical of our country: in the first season the traditional Mediterranean architecture is transformed into a progressive ideal used to specify shapes and intentions of the new architecture, especially in its character of anonymity and puristic reduction. The first part of the research, introduces the relationship between modern architecture and Mediterranean inspiration and deepens in a critical manner, the weakness of the concept of Mediterranean, founded on one hand in a sham and on the other on how rationalism looks at the historical landscape searching for a radical overhaul of the style of architecture. The Mediterranean myth in the Italian architecture is mainly influenced by the idea of the correspondence of the formal themes of modernity and is used for political reasons in order to find a place of modern Italian positions within the regime. The Mediterranean architecture is not, therefore, re-interpreted conservatively, but revised into a new paradigm, a new way of imagining the architecture. In the second part, by the pre-war myth, still literary and idealized, we move to a more critical and accurate knowledge to the empirical verification and philological sort order, losing the progressive tension of the first season and building a system of strict preservation rules, revealed, too deterministic and inhibitory. The weakness of the rationalist positions, reveals the architecture of the Second World War, who looked to the Mediterranean, devoid by now, of the ideal tension during the rationalism: it is less parallelism between cutting-edge research and charm of the Mediterranean landscape and the question begins to focus more on the relationship with the towns, with the existing environment, and for a certain range of the debate, with the preservation of historic centers, up to produce more and become part of the theories of critical regionalism, political manifesto, as Frampton says, of resistance towards globalization. The enhancement of local realities is no longer specific to the Mediterranean, but is extended: it is as if the great architecture of Mediterranean figures lost part of the universal value, which instead is recognized during rationalism. In the present, after the crisis of the great paradigms interpretive, the debate about relationship between new and old loses strength and becomes eccentric compared to issues considered preeminent. Some great works receive media attention representing particular methodologies, these are exceptional circumstances, related to charismatic personalities who avoid to define a strong theory. This research select a field of attentive investigation to the works of medium size on which you can recognize an empirical approach (not programmatic), which could be recognized as typical of this period. An approach that addresses issues that in the past were strongly ideological - the relation between modernity and tradition and continuity and rupture with the figures of history - out of those programmatic intentions and norms: in this way many architects of the younger generation, active in the Mediterranean territories, they built a sensitive and imaginative dialogue between the elements inherited from the context and strategies - even radical - of contemporary design, defining a fertile scene and interesting to build new methodologies and practices of intervention. Currently there is no attention to the great paradigm, but an open and practical approach. I will approach the scope of this study as part of the Mediterranean, in order to understand the outcome of discussions which are the current approaches and isolating a specific subject of the tradition, one of the most characteristic, trying to figure out how the projects chosen take up and rework the issue. The modulation of the light, treated according to the manner in which you relate to some elements of tradition: the dematerialization of the building mass, the dimming systems, gaps in the patio and courtyard and places of shade. Each of the examples treated, shows that there is a traditional way to control the light that has characterized the Mediterranean architecture of the past and that has been expressed by the categories identified. I prove that there are contemporary projects which reflect those solutions contextualizing and reinterpreting them in an empirical and practical way: this is very interesting because it demonstrates the vitality of the relationship between contemporary architecture and history and how certain paradigms of the Mediterranean tradition have survived as a cultural and architectural legacy, in the attempt to offer a possible answer to the complexity of the problems posed by the existing historic and how have been reinterpreted. Beyond each "nuovismo", as well as the obsession of memory, which often gave rise to an analytical mummification that carries with it the nostalgic for the unachievable quality of the ancient city and the assurance of the absence of quality of the city modern-contemporary, can be an alternative based on the careful study of places to go back to the essential qualities that the architectures are realized in it.
The Human Rights topic is increasing its relevance in the field of legal studies and in the agenda of inter/transnational actors. The Sociology of Law is deeply engaged in this dialogue, but some of its contributions seem to share a common lack of concern about the dimensions of cultural legitimacy and politics of imagination. Refusing the "simplistic" vision of «legal transplants», the approach in term of regionalization and the genealogical theories (i.e. the so called generations of human rights), the thesis aims to outline a multidisciplinary frame, trying to merge the anthropological and the socio-legal knowledge to shed light on the «anthropologies of human rights». The use of the plural suggests several orders of realities: firstly, it reflects the high fragmentation which characterizes the epistemological and methodological debate of contemporary anthropology, as a disciplinary field. An "internal" multiplication of points of view which becomes even more striking in its interactions whit the HR subject and its own kind of internal dissemination. Secondly (and consequently), it enlightens that the "pluralisation" of human rights discourse could be better understood as a proliferation of world-visions and axiologies. In this second meaning, the summoned «anthropologies» have to be intended in term of theories on human beings, on social reality and social order, shaped by cultural assumptions, taken-for-granted and (shared) symbolical repertoires. Deeply merged within every manifestation of the «humanitarian transnational narration», these world-versions need to be studied as sources of influence and inspiration for legal claims, texts and declarations that build the corpus of international humanitarian law. Lastly, this plurality which stems from the relationship between the macro-narrative of the International Bill of Human Rights and its situated appropriations points out the potentiality of a cultural analysis of the social life of (human) rights in avoiding the dichotomist models (universalism versus relativism, global versus local and so on) in favor of a representation in term of narrative encounters between different conceptions of human dignity, human beings, normative orders and social realities. To grasp this mutual and multilayered overlapping, the first part of the thesis builds an analytical framework destined to be applied, in the second part, to the specific context of the «African system of human rights». This choice was dictated by the peculiarities which seem to distinguish it from others regional systems: amongst these features, the African Charter on Human and Peoples' Rights deserves a special place, considered its aspects of relevant innovation and creativity as well its signs of criticism and its lack of real efficacy. In the first chapter we start from the general liaison between Law and Culture, looking for a «relational paradigm» which rejects determinist or reductionist presentations of this organic link. Adopting a pluralist point of view (centered on the idea of «normative pluralism» preferred to the classical one in term of «legal pluralism»), we borrow some insights from early anthropological researches on «primitive law» and on the co-existence of plural normative orders in colonial settings. The second chapter deals with the concept of «legal culture», trying to discuss a cardinal notion of sociology of law that often pretend to exhaustively grasp the complexity of law/culture nexus. We explore the richness and the pitfalls of influent theorizations about this topic, sorting out three dimensions which seem to require a deeper engagement: the power, the (construction of the) collective identities and the pluralism. In strict dialogue with the studies on «legal consciousness» and «legal socialization», we move towards a textual description of culture. The third chapter sketches a theory of culture in term of cognitive and normative interface between men and the meaningful world they try to create (and to live in). Borrowing from Clifford Geertz the fundamental ideas about the «social traffic of meanings», the textual dimension of cultures and the law as a way of world-making – or better, of imaging the reality –, we keep developing our model in a more comprehensive perspective which dismisses the "literary" constraints entrenched in the idea of «text». The forth chapter deals with some assumptions of the so-called «narrative paradigm», trying to "dissolve" the persisting rigidities of the textual frame into a larger and (more) universal human ability: the narrative competence. We examine the coalescence between narrative attitude and normative attitude, stressing the similarities and the constitutive power of both of them. Starting from narration as a meta-model for the social construction of reality, we move towards the specificities of «legal narration» as expression of the legal construction of social reality. This narrative standpoint can be synthesized as follow: the human skill to produce, to understand and to manipulate tales (and other sources of narrative production) is the key that ensures the transmission and the socializations of cultural meanings, representations and symbols. Trough the narrativization of culture it becomes easier to conceive the narrativization of legal cultures as shared, contested, polyphonic repertories of legal and social ideas. In the fifth chapter we start applying our theoretical framework to the human rights topic. We begin with a preliminary set of issues regrouped under the label of «spatial problematic». It underlines the paradox of the Universalist project, with its claims of cultural independence and planetary applicability on the one hand, and the need of cultural resonance and local relevance on the other. We explore critical contributions about the «globalization talk», which stress some traps of this overriding way of representing social and socio-legal phenomena in the contemporary world. Aiming to reject monodimensional explanations, we merge the «rhetoric of flaws» with the sensibility for «friction events» generated by and trough the encounters between transnational narratives and specific local (and cultural) settings. The concept of «vernacularization» helps us to conceive these interactions/intersections between global flows and punctual frictions. The sixth chapter introduces the main elements of the African context, starting from a sketched portrait of what we define its «radical normative pluralism». In order to cope with the complex reality of the African human rights system, we outline a historical (and political) description of the events that preceded the creation of the Organization for the African Unity, the institutional body which had the main responsibility in the consolidation of the system itself. We also examine various "legal" precedents (the so-called Lagos Law, the Universal Declaration of the Rights of Peoples and so on) which influenced the elaboration of the African Charter with their moral and political authority. Whit the seventh chapter we finally land the heart of our topic: the narrative analysis of the African Charter of Human and Peoples' Rights. After a quick identification of the focal features of the document, we approach the meaningful core of the Charter: the organic/holistic relationship between individual human rights and collective dimension of peoples' (human) rights. We split our investigation in two different but related paths: the individual/people pole and the rights/duties pole, assuming they are two dissimilar strategies to arrange this underlying "cohabitation". We also draw to several pronunciations of the African Commission of human and peoples' rights exploring the potential meanings of people and peoples' rights to clarify the official/institutional position on the subject. Anthropological and sociological studies on the ongoing modifications of collective frames of reference (the family, the ethnic group and other strategies of kinship allegiance) in contemporary Africa are employed to complete our inquiry. In the eighth chapter we (temporary) leave the African Charter in favor of other documents and protocols produced by the African system, strictly related to the «culture variable»: the Pan-African Cultural Manifesto, the Cultural Charter for Africa and the Charter for African Cultural Renaissance. After that, we approach three other texts more engaged on the promotion and protection of human rights for specific categories of people: the African Charter on the rights and welfare of the child, the Protocol to the African Charter on human and peoples' rights on the rights of women in Africa and the African Youth Charter. Our aim is to show how cultural assumptions about the subjects concerned shape or influence the normative prescriptions designed to protect them. The ninth chapter, finally, outlines a general evaluation of our analytical model trough the exploration of its weakness and its points of strength. It shows the hermeneutical advantages provided by the «gius-narrative» key, which enabled us to trace and emphasize the links between myths and foundational narratives of social groups and theirs normative constructions. It also stresses the need for a cultural study of social life of human rights, to (try to) grasp the many faces that the struggle for human rights is showing in its continuous spread around the world.
La ricerca si propone di definire le linee guida per la stesura di un Piano che si occupi di qualità della vita e di benessere. Il richiamo alla qualità e al benessere è positivamente innovativo, in quanto impone agli organi decisionali di sintonizzarsi con la soggettività attiva dei cittadini e, contemporaneamente, rende evidente la necessità di un approccio più ampio e trasversale al tema della città e di una più stretta relazione dei tecnici/esperti con i responsabili degli organismi politicoamministrativi. La ricerca vuole indagare i limiti dell'urbanistica moderna di fronte alla complessità di bisogni e di nuove necessità espresse dalle popolazioni urbane contemporanee. La domanda dei servizi è notevolmente cambiata rispetto a quella degli anni Sessanta, oltre che sul piano quantitativo anche e soprattutto sul piano qualitativo, a causa degli intervenuti cambiamenti sociali che hanno trasformato la città moderna non solo dal punto di vista strutturale ma anche dal punto di vista culturale: l'intermittenza della cittadinanza, per cui le città sono sempre più vissute e godute da cittadini del mondo (turisti e/o visitatori, temporaneamente presenti) e da cittadini diffusi (suburbani, provinciali, metropolitani); la radicale trasformazione della struttura familiare, per cui la famiglia-tipo costituita da una coppia con figli, solido riferimento per l'economia e la politica, è oggi minoritaria; l'irregolarità e flessibilità dei calendari, delle agende e dei ritmi di vita della popolazione attiva; la mobilità sociale, per cui gli individui hanno traiettorie di vita e pratiche quotidiane meno determinate dalle loro origini sociali di quanto avveniva nel passato; l'elevazione del livello di istruzione e quindi l'incremento della domanda di cultura; la crescita della popolazione anziana e la forte individualizzazione sociale hanno generato una domanda di città espressa dalla gente estremamente variegata ed eterogenea, frammentata e volatile, e per alcuni aspetti assolutamente nuova. Accanto a vecchie e consolidate richieste – la città efficiente, funzionale, produttiva, accessibile a tutti – sorgono nuove domande, ideali e bisogni che hanno come oggetto la bellezza, la varietà, la fruibilità, la sicurezza, la capacità di stupire e divertire, la sostenibilità, la ricerca di nuove identità, domande che esprimono il desiderio di vivere e di godere la città, di stare bene in città, domande che non possono essere più soddisfatte attraverso un'idea di welfare semplicemente basata sull'istruzione, la sanità, il sistema pensionistico e l'assistenza sociale. La città moderna ovvero l'idea moderna della città, organizzata solo sui concetti di ordine, regolarità, pulizia, uguaglianza e buon governo, è stata consegnata alla storia passata trasformandosi ora in qualcosa di assai diverso che facciamo fatica a rappresentare, a descrivere, a raccontare. La città contemporanea può essere rappresentata in molteplici modi, sia dal punto di vista urbanistico che dal punto di vista sociale: nella letteratura recente è evidente la difficoltà di definire e di racchiudere entro limiti certi l'oggetto "città" e la mancanza di un convincimento forte nell'interpretazione delle trasformazioni politiche, economiche e sociali che hanno investito la società e il mondo nel secolo scorso. La città contemporanea, al di là degli ambiti amministrativi, delle espansioni territoriali e degli assetti urbanistici, delle infrastrutture, della tecnologia, del funzionalismo e dei mercati globali, è anche luogo delle relazioni umane, rappresentazione dei rapporti tra gli individui e dello spazio urbano in cui queste relazioni si muovono. La città è sia concentrazione fisica di persone e di edifici, ma anche varietà di usi e di gruppi, densità di rapporti sociali; è il luogo in cui avvengono i processi di coesione o di esclusione sociale, luogo delle norme culturali che regolano i comportamenti, dell'identità che si esprime materialmente e simbolicamente nello spazio pubblico della vita cittadina. Per studiare la città contemporanea è necessario utilizzare un approccio nuovo, fatto di contaminazioni e saperi trasversali forniti da altre discipline, come la sociologia e le scienze umane, che pure contribuiscono a costruire l'immagine comunemente percepita della città e del territorio, del paesaggio e dell'ambiente. La rappresentazione del sociale urbano varia in base all'idea di cosa è, in un dato momento storico e in un dato contesto, una situazione di benessere delle persone. L'urbanistica moderna mirava al massimo benessere del singolo e della collettività e a modellarsi sulle "effettive necessità delle persone": nei vecchi manuali di urbanistica compare come appendice al piano regolatore il "Piano dei servizi", che comprende i servizi distribuiti sul territorio circostante, una sorta di "piano regolatore sociale", per evitare quartieri separati per fasce di popolazione o per classi. Nella città contemporanea la globalizzazione, le nuove forme di marginalizzazione e di esclusione, l'avvento della cosiddetta "new economy", la ridefinizione della base produttiva e del mercato del lavoro urbani sono espressione di una complessità sociale che può essere definita sulla base delle transazioni e gli scambi simbolici piuttosto che sui processi di industrializzazione e di modernizzazione verso cui era orientata la città storica, definita moderna. Tutto ciò costituisce quel complesso di questioni che attualmente viene definito "nuovo welfare", in contrapposizione a quello essenzialmente basato sull'istruzione, sulla sanità, sul sistema pensionistico e sull'assistenza sociale. La ricerca ha quindi analizzato gli strumenti tradizionali della pianificazione e programmazione territoriale, nella loro dimensione operativa e istituzionale: la destinazione principale di tali strumenti consiste nella classificazione e nella sistemazione dei servizi e dei contenitori urbanistici. E' chiaro, tuttavia, che per poter rispondere alla molteplice complessità di domande, bisogni e desideri espressi dalla società contemporanea le dotazioni effettive per "fare città" devono necessariamente superare i concetti di "standard" e di "zonizzazione", che risultano essere troppo rigidi e quindi incapaci di adattarsi all'evoluzione di una domanda crescente di qualità e di servizi e allo stesso tempo inadeguati nella gestione del rapporto tra lo spazio domestico e lo spazio collettivo. In questo senso è rilevante il rapporto tra le tipologie abitative e la morfologia urbana e quindi anche l'ambiente intorno alla casa, che stabilisce il rapporto "dalla casa alla città", perché è in questa dualità che si definisce il rapporto tra spazi privati e spazi pubblici e si contestualizzano i temi della strada, dei negozi, dei luoghi di incontro, degli accessi. Dopo la convergenza dalla scala urbana alla scala edilizia si passa quindi dalla scala edilizia a quella urbana, dal momento che il criterio del benessere attraversa le diverse scale dello spazio abitabile. Non solo, nei sistemi territoriali in cui si è raggiunto un benessere diffuso ed un alto livello di sviluppo economico è emersa la consapevolezza che il concetto stesso di benessere sia non più legato esclusivamente alla capacità di reddito collettiva e/o individuale: oggi la qualità della vita si misura in termini di qualità ambientale e sociale. Ecco dunque la necessità di uno strumento di conoscenza della città contemporanea, da allegare al Piano, in cui vengano definiti i criteri da osservare nella progettazione dello spazio urbano al fine di determinare la qualità e il benessere dell'ambiente costruito, inteso come benessere generalizzato, nel suo significato di "qualità dello star bene". E' evidente che per raggiungere tale livello di qualità e benessere è necessario provvedere al soddisfacimento da una parte degli aspetti macroscopici del funzionamento sociale e del tenore di vita attraverso gli indicatori di reddito, occupazione, povertà, criminalità, abitazione, istruzione, etc.; dall'altra dei bisogni primari, elementari e di base, e di quelli secondari, culturali e quindi mutevoli, trapassando dal welfare state allo star bene o well being personale, alla wellness in senso olistico, tutte espressioni di un desiderio di bellezza mentale e fisica e di un nuovo rapporto del corpo con l'ambiente, quindi manifestazione concreta di un'esigenza di ben-essere individuale e collettivo. Ed è questa esigenza, nuova e difficile, che crea la diffusa sensazione dell'inizio di una nuova stagione urbana, molto più di quanto facciano pensare le stesse modifiche fisiche della città. ; The research aims to define guidelines for the preparation of a plan that deals with quality of life and well-being. The reference to the quality and well-being is positively innovative, because imposes to organs of the government to relate with the subjectivity of active citizens and, at the same time, makes clear the need for a broader and transversal approach to the city and a more close relationship of technicians/experts with the leaders of political and administrative bodies. The research investigates the limits of modern town-planning theory in front of the complexity of new needs expressed by contemporary urban populations. The demand for services has changed significantly compared to that one of the Sixties, not only on the quantity but also and especially in terms of quality, because of the social changes that have transformed the modern city, from the point of view of the structure and the cultural request: the intermittent citizenship, so cities are increasingly experienced and enjoyed by citizens of the world (tourists and/or visitors, temporarily present) and popular citizens (suburban, provincial, metropolitan); radical transformation of the family structure, so the family-type consisting of a couple with children, solid benchmark for the economy and politics, is now minority; the irregularity and flexibility of calendars, diaries and rhythms of life of the population active, and social mobility, so individuals have trajectories of life and daily practices less determined by their social origins of what happened in the past; the elevation of the level of education and thus the increase in demand for culture; the growth of elderly population and the strong social individualism have generated a demand for the city expressed by the people extremely varied and diverse, fragmented and volatile, and in some aspects quite new. Close to old and consolidated requests - the city efficient, functional, productive, accessible to all - there are new questions, ideals and needs such as beauty, variety, usability, security, the ability to amaze and entertain, sustainability, the search for new identities, questions that express a desire to live and enjoy the city, to fell good into the city, questions that can no longer be satisfied through a welfare simply based on education, health, pension system and social security. The modern city or the modern idea of the city, based only on the concepts of order, regularity, cleaning, equality and good governance was handed over to the past history turning into something very different hard to represent, describe, tell. The contemporary city can be represented in many different ways, both on town-planning way and social way: in the recent literature there is the obvious difficulty of defining and enclose within certain limits the subject "city" and the lack of a strong belief in the interpretation of political, economic and social transformations that have invested society and the world in the last century. The contemporary city, beyond the administrative areas, territorial expansion and urban structures, infrastructure, technology, functionalism and global markets, is also a place of human relations, representation of the relationship between individuals and urban spaces where these relationship move. The city is both physical concentration of people and buildings, but also variety of uses and groups, it's the place of dense social relations where processes of cohesion or social exclusion occur, a place of cultural norms that govern behaviour and identity, expressed physically and symbolically through public spaces of city life. It's necessary a new approach to study the contemporary city, made up of cross-contamination and knowledge provided by other disciplines such as sociology and human sciences, which help to build the image commonly known of the city and the territory, landscape and environment. The representation of the urban social life varies according to what it is considered, in a specific historic moment and in a given context, a situation of well-being. The modern town-planning aimed at maximum level of well-being for individuals and communities, modelling on "real needs of people": in the old urban systems manuals appears a "Plan of services" as an appendix to the master plan, which includes services distributed on the surrounding areas, a sort of "social master plan" to avoid neighborhoods separated by segments of population or classes. In the contemporary city globalization, new forms of marginalization and exclusion, the advent of the so-called "new economy", the re-definition of the production base and the labour market are urban expression of a social complexity that can be defined trough transactions and symbolic exchanges, rather than trough processes of industrialization and modernization towards which the historic city, adopted modern, was oriented. All of this questions are the expression of that complex of matters which are currently described as "the new welfare", opposed to the one essentially based on education, on health, on the pension system and on social assistances. The research has therefore examined the traditional tools of town-planning and territorial programming in their operational and institutional dimension: the main destination of these instruments is the classification and accommodation of services and urban containers. It's evident, however, that in order to answer to the many questions of complexity, needs and desires expressed by contemporary society the actual allocations to "make city" must necessarily overcome the concepts of "standards" and "zoning" that are too rigid and unable to adapt to a growing demand for quality and services and at the same time inadequate to manage the relationship between collective space and domestic space. In this sense it is important to consider the relationship between housing types and urban morphology and hence the environment around the house, which establishes the relationship "from the house to the city" because it is in this duality that it is possible to define the relationship between private domestic spaces and public spaces and contextualize questions of roads, shops, meeting places, accesses. After the convergence from the wide urban scale construction to the architectural scale, the attention moves from the architectural scale to the scale of urban constructions, since the criterion of well-being goes through the different scales of habitable space. Moreover, in territorial systems with a widespread well-being and a high level of economic development there's an emerging awareness that the very concept of well-being is no longer linked only to the ability of collective and/or individual income: today the quality of life is measured in terms of environmental quality and social inclusion. Thus the need of an instrument of knowledge of the contemporary city to be attached to the Plan, containing criteria to be observed in the design of urban spaces in order to determine the quality and well-being, in the meaning of "quality of feeling good", of urban environment. Obviously, to reach quality and well-being it is necessary to satisfy macroscopic aspects of social functioning and living standards, through the indicators of income, employment, poverty, crime, housing, education, etc., and also first needs, basic and elementary, and secondary, cultural and changing, moving through the welfare state to a general feeling of well-being, to wellness in a holistic sense, all expressions of a desire for mental and physical beauty and a new relationship of the body with the environment, then real expression of a need for an individual and collective wellbeing. And it is this need, new and difficult, which creates the widespread feeling of a starting new urban season, much more than physical changes of the city could represent.
Il lavoro è volto a mettere in luce le problematiche connesse all'attività delle imprese multinazionali e alla sussistenza in capo alle stesse di una responsabilità sociale internazionale (RSI). Nell'attuale panorama economico e politico mondiale, caratterizzato dalla globalizzazione e dalla stretta interdipendenza dei mercati, dalla sempre più frequente internazionalizzazione dei processi produttivi e aziendali e dalla contestuale operatività delle società in più Paesi, dalla accresciuta consapevolezza del consumatore circa il rispetto, nei processi produttivi, di istanze ritenuti fondamentali dalla società civile, come i diritti fondamentali dell'uomo e dei lavoratori o la protezione dell'ambiente, l'impresa multinazionale assume un ruolo fondamentale sia nell'indirizzare i trends economici globali (si pensi al fatto che alcune società hanno profitti superiori al PIL di buona parte degli Stati della comunità internazionale); la configurazione di una responsabilità sociale in capo a tali società vuol dire mescolare la libertà di impresa e il libero mercato con l'etica. La necessità di inserire la questione dell'etica negli affari nasce, dunque, dalla convinzione - sempre più diffusa in ambito internazionale e nazionale - che l'attenzione dell'impresa verso le istanze sociali, ambientali ed etiche delle comunità umane costituisca una condizione imprescindibile per uno sviluppo durevole e sostenibile. In tale prospettiva, dunque, il concetto di responsabilità sociale d'impresa richiama le imprese a considerare attentamente - nella definizione della propria strategia, nell'articolazione delle politiche e nelle procedure gestionali quotidiane - gli interessi diffusi della collettività, nonché l'impatto delle proprie attività, non solo in termini economici, ma anche sociali, ambientali ed etici. La responsabilità sociale rappresenta, quindi, per l'impresa uno strumento utile ed efficace per rispondere alle istanze e alle esigenze della società civile. Con la RSI nasce quindi una teoria di impresa che vede la produzione di beni non solo come strumento di profitto ma anche come occasione di realizzazione del benessere sociale; lo stesso operato dell'impresa inizia ad essere valutato globalmente non solo in rapporto ai risultati economici della stessa ma anche in base alla qualità del prodotto, alla qualità dell'ambiente lavorativo e alle istanze ambientali, seconda i dettami di quella scuola di pensiero del cd. business ethics per cui le imprese sono chiamate a compiere azioni che contribuiscano ad eliminare e prevenire le iniquità sociali e a promuovere lo sviluppo della collettività. Tale necessità è stata anche consequenziale a comportamenti ed abusi messi in atto dalle società transnazionali che hanno arrecato gravi danni alle comunità umane degli Stati ospiti delle attività produttive. Gli abusi commessi dalle imprese, non sempre riconducibili a precise violazioni degli ordinamenti nazionali, sono stati progressivamente interpretati e costruiti come violazioni o mancanze nei confronti di un complesso di principi definiti come appartenenti ad una ampia sfera di responsabilità sociale internazionale dell'impresa, che implica la perdita di reputazione e, quindi, la possibile riduzione delle sue quote sul mercato qualora gli stakeholders più interessati riescano a mobilitare l'opinione pubblica su larga scala. Fin dagli anni '70, diverse organizzazioni internazionali hanno iniziato ad occuparsi della regolamentazione dell'attività delle imprese transnazionali, evidenziando il ruolo che le imprese multinazionali sono chiamate a rivestire nei processi di tutela dei diritti umani e dell'ambiente che emergono nello svolgimento delle loro attività economiche; appare evidente come sia basilare, nel piano dell'opera, definire l'impresa multinazionale, analizzando i diversi strumenti adottati dalle organizzazioni internazionali e i contributi dottrinali in materia, alla luce dei quali sembra potersi dire che il carattere di "multinazionalità" o "transnazionalità" è dato dalla presenza di diverse unità operative, dislocate in più Paesi, che si trovano sotto il controllo (azionario o di gestione) di un'unica società holding; tale distinzione tra unità operative si estende fino al profilo giuridico, in quanto le singole consociate sono autonomi soggetti di diritto sottoposti, relativamente ai profili della regolamentazione e della costituzione, all'ordinamento giuridico dello Stato di nazionalità. Ciò spesso comporta che le società scelgano come sede un Paese sulla base della convenienza che ciascuno di essi offre in relazione al trattamento fiscale, al costo della manodopera e delle materie prime, alla regolamentazione in materia di protezione dell'ambiente. Sembra quindi necessario un tentativo di regolamentazione da parte di organismi sovranazionali, a fronte del numero sempre maggiore di imprese operanti in più mercati (più di 80.000 società con circa 900.000 società sussidiarie), al loro peso economico e occupazionale (si stimano circa 80.000.000 di posti di lavoro) e a seguito di numerosi episodi che hanno coinvolto tali imprese dagli anni '70 ad oggi, come nei casi della Drummond o della Del Monte, accusate di gravi repressioni dei diritti sindacali e sociali dei lavoratori, o della Chevron/Texaco e della Union Carbride, responsabili di disastri ambientali tra cui quello di Bophal, in India, fino al caso, recentissimo, del disastro ambientale causato dalla piattaforma Deepwater Horizon al largo delle coste della Florida e della Louisiana tra il 2010 e il 2011, o i casi di violazioni dei diritti umani e commissione di crimini internazionali (arresti arbitrari, torture, violenze sessuali, trattamenti inumani e degradanti), commesse da società transnazionali operanti nel settore estrattivo e minerario in Africa e nel Sud Est Asiatico, commessi direttamente o a mezzo di milizie assoldate per la protezione degli impianti. L'attività delle Organizzazioni internazionali, a partire dagli anni '70, si è focalizzata sul tema; l'OCSE, l'Organizzazione internazionale del lavoro, la Camera di Commercio internazionale hanno adottato in quegli anni raccomandazioni e dichiarazioni rivolte agli Stati membri e alle imprese per l'adesione a certi principi e diritti già sanciti da altri strumenti convenzionali; le Nazioni Unite, prima attraverso l'attività della Commissione sulle imprese multinazionali e poi della Sottocommissione per la protezione e promozione dei diritti umani, si sono occupate della materia, giungendo alla elaborazione di un Codice di condotta per le imprese multinazionali (mai adottato) e di Norme sulla responsabilità delle imprese multinazionali e altre imprese in relazione ai diritti umani, che si affiancano alla partnership pubblico-privata del Global Compact. Ancora, anche altre organizzazioni internazionali, come l'Organizzazione mondiale della sanità, l'OMC, la Banca mondiale, l'International Standard Organisation, hanno adottato atti che invitano le imprese a svolgere la propria attività produttiva nel pieno rispetto dei diritti fondamentali della persona, delle comunità locali e dell'ambiente, e quindi prendendo in considerazione non solo interessi e diritti dei soci ma di tutti i soggetti a vario titolo coinvolti o toccati dall'attività aziendale. In ultimo, è il lavoro del Rappresentante Speciale del Segretario Generale ONU John Ruggie ad elaborare un quadro normativo (denominato Protect, Respect, Remedy) generale relativo al rapporto tra business e diritti umani. La caratteristica degli strumenti analizzati è la loro natura non vincolante, quindi meramente esortativa e ad applicazione volontaria. Tale situazione si ricollega sostanzialmente a due ragioni: la discussa soggettività internazionale delle imprese multinazionali e le opposte visioni dei Governi in materia (con evidenti difformità di vedute tra Paesi in via di sviluppo e Paesi industrializzati). Riguardo alla soggettività delle imprese multinazionali, ovvero lo status di essere titolari di diritti e obblighi nascenti dal diritto internazionale, la dottrina internazionalistica è fortemente divisa. Secondo un primo orientamento, le IMN non sarebbero soggetti di diritto internazionali in quanto sono solo destinatarie di norme, e quindi "oggetto" del diritto internazionale; sarebbero soggette solo alla giurisdizione dello Stato, e vincolate dal diritto internazionale solamente in virtù del richiamo da parte dell'ordinamento giuridico interno. Dagli anni '60, inizia a farsi largo un diverso filone dottrinale che, partendo dal noto parere della Corte internazionale di giustizia Reparations for Injuries, considera l'impresa quale soggetto di diritto internazionale, in virtù di una serie di diritti e obblighi che le vengono attribuiti dal diritto internazionale, soprattutto in materia di investimenti e di contratti internazionali (tra tutti, il diritto di adire un'istanza arbitrale o giurisdizionale a carattere arbitrale). Inoltre, la costante attenzione per l'attività delle IMN da parte delle Organizzazioni internazionali, potrebbe testimoniare la nascente opinio juris di conferire una, seppur limitata, soggettività internazionale alle imprese. Dall'analisi della prassi internazionale si sono tratte conclusioni provvisorie, in particolare che l'impresa, soprattutto nel settore del diritto economico e degli investimenti, possegga una personalità giuridica internazionale limitata e soprattutto derivata dalla volontà degli Stati, ma soprattutto funzionale, poiché contenuta nei limiti stabiliti dal trattato internazionale (BITs) o del contratto internazionale che stabilisce diritti e obblighi per la stessa. Negli ultimi anni anche l'Unione Europea ha iniziato a promuovere una adesione delle imprese ai valori fondamentali dei diritti dell'uomo, dei lavoratori e dello sviluppo sostenibile. A partire dal Libro Verde del 2001, l'UE ha elaborato progressivamente una strategia europea per la responsabilità sociale di impresa, qualificata come adozione spontanea di prassi volte a contribuire al miglioramento della società e alla qualità dell'ambiente. La strategia dell'UE si caratterizza per avere una dimensione sia interna all'impresa, stabilendo una serie di programmi d'azione e l'adozione di sistemi di gestione dei processi produttivi, sia esterna alla stessa, prevedendo il coinvolgimento di comunità locali, partner commerciali, clienti, fornitori, ONG, autorità statali. A tali fini, l'UE lanciò una serie di iniziative, quali i sistemi EMAS e ECOLABEL di certificazione ecologica e di audit ambientale, il Multistakeholders' forum, per formare un quadro giuridico regolamentare in materia di appalti pubblici e sostenibilità ambientale, di tutela del consumatore, di pubblicità ingannevole, nonché l'adozione di codici di condotta settoriali, ispirato ai principi della RSI. L'attività di regolamentazione della RSI ha ricevuto un contributo dalle stesse imprese multinazionali, nel senso di una autoregolamentazione delle proprie attività, attraverso dei codici di condotta autonomamente adottati dalla singola impresa in funzione delle proprie strategie e valori. Tali codici si distinguono nettamente dalle linee guida adottate dalle Organizzazioni internazionali perché in essi l'impresa si fa creatrice e destinataria di norme, create non perché la necessità provenga dal diritto, ma dall'interesse dell'impresa (che, in molti casi, si caratterizza per essere meramente reputazionale). Tali codici, di chiara natura volontaristica, garantiscono il rispetto degli standard di tutela e di promozione dei principi in esso contenuti, stabilendo il più delle volte un meccanismo di monitoraggio e controllo del rispetto delle norme in esso contenute, meccanismo che può essere a carattere interno (gestito quindi da un ufficio interno all'impresa) o a carattere esterno (gestito, il più delle volte, da una ONG o da un sindacato). Infine, la ricerca si conclude con l'analisi dei principali temi che riguardano la RSI negli ultimi anni, ovvero quelli relativi ai profili di responsabilità delle imprese per violazione dei diritti fondamentali e per danni ambientali (con particolare riguardo alla disciplina statunitense contenuta nell'Alien Torts Statute), con particolare riferimento agli obblighi internazionali che incombono sugli Stati attraverso la ricostruzione della prassi internazionale. Inoltre, ulteriore profilo di studio è quello che si concentra sulla possibile estensione della giurisdizione dei tribunali internazionali per crimini internazionali alle persone giuridiche, con particolare riguardo ai lavori preparatori della Conferenza di Roma che ha portato all'istituzione della Corte Penale Internazionale. In conclusione, oggetto della ricerca è stato la ricostruzione del concetto di RSI, il quale è un prodotto degli ordinamenti nazionali ed in particolare degli ordinamenti giuridici degli Stati industrializzati, identificando un framework giuridico che include strumenti normativi di varia natura e in svariati settori, come quelli che disciplinano le società commerciali; le normative nazionali di prevenzione e repressione della corruzione; le normative del settore finanziario ed in particolare quelle sulle borse valori; le discipline a tutela del lavoro, dell'ambiente e del consumatore. Negli Stati più avanzati dal punto di vista economico e istituzionale la RSI, dunque, non è codificata in uno specifico settore regolamentare ma rappresenta un sistema complesso di normative che regolano i diversi aspetti di quelle attività di impresa; nei PVS, invece, tali normative sono spesso frammentarie o addirittura assenti: questa situazione ha permesso alle IMN di avvantaggiarsi dei vuoti legislativi o delle regole stringenti presenti in questi Paesi. Appare evidente come la comunità internazionale abbia constatato la necessità di regolare l'attività delle imprese multinazionali, per la promozione e la protezione dei propri valori fondamentali e di uno sviluppo in un'ottica di sostenibilità ambientale, nell'intenzione di creare un quadro giuridico internazionale che permetta alle imprese di perseguire le proprie finalità aziendali senza perdere di vista le esigenze collettive (in particolare dei Paesi in cui operano). Per raggiungere tale obiettivo, appare inevitabile un'evoluzione del diritto internazionale vigente, i cui processi di formazione, gestiti sostanzialmente dai Governi, non possono non tenere conto dell'accresciuto ruolo e peso delle IMN e della società civile. ; In today's economic and political world characterized by globalization and interdependence of markets, by an increasingly internationalization of production processes and by business operations of the company conducted simultaneously in several countries, by an increased consumer awareness regarding compliance of production processes to values that are considered essential by civil society, as fundamental human rights and labour and environmental protection, MNEs have a fundamental role in addressing the global economic trends. In this perspective, then, the concept of corporate social responsibility attracts companies to consider carefully - in the definition of its strategy and in the articulation of policies and procedures daily management - the various interests of the community, as well as the impact of its activities, not only in economic terms but also in social, environmental and ethical issues. Social responsibility is, therefore, a useful tool for the enterprise and effective way to respond to the needs and demands of civil society.With the CSR arises, therefore, a theory of business that sees the production of goods not only as a means of profit, but also as an opportunity for the realization of social welfare, as dictated bythe school of thought of thebusiness ethics, which invite companies to take action in orderto eliminate and prevent social inequities and promote community development. This need was also consequential to the abusescommitted by transnational corporations that have caused serious damage to human communities of their host countries. Abuses committed by companies, not always related to specific violations of national laws, have been gradually interpreted and constructed as a violation or misconduct against a set of principles defined as belonging to a broad spectrum of social responsibility international, which implies loss of reputation and, therefore, the possible reduction of its share on the market where the key stakeholders concerned can mobilize public opinion on a large scale. Since the 70s, several international organizations have begun to deal with the regulation of transnational corporations, highlighting the role that multinational corporations are called to play in the process of protection of human rights and of the environment that emerge in the course of their economic activity. Is fundamental for the work plan, define the multinational enterprise, by analysing the various instruments adopted by international organizations and doctrinal contributions on the subject, the light of which it seems possible to say that the character of "multinationality" or "transnationality" is the presence of various operating units, located in different countries, which are under the control (equity or management) of a single holding company; the distinction between operational units extends to the legal point of view, as the individual subsidiaries are independent legal entities subject, relatively to the profiles of the regulation and constitution, subjected to the legal system of the State of nationality. It often means that companies choose the host country on the basis of convenience that this country provides in relation to the tax treatment, labour costs and raw materials, to the rules on environmental protection. It therefore seems necessary to attempt to regulate multinational enterprises by supranational bodies, in relation to the increasing number of companies operating in multiple markets (more than 80,000 companies with about 900,000 subsidiaries), to their economic and employment (an estimated 80 million job opportunities) and following several incidents involving such companies from the '70s to today, as in the case of Drummond or Del Monte, accused of severe repression of trade union rights and social rights of workers, or Chevron/ Texaco and Union Carbide, responsible for environmental disasters including that of Bhopal, India, to the case of the environmental disaster caused by the Deepwater Horizon rig off the coast of Florida and Louisiana between 2010 and 2011, or cases of human rights violations and commission of international crimes (arbitrary detention, torture, rape, inhumane and degrading treatment) by transnational corporations operating in the mining industry in Africa and South East Asia, made directly or through the militias hired to the protection of plants. The activities of international organizations, from the 70s, focused on the theme, the OECD, the International Labour Organization, the International Chamber of Commerce adopted in those years, recommendations and declarations addressed to the Member States and the companies for adherence to certain principles and rights already provided by other conventional instruments; also the United Nations, first through the work of the Committee on Multinational Enterprises and then through the subcommittee for the protection and promotion of human rights, have dealt with the matter, coming to the elaboration of a Code of Conduct for Multinational Enterprises (never adopted) and rules on the responsibilities of transnational corporations and other business enterprises with regard to human rights, alongside to the public-private partnership of the Global Compact. Still, other international organizations such as the World Health Organization, the WTO, the World Bank, the International Standards Organization (which as a private nature), have taken actions that invite businesses to carry out its production activities in full respect of fundamental human rights, of local communities needs and of the environment, and then taking into account not only the interests and rights of the shareholders but to all those involved in various ways affected the activity or business. Finally, it is the work of the Special Representative of the UN Secretary-General John Ruggie to develop a framework (called Protect, Respect, Remedy) concerning the relationship between business and human rights. The characteristic of the analysed tools is their non-binding nature, then merely hortatory and voluntary application. This situation is linked mainly to two reasons: the disputed international subjectivity of multinational enterprises and the opposing views of Governments on the subject (with obvious differences of views between developing countries and industrialized countries). Regard to the subjectivity of transnational corporations, or the status of being holders of rights and obligations arising from international law, international legal theory is strongly divided. According to one view, MNEs would not be subject to international law as they are only recipients of rules, and then the "object" of international law would be subject only to the jurisdiction of the state, and bound by international law only by virtue of the reference made by the domestic legal system. Since the '60s, a different doctrinal trend began to make his way starting from the known opinion Reparations for Injuries of the International Court of Justice, and then considering the company as a subject of international law, by virtue of a series of rights and duties which are assigned to it by international law, especially in the field of investment and international contracts (among them, the right to appeal an arbitration tribunal or judicial character arbitration). In addition, the constant attention to the activities of MNEs by international organizations, could witness the nascent opiniojuris to give ainternational subjectivity to businesses, albeit limited. An analysis of international practice have taken provisional findings, in particular that the company, especially in the field of economic law and investment, possesses an international limitedlegal personality and mainly derived from the will of the States, but above all functional, as contained in limits established by international treaty (BITs) or international agreement that establishes rights and obligations for the same. In recent years the European Union has begun to promote adhesion of the companies core values of human rights, labour standards and sustainable development. From the Green Paper of 2001, the EU has developed progressively a European strategy for corporate social responsibility, described as spontaneous adoption of practices to contribute to the improvement of society and the quality of the environment. The EU strategy is characterized by having an internal dimension to the company, establishing a series of action programs and the adoption of management systems, processes, and external to it, calling for the involvement of local communities, commercial partners, customers, suppliers, NGOs, state authorities. To this end, the EU launched a series of initiatives, such as EMAS and Ecolabel certification ecological and environmental audit, the multi-stakeholder forum, to form a legal framework to regulate public procurement and environmental sustainability, protection of consumer, misleading advertising, and the adoption of sectorial codes of conduct based on the principles of CSR. The regulatory activities of CSR has received a grant from the multinational enterprises themselves, in the sense of a self-regulation of their activities, through codes of conduct adopted by each company independently according to their own strategies and values. These codes can be clearly distinguished from the guidelines adopted by international organizations because in them the company is the creator and recipient of rules, created not because the need comes from the law, but by the company (which, in many cases, characterized by being merely reputational). These codes, clearly voluntary, ensure compliance with standards for the protection and promotion of the principles contained therein, setting most of the time a mechanism for monitoring and enforcement of the rules it contains, a mechanism that may be internal character (then managed by an office inside the company) or external character (managed, in most cases, an NGO, or a trade union). Finally, the research concludes with an analysis of the main issues concerning CSR in recent years, namely those related to the profiles of corporate responsibility for violation of fundamental rights and environmental damage (especially with regard to U.S. regulations contained in the Alien Tort Statute), with particular reference to international obligations on states through the reconstruction of the international practice. In addition, further study is to profile that focuses on the possible extension of the jurisdiction of international tribunals for crimes under international law to legal persons, with particular reference to the drafting history of the Rome Conference that led to the establishment of the International Criminal Court. In conclusion, the object of the research was the reconstruction of the concept of CSR, which is a product of national law and in particular the legal systems of the industrialized countries, identifying a legal framework that includes legal instruments of various types and in various sectors, such as those governing commercial companies, national regulations for the prevention and combating of corruption; regulations of the financial sector and in particular those on stock exchanges; disciplines to protect labour, the environment and the consumer. In the most advanced in terms of economic and institutional CSR, therefore, is not encoded in a specific sector regulation but it is a complex system of regulations governing various aspects of the business activities, in developing countries, however, these rules are often fragmentary or even absent: this situation has allowed MNCs to take advantage of loopholes in the law or stringent rules present in these countries. It is evident that the international community has identified the need to regulate the activities of multinational enterprises, for the promotion and protection of its fundamental values and development in a sustainable environment, with the intention to create an international legal framework that allows companies to pursue their own business purposes without losing sight of the collective needs (in particular in the countries in which they operate). To achieve this goal, it is inevitable evolution of international law, whose formation processes, managed largely by governments, cannot fail to take into account the increased role and weight of MNEs and civil society. ; Dottorato di ricerca in Persona, impresa e lavoro: dal diritto interno a quello internazionale (XXV ciclo)
