Abstract: Contemporary international society is characterized, among other elements, by its progressive humanization, which situates human beings at the centre of all international concerns. This conceptual approach, and the capacity of global health to situate itself transversally across multiple dimensions, means that health is a material domain that can become a central axis of international action and of International Law. In this paper are discussed, fi rstly, the international notion of health and its global character in a globalized world; secondly, are analysed certain key aspects concerning health as an object of cooperation and international regulation, particularly as it involves the United Nations and the World Health Organization (WHO). Finally, are presented some of the principal substantive dimensions of current international action in matters of global health. Este planteamiento conceptual y la misma capacidad de la salud global para situarse transversalmente en múltiples dimensiones configuran a la salud como un ámbito material que puede convertirse en un eje central de la actuación internacional y del Derecho Internacional. En este artículo se presenta, en primer lugar, una aproximación a la noción internacional de salud y a su carácter global en un mundo globalizado; en segundo lugar, se analizan algunos aspectos clave en relación con la salud como objeto de cooperación y regulación internacional, en particular en torno a las Naciones Unidas y a la acción de la Organización Mundial de la Salud (OMS); por último, se formula una rápida presentación de algunas de las principales dimensiones sustantivas de la actual actuación internacional en materia de salud global. Cette approche conceptuelle et la même capacité de la santé mondiale à être placé transversalement dans des multiples dimensions confi gure la santé comme un domaine matériel qui peut devenir une pièce maîtresse de l'action internationale et du droit international. Cet article présente, en premier lieu, une approche à la notion de santé internationale et sa nature global dans un monde globalisé; deuxièmement, sont discutés certains aspects référées à la santé comme un objet pour la coopération et la réglementation internationale, en particulier autour de l'Organisation des Nations Unies et de l'action de l'Organisation mondiale de la Santé (OMS); enfin, on fait une brève présentation de certaines des principales dimensions de fond de l'action internationale actuelle autour de la santé mondiale. This paper analyses legal interpretation in Private International Law. It focuseson the legal reasoning of Spanish judges when dealing with international disputes ofa private nature, without forgetting that they are also European Union judges. Afterdescribing the reduced scope of Codification in Private International Law, the paperattempts to clarify why interpretation in this area is more complex than in otherlegal domains: international objectives but with basically national means, a PrivateLaw focus and the development of European Union Private International Law aresome of the aspects that will be assessed in order to explain, briefly, the very creativerole of judges in looking for justice in each particular case. Finally, this paper dealswith methods of interpretation in Private International Law as well as the problemsof legal language and translation. ; El trabajo analiza los problemas de la interpretación jurídica en Derecho internacional privado. Se centra en el razonamiento jurídico de los jueces españoles cuando afrontan un litigio internacional de carácter privado, sin olvidar que son también jueces de la Unión Europea. Después de resaltar el reducido alcance de la Codificación en Derecho internacional privado, el trabajo intenta clarificar por qué la interpretación en este campo es más compleja que en otros ámbitos jurídicos: fines internacionales pero medios básicamente estatales, enfoque de Derecho privado, desarrollo del Derecho internacional privado de la Unión Europea, son aspectos, entre otros, que serán analizados para explicar, en definitiva, el papel particularmente creativo de los jueces en la búsqueda de la justicia en el caso concreto. Finalmente, se presta atención a los diferentes elementos de la interpretación en Derecho internacional privado así como a los problemas del lenguaje jurídico y la traducción.

El artículo resalta los aportes realizados por Hans Kelsen en temas relativos al derecho internacional y su conexión con la justicia, la filosofía política, la democracia y la teoría del Estado. En los años en que Kelsen trabaja para el Instituto Universitario de Altos Estudios Internacionales, elabora importantes estudios sobre el, en aquel momento, nuevo proyecto de Organización de Naciones Unidas. En este sentido, aparece una comparación entre la teoría del derecho internacional que elabora Kelsen y la que elaboró su discípulo Alfred Verdross. Por último, también aparecen desarrolladas cuestiones vinculadas a las relaciones existentes entre la Teoría Pura del Derecho y el derecho internacional. ; This article remarks the contributions made by Hans Kelsen in topics related with the international law and its connection with the issue of justice, politics philosophy, democracy and theory of State. In the years in which Kelsen was working for the International High Studies University Institute, he made some approaches to the, in that time, new project for the United Nations Organisation. The main purpose of this essay is to sustain the thesis of the priority application of international law over domestic law through a methodical and systematic interpretation of the Spanish Constitution of 1978. This qualification is not exclusive of the Spanish case. Constitutional systems such as that applicable in Germany before reunification, both in the Federal and in the Democratic Republic established the equivalence of general international law and domestic laws and, as the case may be, the prevalence of conventional international law. Although pertaining to a different legal system, mention should be made of English common law, so as to point that the Spanish Constitution is not an isolated and unusual case among homogeneous legal spaces, but follows a tradition common to almost all present legal systems. ; El presente ensayo tiene como finalidad principal exponer la tesis de la aplicación constitucional preferente del derecho internacional respecto del derecho interno, acudiendo a una interpretación metódica y sistemática de la Constitución española de 1978. Pero esta cualificación no es privativa del ordenamiento constitucional español. Sistemas como el alemán anterior a la reunificación, tanto de la República Federal como de la República Democrática, imponían la equivalencia del Derecho internacional general respecto a los ordenamientos internos y, en su caso, la prevalencia del derecho internacional convencional. Es pertinente citar, aunque pertenezca a un conjunto jurídico distinto, el caso del common law inglés y con eso queremos señalar que la Constitución española no es un supuesto aislado y extraño entre espacios jurídicos homogéneos, sino que sigue una tradición común a casi todos los sistemas jurídicos actuales.

History and its political, economical and social processes, marks a before and an after, they must be of interest to society because they represent a slight or radical change. For this essay, history is the main player that changes the international order, the processes of war in Europe began since 1517 with Martin Luther, considered as the starting point of the wars. In the beginning it was due to religion, but afterwards it moved towards the struggle for trade and territories until its ending with the Peace of Westphalia that determines the principles of the international order that still persist nowadays. Wars despite being the most violent and tragic method of conflict resolution it left something good, and that's how the so called "Great War" gave birth to League of Nations that by the time was somewhat inconceivable because there had never been a supra-stately entity that could compared to it, in the same context, organizations, sovereignty, self-determination, the importance of international peace, all fruits of "The Great War" and even though such peace was not lasting, it served as a fundamental basis for the birth of the United Nations entity of public international law whose purpose is to preserve international peace and security, either voluntarily or by being coerced. ; La historia, así como sus diversos procesos políticos, económicos y sociales, marcan un antes y un después, deben ser de interés para la sociedad pues suponen un cambio ya sea leve o radical. Para este artículo, la historia es el actor principal que modifica el orden internacional; los procesos de guerra en Europa inician desde 1517 con Martin Lutero, considerado como el punto de partida de las guerras. En sus inicios fue por la religión, pero posteriormente, transitó hacia la lucha por el comercio y territorios hasta culminar con la paz de Westfalia, que determina los principios del orden internacional que aun hoy en día persisten. Las guerras, pese a ser el método de resolución de conflictos más violento y trágico deja algo bueno, y así fue como la llamada "Gran Guerra" gestó el nacimiento de la Sociedad de Naciones que para la época era algo inconcebible, que jamás había existido un ente supraestatal que se le comparara; en este mismo contexto surgen las organizaciones internacionales, de la soberanía, de la autodeterminación, de la importancia de la paz internacional, todos frutos de la "Gran Guerra" y aunque la paz no fue duradera, sirvió como base fundamental para el nacimiento de Naciones Unidas, ente del Derecho Internacional Público cuyo propósito es preservar la paz y la seguridad internacional, ya sea de manera voluntaria o siendo coaccionado.

The economic, commercial and financial blockade imposed on Cuba by the government of the United States of America since the first years of the Cuban Revolution has caused the loss of commercial opportunities, the limitation of exports of merchandise and access to them. An analysis analysis of the most important legal instruments that constitute this policy demonstrates its incompatibility with many principles endorsed in the United Nations charter and the norms of Public International Law. ; El bloqueo económico, comercial y financiero impuesto a Cuba por parte del gobierno de Estados Unidos de América desde los primeros años de la Revolución Cubana ha provocado la pérdida de oportunidades comerciales, la limitación de exportaciones de mercancías y el acceso a las mismas. Un análisis de los instrumentos jurídicos más importantes que justifican esta política, demuestra su incompatibilidad con los principios refrendados en la Carta de las Naciones Unidas y las normas del Derecho Internacional Público.

The study of a national frontier in International Law, covers an ambit of the state and its territorial component. The key assertion according to which once agreed, the boundary stands -"for any other approach would vitiate the fundamental principle of the stability of boundaries-", leads to consideration of other issues related to the title and its consolidation.The value of geography, politics and history provide a better consideration of the frontier phenomenon. ; El estudio de la frontera nacional en el Derecho Internacional, abarca un ámbito propio del Estad y su componente territorial. La frase clave según la cual una vez acordado un límite este permanece –en cuanto otra fórmula afectaría el principio de la estabilidad de la frontera−, trae a consideración cuestiones relativas al título y su consolidación, y al valor de la geografía, la política y la historia en la comprensión del fenómeno limítrofe.

Cabe decir que el sistema de Derecho internacional privado actual tiene su génesis histórica en la modernidad y que muchos de sus postulados y, en particular, entre ellos, la pretensión de universalidad, esto es, de soluciones universales (F.K. von Savigny), válidas incluso en el caso de la existencia de una pluralidad de ordenamientos en presencia (como sucede en el caso de las situaciones privadas internacionales) se configuraron en dicha época. No obstante, se constata una evolución, que ha tenido su reflejo, entre otras manifestaciones, en el empleo de una pluralidad de técnicas de reglamentación para dar respuesta a las referidas relaciones de tráfico externo, de la que se da cuenta en el presente estudio. ; Private International Law is rooted in "modernity" and most of its postulates, specially the universalist paradigme (Savigny), come also from this period. The universalist myth was available even in the case of a private international relationship linked with different legal systems. But, nowadays, one can find another kind of trend that consists on a plurality of regulation methods for solving the questions that arise in relation with those private international relationships. This article tries to explain the changes that are taking place in private international law systems and the influence into this subject of the postmodernist ideas.

The evolution of international society invites us to analyze whether the new heterogeneous multipolarity and globalization are complementary or contradictory realities, and whether international law is a law in transition or in transition. It is not surprising that international law has been challenged in its formulation and conditioned in its application, leading to a contradictory process of transformation. The unity of the legal system is also questioned theoretically and practically by political-ideological and cultural-religious differences. The study and teaching of international law should not be presided over by formalistic interpretation, ideological justification or political pragmatism, but by intellectual concern, scientific honesty and moral commitment. ; La evolución de la sociedad internacional invita a analizar si la nueva multipolaridad heterogénea y la globalización son realidades complementario o contradictorias entre sí, y si el Derecho internacional es un derecho de transición o está en transición. No resulta sorprendente que el Derecho Internacional se haya visto cuestionado en su formulación y condicionado en su aplicación provocando un contradictorio proceso de transformación. También la unidad del ordenamiento jurídico queda cuestionada teórica y prácticamente por diferencias político-ideológicas y las culturales-religiosas. El estudio y enseñanza del Derecho Internacional no debería estar presidido por una interpretación formalista, la justificación ideológica o el pragmatismo político, sino por la inquietud intelectual, la honestidad científica y el compromiso moral.

The aim of the article is to discuss the methodological problems and foundations of private international law. The existence of legislative diversity imposes the needto find an adequate solution to factual assumptions with foreign elements; throughout history and Comparative Law it has been possible to give answers, but they are not the same everywhere, therefore, it hasbeen sought to achieve a unification which has not been easy. As for the content, the research is based on legal texts such as the National Constitution of the Bolivarian Republic of Venezuela(1999), the Venezuelan Private International Law Law Law Law, and the doctrine of authors such as Guerra (2007), among others. From the methodological point of view, the research is ofa documentary type, since it was based on the collection, analysis and interpretation of the data contained in legal documents and doctrine. The results showed that, at present, there is a predominance of the bilateral method, which derives from the functioning of bilateral conflictrules. ; El objetivo del artículo consiste en debatir los problemas metodológicos y los fundamentos del derecho internacional privado. La existencia de la diversidad legislativa impone la necesidad de encontrar una solución adecuada a los supuestos de hecho con elementos extranjeros; a través de la historia y del Derecho Comparado ha sido posible dar respuestas, pero las mismas no son iguales en todas partes, por lo tanto, se ha buscado lograr una unificación la cual no ha sido fácil. En cuanto al contenido, la investigación se apoya en textos legales como la Constitución Nacional de la República Bolivariana de Venezuela (1999), Ley de Derecho Internacional Privado Venezolana, y la doctrina de autores como Guerra (2007), entre otros. Desde el punto de vista metodológico la investigación es de tipo documental, ya que se basó en la recolección, análisis e interpretación de los datos contentivos en documentos legales y en la doctrina. Los resultados demostraron que, en la actualidad, hay un predominio del método bilateral, el cual deriva del funcionamiento de las normas de conflictos bilaterales.
