The article is devoted to the constitutional foundations of judiciary in Ukraine. According to article 6 of the Constitution of Ukraine, state power in Ukraine is divided into three main branches – legislative, еxecutive and justice. For each of these branches there is a corresponding system of foundations and principles that determine their essence and specific features of organization and functioning of the mechanism of the state. They play a key role for the judiciary in Ukraine. Appropriate due to the main objective of the national judiciary – a provision of the capacity for each person to exercise their right to a fair trial,based on the rule of law. Considering the issues, it is first necessary to pay attention to the essence of the concepts "foundations" and "principle" as constitutional categories. It should be noted, that these concepts have the same meaning for the expression of fundamental ideas and leadership directions of the organization and functioning of all basic constitutional legal institutions in Ukraine. The concept of the constitutional foundations of justice in Ukraine, given the position on the advisability of securing the appropriate category in the position of art.129 of the Constitution of Ukraine, which is a basic norm in the system of foundations and principles of the judicial branch of power and its legal effect on the reflection, is refined in laws and procedural codes. This article highlights some of the problematic issues related to the definition of the subjects of use of forensic technology nowadays, analysis of norms of the current criminal procedural legislation of Ukraine, regulating the issues (procedure) of the use of technical means in criminal proceedings, particularly institute of the defense party in the part of the rights of the suspect, accused, their defense counsel, as well as scientific and substantiated proposals for their solution. The article deals with the essence of the concept of "forensic technique" in various aspects: as a section of forensic science and a set of technical means used in the investigation of criminal offenses. It explores the views of various Ukrainian scholars on the concept of "forensic engineering" and its place in modern legal science. The author analyzed the importance of scientific and technical means in forensic practice and considered the problem of legal definition of the concept of "technical and criminalistics means" The article identifies and describes the subjects of forensic technology, in particular, investigators, specialists, forensic experts and others forensic workers and operatives. The author draws attention to the problem of legislative regulation of the basics of use of forensic technology. Perspective directions of investigation of the place of forensic techniques in criminal proceedings are determined. In particular, attention was drawn to the need to clarify in the current Criminal Procedure Code the regulation of the procedure for the use of technical means by the subjects of criminal justice in the conduct of investigative actions, as well as the regulation of the legal bases for the use of forensic equipment in general. The article analyzes the socio-demographic determinants of Ukrainian citizens' attitude to the judiciary identified on the basis of a nationwide survey. The sociological specifics of the analysis provided for the verification of the influence of those factors that reflect the consequences of social stratification in a particular society — its socio-economic, political and socio-cultural dimensions. In different countries of the world, the influence of socio-demographic factors on the attitude to the judiciary has been uneven and unequal. In many European countries, the experience of cooperating with the courts leads to a negative attitude towards justice. The attitude to the judiciary is considered through four indicators: 1) trust in the courts; 2) assessment of the chances of winning court case, regardless of the wealth of the citizen; 3) assessment of an independence of judges; 4) assessment of an integrity of judges. Despite social optimism observed in Ukrainian society after the 2019 presidential and parliamentary elections, the study found a low level of trust and negative assessments of Ukrainian justice. Using the method of multiple linear regression, it was found that public opinion about justice is formed regardless of gender, level of education and region of residence. It was found that Ukrainians' attitude to the judiciary is largely determined by age, settlement type, language of communication at home and experience of participation in the trial. Confidence and positive assessments assessments of the judiciary are mainly manifested as the age and size of the settlement decrease, as well as among Russian speakers and those who have experience of participating in the trial. The influence of the respondents' financial situation on their assessment of the independence of judges was unexpectedly dependent: as the financial situation of the family decreased, the tendency to consider judges independent increased.
The modern principles of judiciary, being an integrative constitutional-theoretical category, are the object of scientific research from the point of view of a meaningful interpretation, as well as the specific nature of formalization, including its the comparative legal aspect. In this regard, the research subject of this article is represented by the norms of the constitutions of the member states of the Commonwealth of Independent States. The article presents the analysis results, which allowed us identifying the non-standard approaches to consolidate the constitutional principles of the judiciary in the focus group of acts. We associate these approaches with the compositional specific nature of principle reflection, as well as with the variably-substantive aspect, which quantitatively and qualitatively supplements the standard list of required fundamental ideas.
The term «international legal standards» is considered to be the most acceptable designation of the rules for the national legislation of Ukraine. Such rules are included in various international documents and in standardized rules of conduct of subjects in certain areas of intergovernmental cooperation. Their significance for the national legislation of Ukraine lies in the fact that they perform the function of a guideline. But such rules require adaption to the norms of domestic law. During the years of independence, the judicial system of Ukraine has been reformed repeatedly. However, the objectives set before it have never been implemented. For a successful judicial reform, one pattern can be traced: reform of the judicial system should take place in a comprehensive manner: reforming the judicial system itself and other related legal institutions. Therefore, the problem of reforming the judiciary in Ukraine has never been so relevant as nowadays. The most important preconditions for the development of civil society should be quality, stable legislation and effective justice. These can really provide a reliable protection of human rights and freedoms, the interests of society and of the state in order to eradicate tyranny and iniquity. A theoretical understanding of the issues of the implementation of judicial and legal reform is necessary in order to ensure the effective functioning and further development of the judicial system. Such research is necessary for the study and further consideration of problems that arise in the process of reform. ; Термін «міжнародно-правові стандарти» для національного законодавства України вважається найбільшприйнятним позначенням закріплених у різноманітних міжнародних документах норм, стандартизованими правилами поведінки суб'єктів у тих чи інших сферах міждержавного співробітництва. Їх значення для національного законодавства України полягає в тому, що вони є своєрідним орієнтиром. Але такі норми потребують конкретизації і доповнення з боку норм внутрішньодержавного права. За роки незалежності судова система України піддавалася реформуванню неодноразово. Однак поставлені перед нею цілі до кінця так і не були реалізовані.Для успішного проведення судової реформи простежується одна закономірність – реформування судової системи має відбуватися комплексно, а саме реформування самої судової системи, судоустрою та інших пов'язаних правових інститутів. Проблема реформування судової влади в Україні натепер виявляє свою актуальність як ніколи, оскільки найважливішими передумовами розвитку громадянського суспільства мають стати якісне, стабільне законодавство та ефективне правосуддя, які здатні реально забезпечувати надійний захист прав і свобод людини, інтересів суспільства і держави, щоб викорінити свавілля і беззаконня. Задля забезпечення ефективного функціонування та подальшого розвитку судової системи необхідне теоретичне осмислення питань реалізації судово-правової реформи. Такі дослідження є необхідними для вивчення і подальшого врахування проблем, які виникають у процесі здійснення реформи.

The article reveals and researches the basic principles of the formation of the judiciary in Ukraine. It is established that judicial corps should be understood as an appropriate number of civil servants who hold the relevant positions as judges in the judicial bodies of Ukraine. It has been proved that judges make universally binding decisions, which determine, for example, other processes of maintaining law and order in the state. It is determined that the legislation lacks a clear definition of the term "judiciary" and lacks the primary grounds and principles by which the process of formation of the judicial corps in Ukraine should take place. It is established that the principles of formation of the judiciary in Ukraine should be based on the requirements for candidates for the position of judges, which are defined by Article 69, "Requirements for candidates for the position of the judge" of the Law of Ukraine "On Judiciary and the Status of Judges". It is proved that one of the components of the procedure for the formation of the judiciary in Ukraine is the qualification assessment of candidates for the position of judges. It was found out that the qualification assessment of judges by the criterion of professional competence should be based on the principle of specialization and instance. It is established that the main principles based on which the appointment of judges-candidates for the positions of members of the Supreme Council of Justice are: the principle of the rule of law; the principle of professionalism; the principle of publicity; the principle of political neutrality. It is determined that one of the critical principles of formation of the judiciary in Ukraine should be the principle of non-political influence, namely its essence is revealed in the fact that entities that will participate both directly and indirectly in the formation of the judiciary should not, in any case, have any relation to the political sphere. It is noted that the prospects for further research in this area are the study of the holistic system and features of the formation of the judiciary in Ukraine. ; У статті розкрито і досліджено основні принципи формування суддівського корпусу в Україні. Встановлено, що під суддівським корпусом слід розуміти відповідну кількість державних службовців, які займають відповідні посади суддів у судових органах України. Доведено, що судді ухвалюють загальнообов'язкові рішення, від результатів яких залежать, до прикладу, подальші процеси піддержання законності та правопорядку у державі. Визначено, що у законодавстві відсутнє не лише чітке визначення поняття «суддівський корпус», але і відсутні основні засади та принципи, у відповідності до яких має відбуватись процес формування суддівського корпусу в Україні. Встановлено, що засади формування суддівського корпусу в Україні повинні виходи із вимог, що ставляться до кандидатів, що претендують на посади суддів, та які, до прикладу, визначені статтею 69 «Вимоги до кандидатів на посаду судді» Закону України «Про судоустрій і статус суддів». Доведено, що однією із складових процедури формування суддівського корпусу в Україні виступає кваліфікаційне оцінювання кандидатів, що претендують на посади суддів. З'ясовано, що проведення кваліфікаційного оцінювання суддів у відповідності до критерію професійної компетентності повинно базуватися на принципі спеціалізації та інстанційності. Встановлено, що основними принципами, на засадах яких відбувається призначення суддів-кандидатів на посади членів Вищої ради правосуддя, виступають: принцип верховенства права; принцип професійності; принцип публічності; принцип політичної нейтральності. Визначено, що одним із ключових принципів формування суддівського корпусу в Україні повинен стати принцип недопущення політичного впливу, а саме його суть розкривається у тому, що суб'єкти, що братимуть безпосередньо як пряму, так і опосередковану участь у формуванні суддівського корпусу, не повинні у жодному разі мати будь-які відносини із політичною сферою. Зазначено, що перспективами подальших досліджень у цьому напрямі є дослідження цілісної системи і особливостей формування суддівського корпусу в Україні.

The Judiciary Council has been ineffective in its constitutional mission: helping to sustain the judges' independence against the other — dignified or efficient — Powers' pressures. The way its members are appointed and how they in turn elect the holders of the main judicial positions has shown their dependency on the political parties. But the 2013 reform does not resolve this problems, does not fulfil the constitutional provisions on pluralism in its composition and collegiality, creates some new ones as a consequence of the reinforcement of its president's powers and transfers a substantial part of its former competences to the Executive power. It is a deliberate setback to the pre-constitutional way of governing the judiciary: a genuine Counter-Reform. ; El Consejo General del Poder Judicial ha sido ineficaz en su misión constitucional de ayudar a defender la independencia de jueces y tribunales frente a presiones de los demás poderes, dignificados o eficientes. The perception of the Judicial Council is, throughout its existence, too often associated to partisan or corporative interests. This has caused the image of the judiciary to suffer as a whole. One way to avoid dependence on outside interests is the procedure to appoint its members. Until now, three systems were tested, but none proved to be effective for the intended aims. This essay formulates a new appointment system proposal for the Council's members, involving the direct participation of judges and the legislature. It pursues the following objectives: to observe the democratic principle, and to facilitate and promote the participation of all judges and magistrates in the election of its governing body —thus ensuring a plural and inclusive body—. Additionally, other measures are formulated in order to limit outside influences and pressure on the Council, to promote the election of its members based primarily on merit and ability, and to steer the Council back to its strict mandate of defending judicial independence and Justice interests. ; La imagen del Consejo General del Poder Judicial ha estado vinculada en demasiadas ocasiones a intereses partidistas o asociativos a lo largo de su existencia, dañándose con ello la propia imagen del Poder Judicial en su conjunto. The article is devoted to the concept of emancipation of a minor in civil proceedings, providing on the basis of the analysis of scientific views and taking into account the current legislation theoretical and legal characteristics of the emancipation of a minor in civil proceedings. The problem of granting full civil capacity to minors (emancipation) is considered. The problem related to the procedure and grounds for granting full civil capacity to minors in civil proceedings is highlighted. The problems that arise when granting full civil capacity in court are analysed. Judicial practice of granting full civil capacity to a minor registered by the person's father or mother is considered. To achieve these results, a scientific description of the status of minors and the definition of emancipation, investigated the grounds and procedure for granting full civil capacity to minors and analysed the case law on granting full civil capacity to a minor who is registered as a child or parent. The conclusion is characterized that the rights of the child as a separate category of human rights have acquired and are gaining legal consolidation, based on the need for special treatment, taking into account the physiological and psychological characteristics of the needs of the child. The rights of the child, as well as human rights, should be spoken of in terms of power-to-person relations. If a child has a right, the state is obliged to guarantee it. For example, as defined in Article 55 of the Constitution of Ukraine – the rights and freedoms of man and citizen are protected by the court, respectively, the state guarantees everyone access to court, including minors. The state creates a judicial system and develops rules governing its functioning, which are constantly on the move and improving. These rules provide, inter alia, for the proper emancipation of minors by civil proceedings – the problem is urgent and insufficiently covered. New approaches to the analysis of the state of solving this problem in civil proceedings are contained in our study. ; Статтю присвячено поняттю емансипації неповнолітньої особи в цивільному судочинстві, наданню на підставі аналізу наукових поглядів та з урахуванням чинного законодавства теоретико-правової характеристики емансипації неповнолітньої особи в цивільному судочинстві. Розглянуто проблему надання повної цивільної дієздатності неповнолітнім особам (емансипації). Висвітлено проблему, пов'язану з порядком та підставами надання повної цивільної дієздатності неповнолітнім особам у цивільному судочинстві. Проаналізовано проблеми, які виникають під час надання повної цивільної дієздатності в судовому порядку. Розглянуто судову практику надання повної цивільної дієздатності неповнолітній особі, яка записана батьком або матір'ю особи. Для досягнення таких результатів здійснено наукову характеристику статусу неповнолітніх та визначення поняття «емансипація», досліджено підстави та порядок нaдaвання повної цивільної дієздaтності неповнолітнім особам та зроблено аналіз судової практики щодо надання повної цивільної дієздатності неповнолітні особі, яка записана батьком або матір'ю дитини. Охарактеризовано висновок про те, що права дитини як окрема категорія прав людини набули й набувають юридичного закріплення, базуючись на необхідності особливого ставлення, з урахуванням фізіологічних і психологічних особливостей, потреб дитини. Про права дитини, як і про права людини, слід говорити з погляду відносин «влада – особа». Якщо дитина має право, то держава зобов'язана гарантувати їй це право. Наприклад, як визначено у ст. 55 Конституції України, права і свободи людини і громадянина захищаються судом, відповідно держава гарантує кожному доступ до суду, у тому числі неповнолітнім особам. Держава створює судову систему і розробляє правила, що регулюють її функціонування, що постійно перебувають у русі та вдосконалюються. Зазначеними правилами передбачено здійснення належної емансипації неповнолітніх засобами цивільного судочинства – проблема нагальна та недостатньо висвітлена. Нові підходи до аналізу стану вирішення цієї проблеми в цивільному судочинстві містяться в нашому дослідженні.
Abstract:The Spanish Constitution of 1978 established the General Council of the Judiciary, as an organ for the Judiciary government. Since of its creaction on 1980,this organ has been objet of a constant process of reforming that shows how the Conuncil hasn't achieved to find its place in institutional system and how this organ couldn't consolidate itself under a stable model. The last most important reform, the Organic Law 4/2013, reforming the CGPJ, has introduced in a reformulation of the structure and functions of the Council, and a new way of election of its members, thus constituting. This paper presents the evolution and the changes about of Council in forty years of constitutional vigence and analyzes the reform, the new position and place of Council and its organs, the doubts on the functioning of the Council, and the questions that today remain open. ; Resumen:La Constitución española de 1978 consagró el Consejo General del Poder Judicial, como órgano de gobierno del Poder Judicial. Desde su creación en 1980, este órgano ha estado sometido a constantes reformas, en un proceso de continuas modificaciones que han derivado en un órgano que no parece haber encontrado su lugar en el sistema institucional, y no ha podido consolidarse. La última reforma más importante, la Ley Orgánica 4/2013, de reforma del CGPJ, ha introducido una nueva reformulación del modo de elección, la estructura y las funciones del CGPJ. El presente trabajo expone la evolución y los cambios habidos en el Consejo en estos cuarenta años de vigencia constitucional, y analiza el régimen establecido por la reforma de 2013, la nueva posición del Consejo y de sus órganos de funcionamiento, la dudas sobre el funcionamiento que plantea y las cuestiones que aún siguen abiertas.Abstract:The Spanish Constitution of 1978 established the General Council of the Judiciary, as an organ for the Judiciary government. Since of its creaction on 1980,this organ has been objet of a constant process of reforming that shows how the Conuncil hasn't achieved to find its place in institutional system and how this organ couldn't consolidate itself under a stable model. The last most important reform, the Organic Law 4/2013, reforming the CGPJ, has introduced in a reformulation of the structure and functions of the Council, and a new way of election of its members, thus constituting.
