A partire da tale inquadramento sono state individuate e trattate alcune tipologie di potenziamento, utilizzando un approccio metodologico medico sociale ed approfondendo ciascuna tematica sotto il profilo sia dottrinario sia giurisprudenziale. Risultati: Doping, chirurgia estetica e divieto di selezione eugenetica sono tecniche già disciplinate. Smart drugs e deep brain stimulation sono tecniche già disciplinate per utilizzo a scopo terapeutico, ma talvolta il loro utilizzo esula dalla cura di patologie. Potenziamento militare e Potenziamento biologico sono tecniche in fase sperimentale. Di ciascuna di esse sono state rappresentate le peculiari difficoltà nell'identificazione dei limiti di liceità. Results: Doping, cosmetic surgery and prenatal genetic enhancement's prohibition are techniques already disciplined. Smart drugs and deep brain stimulation are techniques already disciplined for therapeutic purpose, but sometimes their application lies outside the disease's therapy. We have represented the particular difficulties inidentifying the limits of lawfulness of each of these typologies of enhancement. Conclusions: We could hypothesize a 'case by case' law's approach, because it's ductile and able to adapt on the peculiar characteristics of every single form of enhancement, evaluating at the same time political, legal, ethical, social and safety impact, in a context of inhomogeneity of the Human Enhancement Technologies that it doesn't allow an uniform normative framework able to fully satisfy individual and collective needs.
ANTECEDENTES: La mejora humana es una modificación destinada a mejorar las características y capacidades humanas a través de intervenciones científicas o tecnológicas en el cuerpo humano, comenzando desde una "condición de integridad" y no desde un estado de enfermedad. Por lo tanto, debemos valorar si la mejora es perjudicial para la dignidad humana o si es una herramienta útil para mejorar la condición de la vida humana. MÉTODOS: En un principio nos centramos en la investigación bibliográfica dedicada a la clasificación de la HE a través del análisis de las definiciones de salud y mejora, confrontando la perspectiva biojurídica como, por ejemplo, los posibles efectos negativos sobre la dignidad, identidad, libertad, igualdad de una persona; y comparar teorías científicas y humanísticas. Posteriormente examinamos en detalle el marco legal nacional y supranacional de los últimos diez años, desde el Estudio de Mejoramiento Humano de la Evaluación de Opciones Científicas y Tecnológicas hasta las opiniones del Comité Nacional de Bioética. A partir de esta clasificación localizamos y analizamos algunas tipologías de mejoramiento, utilizando un enfoque metodológico social médico y profundizando cada tema desde el perfil tanto doctrinario como jurisprudencial. RESULTADOS: El dopaje, la cirugía estética y la prohibición del mejoramiento genético prenatal son técnicas ya disciplinadas. Los fármacos inteligentes y la estimulación cerebral profunda son técnicas ya disciplinadas con fines terapéuticos, pero a veces su aplicación se encuentra fuera de la terapia de la enfermedad. La mejora militar y biológica son técnicas en fase experimental. Hemos representado las dificultades particulares para identificar los límites de legalidad de cada una de estas tipologías de mejora. Il potenziamento umano consiste in una modifica volta a migliorare la performance umana individuale attraverso interventi scientifici o tecnologici sul corpo umano. Esso si basa su tecniche volte a trasformare l'aspetto estetico, aumentare prestazioni sportive, fisiche, ed intellettuali, ed aumentare la capacità di lavoro. L'obiettivo del nostro studio è individuare i margini etici e giuridici, medico legali e medico sociali entro i quali inserire il potenziamento, considerando che il miglioramento è inevitabile in quanto gli esseri umani sono competitivi per natura ed il cambiamento è ragione principale della nostra evoluzione. Occorre pertanto valutare se il ricorrere a tecnologie di potenziamento sia lesivo della dignità umana oppure sia strumento utile a migliorare le condizioni di vita dell'uomo. In un primo momento si è proceduto alla ricerca bibliografica dedicata all'inquadramento dello HE mediante l'analisi terminologica entrando nel dibattito storico-evolutivo dei concetti di salute e di potenziamento, affrontando gli aspetti di pertinenza biogiuridica come ad esempio i possibili impatti negativi su dignità, identità, libertà ed uguaglianza, e mettendo a confronto teorie scientifiche ed umanistiche. In un secondo momento si è proceduto all'analisi dettagliata del quadro normativo nazionale e sovranazionale degli ultimi dieci anni, dallo Human Enhancement Study dello STOA ai pareri del Comitato Nazionale per la Bioetica. A partire da tale inquadramento sono state individuate e trattate alcune tipologie di potenziamento, utilizzando un approccio metodologico medico sociale ed approfondendo ciascuna tematica sia sotto il profilo dottrinario sia sotto il profilo giurisprudenziale: doping, chirurgia estetica e divieto di selezione eugenetica (tecniche già disciplinate); smart drugs e deep brain stimulation (tecniche già disciplinate per utilizzo a scopo terapeutico, ma talvolta il loro utilizzo esula dalla cura di patologie); potenziamento militare e potenziamento biologico (tecniche in fase sperimentale). Di ciascuna di esse sono state rappresentate le peculiari difficoltà nell'identificazione dei limiti di liceità associati a variabili di differenziazione, tra cui invasività, durata, reversibilità, trasmissibilità ai discendenti, etc. In particolare nell'ambito della Medicina Estetica,al fine di comprendere il fenomeno del Physical Enhancementnella sua concretezza quotidiana e di verificare se abbia effetti positivi o ricadute negative sull'equilibrio psico-fisico dell'individuo, è stata elaborata un'analisi casistica mediante redazione di un questionario. Alla luce di quanto esposto, risulta fondamentale che il diritto si tenga al passo con i tempi, così come è auspicabile che anche lo sviluppo frenetico delle ricerche scientifiche vada di pari passo con l'ossequio dei principi etici e giuridici di rispetto dell'essere umano. A tal fine si è tentato di dare un input per la realizzazione di una normativa generalizzata, in grado di soddisfare pienamente i bisogni individuali e collettivi, che disciplini lo Human Enhancement partendo dal presupposto inderogabile del rispetto dei diritti inviolabili, propri ed altrui, ed avente come ipotetico oggetto di tutela comune la salute, la sicurezza sociale, i costi economici gravanti sulla collettività.
We face an emerging range of technologies that can be applied to our human natures with the goal of enhancing us. There are nootropic smart drugs and gene editing that influence the development of the brain. The near future promises cybernetic technologies that can be grafted onto our brains and bodies. The challenge for readers of Dialogues on Human Enhancement is to decide how to respond to these and other coming enhancement technologies. As you read these dialogues you will meet passionate advocates for a variety of responses to enhancement tech, ranging from blanket rejection to ecstatic endorsement. You'll encounter Olen, for whom there is no such thing as too much enhancement. You'll meet Winston, a bioconservative who fiercely but also imaginatively opposes any human enhancement. And there is the moderate Eugenie, who strives to distinguish between enhancement technologies that should and should not be accepted. As these characters philosophically engage with each other they will benefit from the supervisory presence of Sophie, the philosopher. Abstract The article deals with the philosophical and ethical implications of transhumanism and human enhancement techniques. It considers how enhancement and therapy are two different types of biomedical intervention. It then looks at the implementation of these ideas in the military sector. It analyses various standpoints and views on transhumanism, the benefits and risks of using newly acquired scientific knowledge to improve and alter naturally deficient human nature. The need for ethical reflection and argumentation is emphasized; new scientific discoveries can dramatically change our experience of the world around us and may present a huge risk to mankind if left unchecked and not critically discussed. The article reflects on the dangers and risks of human enhancement and its possible consequences on the battlefield as well as the broader contexts and implications. The article also considers which criteria would be suitable to ensure beneficial and less controversial enhancements are carefully selected and to enable these to be distinguished from more dangerous practices that change the human body and/or mind. The aim is to consider and evaluate the possible benefits (positive consequences) and risks (negative consequences) of using enhancements for military purposes and to identify possible criteria for their justification and/or rejection.
This article deals with some uncertainties associated with human enhancement ethics. It presents the latter as a kind of a narrative made up of scientific and philosophical concepts. In the paper it is shown that scientific notions underpinning the human enhancement tendency are burdened with a substantial level of uncertainty, especially when the radical enhancement is considered. On the level of philosophical thinking, we encounter many unresolved questions concerning the understanding of the good and our post human destiny, namely who we want to become and why. This amounts to a high level of uncertainty. However, uncertainties are not utterly useless and destructive. They can play roles of stimulating factors or, at least, they can be helpful in discovering new horizons for our existence. In some situations they can also lead us to realize and appreciate what we possess already.
