Relevant Issues of Combating Corruption in Ukraine
Since Ukraine is passing not just a stage of democratization of the state system, but is carrying out a radical transformation of the economic and political system, the legal and social systems, the increase in the level of corruption is an objective conditioned factor. In Ukraine, corruption is one of the problems that needs immediate resolution. This poses a significant threat to democracy, the rule of law, social progress, national security, and the emergence of civil society. Therefore, creating an effective system for preventing corruption, developing and implementing a set of organizational and legal measures to counteract this phenomenon, identifying and overcoming its social preconditions and consequences should become one of the priorities of the state and its policy. The specificity of counteraction to corruption requires, first of all, the regulatory and legal establishment of a complex, harmonized system of preventive measures, which must be developed by various branches of legislation, including the administrative one. Therefore, the issue of counteracting corruption is extremely urgent, as it is also important to tackle one of the most urgent problems - overcoming corruption, as an extremely negative phenomenon in a society that undermines public confidence in the government, diminishes the prestige of the state in the international arena, distorts political competition. The article examines current legislative initiatives aimed at combating corruption in Ukraine. The results of sociological surveys on the attitude of Ukrainians to corruption are analyzed. The experience of combating corruption in European countries is presented. Positive features of such experience and possibility of its application in Ukraine are defined. It is concluded that the goals of anti-corruption policy in Ukraine should be to reduce the level of corruption and to protect the rights and legitimate interests of citizens, society and the state against threats related to corruption. POLITICAL ADVERTISING: SOME ISSUES OF LEGAL SUPPORT

The article examines some issues of legal support of political advertising during the process of election, but is not limited to it, as well as how they affect the outcome of elections. In this study comparative, observation, dynamical analogies, analysis methods are used. The author compares the current legislation of Ukraine and the legislation of a number of other European countries and identifies their common and distinctive features.
Special attention is given to the political advertising law of Poland, as its closest neighbour. Also, the legislation of France, Germany and Great Britain is examined. The article underlines their main differences. Partial and systematic violations of advertising legislation during the electoral process and during the period between the elections are also identified.
The article also shows that the issue in question is not fully studied by legal scientists. The research, in particular, emphasises on the lack of comprehensive definition of political advertising and its legal regulation during the period between the elections. The article draws attention to the incorrectness in law legal regulation of political advertising by the laws regulating commercial advertising. The legal acts, that influence the results of elections are specified, in particular, the author pays attention to the state budget funding for political parties. Reducing Government expenditure can preserve the principle of absolute equality among political actors, so they could participate constructively in the elections. The best thing to do considering the circumstances is to adopt a new law on political advertising or to to amend the existing Act, that regulates advertising in general. As a result, it is proved that political advertising is not limited to the electoral process and must be governed by legislation. The article also states that any law in this area also should comply with international law, especially with acts adopted by the European Union.
Some Issues of Gender Discrimination in Labour Relations
The article analyzes various aspects of gender equality which are stipulated in legislation regulating labour relationship. The author aims to research various aspects of discrimination by gender in labour relations, to identify and analyze the major problems which prevent counteraction to gender discrimination in labour law. One of the main priorities in development of Ukrainian legislation is to ensure gender equality not only in labour relations but also in other spheres of public life. That is why persons who enter labour relationship expect the state to ensure the principle of equality which prohibits discrimination. For better understanding of the problem the article provides a short theoretical analysis of the problem as well as lists national and international legislation which nowadays ensures equality of rights based on gender. The author also the draft law of a new Labour Code which is not under consideration of the Verkhovna Rada of Ukraine but is still important to be researched from historical perspective. In order to analyze the compliance with principle of equality in labour law the article has analyzed various types pf labour relationship between the employer and the employee or a future employee. The author also investigates pre-labour relationship which is undergoing the interview and advertisement (placement of vacancies). It is essential to mention that the article has also analyzed the means for ensuring the principle of equality in labour relationship by the state. It is noteworthy to state that important and actual problems which should be solved and regulated have been identified during such kind of an analysis. Some issues of legal regulation of political advertising
For the first time in Ukraine, the definition of «political advertising» is reflected in the Law of Ukraine «On Elections of People's Deputies», so far only on the basis of the definition of «advertising» in the Law of Ukraine «On Advertising» it was possible to qualify political advertising as any information about political actors, political parties, designed to raise awareness of their activities. The mechanism of legal regulation of political advertising involves the development and adoption of national laws and regulations governing public relations arising in the process of production, placement, distribution of political advertising, because in this case may affect the interests of society and the state as a whole. Today the issue of political advertising is regulated by several legal acts, in particular in Article 1 of the Law of Ukraine «On Advertising» provides only the definition of such advertising without details, the Law of Ukraine «On Local Elections», the Law of Ukraine «On Elections of Deputies of Ukraine», the Electoral Code Ukraine's norms stipulate the peculiarities of campaigning in the form of political advertising, some restrictions on campaigning, etc. Therefore, the legislation should be characterized by the dispersion of norms on such advertising and inconsistency in the definition of «campaigning» and «political advertising. STRATEGIC ISSUES OF PUBLIC GOVERNANCE IN SPORTS DEVELOPMENT IN UKRAINE
Introduction. Commitments adopted by the Verkhovna Rada and the Cabinet of Ministers of Ukraine have little influence on the development of sport for all and Olympic sports for higher achievements. The post is devoted to the results of studying the content of legislative and regulatory acts governing the development of sports in Ukraine. The reason for the extremely unsatisfactory implementation of the adopted legislative and regulatory acts is in the unwillingness of public institutions to make major efforts to ensure the real growth of sports development indicators. Aim of the study is to identify the existing issues of public administration, which cause insufficient rates of improvement of the state of sport for all and Olympic sports of higher achievements, to prevent these problems in the future. Material and methods: literature analysis, analysis of documents, synthesis, abstraction. The research was conducted during april-august 2020. Results. The analysis shows that the adopted legislative and regulatory acts do not contribute to the development of the sphere. This is due to the fact that a large part of their content is marked by the declarative nature and lack of established standards which does not allow to control their implementation. Such a negative factor will affect the activities of the public administration which will be in charge of taking care of the development of the sport. Conclusion. The current state of governance in the field of sports is critical and is not conducive to making positive changes in this important humanitarian field. We will have to create more sophisticated legislative organization and financial tools for improvement of the state of sports. ; Актуальність. Мета дослідження: визначити наявні проблеми державного управління, які зумовлюють недостатні темпи покращення стану не лише спорту для всіх, а й спорту вищих досягнень, з метою не допустити в подальшому. Матеріал і методи: теоретичний аналіз літературних джерел, аналіз документальних матеріалів, синтез, абстрагування. Дослідження проведене протягом квітня‒серпня 2020 року. Результати. Проведений аналіз свідчить, що ухвалені законодавчі та нормативні акти спрямовані на розвиток сфери спорту, не реалізовуються суттєво й дієво. Це відбувається, оскільки значній частині їх змісту притаманна декларативність і відсутність встановлених норм, що не дозволяє контролювати їх виконання. In this article the aspects of migration law and modern demography problems of Ukraine are highlighted. The conclusion is made, that law aspects as a whole follow the problems of demography and migration processes in time, while governmental mechanisms of migration regulation fall behind substantially and do not work to overtaking of existing challenges. KEY ISSUES OF UKRAINIAN TOUR OPERATING ; ОСНОВНІ ПРОБЛЕМИ УКРАЇНСЬКОГО ТУРОПЕРЕЙТИНГУ
The article characterizes the historical aspects of the emergence and development of tour operating as a type of business which is fundamentally new in Ukraine. The dynamics of changes in the number of tour operating companies as well as the reasons for the bankruptcy of some of them are analyzed, the main problems hindering the tourist activity are examined, particularly in outbound tourism. The author assesses the seriousness of threats to Ukraine business caused by emanating from the dramatic changes in legislation and independent tourism being actively developed. Results of researches testify to existence of a number of problems, main from which are: instability of tax system, insuffi cient support from the state, lack of favorable conditions for development of tourism industry, including the state investment policy in the sphere of tourism, lack of a holistic and complex command and control system of use of tourist and recreational resources of the country, diff erent departmental submission of tourist, resort and recreational resources, lack of eff ective system of protection of the rights and interests of tourists, providing a safe environment on objects of tourist visits and directions of tourist routes, a lack of own funds at the tourist enterprises, insolvency of consumers of tourist services, imperfection of legal acts regulating tourist activity, an unsatisfactory status of tourism infrastructure, defi ciency of investments, poor quality of a national tourist product and so forth. ; У статті дано характеристику аспектам виникнення і розвитку туро- перейтинга як принципово нового для України виду комерційної діяльності. Аналізується динаміка змін кількості туроператорів, а також причини бан- крутства деяких із них, досліджуються основні проблеми, які заважають туро- ператорській діяльності, зокрема в сфері виїзного туризму. Автор дає оцінку сер- йозності існування туроператорів, ви- ходячи з кардинальних змін у законодав- стві та із проблеми активного розвитку самостійного туризму, що несе реальну загрозу розвитку туристичного бізнесу. Здійснено дослідження стану розвитку туроператорських підприємств України на сучасному етапі. Результати роботи свідчать про існування низки проблем, го- ловними з яких є: недостатня підтримка з боку держави, відсутність сприятли- вих умов для розвитку туристичної галу- зі, в тому числі державної інвестиційної політики у сфері туризму, різне відомче підпорядкування туристичних та ку- рортно-рекреаційних ресурсів, відсут- ність ефективної системи захисту прав та інтересів туристів, нестача власних грошових коштів у туристичних підпри- ємств, неплатоспроможність спожива- чів туристичних послуг, недосконалість правових актів, що регулюють турис- тичну діяльність.

XBRL reporting standard: implementation issues ; Проблеми впровадження стандарту звітності XBRL
The advent of electronic reporting has necessitated the use of a universal reporting standard. One of the trends in reporting development is the use of the popular XBRL format in most countries of the world. The article is devoted to the disclosure of the implementation of the XBRL reporting standard in Ukraine. For this purpose, the emergence of XBRL is briefly described, as well as its potential distribution in different countries of the world is evaluated. Based on the research of scientific works, as well as taking into account practical experience, the advantages from the implementation of XBRL are summarized for such user groups as government agencies, investors and company management. Taking into consideration the expectations of reporting users, the conditions of the implementation of XBRL are critically evaluated.This allowed us to distinguish four groups of issues: organizational (insignificant number of properly trained specialists); regulatory (approval of mandatory certification of software and specialists); software and hardware (deficiencies in the financial reporting system); financial (significant costs for the implementation of the XBRL standard). Their presence is also confirmed by the fact that the presentation of financial statements on the basis of a taxonomy according to international standards in electronic form for the reporting 2020 was postponed to 2021. The main directions of ensuring the effectiveness of the implementation and use of the XBRL format are identified, in particular the improvement of legal regulation, the development of telecommunications and its infrastructure, the training of specialists in the field of XBRL and IFRS as well as the ensuring the openness and transparency of enterprises and government bodies. ; Поява електронної звітності зумовила потребу використання універсального стандарту звітності. Однією з тенденції розвитку звітності є використання у більшості країн світу популярного формату XBRL. Статтю присвячено розкриттю особливостей впровадження стандарту звітності XBRL в Україні. З цією метою коротко описано появу XBRL, а також оцінено його можливості поширення в різних країнах світу. На основі дослідження наукових праць та з огляду на практичний досвід узагальнено переваги від реалізації XBRL для таких груп користувачів, як державні органи, інвестори та керівництво підприємства. Враховуючи очікування користувачів звітності, критично оцінено умови впровадження XBRL, що дозволило виокремити чотири групи проблем: організаційні (незначна кількість належним чином підготовлених фахівців); нормативно-правові (затвердження обов'язкової сертифікації програмного забезпечення та фахівців); програмно-технічні (недоліки у Системі фінансової звітності); фінансові (значні витрати на впровадження стандарту XBRL). Їх наявність підтверджується і тим фактом, що подання фінансової звітності на підставі таксономії за міжнародними стандартами в електронній формі за звітний 2020 рік було перенесено на 2021 рік. Визначено основні напрями забезпечення ефективності впровадження і використання формату XBRL, зокрема, удосконалення нормативно-правового регулювання, розвиток телекомунікаційного зв'язку та його інфраструктури, підготовка фахівців у сфері XBRL та МСФЗ, а також забезпечення відкритості та прозорості діяльності підприємств та державних органів.

CURRENT ISSUES OF IMPROVEMENT OF UKRAINIAN LEGISLATION IN THE FIELD OF HEALTHCARE

The article is dedicated to the issues of legal medical sphere regulation in Ukraine. The purpose of the article is to study current issues of improving the Ukrainian legislation in the field of health care, to identify existing problems and outline the ways to solve them.The study of legal phenomena and legal categories was carried out through using general and special legal methods of cognition, namely: classification method, modeling, specific-statistical, systematical-structural, comparative-legal, formal-legal, dialectical and other methods of scientific analysis according to the research subject. Conclusions. The article asserts that for the effective reform of the medical sector and for sufficient protection of legal entities' rights and freedoms in the health care field, a high-quality regulatory framework is needed. It has been proven that the improvement of the current healthcare legislation is complicated by the complex essence of legal relations in this area and the lack of a clear and systematic approach. It is substantiated the expediency of passing the special consolidated legislative act with a clear internal structure – the Medical Code of Ukraine. The author proposes to amend provisions regulating the protection of personal data, epidemiological surveillance and infection control. The adoption of the law on medical self-government and development of modern industry standards for medical care is substantiated. The problems of industry staffing, as well as the lack of strategic documents for the training for health workers and imperfect instructions for managers of several health care institutions are analyzed. The author also identifies the main problems of personnel policy in the healthcare. The author specifies the necessity to unite the efforts of scientists and practitioners in the medicine and jurisprudence for solving all the individual problems on improving the regulatory framework in the field of health care. Recognition of Decisions of General Meeting of Companies Invalid: Problem Issues
The work is devoted to the research of problematic issues of recognition of decisions of the general meeting of a company as invalid as a special way of protecting the corporate rights of participants of the respective company. In addition, the decision of the general meeting, in turn, is also a way of influencing the participants in the direct activities of the company, by exercising their right to management provided for in corporate law. The issues regarding the terms of appeal against the decisions of the company meeting are analyzed, namely: 1) the companies with limited liability and additional liability have not been set exact terms, so we should be guided by the provisions of the Civil Code of Ukraine; 2) no law contains information about the possibility of renewal of the statute of limitations, so again it is necessary to refer to the provisions of the CCU; 3) is not fixed at the legislative level and the validity of the reason for missing the general meeting. Holding a general meeting is an important process in any business community, as it is now the only way for participants to influence the affairs of the company. As is well known, any phenomenon has ways of managing the negative consequences, including the protection of corporate rights of members of companies. Therefore, one of the important ways of protecting such rights is to declare the decisions of the general meeting invalid, which in turn is one of the special ways of protecting the rights and interests of the founders or participants (shareholders) of companies. To appeal against the decisions of such a collegial body of a company as a general meeting (hereinafter referred to as a meeting), vested solely with the members of the respective industry who had such status at the time of the contested decision. Temporary access to things and documents: problematic issues of law enforcement
The article explores the issues of the victim's involvement in the process of obtaining temporary access to things and documents. The current legislative provisions were analyzed, according to it only the parties to criminal proceedings have the right to appeal to the investigating judge during the pretrial investigation or the court during the court proceedings requesting temporary access to things and documents. It is established that when a victim is not a part of the criminal proceedings, he is not empowered to apply to the investigating judge with a request for temporary access to things and documents. However, the practice of applying the law evidences about application another one approach to the solution of this issue, in particular, the existing court decisions on granting the investigative judge permission to the victim to temporary access to things and documents. This practice has led the Supreme Court to find that there is a lack of clarity, uncertainty about the legal rules regarding the victim's status and his rights in criminal proceedings, which constitutes an exclusive legal problem. In order to resolve this issue and to ensure the development of the law and the formation of a single law enforcement practice, the panel of judges concluded that it was necessary to refer the criminal proceedings to the Grand Chamber of the Supreme Court.
