The Prohibition of Collective Expulsion as an Individualisation Requirement
This volume examines the implementation of the Return Directive from the perspective of judicial dialogue. While the role of judges has been widely addressed in European asylum law and EU law more generally, their role in EU return policy has hitherto remained under explored. This volume addresses the interaction and dialogue between domestic judiciaries and European courts in the implementation of European return policy. The book brings together leading authors from various backgrounds, including legal scholars, judges and practitioners. This allows the collection to offer theoretical and practical perspectives on important questions regarding the regulation of irregular migration in Europe, such as: what constitutes inadequate implementation of the Directive and under which conditions can judicial dialogue solve it? How can judges ensure that the right balance is struck between effective return procedures and fundamental rights? Why do we see different patterns of judicial dialogue in the Member States when it comes to particular questions of return policy, for example regarding the use of detention? These questions are more timely than ever given the shifting public discourse on immigration and the growing political backlash against immigration courts. This book will be essential reading for all scholars and practitioners in the fields of immigration law and policy, EU law and public law.

Social Inequality in Political Participation: The Dark Sides of Individualisation

Has the participatory gap between social groups widened over the past decades? And if so, how can it be explained? Based on a re-analysis of 94 electoral surveys in eight Western European countries between 1956 and 2009, this article shows that the difference in national election turnout between the half of the population with the lowest level of education and the half with the highest has increased. It shows that individualisation - the decline of social integration and social control - is a major cause of this trend. In their electoral choices, citizens with fewer resources - in terms of education - rely more heavily on cues and social control of the social groups to which they belong. Once the ties to these groups loosen, these cues and mobilising norms are no longer as strong as they once were, resulting in an increasing abstention of the lower classes on Election Day. In contrast, citizens with abundant resources rely much less on cues and social control, and the process of individualisation impacts on their participatory behaviour to a much lesser extent. Résumé Dans un pays où l'âge et le genre jouent un rôle central dans la construction sociale des temps, l'avènement de la société de service transforme-t-il la maîtrise de leurs temps de vie par les individus ? La participation des femmes à la force de travail n'a modifié ni le partage des tâches domestiques entre hommes et femmes ni les modes d'accomplissement de ces tâches. L'absence d'une remise en cause fondamentale du caractère régulateur de l'âge et du genre au sein de la convention de disponibilité temporelle japonaise constitue un obstacle de taille à l'individualisation des temps de vie.

L'engagement associatif a évolué au cours des vingt dernières années, témoignant
d'un mode d'être dans la société marqué par un renforcement de l'individualisation.
Plus actif mais moins militant, il est centré sur l'épanouissement personnel,
valorise la sociabilité amicale et s'inscrit essentiellement dans des associations
sportives et de loisirs. Cette évolution ne joue guère en faveur du rôle,
traditionnellement attribué aux associations, de responsabilisation et d'ouverture
sur la société globale. Désormais, la vie associative s'articule moins à des normes
et à des valeurs qu'à la mise en oeuvre d'une sociabilité et à la valorisation d'une
subjectivité. Cette évolution de l'engagement associatif entraîne de nouvelles
modalités d'inscription des individus dans l'espace public.

L'infidélité conjugale : individualisation de la vie privée et genre

Cadre de la recherche : Cet article propose un approfondissement des thèses de l'individualisation de la vie privée comme explication de l'infidélité conjugale. Il propose une analyse tenant compte des milieux sociaux où se diffusent prioritairement les représentations du « soi authentique » (les classes intermédiaires-supérieures ») et du genre.
Objectifs : L'objectif principal de ce texte est de montrer que l'individualisation de la vie privée et le modèle de l'amour romantique trament les doubles vies, mais que celles-ci prennent appui sur un modèle familial traditionnel porté par les hommes.
Méthodologie : Nous avons réalisé trente-neuf entretiens biographiques enregistrés d'une durée de trois à six heures. Nous avons retenu des personnes qui ont ou ont eu une relation extraconjugale de plus de deux ans, de manière régulière. Une analyse de blogues a également été réalisée.
Résultats : Les logiques sociales de l'extraconjugalité se rapprochent de celles des séparations aux mêmes âges et dans les mêmes milieux sociaux. Cependant, les ressorts des parcours conjugaux caractérisés par une liaison clandestine durable sont singuliers en termes de genre.
Conclusions : La quête d'un « soi authentique » dans les relations clandestines existe chez les hommes et les femmes. En revanche, ces dernières adhèrent prioritairement au modèle contemporain de l'amour romantique alors que les hommes sont, eux, porteurs d'un modèle familial traditionnel qui suppose l'indissolubilité de la famille. Dans ces liaisons qui durent plusieurs années, les représentations des femmes tendent à se rapprocher de celles des hommes.
Contribution : Cet article contribue à un approfondissement des analyses – rares – de l'infidélité conjugale. Il montre que l'individualisation qui prévaut à la quête de « soi » dans un amour hors du couple officiel est genrée.
