The heated political debate on aggressive tax practices of multinational entities starts to produce tangible outcomes. On 7th of June 2017 Finland signed the so-called "Multilateral Convention to Implement Tax Treaty Related Measures to Prevent Base Erosion and Profit Shifting" (MLI). Certain rules related to the abuse of tax treaties will, as a result, start to become applicable soon. They can be seen as quite disruptive in international tax law. Hence, it appears worthwhile to present them to a broader audience. The reader will be introduced into the topic via a short outline of the flaws in the current international tax system leading to concerns on international (OECD, UN) and supranational (EU) level. Embedding it into the bigger picture of action against "Base Erosion and Profit Shifting", the MLI and one of the Finnish choices – the Principal Purpose Test – will be elaborated. The article aims to assess the impact of this provision on Finnish tax treaty practice. It will be shown that, with respect to different occasions, the Principal Purpose Test leads to consequences considerably stricter than provided for by current rules. By itself, this was subject to severe critique in specialist literature. Furthermore, it raises a number of dogmatic problems. In this context the author attempts to provide for an interpretation of the provision towards alleviating its effects. The first two chapters are meant to give non-tax specialists some background information. They can be widely skipped by readers familiar with the subject. Due to space limitations constitutional law and European law questions are not within the scope of the investigation. Also, the analysis of Sec. 28 VML does not reflect the discussions held in scholarship in detail. Im europäischen Kartellrechtsverständnis vollzog sich in den vergangenen Jahren der Wandel von einem ordoliberal geprägten, marktstrukturellen Kartellrechtsverständnis zu einem zunehmend auswirkungsorientierten, auf ökonomisierten Grundlagen basierenden Ansatz (sog. "More economic approach"). Während sich die Europäische Kommission und die Literatur bereits verstärkt mit den Auswirkungen dieses Wandels auf die Tatbestandsseite des Art. 102 AEUV beschäftigt haben, sucht man eine vergleichbare Auseinandersetzung mit Abhilfemaßnahmen nach Art. 7 VO 1/2003 auf der Rechtsfolgenseite bisher noch vergebens.Die Arbeit setzt an diesem Punkt an und entwickelt einen Leitfaden, der die Umsetzung des durch den "More economic approach" beeinflussten erweiterten Schutzzweckverständnisses im Rahmen der Abhilfepraxis auf systematische Art und Weise ermöglicht und dadurch die vollumfängliche Umsetzung des gewandelten Schutzzweckverständnisses in der Entscheidungspraxis erleichtern soll

Die gegenwärtige Transformationsforschung zu demokratischen politischen Regimen zeichnet sich durch einen Gegensatz zwischen den traditionellen Modernisierungs- und Strukturtheorien einerseits und den Akteurs- und Prozeßanalysen andererseits aus. Um diesen Gegensatz zu überwinden, wird im vorliegenden Beitrag ein theoretischer Rahmen entwickelt, mit dessen Hilfe die beiden Ansätze integriert werden können. Der Autor betrachtet die Entstehung und Stabilisierung von demokratischen Regimen aus einer akteurtheoretischen Perspektive, wobei die Mobilisierung und Organisierung von Bevölkerungssegmenten zu organisierten kollektiven Akteuren im Rahmen ihrer jeweiligen politischen Interessen im Mittelpunkt stehen. Die Eliteninteressen und -strategien werden in ihrem Verhältnis zu den jeweils relevanten Bevölkerungsgruppen untersucht und an einem empirischen Beispiel über das Abstimmungsverhalten von Abgeordneten im preussischen Abgeordnetenhaus anlässlich einer Abstimmung über die Einführung des allgemeinen, gleichen Wahlrechts in Preußen im Jahre 1918 verdeutlicht. Es wird vor allem danach gefragt, welchen demokratisierenden Gehalt eine derartige Wahlrechtsänderung gehabt hätte und ob die den einzelnen Bevölkerungssegmenten zugeschriebenen sozial konstruierten Interessen das Abstimmungsverhalten der Abgeordneten erklären können. The Palestinian Authority has established various mechanisms to monitor its security forces and hold them accountable over human rights violations. This article explores and assesses the accountability measures that deal with the human rights abuses arising from the excessive use of force in light of international standards, particularly human rights treaties that Palestine has acceded to in recent years. The use of force may occur in different contexts, including during demonstrations, while enforcing the law against criminal acts, searches, lawlessness, in detention, interrogation, investigation and in prisons. The article traces the accountability processes that arise in such circumstances. Alongside reviewing domestic legislation and cases as well as citing relevant literature, the article employs empirical qualitative field research approach by conducting a series of interviews with senior security officials, particularly top commanders and those in charge of accountability within the government and security agencies along with NGOs, experts, academics and field-based international institutions.

This book looks at the past, present and possible future relationship between the EU and the UK in the fields of law enforcement and judicial cooperation in criminal matters. It examines successively the EU-UK relationship prior to 1 February 2020; the relationship during the transition period; the relationship after the end of the transition period. The book analyses the relevant provisions of the Withdrawal Agreement, the Political Declaration, of the EU and UK negotiating mandates and draft legal texts, and the state of play of the negotiations. It looks at the possible forms that the future cooperation can take and the likely areas, which might be covered, such as cooperation with Europol and Eurojust; criminal records; DNA, dactyloscopic and vehicle registration data; passenger name records; surrender procedures, and mutual legal assistance. It also analyses the overarching issues of protection of personal data and the future role of the Court of Justice of the EU. Finally, this book puts forward some ideas on the possible impact of Brexit on security cooperation within wider Europe and on the possible emergence in future of a European Security Union within wider Europe. The volume is aimed at practitioners and academics in European Studies, International Relations, and Law.
