Summary: In the context of the development of the so-called environmental state of law: there is an interesting aspect at ius-philosophical level that takes place directly on the basis of the commitments made by the judges: the value of human dignity in relation to environmental care. This work is intended to demonstrate how respect for dignity is at the heart of the interpretative work and constitutes a guiding criterion in judicial decision-making in recent years of the Supreme Court of Justice of the Argentine Nation concerning the right to drinking water and the protection of water resources. ; Resumen: En el marco del desarrollo del denominado "Estado ambiental de derecho" existe un aspecto interesante a nivel iusfilosófico que tiene lugar directamente sobre la base de los compromisos asumidos por los jueces: el valor de la dignidad humana en relación con el cuidado del ambiente. Este trabajo se propone demostrar cómo en la jurisprudencia de los últimos años de la Corte Suprema de Justicia de la Nación argentina, concerniente al derecho al agua potable y la protección de los recursos hídricos, el respeto de la dignidad se encuentra en el centro de la labor interpretativa y constituye un criterio rector en la toma de decisiones judiciales.

The Constitutional Court of Colombia, created by the Political Constitution of 1991 to guarantee the protection of fundamental rights and respect for the Constitution, has developed, from its constitutional interpretation, a protective and creative jurisprudence of new rights, extending its judicial competences putting them very close to the legislative ones. For 26 years, the Court has been applying an interpretative typology found in its judgments, which shows advances in the defense of the constitution and the protection of fundamental rights. This article will try to explain the types of interpretation applied by Colombian Constitutional Court. ; El Tribunal Constitucional de Colombia, creado por la Constitución Política de 1991 para garantizar la protección de los derechos fundamentales y el respeto a la Constitución, ha desarrollado a partir de su interpretación constitucional, una jurisprudencia protectora y creadora de nuevos derechos, extendiendo sus competencias judiciales poniéndolas muy cercas a las legislativas. Legal interpretation is discovering the solution to the given cases in accordance interpretation with the law now in force. Interpretation is always necessary since there are no clear cases and those who have the task of deciding the interpretation of the law are the judges and civil servants who have to resolve the cases presented to them for their consideration. This characteristic underlines that legal interpretation is the search for a solution based on equity. Another of the tasks of interpretation is the solution of conflicts and, in this sense, the appeal to principles and the logic of reason provides the acceptable solution. This dialectic among the legislature, the judges, the doctrine and public opinion make up the life of the law, in this way reconciling stability and change. ; La interpretación jurídica consiste en descubrir la solución en los supuestos dados con arreglo al derecho vigente. La interpretación es siempre necesaria porque no existen casos claros y a quien incumbe la tarea de decidir la interpretación del derecho es a los jueces y funcionarios, al resolver los casos que se presentan a su consideración. Una característica destacable de la interpretación judicial es la búsqueda de una solución basada en la equidad. Otra de las tareas de la interpretación es la solución de conflictos y, en este sentido, el recurso a los principios y a la lógica de lo razonable suministra la solución aceptable. Esta dialéctica entre el legislativo, los jueces, la doctrina y la opinión pública constituyen la vida del derecho, conciliando de este modo la estabilidad y el cambio.
The article is devoted to the study of the essence of constitutional law, together with judicial guarantees, their interpretation and normative consolidation in international legal acts and national regulations, as well as to the clarification of the place of the right to a fair trial in human rights. Thanks to the use of a system of general scientific and special scientific concepts and methods, it was established that the conceptualization of the right to a fair trial was given by the European Convention for the Protection of Human Rights and Fundamental Freedoms and, moreover, is reflected in the precedent practice of the European Court of Human Rights. In this context, characteristic features of the right to judicial guarantees are defined, its procedural and functional components are distinguished, and procedural and substantive justice are characterized. Everything allows concluding that, the characteristic features of the constitutional right to a fair trial in a state governed by the rule of law are defined as: the perceived ability of a person to exercise the specified right; the presence of a special subject-object structure; appropriate actions in specially created state judicial institutions to restore violated rights.
El marco normativo sobre inmigración por razones familiares pueden afectar de manera desproporcionada y negativa a las mujeres inmigrantes y a sus derechos, produciendo efectos de género. En algunos casos, estos efectos están conectados con la imposición legislativa y judicial de modelos de familia que son muy difíciles de satisfacer (por ejemplo, el modelo de 'buena madre', el de proveedor único, o el basado en una rígida distinción entre el trabajo productivo y el reproductivo). En otros casos, dichos efectos se deben a la subestimación de las dificultades y necesidades específicas de las mujeres inmigrantes, en sus familias y en el más amplio contexto normativo y social del país de acogida. Para revelar y corregir eficazmente estos efectos de discriminación indirecta, en este artículo propongo una visión alternativa del derecho a la vida familiar de la mujer inmigrante, como conjunto de derechos y titularidades más que como derecho mono-dimensional. Como enfoque teórico, esta construcción permite poner de manifiesto, de manera eficaz, las complejas experiencias de las mujeres inmigrantes en el espacio jurídico europeo. También posibilita desvelar los efectos de género que no se derivan de normas individuales, sino que son producto de la interacción de normas tradicionalmente atribuidas a diferentes ámbitos del derecho (como por ejemplo el derecho migratorio y el derecho penal). Como estrategia judicial, esta visión posibilita que los tribunales supranacionales y nacionales se aproximen a las mujeres inmigrantes como sujetos en contexto, y nosólo como personas aisladas. Esta interpretación judicial, atenta al contexto familiar, social, y normativo en el que viven las mujeres inmigrantes, se puede definir como interpretación contextualizada. Ella tiene un gran potencial para neutralizar los efectos de género de carácter negativo derivados de ciertas normas que regulan la inmigración por razones familiares. Para ilustrar estos extremos, este artículo analiza distintos ejemplos judiciales significativos ofrecidos por el Tribunal Europeo de los Derechos Humanos (TEDH) y por las jurisdicciones nacionales de países con una incidencia particularmente alta de mujeres inmigrantes (Italia y España). ; At all normative levels, family migration law can disproportionally and negatively affect immigrant women's rights in this field, producing gendered effects. In some cases, such effects are related to the normative and judicial imposition of unviable family-related models (e.g., the ʻgood mother ̕ the one-breadwinner family, or a rigid distinction between productive and reproductive work). In other cases, they are due to family migration law's overlooking of the specific needs and difficulties of immigrant women, within their families and in the broader context of their host countries' social and normative framework.To effectively expose and correct this gender bias, in this article I propose an alternative view of immigrant women's right to family life, as a cluster of rights and entitlements rather than as a mono-dimensional right. As a theoretical approach, this construction is better equipped to capture the complex experiences of immigrant women in the European legal space, and to shed light on the gendered effects generated not by individual norms but by the interaction of norms that are traditionally assigned to separated legal domains (e.g., immigration law and criminal law). As a judicial strategy, this understanding is capable of prompting a consideration by domestic and supranational courts of immigrant women not as isolated individuals, but as 'individuals in context'. I shall define this type of approach as 'contextual interpretation', understood as the consideration of immigrant women in the broader contexts of their families, their host societies and the normative frameworks applicable to them. Performed in a gendersensitive manner, a contextual judicial interpretation has the potential to neutralize the gendered effects of certain family migration norms. To illustrate these points, I will discuss selected judicial examples offered by the European Court on Human Rights, as well as from domestic jurisdictions of countries with a particularly high incidence of immigrant women (Italy and Spain).
The introduction of the human rights in the Constitutions, that is the main characteristicof the Constitutional states, has given an important role to ConstitutionalCourts because they are responsible for protecting and interpreting those rights. Thisrole assigned to judges has been discussed because it means a restriction to the decisionsthat can be adopted by a political majority. In this paper, the characteristics ofthe tension between democracy and constitutionalism will be studied and it will beargued that judicial power can be a guarantee of democracy if we understand its roleas an interpretative role of the contents of the Constitution. ; La inclusión de los derechos humanos en los textos constitucionales, principal característica de los Estados constitucionales, ha otorgado mucho protagonismo a losTribunales Constitucionales, que son los encargados de custodiar e interpretar elalcance de tales derechos. Se ha cuestionado esta función del poder judicial por seruna restricción a la decisión de las mayorías políticas. En este trabajo, se analizan las características de la tensión entre constitucionalismo y democracia y se intenta ver como el poder judicial puede entenderse como una garantía a la democracia al ser sutarea principalmente interpretativa a partir de lo contenido en el propio texto constitucional.
The idea of a Republic needs a judiciary independent, impartial, honest and able to solve the cases according to the law and to check and balance the other two branches by constitutional control. But this ideal is hard to put into practice. Firstly, there is a political pressure on the judiciary, especially on the way to select its members. Secondly, principles and neo-constitutionalism expect from the judges, by way of interpretation, a legislation-like function, on a general scope, the judicial organization is not designed to fulfil. The root of this problem is philosophical: our society attributes to the act of evaluation an ontological nature which entails some method to determine the truth of subjective sentences. To escape from this complication is possible, though difficult; but to do so it is necessary to encourage within the law a revolution similar to the Copernican one. ; Fil: Guibourg, Ricardo A. Pero realizar este ideal es difícil. Primero, por la constante presión política sobre la institución judicial, empezando por el modo de selección de los jueces. Segundo, porque el principialismo y el neoconstitucionalismo imponen a los magistrados, por vía de interpretación y de la garantía de los derechos, una función de tipo legislativo con alcance general, para la que la organización judicial no está diseñada. The article introduces the emergence of the Right to Work in an Economical and Social dimension, its Definition as a Right by Scholars and its regard with freedom of choice. Moreover, the article states the established standards by which Work may be covered as a Human Right. Equally, it specifies how the Right and Freedom to work have been provided by Mexico and Spain's Constitution as well as the interpretation made by Mexico's Judicial Branch and the Constitutional Court of Spain. Finally, the article points out the Legislative and Interpretative Methods effect of the Right to Work. ; El artículo introduce el surgimiento del derecho al trabajo en la dimensión económica y social, su identificación como derecho por los estudiosos del tema y la relación que tiene con la libertad de elección del mismo. Enseguida, enuncia los estándares que se han establecido internacionalmente para dar cobertura al trabajo como derecho humano. The essay advances the theoretical relevance of distinguishing between two legal approaches: Neo-constitutionalism and Garantismo. Both theories are interested in the same model of political and legal organization, that is, democratic constitutionalism. This has produced confusions among European and Latin American scholars, who tend to use both categories indistinctively. However, the author argues that whereas garantismo is an expression of legal positivism, neo-constitutionalism not. This basic difference has many theoretical consequences and some practical implications in the realm of judicial interpretation of constitutional norms. ; En este ensayo se sostiene la pertinencia teórica de distinguir entre el neoconstitucionalismo y el garantismo. Ambas aproximaciones teóricas estudian el mismo modelo de organización político/jurídica: el constitucionalismo democrático. Esto ha provocado que diversos estudiosos europeos y latinoamericanos confundan las dos aproximaciones y utilicen ambas categorías de manera indistinta. Sin embargo, en el texto se sostiene que el garantismo es una teoría que debe adscribirse al positivismo jurídico mientras el neoconstitucionalismo (que, en realidad, es una categoría que conjuga diferentes teorías) tiene una tendencia iusnaturalista. Esta diferencia fundamental tiene implicaciones teóricas relevantes y también consecuencias prácticas sobre todo en el ámbito de la justicia constitucional.
The article reflects on the constitutional interpretation in Hungary from a constitutional and normative perspective. This article starts from the conception of interpretation as an adaptation tool that ensures, the understanding and application of the right to specific cases, thereby ensuring institutional stability and legal certainty. In the case of constitutional interpretation, the text addresses the judicial interpretation and the broad activism of modern judges which make them protagonists of the current constitutional states. In the case of Hungary, the emergence of a jurisdiction that has taken an important place, because of its interpretative work and its contribution to the defence of the Political Charter, is highlighted. Finally, this work shows the great challenge of constitutionality decisions and the particularities that make it possible to compare the Hungarian case with other constitutional systems in the world. ; Este artículo hace una reflexión acerca de la interpretación constitucional en Hungría desde una perspectiva constitucional y normativa. Se parte de la concepción de la interpretación como herramienta de adaptación que asegura la comprensión y aplicación del derecho a casos concretos, asegurando con ello la estabilidad institucional y la seguridad jurídica. Para el caso de la interpretación constitucional, el texto aborda la interpretación judicial y el amplio activismo de los jueces modernos que los hacen protagonistas de los Estados Constitucionales actuales. Para el caso de Hungría, se resalta el surgimiento de una jurisdicción que ha tomado un lugar importante por su labor interpretativa y su aporte en la defensa de la Carta Política. Finalmente, este trabajo muestra el gran desafío que toma las decisiones de constitucionalidad y las particularidades que permiten comparar el caso húngaro con otros sistemas constitucionales en el mundo.
En el presente artículo se examinan varias propuestas que abordan la argumentación como un ejercicio válido y necesario de control judicial; ello, a través del estudio de diversos elementos doctrinales, como lo son la representación democrática argumentativa, la interpretación previa y la debida justificación de las decisiones, así como la ponderación y la aplicación de los principios, entre otros. Al margen de lo anterior, nuestra intención no es otra sino la de presentar una descripción del estado del arte de dichas cuestiones, el cual es presentado en un repaso detallado en varios planteamientos teóricos que, directa o indirectamente, evalúan el papel de la argumentación como eje del control judicial. ; This article evaluates several proposals about the argumentation as a necessary requirement in any exercise of judicial review. The proposals are analysed through many doctrinal approaches. For instance, the argumentative democracy; the interpretation and the justification of the decisions; the balancing and the principles. Our intention in this study is neither to analyze some problems and its solutions; rather, it is to present the state of the art in several theories about the role of argumentation in the context of judicial review.
