Transnational non-state governance supplies a growing proportion of the rules and regulations that govern the global economy, raising pressing questions about its legitimacy. Cutting across established perspectives, this article adopts the empirical approach of legitimation research to explain variation in the choice of normative strategies to create legitimacy for private rules. To this end, it reviews existing explanations of institutional design in private governance research and integrates them into a common framework of analysis. This framework is put to work in three in-depth case studies, tracing the formation of multi-stakeholder governance in the field of sustainable agriculture – currently the most dynamic site of transnational non-state institution building. The case studies reveal that a full explanation of variation in the use of participation-, expert-, and procedural fairness-based strategies needs to consider both the internal mechanisms of institutional choice as well as differences in the political environments in which these choices are taken.

In this paper, based on my research about the mutual aids between local govern-ments after the Great East Japan Disaster (3.11), I try to describe the process in which I have collected data based on typical theories and through the interaction with informants belonging to local governments in order to discuss the possible relationship between data and theories. First of all, I evaluate two recent empirical studies both of which reached one similar conclusion on one of the typical theoretical perspective shared by most researchers on Japanese society after 3.11. I name this perspective "divergent theory" because that perspective should generally point out the divergence of two incompatible forms of norm or narratives on political responses to that disaster. Secondly, I describe the data-producing process in which I have collected the data about the decision-making of mutual aid implementation initially through structured questionnaires which were planned based on those static theories and then I modified these data through face-to-face interviews. Consequently, I have come to interpret these political responses to disaster as convergence rather than divergence referring not only to my own process-produced data but to Luhmann's sociological theory which was produced by comparative observation of interactions within political processes. Finally, I describe reactions of my informants who were introduced to my theoretical interpretation as part of the open-ended process of a reflexive relationship between data and theories in my research, which should be called "action research."

Gesetzesfolgenabschätzungen werden auch in Deutschland in den letzten Jahren vermehrt eingesetzt, um staatliche Eingriffe und ihre rechtliche Kodifizierung für Normadressaten, vollziehende Verwaltungen und Drittbetroffene zielführender und weniger belastend zu gestalten. Im Mittelpunkt dieses Beitrags steht die Frage, inwieweit die derzeitig von der Bundesregierung angewendeten Instrumente der besseren Rechtsetzung, insbesondere die Quantifizierung des Erfüllungsaufwands für die Normadressaten und für die vollziehenden Verwaltungen, geeignet sind, die Legitimation von Verwaltungshandeln zu erhöhen. Dabei wird sowohl die konzeptionelle Ausgestaltung der Gesetzesfolgenabschätzung auf ihre Zielführung und ggf. vorhandene Lücken untersucht wie auch der Frage nachgegangen, wie die im deutschen Föderalismus angelegte Unvollständigkeit der Gesetzesfolgenabschätzung für den Vollzugsbereich, der den selbständig vollziehenden Ländern untersteht und damit nicht im Kompetenzbereich des Bundes liegt, behoben werden kann.

"In vielen Betrieben nimmt man eine Verschiebung der Betriebsratsfunktion von der konventionellen Interessenvertretung ('Schutz') hin zu einem Co-Management ('Gestaltung') wahr. Die Frage der Legitimation bleibt dabei weiterhin aktuell. Neben periodischen Wahlen kann durch die Miteinbeziehung des (Wähler-)Vertrauens eine kontinuierliche Legitimation erfasst werden. Vertrauen kommt innerhalb der Beziehungen zwischen Betriebsrat und Belegschaft eine wesentliche Stabilisierungsfunktion zu. Diese Sicht wurde in bisherigen Betriebsratsstudien nur wenig berücksichtigt. Unter Miteinbeziehung mehrerer Vertrauenstheorien wurde eine quantitative Studie konzipiert. Durch ein theoretisches Sampling wurden zwei Tochterbetriebe der Voestalpine AG für eine Befragung ausgewählt. Neben der Unternehmensgeschichte, der Unternehmensbranche, der Unternehmenskultur und betriebsspezifischen Gegebenheiten seitens der Betriebsratsgremien nimmt der Aspekt des Vertrauens in den Betriebsrat einen wesentlichen Einfluss auf die Wahrnehmung der Betriebsratsarbeit. Dieses Vertrauen bedarf der Transparenz und der Präsenz des Betriebsrats. Wissenschaftlich gesehen bewährt sich der Begriff 'Vertrauen' als zentrales theoretisches Konzept bei Betriebsratsthemen, wenngleich er näher an die alltagsweltlichen Bedeutungsfelder herangeführt werden sollte." The article presents an empirical study of the legitimation of the market economy in the public sphere and examines whether criticism of the market economy has increased as a result of the euro crisis. The research results support the hypothesis of a transformation of the legitimacy basis for the market economy and democracy. The traditional model of legitimation is based on separate principles for the market economy and for democracy. An alternative model, in which democracy must also meet standards of efficiency and of political participation, has its limitation. A third model, the model of elite responsibility, is currently on the rise.
