The lack of a coherent European legislative framework, coupled with the principle of state sovereignty, induced unaccompanied migrant children to find themselves in a position which produced a situation of rightlessness, when outside of their own territories. In addition to their harsh condition, Member States national law not always provides rules for their safeguard, also often not harmonized with EU Directives. In some cases, to worsen the situation the lack of adequate policies in respect of their rights, their needs and their claims. This thesis provides an analysis of the international and European discipline, of unaccompanied minor migrants entering Europe. Juveniles, who find themselves in a hope journey without family members or guardianship, are in a very vulnerable position. In consequence of the migration crisis, especially in 2015, a massive flux of UAMs entered the European Union, so its Member States found themselves unprepared to cope with the needs of this specific category. In this thesis it is brought to light the fact that, international conventions alongside with EU legislative scheme provide a fragmented scheme for protection of separated children. Legally binding documents, as relevant International Conventions, European Treaties, Regulations and Directives are analysed, as also Conventions of the Council of Europe in concern to unaccompanied minors asylum seekers. In the paper are outlined and criticized bad practises of States on treatment and neglecting the needs of unaccompanied minor migrants, on breach of the rights of unaccompanied asylum seekers and on marginalizing unaccompanied refugee minors. In this research, have been pointed some good practises, for ameliorating their condition through the study between some European countries. The commitment showed by European Union through the European Action Plan as also by the EU to fulfil the obligations in respect of the rights of UAMs is demonstrated by the interest in revising, amending and fortifying several legally binding documents towards a more comprehensive children based approach. In compliance with this, in confirming expectations and welcoming the challenge for an international an enforced scheme of legal protection on UAMs, highlighted the recent effort of soft law by the CRC Committee and the Committee on Migrants Workers with Joint Comments. It is noteworthy that, the International Community and the European Union are meeting the need for a slow emersion on a dedicated legal framework on unaccompanied minor migrants. In conclusion, deemed that the issue of UAMs is still evolving, by figuring out the actual situation, till the end of 2017, we hope for future better assessments on the rights of the children and their indeed protection by law and by practise.
Providing specific criminal protection for migrant minors requires the balance of two legal aspects related to the specific weaknesses of the children; on the one hand, the condition of the minor is characterized by the inadequate experience and specific risks of victimization; on the other hand, the migrant status is related to the lack of social and family references, economic need and diversity of culture. The protection the two mentioned legal aspects requires the enforcement of both different rules to be combined; the application of existing regulations, with the evaluation of the crime's circumstances, as well as the definition of new criminal figures, who identify some peculiar forms of possible aggression or endangerment, are both useful solutions for the very problematic balance of the two goods. In order to provide effective protection for migrant minors, it is essential to fully implement the principle of "last resort". Criminal protection, in fact, should only intervene in support and completion of priority preventive administrative safeguards; the administrative protection has to intervene before the commission of serious crimes, which risk compromising, even irremediably, the personality of the vulnerable minor. Otherwise, the administrative action would provide only indirect protection, with no effects on weak persons; an efficient intervention aims to preserve the fragility of the migrant child taking into account the objective risks, often very serious, due to the simultaneous of the two conditions (minor age and migration status). Criminal protection alone would not prevent the maturing of trauma, harassment, exploitation, material and educational deprivation. The contribution aims to illustrate the evolution of national and European legislation on the subject of the protection of unaccompanied minors; the effectiveness of the Italian discipline and the French one in a comparative perspective as well as the European strategy are the core of the analysis. The adoption of the Italian Law 7 Aprile 2017 n. 47, so called Zampa Law, represents an important step towards the recognition of a complete protection of migrant child in the national background; the study on the enforcement of the reform will allow the evaluation of the Italian legal system's efficiency. On the other hand, I will analyze the remedies offered by the French system; in this context the regulation concerning children in civil code gets along with different legal source. Particular attention will be paid to the state of art in the European context looking for common rules or guidelines. I bambini sono esseri umani che - proprio per la giovane età e la conseguente vulnerabilità - hanno bisogno di una specifica protezione. E' nella fase dell'infanzia che si pongono le basi per la realizzazione della vita da adulto: garantire un'infanzia felice e libera da preoccupazioni e problemi significa assicurare al bambino la possibilità di diventare un adulto felice, realizzato e responsabile. Quindi qualsiasi situazione economica o sociale che possa mettere in pericolo la corretta crescita e lo sviluppo del minore costituisce una violazione dei suoi diritti. La cooperazione allo sviluppo si pone come obiettivo principale quello di contribuire all'innalzamento del livello di protezione dei diritti dei bambini su scala mondiale. Nonostante in materia di diritti dell'infanzia si disponga, ormai, a livello internazionale, di una normativa esauriente e universalmente condivisa, milioni di bambine e bambini e di adolescenti nel mondo continuano a subire soprusi di ogni tipo: basta leggere le cronache quotidiane, i rapporti delle Ong, della Commissione ONU per i diritti umani o del Comitato per i diritti del fanciullo delle Nazioni Unite. La cooperazione alo sviluppo si orienta verso la risoluzione di questi problemi affrontando le problematiche più gravi che colpiscono i minori in situazioni di vulnerabilità e rischio in tante parti del mondo. In questo lavoro si è esaminata la cooperazione allo sviluppo italiana e l'approccio ai diritti dell'infanzia; dapprima, si è analizzata la cooperazione governativa attuata dal Ministero degli Esteri; successivamente la cooperazione non governativa e decentrata posta in essere dalle ong e dagli enti locali; è stata realizzata quindi una ricerca di campo su alcune tra le maggiori ong italiane che si occupano di infanzia e di adolescenza ed è stato analizzato un progetto di cooperazione realizzato da una ong italiana in Marocco, Algeria, Francia, Spagna e Italia sulla tutela dei minori migranti. Nel lavoro si cerca di rispondere a un quesito fondamentale: in tempi di crisi, finanziaria, economica e, a volte, anche di valori, può la cooperazione allo sviluppo non governativa, e in particolare quella decentrata, salvare la cooperazione italiana e ridarle quello slancio di cui ha bisogno per riacquistare efficacia e fiducia da parte degli Italiani, e ridare all'Italia un posto importante nello scacchiere internazionale che si occupa di sviluppo? ; Children are human beings - just for the young and the resulting vulnerability – that need special protection. And, in the phase of childhood there is the foundations were laid for the realization of the adult life: ensure a happy and free from worries or problems about making sure to child the chance to become a happy adult, and made responsible. Therefore, any economic or social situation that might impair the proper growth and development of the child shall be a violation of his rights. Development cooperation aims primarily to contribute to raising the level of protection of the rights of children worldwide. Although on the rights of children we have, now, internationally, a comprehensive legislation and universally shared, millions of girls and children and adolescents in the world continue to suffer abuses of all kinds, just read the daily news, the reports of NGOs, the UN Commission on Human Rights or the Committee on the Rights of the Child United Nations. The development cooperation is directed towards solving these problems by addressing the most serious problems affecting children in situation of vulnerability and risk in many parts of the world. In this work we examined the Italian development cooperation and its approach to children's rights, at first, we analyzed the governmental cooperation implemented by the Ministry of Foreign Affairs, after which the non-governmental cooperation and decentralized into being by the NGOs and institutions local, then a research was made of field on some of the major Italian NGOs that deal with childhood and adolescence and we analyzed a cooperation project carried out by an Italian NGO in Morocco, Algeria, France, Spain and Italy on the protection of migrant children. The new bill reforming Italian citizenship law, as adopted by the Parliament in October 2015, has seen a new set of actors at the centre of the public and political debate: the second generations of migrants. Children of immigrants who were born and/or grew up in Italy have proven capable of influencing the political agenda through the use of innovative instruments to voice their concerns. Questi ultimi, con strumenti e modalità talvolta inediti, sono riusciti a influenzare l'agenda politica e a far sentire la propria voice. Pragmatismo, moderazione, e in taluni casi, contraddizioni caratterizzano le loro proposte e attività in tema di riforma dei modi di acquisto della cittadinanza.
In her article, Bailkin is interested in the embodied presences of empire in the case files and records of the post-war welfare state. She sets out to interrogate the history of decolonization and the strict correlation with families' lives. She wonders also how the new social sciences provided modern modes of interaction between the state and different migrant groups in Great Bretain. Her attention in this article concerns African immigrant students from Nigeria and Ghana and his/her family (when their wifes or husbands and children were in Britain too). Bailkin uses archives from various government departments, newspaper reports, and individual life stories to unpack the ways in which new migrant subjects were constituted and pathologised. Concerning the fostering and/or adoption of African children into English White homes Bailkin points out the profound consequences for generations of black families, as well the criteria by which all families in Britain were evaluated as "good" or "bad" ones.
Nowadays Italian youth can be considered heterogeneous concerning somatictraits, color of the skin, spoken languages at home and the religionorientation. Some of them were born abroad, outside national borders, andsome, although they were born on the national territory, are not yet Italiancitizens. But then the question arises: who are they? These are the so-calledsecond generations, or the children of those migrants, who since the mid-70s have considered Italy as a country that could offer a future for them andtheir children. The topic of second generations is central in political debates,both at European and national level, regarding citizenship, integration, socialinclusion; but not only, scholars, engaged in migration studies both in Europeand America, began to focus their research on second generations.Overseas the research started since the time of the Chicago School, investigatingon children of European migrants. In Europe and, above all, in Italy,where the migration phenomenon is relatively recent, research on secondgenerations started only in the 90s. This paper aims to illustrate a researchconducted in South Tyrol in 2019 investigating identity and desires of second-generation girls with Albanian origins. Peculiar is the environment inwhich these girls were born and raised, South Tyrol, a border land inhabitedby three different linguistic groups with their own ethnic identities. ; I ragazzi italiani di oggi sono eterogenei dai tratti somatici al colore dellapelle, alla lingua parlata in casa e alla religione praticata. This text – which opens with a forward written in the aftermath of the 2015 attacks in Paris and some critical thoughts on the march and discursive productions that followed – presents some remarks on the numerous "shipwrecks with spectators" that constitute one of the fundamental visual experiences of the present on the Northern shore of the Mediterranean. (These remarks were prepared for a May 2014 seminar). In particular, the analysis focuses on the production of institutional images that followed the shipwrecks of October 3 and 11, 2013, and points to the "displayability" of "migrant bodies" e to the consequent participation of spectators' gaze in the construction of such displayability. It is thus a participation in the gaze that power produces, in the gaze on subjects – women, men, children – produced by migration government policies in their preventing these subjects' possibility to move and consigning them to the gaze of spectators "only as shipwrecked people." In this context, the capacity for critical thought and collective action on these subjects on the part of groups that oppose such migration politics is lacking. Some hints in the direction of articulating a possible approach to this situation come from the movement of the mothers and families of disappeared Tunisian migrants. Die jahrhundertealte Präsenz italienischer Migranten in Istanbul durchlief im Laufe des 19. Jahrhunderts einen tiefgreifenden Wandel, der zunächst durch den Zustrom politischer Exilanten des Risorgimento, dann großenteils durch die Wirtschaftsmigranten ausgelöst wurde. Im folgenden Artikel werden diese Bevölkerungsgruppen vor allem in ihrer zweiten Generation, das heißt an ihren im Osmanischen Reich geborenen Kindern untersucht. Ohne ein Zusammengehörigkeitsgefühl vorauszusetzen, beschreibt der Artikel ihre Sozialität, ihre Loyalitäten und Identifikationen, um auf diese Weise den "italienischen" bzw. "osmanischen Anteil" ihrer Persönlichkeitsstruktur auf verschiedenen Ebenen und in ihren jeweiligen Ausdrucksformen zu erhellen. Nach einem Überblick über die Geschichte der italienischen Bevölkerungsgruppen analysiert der Artikel die Instrumente, die man bei der Entwicklung einer Italianität mit Blick auf die Herausbildung des italienischen Nationalstaates einsetzte (Vereine, Schule, Sprachenpolitik), arbeitet aber auch ihre Grenzen heraus. Am persönlichen Lebensweg von Angelo Scanziani, dem Sohn eines lombardischen Migranten, Sekretär und Übersetzer von Sultan Abdülhamid II., lässt sich beispielhaft aufzeigen, wie vielfältig die Loyalitäten waren und wie das Zugehörigkeitsgefühl dabei eher individuellen als nationalen Kriterien gehorchte. Mentre sul suolo patrio andava in scena la curiosa vicenda dell'accusa alle Ong umanitarie di complicità a vario titolo con i trafficanti di esseri umani nel Mediterraneo, l'8 maggio 2017, nel Palazzo di Vetro delle Nazioni Unite a New York la Procuratrice della Corte penale internazionale prendeva la parola dinanzi al Consiglio di sicurezza per presentare il 13° rapporto sulla situazione in Libia. Senza i soliti convenevoli diplomatici e con stile diretto la Procuratrice lanciava subito l'allarme che avrebbe impensierito chiunque, ma non i navigati rappresentanti degli Stati membri del Consiglio: "allow me to observe with profound regret that the overall security situation in Libya has deteriorated significantly since my last briefing to the Council last November. Reports indicate that the country is at risk of returning to widespread conflict". Secondo la Bensuda, tale epilogo militare determinerebbe una situazione di violazioni gravi e generalizzate dei diritti umani e del diritto internazionale umanitario che avrebbe come vittima sacrificale la popolazione civile. Ai nostri fini, la Procuratrice non si è limitata a paventare il rischio di una sanguinosa deriva in Libia dall'anarchia diffusa al conflitto generalizzato, ma ha fornito una rappresentazione veritiera dell'attuale e terribile situazione in cui si trova la moltitudine dei migranti in transito nel territorio libico: "I am deeply alarmed by reports that thousands of vulnerable migrants, including women and children, are being held in detention centres across Libya in often inhumane conditions. Crimes, including killings, rapes and torture, are alleged to be commonplace" (ibidem, p. 4). Come se ciò non bastasse, la Bensouda ha anche citato fonti credibili secondo cui "Libya has become a marketplace for the trafficking of human beings". ; While on the italian ground wnt on stage the curious story of the human rights NGO's complicity with various human traffickers in the Mediterranean, on May 8, 2017, at the United Nations Glass Palace in New York, the Procurator of the International Criminal Court took the floor before the Security Council to present the 13th report on the situation in Libya. Without the usual diplomatic ways and with direct style, the Prosecutor immediately launched the alarm that would have been alarmed by anyone, but not the navigated representatives of the Council Member States: "Let me observe with deep regret that the overall security situation in Libya has deteriorated significantly since my last briefing to the Council last November. Reports indicate that the country is at risk of returning to widespread conflict". According to Bensuda, this military epilogue would lead to a serious and generalized violation of human rights and international humanitarian law that would sacrifice the civilian population as a victim. For our purposes, the Prosecutor has not only evoked the risk of a bloody drift in Libya from the widespread anarchy to a generalized conflict, but has provided a realistic representation of the current and terrible situation of migrants that are in transit in Libyan territory: "I am deeply alarmed by reports that thousands of vulnerable migrants, including women and children, are being held in detention centers across Libya in often inhumane conditions. Crimes, including killings, rapes and torture, are alleged to be commonplace As if that were not enough, Bensouda also cited credible sources that "Libya has become a marketplace for the trafficking of human beings".
Das Schulregister des Kultusministeriums MIUR verzeichnet, dass mehr als jede/r zehnte aller Schüler/innen in Italien keine italienische Staatsbürgerschaft hat, obwohl sie mehrheitlich dort geboren wurden. Zahlreiche Erhebungen weisen für sie im Vergleich zu den italienischen Mitschülern/innen geringere Italienischkenntnisse und weniger schulischen Erfolg auf. Innerhalb dieser explorativen Feldforschung haben Einzelinterviews mit 121 Schülern/innen (5.-8. Klasse) in Turiner Schulen und mit 26 Eltern, sowie die Auswertung von 141 an 27 Italienisch- und Herkunftsprachlehrer/innen verteilten Fragebögen ergeben, dass viele Schüler/innen "zweisprachige Natives" sind, da sie mit Italienisch und einer anderen Sprache aufwachsen. Dieser Polyglottismus, den die Interviewten sehr positiv bewerteten, findet jedoch in der Schulpraxis keine Entsprechung: Gezielte Förderung im Italienischen und der Unterricht der Familiensprache sind meist Wunschdenken. In der Kohorte haben die Schüler/innen mit den besten Italienischkenntnissen einen italophonen Elternteil bzw. kamen im Vorschulalter nach Italien und besuchten dort den Kindergarten. Dagegen sind, wie auch bei den INVALSI-Tests, die in Italien geborenen und die dann die Krippe besuchten, leicht benachteiligt. Was die Familiensprache angeht, verbessert ihr Erlernen die Kompetenzen darin, ohne dem Italienischen zu schaden: Im Gegenteil. Diese Ergebnisse bestätigen die wichtige Rolle der "anderen" Sprache für einen gelungen Spracherwerb. Das MIUR sollte also sein Schulregister mit Sprachdaten ergänzen, um die Curricula im Sinn der EU-Vorgaben umzuschreiben und den sprachlich heterogenen Klassen gezielte Ressourcen und definierte Vorgehensweisen zur Verfügung zu stellen. Mit geringeren Mitteln, im Vergleich zu den jetzigen Kosten für Herunterstufung, Klassenwiederholung und Schulabbruch würde man Schulerfolg, Chancengerechtigkeit und Mehrsprachigkeit fördern, mit positiven Folgen für den Einzelnen sowie für die Volkswirtschaft. ; The Italian Ministry of Education (MIUR) student register records that today in Italy more than one out of ten students is not an Italian citizen, although the majority of them were born there. Several statistical surveys indicate that "foreign" students, when compared to native students, show a poorer performance in Italian and in academic achievement. This exploratory fieldwork carried out in schools in Turin (5th to 8th grade) analyzed data obtained through semi-structured interviews with 121 students and 26 parents as well as 141 questionnaires filled in by 27 teachers of Italian and family language. It showed that many students are "bilingual natives", as they grow up acquiring both Italian and another language; however, despite the fact that the interviewees rate polyglottism positively, schools don't usually offer targeted support in either language. Within the cohort the broadest range of competences in Italian are found first among those with an Italian-speaking parent, then among those who arrived in Italy at pre-school age attending kindergarten there; this latter group shows higher competences than those born in Italy attending nursery there, as also in the INVALSI tests. As far as family language is concerned, data illustrate that its teaching increases its competences without affecting those in Italian: quite the opposite in fact. These results confirm the remarkable role played by the "other" language in successful language education. MIUR is therefore called upon to include also linguistic data in its student register, so as to redefine its curricula according to EU Guidelines, and to identify specific procedures and resources for multilingual classes. This new policy would reduce the current cost of placing students in a lower grade, grade retention and drop-outs, and would promote school success, equal opportunities and multilingualism, with positive consequences both for the individuals and for the national economy. ; L'anagrafe studenti del MIUR registra come oggi in Italia più di uno studente su dieci non è cittadino italiano, pur essendo la maggioranza di loro nata in questo paese. Numerose indagini statistiche mostrano come gli allievi "stranieri" presentino, rispetto a quelli italiani, ridotte competenze in italiano e minore successo scolastico. Questa ricerca esplorativa svolta in alcune scuole di Torino (V elementare-III media) ha analizzato dati ottenuti tramite interviste semi-strutturate a 121 studenti e 26 genitori e 141 questionari compilati da 27 insegnanti di italiano e di lingua di famiglia. Da essa è emerso che molti studenti sono "nativi bilingui", poiché crescono usando l'italiano e un'altra lingua. Questo poliglottismo, valutato dagli intervistati assai positivamente, non si rispecchia però nella prassi scolastica: un supporto mirato in italiano e l'insegnamento della lingua di famiglia sono di regola una chimera. All'interno del campione le più ampie competenze in italiano si trovano fra chi ha un genitore italofono e chi è arrivato in Italia in età prescolare frequentandovi la scuola materna; come constatato anche nei test INVALSI, chi è nato in Italia e vi ha frequentato l'asilo nido è leggermente svantaggiato. Rispetto alla lingua di famiglia risulta che il suo studio porta a migliori competenze in essa, senza nuocere all'italiano: anzi. Emerge quindi il ruolo significativo della lingua "altra" per un'educazione linguistica efficace. L'invito al MIUR è quindi di integrare la propria anagrafe con dati linguistici, così da ridefinire i propri curricula secondo le Linee Guida Comunitarie, individuando procedure e risorse specifiche per le classi multilingui. Con un investimento ridotto, paragonato con il costo attuale dato da retrocessioni, ripetenze e abbandono scolastico, si riuscirebbe a sostenere il successo scolastico, le pari opportunità e il plurilinguismo, con conseguenze positive per i singoli e per l'economia nazionale.
