The "Argument Section" for this edition of the Journal of Health Law deals with the right to water and public health. There are three papers, the first two analyze the water fluoridation, and the last, the management of water resources. As we will see, there is an Ariadne thread joining them: the subject of democracy, or politics as a mediator of social conflict through law and through itself ; O "Tema em Debate" desta edição da Revista de Direito Sanitário trata do direito à água e saúde pública. São três artigos, os dois primeiros analisam a fluoretação da água e, o último, a gestão dos recursos hídricos. Como veremos, há um fio de Ariadne que os une: o tema da democracia, ou a política como mediadora dos conflitos sociais por meio do direito e de si mesma.

OBJECTIVE: To discuss the negative and positive concepts of liberty and postulate its interdependent and complementary relationship in the evaluation of public policy intersectoral actions, taking water fluoridation as a case. METHOD: To describe scopes and limits regarding 1950s Isaiah Berlin's distinction, showing its validity in facing the harmful effects of an uncontrolled market economy and an autocratic political regime. RESULTS: Both the rights that protect citizens against a powerful state and the rights that protect the state against powerful citizens were equally acknowledged as crucial. CONCLUSION: We argued that, in a context in which negative and positive liberties are balanced, regulatory policies have double meaning. Thus, there should be a balance between the establishment of necessary rules for social protection and limits for them not to violate individuals' rights ; OBJETIVO: Discutir os conceitos negativo e positivo de liberdade e postular sua relação de interdependência e complementariedade na avaliação da política pública intersetorial, tomando como caso a fluoretação da água. MÉTODO: Descrevem-se os alcances e limites relativos à distinção formulada por Isaiah Berlin nos anos 1950, demonstrando sua validade para enfrentar os efeitos nocivos decorrentes tanto de uma economia de mercado sem controle quanto de um regime político autocrático. RESULTADOS: Reconhece-se que são igualmente cruciais tanto os direitos que protegem os cidadãos contra um Estado poderoso quanto os direitos que protegem o Estado contra os cidadãos poderosos. CONCLUSÃO: Argumenta-se que, em um contexto de equilíbrio entre a liberdade negativa e positiva, a política regulatória tem duplo sentido, e deve buscar um balanço entre o estabelecimento de regras necessárias para a proteção do público e de limites além dos quais as regras não devem violar os direitos dos indivíduos.

This empirical investigation contrasts urban food sharing practices in community gardens of two global cities facing the problems of urban vacant land and the violation of the right to food. The central inquiry guiding this investigation is: How do the principles of the right to food relate to food sharing practices within Berlin and Rio de Janeiro community gardens, and what factors explain the similarities and differences in these connections within and between these cities? The hypothesis suggests that urban food sharing within community gardens can be linked to right to food. These connections may vary based on unique socioeconomic contexts and urban challenges in each city. To empirically assess this hypothesis, the study formulated the theoretical proposition that the human right to food, the concept of urban commons, and the establishment of community gardens serve as mechanisms for addressing urban land and food crises. Interviews and questionnaires applied between 2019-2023 characterized community gardens' territorial and sociodemographic profiles by engaging with gardeners and experts (40 in total). The data had a thematic coding and analysis, combining deductive and inductive reasoning. The results confirmed the hypothesis. However, agroecological food production emerged as a unifying factor across both cities, demonstrating a shared commitment to sustainable practices. This suggests a significant international step toward social-ecological transformation in urban food and land management. The findings expanded the existing literature on the role of urban agriculture and alert for the necessary promotion and protection of community gardens.

Abstract: Justice Reform in developing countries is one of the most important priorities of international economic organizations. Reform is frequently pursued by setting up new institutions beyond national authorities, in order to prevent national government interference with their functions. The theories linking economic growth and rule of law models offer legitimization to the legal transplants required to meet international standards. Foi realizada análise crítica, levando-se em consideração as questões de gênero, dos resultados oficiais do relatório do governo brasileiro para o Programa Conjunto das Nações Unidas para o HIV/Aids - UNAIDS. Mais especificamente, foi abordado o cumprimento das metas resultantes da Declaração de Compromisso sobre HIV/Aids, nos itens Direitos humanos e Redução do Impacto Social e Econômico da Aids até o ano de 2003. Foram apontados os conceitos chave incluindo reflexões sobre os indicadores e estratégias que auxiliam a sociedade civil organizada a efetivar seu monitoramento até 2010. ; The paper critically analyzes, from the gender standpoint, official results presented in the Brazilian government report to the Joint United Nations Programme on HIV/AIDS (UNAIDS). Specifically, the fulfillment of 2003 targets set forth in the United Nations Declaration of Commitment on HIV/AIDS, under the category of Human Rights and Reduction of the Economic and Social Impact of AIDS, are evaluated. Key concepts are highlighted, including indicators and strategies that may help civilian society better monitor these targets until 2010.

In this paper, the child participation in collective actions in dialog with the academic production about the Movimento Nacional de Meninos e Meninas de Rua (MNMMR) - National Movement of Street Boys and Girls - and the Sem Terrinha - Little Landless -, a collective of children linked to the Movimento dos Trabalhadores Rurais Sem Terra (MST) - Landless Workers' Movement is analyzed. The text seeks to reveal the participation of children in each movement, in the tension between the legal provisions on the rights of the child and their concrete experiences. When seeking to understand the meaning of fulfilling children's rights in their daily lives, the perspective of rights governance, the relationship with the State and the political dimension stand out in each movement. The intent was to discuss the conceptions of participation and "protagonismo" faced by the hierarchical relations of power between adults and children, both in the organization and management of movements and in the legitimation of discourses. Thus, the work contributes to the theories of the studies of social movements and collective actions, since it demonstrates that the concepts of agency and participation cannot be taken as a priori assumptions, as they demand analysis of the conditions and contradictions for their effectiveness. In this direction, the understanding of the child as a social actor is revealed, in both movements, as a way of overcoming the victim mentality in order to occupy the place of a subject who collectively fights for his/her rights. ; Este artigo analisa a participação da criança em ações coletivas, em diálogo com a produção acadêmica acerca do Movimento Nacional de Meninos e Meninas de Rua (MNMMR) e os Sem Terrinha, coletivo infantil vinculado ao Movimento dos Trabalhadores Rurais Sem Terra (MST). O texto busca desvelar a participação das crianças em cada movimento, na tensão entre os marcos legais sobre os direitos da criança e suas experiências concretas. Ao buscar compreender o significado de fazer os direitos das crianças em sua vida cotidiana, destaca-se, em cada movimento, a perspectiva da governança de direitos, da relação com o Estado e a dimensão política. Procurou-se discutir as concepções de participação e protagonismo tensionadas pelas relações hierárquicas de poder entre adultos e crianças, tanto na organização e gestão dos movimentos quanto na legitimação dos discursos. Assim, o trabalho contribui para as teorizações dos estudos dos movimentos sociais e de ações coletivas demonstrando que os conceitos de agência e participação não podem ser tomados como pressupostos apriorísticos, mas que demandam análise das condições e contradições para sua efetivação. Nessa direção, a compreensão da criança como ator social revela-se, em ambos os movimentos, como forma de superação do lugar de vítima para o lugar de sujeito que luta coletivamente por seus direitos.

Neste artigo irei contextualizar o aumento do número de movimentos de gays e lésbicas no âmbito dos debates sobre os discursos dos direitos e da temática dos direitos, que é seguramente o mais forte afrodisíaco do liberalismo. Analiso o modo como a sexualidade se tornou parte de uma formação essencial na articulação de cidadãos plenos através dos vários registos, como género, classe e etnia, quer nacional, quer transnacionalmente. Este estudo posiciona claramente o homonacionalismo como categoria analítica necessária à compreensão e conceção histórica dos motivos pelos quais o estado de uma nação como simpatizante gay se tornou desejável à partida. Como a Modernidade, o homonacionalismo pode ser objeto de resistência e de resignificação, mas não pode ser excluído: todos somos condicionados por ele e através dele. O artigo encontra-se estruturado em três secções. Começo por apresentar uma panorâmica do projeto Terrorist Assemblages, prestando atenção, em particular, à utilização do termo "homonacionalismo". Em segundo lugar, discuto o homonacionalismo no contexto da Palestina/Israel, com o objetivo de demonstrar a relevância dos discursos sobre direitos sexuais e da narrativa de "lavagem cor-de-rosa" para a ocupação. Termino com uma reflexão acerca do potencial inerente ao pensamento da sexualidade, não como uma identidade, mas como mosaicos de sensações, afetos e forças. Esta viralidade da sexualidade destabiliza produtivamente as noções humanistas dos sujeitos da sexualidade, assim como a organização política que procura resistir aos discursos jurídicos instituídos com o objetivo de nomear e controlar estes sujeitos de sexualidade. ; In this article I aim to contextualise the rise of gay and lesbian movements within the purview of debates about rights discourses and the rights-based subject, arguably the most potent aphrodisiac of liberalism. I examine how sexuality has become a crucial formation in the articulation of proper citizens across registers like gender, class, and race, both nationally and transnationally. The essay clarifies homonationalism as an analytic category necessary for understanding and historicising why a nation's status as "gay-friendly" has become desirable in the first place. Like modernity, homonationalism can be resisted and resignified, but not opted out of: we are all conditioned by it and through it. The article proceeds in three sections. I begin with an overview of the project of Terrorist Assemblages, with specific attention to the circulation of the term 'homonationalism'. Second, I will elaborate on homonationalism in the context of Palestine/Israel to demonstrate the relevance of sexual rights discourses and the narrative of 'pinkwashing' to the occupation. I will conclude with some rumination about the potential of thinking sexuality not as an identity, but as assemblages of sensations, affects, and forces. This virality of sexuality productively destabilises humanist notions of the subjects of sexuality but also the political organising seeking to resist legal discourses that attempt to name and control these subjects of sexuality.

This article analyses Olavo de Carvalho's pathway and reflects on his role in advancing the Far-Right in Brazil. To this end, it discusses his trajectory and his strategies for spreading his positions, with an emphasis on the website Mídia sem Máscaras (MSM) (Media without masks). A proposed "cultural war" and the denunciation of the supposed "Gramsci-ist" influence are central elements of this process. Finally, the article approaches the relationship between Olavo de Carvalho and the Bolsonaro family and their influence within the current Brazilian government. ; O artigo propõe analisar a trajetória de Olavo de Carvalho e refletir sobre seu papel no avanço da extrema-direita no Brasil. Para isto, aborda sua trajetória e as estratégias que utilizou para projetar publicamente suas posições, com destaque para o sítio eletrônico Mídia sem Máscaras. A proposição de uma "guerra cultural" e a denúncia da suposta influencia "gramscista" são elementos centrais deste processo. Finalmente, o artigo aborda a relação entre Olavo de Carvalho e a família Bolsonaro, assim como sua influência no atual governo brasileiro.

This article presents a critical overview of theories and practices that aim to enhance black women's health focusing on the concept of resilience. Beyond the academic literature, mostly from Pyschology, this text mobilizes different sources about racial relations, including the social movement production. Black women are exposed to human rights deprivation, to the inefficency of governmental programs that should guarantee the right to education and to comprehensive health care, among others. They are also frequently exposed to racism and sexism that affect their health. The concept of "resilience as a process" adopted in this article, a result of both the critical reflection on the literature and of research data, supports the adoption of a psychosocial approach resulting from vulnerabilities analysis integrated to a human rights based framework. The conclusion calls for initiatives that include the practical knowledge of black women and for valuing their collective and transgenerational experiences that has supported the overcome of their exposure to extreme vulnerable contexts, experiences that enhanced their processes of resilience. In this perspective, there is a need to consider not only black women's assistance and individual care but also their different experiences of belongingness, their trajectories, their networks, communities and territories. ; Este artigo apresenta uma revisão crítica de teorias, técnicas e práticas que visam a potencialização da saúde de mulheres negras com foco em concepções sobre resiliência. Além da literatura acadêmica, em especial da psicologia, o texto mobiliza diferentes fontes sobre relações raciais, inclusive a produção do movimento social. Mulheres negras estão expostas à privação de direitos humanos, à ineficiência dos programas de governo na garantia do direito à educação e à saúde integral, entre outros. Estão também expostas à incidência frequente do racismo e do sexismo, que se traduzem em prejuízos à sua saúde. A concepção processual de resiliência adotada neste artigo, que resulta tanto da reflexão crítica sobre a literatura como de resultados de pesquisa apresentados, fortalece a adoção de uma perspectiva psicossocial, resultante da análise das vulnerabilidades integrada ao quadro dos direitos humanos. Conclui-se pela produtividade de iniciativas que incluam a sabedoria prática das mulheres negras e a valorização de experiências coletivas e transgeracionais que as apoiam para superar os contextos de alta vulnerabilidade a que estão expostas, estimulando a potencialização de processos de resiliência. Nessa perspectiva será necessário considerar não apenas o acolhimento das mulheres negras, mas também suas experiências e instâncias de pertencimento, suas trajetórias, suas redes, comunidades e territórios.
