O Novo Código de Processo Civil apresenta a mediação como uma das novidades introduzidas; o presente trabalho faz uma breve análise sobre essa inovação, abordando suas peculiaridades. Assim, questiona-se se esse novo ins- trumento será capaz de atenuar a problemática da crise numérica de processos e proporcionar uma prestação jurisdicional efetiva. E ainda, analisa-se se media- ção proporcionará o efetivo acesso à justiça, de modo a satisfazer as tutelas que sobrecarregam ao Poder Judiciário.

O ATIVISMO JUDICIAL E O ENFRAQUECIMENTO DO PODER POLÍTICO: CRISE EFETIVA OU MUDANÇA PARADIGMÁTICA?
É extenso o debate envolvendo o fenômeno do ativismo judicial e não faltam argumentos contra ou a favor dos resultados contabilizados. De um lado, os críticos enfatizam a suposta ilegitimidade democrática dos personagens envolvidos, ou mesmo os limites impostos pela capacidade institucional do Judiciário, que estaria enfraquecendo o poder político formado pelo legislativo e o executivo. De outra banda milita favoravelmente os argumentos de defesa efetiva ao Estado de Bem Estar Social previstos no Brasil a partir da Constituição de 1988. Nestes termos é o objetivo deste artigo a impulsionar uma reflexão teórica em torno da doutrina jurídica brasileira sobre o fenômeno do ativismo judicial. A ênfase na reflexão sobre a doutrina será sobre algumas das causas que promovem a intervenção do judiciário e o seu embasamento para concluir se efetivamente estamos diante de uma crise do poder político ou se o processo intervenção intencional do judiciário no policy-makers diz respeito apenas a mudança paradigmática imposta pela sociedade em vertiginosa evolução, e que exige o fortalecimento do judiciário para a efetivação dos direitos constitucionalmente assegurados.

COVID-19 NO BRASIL: SAÚDE COMO GARANTIA SOCIAL E A INTERVENÇÃO JUDICIAL EM TEMPOS DE CRISE
Objetivo: Discutir o papel do judiciário brasileiro, quanto à proteção dos direitos fundamentais da vida e da saúde, frente aos dilemas excepcionais que a pandemia ocasionou, evidenciando a importância do sistema de saúde pública e, além, com o impacto da crise sanitária da Covid-19.Metodologia: Os métodos de pesquisa foram o documental e o bibliográfico, com o intuito de compreender a relação do sistema de saúde pública e do judiciário, diante dos desafios levantados para proteção da saúde, como direito fundamental, e sua exasperação face à pandemia do novo coronavírus no Brasil. Buscou-se, também, analisar o impacto da crise sanitária de forma holística e as medidas preventivas aplicáveis.Resultados: A partir da articulação conceitual foi possível apontar que é imprescindível um diálogo entre o conhecimento técnico do sistema de saúde e o judiciário, para que a interpretação do magistrado seja melhor subsidiada e resolva as demandas de saúde com maior eficiência, inclusive quando se tratar de questões ligadas a pandemia.Contribuições: Trata-se da interpretação sob uma perspectiva que visa garantir e proteger os direitos fundamentais e humanos da saúde e da vida, partindo da necessidade da inserção de uma análise técnica à interpretação judicial. Nesse sentido, salienta a importância do monitoramento e pesquisa do sistema de saúde pública em face de crises humanitárias como a da Covid-19. Ressalta-se a atuação das Cortes Superiores e a necessária interpretação da legislação, em consonância com a normativa constitucional, de forma a reforçar a segurança jurídica no sistema de saúde.Palavras-chave: Direito fundamental à saúde. ABSTRACTObjective: To discuss the role of the Brazilian judiciary in protecting the fundamental rights of life and health, in the face of the exceptional dilemmas caused by the pandemic, highlighting the importance of the public health system and, also, the impact of the COVID-19 health crisis.Methodology: The research methods were documental and bibliographic, with the purpose of understanding the relationship between the public health system and the judiciary, in face of the challenges raised for the protection of health, as a fundamental right, and its exasperation in face of the new coronavirus pandemic in Brazil. It was also sought to analyze the impact of the health crisis holistically and the preventive measures applicable.Results: From the conceptual articulation it was possible to point out that a dialogue between the technical knowledge of the health system and the judiciary is essential, so that the magistrate's interpretation is better subsidized and resolves health demands with greater efficiency, including when dealing with pandemic-related issues.Contributions: It deals with interpretation from a perspective that aims to guarantee and protect the fundamental and human rights of health and life, starting from the need for the insertion of a technical analysis to judicial interpretation. In this sense, it emphasizes the importance of monitoring and researching the public health system in the face of humanitarian crises such as Covid-19. The performance of the Supreme Courts and the necessary interpretation of the legislation is emphasized, in line with the constitutional normative, in order to strengthen legal security in the health system, is emphasized.Keywords: Fundamental right to health. Crises and Reconciliation in Swat
Swat has held prominence for its known history. In 1915 Swat State came into being after which Swat tremendously progressed in fields of education, health care services, peace, communication and judicial system. The State was brought to an end in 1969 with which drastic changes occurred in all respects. A new and alien administrative apparatus was brought, characterized by federal and provincial centralization, bureaucratic mindset, red-tape and dilly-dally, which proved unresponsive and hence generated sense of deprivation and resentment. With each passing day, the people saw to the state period with nostalgia and aspired for a positive change, especially in the judicial arena. This boosted Tahrik Nifaz-e-Shariat-e-Muhammadi (TNSM) and its demand for making the judicial system conform to Islamic laws. Some other factors, internal and external, also worked in their own ways. All these culminated into the Taliban upsurge in 2007 and the resultant fighting, military operations, destruction and displacement of millions of people. By July 2009, the Taliban were defeated and the situation brought under control by the security forces, but the Taliban and their ideology have not perished. Therefore, for a durable peace, the core issues needs to be addressed spiritedly and the Taliban brought to the mainstream.

Nos dias atuais multiplicam-se as discussões em torno da "crise da justiça". Porém, nas sociedades modernas esta expressão (independentemente do seu conteúdo concreto) designa especificamente a crise da justiça democrática e liberal ou, pode-se ainda dizer, a crise do poder judicial na sociedade democrática e liberal. Assim, qualquer discussão acerca da "crise da justiça" parece exigir um enquadramento contextual que ajude a clarificar o lugar ocupado pelo poder judicial em sociedades como as nossas. O propósito deste artigo consiste em contribuir para elucidar qual é, do ponto de vista político e constitucional, esse contexto. A perspectiva da História do Pensamento Político é considerada como a mais útil, na medida em que permite aceder à origem dos fundamentos intelectuais que estruturam não só o poder judicial moderno, mas a sociedade moderna como um todo. Neste artigo, John Locke e Montesquieu aparecem como dois autores incontornáveis por terem dado um contributo indelével para essa dupla estruturação.
