According to Ana Marques « the true consent is the guarantee of the participation to the creation of a social cohesion. » The right relies on the Ethic, agrees with the Ethic and comes in various forms in a conditional way. This resarch aims at showing the evolutions relating to the doctor-patient relationship, viewing the consent, a concept that makes the link in this remarkable symposium. The jurist can therefore see the construction as he reads the texts and the jurisprudence. The importance of the consent takes part in the transformation of the doctor's social position, within the social space and the doctor-patient-state relationship. From a remakable symposium emerges a new triptych. What is at stake here is that the collective and individual visions of the consent are built as opposites. Indeed, the health democracy is a rhetoric : we cannot talk about it but under concrete devices. Despite the confrontation between fundamental rights and security (especially health security), there are two opposite movements. Referring to the patient, taken in his individuality, his fundamental rights prevail but confronted to the community, this latter prevails. How can the dispute around the question of the patient's consent find a balance between these two sides ? The legislator ventures to intervene in a scientific field which is fallible because uncertain. Between what is implicit, explicit, assumed, asserted, possible or not, it is not easy to legislate and compensate a prejudice endured by a patient, user of the health system. This is where the relations between the administration, the doctors and the experts play a part via some tools : recommendations are diverted by the administration on power struggles, transforming what is legitimate for everyone. How do the legislator and the judge arbitrate and carry out an arbitrage operation in this purpose ? At the end, can the patient negociate the decisions concerning his health ? Is he in a position of compromise and mutual action ? Or does he manage to force his will in other spheres than as regards the end of life ? Comment le législateur et le juge arbitrent-ils et exercent-ils un arbitrage à cette attention ? Au final, le patient négocie-t-il les décisions qui concernent sa santé ? Se place-t-il dans une position de compromis et d'action réciproque ? Ou parvient-il à imposer ses volontés dans d'autres domaines qu'en matière de fin de vie ? The discovery of the endocannabinoid system in the 1990s has opened the way for medical cannabis. Three cannabinoid medicines are currently available in some countries for specific therapeutic indications: spastic pain of multiple sclerosis, chemotherapy-induced nausea and vomiting and anorexia in patients with HIV. The research progress and new therapeutic applications are growing, especially for chronic pain's treatment. A large part of the population is affected with this pathology and cannabinoid's use in chronic pain's treatment has given important results in several preclinical and clinical studies. While in some countries such as Canada or United states, drugs derived from cannabis are available with a prescription in pharmacy for over 15 years, France appears to be lagging behind. However, French people say themselves to be ready to use cannabis-based medication if needed. These new treatments seem to be promising; however medical cannabis has still to overcome the political barrier which slows down its medical recognition. ; La découverte du système endocannabinoïde dans les années 90 a ouvert la voie au cannabis thérapeutique. Trois médicaments à base de cannabinoïdes sont actuellement disponibles dans certains pays pour traiter des pathologies aux indications précises : douleurs spastiques de la sclérose en plaque, nausées et vomissements chimio-induits (NVCI) et anorexie chez des personnes atteintes du VIH. La recherche avance, et d'autres usages thérapeutiques se développent : en particulier dans le traitement des douleurs chroniques. Une grande partie de la population est touchée par cette pathologie, et l'utilisation des cannabinoïdes dans le traitement des douleurs chroniques a donné des résultats prometteurs dans plusieurs études précliniques et cliniques. The WHO (World Health Organisation) considers excessive sugar consumption as a risk factor for the four main non-transmittable diseases (cardiovascular disease, cancer, diabetes and respiratory diseases). However, sugar consumption across the world is far from decreasing. This work will first expose the mechanisms of sugar consumption and the pathologies linked with an excessive one. Industrials who commercialise products of high sugar level have little interest in public health policies advocating for a healthier diet. We can safely ask ourselves: do they have an influence on medical scientific research? To find out a potential link between the sugar industry and scientific research, a systematic review of the literature has been carried out on articles linking dietary sugars consumption to the apparition, maintaining or development of cardiovascular pathologies. Acknowledgement, declared conflicts of interest and the authors' affiliations have been reviewed to identify a food industry input. This has later been compared with the nature of the results of each study. This study confirms a real influence of the food industry on medical scientific publications. On the 27 reviewed articles, 9 declared conflicts of interest with the food industry. Articles who declared conflicts of interests with the food industry show results minimising the negative impact of dietary sugars on health and more precisely on the apparition, maintaining or development of cardiovascular pathologies. ; La consommation excessive de sucres est considérée par l'OMS (Organisation Mondiale de la Santé) comme un facteur de risque des 4 principales maladies non transmissibles (maladies cardiovasculaires, cancer, diabète, et maladies respiratoires). Pour autant, la consommation de sucre dans le monde ne décroit pas. Ce travail présente dans un premier lieu les mécanismes de la consommation de sucre, et les pathologies liées à une consommation excessive. Les industriels qui commercialisent des produits à forte teneur en sucres ajoutés n'ont pas intérêt au développement de politiques de santé publique favorisant un comportement alimentaire sain. La question se pose naturellement : ces mêmes industriels ont-ils une influence sur la recherche scientifique en santé. Pour étudier l'existence potentielle ce lien, une revue systématique de la littérature a été réalisée sur des articles associant la consommation de sucres ajoutés et son influence sur l'apparition, le développement ou le maintien de maladies cardio-vasculaires chez les humains. L'affiliation des auteurs, les conflits d'intérêts déclarés et les remerciements ont été revus pour identifier la présence d'industrie agro-alimentaire et mise en relation avec les résultats avancés par les auteurs. D'après l'étude, il semble il y avoir une influence réelle de l'industrie agro-alimentaire sur les publications de recherche en santé. Sur 27 articles étudiés, 9 déclarent des conflits d'intérêt avec l'industrie agro-alimentaire. Ces articles déclarant des conflits d'intérêt avec des firmes de l'agro-alimentaire présentent des résultats minimisant l'impact néfaste des sucres ajoutés sur la santé et plus précisément sur l'apparition, le maintien ou le développement de pathologies cardiovasculaires.
Implantable Medical Devices (IMD) are health products meant to remain in contact with the human body for an extended period of time and thus a potential health risk. Therefore, they are subject to specific traceability rules. Sanitary traceability is part of materials vigilance and aims to allow the rapid identification of patients for whom the IMD of a batch have been used or the batches from which the IMD used for a patient come. It was absent from the first European directives relating to medical devices (MD) but has been regulated by French legislation since 2006. The European Regulation 2017/745 will come into force on May, 2017 and one of its objectives is to reinforce the vigilance and traceability procedures for IMD with the introduction of a unique device identification (UDI) and a European database on medical devices: Eudamed. This regulation will set new rules to all MD sector players, including health structures and professionals. These actors are supported nationally by various public health institutions and agencies. The French Ministry of Solidarity and Health will be able to make the legislative and regulatory framework relating to health traceability evolve in relation to the services which back its action throughout the country. The National Agency for the Safety of Medicines and Health Products is the French government agency with jurisdiction over MD and can rely on many institutional actors operating at the national and regional level. This framework allows the effective implementation of sanitary traceability and the proper functioning of the materials vigilance system in France. ; Les Dispositifs Médicaux Implantables (DMI) sont des produits de santé destinés à rester en contact avec le corps humain pendant une durée prolongée et présentent ainsi un risque potentiel pour la santé.
