Die Konsequenzen impliziter Anreize oder institutioneller Interdependenzen für Leadership in sozialen Institutionen sind auf neuen oder etablierten sozialen Märkten fast vollständig unbekannt. Der Beitrag diskutiert Effizienz- und Kooperationsprobleme auf sozialen Märkten und in sozialen Institutionen. Beide betreffen Leadership in Hinblick auf die Koordinierung und Führung hoch qualifizierter, spezialisierter Mitarbeiter. Nach einem kurzen Überblick über Leadership-Konzeptionen wird Effizienz in sozialen Institutionen und auf sozialen Märkten auf der Basis der Transaktionskosten- und der Agency-Theorie diskutiert. Kooperationsprobleme und Interaktionsdilemmata können über Kostenheuristik und Wohlfahrtsverluste identifiziert werden. Es ergeben sich zwei Schlussfolgerungen für Leadership: (1) Markteffekte müssen ihren Niederschlag in Organisations- und Personalentwicklung finden. Im Reden über Kriminalität verständigt sich die Gesellschaft – über die Moralisierung von "Abweichung" – auf die soziale Ordnung und die in ihr eingelassenen Macht- und Herrschaftsverhältnisse. Kriminalität ist nicht nur ein Thema von Kontroll-"Experten", auch im Alltag werden beständig Geschichten über Kriminalität erzählt, weil sie eine Moral enthalten, die im Prozess der (Medien-) Rezeption lebenspraktisch gemacht werden kann. Der Beitrag zeigt auf, wie über die Analyse des alltäglichen Erzählens von Moralgeschichten symbolische und kulturelle Dimensionen von Kriminalität herausgearbeitet werden können, und welche Funktionen Kriminalität als symbolischer und kultureller Ressource im Prozess des alltäglichen Moralisierens zukommen. Vorgestellt wird dabei ein Konzept der Narrationsanalyse, das übliche Trennungen zwischen Text und Kontext, Form und Inhalt überwindet und die Moralgeschichte mit der Erzählsituation verbindet. Abschließend wird das Potential der Narrationsanalyse für die Untersuchung der Rezeption massenmedialer Kriminalitätsdarstellungen diskutiert.
Recent tensions at the governmental level do not yet add up to a crisis in German-American relations. But political divergences and dissonances are an expression of structural conflicts in the transatlantic relationship that have been intensified by the post-September 11 strategy shift in American global policy. The emerging paradigm shift in U.S. foreign policy confronts Germany's policy toward the United States with new challenges. These challenges cannot be mastered through either unreflective opposition or reflexive loyalty; rather, they require a strategically conscious approach toward the United States. (author's abstract)
Soziale Ungleichheit ist eines jener Phänomene, die zugleich moralische Entrüstung, politisches Engagement und soziale Analyse mobilisieren. Der Diskurs über Ungleichheit bietet verständlicherweise ein Forum dafür, soziale Benachteiligungen und Unterdrückungen zu thematisieren. Das soziologische Theoretisieren über soziale Ungleichheit fügt diesem Ungleichheitsdiskurs nur mehr eines hinzu: nämlich im Rückgriff auf empirische Daten der einen oder anderen Thematisierung wissenschaftliche Legitimation verleihen. Auch der soziologische Diskurs über Ungleichheit entkommt somit nicht der sozialen Funktion des Ungleichheitsdiskurses: nämlich an der Erzeugung kognitiver Repräsentationen sozialer Ungleichheit mitzuarbeiten. Eine soziologische Analyse, die diese Implikation nicht verdrängen will, muss soziale Ungleichheit als ein Deutungsmuster sozialer Realität begreifen und nach seiner Funktion in der sozialen Realität fragen. Eine solche soziologische 'Objektivierung' des Ungleichheitsbegriffs setzt eine theoretische Perspektive voraus, die den Diskurs über soziale Ungleichheit in der sozialen Realität, die ihn produziert, lokalisiert. Ich möchte die These verteidigen, dass der moderne Ungleichheitsdiskurs von kollektiven Erfahrungs- und Wahrnehmungsweisen der sozialen Welt geprägt ist, die mit dem Aufstieg der bürgerlichen Klasse im 18. Jahrhundert entstanden sind und heute von den Mittelklassen dominiert werden. Die aktuelle Konjunktur der Ungleichheitsforschung in der Soziologie (Kreckel 1983) lässt sich so - provokativ formuliert - als Effekt einer "Verkleinbürgerlichung" der Soziologie erklären.

Matthew Adelstein kindly invited me & Michael Huemer to hash out our disagreements about utilitarianism over on his YouTube channel. The resulting discussion was fun and wide-ranging. In this post, I just want to highlight a couple of major themes that seemed fairly central to our dispute: (1) which intuitions we place the most weight on, and (2) the inferential role of wrongness.(1) Which intuitions?Huemer, like many philosophers, regards utilitarianism as extremely "counter-intuitive", because there are many hypothetical cases in which it recommends actions that intuitively seem wrong. Against this, I argue that (something close to) utilitarianism is actually the most intuitive moral theory, because (i) its conflicts with intuition are shallow, and can generally be accommodated at least reasonably well by appeal to related moral considerations such as character evaluations; whereas (ii) non-consequentialism conflicts with our intuitions about what matters in ways that are deep and irresolvable.The dispute arises because our intuitions about cases, if taken at face value, are simply impossible to mesh with coherent and plausible principles about what's actually important. They're an unprincipled mess. So you can either accept those verdicts at face value (as Huemer does) and give up all hope of having "right" and "wrong" track anything that's independently understandable as worth caring about, or we can seek to "charitably reinterpret" those verdicts, occasionally rejecting their face-value claims while seeking to accommodate their underlying spirit as well as possible.Which route is better? Well, I guess it depends which intuitions you're more confident of. I'm much more confident of the deeper intuitions about what matters. I'm not particularly attached to my intuition that it's "wrong" to kill one to save five in the trolley bridge case, for example. I think there are obvious psychological confounders here (e.g. involving disparities of salience between the one and the five) that could be expected to distort my immediate intuitive judgment. And I'm not even confident that the "don't push" intuition speaks to the strengths of my reasons for action at all; it seems at least as plausible to me that I'm instead reacting negatively to the decision procedure or dispositions of character that would lead someone to be cavalier about killing innocent people. As R.M. Hare pointed out long ago, utilitarians can fully endorse the rejection of decision procedures that would lead one to engage in instrumental harm, for those seem unlikely to be the best decision procedures around. As a result, it's hard to see how our intuitive rejection of those decision procedures is supposed to count against the view. (Huemer wants to claim that it's not just that the person is vicious or their decision procedure is intuitively bad, but further, the act is intuitively wrong. But I dispute that it's at all clear that there is any such further intuition in this case. And as we'll see in the second section, below, I think it's especially unclear what Huemer's intuitions of "wrongness" are really about.)By contrast, I think it is much clearer that (e.g.) innocent people's lives are more important than deathbed promises. That is, we should care more about the former, and prioritize them when they come into conflict with the latter. I think it's also pretty clear that there shouldn't be a total disconnect between what we should care about and what we should do. Insofar as there is such a disconnect on Huemer's view, I think it really undermines the normative authority of what he calls "wrongness". Like archaic honor codes, when deontic constraints conflict with what's actually worth caring about, they lose their force.And I don't just mean this as a general intuition for a free-floating, untested principle. This also seems intuitively right (to me, at least) when reflecting more deeply about the specific cases. When you start to think more about which possible outcome seems morally preferable, all things considered (even taking into account whatever moral significance killing may have), it seems intuitively clear that (i) you should prefer that any one person be killed so that five comparable others may be saved; and (ii) you should, if you can, choose to bring about this morally preferable outcome. This verdict can be further reinforced by thinking about what all the affected parties would have preferred from behind a veil of ignorance, or about what a benevolent observer/God would wish for you to do, or about how deontic constraints enshrine status quo bias, etc.So: Deontology may capture superficial verdicts, but it just falls apart completely when you dig a little deeper into the cases. And I don't see any hope for the deontologist to "accommodate the underlying spirit" of these deeper intuitions. They're simply lost. So I think that even our case-based intuitions, upon deeper reflection, favour utilitarianism on net -- and overwhelmingly so.This is important, since Huemer's main response to the clash of intuitions was to appeal to the general epistemic principle that (he thinks) our intuitions about cases are on much firmer footing than our intuitions about general principles. That doesn't seem universally correct to me, and indeed it seems self-defeating for Huemer to appeal to this general principle when faced with a specific dialectic in which the conflict of intuitions intuitively favours utilitarianism. (By his own principles, he should instead assess this particular dialectic on its merits, or so I would imagine.) But regardless, I would now suggest that even our intuitions about cases favour utilitarianism, so long as we're thinking about the cases deeply and not just superficially. When thinking about these cases, we need to bring to bear the full range of our intuitions about what's worth caring about in the scenario, what it makes sense to do in light of the appropriate concerns, and how it all fits together. These are really important intuitions!(2) What is wrongness?I'm interested in the strengths of our reasons for action: which acts are really worth doing, and how important it is that we do them. In my 'Deontic Pluralism' paper, I point out that there are multiple ways to reconstruct notions of "right" and "wrong" out of scalar reasons. We might talk (with maximizers) about what we have most reason to do. Or we might talk (with satisficers) about what we'd be blameworthy for failing to do. But I don't believe in any completely independent, indefinable sense of "wrongness" (or what Parfit called mustn't-be-done), and I don't know of any utilitarians who do.If Huemer believes in indefinable wrongness (not reducible to reasons, etc.), then we risk talking past each other. I got the impression that his methodology was to first form an intuition about an act's (indefinable) wrongness, and then infer from this that we have decisive reason not to do it.One simple revision that might reconcile our views would be if he gave up on making that subsequent inference. (How confident is he in the general principle that this inference is warranted? How does it compare to all the rational principles that conflict with deontic constraints?) Perhaps there is some indefinable property described by Huemer's common-sense morality, but it simply lacks normative authority, and we don't have any good reason to act upon it when it conflicts with things -- like people's lives -- that we ought to care about more. I'd be curious whether he's at all open to this possibility.Given the divergence between the normative concepts central to consequentialism and the ordinary (vague and undefinable) sense of "wrongness", it's an interesting question whether consequentialism is best understood as offering an internal revision of how we should understand "wrong", etc., or as offering an external rival to morality. I guess the difference is ultimately just terminological, so shouldn't matter too much as long as we're clear. But either way, I think it helps to further defang the supposed "counterintuitiveness" of utilitarianism's verdicts if defenders of the view can respond, "No, I don't mean right/wrong in that sense. I just mean that we have more reason to bring about the better outcome!"Most of the intuitions evoked by critics of utilitarianism arguably don't directly address this question of what we have most reason to do (or what we really ought -- as opposed to merely "morally" ought, in some restricted or "inverted-commas" sense -- to do). When we formulate the normative question in terms of practical reasons, my intuitions about cases overwhelmingly favour utilitarianism over deontology. Maybe I'm idiosyncratic. But I think that at least many who are initially inclined to think that utilitarianism is "counterintuitive" only believe this because they've misconceptualized what normative ethics is really about. So I'm optimistic that significant progress could be made on this front (which is not to say universal agreement, of course) by getting clearer on this. That's one of my major goals for the next few years...

While the second televised candidate forum for Louisiana governor on the was better executed, it only marginally provided greater insight and information into the candidacies.
Nextstar television stations produced this one eight days after the first and featured two additional candidates to the first, which had Republicans state Sen. Sharon Hewitt, Treas. John Schroder, and former gubernatorial official Stephen Waguespack; Democrat former cabinet member Shawn Wilson, and independent trial lawyer Hunter Lundy. Front runner GOP Atty. Gen. Jeff Landry joined this one, along with the candidate that polling shows drags the rear, GOP state Rep. Richard Nelson.
As opposed to the previous one, this forum perhaps even more sparsely viewed focused more narrowly and more in depth on subjects, and the journalists asking questions did a better job of removing themselves from the topics of debate. Still, a minute for answers and rebuttals even shorter don't provide much, and some decisions on questions were puzzling, such as spending almost a third of the entire program on the issue of abortion, which in a recent survey ranked as only the seventh-most important issue to state residents while the debate ignored third-ranked education.
The two candidates with the most to lose in a debate, Landry and Wilson which polling proclaims will head to a runoff with no one else even close, played it safe by making the most general statements. However, the format allowing for greater depth did have them going into more detail on some issues, such as abortion. On this, Landry acquitted himself well by marshalling facts to support his position that the law as written and regulations as issued – allowing abortion only in the instance of the pregnancy endangering the mother's life or futile survival of the unborn – merited no legal changes and batted away assertions of inordinate enforcement. Wilson, by contrast, on this made situational morality arguments that historically have been heard before from eugenicists and totalitarians.
Only Wilson, who wants to legalize abortion on demand, argued against the law. Only Nelson thought the issue of broadening exceptions definitively needed revisiting.
Wilson more obviously foundered when asked about his record at the Department of Transportation and Development that he headed for seven years and that he worked in for 18. In trying to explain away a lack of progress in infrastructure building, he whined that his hands were tied,by legislative instruments and funding.
But that dodged the accusation that has haunted his campaign that the department under his leadership did poorly in completing what projects did get funded, such as finishing the flyover ramps in Kenner to the new terminal at the New Orleans airport, still incomplete after four years, or in planning and executing widening of Interstate 10 in Baton Rouge and a new bridge across the Mississippi River there. Even Lundy, who throughout made the most simplistic remarks of the bunch drawing upon a Manichean liberal populist worldview, piled on by asserting Wilson escaped from the job just as a bridge failure near that location came from Wilson's inadequate management.
Wilson also flubbed a question about Wuhan coronavirus pandemic restrictions, saying government and people had to "follow the science" – which continues to reveal that restrictions such as those imposed far too long by Democrat Gov. John Bel Edwards were pointless, if not harmful, as Wilson continued to defend in general those actions. All others swore off such extreme government intervention.
But the most cringeworthy moment came for Schroder, who kept trying to flog that a donor to Landry's campaign under judicial and Insurance Department sanctions somehow confirmed cronyism and devalued honesty in government. He was reduced to saying this "appearance" was bad.
The forum also discussed the state police coverup in the death of black motorist Ronald Greene, although it didn't really delve into the most important issue cited by residents, crime. It discussed toll roads about transportation funding, but didn't get into the larger issue itself. And it corralled candidates into saying they likely would call a special session to address insurance woes.
As to a winner, Hewitt provided most often the most direct and fearless answers. In discussing the Greene death without mincing words she indicted Edwards' role in that. She dinged Wilson on failures to maintain bridges as part of his general fumbling. And she called out by name Edwards' policy failures on pandemic restrictions.
Despite the sporadic broadsides against Landry and Wilson by all the other candidates, this exercise did little to change the dynamics hurtling the pair to a runoff.

Given the pace of development of modern science and the world as a whole, the topic of studying the principles of regulation of biomedical research and their improvement is relevant. The article highlights the basic principles of the use of humans and animals in biomedical research. It was explained why it is so important to strengthen the humanization of this process. The conclusions are the following: it is very important to prevent cruelty of any biological objects in the context of resolving bioethical and legal problems associated with the implementation of the principle of humanism and the protection of the rights of living organisms. Modern science and the practice of preclinical and clinical tests should be involved into serious challenge in order to improve and universalize the process of medical and biological research technology in vitro. The purpose of the article is to study the main international legal principles of using living organisms in biomedical experiments, as well as to determine the main problems on this issue and to outline the ways to resolve them. To examine the current state of ethical and legal regulation, principles and rules for conducting experimental biomedical research. Nowadays the international community has adopted enough legal acts regulating the proper behavior with biological objects, including those specially cultivated for such studies (laboratory) when conducting biomedical experiments. Recently, both, in the national legislation of European countries and international legislation, there have been trends to strengthen their protection in the field of biomedical research. The article provides examples of bullying, and as a result of a direct violation of the basic principles of bioethics – respect for the autonomy and dignity of a person. It is proved that the main task of bioethics is to preserve the life and health of every organism. It is imperative, both at the international and national levels, to adopt programs for development and support of scientific study of the in vitro biosystems introduction into research practice. At the national level, it is necessary to criminalize the violation of international standards for conducting biomedical research using organisms. Both, international and national legislation should impose a direct ban on the use of in vivo technologies in case of the possibility of using in vitro technologies. В роботі розглянуто проблеми етико-правового регулювання сучасних біомедичних досліджень, де одним із методів вивчення та опису об'єктів навколишнього середовища є експеримент. Він є ключовим інструментом практики, без якої неможлива теорія. Враховуючи темпи розвитку сучасної науки та загалом світу, актуальною є тема вивчення принципів регулювання біомедичних досліджень та їх удосконалення. У статті також висвітлено основні принципи використання людей та тварин у біомедичних дослідженнях. Пояснено чому так важливо посилити гуманізацію цього процесу. Висновки: дуже важливо запобігати жорстокому поводженню з будь-якими біологічними об'єктами в контексті вирішення біоетичних та правових проблем, пов'язаних із реалізацією принципу гуманізму та захистом прав живих організмів. Сучасна наука та практика доклінічних та клінічних випробувань повинні бути залучені до цієї проблеми з метою вдосконалення та універсалізації процесу медико-біологічних досліджень in vitro. Мета статті – вивчити основні міжнародно-правові принципи використання організмів у біомедичних експериментах, а також визначити основні проблеми з цього питання та окреслити шляхи їх вирішення. Оглянути сучасний стан етико-правового регулювання, принципів та правил проведення експериментальних медико-біологічних досліджень. На сьогоднішній день міжнародне співтовариство прийняло достатньо правових актів, що регулюють належне проведення біомедичних доклічнічних та клінічних досліджень з біологічними об'єктами, в тому числі спеціально вирощених для таких досліджень організмів (в лабораторії). Останнім часом як у національному законодавстві європейських країн, так і в міжнародному законодавстві спостерігаються тенденції посилення їх захисту у галузі біомедичних досліджень. В статті приведено приклади знущання, і як наслідок прямого порушення основних принципів біоетики – поваги до автономності та гідності людини, Доведено, що основна задача біоетики – збереження життя та здоров'я кожного організму. Обов'язковим є як на міжнародному, так і на національному рівнях прийняття програм розвитку та підтримки наукового вивчення впровадження біосистем in vitro у практику досліджень. На національному рівні необхідно криміналізувати порушення міжнародних стандартів проведення біомедичних досліджень з використанням організмів, посилити інші види відповідальності та створити спеціальну систему державних органів, відповідальних за політику їх використання у біомедичних цілях та здійснення контролю в цій області. The article examines the problems of the component s of the concept of threats to religious security, for example, which are transformed into concepts. Religion as a relatively independent socio-cultural reality needs protection from internal and external threats. Religious security is a system of conditions that ensures the preservation of the traditional religious system within the established norm that has historically developed. The problem of religious security was identified when the cases of anti-state, anti-social activities of religious associations became more frequent.Methodology: The following research methods were used to address the issues set in the article: general scientific methods – descriptive, systemic, structural-functional, comparative, institutional-comparative; general logical methods – empirical, statistical, prognostic modeling and analysis; special methods of political science. The preference was given to the method of political-system analysis, by which the common and distinctive characteristics of the basic components of soft power strategies were identified, reflecting existing political, public, information and other challenges for international relations and global development.Results. As societies develop from agrarian to industrial to knowledge-based, growing existential security tends to reduce the importance of religion in people's lives and people become less obedient to traditional religious leaders and institutions. Research of the problem by scientists. Religion is characterized by the historical predominance of Catholic Christianity (40 % of the world's Catholics in the region).Conclusions. Although some religious conservatives warn that the retreat from faith will lead to a collapse of social cohesion and public morality, the evidence doesn't support this claim. В современных условиях переходных режимов религиозная система становится важным фактором политической стабильности. В особенности это касается традиционной религиозной системы, которая имеет историю развития, глубокую систему в народной культуре. В геополитическом противостоянии также важную роль имеет религиозный фактор. Ситуация требует мобилизации ресурсов религиозной безопасности общества. Среди задач – проблема подготовки идеологических кадров, например, политологов, философов, которые имеют способность противостоять идеологическому влиянию. Актуальной есть проблема формирования эффективной религиозной идеологии, которая учитывает геополитическое соперничество государств, усиления динамики духовной конкуренции, духовной экспансии.Угроза религиозной безопасности состоит в том, что Латинская Америка, как один из центров католицизма в мире, стоит перед идеологическим выбором. С одной стороны, она может возвратиться в лоно римо-католической церкви. Поскольку в регионе возрастает уровень взаимосвязи государства и общества, существует необходимость в комплексе мероприятий с целью обеспечения религиозной безопасности. Раскрыт особенности путей и средств противодействия религиозной опасности. Ситуація вимагає мобілізації ресурсів релігійної безпеки суспільства. Серед завдань є проблема підготовки ідеологічних кадрів, наприклад політологів, філософів, які мають здатність протистояти ідеологічному впливу. Актуальною є проблема формування ефективної релігійної ідеології, яка враховує геополітичне суперництво держав, посилення динаміки духовної конкуренції, духовної експансії.Загроза релігійній безпеці полягає в тому, що Латинська Америка як один із центрів католицизму у світі стоїть перед ідеологічним вибором. З одного боку, вона може повернутися в лоно римо-католицької церкви. Оскільки в регіоні зростає рівень взаємозв'язку держави та суспільства, то існує потреба в комплексі заходів із метою забезпечення релігійної безпеки. Розкрито особливості шляхів і засобів протидії релігійній небезпеці. Влада спрямовує зусилля на реалізацію реформ, які стануть гарантією стабільного політичного режиму.
The article presents the analysis of the epistemological basis for the concept of dignity in the philosophical discourse of an outstanding English enlightener John Locke. His views on natural rights and freedoms as well as on human dignity, formed within the framework of the Enlightenment formative shifts, haven't lost their heuristic potential, and moreover, reveal their relevance in the context of the tendencies prevailing in the contemporary dynamic world. In the process of investigation the following methods were applied: dialectical, hermeneutical, phenomenological, and comparative. The research has revealed that John Locke's concept of dignity, as well as the conception of educating a worthy citizen, directly correlate with his epistemology. Despite the fact that the phraseological unit "tabula rasa" wasn't mentioned in Locke's works directly, though having been repeatedly attributed to him, the intention emphasized in this Roman phrase is present in his views. This phrase lied in the basis of his fundamental view that moral ideas couldn't be inborn. Rejecting the metaphysical basis for human morality, John Locke argued that social differentiation as well as a person's virtuous or wicked behavior were not rooted in human nature, but on the contrary, were formed by the social environment, especially by the upbringing. This idea presupposed having equal cultural, educational, political, and legal conditions for a person's social start. Only human striving for happiness could be considered innate. This desire, in its correlation with social progress, was seen as transforming the idea of human dignity. Having been established, Western capitalism gives rise to new competitive possibilities of self-realization, not available for most people before. Consequently, dignity has been increasingly identified with rationality and the level of education and upbringing, as well as with personal and professional success. ; В статье проанализировано особенности эпистемологического обоснования концепта достоинства в философском дискурсе выдающегося английского просветителя Джона Локка. Его взгляды относительно природных прав и свобод, достоинства человека, сформированы в условиях формационных изменений Нового времени, не только не потеряли своего эвристического потенциала, но и с новой силой проявляют свою актуальность в свете тенденций современного динамического мира. В процессе работы над статьей применялись как общенаучные, так и философские методы исследования (герменевтический, феноменологический, диалектический, компаративный). В ходе исследования установлено, что концепт достоинства и концепция воспитания достоинства гражданина в философском дискурсе Джона Локка прямо связаны с его эпистемологией. Хотя в его произведениях нет ни малейшего упоминания про фразеологизм "tabula rasa", авторство которого ему неоднократно приписывалось, но все же интенция, на которой акцентирует внимание, указанное римское изречение у него присутствует. Именно оно для английского просветителя становится основанием отрицания врожденности моральных идей. Отрицая метафизическую причину человеческой моральности, Джон Локк утверждает, что социальная дифференциация, добродетельное или недобродетельное поведение личности ни в коей мере не укоренены в человеческой натуре, а порождены социальной средой, в частности влиянием воспитания. Поэтому все должны иметь равные культурно-образовательные и политико-правовые условия для социального старта. Врожденным в человеке является только стремление к счастью, которое в диалектической взаимосвязи с общественным прогрессом становится основанием трансформации представлений о достоинстве. Утверждение западного типа капитализма создает новые конкурентные возможности самореализации, недоступные раньше для большинства людей. Саме вона для англійського просвітника стає підставою заперечення вродженості моральних ідей. Відкидаючи метафізичну причину людської моральності, Джон Лок стверджує, що соціальна диференціація, доброчесна або недоброчесна поведінка особистості аж ніяк не вкорінені в людській натурі, а породжені соціальним середовищем, зокрема, впливом виховання. Тому усі повинні мати рівні культурно-освітні та політико-правові умови для соціального старту. Вродженим в людині є тільки прагнення до щастя, яке в діалектичному взаємозв`язку із суспільним прогресом стає основою трансформації уявлень про гідність. Утвердження західного типу капіталізму створює нові конкурентні можливості самореалізації, недоступні раніше для більшості людей. А отже гідність все більшою мірою починає ототожнюватися з раціональністю, рівнем освіти та виховання, особистісним і професійним успіхом.
The paper considers the problems of ethical and legal regulation of modern biomedical research, where one of the methods of studying and describing environmental objects is an experiment. It is a key tool of practice, without which theory is impossible. Given the pace of development of modern science and the world as a whole, the topic of studying the principles of regulation of biomedical research and their improvement is relevant. The article highlights the basic principles of the use of humans and animals in biomedical research. It was explained why it is so important to strengthen the humanization of this process. The conclusions are the following: it is very important to prevent cruelty of any biological objects in the context of resolving bioethical and legal problems associated with the implementation of the principle of humanism and the protection of the rights of living organisms. Modern science and the practice of preclinical and clinical tests should be involved into serious challenge in order to improve and universalize the process of medical and biological research technology in vitro. The purpose of the article is to study the main international legal principles of using living organisms in biomedical experiments, as well as to determine the main problems on this issue and to outline the ways to resolve them. To examine the current state of ethical and legal regulation, principles and rules for conducting experimental biomedical research. Nowadays the international community has adopted enough legal acts regulating the proper behavior with biological objects, including those specially cultivated for such studies (laboratory) when conducting biomedical experiments. Recently, both, in the national legislation of European countries and international legislation, there have been trends to strengthen their protection in the field of biomedical research. The article provides examples of bullying, and as a result of a direct violation of the basic principles of bioethics – respect for the autonomy and dignity of a person. It is proved that the main task of bioethics is to preserve the life and health of every organism. It is imperative, both at the international and national levels, to adopt programs for development and support of scientific study of the in vitro biosystems introduction into research practice. At the national level, it is necessary to criminalize the violation of international standards for conducting biomedical research using organisms. Both, international and national legislation should impose a direct ban on the use of in vivo technologies in case of the possibility of using in vitro technologies. Він є ключовим інструментом практики, без якої неможлива теорія. Враховуючи темпи розвитку сучасної науки та загалом світу, актуальною є тема вивчення принципів регулювання біомедичних досліджень та їх удосконалення. У статті також висвітлено основні принципи використання людей та тварин у біомедичних дослідженнях. Пояснено чому так важливо посилити гуманізацію цього процесу. Висновки: дуже важливо запобігати жорстокому поводженню з будь-якими біологічними об'єктами в контексті вирішення біоетичних та правових проблем, пов'язаних із реалізацією принципу гуманізму та захистом прав живих організмів. Сучасна наука та практика доклінічних та клінічних випробувань повинні бути залучені до цієї проблеми з метою вдосконалення та універсалізації процесу медико-біологічних досліджень in vitro. Мета статті – вивчити основні міжнародно-правові принципи використання організмів у біомедичних експериментах, а також визначити основні проблеми з цього питання та окреслити шляхи їх вирішення. Оглянути сучасний стан етико-правового регулювання, принципів та правил проведення експериментальних медико-біологічних досліджень. На сьогоднішній день міжнародне співтовариство прийняло достатньо правових актів, що регулюють належне проведення біомедичних доклічнічних та клінічних досліджень з біологічними об'єктами, в тому числі спеціально вирощених для таких досліджень організмів (в лабораторії). Останнім часом як у національному законодавстві європейських країн, так і в міжнародному законодавстві спостерігаються тенденції посилення їх захисту у галузі біомедичних досліджень. В статті приведено приклади знущання, і як наслідок прямого порушення основних принципів біоетики – поваги до автономності та гідності людини, Доведено, що основна задача біоетики – збереження життя та здоров'я кожного організму. Обов'язковим є як на міжнародному, так і на національному рівнях прийняття програм розвитку та підтримки наукового вивчення впровадження біосистем in vitro у практику досліджень. На національному рівні необхідно криміналізувати порушення міжнародних стандартів проведення біомедичних досліджень з використанням організмів, посилити інші види відповідальності та створити спеціальну систему державних органів, відповідальних за політику їх використання у біомедичних цілях та здійснення контролю в цій області. Traffic accumulated by cars is responsible for considerable problems in our cities. The problem is partly about the negative effects on human health due to harmful particulate emissions, noise, traffic accidents and sedentary lifestyles, partly about the space it occupies, which leads to congestion, and the fact that valuable land is taken up by road infrastructure and parking lots. In a bigger perspective, car traffic also contributes to greenhouse gas emissions that fuel climate change.At the same time, the car is ingrained in our way of life and a necessity for many people's lives to function. Politicians are therefore generally reluctant to limit car use, and as a result, transport planners find it difficult to enforce measures that lead to a significant reduction in car traffic. Attempts are being made with soft measures that encourage people to walk, cycle and take public transport. These measures can, for instance, be to inform about alternatives to car use, marketing new cycle routes, and offering free trial periods with public transport. So far, it has proved difficult to sufficiently evaluate these measures, which has led to scepticism about their usefulness. At the same time, we need to know more about what it is that motivates modal shifts for different groups. Thus, more knowledge about soft measures is needed.Innovations in the form of smartphones and electric bicycles (e-bikes) have opened new opportunities for soft measures, both in terms of evaluation of these and the potential to influence car use. Furthermore, previous research has shown that it is important to target soft measures and adapt information and marketing to specific target groups, also called segmentation. Against this background, this thesis (including five individual papers) has examined smartphones, e-bikes, and marketing. These three elements have been used in variation to investigate motivation to reduce car use in favour of walking, cycling and public transport, segmenting and targeting, as well as evaluation of soft measures.Regarding the possibility of smartphone applications to influence travel behaviour,explored in the first paper, a review of previous research showed that there is potential but that too few studies have been conducted to be able to draw any general conclusions. The paper found that applications need to be customised to the user, provide relevant information and feedback about the user's behaviour, create a commitment towards its use, and have a user-friendly design. The second paper presented a process evaluation of a project where an application was developed to facilitate sustainable business travel. However, the study showed several weaknesses with the application and the difficulty in evaluating the effect of such a soft measure, which gave lessons about both study design and the development of applications and their implementation in organisations.In the third paper, we found that marketing for sustainable travel is more motivating if it is aimed at the collective rather than the individual, and contains altruistic messages linked to the environment and health. The respondents' stated motivation to reduce car use reflected their current car use and attitude towards the environment and various means of transport. This underlines the importance of adapting marketing to the target group. The fourth paper showed that one's morality towards the climate has a significant impact on the motivation to reduce car use, but habits, travel time and attitudes towards car and bicycle use also play a role. Such factors differ between gender, age, level of education and between urban and rural areas and may be important for the segmentation used for soft measures.The results from the fifth paper showed that e-bikes have exciting potential to replace the car and contribute to more sustainable travel behaviours. In a field experiment where the participants consisted of frequent drivers, car travel measured in distance decreased by an average of 37% as a result of the participants gaining access to their respective e-bike. The share of cycling of total travel increased by just over 20% on average. The participants measured their travel behaviour and answered survey questions using their smartphones, which contributed to high data quality. Both the effect evaluation of the use of e-bikes and the use of smartphones to measure travel behaviour make a novel and important contribution to the research field on soft transport measures, and the application of these in practice.The thesis concludes that innovations have great potential to improve soft measures, both as a means for contributing to increased sustainable travel behaviours and as a means of making more rigorous evaluations. The thesis also contributes to the knowledge about how sustainable transport can be marketed, what creates motivation to reduce car use, as well as different perspectives on segmentation and which target groups soft measures can be aimed at.

The article deals with the essence of the legal understanding and basic approaches to its scientific comprehension. The typology of legal thinking hasbeen identified. The study proposes an approach according to which there are four main types of legal thinking: legal positivism, naturalism, sociological legalthinking, and integrated legal thinking. It is established that each of these types of legal thinking in one way or another deals with the problems of their ownconditionality of law.It is determined that in the simplest form legal positivism is a style of legal thought, which uses three postulates: the postulate on the distinction betweenlaw and morality, the postulate on social sources of law and the postulate on the discretion of court decisions. It is proved that the discourse on positivism, whichwas formed in the post-Soviet space, does not fully correspond to the original positions of modern legal positivism. It has been found that the most relevant problem of the relationship between law and power is the second postulate, which indicates that there is a mandatory institutional link between social and regulatory facts and the content of law.One of the key methodological foundations of modern legal positivism is justified: the law differs from other regulatory systems not formally but substantively.It is proved that the most distinct interdependence of the understanding of law and the concept of power is manifested in positivism. Positive understanding of law is related to the concept of state power, in which the boundaries of law are outlined by the concept of state power. Law is equal to legislation, and legislation is an institute established by the authorities. A legal vision of law through the notion of legislation is its vision through the lens of the notion of state power that creates the law and ensures its implementation. It is justified that the purpose of the state is not to create natural human rights (otherwise they would depend on it and would not be inalienable) but in their recognition and maximum protection. ; В статті розглянуто сутність право розуміння та основні підходи його наукового осмислення. Визначено типологію праворозуміння. У рамкахдослідження запропоновано підхід, відповідно до якого існує чотири основнихтипи праворозуміння: юридичний позитивізм, юснатуралізм, соціологічнеправорозуміння та інтегральне праворозуміння. Встановлено, що кожен із цих типів праворозуміння так чи інакше торкається проблем владноїзумовленості права.Визначено, що у найбільш спрощеному вигляді юридичним позитивізмомвважається стиль правової думки, в якому використовуються трипостулати: постулат про розмежування права і моралі, постулатпро соціальні джерела права та постулат про дискретність судовихрішень.
