Cet article interroge l'exercice de la police de proximité, et ses multiples acteurs, dans des quartiers de villes rwandaises. Les autorités centrales du Rwanda, tout en s'appuyant sur la participation locale – apparemment volontaire – pour prévenir la criminalité, maintiennent une nette séparation entre ceux qui agissent sous leur autorité et ceux qui agissent avec leur autorité. Il en résulte un appareil très efficace de signalement de la criminalité dans lequel les frontières institutionnelles de l'État sont exceptionnellement bien définies. Cette recherche, reposant sur 18 mois de travail sur le terrain entre 2013 et 2015, met ainsi en valeur la pluralité des acteurs participant à la police et au maintien de l'ordre à l'échelle locale d'une manière qui n'a pas encore été faite au Rwanda.

L'exploitation illégale des forêts est une menace importante pour la plupart des grands massifs forestiers tropicaux. Afin de lutter contre l'exploitation et le commerce illégaux du bois, l'Union européenne a mis en place le Plan d'action « Forest Law Enforcement, Governance and Trade » (FLEGT) qui a ouvert la négociation de l'Accord de partenariat volontaire avec le Cameroun. En 2010, les deux parties ont signé cet accord qui engage le Cameroun à assurer la légalité du bois à destination des marchés extérieurs et intérieurs pour tous les titres forestiers. Les forêts communautaires ont de ce fait été incluses dans cet accord et devront assurer la légalité de leur production de bois. Pour ce faire, une grille de légalité spécifique a été élaborée. Cette grille de légalité a été testée au sein de la moitié des forêts communautaires actives afin d'analyser les écarts existant entre les activités telles qu'elles sont conduites sur le terrain et les indicateurs de légalité inclus dans la grille. Les résultats montrent qu'aucune des forêts échantillonnées ne respecte entièrement les exigences de cette grille. Cette étude a permis d'identifier les goulets d'étranglement qui s'avèrent liés à des procédures complexes et au coût excessif qu'impose le respect de la légalité. Certains vérificateurs actuellement non conformes pourraient le devenir en renforçant les capacités des communautés et aussi en modifiant diverses réglementations. C'est à ces conditions que ces forêts pourront constituer une source d'approvisionnement légal du marché national du bois. ; Illegal logging is a threat to the world's tropical forests. To act against overexploitation of timber, the European Union has set up the Forest Law Enforcement, Governance and Trade action plan (FLEGT), which opened the Voluntary Partnership Agreement (VPA) negotiating agenda with Cameroon. In 2010, the two parties signed the VPA, committing Cameroon to ensure the legality of timber from all logging concessions sold on external and domestic markets. Community forests (CF) were included in the agreement and must therefore ensure the legality of their timber production. To do that, a specific legality grid has been developed. This was tested in half of active community forests in Cameroon to analyse any gaps between activities as practiced in the field and the legality criteria set out in the legality grid. The result show that no CF fully complied with this grid. The study identified obstacles due to complex procedures and to the excessive costs of compliance. Some criteria not currently met could be complied with through community capacity-building and by amending certain regulations. Under these conditions, community forests could become a source of legal supplies at least for the domestic timber market. ; Peer reviewed

The present Report on "EU European competition law enforcement and the challenges of globalisation" adrresses a series of expert questions. It is part of a fact-finding mission of the European Affairs Committee of the National Assembly of the French Republic. The objective of this fact-finding mission is to draw the consequences of the veto imposed on the merger between Siemens and Alstom in February 2019 and to assess whether European competition law is now ill-adapted to the new challenges posed by the globalization of the economy. The objective assigned to the information mission is to find possible ways of reforming this law in order to enable the emergence of European "industrial champions", while respecting the objective of consumer protection. ; Ce rapport répond à une série de questions-réponses portant sur « le droit européen de la concurrence face aux enjeux de la mondialisation ». Il s'inscrit dans le cadre d'une mission d'information de la Commission des affaires européennes de l'Assemblée nationale de la République française. L'objectif de cette mission d'information est de tirer les conséquences du veto opposé au rapprochement entre Siemens et Alstom en février 2019 et de mesurer si le droit européen de la concurrence se trouve désormais inadapté aux nouveaux enjeux posés par la mondialisation de l'économie. L'objectif assigné à la mission d'information est de trouver les modalités éventuelles de réformes de ce droit afin de permettre de faire émerger des « champions industriels » européens, tout en respectant l'objectif de protection des consommateurs.

The Ph.D. project aimed to analyze the right to privacy in light of the recent restrictions and derogations put in place in international and European law, particularly in response to the terrorist attacks that occurred on 11th September, 2001. In this context, tensions peaked in 2013 when former NSA employee, Edward Snowden, denounced mass surveillance programs put in place by the American government. These programs, made also possible by the collaboration of the most important American internet service providers, aimed to monitor American citizens and not. Undeniably, in 2013 the international community gained greater awareness of the potential risks connected to the indiscriminate collection of personal information by the National Security and law enforcement authorities. In fact, there are still many States that consider mass surveillance an effective tool in protecting national security and preventing terrorist attacks. However, these measures simultaneously contain considerable risks for citizens' rights, due to either the frequent lack of adequate jurisdictional control at a national level or the indiscriminate nature of the data collected. Despite the importance of the right to privacy, there is still a lack of adequate legislation in this matter. This is especially evident at the international level. Notably, Article 12 of the Universal Declaration of Human Rights and Article 17 of the International Covenant on Civil and Political Rights both fail to explicitly provide for the protection of personal data. Furthermore, there is no mention of this right in article 8 ECHR. The legal deficiencies, mainly caused by the lack of adequate technical knowledge on the matter during the period that these conventions were drafted and ratified, have been partially compensated for by the development in case-law put in place by the European Court of Human Rights, beginning with the Klass and others v. Germany sentence until the more recent Big Brother Watch and others v. United Kingdom. In particular, according to the judges of Strasbourg, any limitation must be provided for by law, pursuing a legitimate aim, is necessary in a democratic society and respectful of the principle of proportionality. From a legislative point of view, the situation seems to be consistently more favorable in the European context where the right to privacy has become a fundamental right, according to Article 8 of the Charter of Fundamental Rights of the European Union and Article 16 TFEU. In the final part of the project have been also identified and analyzed other significant unresolved issues in the context of the right to privacy, regarding in particular corporate responsibility for illegitimate transmission of personal data to National Security and law enforcement authorities, which violates international standards protecting human rights, and possible extraterritorial exercise of jurisdiction by monitoring bodies.

La mise en oeuvre des règles de responsabilité implique de choisir entre un régime de responsabilité pour faute ou sans faute. Dans cet article, nous analysons les déterminants du respect des règles de droit lorsqu'il existe des coûtes liés à la stigmatisation en plus des incitations économiques standard. Ce coût de stigmatisation ne correspond donc pas à un simple transfert de ressources. Nous montrons que lorsque le standard définissant le régime de responsabilité pour faute est égal au niveau de dissuasion, le résultat n'est jamais optimal. Le régime de responsabilité optimal dépend des montants de dommages constatés et du coût de la stigmatisation. Classification JEL: K13, K42, D62

This paper explores the normative challenges of digital security technologies i.e., end-to-end (E2E) encryption and metadata analysis, in particular in the context of law enforcement activities. Internet of Things (IoT) devices embedded in smart environments (e.g., smart cities) increasingly rely on E2E encryption in order to safeguard the confidentiality of information and uphold individuals' fundamental rights, such as privacy and data protection. In November 2020, the Council of the EU published a resolution titled "Encryption – Security through encryption and security despite encryption". The resolution seeks to ensure the ability of security and criminal justice authorities to access data in a lawful and targeted manner. Nonetheless, in the context of pre-emptive surveillance and criminal investigations, E2E encryption renders the analysis of the content of communications extremely challenging or practically impossible, even when access to data could be lawful. Here, two different layers of complexity seem to emerge. They concern: (i) whether a balance between the values protected by E2E encryption and the aims of law enforcement can be attained; (ii) whether state-of-the-art AI models can preserve the advantages of E2E encryption, allowing for inferences of valuable information from communication traffic, with the aim of detecting possible threats or illicit content. Against this backdrop, we firstly examine whether AI algorithms, such as Machine Learning and Deep Learning, might be part of the solution, especially when it comes to data-driven and statistical methods for applying classification in encrypted communication traffic so as to infer sensitive information about individuals. Secondly, we consider the possible uses of AI tools in the analysis of IoT-generated data in smart cities scenarios, focusing on metadata analysis. We explore whether that AI-based classification of encrypted traffic can circumscribe the scope of law enforcement monitoring operations, in compliance with the European surveillance case-law. Finally, as far as our research focus is concerned, we discuss how the use of AI bears the potential of smoothing traditional trade-offs between security and fundamental rights, allowing for encrypted traffic analysis without breaking encryption.

Indeed, from November 2015 to November 2017, the terrorist threat looming over France allowed police departments to use anti-terrorist measures against social movement actors. Interviews with people under house arrest and those legally banned from demonstrations will serve to illustrate how anti-terrorism proceeds from a "terrorisation" of these populations. We propose to show the processes behind its emergence, its methodology and its effects on the concerned populations. ; Dans cette contribution, nous reviendrons sur la façon dont des mesures exceptionnelles ont été utilisées dans l'objectif de réprimer des mouvements sociaux. En effet, d'octobre 2014 à novembre 2017, la menace terroriste qui plane sur la France a permis aux services de police d'user de mesures antiterroristes sur des acteurs des mouvements sociaux. À partir d'entretiens avec des assignés à résidence et des interdits de manifester, nous montrerons la façon dont l'anti-terrorisme procède d'une « terrorisation » de ces populations. Nous proposons ici de montrer les processus dans lesquels elle s'origine, sa méthodologie et ses effets sur les populations concernées.
