'Der Beitrag beschäftigt sich mit der Frage, wie Menschen, die in Minderheitenbewegungen aktiv sind, Kultur und andere Quellen von Identität definieren müssen, um diese als politische Ressource nutzen zu können. Sie fordern Gleichberechtigung für Gruppen, die in einer Gesellschaft kulturelle, soziale und wirtschaftliche Nachteile erleben. Es wird dargestellt, dass jene Minderheiten, die sich selbst als homogene Einheiten mit eigener Sprache und Kultur und mit eigenständigen, über Generationen erhaltenen Traditionen beschreiben, die besten Chancen haben, von Staaten und internationalen Organisationen als echte Minderheiten anerkannt zu werden. Das Paradox der Minderheitenrechte soll genau dieses Phänomen beleuchten: Um als echte Minderheit anerkannt zu werden, ahmen die MinderheitenaktivistInnen die in internationalen Minderheitenrechtsinstrumenten festgelegten Normen und Kriterien für Minderheitenrechte nach. Eine Minderheit, die Kultur gemäß einem modernen Verständnis als etwas begreift, das ständigem Wandel unterliegt und auch Unterschiede unter den Mitgliedern der Gruppe betont, hat keine oder geringe Chancen auf Minderheitenschutz und Förderung. Das Rechtsparadox resultiert daraus, dass die Minderheitenschutzinstrumente nicht nur die Kultur und Identität von Minderheiten schützen, sondern auch mit definieren, was schutzwürdig ist.' The Kurdish question is a heritage of the post-WW1 peacemaking – an unfortunate legacy that has cast a long shadow for a century. The dreams of the Kurdish national movement that had developed in the late phase of the Ottoman Empire to gain its own Kurdish nation-State were disappointed after 1919, instead the Kurdish territories were incorporated into the newly founded States of Turkey, Iraq and Syria. None of these new States was ready to accept political rights for a Kurdish community as a separate people on their territory – just to the contrary, the new Turkish Republic was decided to assimilate Kurds in their 'great' Turkish nation, and also the soon forming new States of Iraq and Syria repressed any sign of Kurdish separatism and insistence on Kurdish traditions and a distinct ethnicity. A new situation developed in the aftermath of the US interventions since 1991. The events following these interventions were the starting point for the de facto autonomy that developed in Kurdish Northern Iraq throughout the 1990s. Hopes for an autonomy arrangement for the mainly Kurdish territories in the eastern parts of Turkey were to arise some years later. After 2011, a new opportunity for (factual) Kurdish self-government opened up in Syria as a side effect of the civil war in that State. The paper looks look into the normative benchmarks on how to deal with the Kurdish question. In a first part, the essay will reconstruct the major legal reference points concerning self-determination of the Kurdish people. In a second step, the text will turn to autonomy arrangements as a middle-ground solution for the need for structures of 'internal self-determination'. In a third step, as a concession to 'realpolitik', the minimalist options in the context of minority protection will be mapped, in their potentials, but also in their pitfalls.

From a modern international law perspective, the referenda over Schleswig held in early 1920 would be framed in terms of minority rights and self-determination of peoples. However, the 'Schleswig-Holstein question', which had erupted into a series of armed conflicts challenging the European Concert for two decades during the mid-19th century, is deeply rooted in feudal law. It is thus linked to an 'international law' that was predominantly understood as defined by the interpersonal relations between the ruling monarchs and princes. This article traces the development of the 'question' over time in a changing legal environment, from its feudal origins over the instrumentalisation of historical documents in the context of German and Danish 19th-century nationalism to the Treaty of Versailles and the present day where it has finally become possible to normalise the 'Schleswig-Holstein question' by framing it in terms of minorities, autonomies, and referenda.

"Die Geschichte der Minderheitensprachen in den letzten 200 Jahren ist vielerorts eine Geschichte ihrer Unterdrückung. Im Kontext der Entstehung von Nationalstaaten wurden und werden bis heute die Sprachen der Minderheiten vielfach benachteiligt, zum Teil verboten und ihre Sprecher auf unterschiedliche Art und Weise unterdrückt. Mit Beginn der 1970er Jahre findet aber eine Umkehr in der In-terpretation des Status der Minderheitensprachen statt, die verbunden ist mit einer Stärkung der Rechte der Minderheiten auf internationaler und nationaler Ebene. Eine Allianz von Juristen, Linguisten, Anthropologen, Sozialwissenschaftlern, sozialen Bewegungen und verschiedenen internationalen Organisationen war erfolgreich, die Idee des Schutzes der Minderheitensprachen vielerorts zur hegemonialen Idee werden zu lassen. So legitim es einerseits ist, gesellschaftlichen Gruppen, die eine eigene Sprache sprechen, das Recht zur sprachlichen Selbstbestimmung einzuräumen und sie vor der Verfolgung ihrer Sprache zu schützen, so übertrieben scheinen andererseits manche Forderungen zu sein, die den Schutz der Minderheitensprachen in den Status eines neuen Kults erheben. Die folgenden Überlegungen unterziehen die Argumente und Deutungsmuster, die den Kult der Minderheitensprachen begründen, einer kritischen Prüfung. Zuvor geht der Blick zurück, um das Verhältnis von Nationalstaatsentstehung und Minderheitenpolitik kurz zu skizzieren (Kapitel I).
