Članak završava analizom dokumenta o ljudskom bratstvu pape Franje i velikog imama Ahmada al-Tayyeba i njegovog etičkog pristupa dijalogu. ; The present article pleads for the revival of an interreligious dialogue on ethics and law as an instrument of peace and reconciliation. Whereas the first phase of IRD was marked by a considerable prominence of these topics, the have become of less importance in the second phase. This needs correction for two reasons. Theoretically the rationality of dogmatic or systematic insights (as found in all faith traditions) is largely exclusive, whereas the rationality of ethics, also religiously founded ethics, is basically inclusive. It is therefore open to dialogue. There exists considerable common ground on norms, rules and values between religious traditions, which are to serve humans, the society and the political community. This is of particular importance in today's multi-religious societies as well as in a world more than ever interconnected by globalization. The article concludes with an analysis of the document on Human Fraternity of Pope Francis and Grand Imam Ahmad al-Tayyeb and its ethical approach to dialogue.

Considering that in the spectrum of juvenile criminal sanctions punishment of deprivation of liberty is the most severe criminal sanction, international documents related to juveniles in conflict with the law proclaim standards that this sanction has to be imposed only as a measure of last resort and for the shortest period. Issues like possible duration of subject sanction and scope of its imposition, represents some of the basic features of the legal and judicial policy of sanctioning of juveniles, and represent the subject of this paper. The author analyzes how these issues are regulated in Bosnia and Herzegovina"s and comparative law, and how aforementioned standards are applied in practice. Applying the comparative analysis it was determined that there are certain indicators that Bosnia and Herzegovina is one of the countries that has in its heritage "humane" sanctioning policy of juvenile offenderes, and that the aforementioned international standards are consistently accepted in domestic law as well as in the jurisprudence.

This volume is the first study of the influence of Roman law on the first written law of Iceland. Starting with a presentation of the legislation during the period of the Icelandic free state, Hafliði Másson is presented in detail. Through him influences from Roman law, as well as norms from the Old Testament played a part in the legal codex of Grágás. The work is thus of significance for legal history as well as for German and Byzantine studies. Hans Henning Hoff, Hamburg.

; Undertaking legislative reform becomes necessary when the legal system does not respond to the needs of society in changed social circumstances. The reform can be carried out on the basis of existing sources, within the legal system to be reformed, or by borrowing institutions from more advanced systems, which are already known. After the 11th century, following the revival of the function of the state in Europe, more and more rulers resorted to the reform of the legal system, as a response to the growing problems that society was facing. This reform began in Sicily in 1140, with the enactment of Assizes from Ariano and continued in England with the enactment of The Assize of Clarendon? (1166) by King Henry II. In an attempt to point out the possible influence that took place by taking ready-made solutions from one legal tradition to another, the historical and comparative method is used. Some legal institutions that were part of this reform indicate that these were transplants that the Anglo-Saxon and Norman traditions did not know. The solutions adopted point to similarities with the Sharia legal tradition, and their transposition into the English legal system could have come through people who were in the service of the Norman rulers in Sicily (Roger II) and who later entered the service of King Henry II.

Medieval Icelandic law contains no provisions about copyright. Authors used without hesitation narrative texts by others, but poets were paid for composing laudatory poems about kings and narrators for telling stories at their courts. The art of storytelling became a speciality of Icelanders, who were also hired to write biographies of Norwegian kings. It was considered reprehensible to use the poetry of others as one's own work. Two Norwegian poets may have got the cognomens skáldaspillir (Destroyer of poets?) and illskælda (Bad or Evil poet?) for plagiarism. An Icelandic poet composed a laudatory poem about a woman but changed it to fit another one, receiving a bitter revenge. In Icelandic sagas stanzas occur frequently and, unlike borrowings in prose, their authors are usually named. In the medieval law of Iceland it is forbidden to compose about people not only derogatory but also laudatory poetry. Conceivably it has been considered to give the author some kind of power over the person who was the subject of the poetry. Proper copyright, though, does not occur in Icelandic law until the beginning of the twentieth century.
This paper aims at defining the concept of "geopolitical space of the geopolitics of the Sea" and it analyses the way it is constructed. Given that the notion of geopolitical space in the general sense has been largely neglected in contemporary geopolitical theory, this is not a simple task. The paper deals with a physical space of the World Sea and utilizes the theory of modern human geography in which space is understood as a product of human activity. We argue that there is a significant connection between geopolitics of the Sea and the academic discipline of the International Law of the Sea. This link is taken as the basis for the discussion regarding geopolitical space, which encompasses three teleological elements: the fulfillment of the paper's main objective; the argument regarding the connection of Geopolitics of the Sea with the International Law; and, finally, presenting the political science context of the codification of the modern International Law of the Sea. By using earlier studies, the paper analyses the geopolitical space through ideas of construction within dichotomy, as well as through the process of establishing a community within the international framework. The paper also offers our own theory according to which the geopolitical space is the space of manifestation of geopolitical phenomena.

Á fyrstu áratugum tuttugustu aldar mótaðist meðal bandarískra lögfræðikennara hreyfing í kringum þetta efni (e. the law and literature movement) sem hafði framan af þann tilgang að bæta húmanískan bakgrunn lögfræðinema. Um miðjan þriðja áratuginn voru færð rök fyrir mikilvægi þess að lögfræðingar kynntu sér skáldskap og bókmenntir. Þar sem starf stéttarinnar snerist að verulegu leyti um skriftir (að semja sóknar- og varnarræður, lög og dómsorð) væri yfirgripsmikil þekking á stíl og stílbrögðum gagnleg hverjum þeim sem vildi ná árangri í faginu. Ekki leið á löngu þar til bandaríska fræðiumræðan fór að hafa áhrif víðar, meðal annars í Evrópu. Meginmarkmið með þessu þemahefti Ritisins er að kynna þessa fræðahefð hérlendis og vekja áhuga á margháttuðum tengslum lögfræðinnar við bókmenntafræði, sagnfræði og heimspeki. Í heftinu birtast fjórar frumsamdar og tvær þýddar greinar þar sem lög og bókmenntir fléttast saman.

The aim of this article is to discuss two contemporary Icelandic novels, Kata by Steinar Bragi and Gott fólk by Valur Grettisson, in connection to interpretations of revenge literature and films in the field of Law and literature. Both novels deal with shortcomings in the legal system and judiciary in dealing with and proving crimes involving rape and sexual abuse. This analysis focuses on how the two novels are connected to the advocacy for change, both for the legislator and the judicial system in Iceland. The novel Kata is named after the protagonist, whose daughter is kidnapped, raped and murdered. Kata decides to revenge her daughter and murder the perpetrators, one by one. Throughout the story the reader is made aware of the necessity of avenge, but still the question of righteousness remains. In Gott fólk the narrator, Sölvi, is put through the accountability process by Sara and her friends, after she accuses him of both mental and sexual misconduct during the time of their relationship. Sölvi experiences the process as revenge, but to the reader it is clear that he is guilty and cannot cope with that realization. The two novels offer a basis for discussion on sexual offence, the legal system, revenge and justice.
