Marriage Agreement in Ukraine: Myth or Reality
The article is devoted to the research of the Institute of Marriage Treaties, both in Ukraine and in the countries of Europe and the United States of America. The authors analyzed the main aspects of national legislation on the subject, as well as the historical origins of such a mechanism for regulating marriage and family relations. The article highlights key issues related to the use of the term "marriage contract" itself and the lack of legal definition of it in the law. In addition, the basic provisions of the content of the marriage contract are explored concerning the beginning, term, legal regime of property, termination or dissolution of the marriage, as well as the conditions that may be included in the document according to the current Ukrainian legislation. In the article it is expedient used the basic achievements of a number of scientists, such as D.M. Belov, V.M. Belousov and V.A. Dmitryshyn, I.V. Rimarenko, M.O. Reznikov, T.Y. Selezneva, S. Fursa, L.M. Doroshenko and others. The authors analyzed the historical experience of Ukraine, dating from the 16th century to the present. An important component of this article is to provide statistics on marriage contracts in Ukraine over the past year. The authors also focus on the problems that are hampering the increase in the performance of the above-mentioned documents. Finally, the article highlights and compares the international experience of such countries as Switzerland, Lithuania, France, and the United States. The authors conclude that opinions about the relevance of the subject of marriage contracts, but also their contradictions, which is explained by the Ukrainian mentality, in general, the psychological characteristics of the people, as well as views differing from the Western world about the institution of marriage and family relations.

The article investigates an essential characteristics of the political myth. The authors provide a definition of the phenomenon of political myth, and analyze it in comparison with the phenomenon of political ideology.The works of domestic and foreign scientists are thoroughly analyzed. In particular, the key structural component of the political myth is considered to be a universal historical epic narrative, in the context of which political reality is structured and interpreted (the so-called metanarrative).The authors state that the metanarative of the political myth is utopian by nature. Utopia, which is a narrative of a political myth, is viewed as a projection of the mythical consciousness of the individual and society on the course of the historical process, guided by the desire to "conquer history" and build a post-historic society within the chronotope given by the political myth.It is established that the phenomenon of a political myth has such intrinsic characteristics as metanarrativity, utopianism and syncretism. Prospects for further studies of this problem, in particular the structure and functions of the political myth have been determined. ; Стаття присвячена дослідженню сутнісних характеристик політичного міфу. Автори надають визначення феномену політичного міфу, та аналізують його у порівнянні з феноменом політичної ідеології. Детально проаналізовано роботи вітчизняних та закордонних науковців. Розглядається, зокрема, ключовий структурний компонент політичного міфу – універсальний історичний наратив епічного характеру, у контексті якого структурується та інтерпретується політична дійсність (так званий метанаратив).Автори констатують, що метанаратив політичного міфу має утопічний характер. Утопія, яка складає наратив політичного міфу, розглядається як проекція міфічної свідомості індивіда та суспільства на перебіг історичного процесу, що керується прагненням «перемогти історію» та побудувати постісторичне суспільство у межах заданого політичним міфом хронотопу. Встановлено, що феномену політичного міфу властиві такі сутнісні характеристики, як метанаративність, утопічність та синкретизм. Окреслено перспективи подальших досліджень даної проблематики, зокрема – структури та функцій політичного міфу.

The Specifics of Russian Sophiological Myth ; Специфіка російського софіологічного міфу
The article analyzes the Russian ideological phenomenon of the late 19th – early 20th centuries, notes that the categories 'sobornost', 'the spirit's integrity', and 'all-unity' that were reflected by the Russian thought straightaway, contrasted to all Western philosophy that had become a request for the constitutions of the original Russian philosophy. The unclear relationship of the Russian reflection with theology and its incompatibility with scientific philosophy had conditioned the selection by Russian thought a peripheral theme for both directions, not in the sense of having a theme but in the developing it on the Russian base. Russian originality is concluded in the transformation of the topic of all-unity and understanding it as a sophiology, which we consider in the mode of the author's myth. After all, leading sophiological concepts point out the authors' unavailability to separate myth from philosophical logos. The sophiology begins where the tendency towards the hypostasis of Sofia manifests itself, giving it the status of the creature that is conscious of itself, or the face-hypostasis. The quintessence of V. Solovyov's concept is "Everything is Sofia," P. Florensky's – "All Orthodox and churched are Sofia," S. Bulgakov's – "God is Sofia." However, the common place of all theories is that Sofia acts as a personification of the Cosmos, which is opposed to the Chaos. Consequently, Russian sophiology is a typical authorial (secondary) myth, not a Russian kind of philosophical knowledge, as it is mainly positioned in case studies. The theme of Sophia became a marker of the "Silver Age," when there were sophiological concepts of E. Troubetzkoy, L. Karsavin, S. Franko, O. Losev, O. Blok's sophiography poetry of the Beautiful Stranger. Specific Russian sophiology appeared as a reaction to the political events of a conscious "eschatological" end of the "the Russian World" on the eve of its collapse, against the background of the revolutionary changes in 1917.Article received 07.05.2019 ; У статті здійснено аналіз провідних концепцій російської софіології – трансформації «теорії всеєдності» В. Соловйова. Російський спосіб філософствування постає як несвідоме міфологізування, де в підсумку Софія виступає як персоніфікація Космосу – опозиція вселенському Хаосу, що є загальним місцем усіх зазначених концепцій. Проте опозиційні категорії космосу – хаосу є характерним маркером «священного» міфу. Отже, російська інтелектуальна думка, занурившись у Софію, створила інваріант софіології як топос міфопоетики, що розроблялася у формі авторського (вторинного)міфу. WORLDVIEW STRUCTURES OF THE MODERN IMPERIAL MYTH ; СВІТОГЛЯДНІ СТРУКТУРИ СУЧАСНОГО ІМПЕРСЬКОГО МІФУ
The article examines the imperial myth as a special worldview code structure. Technological imperial and natural national myths (as embodiments at the code level of absolutely opposite worldview structures) are struggling for a world-prevailing. On the example of Ukraine, this ideological conflict can be analyzed as best as possible. The imperial myth is a world-view construct that evolved from the Russian Empire to the Soviet Union, and is now being updated in the Russian Federation. The key imperial mythologem is defined by the «idea of mission», which justifies any acts of authorities and works to expand the space, legitimizes conquests. Topical is the mythologem of the «Third Rome» as the last legitimate state formation in the World. There was a sacralization of undeniable state power in the person of the ruler (mythologemes of the «Tsar» and «False King») and those who are near him. The «mythologem of the Land» (which is considered exclusively as a territory) has been transformed and in this outlook also gave the right to territorial conquests. Russian imperial myth has several important features. His codes are mostly actualized through stereotypes, not through of archetypes (by K.G. Jung). At the code level, the power of the church and state structures is combined, that is more important than nationality. The imperial myth is characterized by deeply rooted in it carnival and game-based beginning (in the sense of virtualization of reality). Association to the imperial myth is carried out through the code system of the Russian language, which became the main factor of self-identification. All spheres of life are clearly regulated, stereotyped, and people are constantly struggling for their place in the formal social hierarchy. The imperial myth is unfavorable to the development of the national and the actualization of natural life-affirming structures. It combats them in every way, reducing the level of creative energy and the value of a developed individual. As a result, national worldview structures are infected with a complex of inferiority. All this can be seen in the historical retrospect of the Ukraine and the Russian Federation and in modern political confrontations. Технологічний імперський і природний національний міфи, як втілення на кодовому рівні абсолютно протилежних світоглядних структур, борються за світоглядну домінанту у сучасному світі. На прикладі України цей світоглядний конфлікт може бути проаналізований якнайкраще. Імперський міф є світоглядною конструкцією, яка за кілька століть еволюціонувала від Російської імперії до Радянського союзу, а нині актуалізована у Російській Федерації. Ключовою імперською міфологемою визначено «ідею місійності», яка виправдовує будь-які вчинки легітимної влади і працює на розширення простору, легітимує завоювання. Актуальною є міфологема «Третього Риму» як останнє легітимне державне утворення у світі. Відбувалася сакралізація незаперечної державної влади в особі правителя (міфологеми «Царя» і «лже-царя») і тих, хто знаходиться поряд із ним. Трансформувалася «міфологема землі», яка розглядається виключно як територія, що у цьому світогляді також дає право на територіальні завоювання. Standards of Evidence in the European Human Rights Court: Myth or Reality
The article explores the activities of the European Court of Human Rights. In recent years, many papers have been published on the issue of defining the "standard of proof" and its implementation in national law. The content of the concept of "standard of proof" is explained in the article. Its nature is revealed. Its features are identified and constituent parts of this concept are provided. Its interdependence with the concept of "inner conviction" is substantiated. Criteria for establishing an 'standard of proof' are provided, such as: - the existence of a body that sets these 'standards'; - fixing certain requirements for the content of a certain "standard" in legislative acts; - compliance with these "standards" by other bodies, etc.; - punishment for failing to comply with the requirements of "standards". The activities of the European Court of Human Rights are analyzed. The basic principles of its activity are noted, which include: General principles: -the principle of the rule of law; - the principle of legality; - the principle of justice; - the principle of proportionality of intervention. Special principles include the following: - the principle of "least common denominator"; - the principle that there are no barriers to the inadmissibility of evidence or a pre-determined formula for evaluating it "; - the principle of proportionality; - the principle of discretion; - the principle of additionality; - the principle of effectiveness of the Convention; - the principle of autonomous understanding. It argues that it is impossible to speak of "standards of proof" in the European Court of Human Rights. Such concepts as "beyond reasonable doubt", "equality of arms", "weighing of opposing interests", "evaluation of the fairness of the process as a whole" the author reveals through the case law of the ECtHR, namely " Abu Zubaydah v. ON THE QUESTION OF MODERN MYTHS. POLITICAL MYTH AS APPLIED MYTHOLOGY ; К ВОПРОСУ О СОВРЕМЕННЫХ МИФАХ. "ПОЛИТИЧЕСКИЙ МИФ" КАК ПРИКЛАДНАЯ МИФОЛОГИЯ ; ДО ПИТАННЯ ПРО СУЧАСНІ МІФИ. ПОЛІТИЧНИЙ МІФ ЯК ПРИКЛАДНА МІФОЛОГІЯ
In this article, the author argues that philosophy is a "methodology" of understanding. Hermeneutics is the theory and methodology of interpretation especially the interpretation philosophical texts. H.-G. Gadamer asserted that methodical contemplation is opposite to experience and reflection. We can reach the truth only by understanding or mastering our experience. According to H.-G. Gadamer, our understanding is not fixed but rather is changing and always indicating new perspectives. The most important thing is to unfold the nature of individual understanding. Hermeneutics is not just "art", but the methodology of "understanding." Accordingly, philosophy is the methodology of understanding and interpretation. Philosophy is a science with its own subject and object. Legal laws are not absolute, therefore they should be interpreted. It is the task of philosophy. Philosophy speaks the language of concepts and evidence. Concepts should be specific, clear, defined. Philosophical work is the formulation of concepts. On the basis of such understanding of philosophy, we will now study the question of "political myth".Scientific exploration is devoted to the study of the concept of "myth" and identifying the essential features of the "political myth". What is "political myth" of modernity? What language is he speaking? What appealed? In this intelligence proved that "political myth" is a communication system that distorts reality. It is established that every "political myth" has its own shelf life and the boundaries of its interpretation. It is confirmed that "political myth" is one of the most effective tools to meet political goals, such as achievement of power and its legitimation. It is proved that political discourse is irrational, and political speeches appeal to the argument of sensuous, not rational. "Political myth" models own "world picture", which is a simplified, taken for granted, self-evident. It is proved that the ability of critical judgment, ability to work with information and qualitative analysis from the mouth of the unbiased media and the expert environment, though not a panacea, but partially negate the "force," "political myth". Myth has an irrational basis, and controls the emotions with the help of stereotypes. The myth creates its own reality and creates the effect of solidarity of the masses. The essence of "political myth" is that he always addressed to specific audiences, takes into account the peculiarities of mentality. A dominant position in the "political myth" plays a stereotype. Any stereotype is formed on the generalizations. What is the difference between the stereotypes and myths? "A stereotype is a label", which is the context, but it there is no story. That is, the stereotype is a form, and the myth is content history. In addition, in this exploration of the role and value of such concepts as "political magic" and "political spectacle" in the context of "political mythology" as applied mythology. ; Посвящено исследованию понятия "мифа" и выявлению сущностных признаков понятия "политического мифа", осмыслению вопроса, чем является "политический миф" сегодня, на каком языке он говорит, к чему апеллирует. В рамках данного исследования доказано, что "политический миф" является коммуникативной системой, которая деформирует реальность. Установлено, что каждый "политический миф" имеет свой срок годности и пределы своей интерпретации. Подтверждено, что "политический миф" является одним из самых эффективных инструментов для реализации таких политических целей, как достижение власти и её легитимация. Благодаря исследованию специфических признаков "политического мифа" удалось установить, что политический дискурс является иррациональным, а политические речи апеллируют к аргументу чувственного, а не рационального начала. "Политический миф" моделирует свою "картину мира", которая является упрощенной и самоочевидной. Обосновано, что способность критического суждения, умение работать с информацией и качественная аналитика, работа незаангажированных СМИ и экспертной среды, хотя и не является панацеей, но все же частично нивелируют "силу" влияния "политического мифа". Особое внимание в данном исследовании посвящено таким понятиям, как "политическая магия" и "политический спектакль" в контексте "политической мифологии" как прикладной мифологии. ; Присвячено дослідженню поняття "міфу" та виявленню сутнісних ознак "політичного міфу", з'ясуванню та проясненню питання, чим є "політичний міф" сьогодення, якою мовою він говорить, до чого апелює. Доведено, що "політичний міф" є комунікативною системою, яка деформує реальність. Встановлено, що кожен "політичний міф" має свій строк придатності і межі своєї інтерпретації. Підтверджено, що "політичний міф" є одним із найефективніших інструментів для задоволення таких політичних цілей, як досягнення влади та її легітимація. Завдяки дослідженню специфічних ознак "політичного міфу" вдалося виявити, що політичний дискурс є ірраціональним, а політичні промови апелюють до аргументу чуттєвого, а не раціонального. "Політичний міф" моделює свою "картину світу", яка є спрощеною, самозрозумілою, самоочевидною. Обґрунтовано, що здатність критичного судження, уміння працювати з інформацією та якісна аналітика з вуст незаангажованих ЗМІ та експертного середовища, хоч і не є панацеєю, але все ж таки частково нівелює "силу" "політичного міфу". Окрім цього, виявлено роль і значення таких понять, як "політична магія" та "політичний спектакль" у контексті "політичної міфології" як прикладної міфології.

How the ustasha regime exploited prejudices and stereotypes about jews in creating the myth about enemy
In examining the role of political myths in the Independent state of Croatia (NDH) propaganda, I will explore one political myth that aroused from pre-existing images and stereotypes about Jews in Croat lands that lie at the heart of NDH propaganda: The Myth about the Enemy. That myth was instrumental in providing "moral" justification for genocide and military violence against Jews throughout NDH history and is important for understanding how propaganda was successful in the recruitment of soldiers in the Ustasha movement, as well as for understanding war and genocidal rhetoric. I will discuss how official-level rhetoric has tailored that myth in order to provide significance for political circumstances and legitimize mass violence against Jews.

The Origin and Functioning of Myth: Linguistic Conditions ; Зародження та функціонування міфу: лінгвістичні умови
The article identifies two approaches to determining the linguistic conditions of the emergence and functioning of the myth. The first approach assumes that the myth is a manifestation of unconscious (M. Müller) or conscious (E. Cassirer, R. Barthes) distortion of language. Within this approach it is impossible to escape from myth because the presentation of the facts of the world in language is inescapable, which is always imperfect. These distortions are meant for political influence, as according to the proponents of the conscious mythologizing of language. Philosophy is tasked with resisting such distortions and, consequently, myth creation in general. This approach seems simplified, because the myth is identified here with the linguistic form of its distribution, reduced to the analysis of distortions of language presentation. At the same time, the psychological and epistemological preconditions of the myth, its unique status in the life of communities are lost. Conditions for the development of the second approach arise through the critique of classical rationality by several influential thinkers who undermined the belief in the exclusive ability of discursive language to present the truth (F. Nietzsche, L. Wittgenstein, M. Heidegger). The second approach assumes that the myth emerges and continues to exist due to the inability of the logos to present some important aspects of reality, especially its existential dimension (P. Tillich, H. Blumenberg, L. Hatab, K. Morgan). In this case, myth and logos become alternative and at the same time closely connected linguistic ways of presenting the truth. Logos (the language of science) presents primarily abstract causal connections of essences. At the same time, mythical narratives are better than science at presenting the mysteries of origin and existence, creating a hierarchy of values for communities. ; У статті виокремлено два підходи до визначення лінгвістичних умов появи і функціонування міфу. За першого підходу припускають, що міф є проявом несвідомого (М. Мюллер) або свідомого (Е. Кассирер, Р. Барт) викривлення мови. Міф є неусувним, адже неусувною є мовна презентація фактів світу, яка не буває досконалою. На думку прихильників свідомої міфологізації мови, ці викривлення здійснюються задля політичного впливу. На філософію покладається завдання протистояти такому викривленню, а отже, і міфотворчості загалом. Цей підхід видається спрощеним, оскільки міф тут ототожнюється з лінгвістичною формою його поширення, редукується до аналізу спотворень мовної презентації. При цьому втрачаються психологічні і гносеологічні передумови міфу, його унікальний статус у житті спільнот. Умови для розроблення другого підходу виникають через критику класичної раціональності низкою впливових мислителів, що підважили віру в ексклюзивну здатність дискурсивної мови презентувати істину (Ф. Ніцше, Л. Вітґенштайн, М. Гайдеґґер). Згідно з другим підходом, міф зароджується і продовжує існування через неспроможність логосу презентувати деякі важливі аспекти реальності, передовсім її екзистенційний вимір (П. Тілліх, Г. Блюменберґ, Л. Гатаб, К. Морґан). В такому разі міф і логос стають альтернативними та водночас тісно пов'язаними лінгвістичними способами презентувати істину. Логос (мова науки) презентує передовсім абстрактні каузальні зв'язки сутностей. Водночас міфічні оповіді краще за науку здатні презентувати таємниці походження і існування, створювати ціннісну ієрархію для спільнот.

The myth of the "Christian city" in early childhood the Reformation movement in Germany (1517-1525)
The article analyzes the Reformation project "Christian city Wittenberg" in the works of the famous reformer Andreas Karlstadt. Unlike previous researchers, the author considers it in the context of the mythologizing of various social forces and institutions that claimed to make the Reformation. The myth of the "Christian city" is formed in opposition to other mythologized communities and individuals - "Christian ruler", "Christian nobility", "Christian duke". The Reformation project of the "Christian city" arose in search of forces capable and ready to carry out the Reformation program formulated by Luther and his associates. In the first years of the Reformation, the myths of the "Christian duke" (reformer) and the "Christian nobility" came to the fore in socio-political thought. The Worms Reichstag of 1521 showed the inability of the political elite and the "Christian nobility", led by the emperor, to consolidate their efforts and to renew the Papal Church. The hopes of the Wittenberg reformers that the "Christian duke" (Prince-elector Friedrich of Saxony the Wise) would carry out the reforms proved futile. Luther's patron pursued a careful ecclesiastical policy and was in no hurry to transform. The idea of a "Christian city" arose spontaneously during the mass riots in Wittenberg in early 1522. After the first transformations took place here, one of the leaders of the Reformation movement, Andreas Karlstadt, promoted Wittenberg as a model of a true "Christian city." After Wittenberg and other cities proved unable to carry out their reform mission, Karlstadt, together with the radical reformers, continued to give the leading role to another community, the "common people," which was based on the peasantry. The identifier of such community is the "common man", who in the mass consciousness acquires the characteristics of a mythical hero. Статья посвящена выявлению просчетов, которые были допущены технологами этого манипулятивного воздействия.Выявлено, что ошибки сводятся к неквалифицированному подходу при формировании образа ключевой персоны мифологии, неучитыванию очевидных черт украинского менталитета, а также более мелким, техническим просчетам. ; The author continues the philosophical study of manipulative influence on the mass consciousness, which is the basic component of the aggression of the Russian Federation against Ukraine.The article is devoted to the identification of miscalculations that have been admitted by technologists of this manipulative effect.It was revealed that the mistakes amount to unqualified approach in forming the image of the key person of mythology. It was established that classics of cultural studies, religious studies and philosophy studied in detail the stages of formation of the person of a cultural hero in the epic of different peoples. These stages, in general similar, are traced to all ethnic groups and provide a compulsory and invariable algorithm for transforming an ordinary person and turning it into a Hero.Also, the classics of science insist that mythology is the basis of any cultural activity of a modern human being - it is its background. In addition, they point to the danger of unskilled myth-making.The author of the article has established that Russian technologies of manipulation by consciousness have neglected all the advice of scientists and ignored the basic stages of the formation of the Hero in political myth-making.Therefore, the author of the article makes a number of conclusions about the possible imminent collapse of the negativism of the people of Russia in relation to its unsuccessfully mythologized President - with all the resulting political consequences.Also, the article reveals other miscalculations of manipulators, which concern mistaken assessments of the Ukrainian mentality and technical miscalculations.
