The subject of the considerations presented in the article is the shape of modern regulations on the protection of agricultural land. The analysis is conducted primarily in the field of protective provisions regarding the so-called quantitative and qualitative protection of agricultural land, as well as economic instruments correlated with these provisions for the protection of agricultural land. Other regulatory areas, including predominantly the existing and discussed solutions of European Union law regarding closer linking of agricultural producer support instruments with requirements in the field of environmental protection, within the scope of the so-called conditionality and greening. The subject of the study is not only the analysis of traditional directions of agricultural land protection as a means of production in agriculture, but also an attempt to determine the areas and directions for further development of this regulation. ; Przedmiotem rozważań prezentowanych w artykule jest kształt współczesnej regulacji dotyczącej ochrony gruntów rolnych. Analiza prowadzona jest głównie w zakresie przepisów ochronnych dotyczących tzw. ochrony ilościowej i jakościowej gruntów rolnych, a także skorelowanych z tymi przepisami instrumentów ekonomicznych ochrony gruntów rolnych. Przedmiotem rozważań są również inne płaszczyzny regulacyjne, w tym przede wszystkim istniejące i dyskutowane rozwiązania prawa Unii Europejskiej dotyczące ściślejszego powiązania instrumentów wsparcia producentów rolnych z wymaganiami w zakresie ochrony środowiska naturalnego, w zakresie tzw. warunkowości i zazieleniania. Przedmiotem opracowania jest zarówno analiza tradycyjnych kierunków ochrony gruntów rolnych jako środka produkcji w rolnictwie, jak i próba określenia płaszczyzn dalszego rozwoju tej regulacji.
Tom siódmy "Historii Prus" Gottfryda Lengnicha (do s. 336), w którym opisuje on panowanie króla Jana Kazimierza (1648–1668). Lengnich był zdania, że za konflikt z Kozakami odpowiedzialna była Polska. Za klęskę polskiej dyplomacji uznał dopuszcznie do otwartego konfliktu ze Szwecją i poświęca potopowi szwedzkiemu (1655-1660) sporo miejsca. Kronikarz z dumą opisuje gotowość zbrojną prowincji pruskiej, a zwłaszcza Gdańska, do wojny w przeciwieństwie (jego zdaniem) do innych terytoriów Polski. Lengnich zarzucał Polakom, że ich szczególną cechą był fakt, że w przeciwieństwie do innych narodów prowadzą częste konflikty zbrojne na własnym terytorium. Podkreśla także wierność Gdańska wobec Korony. Po s. 336 następuje dział "Documenta", w którym zamieszczono treść najważniejszych dokumentów z okresu panowania Jana Kazimierza oraz indeks (po s. 169).
Regulations of the Act on Protection of Agricultural and Forest Land are treated as a limitation of the right of ownership of the real estate. Unlike civil law regulations, in this Act the legislator defines agricultural land as the subject of obligations specified in the Act, treating them in separation from the issue of ownership relationships. Unlike in civil law regulations, apart from the owner, a number of obligations associated with the protection of agricultural land is also imposed on other entities, which make economic use of the real estate property. According to the Act, the owner of real estate property has a number of obligations, such as prohibition to use land for non-agricultural purposes without having obtained a decision to designate the land for non-agricultural purposes and consent for exclusion of land from production. The owner also has other positive duties, such as the duty to prevent land degradation and devastation. These obligations, however, do not shape the subjective right of ownership, but are external to it, although they should be treated as a limitation to this right. ; Uregulowania ustawy o ochronie gruntów rolnych i leśnych są traktowane jako ograniczenia prawa własności nieruchomości. Odmiennie niż w regulacji cywilnoprawnej prawodawca przedmiotem obowiązków określonych w tej ustawie czyni grunty rolne, których ujęcie abstrahuje od problematyki stosunków własnościowych. W przeciwieństwie do przepisów prawa cywilnego, oprócz właściciela, szereg obowiązków związanych z ochroną gruntów rolnych został nałożony także na inne podmioty, które wykorzystują nieruchomości w sposób ekonomiczny. Właściciel nieruchomości ma zgodnie z regulacją ustawy szereg obowiązków, takich jak zakaz jej nierolniczego wykorzystania bez uprzedniego przeznaczenia terenu na cele nierolnicze oraz bez uzyskania zgody na wyłączenie gruntów z produkcji. Obciążają go również czynne obowiązki, m.in. obowiązek przeciwdziałania degradacji gruntów. Powinności te nie kształtują podmiotowego prawa własności, ale pozostają wobec niego zewnętrzne, jakkolwiek powinny być traktowane jako jego ograniczenia.

Sustainable development requires reconciling the requirements of agricultural land protection with increased investment needs in industry and housing, but also with respect for environmental protection requirements. These objectives should also be pursued in relation to agricultural land within the administrative boundaries of cities. However, with regard to agricultural land in cities, there is a clear conflict between the needs of investors and the resulting pressure to invest and the protection of agricultural land. The analysis of such determined research topic required a territorial approach to the protection of agricultural land, which is reflected in spatial planning. The purpose of this study is to analyze the Polish legislation from the point of view of the admissibility of change to agricultural land use in urban areas. ; Zrównoważony rozwój wymaga pogodzenia wymogów ochrony gruntu rolnego ze zwiększonymi potrzebami inwestycyjnymi w przemyśle i budownictwie mieszkaniowym, a także z poszanowaniem wymogów ochrony środowiska. Cele te powinny być realizowane również w odniesieniu do gruntów rolnych położonych w granicach administracyjnych miast. W odniesieniu do gruntów rolnych w miastach dochodzi jednak do jaskrawego konfliktu pomiędzy potrzebami inwestorów i wynikającą z tego presją na realizację inwestycji oraz ochroną gruntów rolnych. Analiza tak zakreślonego tematu badawczego wymagała podejścia terytorialnego do ochrony użytkowej gruntów rolnych, co znajduje swój wyraz w planowaniu przestrzennym. Celem niniejszego opracowania jest analiza polskiego ustawodawstwa pod kątem dopuszczalności zmiany przeznaczenia gruntów rolnych na obszarach miast.
The article is an effect of interest in research interests across the image of Polish accession to the EU which was created by press texts of regional newspapers of the Western Land of Poland. The press texts was selected broadcast content on the appropriate form, and clearly carved eventually reflect the problems that have become important and have been discussed issues relating to the Polish accession to the EU. Polish-German relations was important point of pre-accession discussions in the regional analyzed newspapers. Based on analysis, can be concluded that the motive for combining texts, newspapers surveyed had hoped that the adoption of Polish EU will speak to a symbol that will contribute to the disappearance of overcoming mutual prejudices and stereotypes still functioning. Although the mutual relations of both countries still had a significant impact historical and social events, it seems that the regional press journalists of the Western Lands really belief that after 1 May 2004 will begin a new stage of history. In press texts was repeated several times the idea of Polish-German 'community of interests'. Analysis of the texts shows that in the pre proceeded quite freely communication processes between German and Polish representatives of local authorities, particularly where the German side clearly says about concerns stemming from EU enlargement, Poles and Germans expecting to improve the better economic situation. The analysis of the press shows clearly that the German political elite was unable to convincingly explain the lack of acceptance of the German society for EU enlargement to include Poland.
The article submits to a scientific discussion on the issue of the auction of a dwelling or a plot of land developed with a residential building, serving to satisfy the debtor's housing needs during the SARS-CoV-2 virus epidemic. The key importance should be attached to the new Article 9521 § 5 of the Civil Procedure Code, which states that an auction of a dwelling or a plot of land developed with a residential building, which is to meet the housing needs of the debtor, is not carried out during the state of epidemic threat or epidemic state and 90 days after its end. The new legal solution highlights the general problems with the organization of the work of the courts (related to judicial enforcement proceedings) during the SARS-CoV-2 virus epidemic and the division of duties between the district court and the court bailiff. The presented considerations postulate the introduction of innovative solutions applicable not only in the state of epidemics. Firstly, an introduction, through legislative intervention, of an electronic auction in the course of enforcement of real estate, following the example of an electronic auction of movable property. Secondly, breaking the rule according to which the auction of real estate requires direct supervision by a judge (court clerk). Jahrhundertelang durchdrangen sich auf diesem Gebiet polnische und deutsche Einflüsse und das Gebiet wechselte ständig den Besitzer. Ursprünglich gehörte es zum Königreich Polen, im 13. und 14. Jahrhundert wurde es vom Deutschen Orden besetzt, 1466-1772 war es erneut bei Polen und kam danach infolge der Teilungen an den preußischen Staat. 1914, vor Beginn des 1. Weltkriegs hatte es den Anschein, als sei diese jahrhundertelange Rivalität von der deutschen Seite gewonnen worden. Denn die demografischen Tendenzen entwickelten sich zugunsten der Deutschen. Nach den offiziellen Angaben aus der Volkszählung von 1910 wohnte in der damaligen Provinz Westpreußen 65% deutsche und 35% polnische Bevölkerung. In 1914, at the beginning of the outbreak of the Great War, it seemed that the German party had won this competition lasting for several centuries. Demographic trends were more favorable for the Germans. According to the official data of the 1910 census, the then province of West Prussia was inhabited by 65% of the German and 35% of the Polish population. Four years of the Great War changed this situation. In November 1918, Germany lost the war, and the issue of Poland's independence and its return to the Baltic came back to the arena of international negotiations. Local Polish circles also took actions to organize local Polish structures. This is how the Subcommittee of the Supreme People's Council based in Gdańsk was established; what is more, local People's Councils were set up in each county. Underground structures were also emerging, including above all the Military Organization of Pomerania. Its structures were particularly active in the Tuchola Forest and in the Chełmno region. The final shape of the borders and the political belonging of the disputed lands was decided by the Versailles Treaty signed on 28 June 1919. Upon the strength of the Versailles Treaty, 62% of the area of the province of West Prussia was granted to Poland. However, the capital of Pomerania - Gdańsk, which was declared the free city, remained outside Poland. Local development policy consists of many sub-policies that allow for proper management of a commune. Tools that support the process of management and decision-making in local government units are land information systems. Their use is also possible in the development of a participatory model of a commune.The chapter presents the essence of local development policy and identifies the tools used in the process of its operation. Particular emphasis is put on the use of land information systems, which due to their use in communes may be an essential element of support for the implementation of territorial unit tasks. They are also a tool supporting the accomplishment of the concept of good governance in the activities of local authorities. The chapter presents good practices in the scope of use of land information systems in collecting data and supporting decision-making processes with the use of these tools. An important element of the participatory decision-making is the SoftGIS method identified as one of the best functioning methods in Scandinavian conditions, which is also used in Poland. In the chapter, data from the research carried out in the scope of good governance, showing the level of civic engagement in co-government, has been used.
The Institute for Scholarly Research on Eastern Europe in Wilno functioned from 1930 to 1939. It was established on the initiative of Stefan Ehrenkreutz and other professors of the Department of Law and Social Sciences at Stefan Batory University in Wilno. A Higher School of Political Science was established at the same time as the Institute. Members of the Institute consisted of notable Polish scholars, writers, journalists along with social and political activists. The Institute's purpose was to conduct research on economic, cultural, social and political questions, to research the formation of government structures in the lands between the Baltic and Black Seas, as well as to study the peoples of these lands and to propagate this knowledge. In this connection the Institute acquired impressive library collections of the newest literature on these topics. It organized public readings and presentations. It published two scholarly magazines, "The Yearbook of the Institute for Scholarly Research on Eastern Europe in Wilno" and "Balticoslavica", along with a series of books. It formed and maintained contacts with many scholars, institutions and academic associations both in Poland and abroad. In the relative short period of time during which it operated, the Institute became an important scholarly center and made a significant contribution to the research of events, politics, culture and the economies of neighboring countries.

https://wuj.pl/ ; Die verwickelte und auf vielen Ebenen verlaufende Frage nach der Rolle der politischen Parteien in der Wirksamkeit des Bundesrates der BRD gehört zu den umstrittensten Fragen der deutschen Wissenschaft; es ist schwer, den Standpunkt der einzelnen Forscher diesbezüglich auf einen gemeinsamen Nenner bringen zu wollen. Die Auseinandersetzungen mit diesem Problem tauchten bereits in den Disskussionen im Parlamentarische Rat über den Entwurf des Grundgesetzes auf. Die Folge dessen war, dass man die Struktur des Bundesrates akzeptierte, die die Verfassungstradition Deutschlands berücksichtigte und nicht die des Senats, die damals als Alternative stand. Nachdem der Verfasser sowohl den normativen Stand und die Meinungen eines Teils der westdeutschen Doktrin bezüglich der angenommenen Struktur des Bundesrates als auch die Prinzipien, nach welchen die Parteien an der Gestaltung des Gesamtwillens der Nation mitwirken, analysiert hat, kommt er zum Schluss, dass das gesetzliche Verfassungssystem der BRD ein Mangel an innerem Zusammenhalt aufweist. Es ist die Folge einer ungeschickten Verknüpfung von Verfassungsrelikten aus dem 19 Jahrhundert mit den in der westlichen Welt schon ziemlich verbreiteten Verfassungsprinzipien bürgerlicher Demokratien. Dieser Mangel ist weit fortgeschritten und vertieft, weil die Doktrin mit steifen und traditionellen Kategorien umgeht. Darüberhinaus nimmt dieses Verfassungssystem keine Rücksicht auf die für das effektive Funktionieren notwendigen praktischen Erfordernise. Danach bespricht der Verfasser die tatsächlichen Mechanismen, nach denen die Wirksameit des Bundesrates von den Parteien beeinflusst werden; er weist darauf hin, dass sie einerseits vom Charakter des imperativen Mandats abhängig sind, andererseits von den in der Praxis gestalteten gegenseitigen Verhältnissen zwischen den Parteiorganisationen (Instanzen), durch welche Regierungen der Bundesländer ausgestalten werden, und den Parteiorganisationen, die im Bundestag repräsentiert sind. Die Analyse beider Faktoren erweist, dass sie nicht nur die Beeinflussung des Bundesrates seitens der Parteileitung nicht behindern, wie manche Vertreter der westdeutschen Doktrin behaupten, sondern dass sie, im Gegenteil, wesentliche Elemente sind, die diese Beeinflussung in ihrer Wirksamkeit noch fördern. Die Formen und Methoden, derer sich politische Parteien bei der Beeinflussung der Bundesratsmitglieder bedienen, sind wesentlich verschieden von denen, die im Bundestag bestehen. Der Grund dafür ist im Mangel an gesetzlich festgelegten Parteistrukturen im Bundesrat zu sehen. Der Entscheidungsprozess in diesem Organ ist einer Reihe verschiedener Faktoren unterordnet, deren Aktivierung von der Art der zu Debatte stehenden Angelegenheit abhängt. Die Hauptrolle unter ihnen spielen politische Parteien, die den Rahmen für die Wirkung des bürokratischen Fachapparates der Bundesländer abstecken. Bei der Einflussnahme seitens der partei-politischen Organe bemerkt man die Tendenz einer verstärkten Aktivierung entweder der föderativen Wirksamkeit der Parteileitung oder aber der Länderleitung. Jene Aktivierung ist abhängig hauptsächlich vom Spannungsgrad und nicht selten vom politischen Kampf in Sachen, die im Bundesrat zu Debatte stehen. Sind es Angelegenheiten von grosser politischer Bedeutung, besonders wenn sie aussenpolitische oder Verteidigungsprobleme oder aber gesetzliche Regelungen von Wichtigkeit für die Parteiinteressen betreffen, dann treten deutlich Einwirkungen der Bundesparteileitung auf, die mit der Stellungnahme der Fraktion im Bundestag übereinstimmen. Sind es aber Angelegenheiten von Interesse für die einzelnen Bundesländer, wie z. B. neue Einteilung von Steuereinnahmen oder von finanziellen Belastungen, Verteilung von Aufgaben, besonders jener, die die gesetzliche Selbständigkeit der Bundesländer begrentz, dann wiegen Gründe der Landesparteileitungen wie auch der mit ihr eng verbundenen Landesbürokratie vor. Je nach dem Charakter der Angelegenheit werden also die einzelnen Vertretungen der Länder bestimmten Gliederungen unterordnet, übereinstimmend mit der von der Regierungsmehrheit oder Opposition angegebenen Linie. Diese Unterordnungen sind jedoch keine einfache Konsequenz jener Gliederung, weil das Kräfteverhältnis in den Landtagen anders als im Bundestag verläuft. Ein anderer daraus resultierender Grund ist das ungleiche Verhältnis der die Regierungsmehrheit bildenden Parteien in den Ländern zu den Parteien der Regierungsmehrheit und der Opposition auf Bundesebene. Die von den einzelnen Länderregierungen vertretenen Stellen im Bundesrat sind daher in der Praxis das Ergebnis äusserst komplizierter und verwickelter gegenseitiger Abhängigkeit und Verknüpfungen; die wesentlichen Varianten derselben werden von Verfasser einer Analyse unterzogen. Trotz jener Verwicklungen herrscht jedoch sowohl im Bundesrat, als auch im Bundestag eine Gliederung vor, die aus dem angenommenen alternativen Regierungssystem resultiert: Kräfte, die die Wirksamkeit der Regierung unterstützen, neben solchen, die zu jener in Opposition stehen. In den Jahren, wo die Mehrheit in den beiden Parlamentskammern in Westdeutschaland der christlichen Demokratie und ihren Koalitionspartnern gehörte, beobachtete man eine Zunahme der Zentralisierung neben Abschwächung des föderativen Charakter des Staates. Das geschah hauptsächlich dadurch, dass die Bundesbehörden sich der Befugnisse der Landesorgane bemächtigten, was in der Praxis dazu führte, dass die BRD in ein Staat des "kooperativen Föderalismus" verwandelt wurde. Der Bundesrat dagegen, staat die Interessen der Länder auf Bundesebene zu vertreten, wurde in der Tat zum Instrument in den Händen der politischen Leitung des Bundes, zwecks Einflussnahme auf die Regierungen und die Parlamente der Länder. Nach der Machtübernahme durch die kleine Koalition SPD/FDP im Jahre 1969 blieb die Superiorität im Bundesrat bei der christlichen Demokratie; deshalb wurde auch der Bundesrat kein wirksames Oppositionsinstrument gegenüber den Massnahmen der Regierung, obwohl jetzt öfter denn je gegen das Handeln der Regierungsmehrheit Einsprüche seitens der zweiten Kammer erhoben wurden. In den Schlussfolgerungen behauptet der Verfasser, dass der auf traditionellen deutschen Konstruktionen basierende Bundesrat nichts zur Vertiefung des föderativen Charakters des Staates beigetragen hat; im Gegenteil, infolge verschiedener Wandlungen — Resultat der von politischen Parteien gestalteten Praxis — ist der Bundesrat zu einem wesentlichen Element in der Entwicklung und Festigung des Zentralisierungsprozesses geworden und, in Konsequenz, einer gewissen Deformierung der Verfassung, die ein auf legalem Wege unantastbares und unveränderliches fundamentales Prinzip des Bundesstaates bildet.
The article summarises, analyses and develops the opinions conveyed by the secondary literature regarding the inspirations for the reorganisation of the military system of Peloponnese as proposed by George Gemistos Plethon. Three sources of inspiration taken into consideration are: the ancient one (Platonic theoretical framework and the Spartan society), the Byzantine one (the pronoia system) and the Ottoman one (the timar system). It seems that for Plethon the ancient component was more important in the symbolic sphere related to the Hellenic identity promoted by him. The core of the reform consists of the idea of binding the duties towards the state with the income derived from the land.
