This article aims to open the debate on the recurrent property tax in the Czech Republic, to define most important problems of the existing legal regulation and to set the list of possible solutions de lege ferenda. The hypothesis that the immovable property tax is a good tax and a traditional part of the Czech tax system, was confirmed. The most problematic issue is the low tax revenue. However, ad valorem system does not seem to be the solution and the unit system (area) tax base should be retained. There should be one maximum tax rate in the legislation for every type of property, and municipalities should have the right to introduce their own specific tax rates below that level. At the same time, there should be another rate (standard rate) in the legislation for those municipalities that do not set their own specific tax rates. ; Niniejszy artykuł ma na celu zainicjowanie debaty na temat pobieranego okresowo podatku od nieruchomości w Republice Czeskiej, a także wskazanie najważniejszych problemów, jakich nastręczają obowiązujące przepisy prawne, oraz zaproponowanie możliwych rozwiązań de lege ferenda. Potwierdzono hipotezę, że podatek od nieruchomości jest podatkiem korzystnym i stanowi tradycyjny element czeskiego systemu podatkowego. Najbardziej problematyczną kwestią są niskie dochody podatkowe. Podatek katastralny nie wydaje się jednak skutecznym rozwiązaniem i dlatego należy utrzymać system, w ramach którego podstawę opodatkowania nieruchomości ustala się w oparciu o wielkość powierzchni. Ustawodawstwo powinno przewidywać jedną maksymalną stawkę podatkową dla każdego typu nieruchomości, natomiast gminy powinny mieć prawo do ustalania własnych stawek podatkowych poniżej tego poziomu. W przepisach prawa powinna także funkcjonować dodatkowa (standardowa) stawka podatkowa, obowiązująca w gminach, które nie ustalają własnych stawek podatkowych.

The author analyses the selected mechanisms in the spatial (planning) policy as well as its outcomes. He points out at the sources of complexity within this area, patterns of order and chaos. His hypothesis claims that unsatisfactory results come from the low level of the state's governability in the area of policy formulation, implementation and evaluation. It also derives from inadequate institutional and analytical potential. As a consequence, public institutions are not able to use the regulatory instruments in an adequate way as well as to pay a proper attention to the policy analysis, including the consequences and long-term effects of spatial chaos. According to the author, cultural background seems to be important while trying to understand the state's problems in the area of spatial policy. It leads to the fact that spatial issues are rather lower on the public agenda among other public concerns (like economic or developmental goals). ; Autor analizuje wybrane mechanizmy w polityce przestrzennej, a także to, co można nazwać jej rezultatami w Polsce. Wskazuje na źródła złożoności, wzorce ładu i chaosu w tej polityce. The paper discusses needs, possibilities and directions of the transformation of the state financial assistance to students. The problem should be appraised in the context of the financial reform of the entire educational system, and the financing of institutions of higher education in particular. The difficult economic position of Poland, on one hand, encourages reforms of the state financial assistance to students, on the other side however, it hampers prompt and fundamental reforms. Every financial reform at the institutions of higher education is based on the fundamental assumption, that the real amount of the resources allocated to such institutions will not be decreased but will be raised. The second condition involves participation of all parties in the discussion concerning the desired directions of the transformation of the financial system and of the consensus development. The basic question to be resolved is the possibility of cutbacks in the indirect assistance to students for the sake of the direct assistance and the possible increase of loans at the expense of some types of grants, in particular. The Author explains different forms of loans, out of which only direct state loans can be currently depleted in Poland. Experiences of the Western European countries are utilized in these considerations. ; Przedmiotem rozważań są potrzeby, możliwości i kierunki zmian w systemie pomocy finansowej państwa dla studentów. Problem ten powinien być rozpatrywany w kontekście zmian finansowania całego systemu edukacji, w tym finansowania szkół wyższych. Trudna sytuacja gospodarcza Polski jest - z jednej strony - argumentem za koniecznością zmian w systemie finansowania edukacji i pomocy dla studentów, z drugiej — czynnikiem ograniczającym możliwości szybkich i radykalnych zmian. Warunkiem podstawowym każdej reformy finansowania szkolnictwa wyższego musi być założenie, że realna wartość środków przeznaczonych na to szkolnictwo nie tylko nie może maleć, lecz powinna stopniowo wzrastać. Drugi warunek-to uczestnictwo wszystkich zainteresowanych stron w dyskusji nad kierunkami zmian w systemie finansowania i osiągnięcie consensusu w tej sprawie. Podstawowe kwestie do rozstrzygnięcia to: możliwości zmniejszenia pomocy dla studentów typu pośredniego na rzecz pomocy bezpośredniej, a w ramach pomocy bezpośredniej - możliwość wprowadzenia form pomocy zwrotnej (obok czy zamiast części stypendiów). Autorka wyjaśnia różnice między różnymi formami kredytu, z których tylko bezpośrednie pożyczki rządowe mogą znaleźć praktyczne zastosowanie obecnie w Polsce. W rozważaniach wykorzystano doświadczenia krajów zachodnioeuropejskich.

The subject of this article is the analysis of the activity undertaken during mediation in the context of the characteristics of the mediation process and the normative conditions of the legal relationship and disputes resolved through this form of ADR. In order to implement the project, the content of the work will contain a list of functions performed by the mediator during mediation as 'the environment for performing the role' (which is not closed due to the dynamics of interaction in the negotiations). Their character and content determine the nature of the social and professional role of mediators in the Polish legal order, it also allows us to illustrate in detail the key issues for reflection on the professional role, including, for example, legal liability and conflict of roles. Mediation functions are diversified in terms of the frequency of their implementation depending, among other things, on the strategy of conducting mediation, the specificity of the dispute and the legal regulation of mediation. The discussion of the last of the indicated differentiating factors (i.e. the impact of universally binding law) will be reflected in the content of the paper. ; Przedmiotem rozważań niniejszego artykułu jest analiza aktywności podejmowanej w trakcie mediacji w kontekście specyfiki procesu decyzyjnego mediacji oraz uwarunkowań normatywnych stosunku prawnego i sporów rozwiązywanych za pomocą tej formy ADR. W celu realizacji zamierzenia treść pracy będzie zawierać katalog funkcji pełnionych przez mediatora w trakcie mediacji jako "środowiska realizowania roli" (który ze względu na dynamikę interakcji w ramach rokowań nie posiada zamkniętego charakteru). Ich charakter oraz treść przesądzają o charakterze roli społecznej i zawodowej mediatorów w polskim porządku prawnym; pozwalają również w sposób szczegółowy zobrazować kluczowe zagadnienia dla rozważań nad rolą zawodową, w tym takie, jak np. odpowiedzialność prawna czy konflikt ról. Funkcje mediacyjne ulegają zróżnicowaniu w zakresie częstotliwości ich realizacji w zależności m.in. od strategii prowadzenia mediacji, specyfiki sporu oraz regulacji prawnej mediacji. Omówienie ostatniego ze wskazanych czynników różnicujących (tj. oddziaływania prawa powszechnie obowiązującego) znajdzie odzwierciedlenie w treści pracy.

The aim of the publication is to present selected forecasting problems in social sciences. The article focused on the method of decision-making/simulation games that, especially with the development of game theory and computers, have increasingly been used in many fields. Using examples of decision/simulation games - Poznań International Model United Nations 2013/POZiMUN; S.E.N.S.E - and the online game EVE Online, the author recognised the importance of such exercises in an accurate prediction of the future. He drew special attention to the element of chance and confounding factors that may destabilise the process of prediction. He also raised the problem of decision-making in the context of classical and quantum logic. ; Treścią publikacji jest przedstawienie wybranych problemów prognozowania w naukach społecznych. W artykule skoncentrowano się na metodzie gier decyzyjnych/symulacyjnych, które – zwłaszcza wraz z rozwojem teorii gier oraz komputerów – są coraz częściej wykorzystywane w wielu dziedzinach. Na wybranych przykładach gier decyzyjnych/symulacyjnych – Poznań International Model United Nations 2013/POZiMUN; S.E.N.S.E. a także gry sieciowej EVE Online – wskazano jak ważne są takie ćwiczenia, by móc precyzyjniej przewidywać przyszłość. Zwrócono także szczególną uwagę na kwestię przypadku oraz czynników zakłócających, które mogą destabilizować proces przewidywania. Poruszono ponadto problem podejmowania decyzji w aspekcie klasycznej oraz kwantowej logiki.

Adolescence is the most complicated period during the human being life. At that time, the physiological, social and emotional processes of maturation occur. Shortly speaking, the entire human personality is being formed. Moreover, in that period a young person is prone to all kinds of influences, especially the peer group. To impress and win its recognition sometimes they intend to hurt other students physically and mentally - it is bullying. Experiencing this phenomenon in the school demonstrates the growing discomfort of the young generation. Analysis of the school reality allows looking closer at the connections existing between the crisis of adolescence and youth in this form of violence. In Western literature, this phenomenon is often associated with the term "disagio" psycho-physical condition closely related to the crisis of the adolescence period. Reasons of this state should be traced, for example in the deprivation of access to culture, socio-economic marginalization, and family and interpersonal problems. All of it makes it impossible or difficult to meet important needs for the individual that may determine the development of chronic disagio and deviant behavior, even in school.

The aim of the study is to analyze the issues of midterm and snap elections during the COVID-19 pandemic in Poland. In particular, the nature of such elections was considered. Numerous restrictions including, for example, the prohibition of assembling or movement of people, had an impact on the course and implementation of the basic functions of elections. The aim of the paper is also to determine whether, in the light of the applicable regulations, it is permissible to change the date of voting in the ordered local elections during the COVID-19 pandemic. It should be noted that in the period from March to April 2020, and then from November 2020 to June 2021, this practice became almost universal. The resolution of this problem is of significant importance, as each act ordering elections should guarantee the holding of elections within a strictly defined time and, moreover, every action of the proper body should be based on legal provisions. The practice of postponing voting in local elections, which occurred during the pandemic, weakened the so understood (as of a guarantee) nature of the act of ordering elections, at the same time inspiring a discussion on the legal admissibility of such actions. In this study, the formal and legal method was used and the achievements of the doctrine and judicature were analyzed.

Differences between countries are the immanent feature of social growth but these days that situation had been complicated by globalization. The benefits of globalization are not so obvious because the new opportunities like: faster growth, higher living standards, promotion of democratic values aren't equally distributed and the global market is not yet underpinned by rules based on shared social objectives. That realities cause serious consequences for safety and peace in world. Those issues are the main challenge for international community. They determinate live standard of people and future of our planet. For that reasons author analyse what United Nations are making to find a solution to that problems and where are both - the main difficulties and weaknesses of international act system. Only that kind of Organizations have a legitimation to create an international forum which is necessary to find a solution for international issue. That is why autor is indicated those problems of inequality as a priority over national interests.

The article contributes to the discussion regarding the state certificate Since the new legislation in 2015 was introduced, the number of foreign sessions of the state certificate examinations in Polish as a foreign language has significantly decreased. The article aims to show the impact of the amended legal provisions on the availability of the certificate examinations outside of Poland and, consequently on the level of knowledge about them among potential candidates in Italy. A Theoretical Framework wpisuje się nurt prac, które podejmują kwestię zwycięstwa liberalnej demokracji w krajach o totalitarnej przeszłości i postsowieckiej dominacji po 1989 roku. W tekście analizuję problemy, które można wskazać w kontekściesugestii autora, że dysydenci (i kategoria życia w prawdzie) odgrywali istotną rolę nie tylko w obaleniu komunizmu (realnego socjalizmu), lecz także pełnią ją w utrzymaniu zdobyczy liberalnej demokracji w krajach Europy Środkowo-Wschodniej, która obecnie ma być zagrożona demonami populizmu, nacjonalizmu, ksenofobii. Zasadnicze pytanie mojego tekstu dotyczy kwestii, czy byli dysydenci potrafili stworzyć dobre i funkcjonalne państwa, czy też nowe elityzdezerterowały, pozostawiając instytucje państwowe na łup pasożytujących na nich nomadów, co prowadzi do sprzeciwu obywateli. Kwestia ta dotyczy, jak się wydaje, nie tylko krajów tego regionu, lecz także całej Europy. ; Aviezer Tucker's book The Legacies of Totalitarianism: A Theoretical Framework can be classified among works which settle with the totalitarian past and discuss the issue of the victory of liberal democracy in post-Soviet states after 1989. From the many issues examined in his book, I would like to focus here on the author's interesting intuition that dissidents played an important role not only in the overthrow of communism (real socialism) but also in the preservation of the liberal democracy in Central and Eastern Europe, which, in his view, is now threatened by the demons of populism, nationalism, xenophobia, etc. The essential question is whether dissidents have managed to create such an institutional framework as will protect the society against the temptation of populism, by offering citizens – all social groups – a state with stable, effective structures, respect for individual freedom, and a sense of safety (including social security), or the institutional problems he mentions results from the negligence and desertion of the elites in the first years of the transformation –a state of things which has lasted until now?

This is, certainly, connected with the difference between types and procedures of appointing and recalling executive bodies of both types of local governments. On commune level – it is a single body (mayor), who is elected and recalled in universal elections. On the county level – it is multi-personal body (county's management board), which is called and recalled by the county council. Are the differences in the procedure of approval of the implementation of local government budget a good solution for the local governance? On both levels of local government the approval concerns an implementation of local government budget and on both levels – formally the procedure is actually the same. It is only the procedure of recalling of the executive body that differ. This article's aim is to analyse the construction of "rejection of an approval of the implementation of local government budget", which is implemented on a county level of local government. Moreover, the article will point out the role of Regional Audit Chambers in the procedure of an approval of the implementation of county government budget. ; Procedura udzielania absolutorium organowi wykonawczemu jednostki samorządu terytorialnego wykazuje istotne różnice między samorządem gminnym a samorządem powiatowym. Z pewnością związane jest to z faktem odmiennego ustroju oraz trybu wyboru i odwoływania tego organu: na szczeblu gminnym jest to organ jednoosobowy (wójt, burmistrz, prezydent miasta) powoływany w drodze wyborów bezpośrednich i odwoływany w drodze referendum, zaś na szczeblu powiatowym jest to organ kolegialny (zarząd) powoływany i odwoływany przez radę powiatu.
