Water resources management has become a prominent issue in Brazil's regional political agendas but understanding the limits of its practices and policy choices is yet to be achieved. This article presents an analysis of environmental management in the state of Minas Gerais during 1995-2014, a period characterized by a neoliberal political and economic approach. It seeks to identify possible trends, limitations, and possibilities for institutional and administrative development in this area. The research included a revision of documents dealing with the insertion of public policies in the institutional agendas linked directly or indirectly with the management of water resources. These documents cover legal, legislative, and executive aspects of State performance in this sector, as well as information related to the models of environmental management implemented in the State of Minas Gerais, during the period of study. The conclusions suggest that the practices of water resources management in the State were greatly influenced by neoliberal prescriptions, whether by the increase in the institutional public deficit of the environmental sector or by the contextual and political difficulties facing the implementation of long-term integrated management of water resources.
O presente trabalho tem como escopo a reflexão, perante a Nova Lei de Licitações, sobre o protagonismo da figura do contrato bilateral entre os mecanismos de desenvolvimento de políticas públicas, em detrimento de atos unilaterais, de polícia, próprios do Estado Liberal. Analisa a utilização harmoniosa do instituto aos valores do atual regime constitucional, sempre vinculada, ainda que indiretamente, aos objetivos sociais que devem ser perseguidos pelo Poder Público, sob uma índole distributiva. Apresenta os desafios de implementação, a vantagem da perspectiva cooperativista, sem olvidar do perigo de eventual excesso de intervenção regulatória por esses instrumentos, bem como o conceito de política pública e a crescente tutela do Direito sobre as escolhas dos administradores, de modo a derrocar uma atuação em moldes autoritários.Recebido: 07.02.2021/Aprovado: 12.09.2021 ; The scope of this work is to reflect, before the New Bidding Law, on the protagonism of the contract figure, bilateral, among the development mechanisms of public policies, against unilateral acts, typical to the Liberal State. It analyzes the use of the institute in a way that is harmonious with the values of the current constitutional regime, always linked, albeit indirectly, to the achievement of social objectives that must be pursued by the Government, under a distributive nature, which is pursued by the Legislator, more explicitly, in the new law. It presents the implementation challenges, the advantage of the cooperative perspective, without forgetting the danger of an eventual excess of regulatory intervention by these instruments as well as the concept of public policy and the growing tutelage of the Law on the choices of administrators, in order to overthrow an authoritarian action.Received: February 7th, 2021/Approved: September 12th, 2021
The objective of this article is to describe and analyze some of the main characteristics related to the functioning and organizational structures of two governmental research institutions, the CPB Netherlands Bureau for Economic Policy Analysis (CPB) and the Korea Development Institute (KDI), which are international references. The choice of these institutions was due to the fact that their size and attributions are very similar to those of the main Brazilian governmental organization of research in public policies, the Ipea. The main idea is, from the lessons extracted about the forms of action and institutional characteristics of those organizations, to draw attention to the debate about possible alternatives of innovations and trajectories which could be potentially incorporated by Ipea.
La tesi sostiene che, mentre molte teorie di pianificazione si sono concentrate sulle differenze, il multiculturalismo e risoluzione dei conflitti sociali, non c'è ancora sufficiente approfondimento su come queste differenze possano restare profondamente irrisolte e come questa debolezza possa essere fortemente legata a razionalità contrastanti e a una sorta di "slittamento dei livelli di senso" o "equivoci" cognitivi tra i soggetti coinvolti (Bourdieu e Wacquant, 1992). Soprattutto in termini di conflitti urbani espliciti, generati non da opposti interessi economici o differenti volontà politiche, ma semplicemente da differenti background culturali e comportamentali, il livello cognitivo di com-prensione tra le persone coinvolte ha un ruolo fondamentale in termini di consapevolezza e di effi-cacia delle scelte. Dunque il legame tra pianificazione, governance, contesti istituzionali e partecipazione delle comu-nità è, prima di tutto, una questione di reciproca, profonda e vera comprensione, piuttosto che la continua ricerca di nuovi strumenti e politiche. Partendo dalla convinzione che i conflitti siano una fonte incredibile di soluzioni creative e inaspet-tate all'interno dei contesti urbani, dei sistemi di pianificazione e di condivisione di valori, questo lavoro si propone di sondare come la Mobilitazione Cognitiva (Dalton, 1984), per la cura e la prote-zione di un bene comune, può essere in grado di guidare una comunità nella lotta per i propri diritti, permettendo l'acquisizione di conoscenze politiche e abilità specifiche per il raggiungimento di decisioni condivise collettivamente, la costruzione di nuove forme di azione politica dal basso, nuove processi di educazione (Dolci, 1974) e ampliamento culturale contro il prevaricare di Egemonie politiche e sociali (Gramsci, 2007). Utilizzando metodi quantitativi e qualitativi, l'autore presenta due esperienze di pratiche insorgenti provenienti dall' Europa meridionale: (1) un tradizionale Caso-Studio nell' area marina protetta dell' Arrábida, in Portogallo, per illustrare come la mobilitazione cognitiva, volta alla genuina e profonda comprensione delle istanze portate avanti dalla collettività, può realizzare forme di partecipazione che, guardando ai problemi in termini di risorse, permettono alla comunità di collaborare democra-ticamente cercando soluzioni nuove e condivise in grado di modificare profondamente un piano isti-tuzionale il quale, a causa di una profonda contrapposizione tra poteri gioco e valori espressi, ha ge-nerato forme di conflitto dichiarato, ma anche latente; (2) un caso di Participatory Action Research nella valle del fiume Simeto, in Italia, dove le comunità locali, attraverso una forte mobilitazione collettiva, sono state in grado di difendere e curare il fiume Simeto, il più grande in termini di bacino idrogeologico in un territorio caratterizzato da scarsità idrica come la Sicilia, minacciato dalla scelta istituzionale di collocare un inceneritore proprio in un area fortemente incentrata sull'agricoltura, per il suo sostentamento economico, e profondamente legata al paesaggio circostante, in termini di riconoscimento e senso di appartenenza. Questo lavoro può avere importanti implicazioni sia per la teoria, che per la pratica di pianificazione. La scelta di un approccio multi-disciplinare, inoltre, aiuta nella comprensione di come sia possibile trasformare l'antagonismo in spirito competitivo tra soggetti, diversi per natura e per cultura, concentrandosi principalmente sul rispetto e l'apprendimento reciproco, sulla costruzione di processi veramente inclusivi e sulla scelta di soluzioni davvero condivise. ; The thesis argues that while many planning theories have focused the sight on the social differences, multiculturalism and conflicts resolution, there is not yet sufficient acknowledgement on how these differences can be deeply unsolved and how this weakness could be strongly linked with conflicting rationalities and with a 'cognitive slipping' planes of meaning (Bourdieu & Wacquant, 1992). Especially in terms of inexplicit urban conflicts, generated by not opposite economic interests or political will, but by simply and natural differences of the cultural and behavioral baggage, the cognitive level of understanding between people involved plays a fundamental role in terms of awareness and choices efficacy. So this works wants underlines that the link between planning, governance, institutional adjustments and community engagement is, first of all, a matter of mutual deep and real understanding, rather than new form of tools and policies. Starting from the persuasion that conflicts are an incredible source of unexpected creative solution for urban contexts, planning systems and sharing values, this paper aims to probe how a 'cognitive mobilization' (Dalton, 1984) of a community, for the care and the protection of a common good, can be able to "fight for a right" in terms of acquiring political resource and skills to reach own decisions, and constructing new form of genuine power through education (Dolci, 1974) and culture against a 'dominant discourse' (Gramsci, 2007). Using quantitative and qualitative methods, the author presents two field experiences of insurgent practices in the southern Europe: (1) a traditional Case-Study of a Marine Protected Area in Arrábida, Portugal, to illustrate how a community mobilization, that aims to understand really every form of instance and claim, can realize forms of participation that, first of all, sight problems in term of resources, and then allowed people to work democratically together building new and shared solutions able to modify deeply an institutional plan that, due to a displacement between powers and values, generated forms of conflicts between stakeholders, especially in terms of economic and decision making point of view; (2) a case of Participatory Action Research in the Simeto river valley, Italy, where local communities through a strong mobilization were able to defend and took care the river, the biggest in terms of basin in a scarcity water territory, threatened by the institutional choice to collocated an incinerator in a valley strongly based on agriculture, for its economic sustenance, and deeply linked with the landscape, for its recognition and sense of belonging to . This understanding, it is suggested, has important implications for both planning theory and practice. Choosing a multi-disciplinary approach, this work attempts to explore if and how it is possible to transform the antagonism between enemies in competitive spirit among subjects, different for nature and culture, focusing on respect and mutual learning and on the building up of processes really inclusive and choices really shared
This article highlights significant aspects of the contemporary reality in Chinese society,characterized by fast economic and cultural changes. It discusses how has the formation of apublic opinion independent from institutional power occurred, increasingly more fragmented,heterogenous, and sometimes critical to the choices made by the regime. The diversity ofopinions is favored by the internet. But this mean is also considered by the Chinese State, ininitiatives such as the Social Credit System, a tool to strengthen trust and social cohesion,reducing destabilization risks for the leadership of the Communist Party. ; O artigo destaca alguns aspectos significativos da realidade contemporânea na sociedade chinesa, marcada por uma rápida transformação econômica e cultural. Discute como tem se dado a formação de uma opinião pública independente do poder institucional, cada vez mais fragmentada, heterogênea e, em alguns casos, crítica às escolhas do regime. A diversidade opinativa é favorecida pela internet. Mas esse meio é também pensado pelo Estado chinês, a partir de iniciativas como o chamado Sistema de Crédito Social, como instrumento para fortalecer a confiança e a coesão social, reduzindo os riscos de desestabilização à liderança do Partido Comunista.
This article proposes a historical-institutionalist perspective to explain the political and institutional dynamics that polarized the intergovernmental relations in health policy in the 1990s. In this perspective, the history of intergovernmental relations is understood as the result of a long chain of decisions made in particular political contexts of the three governments in the 90s: Presidents Fernando Collor, Itamar Franco and Fernando Henrique Cardoso. During this period, the relations between the political actors of the Brazilian Health Unified System (SUS) and the trends of the national federative context established the direction of the decentralization strategy at each stage. The intensity of institutionalization also depended on the choices of these governments regarding the direction of the national policy and the federative coordination structure of the Ministry of Health, the stability and volume of financing, and the institutional capacities of states and municipalities to take on new responsibilities. ; Este artículo propone un punto de vista histórico-institucionalista para explicar la polarización de las relaciones federativas en SUS a finales en los años 1990. En este enfoque, la trayectoria de las relaciones intergubernamentales es el resultado de una larga cadena de decisiones tomadas en contextos políticos concretos de los tres gobiernos en los años 1990: Collor, Itamar y FHC. La dinâmica de forças entre los actores políticos del SUS y las tendencias del contexto federativo nacional establecieron la dirección de la estrategia de descentralización en cada etapa. La intensidad de institucionalización resultó también de las elecciones de esos gobiernos relativas a la dirección de la política nacional y a la estructura de coordinación federativa del Ministerio de Salud, de la estabilidad y volumen del financiamiento sectorial, y de las capacidades institucionales de estados y municipios para asumir nuevas responsabilidades. ; Este artigo busca explicar a dinâmica político-institucional que produziu um quadro polarizado de relações federativas no SUS nos anos 1990, com base no arcabouço teórico do neoinstitucionalismo histórico. Nessa perspectiva, analisa-se a trajetória das relações intergovernamentais como o resultado de uma cadeia de decisões tomadas em contextos singulares dos governos Collor, Itamar e FHC, onde o jogo entre os atores políticos do SUS e as tendências do contexto federativo nacional estabeleceu a direção da estratégia de descentralização em cada etapa. A intensidade de institucionalização dependeu ainda das escolhas desses governos relativas à direção da política nacional e à estrutura de coordenação federativa do Ministério da Saúde, da estabilidade e do volume do financiamento setorial, e das capacidades institucionais de estados e municípios para assumirem novas responsabilidades.
O presente trabalho tem como objetos de estudo a informação, o domínio do Estado sobre ela e a forma pela qual a informação se insere na política externa por meio das agências de notícias. Dessa forma, serão tratados aqui dois projetos de política de comunicação distintos sob a perspectiva da política externa: a Televisión del Sur (TeleSUR), que teve início de suas operações em 2005; e o projeto de expansão da TV Brasil criado no governo do presidente Luiz Inácio Lula da Silva, começando a operar em 2007. A hipótese é de que as escolhas tomadas quanto à contribuição a essas agências de notícias refletem um contexto maior de posicionamento da política externa brasileira, oscilando ora entre liderança e ora pela integração. A pesquisa foi conduzida através da busca de textos analíticos a respeito das duas instituições de notícias, além de informações coletadas nos meios eletrônicos institucionais, legislações e discursos.Palavras-chave: Política externa comunicacional; TeleSUR; TV Brasil.ABSTRACTThe present work has as its study objects the information, the State´s domain over it, as well as the way in which the information is inserted in the foreign policy through the news agencies. Thus, two distinct communication foreign policy projects will be addressed here: Televisión del Sur (TeleSUR), which started operations in 2005; and the TV Brasil´s expansion project created under President Luiz Inácio Lula da Silva, starting to operate in 2007. The hypothesis is that the choices made regarding the contribution to these news agencies reflect a greater context for the positioning of Brazilian foreign policy, oscillating between leadership and integration. The research was conducted through analytical texts about the two news institutions, in addition to information collected in institutional electronic media, legislation, and speeches.Keywords: Informational foreign policy; TeleSUR; TV Brasil.
Parliamentary websites have become the main window of parliament to the outside world. More than a gimmick, they are an essential element in the promotion of a relationship between parliament and citizens. This paper develops a comparative analysis of the websites of the lower chambers of the Brazilian and the British parliaments, respectively the Chamber of Deputies and the House of Commons. We structure this analysis around three dimensions: 1) information about the institution; 2) information about parliamentary activity; and 3) tools to promote engagement with the public. The choice of two very different case studies enables us to consider more clearly the specific purposes of these parliamentary websites. We consider in particular if these parliaments' institutional differences affect their websites. The websites' analysis is complemented by semi-structured elite interviews with parliamentary staff who manage the services provided by these websites. Our analysis shows that both websites achieve much higher levels of complexity in the information area than in engagement. But it also shows that the Brazilian parliament website includes far more tools designed for public interaction than its UK counterpart. The indexes and interviews show that both institutions are highly committed to disseminating data and information to citizens. This is seen as a path towards achieving higher accountability and improving knowledge about parliamentary processes and, consequently, improving public image and levels of trust. Whilst there is a strong focus on the provision of information, there is still little evidence of enabling citizen participation in the legislative process. This is partly due to a tension between conceptions of representative democracy and those of participatory democracy. The articulation between these different types of democracy still has a long way to be resolved, although parliaments are slowly introducing participatory tools.
This paper examines changes in oil revenue management in the period from the market-oriented reforms of the 1990s to the new oil sector regulatory framework introduced in 2010. Grounded on a combination of the long-term view afforded by historical institutionalism and the tools for modelling agents' behaviour offered by rational choice institutionalism, it stresses the importance of ideas and associated interests in the policy outcome, considering stakeholder interaction in the process, the institutional framework, the new critical juncture, and the new domestic and international setting. The result indicates that the Brazilian oil policy follows the ideas path during the 1990s and 2000s, reflecting the dominant interests in each phase. As well, the domestic economic outlook was critical to determine the extent to which the government had to follow international agencies policy recommendations. ; Este trabajo examina los cambios en la gestión de los ingresos petroleros desde el período de las reformas orientadas al mercado de los años 1990 hasta el nuevo marco regulatorio del petróleo aprobado en 2010. Basado en la combinación de la perspectiva a largo plazo del institucionalismo histórico y en las herramientas del institucionalismo de la elección racional para modelar el comportamiento de los agentes, el estudio subraya la importancia de las ideas e intereses en el resultado de la política pública, considerando la interacción de los actores en el proceso, el marco institucional, nuevas coyunturas críticas y configuraciones nacionales e internacionales. Los resultados indican que la política pública de petróleo en Brasil siguió la trayectoria de las ideas durante el período, reflejando los intereses dominantes en cada fase. Además, la situación económica doméstica desempeñó un papel clave al determinar la necesidad de seguir las recomendaciones de políticas económicas de las organizaciones financieras internacionales. ; Este trabalho examina as mudanças no gerenciamento das receitas petrolíferas desde os anos 1990, período das reformas orientadas para o mercado, até o novo marco regulatório do petróleo aprovado em 2010. Baseado na combinação da perspectiva de longo prazo do institucionalismo histórico e nas ferramentas para modelar o comportamento dos agentes do institucionalismo da escolha racional, o estudo sublinha a importância das ideias e dos interesses no resultado da política pública, considerando a interação dos atores no processo, o marco institucional, novas conjunturas críticas e configurações nacionais e internacionais. Os resultados indicam que a política pública de petróleo no Brasil segue uma trajetória calcada nas ideias vigentes durante o período, refletindo os interesses dominantes em cada fase. Além disso, a situação econômica doméstica teve papel-chave ao determinar a necessidade de seguir as recomendações de políticas econômicas das organizações financeiras internacionais.
Councils acting in the Justice System in democracies have different purposes: to strengthen the independence of the judiciary and the public prosecutor's office, to increase accountability of judges and prosecutors, or/and to improve justice management. This article analyzes the Brazilian National Council of Justice (CNJ) and the National Council of the Brazilian Public Prosecutor's Office (CNMP), particularly regarding their purpose as instruments of accountability. The study shows that these bodies were created as instruments to increase transparency and compel judges and prosecutors to be held accountable for their actions and choices. The hypothesis tested in this research is that the two councils did not meet this expectation. The CNJ and CNMP were analyzed for their institutional design, discussing how the composition and distribution of positions at the council encourage independence of the judges and prosecutors rather than accountability. In addition, the article offers data on the councils' decisions when accusations were presented. Finally, the analysis revealed that CNJ and CNMP are mainly composed of internal members of the Judiciary and the Public Prosecutor's Office, and identified a lack of expressive punishment applied to judges and prosecutors. Therefore, the hypothesis that the councils do not work as instruments of accountability was confirmed. ; En las democracias, los consejos, órganos colegiados que operan en el sistema de justicia, tienen diferentes finalidades: fortalecer la independencia del Poder Judicial y del Ministerio Público (MP), incrementar la accountability con relación a jueces y fiscales, y/o mejorar la gestión de la justicia. Este artículo analiza el Consejo Nacional de Justicia (CNJ) y el Consejo Nacional del Ministerio Público (CNMP), considerando principalmente los primeros dos aspectos. Al momento de crear esos órganos, se creía que ambos serían instrumentos para aumentar la transparencia y permitir que jueces y fiscales pudieran responder de sus acciones y opciones. Nuestra hipótesis es que esa expectativa no se ha cumplido. Para probarla, analizaremos el diseño institucional del CNMP y del CNJ, señalando cómo la composición y distribución de cargos fomentan más la independencia que la accountability y también presentaremos datos relacionados con el comportamiento de los consejos ante denuncias disciplinarias. Nuestra conclusión es que, debido al hecho de que el CNJ y el CNMP están compuestos mayoritariamente por miembros internos del Poder Judicial y del MP y al desempeño insignificante con relación al castigo de jueces y fiscales, los órganos refuerzan aún más la significativa independencia de estas instituciones en Brasil. ; Em democracias, conselhos, órgãos colegiados atuantes no Sistema de Justiça possuem diferentes finalidades: reforçar a independência do Poder Judiciário e do Ministério Público (MP), incrementar a accountability em relação a juízes e promotores e/ou aprimorar a gestão da Justiça. Este artigo analisa o Conselho Nacional de Justiça (CNJ) e o Conselho Nacional do Ministério Público (CNMP), considerando principalmente os dois primeiros aspectos. No momento da criação desses órgãos, acreditava-se que ambos seriam instrumentos para aumentar a transparência e possibilitar que juízes e promotores pudessem responder por suas ações e escolhas. Nossa hipótese é que essa expectativa não se realizou. Para testá-la, analisaremos o desenho institucional do CNMP e do CNJ, apontando como a composição e a distribuição de cargos incentivam mais a independência que a accountability e apresentaremos também dados relativos ao comportamento dos Conselhos frente às denúncias disciplinares. A conclusão é que, em virtude da composição majoritária do CNJ e do CNMP por integrantes internos do Judiciário e do MP e da atuação pouco expressiva em relação à punição de juízes e promotores, os órgãos reforçam ainda mais a expressiva independência dessas instituições no Brasil.
