This essay outlines the role that the national parliaments of federal and regional states can play in the context of the multilevel governance of the EU.The methods of coordination between national parliaments and sub-state territorial bodies areanalysed. They express a bilateral process that moves as much on the European side as on the internal one, potentially giving life to a system that can significantly contribute to the process of European integration, andthat appears to be one of the essential tools to make up, at least partially, to the"democratic disconnect"of the European Union.
Several legal systems use algorithms (even non-deterministic ones) to take administrative decisions although in some of them there are not specific legislative provisions admitting "not-human" decisions. Principles and rules related to administrative procedures have been elaborated having regard to human interactions and decisions while new legal implications arise from automated decision-making processes. Italian constitution and EU primary and secondary law (GDPR) require an ad hoc legal basis to allow a public body to take an algorithmicbased decision. Such a legal basis should also properly safeguard citizens' rights in connection with "not-human" decision-making processes. ; Gli algoritmi, anche di tipo non deterministico, sono già utilizzati nell'assunzione di decisioni amministrative sebbene manchi in alcuni ordinamenti una norma di legge che ammetta espressamente tale possibilità. I principi e le regole che disciplinano il procedimento sono stati costruiti intorno alla decisione "umana", mentre dalla decisione algoritmica derivano questioni giuridiche nuove e del tutto peculiari. I principi costituzionali e il diritto europeo primario e derivato (GDPR) impongono che sia una norma di legge ad ammettere la decisione amministrativa algoritmica prevedendo anche adeguate garanzie per gli interessi dei cittadini dinnanzi alla nuova realtà.
The article highlights the decline of the duty to state reasons both in administrative acts and judicial decisions. Essentially, albeit not exclusively, case law plays a key role in depreciation of the general duty to state reasons for administrative acts. This happens through different manifestations (lack of reasoning, implicit statement of reasons, sufficient or posthumous statement of reasons) and concerns even discretionary administrative acts. Likewise, the duty to state reasons for judicial decisions is going through a process of progressive emptying, both by legislature initiatives and case-law. Even in this case, the phenomenon is general and transversal, covering both administrative courts and civil courts decisions. It has different manifestations, such as simplified statement of reasons or statement of reasons per relationem. The decline of the duty to state reasons leads to a return to the past, when all that matter was the decision. The statement of reasons relates instead to legitimization and rationalization of public power. The lack of the statement of reasons is the essential means of arbitrary exercise of power.

Horden e Purcell bacchettano senza tanti mezzi termini quelli che le considerano dei mondi isolati e dimenticati. Per Matvejevic sono dei 'luoghi particolari' le cui caratteristiche sono fortemente condizionate dalla loro distanza dalla costa. Per Mollat du Jourdin sono soprattutto il frutto di fenomeni sismici. Du Jourdin si sofferma sulle ispirazioni mitiche che le isole hanno da sempre evocato - per l'uomo, nelle sue divagazioni oniriche, l'isola rappresentava un mondo idealizzato, il paradiso perduto, la tanta sospirata Itaca. ; peer-reviewed
The aim of this work is to analyse the most relevant issues related to the topic of the automation of administrative decisions. This phenomenon is, indeed, the result of the process of technological development that has recently begun to affect the traditional way of understanding the organization and the action of the public authorities. In particular, thanks to the spread of increasingly sophisticated computer systems, nowadays public administrations have the opportunity to adopt administrative acts using appropriate algorithms. In fact, although heterogeneous in structure and functions, these tools allow public action to achieve levels of efficiency and speed difficult to achieve through the ordinary conduct of administrative procedures. In the awareness of the significant benefits of this technological change, it is necessary to verify whether and how the use of computer programs by public entities can be considered compatible with the traditional procedural guarantees of administrative law. With the intent to answer this question, this study aims to analyse the phenomenon of automation of decision-making process into four main parts. The first part is dedicated to define the historical and legal framework of the process of digitalization of the public sector. Specifically, after having pointed out the most significant legislative measures adopted in this field in recent years, the work analyzes the main issues related to the implementation of the e-Government model within our legal system. In the light of brief terminological clarifications, the theme of automation is introduced and some interesting cases in which computer systems were used within the public procedures are examined. The second part of the analysis focuses on the issue of the admissibility and of the field of application of algorithmic decisions. Indeed, this topic has already been at the heart of the reflections of the most ancient doctrine, which stated that automation process was allowed only if the exercised administrative power can be considered constrained. However, this approach was overtaken by the more recent literature, which highlighted the opportunity of extending, despite some limitations, the use of automated systems where the public power is discretionary in nature. These are interpretative guidelines which seem to have also influenced the judgements of the administrative jurisprudence, which over time showed a more open attitude towards the use of algorithms in administrative procedures. The third part of the work focuses on the possibility of reconciling the main procedural guarantees provided by the Italian law on administrative procedure with the structural and functional peculiarities that characterize the phenomenon of automation. This analysis is carried out, in particular, by examining whether and in what terms the use of algorithms can be considered compatible with three fundamental principles related to the action of the public authorities: the principle of transparency of administrative decisions; the principle of motivation of administrative acts; the principle of private participation within administrative proceedings. Each topic is analyzed by examining both the evolution of the doctrinal debate and the interpretative solutions proposed in the case law, where for the first time the legal conditions that must guide any attempt to adopt administrative acts using computer software were defined. Finally, the last part of the study deals with the role and the responsibility of the public administrations in the automated decision-making process. Within this session, in particular, it is analyzed how the most relevant doctrinal and jurisprudential positions managed to state the direct accountability of public bodies for the effects deriving from the adoption of automated administrative acts. In the light of the framework carried out, some final considerations are formulated regarding the current needs to regulate the phenomenon within the public sector.
Political-institutional responses to the first wave of Covid-19 were more effective in Italy than in other parts of the world. Not so, at least in part, during the second wave. Precisely for this reason, it is urgent to have a greater awareness of the reasons for the success of the collective action to deal with Covid-19 in the first six months of 2020. The essay aims to analyze the "governance" of the first wave, observing four different circuits that had government action as their center: the government-regions circuit; the government-organized interests circuit: the government-experts circuit; the government-media circuit. Given the exceptional nature of the moment, it was not possible to activate the normal parliamentary debate, where, especially in the work of the committees, both territorial and sectoral interests are represented. However, when parliament is inhibited from acting, someone has to assume the responsibility of the decisions, otherwise the latter would be taken without adequate deliberative scrutiny. Cooperative federalism and neo-corporatism seem to have been the two new patterns of decision-making that emerged from this suspension of the parliamentary life. These patterns, which allowed the government action to succeed in the first wave of Covid-19, could nevertheless constitute a possible solution to the evils of our centralism and regionalism. ; Le risposte politico-istituzionali alla prima ondata del Covid-19 sono state in Italia più efficaci rispetto ad altre parti del mondo. Non così, almeno in parte, nella seconda ondata. Proprio per questo è urgente una maggiore consapevolezza delle ragioni del successo nell'azione collettiva di contrasto al Covid-19 nei primi sei mesi del 2020. Il saggio si propone di analizzare il 'metodo di governo' della prima ondata, osservando quattro diversi circuiti che avevano al loro centro l'azione del governo: il circuito governo-regioni; il circuito governo-interessi organizzati: il circuito governo-esperti; il circuito governo-media. Data l'eccezionalità del momento, non era possibile attivare il normale confronto parlamentare, dove, specie nel lavoro delle commissioni, vengono rappresentanti sia gli interessi territoriali sia gli interessi settoriali. Tuttavia quando il parlamento è inibito ad agire, come in situazioni di 'stato di eccezione', qualcuno deve svolgere questo stesso ruolo pena il rischio di decisioni senza adeguato vaglio delibe-rativo. Federalismo cooperativo e neocorporativismo sembrano essere state le due risposte che hanno consentito il successo dell'azione di governo nella fase della sospensione della vita parlamentare. Queste due modalità di decisione, che hanno caratterizzato la gestione della prima ondata del Covid-19, potreb-bero tuttavia costituire una possibile soluzione ai mali del nostro centralismo e del nostro regionalismo.
The article deals with the problem of the legal nature of the d.P.C.M., the act enacted by the government after the declaration of the health emergency. In particular, the paper aims at investigating the debate around the technical re- quirements in the political decision and the judicial review on the administra- tive measure, in order to verify their compliance with the Constitution.
Progetti a breve termine basati sulle comunità, iniziative temporanee e bottom-up in cui i fruitori generano lo spazio pubblico, si moltiplicano nelle città di tutto il mondo e si affiancano a più tradizionali azioni di pianificazione a lungo termine. L'Urbanistica si trova, inaspettatamente, a prendere in considerazione la forza e la possibilità di soluzioni piccole e lente, domandandosi su come "abilitare" le sperimentazioni dei nuovi city-making integrandole nel tradizionale processo lineare decisionale, stimolando nuove politiche urbane che possano sostenere la creatività dei processi, proporre nuovi modi di decisione e di azione, utilizzando forme di coordinamento e di collaborazione, condivisione di spazi e pratiche di co-progettazione.
The protection of health - an expression included in Article 117, paragraph 3, of the Constitution with Constitutional Law no. 3/2001 - has been regulated in our legal system through provisions that, over time, have flanked elements of legal uniformity with others of differentiation, both modulations that can be found in the original constitutional text and in subsequent constitutional and legislative reforms.The territorial repercussions deriving from this system have fuelled a broad debate on the real capacity of health decentralisation to ensure the principles of solidarity and equality and the financial sustainability of the services - issues that weigh on the responsibility of the regional political institutions and that have been repeatedly intertwined with the proposals for a further devolution of competences to the Regions - but they have also offered the opportunity, in the midst of the pandemic emergency, to test the resilience of the models of health organisation and of the form of regional government, putting the relations between the State and the Regions to the test overall. ; La tutela della salute – espressione inserita nell'art. 117, comma 3, Cost. con la l. cost. n. 3/2001 – è stata disciplinata nel nostro ordinamento attraverso disposizioni che nel tempo, ad elementi di uniformità giuridica, ne hanno affiancato altri di differenziazione, modulazioni entrambe rinvenibili nell'originario dettato costituzionale ed in successive riforme costituzionali e legislative.Le ricadute territoriali derivate da tale impianto hanno alimentato un ampio dibattito sulla reale capacità del decentramento sanitario di assicurare i principî di solidarietà e uguaglianza e la sostenibilità finanziaria dei servizî – temi che gravano sulla responsabilità delle istituzioni politiche regionali e che si sono più volte intrecciati con le proposte di ulteriore devoluzione di competenze alle Regioni – ma hanno anche offerto l'occasione, in piena emergenza pandemica, per testare la tenuta dei modelli di organizzazione sanitaria e della forma di governo regionale, mettendo complessivamente alla prova anche i rapporti tra Stato e Regioni.
La tesi integra, in una singolo quadro concettuale, i metodi di analisi multicriteri spaziale su GIS con tecniche di crowdsourcing di tipo 2.0, al fine di esplorare nuove forme di partecipazione popolare alle decisioni politiche. Il modello rappresenta un sistema di supporto alle decisioni politiche (DSS) volto ad integrare, in modo appropriato, i punti di vista dei cittadini a livello individuale e nelle loro forme di aggregazione associativa. Lo schema concettuale è applicato al confronto tra il tracciato previsto dalla cd. Variante di raccordo Nord-Est di Pisa del 2011 e il tracciato previsto dal vigente Piano Generale del Traffico Urbano di Pisa del 2002, alla luce dei criteri paesaggio, accessibilità e sostenibilità. Il valore aggiunto della ricerca è dato dall'integrazione dell'analisi multicriteri spaziale su GIS con le tecniche di crowdsourcing per la determinazione dei pesi e la raccolta delle informazioni. The thesis integrates, in a single framework, a GIS based methodology for spatial multi-criteria decision analysis (MCDA) and crowdsourcing tools, based on the web 2.0, in a view to explore new forms of public participation in political decision-making. The model represents a decision support system (DSS), based on the opinions of individual citizens and associations. The conceptual framework is applied to the comparison between the Variant to the North-East ring road of Pisa, and the path traced by the current PGTU of Pisa, according to landscape, accessibility and sustainability criteria. The added value of the research is represented by the integration of spatial MCDA and crowdsourcing techniques for the determination of weights and for the collection of information.
L'articolo espone alcuni itinerari attraverso i quali il principio costituzionale della partecipazione, pensato dal Costituente con maggiore attenzione all'attività politica, si è gradualmente esteso anche all'attività amministrativa, a misura che l'evoluzione dell'ordinamento italiano ha tolto centralità alla mediazione partitica e al circuito rappresentativo. L'articolo si sofferma brevemente su alcune forme di partecipazione all'attività amministrativa, evidenziando come non sempre essa dia luogo al pieno dispiegamento del principio democratico. ; The article shows the route through which the constitutional princile of participation, once mainly referred to political activity, has gradually involved the administrative process too, to the extent that the centrality of political parties and representative legitimacy have decreased. The article also shortly considers some types of administrative participation and highlights that they do not always imply a full development of democratic principles.
Nell'articolo si affronta il problema della natura giuridica dei d.P.C.M. adottati dal Governo sin dall'inizio dell'emergenza sanitaria, avendo riguardo anche al ruolo della valutazione tecnico-scientifica come presupposto delle decisioni politiche.In questa prospettiva, si affronta anche la questione del sindacato del giudice amministrativo sugli atti del Governo, per verificarne la idoneità a garantire la c.d. "tenuta del sistema".

Economic processes, consisting of interactions between human beings, exploit the social capital of persons endowed with specific culture and identities. The role of institutions and policy makers is to build positive social capital and exploit it to reach their objectives. However, social capital is elusive and has several dimensions by which to interpret its multifaceted functions in economics and society. We cannot forget, furthermore, that social capital sometimes is undesirable for society, for instance when used for unethical uses. Even so, it is widely accepted that social capital has stable and positive effects.
