The article reveals the contradictory tendencies of ethnopolitical life in Ukraine at the beginning of the XXIst century, the destabilizing infl uence of the Russian Federation on the south-eastern regions in order to slow down the European vector of the country's movement. The features of interethnic relations in the Western regions of Ukraine, external and internal factors of the manifestations of separatism and the spread of ideas for the autonomy of areas of compact residence of national minorities are singled out. The author traces the causal relationships in the ethno-political sphere in the time-past-modern measurement. It was determined that ethnopolitical relations in Ukraine in the early 2000's were characterized by the absence of a state conception of ethnic policy. This opened up foreign policy paths to infl uence the national minorities of the border regions by neighboring states, stimulated the appearance of a number of destructive political organizations that spread the ideas of separatism in the south-eastern regions of Ukraine, in the Crimean peninsula and Transcarpathia. Under the infl uence of Russian propaganda, the local population of the South-East, the Crimea, was an easy prey to ideologues of the «Russian world», who declared Ukraine as «an unnatural state education» doomed to a quick death.

The paper deals with the most debatable questions about the legal nature of corporate relationships based on the membership of joint stock companies, namely the legal status of majorities and minority interests and the squeeze-out and sell-out mechanisms in these legal relationships and the conflicts of interest between these entities, which is called greenmail, about the scope of these relationships and about the basis of corporate relationships based on actual composition. In the corporate and commercial law of Ukraine, some of the most debatable issues are the legal status of minorities and majorities and the squeeze-out procedure based on the legal relationship between these entities. Adoption of the Target Law "On Amendments to Certain Legislative Acts of Ukraine on Improving Corporate Governance in Joint Stock Companies" in 2018 adds some optimism to solving the traditional problems in this area, as well as the current changes to the laws regulating relations between minority shareholders and majorities. in business entities. In 2018, squeeze-out legislation came into force in Ukraine. This procedure enables a majority shareholder (or group of majority shareholders) who owns 95 percent or more of the shares of a joint stock company to oust the minority shareholders (the remaining shareholders holding 5 percent or less of the shares) and become a sole proprietor of the business. During this time, majority shareholders in more than 200 companies have exercised their right to hold squeeze-out. In the realities of today, there are many businesses where majority shareholders are still arguing over whether to hold squeeze-out. These disputes may arise from the prospect of litigation with minority shareholders in Ukrainian courts, though undergoing reform but still often making unpredictable or biased decisions. Стаття присвячена дослідженню особливостей та правових засад сучасної державної політики у сфері національних меншин (спільнот) України, а також проблеми обмеження конституційних прав та свобод національних меншин (спільнот) у КНР та Болгарії.Авторський методологічний аналіз включав низку філософських, загальнонаукових та спеціально наукових методів. Зокрема метод порівняльного правознавства застосовувався для аналізу досвіду КНР та Болгарії щодо обмежень прав національних меншин (спільнот). Компаративний метод сприяв узагальненню знань у сфері державної політики у сфері національних меншин (спільнот).Репрезентовані позиції науковців та інституційних міжнародних органів щодо державної політики у сфері національних меншин (спільнот), мотивовано позицію казуальним виміром. Авторами розкрито ключові моменти державної політики у сфері національних меншин (спільнот), окрему увагу сконцентровано на проблемі позитивної дискримінації (особливому захисті) національних меншин. Вказано на труднощі реалізації державної політики у сфері національних меншин (спільнот) у КНР та Болгарії, а також піднято питання правового становища болгарської меншості (спільноти) України.У статті відображено основні напрямки державної політики у сфері національних меншин (спільнот) та основні завдання Державної служби України з етнополітики та свободи совісті. Приклади дискримінації македонської національної меншини в Болгарії, з одного боку, і вільного, рівноправного розвитку всіх націй і народів, що проживають на території України, – з іншого, ні недосконалість міжнародного законодавства, ні слабкість міжнародно-правових інститутів захисту прав людини не є головною перешкодою для вільного національного розвитку народів та окремих індивідів. Як найважливіша умова та об'єктивний чинник такого розвитку виступає державна національна політика, яка може або сприяти національному розвитку, або гальмувати його.Констатовано, що конституційні засади сучасної державної національної політики України утворюють положення Конституції України, що закріплюють найважливіші цінності конституційного ладу України. Звернено увагу, що національна політика України націлена насамперед на досягнення балансу, паритету інтересів кожної людини окремо та всіх народів (спільнот), що проживають на території України, у сфері національних відносин.У висновку зазначено, що національна політика України – це правова політика держави у галузі регламентації правового статусу національних меншин, формування нормативної бази, що забезпечує реалізацію національної політики на рівні органів державної влади та місцевого самоврядування в Україні.

The article investigates the ethnopolitical risks that arise in the process of interaction between national minorities and kin-states. The existence of "kin-states" and "kin-minorities" is a consequence of the problem of the separation of peoples. It has been established that ethnopolitical risks are determined by such interconnected factors as the low status of minorities in the state of residence and the existence of the "Great Power" project, which stimulate a kin-state to implement the policy of irredentism.The risks have been analyzed for all the participants of irredentist conflict, namely for national minority, kin- state and polyethnic state. A national minority, as a result of the implementation of the policy of irredentism, can worsen its position by the increasing the oppression of the state in which it resides. The elite of both parts of the sep- arated nation can be uninterested in the union, since within the boundaries of one state the power struggle between them is potentially aggravated. For a polyethnic state, the greatest risk of irredentist policy, which is pursued by one of the countries in the region, is the threat of loss of part of the territory. According to the author, the political risks that are perceived by the participants often make it impossible to bring the irredentist conflict to the level of armed interstate confrontation and stimulate the search for other options to meet the needs of ethnic groups.The article analyzes the peculiarities of the interaction of Russian, Hungarian and Romanian national minorities living in Ukraine with kin-states. It is shown that the forms of their interaction are not always acceptable and legitimate: issuance of passports to "ethnic relatives", organization of rallies and manipulation of linguistic issues for the sake of activating irredentist sentiments. The author analyzes the reaction of Hungary and the Hungarian national minority in Ukraine to the "linguistic" article of the Law of Ukraine "On Education" (2017).The most optimal forms of interaction between kin-states and national minorities are determined. Some of them are reflected in the Bolzano/Bozen Recommendations (2008), including the expansion of cultural and educational opportunities for an individual in a kin-state; support for education and cultural organizations in the country of residence. Quite acceptable contacts can be implemented within the frame- work of cross-border cooperation. The signing of bilateral intergovernmental agreements can increase the level of protection of the rights of national minorities. The polyethnic state must conduct an effective ethnopolitics in order to form a national identity for minority representatives, which would be a priority in the individual's identification system. These recommendations are relevant to the Ukrainian authorities, which faces the negative consequences of the irredentist policy of the Russian Federation. ; У статті досліджено етнополітичні ризики, які виникають у процесі взаємодії національних меншин і споріднених держав. Доведено, що етнополітичні ризики зумовлені такими взаємопов'язаними чинниками, як низький статус меншини в державі проживання і існування проекту «Великої держави», які стимулюють споріднену державу до реалізації політики іредентизму. Проаналізовано ризики для всіх учасників іредентистського конфлікту: національної меншини, спорідненої держави, поліетнічної держави.

The paper evolves a thesis on the conditionality of the national minorities problem during the Ukrainian national revolution and in independent Ukraine by the need to preserve the self-identification of both Ukrainians and other national minorities at the present stage in terms of preserving statehood. The dependence of the solution of the issue of national minorities in the Ukrainian National Republic on the position of the Provisional Government and the Bilshovyks is pointed out. The existence of the principle of resolving the issue of national minorities through the development of liberal principles in the conditions of autonomy is emphasized. It is noted that during the autonomy of the Ukrainian Central Rada there was a restriction on the use of Ukrainian language. It is pointed out that national minorities were allowed to influence the division of their own powers. The existence of differences in rights between certain nationalities, which determined different mechanisms of interference in state affairs, is confirmed. The relevance of Russian elite in resolving the issue of national minorities during the Hetmanate of Pavlo Skoropadskyi and the democracy in resolving the issue of Jewish pogroms initiated by the Bilshovyks are noted. Factors influencing the elimination of differences in the national issue in independent Ukraine at the present stage are identified. The global, regional, and national levels of legislation governing the solution of national minorities are highlighted. It is pointed out that there is a possibility of peaceful prevention of conflicts on the language issue, preservation of the identity of national minorities, and influence on Ukraine's path of development. The untrammeled development of national organizations in Ukraine at the present stage and the importance of personal development are emphasized. Ukrainian legislation draws attention to the multi-aspect essence of the notion of national minorities as a Ukrainian society component. The application of liberal principles as a way to solve the issue of national minorities is emphasized. The practical realization of the language and national issue gives the opportunity for productive cooperation between the bodies of state power and national minorities. ; У статті розвивається теза щодо зумовленості проблеми національних меншин у період Української національної революції та незалежної України на сучасному етапі необхідністю збереження самоідентифікації як українців, так і інших національних меншин в умовах збереження державності. Вказується на залежність вирішення питання національних меншин в Українській Народній Республіці від позиції Тимчасового уряду та більшовиків. Визначені фактори, які впливають на усунення розбіжностей у національному питанні у незалежній Україні на сучасному етапі.

Relevance of research. Ukraine is a poly-religious, multi-ethnic country, where religious minorities are a prominent subject in its religious field. The interests of religious minorities are protected by Ukrainian laws. But in real life, the guaranteed rights of religious and ethnic minorities often remain unexercised. Meanwhile, religious minorities have their own specific needs and special conditions to meet them. In particular, the existing laws do not automatically ensure a proper legal basis for participation of religious minorities in public life, especially in such areas as chaplaincy - military, medical, penitentiary, educational; volunteering; educational, informational and cultural space, etc. The purpose of this article is to characterize religious minorities as a spiritual and social phenomenon of poly-religious Ukraine and as the subject of sociological research. Results. The article gives examples of searching for the definition of "religious minorities" in international legal documents, in the works of foreign and national researchers. Attention is paid to the description of sociological research methodology, which object of study is religious minorities. The results of the focus sociological research named "Religious Minorities of Ukraine and State-Denominational Relations"2 have been analyzed, particularly, regarding the assessment of Ukrainian legislation in the field of freedom of conscience and activities of religious organizations by experts (representatives of central and local executive bodies, local self-government authorities (in the matter of religion); leaders of religious minorities communities – persons with administrative and organizational experience; specialists in freedom of conscience and religions (in particular, scholars, lawyers, theologians, media representatives, etc.) and believers-members of religious minorities. The main conclusion the article leads to is the fact that, in civil society, which seeks to be the Ukrainian one, there is a public need for legal understanding of the new principles of interaction between the state and religious organizations, and particularly religious minorities. Thus, experts and believers-members of religious minorities assessed the Ukrainian legislation in the field of freedom of conscience and the activities of religious organizations on a 5-point scale, where 5 is the highest score; and the scores were the following: 3.6 and 3.7 points, respectively. The experts assessed the opinion on the need to update the legislation in order to increase the level of democracy at 3.4 points, and believers at 3.0 points, where 5 is completely perfect legislation. This shows the existing demand of society, in particular religious minorities, for a better legal framework for successful governance in the field of state and religious relations, for proper information and communication activities of all its subjects in this area. Implementation of all legal principles of state and religious relations, mutual information, constant dialogue will contribute to the improvement of these relations as a cooperative (partnership) model of relations in the context of pluralization and democratization of religious life. ; Актуальність дослідження. Україна - багатоконфесійна, багатоетнічна країна, в якій релігійні меншини є помітним суб'єктом її релігійно-конфесійного поля. Інтереси релігійних меншин захищені українським законодавством. Але в реальному житті гарантовані права релігійних та етнічних меншин часто залишаються нереалізованими. Тим часом релігійні меншини мають свої специфічні потреби та особливі умови для їх забезпечення. Зокрема, існуючі закони не гарантують автоматично належної правової основи для участі релігійних меншин у суспільному житті, особливо в таких галузях, як капеланство - військове, медичне, пенітенціарне, освітнє; волонтерство; освітній, інформаційний і культурний простір тощо. Метою даної статті є характеристика релігійних меншин як духовно-соціального феномену поліконфесійної України та об'єкта соціологічного дослідження. Результати. В статті наведені приклади пошуків визначення дефініції «релігійні меншини» у міжнародних правових документах, у працях зарубіжних та вітчизняних дослідників. Приділена увага опису методології соціологічного дослідження, в якому об'єктом вивчення є вітчизняні релігійні меншини. Проаналізовані результати фокусного соціологічного дослідження «Релігійні меншини України та державно-конфесійні відносини»1, зокрема, стосовно оцінки законодавства України у сфері свободи совісті і діяльності релігійних організацій експертами (представники центральних та місцевих органів виконавчої влади, органів місцевого самоврядування (з питань релігій); лідери громад релігійних меншин – особи з адміністративним та організаційним досвідом; спеціалісти з питань свободи совісті та релігій (зокрема, науковці, юристи, богослови, представники медіа тощо) та вірянами релігійних меншин. Основним висновком, до якого підводить матеріал статті, є те, що в громадянському суспільстві, яким прагне бути й українське, формується суспільна потреба на правове розуміння нових принципів взаємодії держави і релігійних організацій, зокрема і особливо, релігійних меншин. Так, експертами та віруючими релігійних меншин українське законодавство у сфері свободи совісті і діяльності релігійних організацій за 5-ти бальною шкалою, де 5 – найвищий бал, було оцінено на 3,6 та 3,7 бали відповідно. Думку про необхідність актуалізації законодавства з метою підвищення рівня демократичності, де 5 - цілком досконале законодавство, експерти оцінили на 3,4, а віруючі на 3,0 бали. Це свідчить про наявний запит суспільства, зокрема релігійних меншин, на більш досконалу правову базу для успішного управління в полі державно-конфесійних відносин, на адекватну інформаційно-комунікаційну діяльність в цій галузі всіх її суб'єктів. Реалізація усіх правових принципів державно-конфесійних стосунків, взаємоінформування, постійний діалог сприятимуть вдосконаленню цих стосунків як кооперативної (партнерської) моделі відносин в умовах плюралізації та демократизації релігійного життя. ; Актуальність дослідження. It is shown that the scale and orientation of punitive measures had fundamental differences in some regions of Ukraine, they become unified touch the representatives of all faiths and national minorities of Ukraine. Most attention is given to Catholics, since the consideration of repression against members of this religious direction distinguishes not only representatives of the clergy and the faithful, but also some members of religious communities. Mass repressions, which experienced the believers national minorities Ukraine for 30th, had to design a society by its violent treatment of enemies of the socialist system, including speakers from the most active religious outlook. However, it was retaliation and punishment for not believing anti-religious and anti-Church policy of the government, a way of intimidation, which had to ensure the loyalty of the rest of the population. The repressive policy was deliberately aimed at the physical destruction of the clergy, active believers, those who provide the proper functioning of religious communities, and the creation of conditions in which normal functioning members of these groups became impossible. ; Розглянуто національний вимір репресій щодо священиків, окремих віруючих та їх груп на території України протягом 30-х років ХХ століття. Визначено справжні причини масштабних каральних заходів, що застосовувалися радянською владою щодо представників етноспільнот України, пов'язаних з діяльністю неправославних релігійних громад під час колективізації та Великого терору.
