Based on a comparative analysis of the sectoral legislation of Ukraine and the practice of its application, the article studies the features of the development of professional self-government in the system of prosecutors, judicial authorities and the bar. It has been found out that prosecutorial self-government in Ukraine is conducted through the Council of Prosecutors of Ukraine (the highest body of prosecutorial self-government in the period between all-Ukrainian conferences of prosecutors) and the all-Ukrainian conference of prosecutors (the highest body of judicial self-government). It has been determined that prosecutorial self-government is a collective independent decision of prosecutors on issues related to the activities of prosecutorial bodies. It has been established that the system of bar self-government bodies in Ukraine is formed by: 1) the Congress of advocates of Ukraine; 2) the Bar Council of Ukraine; 3) the Supreme Qualification and Disciplinary Commission of Advocacy; 4) the Supreme Audit Commission of the Bar; 5) the Regional Conference of Advocates; 6) the Council of Advocates of the region; 7) the Qualification and Disciplinary Commission; 8) the Audit Commission of the region. It has been found that the bodies of judicial self-government in Ukraine are: 1) a meeting of judges, which is a gathering of judges belonging to the corresponding court aimed at discussing the internal activities of such a court and making appropriate collective decisions based on the discussion of such issues; 2) the Council of Judges of Ukraine (the highest body of judicial self-government, which also functions as the executive body of the Congress of Judges of Ukraine); 3) the Congress of Judges of Ukraine (the body that makes decisions that are binding on all bodies of judicial self-government and all courts in Ukraine). It is noted that the prospects for further research in this area are to determine the role of the judiciary in the constitutional and legal mechanism for the protection of human rights and freedoms and to study the requirements for incompatibility of a judge, prosecutor and lawyer with other activities in the context of comparative constitutional law. ; У статті на основі порівняльного аналізу галузевого законодавства України і практики його застосування досліджено особливості розбудови професійного самоврядування в системі органів прокуратури, органів судової влади та органів адвокатського самоврядування. Встановлено, що розбудова професійного самоврядування в системі органів прокуратури, органів судової влади та органів адвокатського самоврядування в Україні регулюється Конституцією України, Законом України «Про прокуратуру», Законом України «Про судоустрій і статус суддів», Законом України «Про адвокатуру та адвокатську діяльність». З'ясовано, що прокурорське самоврядування в Україні проводиться через Раду прокурорів України (вищий орган прокурорського самоврядування у період між всеукраїнськими конференціями прокурорів) і всеукраїнську конференцію прокурорів (найвищий орган суддівського самоврядування). Визначено, що прокурорське самоврядування являє собою колективне самостійне вирішення прокурорами питань, пов'язаних із діяльністю органів прокуратури. Встановлено, що систему органів адвокатського самоврядування в Україні формують: 1) З'їзд адвокатів України; 2) Рада адвокатів України; 3) Вища кваліфікаційно-дисциплінарна комісія адвокатури; 4) Вища ревізійна комісія адвокатури; 5) Конференція адвокатів регіону; 6) Рада адвокатів регіону; 7) Кваліфікаційно-дисциплінарна комісія; 8) Ревізійна комісія регіону. З'ясовано, що органами суддівського самоврядування в Україні є: 1) збори суддів, що являють собою зібрання суддів, що належать до відповідного суду, для того, щоб обговорити питання внутрішньої діяльності такого суду та ухвалити відповідні колективні рішення за результатами обговорення таких питань; 2) Рада суддів України (вищий орган суддівського самоврядування, при чому він функціонує як виконавчий орган з'їзду суддів України); 3) з'їзд суддів України (орган, що приймає рішення, які є обов'язковими до виконання усіма органами суддівського самоврядування та усіма судами в Україні). Зазначено, що перспективами подальших досліджень у цьому напрямі є визначення ролі судової влади в конституційно-правовому механізмі захисту прав і свобод людини та дослідження вимог щодо несумісності посади судді, прокурора та адвоката з іншими видами діяльності в контексті порівняльного конституційно-правового аспекту.
Summary: The article seeks to demonstrate the strength of the judiciary, especially in the electoral branch, with two examples: when the Court ruled on the financing of politics and when it referred to the division of radio and television time between political parties, as well as the rules on electoral debate. In both cases, the Court's ministers referred to the constitutional principle of equality, but its interpretation led to different results: in one case, it led to the invalidation of the funding rules; in another, it was not strong enough to overturn the new legislation that would destroy smaller political parties. By comparing the failures, it can be argued that the judiciary is the real art of electoral rules in Brazil. ; Resumen: El artículo busca demostrar la fuerza del Poder Judicial, especialmente en la rama electoral, con dos ejemplos: cuando el Tribunal se pronunció sobre el financiamiento de la política y cuando se refirió sobre la división del tiempo de radio y televisión de los partidos políticos, al igual que sobre las reglas de debate electoral. En ambos casos, los ministros del Tribunal evocaron el principio constitucional de igualdad, pero su interpretación desembocó en resultados diferentes: en un caso, conllevó la invalidación de las reglas sobre financiación; en otro, no fue lo suficientemente fuerte para anular la nueva legislación que aniquilaría a los partidos políticos menores. Con la comparación de los fallos es posible sostener que el Poder Judicial es el artífice real de las reglas electorales en Brasil.
The Judicial Power constitutes the main called institution within a Constitutional State, to fight against the corruption. This certainly, within a frame of cooperation with other institutions. Since the beginning of the year 2001, the legislation and actions destined to revert the judicial corruption have been increased, emphasizing the role of the judicature throughout new schemes of performance like the sub system of anticorruption, whose competition has been extended, and also the continuous and recognized work of the Office of Control of Judges (Oficina de Control de la Magistratura -OCMA). The judicial reform been applied in our country points out that the fight against the corruption happens to fortify the existing institutions, in order to consolidate a system of justice equipped with impartial, independent, effective and efficient organs in Peru. To accomplish that purpose is necessary to put in practice a set of actions as well as the promotion of some values and a public ethic in our society, which, accompanied by a greater transparency, constitute an authentic policy of prevention of the corruption. ; El Poder Judicial constituye la principal institución llamada, dentro de un Estado Constitucional, a luchar contra la corrupción. Esto, ciertamente, dentro de un marco de cooperación con otras instituciones. Desde inicios del año 2001, la legislación y acciones destinadas a revertir la corrupción judicial se han incrementado, destacando el rol de la judicatura a través de nuevos esquemas de actuación como el del subsistema anticorrupción, cuya competencia ha sido ampliada, y asimismo el continuo y reconocido trabajo de la Oficina de Control de la Magistratura (OCMA). La reforma judicial hoy en marcha en nuestro país plantea entonces que la lucha contra la corrupción pasa por fortalecer las instituciones existentes, a fin de consolidar en el Perú un sistema de justicia dotado de órganos imparciales, independientes, eficaces y eficientes. Para ello deberán ponerse en práctica un conjunto de acciones que han de desplegarse en conjunto con la promoción de algunos valores y de una ética pública en nuestra sociedad, los cuales, de la mano con una mayor transparencia, constituyan una auténtica política de prevención de la corrupción.

This paper presents a study that seeks to items on the various legal reforms that have maximized the debate about the need for protection of women against violence suffered because of their gender. The question to be resolved by the law, as the legal system, is to determine which is the surest way to guarantee to protect women as subjects of law. This is particularly important when discussing transitional justice mechanisms such as Colombia, where the victims of sexual crimes constitute a large universe of women who have suffered particular forms of violence because of the actions of the actors in the internal armed conflict.
Bankruptcy as a phenomenon of the legal order has recently attracted the attention of scientists. En este artículo se aborda el proceso de judicialización de una villa localizada en un área privilegiada de la Ciudad de Buenos Aires actualmente en instancia de reurbanización. Se trata de la "Rodrigo Bueno", como ha sido llamada por sus habitantes, una de las cuatro villas atravesada por la política de Integración Social y Urbana que lleva adelante el Gobierno de la Ciudad. Si bien el GCBA viene impulsando la reurbanización de este barrio a la luz de grandes transformaciones urbanas y dinámicas de valorización de la zona, el reclamo de los habitantes por la radicación y la permanencia en el lugar antecede a tal intervención a través de estrategias diversas como ha sido la judicialización. En estas páginas me propongo analizar el papel de la judicialización de la Villa Rodrigo Bueno, durante el período 2005-2015, tomando en cuenta el entramado actoral desplegado en el "campo jurídico" de una situación declarada conflictiva, y sus efectos sociales y territoriales en un área disputada de la ciudad. En este marco y desde una perspectiva de las ciencias sociales, entendemos a la judicialización como una arena más en la que se cristaliza un conflicto social preexistente -en este caso referido a la inscripción territorial y la permanencia de un sector social (popular) en el espacio urbano- en el cual diversos actores despliegan posicionamientos (argumentales y de construcción de sentido del problema) diferentes, según las instancias y los contextos en los que se encuentran. ; This article discusses the process of judiciary of a shanty town located in a privileged area of the City of Buenos Aires currently in instance of redevelopment. It is the "Rodrigo Bueno", as it has been called by its inhabitants, one of the four shantu town crossed by the policy of Social and Urban Integration carried out by the Government of the City. Although the current GCBA has been promoting the redevelopment of this neighborhood in light of major urban transformations and dynamics of valorization of the area, the inhabitants' demand for the establishment and permanence in the place precede such intervention through strategies diverse as the judiciary has been. In these pages, I propose to analyze the role of judiciary in Rodrigo Bueno, during the period 2005-2015, taking into account the network of actors deployed in the "legal field" of a situation declared conflictive, and its effects social and territorial in a disputed area of the city. In this framework and from a perspective of the social sciences, we understand judiciary as one more arena in which a pre-existing social conflict is crystallized -in this case referring to territorial registration and the permanence of a (popular) social sector in the urban space- in which different actors deploy different positions (arguments and construction of the problem), according to the instances and contexts in which they are found. ; Facultad de Ciencias Jurídicas y Sociales
Given the recognized insufficient quality of law-making that takes place in Ukraine, the task is to develop as soon as possible effective methods of legislative technique, which, being reduced to a unified state standard, taking into account modern world and European experience, would actually serve as a kind of template. would clearly distinguish between regulated legal relations, and determine the conceptual apparatus that would meet the objectives of such regulation. The author's theoretical and legal study of certain fundamental categories, such as "principle", "principle", "basics", etc. has shown that unwarranted manipulation by both theorists and practitioners of these concepts leads to incomplete study of evidence to substantiate the guilt or innocence economic sphere. If they are used incorrectly, circumstances may arise that will cause damage to the business entity due to the enforcement of a court decision that has entered into force. This situation really threatens the establishment of the rule of law and constitutional principles in the conduct of business. Moreover, such actions reduce the activity of citizens in the direction of exercising the constitutional right to engage in entrepreneurial activity. Ensuring proper law and order in the economic sphere, the legislator must strictly adhere to the techniques of legislative technique on the introduction of new laws or amendments to existing regulations. In view of the above, there is a problem of a professional approach to the theoretical justification of the categories studied in this article, reducing them to a clear structured system. The main task, according to the author, is to give a universal character to those principles which, given the multiplicity of combined instruments of legitimate coercion against the violator of economic law, will simultaneously act as guarantees for the protection and safeguarding of the rights of honest entrepreneurs. ; З огляду на визнаний недостатній якісний рівень розроблення законів, який має місце в Україні, виникає завдання якнайшвидше розробити ефективні прийоми законодавчої техніки, котрі, будучи зведені до уніфікованого державного стандарту, з урахуванням сучасного світового і європейського досвіду, насправді слугували б своєрідним лекалом, межі якого б чітко розрізняли регульовані правовідносини, і визначали понятійний апарат, який би відповідав завданням такого впорядкування. Авторське теоретико-правове дослідження окремих основоположних категорій, як, наприклад, «принцип», «засада», «основи» тощо показало, що безпідставне маніпулювання як теоретиками, так і практиками цими поняттями призводить до неповноти вивчення доказів, якими обґрунтовується вина чи невинуватість учасника господарської сфери. За умов некоректного їх застосування можуть виникнути обставини, якими суб'єкту господарювання будуть завдані значні збитки з причини примусового виконання рішення суду, яке набрало законної сили. Така ситуація реально загрожує утвердженню верховенства права і конституційних засад під час провадження підприємницької діяльності. Більше того, такими діями знижується активність громадян на напрямку реалізації конституційного права на зайняття підприємницькою діяльністю, вселяється зневіра у справедливість державної системи захисту суб'єктивного права. Забезпечуючи належний правопорядок у господарській сфері, законодавець має суворо дотримуватись приймів законодавчої техніки при запровадженні нових законів чи внесення змін і доповнень до чинних нормативно-правових актів. З огляду на сказане виникає проблема фахового підходу до теоретичного обґрунтування досліджуваних у цій статті категорій, зведення їх до чіткої структурованої системи. Основним завдання, на думку автора, є надання універсального характеру тим принципам, які, з урахуванням множинності об'єднуваних інструментів легітимного примусового впливу на порушника господарського законодавства, одночасно виступатимуть гарантіями щодо охорони і захисту прав добропорядних підприємців.

Faced with the advanced of the judicialization of politics - and the politicization of justice - this article set out to recreate a controversial scene. Controversy, debate, litigation, polemic, were categories used in this text to characterize the exchange –both political and journalistic– around the "Project for the Democratization of Justice" presented by the former president of the Argentine Nation, Cristina Fernández de Kirchner, in 2013. To do this, we have analyzed the news related to the project of three national newspapers (Clarín, La Nación and Página / 12) and put them in tension with the properly political discourse. What is important at this point does not consist of verifying whether the study actually corresponds to a Lawfare process or, conversely, to an attempt by a certain government to intercede –for political party purposes– in the correct functioning of justice. Rather, how those political-judicial processes that we study appear thus thematized in the Argentine public scene. The materials were analysed considering, as a hypothesis, that the discussion is structured around three axes: a) The moment in which the reform is proposed; b) The discussion on its constitutionality; c) The debate on the division of powers. ; Ante el avance de la judicialización de la política —y la politización de la justicia—, este artículo se propuso recrear una escena controversial. Controversia, debate, litigio y polémica fueron categorías utilizadas en este texto para caracterizar el intercambio —tanto político como periodístico— producido en torno al Proyecto de Democratización de la Justicia presentado por la expresidenta de Argentina, Cristina Fernández de Kirchner, en el año 2013. Para ello, hemos analizado las noticias referidas al proyecto de tres diarios de circulación nacional (Clarín, La Nación y Página/12) y las pusimos en tensión con el discurso propiamente político. Lo importante en este punto no consiste tanto en la verificación de si lo estudiado se corresponde efectivamente con un proceso de lawfare o, a la inversa, con un intento de un determinado Gobierno de interceder —con fines político partidarios— en el correcto funcionamiento de la justicia sino, más bien, cómo esos procesos político-judiciales que estudiamos aparecen así tematizados en la escena pública argentina. Los materiales fueron analizados considerando, como hipótesis, que la discusión se estructura en torno a tres ejes: i) el momento en el que es planteada la reforma, ii) la discusión sobre su constitucionalidad, y iii) el debate sobre la división de poderes.
El objetivo de esta investigación es determinar los aspectos fundamentales que incidieron en este bajo desempeño laboral. Se realizó una fase documental en la cual se analizaron documentos del Consejo de la Judicatura de Manabí en relación a las otras 23 Judicaturas a nivel nacional para determinar posibles causas institucionales. En la fase de campo, se aplicó un cuestionario en escala de Likert para determinar posibles causas asociadas a los servidores del Consejo relacionados con la satisfacción en su puesto de trabajo. De la fase documental, los resultados indican que la inestabilidad de directores Provinciales en 2018, pudiera ser la causa principal que conllevó al bajo desempeño del Consejo de la Judicatura de Manabí para ese año, sin embargo. Los resultados revelaron que a pesar del bajo desempeño del Consejo de la Judicatura de Manabí, sus funcionarios aún están satisfechos con sus puestos de trabajo, por lo tanto, se puede afirmar que el bajo desempeño de esta instancia organizativa se debió a la alta rotación de sus directivos (lo que ocasiona inestabilidad de directrices en el puesto de trabajo) y no a los servidores. The results revealed that despite the poor performance of the Manabí Judiciary Council, its officials are still satisfied with their jobs, therefore, it can be stated that the poor performance of this organizational instance was due to the high turnover of their managers (which causes instability of guidelines in the workplace) and not the servers. The results revealed that despite the poor performance of the Manabí Judiciary Council, its officials are still satisfied with their jobs, therefore, it can be stated that the poor performance of this organizational instance was due to the high turnover of their managers (which causes instability of guidelines in the workplace) and not the servers. Brazil is going through a moment of political and institutional crisis and the adoption of corrosive policies to human rights. More than ever before, the Labour Judiciary must exercise its role as the guardian of these rights and as the protector of the dignity of the common working person. The main purpose of this article is to analyze the diffuse control of conventionality as an instrument for the protection of the human rights and, above all, to examine the conformity of the so-called «labour reform« with international treaties and conventions. Through the study of the decisions of the Inter-American Court of Human Rights, the research shows that it is the duty of the judiciary to protect and to make effective human rights, especially in times of discredit and uncertainty by the Legislative with the consent of the Executive. ; Brasil pasa por un momento de crisis política e institucional y de adopción de políticas corrosivas a los derechos humanos. Más que nunca, el poder judicial laboral debe ejercer el papel de guardián de estos derechos y de protector del postulado de la dignidad de la persona trabajadora. Este artículo tiene como objetivo principal analizar el control difuso de convencionalidad como instrumento de protección de los derechos humanos y, sobre todo, examinar la conformidad de la denominada «reforma laboral» con los tratados y convenciones internacionales. Por medio del estudio de las decisiones de la Corte Interamericana de Derechos Humanos, la investigación demuestra que es deber del poder judicial proteger y hacer efectivos los derechos humanos, sobre todo en momentos de violación por el legislativo con el sello del ejecutivo.
