The paper deals with the analysis of the legal nature of international courts' decisions and their impact on the international financial legal order. The author claims that decisions of international courts, creating no new international legal financial norms, act as an additional source of international financial law, having no autonomy, and in combination with other sources of international law, performs the following functions: 1) regulatory-prescriptive (via opinio juris of existing traditions in interstate practice in the financial sphere transforming them into international customary law); 2) regulatory-affirming (confirming the legal nature of the international agreement between the subjects of international financial legal relations which caused a disputable situation). The judicial practice on financial issues and specificity of functioning of such judicial institutions as the Permanent Court of International Justice, the International Court of Justice, the CIS Economic Court, the Court of Justice of the European Union, the Court of Justice of the Central African Economic and Monetary Community, etc. are examined. The features of the provisions of international agreements on financial issues regarding the procedure for resolving disputes between the parties of the agreement about its implementation are analyzed. The paper explores particularities of the origin and development of the idea of the creation of an international financial court. Amid modern processes of the rapid growth of the amount of crossborder financial flows in the context of globalization, which is the consequence of the implementation of numerous international financial agreements, the idea of creation of an international financial court, which was first suggested in 1935, due to the complexity of legal nature of interstate financial disputes, is an objective necessity. The article analyses the development of the concept of international crime in the "Hague" period, which covers the last decades of the last century and is closely related to the establishment of ad hoc international tribunals in the former Yugoslavia and Rwanda. The article reveals the legal grounds for the establishment of these tribunals, the features of their activities, jurisdiction and principles of responsibility of persons who committed crimes in the former Yugoslavia and Rwanda. The establishment of international justice bodies by UN Security Council decisions has provoked a number of debates about their legitimacy, but it is undeniable that the activities of ad hoc international tribunals have contributed to the initiation of a new stage in the development of international criminal justice, further development of international criminal law, in particular in the development of the Rome Statute and the Rules of Procedure and Evidence of the International Criminal Court. All types of tribunal jurisdictions are disclosed, but special attention is paid to the substantive and personal jurisdictions of tribunals, which became the basis for the theoretical justification of the "Hague" modification of international crime, as well as the practical implementation of this concept in tribunal decisions. It is shown that the categories of international crimes that constitute the jurisdiction of the International Criminal Tribunal for the Former Yugoslavia (serious violations of the Geneva Conventions, violations of the laws or customs of war, genocide and crimes against humanity) and the categories of crimes defined in the Statute of the International Tribunal for Rwanda against humanity and violations of the Geneva Conventions) in the documents of the tribunals have been developed in comparison with the Nuremberg and post-Nuremberg periods. ~ 74 ~ ВІСНИК Київського національного університету імені Тараса Шевченка ISSN 1728-3817 It is shown that the substantive jurisdiction of the ICTY and the ICC does not coincide with the provisions of the Nuremberg and Tokyo tribunals. The differences relate to the list of categories of crimes; parallel jurisdiction of international ad hoc tribunals and national courts; extending the competence of ad hoc tribunals to cases of crimes committed both during wars between states and during internal armed conflict, etc. The content of the categories of crimes, their composition, the subjects of responsibility have been clarified. In particular, the characteristic features of the crime of genocide and crimes against humanity are identified; the conditions, elements and subjects for the recognition of their qualifications are indicated. The author pays attention to the principles of personal jurisdiction, shows that in the decisions of international tribunals ad hoc has developed the principle of individual responsibility for international crimes that constitute substantive jurisdiction. The application of the principle of universal jurisdiction in the activity of tribunals is revealed. The author concludes that the establishment of ad hoc international criminal tribunals and their activities has contributed to the development of the concept of international crime and the separation of a special "Hague" modification. Organizational and functional particularities of judicial and law enforcement activities in Ukrainian Military Forces have been researched in the article within the scope of historical aspects and international experience. It has been emphasized, that strength of military forces is defined not only by quantity of staff, their professionalism, aptitude, quality of military stuff etc. Readiness of troops to oppose threats directly depends on the state of legality and legal order. International experience demonstrated, that in majority of developed countries, that have contemporary military forces and are known as democracies (USA, Great Britain, France, Canada, Spain – about 40 in total) the bodies of military justice reach significant success in strengthening military discipline and order. The Committee of European Council on Human Rights in June 2003 highlighted necessity of military justice bodies, as to the military courts the Committee stated, that their existence did not violate the UN Convention on Human Rights. It was indicated that military courts could be independent and unprejudiced courts. It`s highlighted, that military justice bodies are being currently eliminated even under conditions of antiterroristic operation in Ukraine (currently – Operation of United Forces), and factually under conditions of war at some territories of Ukraine. Military courts were eliminated in 2010, with no hope for renewal, although this issue has been considered at all levels of state authorities. Moreover, now it`s the turn for militaryprosecution bodies to be eliminated. In total there left the only Service of Military Order, with reduced capability and functions. There was provided additional evidence in favor of further Ukrainian military justice reformation by creation of specialized courts and law enforcement bodies: military courts, military prosecution service and future military police. Only in that case necessary lever of legality, legal order and discipline will be obtained in Ukrainian Military Forces. ; У статті, з урахуванням історичного аспекту проблеми та міжнародного досвіду, розкрито організаційні та функціональні особливості здійснення судової та правоохоронної діяльності у Збройних Силах України. Підкреслено, що оборонна міць збройних сил визначається не тільки кількістю військовослужбовців, рівнем їх професіоналізму та майстерності, якістю військової техніки. Боєздатність військових частин та з'єднань напряму залежить від стану законності та правопорядку в них. Тому міжнародний досвід свідчить про те, що у більшості розвинутих країн, які мають сучаснізбройні сили і які у той же час відомі своїми демократичними традиціями (США, Великобританія, Франція, Канада, Іспанія – всього близько 40) органи військової юстиції успішно діють і виконують завдання по зміцненню військової дисципліни та правопорядку. Постійним Комітетом Ради Європи з прав людини (м. Страсбург) у червні 2003 р. була взагалі визначена потреба органів військової юстиції, а щодо військових судів висловлена думка про те, що їх наявність в країні не суперечить Конвенції про захист прав людини і її основоположних свобод, а також зобов'язанням держав, які підписали цю конвенцію. Зазначено, що військові суди можуть бути визнані незалежними і неупередженими судами. Звертається увага на те, що в Україні, в умовах раніше – антитерористичної операції, а зараз – операції об'єднаних сил, а фактично проведенні реальних бойових дій на певних територіях країни, нажаль, йде процес ліквідації органів військової юстиції. Так, військові суди були ліквідовані ще у 2010 році, й до цього часу не відновлені, хоча це питання вирішувалося на всіх необхідних рівнях органів державної влади, військові прокуратури зараз на межі ліквідації. У наявності лише органи Військової служби правопорядку, але з вельми обмеженими повноваженнями, виключно профілактичної спрямованості. Наведені аргументи на користь подальшого реформування військової юстиції у Збройних Силах України, з формуваннями спеціалізованих судових і правоохоронних органів, а саме, їх тріади у складі: військових судів, військової прокуратури та органів Військової служби правопорядку (у майбутньому – військової поліції). Тільки у такому разі буде реально забезпечений належний рівень законності, правопорядку та військової дисципліни у Збройних Силах України.

The dynamics of the formation of the arbitral tribunal in the international law was analyzed in the article. The attention is focused on the basic historical stages of the arbitration justice (arbitral tribunal), and their characteristics is given. It is proved that the arbitration justice (arbitral tribunal) is one of the legal means of international disputes regulation. The regularities of the development of the arbitration justice (arbitral tribunal), which stage-by-stage include the usage of internal models of legal proceedings, the usage of analogies of the legal regulation of the phenomena of internal law to the phenomena of international law, also, the formation of the authentic legal international models of the legal international disputes regulation were discovered in the article. It is advocated that legal disputes, in which the decision was made as a result of the application of legal models, and not the search for a compromise, were the basis of the differentiation of arbitration justice (arbitral tribunal) and reconciliation (agreement) or the mediation. The preservation of the main features of arbitration justice (arbitral tribunal) formed in ancient states throughout the process of the formation peaceful international disputes regulation means, mainly fairness, impartiality, expertise and understanding of the case by the arbitrators was emphasized in the article. It is discovered that arbitration justice (arbitral tribunal) is a special category of international law which includes the elements of legal regulation and the possibility of political (compromising) elements inclusion.Key words: arbitration justice (arbitral tribunal); mediation, arbitration; cruiser «Alabama» case; arbitrage. ; Проаналізовано динаміку становлення третейського правосуддя в міжнародному праві. Акцентовано увагу на основних історичних етапах третейського правосуддя та охарактеризовано їх. Доведено, що третейське судочинство є одним із судових засобів врегулювання міжнародних суперечностей. Виявлено закономірності розвитку третейського правосуддя, які поетапно включають використання внутрішніх моделей судочинства, застосування аналогій правового регулювання явищ внутрішнього права до явищ міжнародного права, а також формування автентичних міжнародно-правових моделей врегулювання міжнародно-правових спорів. Відстоюється позиція, що основою розмежування третейського правосуддя і примирення (погодження) або посередництва виступили спори правового характеру, у яких рішення приймали внаслідок застосування правових моделей, а не пошуку компромісу. Наголошено на збереженні основних рис третейського правосуддя, сформованого в античних державах упродовж усього процесу формування цього засобу мирного врегулювання міжнародних спорів, а саме – справедливість, неупередженість, кваліфікація і розуміння суті справи арбітрами. The article deals with approaches to understanding the concepts of "access to justice" and "accessibility of justice" in the context of the case law of the European Court of Human Rights and Ukrainian courts, acts of international and national law, papers of domestic and foreign legal scholars. The study's author believes that access to justice is an important element of the right to a fair trial and the right to an effective remedy. The study's author points to the lack of a legislative definition of the concept of "accessibility of justice" and "access to justice" in both national and international law. However, this concept is widely used in international and national legislation. The author cites the views of a number of legal scholars on the content of the concepts of «accessibility of justice» and «access to justice». In particular, elements of access to justice are: a fair and public hearing before an independent and impartial tribunal; legal aid; the right to be advised, defended and represented; the right to an effective remedy. Ukrainian scientists' positions on the elements of the concept of "accessibility of justice" and "access to justice" differ from those of foreign scientists. In particular, they indicate that accessibility of justice includes: 1) convenient location of the courts; 2) a sufficient number of judges; 3) the closeness of the court to the population of some geographic area. As conclusion some recommendations have been made to increase the access to justice level in Ukraine.

The article is devoted to disclosure of the essence the fundamental principles of law such as legality and the rule of law in the sphere of administrative justice. Significant changes in the procedural legislation of Ukraine contributed to the actualization of the issues of the principles of the administration of justice. A significant impetus to reform was the direction of our state to the European community. The purpose of such changes is to improve and bring Ukrainian legislation in line with international European standards. The Convention and the practice of the European Court of Human Rights as a source of law require an understanding of such general principles as the rule of law and legality. In order to understand the nature of each principle as an independent, fundamental in the article, the content of the rule of law and legality is considered separately in view of their definition in the context of national and international law. It is emphasized the importance of applying each of these principles in procedural law. The author turns to the historical retrospective of the delimitation of these principles at the theoretical level. In order to understand better the correlation of these principles at the level of national legislation, the understanding of these principles in other normative-legal acts of Ukraine (in addition to the Code of Administrative Procedure), the decisions of the Constitutional Court of Ukraine, the Supreme Court, international legal acts, decisions and interpretations of the European Court of Human Rights and separately the Venice Commission's conclusion are devoted to the rule of law principle. The article is devoted to the consideration of the role and place of decisions of the European Court of Human Rights in the administration of justice by Ukrainian courts. It is stated that the modern world cannot be imagined without the interaction of national legal systems with the system of international law. The socio-political and socio-economic conditions of the present day further emphasize the interconnection between these systems of law, which has long gone beyond purely theoretical reasoning and has become a practical application. The main manifestation of the influence of international law on domestic law is the harmonization of the content of national law with the provisions of international law. As a rule, such harmonization occurs by borrowing international legal norms into national law or by adopting national norms that are consistent with the principles and norms of international law. The judicial practice of the European Court of Human Rights is considered as a source of law, taking into account the adoption of the Law of Ukraine "About implementation ofdecisions and application of practice of the European courton human rights"t has been determined that despite the fact that the provisions of the Law of Ukraine "On the Enforcement of Decisions and Application of the Practice of the European Court of Human Rights" have been in force for more than 10 years, the application of the provisions of the Convention on the Protection of Human Rights and Fundamental Freedoms and the practice of the European Court of Human Rights by national courts case review and decision making is more of an exception than a rule. Отмечается, что решения международных судов, не создавая новых международно-правовых норм, выступают как дополнительный источник международного финансового права, который в сочетании с другими источниками международного права выполняет следующие функции: 1) нормативно-устанавливающую (путем opiniojuris существующих обычаев в межгосударственной практике в финансовой сфере трансформирует их в международно-правовые обычные нормы); 2) нормативно-подтверждающую (подтверждает правовую норму международного соглашения между субъектами международных финансовых отношений, по поводу которой возникла спорная ситуация). Рассмотрено практику международных судов в финансовой сфере. Определены следующие признаки, присущие решениям международных судов (включая решения по финансовым вопросах): 1) локальность (обязательность только для сторон, которые берут участие в конкретном судебном деле); 2) ситуативность и незапланированость появления; 3) беспристрастность (в силу отсутствия политического интереса у судей); 4) авторитетность (в состав международных судов входят признанные специалисты по международному праву). ; Проаналізовано правову природу рішень міжнародних судів та їх вплив на міжнародний фінансовий правопорядок. Рішення міжнародних судів, не створюючи нових міжнародно-правових фінансових норм, виступають як додаткове джерело міжнародного фінансового права, яке, не володіючи самостійністю, в поєднанні з іншими джерелами міжнародного права виконує нормативно-встановну (шляхом opiniojuris існуючих звичаїв у міждержавній практиці у фінансовій сфері трансформує їх у міжнародно-правові звичаєві норми) та нормативно-підтверджувальну функції (підтверджує правову норму міжнародної угоди між суб'єктами міжнародних фінансових правовідносин, з приводу якої виникла спірна ситуація). Розглянуто практику міжнародних судів у фінансовій сфері. Визначено такі ознаки, притаманні рішенням міжнародних судів (включаючи рішення з фінансових питань): 1) локальність (обов'язковість тільки для сторін, які беруть участь у конкретній справі); 2) ситуативність і незапланованість появи; 3) неупередженість (в силу відсутності політичного інтересу у суддів); 4) авторитетність (до складу міжнародних судів входять загальновизнані фахівці з міжнародного права).

As you know, in public international law there is no hierarchy of sources of law. However, in practice, there are controversial situations when legal relations are subject to legal regulation of various sources of law. This is especially acute in the case of international custom and an international treaty.The purpose of the scientific article is to study the problems of the relationship and interaction of the international treaty and international custom in various aspects of their existence, namely: in aspects of their occurrence, observance and application.The article focuses on the legal analysis of the relationship between the international treaty and international custom in the judicial practice of the International Court of Justice of the United Nations. The analysis is subject, in particular, to the case of the continental shelf of the North Sea (1969), as well as the case of military and paramilitary activities in Nicaragua and against Nicaragua (1986).Based on the analyzed materials, the author of the article came to the conclusion that, firstly, an international treaty may contain customary norms, that have already existed and were in effect even before its conclusion. Secondly, the international treaty may be the last stage in the process of forming the customary norm. And thirdly, an international treaty may propose new legal norms that, due to further practice of subjects of international law, can be the basis for the creation of a new international custom.Moreover, it can be concluded that international customs and international treaties can exist and operate in parallel. However, even if the contractual and customary norm are identical in content, and the subjects of international law who are in disputed legal relations are connected, both by one and the second source of law, then from the point of view of applying these identical norms, they exist independently from each other. ; Як відомо, у міжнародному публічному праві відсутня ієрархія джерел права. Including that justice is an all-encompassing category, it is not surprising to have a stable connection with the law, for which it serves the value or orientation. Category of "social justice" becomes more popular nowadays, especially in labor law. We can state that social justice in labor law creates opportunities for the distribution of social benefits, produces the desire of members of society to be involved in the process of labor. And, finally, its implementation in labor relations is a guarantee of the highest level of their effectiveness, which implies unconditional compliance with safeguards and the realization of labor rights.It is mentioned that social justice cannot exist without its legislative consolidation and control over implementation by the state. The direct formulation of social justice as a goal is possible both at the consti- tutional level and at the level of labor legislation. In addition to national legislation, an important role in the development of the idea of social justice plays supranational legislation; in particular, the article analyzes the activities of the European Union and the International Labor Organization. The value of their activities lies not only in the fact that their normative documents operate with social justice as a prerequisite and purpose of their activity, but also through continuous monitoring and recommendations they provide to the states. Thus, within the framework of the European Union, a special social justice criterion (Social Justice Index) has been developed. That makes possible to evaluate and compare the level of social justice in the EU member states. Therefore, we propose to recognize and consolidate social justice as the underlying value, on which modern labor law is based.

The article analyzes the basic provisions of the United Nations Minimum Standard Rules on the Administration of Juvenile Justice ("Beijing Rules") and responded to the worldwide trend of juvenile delinquency by scholars and practitioners from many countries around the world. These rules are designed to take into account the diversity of legal systems and the social development of states and should be the basis of national legislation in need of reform. In addition, the basic principles declared in the Beijing Rules should be reflected in the juvenile policy of the states. The legal analysis made it possible to highlight such important principles as ensuring the welfare of a minor and social justice; Reduction of interference by law and fair and humane treatment of a teenager in conflict with the law; the " principle of proportionality" (limitation of punitive sanctions) and the individualizat ion of the responsibility of minors, taking into account the act committed; expedient use of measures of influence on minors, limited use of punishments, prohibition of the death penalty and corporal punishment, etc. It has been concluded that the improvement of the juvenile justice system under the Beijing Rules is primarily consistent with the general tendency to humanize the rights and protect the rights of children and adolescents, in particular those who are in conflict with the law. Their implementation into national law enables the development of juvenile policy of the state, the system of juvenile law and juvenile justice on the basis of modern international legal standards, which in turn should help to increase the effectiveness of legal influence and reduce the level of juvenile delinquency.

The article considers justice as one of the leading principles of the institute of remuneration. It is concluded that the principle of social justice is a universally recognized value of a democratic state. Social justice – one of the fundamental values of socio-political life, based on the principle of balance in social relations of rights and responsibilities of people, the interests of society and the individual, is a correspondence between the practical role of different individuals (strata) in society and their social status, between work and reward, merit and their recognition. Justice as a key condition for a dignified treatment of the employee involves: a) fair and favorable working conditions; b) fair and satisfactory remuneration for it; c) the dignified existence of the employee and his family members; d) the possibility of association in order to protect their socio-economic interests.It is noted that the institution of remuneration is one of the main in the field of labor law, aimed at ensuring the right of employees to fair remuneration for their work. Guarantees that are enshrined, or should be enshrined in the institution of remuneration, by their nature are aimed at the realization of the right to fair remuneration, ie it is about their focus on ensuring decent wages. Therefore, the concept of "decent, fair wages" should be used in the domestic legislation and in practice for the proper implementation of the right to remuneration. It is stated that today in our country the concept is being implemented – the right of everyone to remuneration for work without discrimination and not below the established minimum wage. At the same time, this concept is not aimed at ensuring life, but rather at "survival". From these positions, it is important to enshrine in domestic law the concept of "decent wages". The state must establish guarantees at the level of normative acts, without which it is impossible to ensure a dignified life for citizens. Many international human rights regulations and the constitutions of modern states directly or indirectly enshrine the right of workers to a dignified existence, which must be ensured by the level of wages. ; У статті розглянуто справедливість як один із провідних принципів інституту оплати праці. Зроблено висновок, що принцип соціальної справедливості є загальновизнаною цінністю демократичної держави. Соціальна справедливість – одна з фундаментальних цінностей суспільно-політичного життя, що виходить із принципу врівноваженості в соціальних відносинах прав і обов'язків людей, інтересів суспільства й особи, це певна відповідність між практичною роллю різних індивідів (верств) у житті суспільства та їх соціальним становищем, між працею і винагородою, заслугами та їх визнанням. Справедливість як ключова умова гідного ставлення до працівника передбачає: а) справедливі і сприятливі умови праці; б) справедливу і задовільну винагороду за неї; в) гідне існування працівника та членів його сім'ї; г) можливість об'єднання з метою захисту своїх соціально-економічних інтересів.Зазначено, що інститут оплати праці є одним із основних у царині трудового права, спрямованих на забезпечення права працівників на справедливу винагороду за свою працю. Гарантії, які закріплюються, або повинні закріплюватися в інституті оплати праці, за своїм характером спрямовані на реалізацію права на справедливу винагороду, тобто йдеться про їх спрямованість на забезпечення гідної оплати праці. Отже, для належної реалізації права на оплату праці у вітчизняному законодавстві та на практиці має бути використана концепція «гідної, справедливої заробітної плати». Констатовано, що сьогодні в нашій державі реалізується концепція – право кожного на винагороду за працю без дискримінації та не нижче встановленого мінімального розміру праці. Разом із тим ця концепція спрямована не на забезпечення життя, а швидше на «виживання». З цих позицій є актуальним закріплення у вітчизняному законодавстві поняття «гідна заробітна плата». Держава має встановлювати на рівні нормативних актів гарантії, без додержання яких неможливе забезпечення гідного життя громадян. У багатьох міжнародних нормативних актах з прав людини та конституціях сучасних держав прямо чи опосередковано закріплене право працівників на гідне існування, що має забезпечуватися рівнем заробітної плати.

The paper deals with the problem of social justice and a version of its resolving within modern analytic political philosophy. The author analyses utilitarian, liberal and communitarian approaches and claims that the mutual good hast to be considered a social ideal which is expressed by the triad of universal, public and private. ; Стаття присвячена проблемі соціальної справедливості та варіанту її вирішення в рамках сучасної аналітичної політичної філософії. На основі аналізу утилітаристського, ліберального і комунітаристського підходів авторстверджує, що взаємне благо необхідно розглядати як суспільний ідеал, що виражається тріадою загального, публічного і приватного.

The article examines transitional justice as a set of post-conflict settlement measures. Today, transitional courts, truth commissions, amnesties, and reparations are transitional justice mechanisms that are widely and relatively effectively used to resolve conflicts around the world. Today, the mechanisms of transitional justice are also being improved to meet the needs of victims of armed conflict. Sociological research confirms that the combination of international and local dimensions of responsibility is an important demand on the part of victims of armed conflict.At the same time, the prosecution of perpetrators of crimes committed during armed conflict in modern conditions concerns individual prosecution, which often goes beyond public prosecution. The state retains the obligation to bring perpetrators of crimes to justice, but this can be done through mechanisms of international law.The practice of post-conflict settlement is due to the fact that not all courts are equally effective in punishing those guilty of crimes and criminal prosecution is not always successful. Formal truth-seeking processes involving the investigation of past violations involve truth commissions. Another important mechanism of transitional justice is the politics of memory. The politics of memory as an element of transitional justice encompasses the work of states with a historical past.The combination of transitional state justice measures with the use of ad-hoc institutions allows for the restoration of justice in the most controversial dimensions of armed conflict. Peace is accelerating in the direction of autonomy and expansion of the mandates of transitional justice institutions, organized memory policy, effective cooperation of national and international institutions to determine their jurisdiction in human rights, sociological research on the needs of victims of armed conflict. Evaluation of the effectiveness of transitional justice mechanisms is possible only if their interconnectedness, interaction with civil society and the state are taken into account. ; У статті досліджується правосуддя перехідного періоду як комплекс заходів постконфліктного врегулювання. Сьогодні перехідні суди, комісії з правди, амністії та репарації є механізмами правосуддя перехідного періоду, що широко й відносно ефективно застосовуються для врегулювання конфліктів у всьому світі. Натепер механізми правосуддя перехідного періоду вдосконалюються і в напрямі забезпечення потреб жертв збройних конфліктів. У процесі соціологічних досліджень підтверджується, що поєднання міжнародного і місцевого вимірів відповідальності є важливим запитом з боку постраждалих у збройному конфлікті.Водночас притягнення до відповідальності осіб, винних у здійсненні злочинів під час збройного конфлікту, в сучасних умовах стосується індивідуального переслідування, що часто виходить за межі державного обвинувачення. Держава зберігає за собою обов'язок притягнення винних у злочинах до відповідальності, але здійснюватись це може за допомогою механізмів міжнародного-правового характеру.Практика постконфліктного врегулювання пов'язана з тим, що не всі суди однаково ефективні в покаранні винних за злочини, і кримінальне переслідування не завжди відбувається успішно. Офіційні процеси пошуку правди (truth-seeking), що стосуються розслідувань порушень минулого, стосуються комісій із встановлення правди (truth commissions). Ще одним важливим механізмом правосуддя перехідного періоду є політика пам'яті. Політика пам'яті як елемент правосуддя перехідного періоду охоплює роботу держав з історичним минулим.Поєднання державних заходів правосуддя перехідного періоду з використання ad-hoc інституцій дозволяє відновлювати справедливість у найбільш суперечливих вимірах збройних конфліктів. Пришвидшення миру відбувається в напрямі автономності та розширення мандатів інститутів перехідного правосуддя, організованої політики пам'яті, ефективної взаємодії національних та міжнародних інститутів щодо визначення їхньої юрисдикції в питаннях захисту прав людини, соціологічних досліджень потреб жертв збройного конфлікту. Оцінка ефективності механізмів правосуддя перехідного періоду можлива лише за умови врахування їхньої взаємопов'язаності, взаємодії з громадянським суспільством та державою.
