El objetivo del trabajo es analizar la conformación de la sala de representantes de la provincia de Mendoza entre 1852 y 1861 desde una perspectiva institucional que inserte el proceso en la dinámica relacional con los poderes ejecutivo y judicial, también en conformación. Para ello se examinarán los discursos sobre la legislatura en la normativa y en la prensa, pasando luego al estudio cuantitativo y cualitativo de la actuación de la sala. La hipótesis que guía el trabajo sostiene que expectativas altas sobre las posibilidades de la cámara llevaron a la producción de discursos negativos sobre ella, pero el accionar real de los legisladores no habría reflejado tales imágenes. ; The aim of this paper is to analyze the formation of the House of Deputes of the Province of Mendoza between 1852 and 1861. An institutional perspective is chosen to insert the process in the relational dynamic between the executive and judicial powers, also in conformation. In order to accomplish it, the discourses on the Legislature, both in the legislation and in the press, will be examined; going in a second time to the quantitative and qualitative study of the work of the Chamber. The hypothesis that guides the paper argues that high expectations about the possibilities of the House led to the production of negative statements about it. This article analyzes the historical development of Chilean congressional leadership offices (1834-1924), while testing a proposition of the theory of legislative institutionalization that says that legislatures gradually move toward greater boundedness over time. The indicator of boundedness is the length of the apprenticeship of congressional leaders. Lateral entry, short office tenure, and returning leaders became distinctive features in the case at hand. Institutional design and exchanges between the legislature and the environment determine legislative institutionalization, so a legislature institutionalizes by acquiring stability, permanence, distinctiveness, and sustainability in a polity. ; Este artículo analiza el desarrollo histórico de las oficinas de liderazgo parlamentario chilenas (1834-1924) y somete a prueba una proposición de la teoría de institucionalización legislativa que dice que los congresos gradualmente aumentan su delimitación. El indicador de delimitación es la extensión del aprendizaje de los líderes parlamentarios. En el caso en estudio, entrada lateral, permanencias cortas y líderes retornados constituyeron características distintivas. Diseño institucional e intercambios entre el congreso y el ambiente determinan la institucionalización legislativa, por lo que un congreso se institucionaliza en virtud de su estabilidad, permanencia, unicidad y sustentabilidad.

El artículo examina algunas de las principales conceptualizaciones y posturas acerca de la violencia en las escuelas mexicanas propuestas recientemente por parte de dos actores externos al sistema educativo cuya importancia es incuestionable: Se trata de los medios de comunicación y el poder legislativo. Estas miradas se abordan mediante un análisis de contenido de las noticias en la prensa escrita de alcance nacional así como de las leyes existentes en once entidades y una revisión documental de la literatura especializada, tomando en cuenta las conceptualizaciones, propuestas e implicaciones más relevantes para el sistema educativo y las escuelas. Este análisis es esencial dado el alcance profundo de las funciones que estos dos actores cumplen en el país y, sobre todo, por la peculiar manera en que ellos han contribuido a enfocar y, en consecuencia, a impulsar acciones concretas dirigidas a la prevención y erradicación de la violencia escolar en México. ; The article examines some of the main concepts and attitudes about violence in Mexican schools proposed recently by two actors external to the education system whose importance is indisputable: it's the media and the legislature. These looks are addressed through a content analysis of the news in the newspapers nationwide as well as eleven entities existing laws and a documentary review of literature, taking into account the conceptualizations, proposals and relevant implications for the educational system and schools. This analysis is essential given the deep scope of functions that comply with these two actors in the country and, above all, by the peculiar way they have contributed to focus and, consequently, to promote specific actions aimed to the prevention and eradication of violence in schools in Mexico

The complexity of this work was due to the diversity of the collection, which is made up of various movable properties: furniture, paintings, stained glass windows, and light fixtures that are located in the offices of the aforementioned institution. As they are part of the daily activity of the establishment, these objects are exposed to permanent changes in location and to a degradation process due to their use. As a result, some of these properties are in a deficient state of conservation, which made it necessary to detect certain pathologies for their possible restoration. This article disseminates some of the results obtained by the assessment of the heritage status of these properties. And our reflections related to the problem of working on this subject with a public institution, which do not have a management plan or trained personnel to manage such an important collection ; El presente artículo expone la experiencia del relevamiento, catalogación y puesta en valor del patrimonio material mueble perteneciente a la Legislatura de la provincia de Mendoza, Argentina, llevado a cabo entre mayo de 2019 y abril de 2020. La complejidad del trabajo se debió a que el acervo está conformado por diversos objetos: mobiliario, obras pictóricas, vitrales, artefactos lumínicos y se encuentran en los despachos de la mencionada institución. Al ser parte del funcionamiento cotidiano del establecimiento, están expuestos a permanentes cambios de emplazamiento y desgaste por su utilización. Algunos de estos se encuentran en estado de conservación deficiente, lo que hizo necesario la detección de ciertas patologías para una posible restauración. Presentamos a continuación algunos de los resultados obtenidos con este proyecto y diversas reflexiones que surgieron a raíz del problema de trabajar con bienes muebles de instituciones públicas, que no cuentan con un plan de manejo ni con personal capacitado para administrar tan importante colección.

Al ser parte del funcionamiento cotidiano del establecimiento, está expuesto a permanentes cambios de emplazamiento y desgaste por su utilización. The launching pad of this paper is the so-called counter majoritarian difficulty, and its aim is to look into some particular mechanisms found in comparative law which could overcome it. In this sense, after a brief incursion into the concepts of "dialogic constitutionalism" and "new Commonwealth constitutionalism", the article relates the notwithstanding clause in the Canadian constitution with some types of constitutional rulings that have been being passed in Europe over the last decades. The idea is that, by different means, both mechanisms allow both to overcome the above mentioned difficulty and to clarify the role that judicial review must play in a new context of division of powers. ; Este artículo parte de la denominada dificultad contramayoritaria con el propósito de estudiar algunos mecanismos concretos que han ido surgiendo en el derecho comparado y que podrían servir para superarla. En este sentido, tras una breve incursión en los conceptos de «constitucionalismo dialógico» y «new Commonwealth constitutionalism», el trabajo pone en relación la cláusula «no-obstante» de la Constitución canadiense con ciertas modalidades de sentencias constitucionales que han ido adoptándose en Europa en las últimas décadas, en el entendido de que, aunque diferentes, ambos constituyen mecanismos jurídicos que permiten tanto soslayar aquella dificultad como clarificar el papel que la justicia constitucional debe ocupar en un nuevo contexto de división de poderes.

En este trabajo se analiza el sistema de partidos de la provincia de Entre Ríos durante el período 1999-2015. El objetivo principal es examinar la actividad legislativa de los partidos políticos entrerrianos en función de los cambios producidos en la arena electoral. Para desarrollar el análisis, se observan los proyectos de ley presentados por los representantes del Poder Ejecutivo y la Asamblea Legislativa. La hipótesis del estudio es que una mayor competitividad electoral favorece la producción legislativa del conjunto de los actores partidarios que se desenvuelven en la legislatura provincial. Cuando los resultados de las elecciones son equilibrados, los distintos partidos que acceden a la representación política manifiestan una tendencia hacia la cooperación y, en función de esto, se coordinan para aprobar diversos proyectos de ley. En cambio, cuando se amplía el porcentaje obtenido por el partido ganador y los partidos opositores, el sistema se torna menos cooperativo, afectando la función representativa de la oposición política. ; This paper analyzes the party system of Entre Ríos province during the period 1999-2015. The main objective is to examine the legislative activity of the political parties following the changes produced in the electoral arena. To develop the analysis, we observe the bills presented by the representatives of the provincial Executive and the Legislative Assembly. The hypothesis of the study is that the electoral competitiveness benefits the legislative production of all the agents of the parties that occupy seats in the provincial Legislature. When the election results are balanced, the different political parties tend to cooperate with each other, and as a result of that they coordinate to pass various bills. Los nuevos gobiernos municipales 'del cambio' están promoviendo procesos de participación barriales, sobre todo a partir de 2019, por lo que tienen un carácter novedoso y poco estudiado. En este marco, se presentan dos experiencias institucionales de participación de la comarca de L'Horta Sud (València) que pretenden fomentar la implicación del vecindario en la mejora de la calidad de vida de sus barrios. A partir de las técnicas de observación directa, entrevista abierta y recopilación documental, se exponen las fases y los resultados de estos procesos, evaluados sobre la base de diferentes dimensiones. Asimismo, se comparan con iniciativas similares y con otras fórmulas de participación como los presupuestos participativos de otras ciudades. Como resultado se observa que el espacio barrial es el ámbito privilegiado para favorecer las prácticas deliberativas y que éstas son la muestra de una democracia que puede transformarse o mejorarse mediante estas estrategias participativas. The new municipal governments "of change" are promoting neighborhood participation processes, especially from 2019 onwards, so they are novel and poorly studied. In this context, two institutional experiences of participation from the L'Horta Sud región (València) are presented, which aim to promote the involvement of the neighbourhood in improving their neighbourhoods quality of life. Based on the techniques of direct observation, on the documentary compilation and the project records, there are exposed the phases and their results of the process, evaluated on the basis of different dimensions. They are also compared with similar initiatives and with other forms of participation such as participatory budgets in other cities. As a result, it is observed that the neighborhood space is the privileged area for promoting deliberative practices and that these are the evidence of a democracy that can be transformed or improved through these participatory strategies.

This paper makes different contributions to the New Political Economy (NEP), specifically addressing the role of absenteeism and abstentionism within a group Weighted Majority Game (WGM). The reason for studying this type of topics is because there is no mathematization of the concepts and games proposed here in the political and economic literature. It is found that, under certain conditions, absenteeism benefits the winning coalition and abstentionism harms it. The application of the theory to two of the recent Chambers of Deputies in Mexico, also using SciLab simulations, allowed us to prove that absenteeism and abstentionism play an interesting role in co-participating in the approval of the different agreements. ; En este trabajo se hacen diferentes aportaciones a la Nueva Economía Política (NEP), abordando de manera específica el papel que tiene el ausentismo y abstencionismo dentro de un Juego de Mayoría Ponderada (JMP) grupal. La razón de estudiar este tipo de tópicos es porque no existe en la literatura política y económica una matematización de los conceptos y juegos que aquí se proponen. Se encuentra que, bajo ciertas condiciones, el ausentismo favorece a la coalición ganadora y el abstencionismo la perjudica. La aplicación de la teoría a dos de las más recientes Cámaras de Diputados de México, usando además simulaciones en SciLab, permitió comprobar que el ausentismo y abstencionismo juegan un papel interesante al coparticipar en la aprobación de los diferentes acuerdos.

Legislatures are critical institutions for the effective functioning of a democratic system and in the policymaking process. They are expected to represent the needs and wishes of citizens, identify problems and adopt statutes to address them, and oversee the implementation of policies. However, the extents to which Latin American legislatures fulfill these roles vary greatly from country to country. Despite the recent proliferation of research on executive-legislative relations in Latin-America, comparative knowledge of how legislative institutions operate in these countries is still quite limited. In an effort to improve understanding in this area, I evaluate the extent and nature of the policymaking role played by 18 Latin American legislatures. Specifically, I use multidimensional scaling (MOS) techniques to test if and how the dimensions by which these legislatures have been previously distinguished correspond to observed similarities among them. The analysis reveals that four types of legislatures can be identified. The findings also confirm that those legislatures with greater capabilities are the ones that play more active roles in the policy making process. Adapted from the source document.

In this paper I aim to analyze the sentence ruled by the Supreme Court of Justice of the Argentine Nation in «García» on May, 2019. The matter ruled and the points of view adopted by te votes make it conceptually rich. The majority declared the unconstitutionality of the impugn tax legislation through the questionable application to the case of the principle of equality, that – as I will argue – fails to demonstrate its reasonability and its anchorage with the circumstances of the case under study. The dissenting vote took a deferential position to the legislator that seems the most acceptable but based on reasons that, generalized, could be problematic for the control of constitutionality and, in any case, would require a more finished exercise of argumentation. At once I will present a systematization and a critical analysis of the arguments presented in both votes. ; En este trabajo me propongo analizar la sentencia dictada por la Corte Suprema de Justicia de la Nación Argentina en el caso García de mayo de 2019. La cuestión resuelta y las posturas asumidas por los votos que la componen la vuelven conceptualmente rica. La mayoría del tribunal declaró la inconstitucionalidad de la legislación impositiva impugnada a través de la cuestionable aplicación al caso del principio de igualdad, que —como argumentaré— falla en la demostración de su razonabilidad y en su anclaje con las circunstancias del caso bajo estudio. El voto disidente adoptó una postura deferente al legislador que parece la más aceptable pero apoyándose en razones que, generalizadas, podrían resultar problemáticas para el control de constitucionalidad y, en todo caso, requerirían de un ejercicio más acabado de argumentación. A continuación presentaré una sistematización y un análisis crítico de los argumentos presentados en ambos votos.
