تناولت هذه الدراسة موضوعاً في غاية الأهمية يتعلق بإشكاليات تنفيذ الأحكام القضائية الإدارية الصادرة ضد الإدارة. وتهدف الدراسة إلى التصدي لظاهرة امتناع الإدارة عن تنفيذ الأحكام القضائية الإدارية والحد من حالات حدوثها، في ظل عدم إمكانية القاضي الإداري التدخل في عمل الإدارة. وتقوم مسؤولية الإدارة والموظف المسؤول في حالة الامتناع عن تنفيذ الأحكام القضائية الإدارية كذلك وفي حالتي التراخي أو التباطؤ في التنفيذ، فالموظف يمكن تحريك دعوى جنائية ضده بموجب أحكام المادة (182) من قانون العقوبات الأردني، ويمكن إثارة مسؤوليته التأديبية من جهة الإدارة ذاتها وبالنتيجة ممكن أن تعاقبه تأديبياً لإخلاله بواجباته الوظيفية، كما أن الإدارة يمكن إثارة مسؤوليتها عن التأخير في تنفيذ الأحكام القضائية الإدارية ورفع دعوى ضدها أمام القضاء الإداري للمطالبة بالتعويض كما أن القضاء الإداري يمكن أن يحكم عليها إضافة للتعويض بإلغاء القرار الإداري السلبي الناتج عن الامتناع. ; Abstract Researcher address in this study was a very important subject related to a problematic implementation of administrative judicial rulings issued against the administration. The study aims to address the phenomenon of the administration's failure to implement judicial rulings and reducing administrative cases occur in administrative judge to intervene in the work administration. The responsibility of the management and the employee that responsible for implementation in case of refusal from implementation of the administrative judicial rulings and in case of inaction or slowdown it is possible to move a criminal claim against him under the provision of article (182) of the Jordan penal code, and its possible to raise his disciplinary responsibility from the department side itself, as result its possible to punish him in disciplinarian way for the breach of his duties. Also it is possible to raise the management responsibility for the delay in the implementation of the administrative judicial rulings and moving claim against them in front of administrative judiciary for asking a compensation also the administrative judiciary can be judged in addition to the compensation by canceling the negative administrative decision that result from the refusal. The present document contains the texts related to the Assembly of Heads of State and Government, the Executive Council, the Commission and the Permanent Representatives Committee as requested by the Lusaka Summit. These texts are the syn thesis of the outcome of the brainstorming session held on 13 and 14 October and chaired by myself, the informal briefing session of the European and Ethiopian Experts, the internal discussion within the two Sub-Committees were I set up and which were co-chaired by the Assistant-Secretaries General, the deliberations of the meeting of the Coordination Committee which I chaired on 23 and 24 November and in which the Assistant-Secretaries General, the Directors of different Department, the Heads of Division, the Legal Counsel and all the consultants working in the General Secretariat participated. This document is, therefore, the sum total of the successive value added of the above-mentioned meetings. By submitting it for consideration to the representatives of Member States, I am confident that it will be given the greatest attention.

Iraq is facing daunting challenges of Islamic State of Iraq and Syria (ISIS) insurgency, political upheaval, and profound economic and humanitarian crises. Compounding the ISIS-related crisis, the sharp decline in global oil prices has resulted in significant decline in oil export revenues. Implementation of political reforms, announced in August 2015, has been slow due to constitutional constraints and systemic resistance to changes. Iraq's economic prospects are subject to significant risks. Iraq has recently achieved some important steps towards strengthening its investment climate, but much remains to be done. An attractive investment climate is integral to economic growth and poverty reduction. A key task of the government is to balance the interests of society and individual firms. A stronger investment climate does not equate with a more comfortable life for individual firms. The government must manage these trade-offs: global analysis of the World Bank's investment climate surveys shows that firms facing strong competition are on average fifty percent more likely to innovate than firms reporting no such pressure. Innovation, in turn, is a key ingredient for productivity improvement. The special focus section explores the different aspects of the investment climate in order to better understand their importance. With this background, the authors then look at Iraq's investment climate and recent efforts to strengthen it. Finally, the authors look at priorities for improving Iraq's investment climate going forward.

تتولّى الإدارةُ العامَّةُ إدارةَ شؤونِ الدولةِ وتسييرَ أُمورِها بما لها مِنْ سُلُطاتٍ وامتيازاتٍ منحها إيّاها المُشرِّعُ تحقيقًا للمصلحةِ العامَّةِ، وإنَّ أخطرَ هذهِ الامتيازاتُ هو حقّها في إصدارِ قراراتٍ مُلزِمةٍ بإرادتها المنفردة ومن ثم يجد الأفراد أنفسهم في مواجهةِ قرارٍ مُلزَمين بتنفيذهِ من دون أنْ يكون لهم الحقَّ في رفضهِ أو إبداء رأيهم فيه، وينبغي ظهور هذه الإرادة الباطنة بمظهرٍ خارجيٍّ حتى يعلم بها الأفراد المعنيون بتنفيذها وهو ما يُطلَق الظهور عليه"شكل القرار الإداري" لذا يُعَدُّ ضمانةً للأفرادِ لأنَّه يُحيطهُم عِلمًا بما تُقرِّره الإدارة تجاههم. ويُعَدُّ عيبَ الشكلِ في القرارِ الإداريِّ من أسبابِ الطعنِ فيه بالإلغاءِ؛ لأنَّه ينصَبُّ على رُكنٍ أساسيٍّ من أركانِ القرارِ الإداريِّ لا يستقيم من دونه، فالإدارةُ مُلزَمةٌ بأنْ تُفرِغَ إرادتَها بالشكل الذي يُحدِّده القانون وللقضاء الإداري سلطةَ إلغاءِ القرارِ المعيبِ بعيبِ الشكلِ. وتَبرزُ أهمّية ركن الشكل في خصوصيَّته؛ لأنَّه يُنظِّمُ ويضبطُ عملَ الإدارةِ في صورةٍ محدَّدةٍ دقيقةٍ وقانونيَّةٍ ممَّا يَستتبِعهُ ضمانُ مشروعيَّةِ القرارِ الذي تُصدِره الإدارة، فالتزام الإدارة به يُؤدِّي إلى تحقيق المصلحة العامَّة؛ لأنَّه يُظهِر إرادة الإدارة في صور ومظاهر خارجيةٍ معلومةٍ للأفرادِ بِغيةَ الالتزامَ بها وتنفيذها. ; The Public Administration Assumes The Management of The Affairs of The State And The Conduct of Its Affairs With The Powers And Privileges Granted To It By The Legislator In order To Achieve The Public Interest، And The Most Dangerous of These Privileges Is Its Right To Issue Decisions That Are Binding on Their Individual Will، And Therefore Individuals Find Themselves With A Refusal To Confront Them Without Facing Their opinion on It، And Since This Inner Will of The Administration Should Appear In An External Appearance Until The Individuals Concerned With Its Implementation Know About It And This Appearance Is What Is Called The "Administrative Decision Form" So It Is Considered A Guarantee For Individuals Because Debriefed Note Determined By The Administration Towards Them.
