The aim of this article is to show that refusing to legalize the status of undocumented immigrants who have been long-term residents is a serious violation of human rights. The "right to have rights" a term coined by Hannah Arendt and developed by Sheila Benhabib A should be construed first and foremost as the right to a legal existence. We take issue with consequentialists who warn that legalizing the status of undocumented aliens will encourage further undesirable immigration, for withholding legal status in order to deter illegal newcomers is neither efficacious nor just. We conclude that "selective" as opposed to "endured" immigration policies are ethically untenable. Adapted from the source document.

After leading Spain from 1996 to 2004, Jose Maria Aznar has now been out of politics for nearly four years. Today, he is a professor at Georgetown University, & is also directing a prestigious international think tank, FAES (Fundacion para el Analisis y los Estudios Sociales), which aims at promoting free-market thinking in Europe & throughout the world. For Aznar, fighting for ideas is as important as fighting for votes. The former Spanish prime minister spells out his credo with his usual eloquence & conviction: a free-market economy is the best way of ensuring everybody's well-being. The permissive ideas of the current prime minister, socialist Jose Luis Zapatero, are weakening Spain & may even lead to its dismantlement, because of the current cabinet's overly understanding attitude towards separatists. From a global standpoint, democratic countries have to bury their differences to fight jointly against Islamic terrorism. Can citizens disobey the law, which comes from the will of the majority and the decision of the legitimately elected Parliament, merely because it seems to them unjust? Opposing conservative thought, which defends the established order and condemns any transgression, contemporary liberal thought has provided a defense of the democratic legitimacy of civil disobedience. However, the Rawlsian and Habermasian justifications of civil disobedience seem rather weak when compared to the political thought of disobedient activists themselves, namely Gandhi, Martin Luther King Jr. and Howard Zinn.
