Çalışmada millet iradesinin yasal meşruiyetin temelini teşkil edip edemeyeceği sorunu ele alınmaktadır. Çoğunluğun iradesinden doğan yasaların meşru olup olmayacağı, şayet bu soruya verilecek cevap olumsuz ise meşruiyetin temelini neyin teşkil edeceği hususları millet ve irade kavramlarının tarihi analizinden yola çıkılarak değerlendirilmiştir. Millet iradesi düşüncesi, Rousseau'nun genel irade kavramının içeriği ile günümüzde de cari olduğundan özellikle Rousseau'nun genel iradesinden doğan milli irade mefhumu ele alınmıştır. ; This question of whether the general will can form the basis of legitimacy was discussed in this thesis. "Can we say that a law made by the will of the majority is directly legitimate? If our answer is negative, where should we look for legitimacy?" We are looking for answer to these questions. In this context, we use Rousseau's concept of general will. This idea is still valid in contemporary political athmosphere. Because of that we'll critisize Rousseau's general will idea and modern concept of nation.

Özet: Soğuk Savaş dönemi sonrası değişen küresel ve bölge- sel konjonktür ile son dönemde keşfedilen hidrokarbon kaynakları Doğu Akdeniz bölgesinin önemini artırmıştır. Bölgede yaşanmakta olan gelişmeler Akdeniz havzasındaki enerji tablosunu olduğu gibi bölgesel dinamikleri de önemli ölçüde değiştirecek niteliktedir. Di- ğer taraftan, Kıbrıs Uyuşmazlığının denizlere yayılmasının bir sonu- cu olan bölgedeki hidrokarbon kaynaklarının paylaşılması sorunu sahildar ülkeler arasında işbirliği ihtiyacını ortaya çıkarmıştır. Bu da son dönemde bölgede yalnızlaşan Türkiye'nin bölgeye ilişkin mevcut politikasını gözden geçirmesini gündeme getirmektedir. Bu çerçe- vede, Türkiye'nin sahildar ülkelerle kuracağı iyi ilişkiler ile bölgede tekrar başat duruma gelmesi, hem Doğu Akdeniz'de hidrokarbon kaynaklarının adil paylaşımını temin edecek deniz alanlarının sınır- landırılmasına yönelik bir anlaşmanın yapılabilmesini hem de diğer sorunların ulusal çıkarlarımıza uygun çözülmesini temin edecektir. Bu kapsamda Doğu Akdeniz'de sahildar devletler arasında kıta sa- hanlığı ve münhasır ekonomik bölge alanlarının sınırlandırması, 'hak- kaniyete uygun çözüme' ulaşmak maksadıyla uluslararası hukuka uygun olarak ve bütün 'ilgili durumlar' dikkate alınarak 'anlaşma' ile yapılacaktır. ; Abstract: The global and regional political atmosphere that changed after the Cold War, together with the recently discovered hydrocarbon resources, have increased the importance of the Eas- tern Mediterranean. Developments taking place in the region are of a significance that can change the energy picture in the Mediterra- nean basin as well as regional dynamics. Furthermore, the problem of sharing the hydrocarbon resources, which has resulted from the extension of the Cyprus dispute to the sea, has revealed the need for cooperation among the littoral states. Therefore, this raises the need for Turkey to review its current policy in the region which at the moment has caused Turkey to be isolated in the region. In this context, Turkey's dominant position for establishing good relations with the littoral states can facilitate the conclusion of an agreement relating to maritime delimitation which will ensure equitable sharing of hydrocarbon resources in the Eastern Mediterranean as well as provide solutions for the other issues in accordance with Turkey's national interests. In this context the delimitation of the continental shelf and exclusive economic zone between litoral states in Estern Mediteranean shall be effected by 'agreement' on the basis of inter- national law and taking account of all the relevant circumstances in order to achieve an 'equitable solution.

Çağın getirdiği yeni ve sınır aşan suçlarla mücadele sürecinde 1999 yılında faaliyete geçen Avrupa Birliği Kolluk Kuvvetleri İşbirliği Ajansı (Europol), Avrupa Birliği'nin (AB) karşılaştığı terörizm, uluslararası uyuşturucu kaçakçılığı, euro sahteciliği, kara para aklama, insan kaçakçılığı gibi suçlar ve siber suçlarla mücadele eden AB'nin polis teşkilatıdır. Europol-Türkiye ilişkilerine bakıldığında ise, Europol ile Türkiye arasında stratejik ortaklık anlaşması olduğu görülmektedir. AB üyesi olan devletlerin doğal üyesi oldukları Europol ile Türkiye arasında stratejik ve teknik seviyede işbirliği yapmasına olanak veren anlaşma "Türkiye Cumhuriyeti ve Avrupa Polis Teşkilatı Arasında İş Birliğine İlişkin Anlaşma" adıyla yapılmıştır. Bu alandaki çalışmalar, Emniyet Genel Müdürlüğü bünyesinde bulunan INTERPOL-Europol Dairesi Başkanlığı tarafından takip edilmektedir. Europol ile Türkiye arasında işbirliği anlaşması, Avrupa Konseyi Sözleşmesi standartlarında yer alan Türkiye'de kişisel verilerin korumasına ilişkin bir kanun olmadığı için stratejik ortak düzeyinde devam etmektedir. Türkiye Büyük Millet Meclisi, 24 Mart 2016'da 6698 sayılı Kişisel Verilerin Korunması Kanunu'nu kabul etmiştir. Bu gelişme ile eş zamanlı olarak Türkiye, Europol ile operasyonel iş birliği anlaşması yapmak için bazı girişimlerde bulunmuştur. Türkiye halen Europol'ün operasyonel ortağı olabilmeye yönelik çalışmalarını devam ettirmektedir. Çalışmada, öncelikle Europol'ün tarihsel arka planı aktarılmış, sonraki bölümde Europol'ün faaliyetleri ele alınmıştır. Son bölümde ise, Europol-Türkiye ilişkileri incelenmiştir. Sonuç olarak çalışmada Europol-Türkiye ilişkilerinde kurumsal ve hukuksal eksiklikler öne çıkarılmıştır. Böylece, kurumsal anlamda ilgili kurumların daha aktif olması, hukuksal anlamda ise ilgili düzenlemelerin yürürlüğe girmesinden bahsedilmiştir. ; European Union Agency for Law Enforcement Cooperation (Europol), which come into operation in 1999 in the process of struggling against new and transboundary crimes brought by the age, it is the EU's police organization that fights against terrorism, international drug trafficking, euro counterfeiting, money laundering, human trafficking and cyber crimes faced by the European Union (EU). When examing the Europol-Turkey relations, it is seen that there is an agreement on strategic cooperation between Europol and Turkey. Between Turkey and Europol, of which EU member states are natural members, an agreement that enables cooperation at a strategic and technical level has been made by the name of "Between the Republic of Turkey and the European Police Organization Agreement on Cooperation ". Actions in this field are followed by the INTERPOL-Europol Department within General Directorate of Police. The agreement between Europol and Turkey continues to be a strategic cooperation level because of the absence of a law in Turkey on the protection of personal data in the standards of The Council of Europe Convention. Turkish Grand National Assembly passed the Personal Data Protection Law No. 6698 on March 24, 2016. Concurrent with this progress, Turkey has attempted to make operational cooperation agreement with Europol. Yet, Turkey is sustaining its efforts to become Europol's operational partner. In the study, first of all, the historical background of Europol was explained, and in the next section Europol's activities were discussed and in the next section. In the last part, Europol-Turkey relationships were examined. As a result, institutional and legal shortcomings in the Europol-Turkey relations are highlighted in the study. Therefore, it was mentioned that the relevant institutions should be more active in the institutional sense and the related regulations should be entered into force in the legal sense.

Milli Görüş Hareketi, Türk Siyasi Hayatı içerisinde son 50 yıllına sosyal, siyasal, fikirsel ve dış politika açısından farklılıklar getirmiş bir siyasi harekettir. 1969 yılında Bağımsızlık Hareketiyle başlayan daha sonra Milli Görüş adını alarak mücadelesini vermiştir. 1970 yıllın da günümüze kadar Partileşme sürecine girmiş siyasi hayatı boyunca beş siyasi partisi "laikliğe aykırı" sebepler dolayısı ile dört partisi kapatılmıştır. Partileşme süreçleri boyunca kurmuş oldukları teşkilat yapısı ve temel esasları ile siyasete içerisinde çeşitli kavram ve söylemler ile yenilikler ortaya atmıştır. Teşkilat modeli ve beli kuraları temel esaslar üzerinden belirleyerek varoluş şekli ve mücadele sebeplerini hem İslami hem de ülke şartlarına göre olması. Teşkilat mensuplarının siyaset yapma amaçlarını öğretmesi, eylem, söylem ve fikir birliği için çalışması siyaset içerisindeki kendi has yapısını göstermektedir. Mücadelesini yaratılış, manevi ve yasal açıdan açıklaması ile varoluş sebebini tarif etmiştir. Siyasi hayata getirmiş olduğu Önce Ahlak ve Maneviyat söylemi ile yeni bir eğitim (maarif) model ortaya çıkmış, ekonomik açıdan ortaya atmış olduğu Adil Ekonomik düzen ve Ağır Sanayi söylemi ile kendine özgü bir ekonomik model ortaya atmıştır. Avrupa Ekonomik Ortak Pazarı günümüzdeki adıyla Avrupa Birliği karşıtı olması ve onun karşısına İslam Birliği söylemi hatırlatması ile D-8 aktif hale getirmesi ile kendine özgü dış politika hamlesi belirlemesi. Sonuç olarak Milli görüş hareketi TSH içinde eli yılık mücadelesi boyunca kendine çalışma metodu olarak belirlediği Temel Esasları ve Söylemleri nasıl oluştuğunu ve devam ettiğini üzerinde durulmuştur. ; The National Vision Movement is a political movement that has brought social, political, and intellectual and foreign policy differences to the last 50 years in Turkish Political Life. The movement, which started with the name of Independence Movement in 1969, continued struggle with the name the National Vision later. Since 1970 up to the present, the national movement, which has been on way to becoming a political party, had been closed for four times during its political life, it has been claiming that its political party was contrary to secularism. Throughout the process of becoming a political party, they have introduced various concepts and discourses and innovations within their organizational structure and basic principles. The fact that the national vision movement determined its organizational model and certain rules based on the basic principles that are both Islamic and suitable to the country conjecture shows its unique structure. Its discourse of which the priority is morality and morale revealed a new educational model. It has created a unique economic model with its economic outlook; "Fair Economic Order" and "Heavy Industry". Its foreign policy formed D-8 Union as an alternative to the European Economic Common Market and it is the anti-European Union. In terms of law regulations, 'Fair Legal System' has been formed by 'Fair Order' based on Justice, Honesty and Human Rights through a multi-legal system. As a result, the National Vision Movement in Turkish political life has focused on how the Fundamental Principles and Discourses, which were determined as a method of self-study during the fifty-year struggle, were formed and continued.

Necmettin Erbakan, supported in Turkey by those who considered themselves as more conservative and religious, had the opportunity to serve the people of Turkey in the capacity of Deputy Prime Minister before 1980. Erbakan's new discourse had won him the favor of the public; however, in the wake of the 1980 military coup, his party was closed down and he, along with most of his close colleagues, was banned from politics. After his party, which was a party with a cause rather than an ordinary one, was closed down, he tried to keep his sympathizers united and active by developing various arguments in order to preserve his electorate in the newly developing conditions. In conjunction with the transition from martial law to democracy, the National Vision Movement continued its course in the political arena with the Welfare Party. Necmettin Erbakan cultivated a new discourse in politics with the motto of "Fair Order" by successfully analyzing the economic developments in the world after 1980. His promise to make Turkey a strong and prominent country, his ideals of Islamic unity, his discourse of nationalism, anti-imperialism and anti-Zionism were accepted by the public. Additionally, his more comprehensive and Pan-Islamist stance compared to the religious jamaats and sects, and the fact that he undertook to be the voice of the people who suffered in the slums following rural-to-urban migration, strengthened the movement. The Motherland Party, founded by Turgut Ozal, who had been the National Salvation Party's Izmir candidate for the parliament before 1980, faced some difficulties while coming into power after 1980, following the military administration. Erbakan surpassed those difficulties, acquired a position in the government as the prime minister of the coalition in 1996 and served the nation. This study explores the establishment and structuring of the Welfare Party, a continuation of the National Vision Movement, in Giresun, as well as the process of its coming to power and later being removed from it. The first elections the Welfare Party took part in were the local elections of 1984, and although the votes it received were below the country average that year, the party increased its vote rates in all subsequent elections and received more votes than the Turkey average in Giresun. The reasons behind this success are that women, who had not been active in politics before 1980, began to participate more, the media was used more effectively, and Giresun was not affected by the conflict between religious sects and politics. This study will examine the efforts of the National Youth Foundation, established as the youth organization of the movement, and other non-governmental organizations during and after the February 28, 1997 post-modern coup process in the context of Giresun.
Avrupa Birliği (AB) 2004 yılından bu yana Orta ve Doğu Avrupa ülkelerinin büyük çoğunluğunu resmi olarak birliğe kabul etti ve Batı Balkanlarda geriye kalan üye olmayan ülkeler AB'nin yeni hedefi haline geldi. Ancak, Birlik AB politik üyelik koşulları yoluyla kurallarını Orta ve Doğu Avrupa ülkelerine kıyasla Batı Balkanlardaki diğer üye olmayan ülkelere aktarırken birtakım zorluklarla karşılaşmıştır. Burada akla iki soru gelmektedir: Birinci soru, "Hangi şartlar altında bu koşullar etkili olabilir?" iken; ikinci soru, "AB üyelik koşulları neden Batı Balkanlarda bulunan ülkelerin iç politikasında kısmen sınırlı bir rol oynar?" şeklindedir. Bu meseleyi açığa kavuşturmak için Schimmelfennig ve Sedelmeier (2004) tarafından "dış teşvik modeli" benimsenmiştir. Bu çalışma "dış teşvik modelinin" bu soruları tam anlamıyla cevaplandıramadığını ve ulusal kimliğin Batı Balkan devletleri olan Hırvatistan ve Sırbistan'da AB üyelik koşullarının etkililiğini belirleme noktasında önemli bir role sahip olduğunu ileri sürmektedir. Çalışmanın Hırvatistan ve Sırbistan'ı durum çalışmaları olarak ele almasının sebepleri; bu iki ülkenin eski Yugoslav Sosyalist Federal Cumhuriyeti olmaları ve 1990'lı yıllarda ortak bir savaş tarihi paylaşmalarıdır. Belirtilen bu ortak özelliklere rağmen bu iki ülkenin Birliğe olan üyelik sürecine ilişkin tutumlarının birbirinden farklılık arz ettiği dikkat çekmiştir (Massari, 2010). Hırvatistan AB üyeliğini hâlihazırda 2013 yılında elde etmiş olmasına rağmen, Sırbistan'ın bu üyeliği gerçekleştirme noktasında kat etmesi gereken daha çok yol vardır ; The European Union (EU) has formally initiated the vast majority of the Central and Eastern European Countries (CEECS) into the Union and Western Balkans' remaining non-EU countries have became the new target of EU enlargement since 2004. The Union, however, has faced some difficulties in transferring its rules to non-member countries in Western Balkans by means of the EU political accession conditionality in comparison to Central and Eastern European Countries. Here are two questions to mind: 'Under what circumstances could the conditionality be effective?' and 'why does the EU conditionality play relatively limited role in the domestic politics of the Western Balkan states?' An "external incentive model" is adopted by Schimmelfennig and Sedelmeier (2004) to articulate the issue. This study addresses this contestation, arguing that the "external incentive model" is incapable of fully answering these questions and that national identity has a huge impact on the determination of the effectiveness of EU accession conditionality by focusing on the problems limiting this effectiveness in two Balkan states, namely Croatia and Serbia. The reasons why the paper has chosen Croatia and Serbia as case studies are that they are republics of former Yugoslavia and that they have shared war history in the 1990s, however act differently on the way to the European Union (Massari, 2010). Although Croatia has become a member of the Union, Serbia still has got a long way to go The European Union has utilised political conditionality as one of the most significant strategies to export its governance and to encourage non-member countries to obey the rules of the EU (Schimmelfennig and Sedelmeier, 2004). Political conditions, which are necessitated by the Union from the very beginning, can be described as a competitive party system, and free and fair elections. As for the essential political conditions of EU accession that the EU confirmed in 1993, which are also defined as the Copenhagen Criteria, they are the stability of democratic institutions, rule of law, liberal market economy, human rights and lastly the protection of minority rights (Bieber, 2013:2). The required political conditions are flexible. By which it means that some specific requirements could be added to the conditions. For instance, the UE required cooperation with the International Criminal Tribunal for the former Yugoslavia (ICTY) in the context of Western Balkans (Frerburh and Richter, 2010:269-71). Predominant studies select "external incentive model" to articulate the logic of EU conditionality and political conditions. This model is based on a rationalist cost-benefit calculation that assumes that states are regarded as rational actors, seeking to boost their interests (Schimmelfennig and Sedelmeier, 2004). The tool of conditionality is perhaps the most significant instrument that the EU external governance applies to force would-be member states to obey the rules of the EU. That is, the Union decides its instructions as conditions and would-be member states are expected or required to accept these conditions to receive rewards. Consequently, the target government would face three various pressures namely from the Union, domestic and international politics in return for EU external incentives (Trauner, 2011:8). It is therefore the credibility of the EU conditionality plays a key role in evaluating the pros and cons of EU rewards as opposed to domestic compliance (Schimmelfennig and Sedelmeier, 2004:663-7). This model is, however, unsuccessful in fully articulating why the EU political conditionality could perform better in states like Croatia than in states like Serbia in the context of Western Balkan despite the fact that the Union has provided these countries with rewards. At this point, national identity, as a constructivist variable, has a huge impact on the determination of the effectiveness of EU accession conditionality by focusing on the problems limiting this effectiveness in two Balkan states, namely Croatia and Serbia. National identity is the main theme that determines whether conditionality can be effective or not. Constructivists argue that wouldbe member states would acknowledge the influence of the Union by means of socialisation and persuasion processes. It is these processes internalizing identities with the help of domestic actors (Trauner, 2011). Considering the rules of the EU appropriate and compatible with political conditionality helps domestic actors to stick to given EU rules (Schimmelfennig et al., 2006:27-52). In this sense, national identity, as a filter actor, influences EU conditionality. It is, therefore, crucial to note that states, as social actors, often shape and reshape national identity when they face or interact with different social structures. The EU political conditionality has raised doubts about its effectiveness in the countries in question. This is because they had ethnic conflicts in 1990s that shaped their national identities. It is this historic background affecting the effectiveness of EU political conditionality in Croatia and Serbia in different lights. As a result, the European Union (EU) has formally initiated the vast majority of the Central and Eastern European Countries (CEECS) into the Union and Western Balkans' remaining non-EU countries have become the new target of EU enlargement since 2004. Although Croatia has become a member of the Union, Serbia still has got a long way to go.Cooperation with the ICTY has been very sensitive issue in both Croatia and Serbia where these countries had to comply with it as a result of being tied to EU accession. The way in which the transformation of the EU rules, however, quite varied from one another. Croatian elites saw the cooperation with ICTY as indispensable part of EU accession and in line with Croatian respect of European organizations. Croatia met EU requirements. This is simply because the country was one of the European countries in which the rule of law is respected and obeyed. As far as Serbia is concerned, the cooperation with the ICTY was ensured by Serbian elites who felt forced and oppressed to do so. But they rejected the Hague tribunal. Even though they rejected it, a sense of obligation arising from the fear of being punished by the international community through the cancellation or postpone of EU talks took place regarding detaining suspects. This problematic issue resulted in different images of the EU in the eyes of these two countries. Serbia regards the European Union as a punisher and a superior force that inclined to in Serbia. This could be one of the reasons why there is distance between Belgrade and Brussels. As for Croatia, the image of Europe in the eyes of Croatian people is related to high democratic standards, liberty and civilization (Subotic, 2011:326-7). This could be one of the reasons why there is close cooperation between Croatia and the European Union. The rational incentive model is important for explaining the choice of would-be member states. It is crucial to clarify that this model is valid once the rules of the European Union are compatible with national identity of the would-be member states. Once the national identity of the target state is incompatible with the rules of the EU, it is fair to say that any material condition does not serve a very useful purpose. Politikaya Serbest Cumhuriyet Fırkası ile başlayan ve Cumhuriyet Halk Partisi ile devam eden Etem Menderes, 1950 seçimlerinde Demokrat Parti Aydın Milletvekili olarak meclise girmiştir. 10 yıl boyunca devam eden milletvekilliği sürecinde çeşitli bakanlıklarda bulunmuştur. Bunlardan biri de içişleri bakanlığı olup bu vazifeye iki kez getirilmiştir. Etem Menderes'in ilk dönem içişleri bakanlığı oldukça yoğun geçmiştir. Bu dönemin faaliyetleri arasında doğu seyahati, vilayetlerin yeniden yapılandırılması, Nüfus Kanunu, yol, su ve elektrik gibi alt yapı çalışmaları, ülke asayişi ve Tevhid-i Zabıta Kanunu ön plana çıkmaktadır. Bununla birlikte yerel yönetimlerde demokratik düzenin zemin bulması için gayret gösterilmiştir. Etem Menderes'in ikinci dönem içişleri bakanlığı sırasında yine vilayetlerin yeniden yapılandırılması ve Nüfus Yazımı Kanunu üzerinde çalışılan konulardır. Bunun dışında 1955 belediye seçimleri dönemin önemli bir iç politika meselesidir. Ayrıca bu dönemde çok önemli bir yer tutan Toplantılar ve Gösteri Yürüyüşleri Kanunu mecliste kabul edilmiştir. ; Ibrahim Etem Menderes was originally from Aydin and was born in Izmir in 1899. Etem Menderes, who started politics with the Free Republic Party and continued with the Republic People Party, entered parliament as the Democratic Party Aydin MP in the 1950 elections. He served in various ministries for 10 years as a member of parliament. One of them is the Ministry of Interior and has been appointed to this duty twice. Etem Menderes' first term as interior ministry was quite busy. Eastern travel, the restructuring of the provinces, the Population Law, infrastructure works (e.g. roads, water and electricity), country security and the Law of Unity of the Constabulary come into prominence among the activities of this period. However, efforts have been made to ensure that the democratic order in local governments is grounded. The restructuring of provinces and the Population Writing Law are matters studied still during Etem Menderes' second term as interior ministry. Except this, the 1955 municipal elections are an important domestic policy issue of the period. Furthermore, the Law on Meetings and Demonstration Marches, which has a very important place in this period, was adopted in the parliament.

Üye devletler, serbest dolaşım ve yerleşme özgürlüğü ilkesi uyarınca yabancı şirketlerin, ülkelerinde ticari faaliyette bulunmasına kısıtlama getiren iç hukuk hükümlerinden kaçınmak durumundadır. Tüzel kişilere tanınan bu iki hakkın altında yatan temel gaye ise yerli-yabancı şirket ayrımının ortadan kaldırılması suretiyle sermaye akışının hızlandırılması ve ortak pazar ekonomisinin sağlanmasıdır. Ancak üye devletlerin iç hukuk hükümleri ve kanunlar ihtilafı mevzuatlarındaki farklılıklar, uygulamada büyük sorunlara yol açmaktadır. Çalışmanın konusunu da; uygulamada karşılaşılan bu sorunların Ortaklık Mevzuatı ve Avrupa Birliği Adalet Divanı kararları ışığında incelenmesi oluşturmaktadır. ; The freedom of mobility granted to natural persons in the European Union Association Legislation is also applicable to the member state legal persons as per the provisions in the Founding Treaty. As a result, a commercial established in an EU member state can conduct commercial activities without any limitations in other EU member states. Freedom of mobility and establishment in legal persons is realized through the relocation of the corporation headquarters from one country to the other or through establishment of branches or affiliated corporations in other countries. Member states are obliged to refrain from legislating national legal provisions which restrict the commercial operations of foreign corporations in their country pursuant to the principle of freedom of movement and establishment. The main purpose of these two rights granted to the legal persons is to increase capital flow and promote common market economy through the ablosihment of foreign – domestic corporation distinction. However, the differences between member states' national legislation and the legislation regarding the conflict of laws lead to crucial problems in practice. This study focuses on the examination of these problems in the light of Association Legislation and the decisions of the European Union Court of Justice.

This article aims to analyze the identity politics in Kosovo after the independence. It employs social constructivist approach to argue that the enmity between Albanians and the Serbs of Kosovo is not natural or primordial but socially constructed as a by-product of Albanian and Serbian national building processes. Considering nation and national identity as socially constructed and therefore a process never completed, the article claims that it is theoretically possible to construct an all embracing "Kosovar" identity in the post-independence Kosovo by emphasizing citizenship rather than ethnic or religious affinities by the new Kosovo state. However, as the independence period and its aftermath was analyzed, it was concluded that the successful formation of a Kosovar identity remains heavily dependent on the degree to which the newly established Kosovo state is able to apply constitutional principles such as supremacy of law and human rights indiscriminately to all its citizens.

Birinci Dünya Savaşı sonrasında mağlup devletler tarafında yer alan Osmanlı Devleti, İtilaf Devletlerinin dikte ettiği Mondros Ateşkes Antlaşması imzalamak zorunda kalmıştır. Ülke bütünlüğüne kast eden bu anlaşmanın 7. ve 24. Maddeleri ile İtilaf Devletleri askerlerini Anadolu'nun birçok yerine göndermeye başlamıştır. İngilizler Amasya bölgesinde gerek kendileri gerekse bölgede bulunan Rum ve Ermeni eşkıya çeteleri ile işgal girişimlerine başlamıştı. Ancak bu durum karşısında İstanbul Hükümeti yurt işgallerine sessiz kalarak hem meşruiyetini hem de millet vicdanındaki yerini kaybetmiştir. Türk milleti tarihinde esarete boyun eğmediği gibi kendi varlığına doğrudan yönelen azınlıkların ve İtilaf Devletlerinin işbirliğine karşı harekete geçmekte tereddüt etmemiştir. Bağımsızlıktan ve topraklardan ödün verilmeyeceğini Türk Milleti Müdafaa-i Hukuk Cemiyetleri kurarak göstermiştir. Amasya milleti de bu onurlu ve kutsal davada vatan ve millet için ne gerekirse hepsini layıkıyla yerine getirmiştir. Osmanlı Devletinin artık fiilen aktifliğinin kalmaması üzerine Mustafa Kemal Paşa, kurtuluşun ancak milletin azmi ve kararı ile gerçekleştirileceğine inanarak Anadolu'da milleti arkasına alıp milli ruh ve milli devletin temellerini sağlam şekilde atmıştır. Bu amaçla Mustafa Kemal Paşa milletin içinden millet tarafından seçilecek yeni ve tek otorite olacak Meclis için adım atarak milleti arkasına almıştır. Ülkede 66 seçim bölgesi belirlenerek her seçim bölgesinden 5 vekilin Meclise katılması amaçlanmıştır. ÖZETKÜRESELLEŞME SÜRECİNDE GELİŞMEKTE OLAN ÜLKELERDE DEVLETİN DEĞİŞEN ROLÜUluslararası sistemin İkinci Dünya Savaşı'nın sona ermesiyle başlayan uzun dönemli büyüme konjonktürünün 1970'li yılların başından itibaren krize girmesiyle başlayan ve kapitalizmin yaşadığı krize çözüm bulmanın bir aracı olarak gündeme gelen küreselleşme olgusu; yaşantımızı ekonomik, sosyal, kültürel olmak üzere birçok yönden etkilediği gibi, önemli bir toplumsal kurum olan devleti de etkilemiştir. Küreselleşme sürecinde gelişmekte olan ülkelerde devlet, kapitalist sermaye birikiminin tek yanlı çıkarları doğrultusunda yeniden yapılandırılırken, sosyal devletin yerini neo-liberal devlet almaya başlamıştır. Bu çalışma ile ulus-devletin egemenliğinin ulus-üstü kurumlarca gerçekleştirilen müdahalelerle yukarıdan, yerel yönetimlerin güç kazanmasıyla da aşağıdan aşındırılması süreci anlatılmaya çalışılmıştır. Egemenliğini yukarıya ve aşağıya doğru devreden ulus-devletlerin bağımsız para, maliye ve dış ticaret politikaları uygulama imkanlarının büyük ölçüde sınırlandırıldığı görülmüştür. Uluslararası sermayenin kazandığı büyük güç karşısında, ulus-devletlerin manevra alanları daralmıştır. Yapısal uyum politikalarından esnek çalışma biçimlerinin yaygınlaştırılmasına pek çok alanda yeni düzenlemeler yapmaya devam eden ulus-devletlerin bu dönemdeki yeni rolleri ise; küreselleşme sürecinin gerektirdiği gerekli alt-yapı yatırımlarının tamamlanması, uluslararası düzenlemelerin ülke içindeki hukuksal yapıya uyarlanması ve gelişmekte olan ülkelerde, küreselleşme süreci ile birlikte daha sık ve daha şiddetli şekilde ortaya çıkma ihtimali olan sosyal patlamaların bastırılması ve emeğin baskılanması olmuştur. ABSTRACTCHANGING FUNCTION OF THE STATE IN THE DEVELOPING COUNTRIES WITH THE GLOBALIZATION PROCESSThe Globalization phenomenon, which came into question as an instrument to overcome the crisis of the capitalism and got started at early 1970's by the end of the long-term growth conjuncture of the capitalism which has been started by the end of the second World War, has effected our lives on several dimensions like economical, social, culturel and it also has effected the state as one of the important social institution as well. While the state in the developing countries has been reconstructed to serve one-sided interests of the international capital with the process of the globalization, the neo-liberal state started to replace welfare state as well. In this study, the detrition of the nation-state sovereignty by the interventions of the supernational organisations and by gainig strength of the local administrations is being tried to be explained. It is obvious that the nation states which trasferred their sovereignty to supernational organisations above and the local administrations below, lost most of the opportunities to use independent fiscal, financial and foreign policies. The manoeuvre space of the nation-states has been narrowed against the huge power gained by the international capital. The new functions of the nations-states which are going on to make several new arrangements like ganaralization of the flexible forms of labour and performing the structural adjustment programs are; completing the infrastructure needeb by the globalization process, adaptation of the national law system to the international regulations, depressing the growing possibilities of the social uprisings and the pressure of the labour.

Besides terrorism is a serious national problem that we face in the modern world, it has gained a global dimension. Terrorist attacks are increasingly being organized by using modern weapons as to damage the human health and threaten the life. Terrorism is begun to be preferable rather than legal means to resolve social, national, religious and other conflicts. All these has led to a more careful research of the phenomena of "international terrorism" in the scientific field. The reason for the differences of opinion on the concepts of terror and terrorism, which could not be defined on a universal scale up to now, is not technical but political. In the framework of the non-existence of a generally accepted definition in international law, different approaches to the concepts of terror and terrorism are included in our study. Terrorism has become a transnational phenomena that surpasses national borders and gains an international dimension. Due to this fact, the concept of international terrorism has constituted the important part of our study. Global measures to be taken against terrorism are often taken through the United Nations, as it has global and accessible multilateral mechanisms. In addition, the fight against, terrorism is carried out at regional level in cooperation with international organization such as Shanghai Cooperation Organization, Commonwealth of Independent States and Collective Security Treaty Organization. The treaties and documents on the fight against terrorism adopted by the United Nations and the Shanghai Cooperation Organization form the basis of the issue in our study. On the basic of these documents and agreements, the statutes which are in effect for struggling against terrorism in Kazakhstan, such as the Criminal Code, the Law on the Suppression of Terrorism, the Law on the Suppression of Terrorism, the Law on the Suppresion of Extremism, The Prevention of Legalization of the Illegitimate Incomes and the Finansing of Terrorism will be evaluated. Besides, within the framework of the legal basis that emerged during our study, Kazakhstan's attitude in the struggle against terrorism will be discussed. ; Terörizm, modern dünyada ulusal nitelikte karşılaştığımız ciddi bir sorun olmanın yanında küresel bir boyut da kazanmıştır. Terör saldırıları gittikçe daha kapsamlı bir şekilde, modern silahlar kullanılarak insan sağlığına zarar verme ve ciddi yaşam tehdidi oluşturma amacıyla düzenlenmektedir. Toplumsal, milli, dini ve diğer çatışmaları çözmek için yasal yollardan ziyade terör tercih edilmeye başlanmıştır. Bütün bunlar, "uluslararası terörizm" olgusunun bilimsel alanda daha dikkatli araştırılmasına yol açmıştır. Bugüne kadar evrensel bir ölçekte geçerli tanımı yapılamayan terör ve terörizm kavramları konusunda görüş farklılıklarına rastlanmasının sebebi teknik değil siyasi bir nitelik taşımaktadır. Uluslararası hukukta genel kabul gören bir tanım yapılamamış olması çerçevesinde terör ve terörizm kavramları hakkındaki farklı yaklaşımlara çalışmamızda yer verilmiştir. Terörizm, ulusal sınırları aşarak uluslararası boyut kazanan ulusötesi bir olgu haline gelmiştir. Bu sebeple uluslararası terörizm kavramı da çalışmamızın önemli bir parçasını oluşturmaktadır. Küresel ve ulaşılabilir çok taraflı mekanizmalara sahip olduğu için terörizme karşı alınması gereken önlemler, en çok Birleşmiş Milletler aracılığıyla alınmaktadır. Ayrıca terörizmle mücadele, bölgesel düzeyde Şangay İşbirliği Örgütü, Bağımsız Devletler Topluluğu, Kollektif Güvenlik Antlaşması Örgütü gibi uluslararası örgütlerin işbirliğiyle de yerine getirilmektedir. Çalışmamızda, Birleşmiş Milletler ve Şangay İşbirliği Örgütü bünyesinde kabul edilen terörizmle mücadele ile ilgili antlaşma ve belgeler, konunun temelini oluşturmaktadır. Ayrıca bu belgelere ve antlaşmalara dayanarak, Kazakistan'ın iç hukukundaki terörizmle mücadele alanında yürürlükte bulunan Ceza Kanunu, Terörizmle Mücadele Kanunu, Aşırılıkçılıkla Mücadele Kanunu, Kanun Dışı Yollarla Ele Geçirilen Gelirlerin Yasallaştırılması ve Terörizmin Finansmanının Önlenmesine İlişkin Kanun ile ilgili değerlendirmeler yapılacaktır. Bunun yanı sıra, çalışmamız boyunca ortaya çıkan hukuki zemin çerçevesinde, Kazakistan'ın terörizmle mücadeledeki tutumu ele alınacaktır.

Traditional citizenship education aiming to build a monolithic national identity, disseminate an image of homogeneous society and transmit the knowledge of political system has evolved towards modern citizenship education characterised by an emphasis on human rights, democracy, the rule of law, respect for diversity and a concern to develop students' political participation skills. The transition to modern citizenship education in Turkey started with the pushing of international educational projects and is still underway. Drawing on critical discourse analysis, this study explores what kind of citizenship education the 2018 Social Studies Courses Programme of Study envisages. The study found that the new programme intensely reflects the characteristics of traditional citizenship education. Taking into account this study's findings might lead to more effective implementation of the programme and increase the success of future curriculum reforms.
