The first Land Use Law reform: 1956-1975 ; La primera reforma de la Ley del Suelo: 1956-1975
For the paper the Law as to Land Use and Town and Country Planning Act of 12 May 1956 was a legal event of the first magnitude that at one go endowed Spain with that complete urbanistic system which, albeit with the two reforms that it underwent, she still enjoys in its general outlines to this day. A study is made of the period from the passing of this first law on through to approving of its first reforming in the Act of 2 May 1975. The accommodating of its new institutions as within the body of urbanistic knowledge and those problems that it gave rise to and which led to its first reforming undertaken in 1972 and approved in the law of 1975 just before the nation's great political upheaval are likewise examined. While the Law of 1956 was still on the books, government pushed ahead with a major policy of setting up industrial and housing estates which were out of keeping with its overall doctrine. Though the Law of 1975 is here considered to be a major legal event though lacking the ground breaking importance of its predecessor, it is felt that it had a greater overall impact. The paper concludes by arguing their new concept of land ownership, of a rationalized overall planning and its all-embracing management to have been these Laws principal contributions when all is said and done. ; La Ley sobre Régimen del Suelo y Ordenación Urbana de 12 de mayo de 1956 fue un acontecimiento jurídico de primera magnitud que introdujo en España, en bloque, un sistema urbanístico completo que, con las dos reformas que luego hubo de sufrir, se mantiene hasta hoy en sus líneas generales. En este trabajo se estudian el proceso recorrido desde entonces hasta la reforma aprobada por la Ley de 2 de mayo de 1975, la incorporación al conocimiento urbanístico de las nuevas instituciones y los problemas que su aplicación puso de manifiesto, que explican la reforma cuyos trabajos se iniciaron en el año 1972 hasta culminar con la aprobación de la Ley en 1975, vísperas del gran cambio político. Durante la vigencia de la Ley del Suelo de 1956 el Estado desarrolló una importante política de creación de polígonos residenciales e industriales con notables excepciones al régimen general. La reforma de 1975 fue otro magno acontecimiento, sin la importancia innovadora de la Ley anterior pero con mayor repercusión. La nueva concepción del derecho de propiedad, la racionalidad del planeamiento general y la gestión integrada son, probablemente, y en síntesis, las aportaciones más importantes de las dos leyes.
