In seinem Beitrag erläutert der Autor aus rechtswissenschaftlicher Perspektive den Einfluss der Medien auf die Rechtspolitik in der Bundesrepublik Deutschland. Im Kontext dieses Vorhabens kommt es zunächst zu einer Begriffsbestimmung von Rechtspolitik. Dabei wird ein Streifzug durch die juristische Literatur vom Staatsrechtler Paul Laband bis zum Völkerrechtler Carl Schmitt unternommen. Rechtspolitik heißt demnach weitläufig formuliert, die tatsächlichen Verhältnisse durch Rechtssetzung - Sache des Gesetzgebers - und Rechtsauslegung - Sache der Gerichte - im Sinne einer durch höherrangiges Recht, also durch Verfassungsrecht, definierten Grundordnung auf eine begrenzte Dauer zu bestimmen. Der zweite Bestandteil des Themas umfasst die Medien und ihre drei Grundfunktionen: (1) Sie können durch das Finden (oder Erfinden) eines Themas, durch seine hartnäckige Verfolgung der Politik die Anregung geben, tätig zu werden. (2) Sie informieren die der von den Politikern ausgeübten Macht Unterworfenen über die Absichten der Politik und den jeweiligen Stand der Verwirklichung. (3) Sie sprechen Urteile aus über das Handeln der Politik als Angebote an das Publikum. An diesen Möglichkeiten orientiert, wird sodann unter Berücksichtigung konkreter Beispiele (Gentechnik, Sozialpolitik usw.) die mediale Macht auf die Rechtspolitik ausgelotet. Weil der Begriff der Rechtspolitik sich einer bündigen Definition entzieht, so der Autor abschließend, verharrt der diesbezügliche Einfluss der Medien im Ungefähren. (ICG2)

Legal policy is a transformation of political goals into state programs and projects and achievement of such goals based on law. Nowadays the problem of effectiveness of legal policy is extremely discussable.
We should underline that for the role of law in Russian society increases as well as a flow of legal information. Various legal acts have been adopted and the new system of legal regulation in different spheres (in particular, in politic sphere) is emerging. As the result our society, individuals and legal entities have more actively began using «Law» to solve their problems, to protect their rights, to resolve conflicts.
But narrow-minded and weak legal policy with the inappropriate legislation is continuously being reflected in the unsatisfactory implementation of social, economy and etc. policies. So, the effectiveness of legal policy determines, inter alia, how effective are the legal policy entities. Some of them take part in all forms of legal policy realization, some of them are active only in particular form. This research helps to understand the peculiarities of the role of legal policy entities.
