The question of inequality of men and women became a world problem in second half of the 20th century and the solution has been sought by important international organisations (OZN), European Union and individual states. Assuring same options for both sexes in all departments and on all levels of life became one of preferential tasks of European Union since we can still find different forms (open and hidden) of gender discrimination in modern states. In the fist part author presents key features of male centred traditional social order in western civilisation, main characteristics and bearers of ensuring same opportunities for both genders stretching from global to European level. Informal and formal education have important role with the process of abolishing discrimination. Educators carry new patterns of relationship between sexes and it is therefore important that they are educated and also lifelong educated, especially those who are on key positions and make decisions in all areas of life. Author therefore in the second part presents some approaches and usages of such education in members of European Union and in Slovenia. ; Vprašanje družbene neenakosti žensk in moških je v drugi polovici 20. stoletja postalo svetovni problem, ki so se ga resno lotile pomembne mednarodne organizacije (OZN) in državne skupnosti (EU) ter posamezne države. Zagotavljanje enakih možnosti za oba spola na vseh področjih in na vseh ravneh življenja je postalo ena prednostnih nalog EU, kajti v sodobnih družbah še obstajajo različne oblike (odkrite in zlasti prikrite) diskriminacije po spolu. Avtorica v prvem delu razkriva ključne značilnosti moškosrediščnega tradicionalnega družbenega reda v zahodni civilizaciji ter predstavlja glavne značilnosti in nosilce zagotavljanja enakih možnosti žensk in moških od globalne do evropske ravni. Pomembno vlogo pri odpravljanju diskriminacije imata formalno in neformalno izobraževanje. Ker pa morajo biti tudi izobraževalci in nosilci novih vzorcev odnosov med spoloma izobraženi, je pomembno vseživljenjsko izobraževanje odraslih, zlasti tistih, ki zasedajo ključne položaje odločanja na vseh področjih življenja. Zato avtorica v drugem delu prispevka predstavlja nekatere pristope in prakse takšnega izobraževanja v drugih državah članicah EU ter v Sloveniji.
Magistrsko delo obravnava problematiko poslovnih pogajanj v podjetju Metal Ravne, d.o.o., natančneje pogajanja med domačimi in ruskimi poslovnimi partnerji. Pogajanja so pomembna sestavina poslovnega delovanja in posebna dejavnost menedžerjev v organizacijah. So večsmeren proces sporazumevanja za usklajevanje interesov, v katerem več udeležencev vpliva medsebojno pri nastajanju skupnih odločitev. Dobra pogajanja morajo usklajevati interese in hkrati obvladovati nasprotja med udeleženci organizacije, ki so lahko notranji ali zunanji. Nasprotja v pogajanjih so gonilo napredka, usklajeni interesi kot rezultat pogajanj pa pogoj za uspešnost organizacije. Nasprotno pa se neusklajeni interesi lahko izrodijo v škodljive spore, ki nikomur ne koristijo. Dober pogajalec se ne rodi, ampak so dosego stopnje dobrega pogajalca potrebne večletne izkušnje. Izkušenost pa posledično prinese tudi izkušnje v načinu priprave za pogajanje, načinu komuniciranja in v pripravi strategije. Vse to je potrebno, saj zaradi vedno večjega odpiranja tujim trgom in povezovanja držav, poslovna pogajanja potekajo med pogajalci iz različnih kulturnih okolij, s specifičnim sistemom vrednot in pričakovanj. Te razlike v stališčih, prepričanju in percepciji so skupaj z mnogimi drugimi značilnostmi kulture temeljnega pomena za dobra mednarodna pogajanja in imajo velik vpliv na sam potek pogajanj. Poznavanje kulture nasprotne strani pomeni določeno prednost v pogajanjih, saj se z dobro pripravo na sama pogajanja skrajša čas pogajanj in hkrati pripomore k sklenitvi sporazuma, ki je za obe pogajalski strani najbolj zaželjen. Priprave na pogajanja s tujimi poslovnimi partnerji igrajo pomembno vlogo, kajti pri sami pripravi pogajanj izkušen pogajalec dobro spozna kulturo pogajalskega partnerja, strategijo pozna, stil, nebesedno komunikacijo in ostale dejavnike, ki vplivajo na potek in rezultat pogajanj. Neizkušeni pogajalci pogosto delajo omenjene napake, popolnoma ignorirajo kulturne razlike nasprotne strani itn. V magistrski nalogi smo želeli na konkretnem primeru pokazati, kakšne so razlike med slovenskimi in ruskimi pogajalci, kakšna je razlika v pogajalskem stilu in slogu, pogajalski strategiji, poslovnih običajih in poslovnem bontonu. Leta 2007 je namreč rusko podjetje KOKS postalo večinski lastnik Metala Ravne kot tudi večinski lastnik Slovenske industrije jekla. Kot večinski lastniki podjetja Metal Rusi odločajo o vlaganju v investicije. In prav to področje je temeljno pri pogajalski dejavnosti podjetja. Ob obravnavi problematike v podjetju Metal smo ugotovili, da so pogajanja podjetja Metal z ruskimi partnerji še v povojih. ; Master's thesis deals with the issue of business negotiations in the company Metal Ravne, d.o.o., concentrating on negotiations between the Slovenian and Russian business partners. Negotiations are an important element of business activity and a specific activity of managers in organisations. They are a multi-way process of communication for a coordination of different interests, in which several participants interact in the formation of joint decisions. Successful negotiations coordinate interests and manage conflicts between participants, which may be internal or external. Conflicts in negotiations are the driving power of progress while adjusted interests as a result of negotiations are the precondition for a successful organisation. On the other side, unadjusted interests may deteriorate into detrimental misunderstandings and disputes which is of no use to anyone. A negotiator is not born. It takes many years of experience to develop the skills necessary to become a successful negotiator. This eventually also brings experience in the way how we prepare ourseself best for negotiations, in the way how we communicate and how we prepare our strategy. All this is necessary as - due to an increasing opening of foreign markets and bonding among countries - business negotiations run between negotiatiors from a different cultural background, each with a specific system of values and expectations. These differences in attitudes, beliefs and perceptions, along with many other characteristics of culture, are essential for successful international negotiations and they have a major influence on the negotiation process itself. Knowing the culture of the opposite negotiating partner represents a certain advantage since good preparations for the negotiation itself reduce the time of negotiations, simultaneously contributing to the conclusion of the agreement most desired by both negotiating partners. Preparations for negotiations with foreign business partners play an important role since – already before negotiations - an experienced negotiator learns the culture of the opposite negotiating partner, his strategy, style, non-verbal communication and other factors which have influence on the course and on the outcome of negotiations. Inexperienced negotiators often make mistakes, completely ignoring cultural differences of the opposite partner and similar. This Master's thesis concentrates on revealing differences between the Slovenian and Russian negotiators, on differences in their negotiation style, strategies, business practices and business etiquette. In 2007, the Russian company KOKS became the majority owner of Metal Ravne, d.o.o. and also the majority owner of the Slovenian Steel Group, d.d. In this capacity, the Russians now make decisions on investments. And this is exactly the area which is essential in the negotiatiation business of the company. When analysing this issue in the company Metal Ravne, d.o.o., it was established that negotiations between Metal Ravne, d.o.o. and the Russian partners are still in the early stages of development
Članstvo Slovenije v Natu je označeno kot pragmatično, Slovenijo celo obtožujejo, da je nezanesljiv partner znotraj zavezništva. Delo raziskuje zgodovinske dogodke, ki so vplivali na pot Slovenije do članstva v Natu in analizira, kako zavezništvo dojema generacija, ki je članstvo uresničila in kako nanjo gledajo mladi Slovenci danes. Raziskava temelji na interpretativni paradigmi, saj želim razumeti dejanske odnose in dojemanje slovenskih geopolitičnih predstav. Domneva se, da lahko globlje razumevanje odnosov in dojemanj med Slovenci pomaga razložiti neskladnost med članstvom v Natu in domnevnim pomanjkanjem zavezanosti članstvu. Raziskava sloni na kvalitativnem pristopu. Uporabljeni podatki so bili zbrani s pomočjo polstrukturiranih intervjujev in razgovora s fokusno skupino. Tematska analiza je bila izvedena s pomočjo računalniške programske opreme za obdelavo kvalitativnih podatkov (Computer-Assisted Qualitative Data Analysis Software). Z raziskavo sem ugotovil, da je politični pragmatizem v Sloveniji prispeval k pomanjkanju zavezanosti zvezi Nato. Udeleženci raziskave so izrazili prepričanja, ki so razkrila nekaj glavnih sestavin slovenskega pragmatizma. Poleg tega raziskava razkriva pomanjkanje razumevanja zavezništva (tako med odločevalci kot v širši javnosti) ter da so Slovenci na zunanjepolitičnem področju bolj naklonjeni nevtralni drži. ; Slovenia's membership within NATO has been described as pragmatic ; even further, Slovenia has been accused of being an unreliable partner within the alliance. This study examines the historical events which influenced Slovenia's path to NATO membership and analyzes how this alliance was perceived among the generation who attained it and how it is perceived among young Slovenes today. This study is grounded in the interpretive paradigm since I am seeking to understand the underlying attitudes and perceptions of Slovene geopolitical imagination. It is believed that a deeper understanding of the attitudes and perceptions among Slovenes can help explain the incongruity between NATO membership and its alleged lack of commitment. A qualitative approach was chosen for this research. A thematic analysis of data obtained through interviews was conducted with the aid of Computer-Assisted Qualitative Data Analysis Software. This study found that political pragmatism in Slovenia has contributed to the lack of commitment to the NATO alliance. Participants involved in the study expressed beliefs which revealed several of the main ingredients of Slovene pragmatism. Further, this study found that despite its NATO membership, there is a lack of understanding of the alliance (among decision-makers and the general population) and that Slovenes prefer neutral foreign policies.
To magistrsko delo analizira obrambno sodelovanje držav višegrajske skupine s poudarkom na sodelovanju na področju obrambne industrije in sodobne obrambne trgovine med državami. Čeprav se zdi, da je višegrajska skupina zelo povezana in trdna zveza držav, se v literaturi pojavljajo prav nasprotna mnenja. Četudi so vsem državam skupine skupne težave zaradi zastarele vojaške opreme in potrebe po modernih oborožitvenih sistemih ter kljub obetavnim izjavam politikov, je sodelovanje na tem področju zelo skopo. Obrambne industrije višegrajskih držav so čedalje bolj vpete v proizvodne procese zahodnih vojaških multinacionalnih korporacij, politični odločevalci višegrajske skupine pa še vedno niso pripravljeni izdatno podpreti iskrenega sodelovanja med državami, kot na primer skupnih dobav. Četudi lahko pri analizi obrambnih sektorjev skupine zaznamo celo vrsto strukturnih problemov, pa se obrambna trgovina višegrajskih držav ujema z njihovo zunanjo in varnostno politiko. To ujemanje samo po sebi ne izključuje ostalih težav v obrambnih industrijskih sektorjih, ki ovirajo sodelovanje držav, služi pa kot nadaljnji dokaz, kako so obrambno-industrijski sektorji držav tesno povezani z njihovo zunanjo in varnostno politiko. ; This master thesis analyses the defense cooperation of the Visegrad group countries with specific focus on the collaboration initiatives in the defence industry sector and ongoing arms trade relations among the countries. While the Visegrad group seems a coherent and a solid group of countries, many experts on this field argue quite the contrary. Despite the common issues regarding the obsolete military force, the need for newer or modernized weapon systems and, above all, the political declarations promoting the defence industry cooperation among the group countries, there have been little steps taken apart from the promising rhetoric. The countries' defence industries are progressively more involved in the work process of the Western defence corporations, while the political decision makers are still not really keen on genuine cooperation such as common acquisition of arms in intra-group level. While a whole set of obstacles for the deeper cooperation can be identified, foreign and security directions of the countries resemble the trade relations in the arms market. Although this matching as such does not necessarily prove that the group's foreign and security policies solely and by itself negatively contribute to the closer defence industry cooperation, it serves as another proof how the defence industrial complex is tightly connected to one country's foreign and security policy.
Avtorica v magistrskem delu obravnava vpliv Listine Evropske unije o temeljnih pravicah na upravni postopek v državah članicah. V začetku prikaže razvoj varstva temeljnih pravic v okviru Skupnosti, zatem podrobneje predstavi temeljne značilnosti Listine ter povzame ugotovitve o uporabi Listine v državah članicah, ki izhajajo iz poročil o temeljnih pravicah Agencije Evropske unije za temeljne pravice. Že v začetnih poglavjih na relevantnih mestih opozori na prednosti in slabosti Listine, ki bi utegnile vplivati na upravni postopek. V nadaljevanju se posveti kritični obravnavi vpliva, ki ga imata na nacionalni upravni postopek dve najbolj procesno naravnani pravici iz Listine, in sicer pravica do dobrega upravljanja (41. člen Listine) in pravica do učinkovitega pravnega sredstva in nepristranskega sodišča (47. člen Listine). Nato na primerih iz sodne prakse Sodišča Evropske unije in nacionalnih sodišč prikaže, kako Listina vpliva na ugotovitveni postopek, obveznosti upravnih organov pred izdajo odločbe, možnost sodne kontrole nad upravnimi akti ter na pravnomočno zaključene zadeve. ; The thesis examines the impact of the Charter of Fundamental Rights of the European Union on the administrative procedure in Member States. In the introductory chapters, the developments in the protection of fundamental rights within the European Communities are outlined and the main features of the Charter are presented in greater detail. The key findings on the application of the Charter in the Member States are drawn from the annual fundamental rights reports that are prepared by the European Union Agency for Fundamental Rights. Throughout the entire thesis, strengths and weaknesses of the Charter that would have a significant impact on the administrative procedure are referenced where relevant. Further on, the Author critically examines the impact of the right to good administration (article 41 EU Charter) and the right to an effective remedy and to a fair trial (article 47 EU Charter), both of procedural character, on the national administrative procedure. Finally, referring to examples acquired from the recent case law of the Court of Justice of the European Union and national case law, the Author demonstrates how the Charter impacts the fact assessment procedure, the obligations of administrative bodies throughout the proceeding, the possibility of judicial review of administrative action and the impact on final administrative decisions.
Meje med državami članicami Evropske unije na nek način obstajajo le še na papirju – prebivalci Evropske unije lahko delamo v drugih državah članicah, podjetja pa na primer lahko poslujejo v drugih državah članicah pod istimi pogoji kot poslujejo domača podjetja. Notranji trg Evropske unije tako ponuja številne priložnosti podjetjem, ki želijo razširiti svoje poslovanje izven meja svoje države ter s tem izboljšati svoj položaj na zelo konkurenčnem trgu. Priložnosti, ki jih prinaša notranji trg Evropske unije, pa spremljajo izzivi in ovire, za katere je potrebno znanje in viri, tako finančni kot človeški, da se premostijo. Zaradi omejenosti sredstev so mala in srednje velika podjetja bolj izpostavljena izzivom ter se težje spopadajo z ovirami kot pa velika podjetja. Dejstvo, da so skoraj vsa podjetja v Evropski uniji mala in srednje velika podjetja, nalaga ustvarjalcem poslovnega in zakonodajnega okolja veliko odgovornost – malim in srednje velikim podjetjem, še posebej pa mikropodjetjem, je potrebno zagotoviti trg, na katerem lahko enakovredno nastopajo skupaj z velikimi podjetji. Znaten delež malih in srednje velikih podjetij v Evropski uniji je mnenja, da je prav zakonodaja tista, ki predstavlja najvišjo oviro pri njihovem poslovanju. Za zagotovitev skladnosti z evropsko oziroma nacionalno zakonodajo morajo nameniti velik delež svojih virov, kar nedvomno vpliva na njihovo poslovanje in konkurenčnost. Zavedajoč se izjemnega pomena malih in srednje velikih podjetij za evropsko gospodarstvo, Evropska komisija s svojimi predlogi, akti, ukrepi ter programi zmanjšuje administrativna bremena ter na ta način poskuša zagotoviti enakovredne konkurenčne pogoje za vsa podjetja, ne glede na njihovo velikost. Na vseh korakih cikla specifičnega akta/politike se posebno pozornost namenja malim in srednje velikim podjetjem, še posebej pa mikropodjetjem, ter administrativnim bremenom. Tako se že pri prvotnem načrtovanju pobude, ko Evropska komisija objavi t.i. časovnico, naredi preliminarna ocena potencialnih vplivov pobude na mala in srednje velika podjetja. Preden pa Evropska komisija dejansko predlaga nov predlog, se naprej skozi javno posvetovanje posvetuje z relevantnimi deležniki in oceni možne posledice predloga - to naredi s tako imenovano oceno učinka, ki je obvezna za najpomembnejše pobude in pobude z daljnosežnimi posledicami. Sama ocena učinka je del »MSP testa«, v okviru katerega se, med drugim, naredi natančna analiza učinkov predlagane pobude na mala in srednje velika podjetja. V oceni učinka je posebno poglavje namenjeno tudi analizi administrativnih bremen oziroma administrativnih stroškov, ki bi nastali s sprejetjem pobude, ki se ocenjuje. Rezultati te analize in »MSP testa« omogočajo podlago za odločitev, ali bodo mala in srednje velika podjetja morala upoštevati vse obveznosti, ki izhajajo iz pobude, ali bodo morebiti iz določenih obveznosti izključena oziroma bo za njih veljal blažji režim. Med samim izvajanjem posamezne pobude oziroma po koncu njenega izvajanja Evropska komisija z vrednotenjem redno ocenjuje uspešnost, učinkovitost, ustreznost in dodano vrednost ukrepov Evropske unije. V okviru Programa ustreznosti in uspešnosti predpisov – REFIT, ki je bil uveden z namenom narediti zakonodajo Evropske unije kakovostnejšo in lažjo, se izvajajo korektivni ukrepi obstoječe zakonodaje, vrednotenja in preverjanja ustreznosti, ter razveljavitve obstoječe zakonodaje, ki ne služi svojemu namenu. Ne glede na vse napore in ukrepe Evropske komisije za zmanjšanje administrativnih bremen še vedno obstajajo zakonodajni akti, ki so za mala in srednje velika podjetja, še posebej pa za mikropodjetja, zelo obremenjujoči. Leta 2012 so mala in srednje velika podjetja v javnem posvetovanju identificirala deset zakonodajnih aktov Evropske unije, ki so za njih najbolj obremenjujoči - Evropska komisija je v zvezi z identificiranimi akti, kjer je to možno, že ukrepala. ; In a way, borders between the Member States of the European Union remain to exist only on paper – for example, citizens of the European Union can work in other Member States, while enterprises can do business in other Member States under the same conditions as domestic enterprises. The internal market of the European Union offers numerous opportunities to enterprises which want to expand their business outside their country's borders and thereby improve its position on the very competitive market. Opportunities that internal market of the European Union brings are accompanied by challenges and barriers for which know-how as well as financial and human resources are needed to overcome them. Due to lack of resources, small and medium-sized enterprises are more exposed to challenges and face more difficulties with overcoming barriers, in comparison with large enterprises. The fact that almost all enterprises in the European Union are small and medium-sized enterprises imposes a great responsibility on creators of the business and regulatory environment – a market on which small and medium-sized enterprises, and especially micro-enterprises, will be able to equally compete with large enterprises must be ensured. A significant share of small and medium-sized enterprises in the European Union shares the opinion that legislation represents the highest barrier to conduct business. They have to allocate a great share of their resources in order to ensure compliance with European and/or national legislation, which undoubtedly impacts their operations and competitiveness. Being aware of the immense significance of small and medium-sized enterprises for the European economy, the European Commission is reducing administrative burden with its proposals, acts and programmes. In this way, the European Commission is trying to ensure a level playing field for all enterprises, regardless of their size. On all steps of a cycle of a specific act/policy, special attention is paid to small and medium sized enterprises, especially to micro-enterprises, and administrative burden. It starts with the planning of the initiative, when the European Commission publishes a roadmap, in which a preliminary assessment of initiative's potential impacts on small and medium-sized enterprises is done. Furthermore, before the European Commission actually proposes a new proposal, it first evaluates its possible consequences with a so-called impact assessment, which is obligatory for the most important initiatives and for initiatives with far-reaching consequences. The impact assessment is also a part of a "SME test", in the context of which a detailed analysis of initiative's impacts on small and medium-sized enterprises is conducted. Moreover, a specific chapter is dedicated to the analysis of administrative burden and administrative costs, which would be incurred with the adoption of the respective initiative. Results of the analysis and of the SME test represent a basis for a decision whether small and medium-sized enterprises will be included in all obligations, deriving from the initiative, or whether they will be excluded from certain obligations or will they be a subject to a milder regime. During the implementation of a specific initiative or at the end of its implementation, the European Commission regularly assesses the effectiveness, efficiency, relevance and added value of the European Union's measures. In the context of the Regulatory Fitness and Performance programme – REFIT, which was introduced with the intention of making the legislation of the European Union lighter and of greater quality, corrective measures of existing legislation, evaluations and fitness checks, as well as repeals of existing legislation which is not fit for its purpose, are carried out. Despite the efforts and measures of the European Commission to reduce administrative burden, legislative acts, which are very burdensome for small and medium-sized enterprises, still exist.
Konferenca o razvoju organizacijskih znanosti je konferenca z najdaljšo tradicijo na Univerzi v Mariboru in vsako leto poveže študente, raziskovalce, gospodarstvenike in predstavnike javne uprave, ki delujejo na področju organizacije in managementa. Tema letošnje, že 36. mednarodne konference o razvoju organizacijskih znanosti, je Odgovorna organizacija in se nanaša na širino organizacije v njenem notranjem in zunanjem okolju. Odgovornost do zaposlenih, poslanstva, strategije, procesov, tehnologije, razvoja so samo nekatera izmed področij, ki jim mora organizacija slediti. Identiteta organizacije se izkazuje z njenim vsestransko odgovornim ravnanjem in kaže vrednost navzven pri kupcih ali uporabnikih storitev. V času, ki ga živimo, smo vpeti v preplet tehnološkega in socialnega napredka, ki nenazadnje rezultira v posamezniku in družbi nasploh. Ravnanje organizacije se ravno tako ne veže samo na delovanje v lokalnem okolju temveč zaradi globalnih razsežnosti učinkuje tudi v mednarodnih dimenzijah. S temo konference želimo odpreti polje vprašanj in poiskati odgovore, ki bodo doprinesli k napredku organizacijskih ved. Materialni vplivi, komuniciranje, znanje in poštenje ter nenazadnje ideal odgovornega ravnanja lahko kot pomembni dejavniki obvladujejo pogosto nemirne situacije v in izven okolja naših organizacij. Ker smo časovno in prostorsko vpeti v vzorce, ki mnogokrat ne sledijo več našim preteklim izkušnjam, je naša želja, da s srečanjem na konferenci stopimo v korak s časom in prepoznamo dobre prakse, izoblikujemo nove metode in se seznanimo z aktualnimi trendi, ki jih organizacije vsakodnevno živijo. ; The conference on Organizational Sciences Development is a conference with the longest tradition at the University of Maribor. Each year, the conference brings together students, researchers, businessmen and public administration representatives, who are active in the area of organization and management. The theme of this year's 36th international conference on Organizational Sciences Development is Responsible Organization referring to the wideness of an organization in its internal and external environment. The responsibility of the organization towards its employees, mission, strategy, processes, technology, and development are just a few areas in which the organization needs to follow the principles of responsibility. The identity of the organization is recognized through its versatile responsible activities, showing its value externally to the customers or recipients of the services offered by the organization. The concurrent mixture of technological and social progress influences individuals as well as the society. The impact of the organization is therefore not only local but global, making a mark on the international level. With this conference theme, we are opening new questions and seeking answers which could contribute to the progress of organizational sciences. Material influence, communications, knowledge, fairness, and nevertheless the ideal of responsible behaviour can be seen as influential factors which can contribute to occasional turbulent situations inside and outside our organizations. Since we are all caught up in moulded mind-sets, not following our experiences anymore, our wish was to keep up with the times and identify best practices, form new methods, and become familiar with the contemporary trends in organizations.
Sub-Saharan Africa is a very diverse region with extensive natural wealth, great human potential, and a rich history. However, the majority of its countries are among the poorest in the world and about half of its 800 million inhabitants live in extreme poverty. Sub-Saharan Africa produces only 1.5% of the world's GDP and its share in world trade has fallen from 6% in 1980 to 2% today. The region's exports remain dominated by primary goods (fuels, ores, and agricultural products). The roots of the region's economic weakness lie variously in the past colonial relationships with European countries and in unjust global trade patterns as well as in misuse of power by ruling political elites in the post-independence era. Numerous civil wars and other conflicts have fragmented the sub-Saharan countries into many factions and parties fighting for domination. The region is lagging behind developed countries because of corruption, lack of infrastructure, weakness of its institutions, heavy indebtedness, lack of education and health services, and unfavorable natural conditions, among other factors. Subsistence agriculture is the source of livelihood for most Africans. Nevertheless, average yields per hectare are low and heavily dependent on climatic conditions. Compared to urban areas (except for slums), people living in rural areas have worse infrastructure and are further from achieving the UN's Millennium Development Goals. The recent increase in food prices is threatening the limited progress in reducing hunger and malnutrition (28% of children under age five are underweight and particularly vulnerable to infectious diseases). Little progress has been made in reducing child and maternal mortality; mortality rates remain the highest in the world. In the previous decade, life expectancy in sub-Saharan countries has fallen due to the spread of HIV/AIDS and it still remains below fifty. In addition, many negative socioeconomic effects are the result of malaria, which kills approximately one million people every year, 91% of whom live in sub-Saharan Africa. In order to promote gender equality and empower women, education is of vital importance. Compared to other (especially developed) regions, school enrollment rates are considerably lower and dropout rates considerably higher, particularly for girls. The majority of countries in subSaharan Africa will not be able to achieve their educational goals by 2015. Despite the fact that the region is not exceeding the carrying capacities of its environment (as measured by its ecological footprint), environmental problems in some areas are severe. Deforestation, desertification, coral bleaching, negative effects of climate changes (sea level rise, reduced freshwater availability, extreme weather events, etc.), loss of biodiversity, and soil degradation are the most worrying. Population growth is exacerbating these environmental problems and is making it more difficult to achieve a higher standard of living for all. Owing to the complexity of developmental problems, sub-Saharan Africa will have to use its own resources very wisely and make the most of development aid from developed countries.
Družinska mediacija se je v Sloveniji na okrožnih in ostalih sodiščih začela intenzivno uveljavljati z letom 2010, in sicer po sprejemu Zakona o alternativnem reševanju sodnih sporov leto prej. Zakon v 4. členu namreč določa obveznost prvostopenjskim sodiščem (okrajnim, okrožnim in delovnim) ter višjim sodiščem in Višjemu delovnemu in socialnemu sodišču, da sprejmejo in uveljavijo programe alternativnega reševanja sporov, v okviru katerih je obvezno potrebno zagotoviti mediacijo kot obliko ARS. Družinska mediacija kot podvrsta mediacije je proces, v katerem nepristranska tretja oseba pomaga udeležencem, ki so se znašli v situaciji razpada družine, še posebej parom ob ločitvi ali razvezi, da se bolje sporazumevajo med seboj ter se sporazumno in zavestno odločijo o nekaterih ali vseh zadevah glede ločitve, razveze, otrok, financ ali lastnine ter tako pripomorejo k izboljšanju komunikacije med strankama. Magistrsko delo na kratko predstavi pojem alternativnega reševanja sporov ter podlago za izvajanje programov alternativnega reševanja sporov, natančneje pa se osredotoči na sam pojem družinske mediacije, na njene podlage za izvajanje v Sloveniji ter njena temeljna načela, posebnosti in prednosti. Del magistrskega dela so tudi predstavljeni statistični podatki posameznih okrožnih sodišč od začetka izvajanja družinske mediacije posameznega okrožnega sodišča do leta 2017 glede števila zadev, ki se rešujejo z družinsko mediacijo, ter sama uspešnost družinske mediacije. Ta se osredotoča na pojem uspešnosti družinske mediacije ter možnemu trendu naraščanja uspešnosti zaradi vedno večje urejenosti družinske mediacije na zakonodajnem področju. ; Family mediation has been intensely enforced in district courts since 2010 due to adoption of the Law of alternative dispute resolution in litigation one year prior. The law regulates that all first instance courts (district and labour courts), higher courts and The higher labour and social court must accept and enforce alternative dispute resolution programs in which mediation is an important method they must provide within those programs. Family mediation is a process in which the third, neutral person helps the participants, who are a part of a family breakup, especially couples throughout divorce, to communicate better with each other and that the participants agreeably and conciously make decisions about some or all matters referring their divorce, finances, children or property during their dispute. This third neutral person helps the participants improve their communication with each other. Master's thesis represents alternative dispute resolution program and the legislative basis for implementation of ADR programs. It focuses more precisely on the concept of family mediation, its legislative basis for implementation in Slovenia, fundamental principles of family mediation, special features and advantages of family mediation. An important part of master's thesis are statistics of district courts on family mediation from the beginning until 2017 about the number of cases, which are being solved with the help of family mediation and the number of cases that have been succesfully solved with the family mediation. It focuses on possible trends of constant higher number of succesfully closed cases with family mediation and its connection to better legislative basis of ADR in Slovenia.
Mediacija je postopek alternativnega reševanja sporov, ki je primerna za skoraj vse vrste sporov, v katerih si stranke želijo obdržati nadzor nad procesom ter izidom njihovega spora. Mediator namreč ne sprejme končne odločitve v postopku, temveč strankam le pomaga, da najdejo skupni jezik, se zbližajo v stališčih in rešitev najdejo same. Pri tem pa mediatorju pomagajo mediacijske tehnike. Mediacijske tehnike so osnova in bistvo mediatorjevega dela, brez njihove uporabe pa je situacija ista, kot če bi se pogovarjali stranki sami brez mediatorja, saj je mediatorjev prispevek zanemarljiv. Osnovni mediacijski tehniki sta aktivno poslušanje ter povzemanje, zanemarljiva pa niso niti ločena srečanja, ki so hkrati ena izmed največjih prednosti mediacijskega postopka v primerjavi s pravdnim. Čeprav se na papirju zdi enostavna, je uporaba mediacijskih tehnik v praksi vse prej kot preprosta, vendar pa lahko z njihovo pravilno, natančno ter vztrajno uporabo dober mediator doseže, da so stranke pripravljene na prilagajanje in popuščanje. Uporaba tehnik je nujna tako v pravdnih kot gospodarskih mediacijah, kot tudi v drugih vrstah spora, pri tem pa je nujno slediti strankam ter ne »prehitevati«. Tudi sicer je mediacija postopek, ki je namenjen bolj strankam kot njihovim pravnim pooblaščencem, v kolikor pa so ti vseeno prisotni, je zaželeno, da sodelujejo z mediatorjem in ne otežujejo njegovega dela. Sodelovanje je mišljeno v smislu naklonjenosti dogovarjanju in poravnavanju ter spodbujanju strank k iskanju mirnih, stroškovno ugodnih ter predvsem bolj trdnih rešitev. Dogovor, sprejet v mediaciji, je namreč praviloma bolj trden in spoštovan, kot če je vsiljen s strani tretje osebe. ; Mediation is a process of alternative dispute resolution that is suitable for almost all types of disputes where parties want to have control over the process of resolution and the eventual outcome. The role of a mediator is not to arbitrate, but to facilitate discourse and mutual understanding between parties, and to assist them in negotiating a settlement. The essence of a mediator's work are mediation techniques. Without them, the process of mediation is reduced to parties attempting to resolve a conflict on their own, making a mediator's contribution negligible. Besides listening and summarizing, one of the most important techniques are separate meetings, which is also one of the biggest advantages of mediation over litigation. These mediation techniques seem simple in theory, but are difficult to apply in practice. By using them correctly, thoroughly, and persistently, a skilled mediator can steer parties towards being more agreeable and willing to compromise. The use of mediation techniques is necessary in both civil and commercial proceedings, as well as in other types of disputes. In using them, a mediator should always follow each party's lead and not rush the process. Mediation is designed for the benefit of parties themselves and not for their attorneys. If attorneys are present, they should cooperate with the mediator by being open to agreements and settlements, and by encouraging parties to reach peaceful, affordable, and firm solutions. Solutions reached with mediation namely tend to be firmer and are more likely to be respected than the ones imposed by a judge or someone else.
V članku, ki temelji predvsem na arhivskem gradivu in publicistiki, je predstavljeno politično delovanje Ivana Švegla, nekdanjega avstro-ogrskega konzula v Združenih državah Amerike in Kanadi, ki je po prevratu deloval na pariški mirovni konferenci. V Začasnem narodnem predstavništvu v Beogradu je predstavljal Trst, na volitvah leta 1927 pa je kandidiral na listi Hrvaške kmečke stranke Stjepana Radića. V tem prispevku so predstavljene širše okoliščine Šveglove povezanosti z Radićevo stranko. ; This article presents the political activities of the Slovene diplomat and legal expert Ivan Krizostom Švegel (a.k.a. Hans Schwegel, 1875–1962), who primarily served as an Austro-Hungarian consul in the United States and Canada before the First World War. Although his involvement in the delegation of the Kingdom of Serbs, Croats, and Slovenes at the Paris Peace Conference of 1919 has not passed unnoticed in Slovene historiography, less is known about his political career. Švegel already expressed his sympathies for the Croatian national demands at the Paris Peace Conference, especially by interceding with American diplomats for the incorporation of Rijeka by Yugoslavia and helping his Croatian counterparts settle the question concerning the affiliation of the Repaš (Hung. Répás) area along the Drava River. In the Temporary National Representation in Belgrade, Švegel represented Trieste and worked within the framework of the Yugoslav Club, headed by the president of the Pan-Slovene People's Party, Anton Korošec. However, Švegel soon parted ways with Korošec and withdrew from active politics for a few years. In the election of 1927, he ran on the ticket of the Croatian Peasant Party in the Gorski Kotar region at the personal proposal of Stjepan Radić and made his way into the Croatian parliamentary representation in the Belgrade assembly. Radić's decision to nominate Švegel as a Slovene candidate in one of the traditionally winnable Croatian constituencies for his party undoubtedly added to the chagrin of Korošec, who had long been at odds with Radić. Much to the surprise of Radić's most intimate circle, at the end of 1927 Švegel joined the rebellious faction of Ljudevit Kežman, a priest and long-standing secretary of the Croatian Peasant Party. Yet rather than hold him to blame, Radić continued to cooperate with Švegel until the fateful shooting incident in the Belgrade assembly on June 20th, 1928. During the assassination against Radić and his colleagues, Švegel, according to his own testimony, was composed enough to help lift Svetozar Pribićević from his bench to safety. In the early period of the royal dictatorship, Švegel maintained a low profile until the spring of 1930, when he joined the government as a minister without portfolio, together with three other dissidents from the former Croatian Peasant Party. After he was soon forced to leave his position in the royal government, he briefly returned to diplomacy in 1931 by being appointed envoy of the Kingdom of Yugoslavia to Buenos Aires. However, no later than 1932, he was forced to leave his office due to disagreements with other officials at the legation and the heads of the foreign ministry and to retire. As his correspondence with Marija Radić reveals, Švegel also remained a faithful adherent to Radić's views after the Second World War.
Pri izpolnjevanju svoje primarne naloge ohranjanja mednarodnega miru in varnosti, ki mu jo nalaga Ustanovna listina Organizacije združenih narodov, Varnostni svet Združenih narodov deluje predvsem v okviru II. in III. stebra odgovornosti zaščititi. Nabor ukrepov, ki jih pri tem uporablja, je kljub temu, da je Varnostni svet edini organ, ki lahko zakonito po VII. poglavju Ustanovne listine odobri izjemo od splošne prepovedi uporabe sile, bistveno širši od gole uporabe sile, ki je bila brez privolitve države doslej odobrena le enkrat, leta 2011 v Libiji. Hipoteza naloge je, da potencial, ki ga odgovornost zaščititi ponuja pri reševanju kompleksnih kriznih situacij, ki lahko vodijo k množičnim grozodejstvom, ni docela izkoriščen zaradi nepopolnega uveljavljanja, ki je predvsem posledica blokade Varnostnega sveta zaradi uporabe veta stalnih članic. Izziv so tudi različne razlage njegovih resolucij, ki so že večkrat privedle do očitkov, da izvajalci resolucij slednje izrabljajo z namenom menjave režima v posameznih državah. Zaradi hudih posledic neaktivnosti z vetom blokiranega Varnostnega sveta, kar se kaže zlasti v primeru Sirije, so se kot alternativne možnosti delovanja mednarodne skupnosti v situacijah, kjer je uporabljiva odgovornost zaščititi, pojavile delovanje preko Generalne skupščine Združenih narodov na podlagi resolucije ˝Združeni za mir˝, regionalnih organizacij (denimo po vzoru Afriške unije) ter intervencija ad hoc koalicij. Ker nobena od navedenih možnosti ne ponuja primerne alternative odločitvi Varnostnega sveta, sta se v okviru odgovornosti neuporabe veta oblikovali dve pobudi za reformo odločanja v Varnostnem svetu, ki predlagata vzdržanje stalnih članic od uporabe veta v primerih štirih grozodejstev, vendar je njuna uspešnost vprašljiva, saj zaenkrat nobena od njiju nima podpore vseh petih stalnih članic. ; Authorized by the Charter of the United Nations, the United Nation Security Council fulfills its primary task of maintaining international peace and security by acting primarily within Pillars II and III of the Responsibility to Protect. Despite the fact, that the Security Council is the only body entitled to legally authorize an exception to the general prohibition of the use of force, this is only one of many measures it can adopt. In fact, the use of force against the will of a state has only been carried out once, in 2011 in Libya. The hypothesis of the present thesis is that the potential that the Responsibility to Protect offers in addressing crisis situations that could lead to mass atrocities is not fully utilized due to a blockage imposed by a veto from a permanent member state. The rising reproaches that those carrying out the resolutions exceed their mandates by changing the regimes in some states also represent a great challenge. This is caused by different interpretations of the language of the resolutions. Due to major consequences of the Security Council's inactiveness, as seen primarily in Syria, some suggestions of alternative actions that could be taken by the international community include acting through the United Nations General Assembly and its ˝Uniting for Peace˝ resolution, regional organizations (following the example of the African Union) and intervention by ad hoc coalitions. Since none of the mentioned possibilities represent a suitable alternative to a decision of the Security Council, two petitions in light of the Responsibility not to Veto have arisen. They suggest the permanent members abstain from the use of veto in the cases of four mass atrocities. Their success, however, is questionable, since neither has so far obtained the support from all five permanent members.
Trgovina z orožjem za marsikatere države in podjetja pomeni velik vir zaslužka. Problem je v tem, ker poleg zakonitega trga z orožjem, obstajata tudi sivi in črni trg. Zato je pomembno, da se vzpostavi celovit in učinkovit nadzor nad trgovino z orožjem. Že od leta 1978 se v resolucijah Generalne skupščine Združenih narodov omenja potreba po pogajanjih glede omejitve mednarodnih prenosov konvencionalnega orožja. Šestintrideset let pozneje je začela veljati prva mednarodna pogodba, ki celovito ureja mednarodno trgovino s konvencionalnim orožjem, Pogodba o trgovini z orožjem (PTO). V procesu nastajanja pogodbe so ves čas sodelovale tudi nevladne organizacije, saj je za vzpostavitev učinkovitega mednarodnopravnega instrumenta pomembno sodelovanje med državami in civilno družbo. PTO je tudi prva mednarodna pogodba, ki ureja prenos osebnega in lahkega orožja. Ravno slednje zaradi svojih lastnosti (enostavno za uporabo, prenosljivost, dolgotrajnost, lahka dostopnost širšemu krogu ljudi) povzroča trpljenje mnogih ljudi. Določbe PTO pa ne posegajo v že urejen sistem pridobivanja orožja, ki velja za športne strelce, lovce in zbiratelje orožja. PTO oboroževanja ne prepoveduje, saj spoštuje pravico vsake države do samoobrambe, temveč le vzpostavlja večjo preglednost nad trgovanjem s konvencionalnim orožjem med državami pogodbenicami. Posebnost PTO je izvajanje po metodi korak po korak, kar omogoča njeno postopno uveljavitev in prilagoditev njenega izvajanja dejanskim razmeram. Učinkovito izvedbo PTO preprečuje nesistematična ureditev kategorij konvencionalnega orožja, streliva in minsko-eksplozivnih sredstev, delov in sestavnih delov orožja, dejavnosti prenosa in neurejenost nadzora nad trgovino s stroji in materiali, ki omogočajo izdelavo orožja in streliva. PTO tudi ne vzpostavlja učinkovitega sistema sankcij za države, ki kršijo pogodbene obveznosti. ; Arms trade has been a large source of profit for various countries and companies. The major problem is that beside legal arms industry there exists grey and black markets. It is thus very important to set up a complete and efficient control of the arms trade. Ever since 1978, The General Assembly of the United Nations in its resolutions has emphasised the need to reach agreements on limiting the international transfer of conventional weapons. Thirty-six years later, the first international treaty that entirely regulates conventional arms trade entered into force. The Arms Trade Treaty (ATT) thus came into effect. Many non-governmental organisations were also engaged in the process of treaty making, since the establishment of the efficient international legal instruments required the cooperative efforts of countries as well as civil societies. The ATT is the first international treaty regulating the transfer of small arms and light weapons. The latter is the one whose features (easy to use, mobility, durability and easy access to a wider public) cause suffering to many people. The rules and regulations of the ATT do not interfere with the already established system of weapon acquisition that is valid for sports marksmen, hunters and weapons collectors. The ATT do not ban armaments, since each country has a legal right to self-defense. Its aim is to establish better transparency over the conventional arms trade among the states parties. The distinctive feature of the ATT is a step-by-step method, and in this way the treaty is gradually enforced and its implementation adapted for actual situations. Nevertheless, the efficient enforcement of the ATT is prevented by the non-systematic regulation of conventional arms, ammunition, munitions, as well as of parts and components of weapons. The arms transfer activities, the non-systematic monitoring of machine and material commerce that enable arms and ammunition production are also the factors that prevent the implementation of the treaty. The ATT do not establish an efficient system of sanctions against states that violate contractual obligations.
POVZETEK MEDNARODNI KAZENSKI PREGON IN ČLOVEKOVE PRAVICE TUJIH TERORISTIČNIH BORCEV Avtor: Rok Petročnik Mentorica: izr. prof. dr. Vasilka Sancin V magistrski nalogi sem raziskoval nastanek fenomena tujega terorističnega borca, njihov mednarodni kazenski pregon in kršitve njihovih temeljnih človekovih pravic v domačih kazenskih pregonih. Varnostni svet OZN je leta 2014 na podlagi VII. poglavja Ustanovne listine OZN sprejel Resolucijo 2178, ki podaja opis tujega terorističnega borca, vendar ne loči med oboroženimi spopadi in terorizmom. Resolucija 2178 opisuje tujega terorističnega borca kot posameznika, ki potuje v tujino z namenom izvedbe ali sodelovanja v terorističnem napadu, medtem ko je tuji borec posameznik, ki odpotuje v tujino z namenom pridružitve oboroženim spopadom. V raziskavi sem prišel do sklepa, da trenutno ne obstaja mednarodni kazenski pregon tujih terorističnih borcev, saj pregon izvajajo države same pred nacionalnimi sodišči. Varnostni svet OZN je pregon tujih terorističnih borcev preložil na države članice OZN, in sicer z vzpostavitvijo različnih odborov za nadzor izvajanja sankcij Varnostnega Sveta, kot so Sankcijski odbor 1267 in Skupina za analitično podporo in nadzor sankcij. V primerih Nada, Ahmed in Abdelrazik so nacionalna sodišča zaradi kršitev temeljnih človekovih pravic s sodbami razveljavila državne upravne akte, ki so vpeljevali sprejete protiteroristične resolucije Varnostnega sveta. Podobno je naredilo sodišče EU v primeru Kadi, kjer je bila razveljavljena uredba, ki je vpeljala sankcije Varnostnega sveta. Sodbe nacionalnih in sodišč v EU so bile glavni dejavnik za spremembo mednarodnopravnega okvirja terorizma OZN in za posledično večji poudarek na spoštovanju temeljnih pravic, ki jih zagotavlja Evropska konvencija o človekovih pravicah. ; ABSTRACT INTERNATIONAL PROSECUTION AND HUMAN RIGHTS OF FOREIGN TERRORIST FIGHTERS Author: Rok Petročnik Mentor: Vasilka Sancin, PhD, Professor In master's thesis i explored the emergence of the foreign terrorist fighter phenomenona, international prosecution of foreign terrorist fighters, and the violation of the fundamental rights of foreign terrorist fighters in domestic prosecutions. UN Security Council in 2014 adopted Resolution 2178 under Chapter VII of the UN Charter. However, while the Resolution outlines the description of a foreign terrorist fighter, it fails to distinguish between armed conflicts and terrorism. Resolution 2178 defines foreign terrorist fighters as individuals who travel to a state other than their states of residence or nationality for the purpose of the perpetration, planning, or preparation of, or participation in, terrorist acts or the providing or receiving of terrorist training, including in connection with armed conflict, while foreign fighter is an individual who travels abroad with intention to join armed conflict. The research led to the conclusion that there is currently no international prosecution of foreign terrorist fighters because states carry it out before national courts. UN Security Council has placed the burden of prosecuting foreign terrorist fighters on UN Member States by establishing different committees monitoring the implementation of the Security Council sanctions, such as the 1267 Committee and the Analytical Support and Sanctions Monitoring Team. In the cases of Nada, Ahmed and Abdelrazik, national courts due to violations of fundamental rights, repealed national administrative acts that introduced the adopted UN Security Council counter terrorism resolutions. The Court of Justice of the EU made a similar decision in the case of Kadi by repealing the regulation introducing the UN Security Council sanctions. Judgements of national and EU courts were the main factor in changing the UN terrorism framework in terms of international law, thus shifting the focus on the respect of fundamental rights as guaranteed by the European Convention on Human Rights.
V magistrskem delu smo raziskali dejavnike poslovnih pogajanj med partnerji iz Slovenije v odnosu s partnerji iz držav razpadle Jugoslavije. Opisani so dejavniki in karakteristike poslovnih pogajanj v splošnem pomenu, kot tudi vpliv dejavnikov kulture, ki se odražajo v sklopu mednarodnih poslovnih odnosov in pogajanj. Kulturna dejstva so temelj, na katerem slonijo poslovni odnosi, kadar se v procesu srečujejo poslovni partnerji iz različnih držav, kar pomeni, da moramo biti pozorni na razlike v komunikacijskem procesu, spoštovanju tuje kulture in njihovih navad, ponekod celo religije. Razlike med našimi in tujimi dejavniki kulture, oz. vsaj poznavanje in spoštovanje le-teh, so ključ za graditev in ohranjanje dolgoročnih poslovnih odnosov. Razlike so pravzaprav prisotne povsod, ne le na globalni ravni poslovanja, najdemo jih že tudi na lokalni ravni, saj so si podjetja, njihove usmeritve in cilji, drugačni. Potrebno se je prilagoditi drugim, če želimo doseči nekaj, kar nam predstavlja korist. Soočanje in osvajanje medkulturnih razlik nam pomaga pri razumevanju medkulturnih dimenzij, pri čemer se je potrebno zavedati, da se bomo tega učili skozi celotno življenje. Kultura je namreč širok spekter pojmov, družbenih norm in vrednot, da bi jih lahko popolnoma prevzeli in se z njimi popolnoma poistovetili. V magistrskem delu so zaradi tega razloga predstavljeni le določeni dejavniki in definicije. Teoretični del ob definicijah in opredelitvah poslovnih pogajanj in mednarodnih pogajanj vsebuje še predstavitev držav nekdanje Jugoslavije, v raziskovalnem delu pa smo povzeli še dejanske izkušnje respondentov poglobljenega intervjuja, ter pridobili pomembne informacije in smernice, ki bodo koristno predstavljene za druge poslovneže, ki že aktivno sodelujejo ali pa imajo namen v prihodnosti sodelovati s poslovnimi partnerji v raziskovani regiji. V sklepnem delu so povzete glavne ugotovitve, in sicer lahko zapišemo, da je za uspešna poslovna pogajanja z državami, ki so nekoč sestavljale mogočno Jugoslavijo, potrebno poznavanje oz. bolje rečeno spoštovanje njihove religije, ki je ponekod zelo izrazita, dejavnik, ki pa zagotavlja pristne in dolgoročne odnose z njimi, pa je faktor človečnosti. Odnosi namreč temeljijo na poznavanju ljudi na osebni in poslovni ravni, ki ju je potrebno usklajeno vzdrževati (tudi v času, kadar nismo v proaktivnem sodelovanju s partnerjem, je potrebno ohranjanje odnosa v obliki osebnega stika in poslovnih daril). Prav tako smo ugotovili tudi, da se način pogajanj iz držav nekdanje Jugoslavije ne razlikuje več močno od evropskega, saj aktivno stremijo evropskim standardom. ; In this work, we examined the factors of business negotiations between partners from Slovenia in relation to partners that came from the stats of former Yugoslavija. The factors and characteristics of business negotiations in the general sense are described, as well as the influence of cultural factors, which are reflected in the framework of international business relations and negotiations. Cultural facts are the foundation upon which business relations are based, when business partners from different countries meet in the process, and that means that we must pay attention to the differences in the communication process, respect for foreign culture and their habits, and sometimes even religion. Differences between our and foreign factors of culture, at least knowing and respecting them, are the key to building and maintaining long-term business relationships. The differences are actually present everywhere, not only at the global level of business, but also at the local level, as companies, their policies and goals are different. It is necessary to adapt to others if we are to achieve something that benefits us. Facing and conquering intercultural differences helps us to understand intercultural dimensions, and we must be aware that we will learn this throughout our lives. Culture is a wide range of concepts, social norms and values, so that they can be completely taken over and fully identified with them. For this reason, in this work only certain factors and definitions are presented. Theoretical part of this work contains the definitions of negotiations and the international negotiations. There is also the presentation of countries that form ex Yugoslavija, while while in the empirical part of this work we summarized the actual experiences of the employees, that have been conducted in the in-depth interview, and obtained important information and guidelines that will be usefully presented to other business people who are already actively involved or have the intention to cooperate with business partners in the research region in the future. The concluding part summarizes the main findings. We can say, that for successful negotiation in the countries of former Yugoslavija, you need to know ther religion and respect it, and that is the factor that will guarantee long term relationships with them. Most of all, they need you to be a person, a good man. Personal relations are more important than making business, relationships are based on knowledge of people on a personal and business level, which need to be maintained in a coordinated manner (even when we are not in proactive cooperation with a partner, it is necessary to maintain a relationship, to contact or to visit them, to bring them gifts). We can also conclude that the way of negotiations in the countries of the former Yugoslavia does not differ much more strongly than the European one, since they actively strive for European standards.
