Türkiye uzun yıllar Batıya dönük dış politika izlemiş, Ortadoğu'yu ise bir tehdit olarak algılamıştır. 2000'li yıllarda değişen dış politika yaklaşımı ile bu algı değişmiştir. Bu dönemden itibaren bir tehdit kaynağı olarak görülen Ortadoğu ülkeleri artık ikili ilişkiler kurulabilecek, işbirliği yapılabilecek ülkeler olmuştur. Bölge ülkeleri ile ortak tarihi geçmiş ve coğrafi yakınlık bir bakıma bunu gerekli kılmıştır. Ortadoğu artık bir tehditten ziyade yeni bir fırsat alanı olmuştur. Bu değişim özellikle Mısır, Suriye, Irak ve İran gibi ülkelerle Türkiye arasında olumlu gelişmelere de zemin hazırlamıştır. Ancak bu olumlu hava Arap Baharının bölge ülkelerini etkisi altına almasıyla son bulmuştur. Arap Baharı ile Ortadoğu yeni ve oldukça sancılı bir döneme girmiştir. Suriye'de ise bu dönem çok daha şiddetli olmuş ve ülkede bir iç savaş başlamıştır. Bu iç savaştan kaynaklı otorite boşluğundan faydalanan IŞİD, PYD/YPG-PKK gibi terör örgütleri Türkiye sınırına yerleşmiş ve hem sınırda hem ülke genelinde kanlı eylemler gerçekleştirmiştir. Bu durum Türkiye'nin yeni bir güvenlik stratejisi ortaya koymasını zorunlu hale getirmiştir. Bu güvenlik stratejisi Türkiye'nin ulusal güvenliğini korumak adına terörle mücadele kapsamında sınır ötesi harekâtları da içeriyordu. Bu çalışmada Türkiye'nin ulusal güvenliğini sağlamak amacıyla Suriye'ye gerçekleştirdiği sınır ötesi askeri operasyonlar, uluslararası hukuk normları üzerinden değerlendirilecektir. Çalışmanın asıl vurgusu ise Fırat Kalkanı Harekâtı, Zeytin Dalı Harekâtı ve Barış Pınarı Harekâtlarının meşru müdafaa hakkı ve Birleşmiş Milletler Güvenlik Konsey'nin ilgili kararları uyarınca gerçekleştirildiği ve bu bakımdan uluslararası hukuka uygun olduğudur. ; Turkey has followed west-facing foreign policy for many year sand has perceived the Middle East as a threat. This perception has changed with the foreign policy approach that changed in the 2000s. Since this period, Middle Eastern countries, which have been seen as a source of threat, have now been countries where bilateral relations can be established and co-operative. In a way, the common history of the countries of theregion and the geographical proximity has made it necessary in a way. The Middle East has now become a new area of opportunity rather than a threat. This change has also paved the way for positive developments between countries such as Egypt, Syria, Iraq and Iran and Turkey. However, this positive weatherended with the Arab Spring affecting the countries of the region. With the Arab Spring, the Middle East has entered a new and quite painful period. In Syria, however, this period has been much more violentand a civil war has started in the country. Taking advantage of the authority vacuum caused by this civilwar, terrorist organization ssuch as ISIS, the PYD/YPG-PKK have settled on the border with Turkey and carried outbloodyacts both at the border and across the country. This has made it necessary for Turkey to put forward a new security strategy. This security strategy included cross-border operations as part of counter terrorism to protect Turkey's national security. In this study, Turkey's cross-border military operations to Syria in order to ensure its national security will be evaluated based on the norms of international law. The main emphasis of the study is that the Euphrates Shield, Olive Branch and Peace Spring Operations and the peace spring operations were carried out in accordance with theright of self-defense and the relevant resolutions of the United Nations Security Counciland in accordance with international law in this respect.
Türkiye'de parlamento seçimlerinde 1961'den beri d'Hondt sistemi uygulanmaktadır. Ayrıca parlamento seçimlerinde ulusal düzeyde uygulanan yüzde onluk seçim barajı mevcuttur. Ülkemizde uygulanan barajlı d'Hondt sistemi, büyük partiler lehine sonuçlar ortaya çıkarmaktadır. Ulusal düzeyde uygulanan yüzde onluk seçim barajı da küçük partilerin parlamentoya girmesini engelleyerek büyük partilerin aşırı temsil elde etmesini sağlamaktadır. Bu nedenle ülkemizde genel seçim sonuçlarıyla parlamento aritmetiği arasında bir adaletsizlik ortaya çıkmaktadır. Ülkemizde uzun yıllar boyunca temsilde adaletin sağlanamadığı bir parlamento yapısı ortaya çıkmıştır. Buna karşılık "İttifak Yasası" olarak bilinen yeni düzenlemeden sonraki ilk seçimler olan 24 Haziran 2018 seçimleri sonucunda parlamentoda temsilde adaletin neredeyse tam olarak sağlandığı görülmektedir. "İttifak Yasası" yüzde ondan daha az oya sahip küçük partilerin parlamentoya girmesinin önünü açmaktadır. Bu nedenle ittifak kurumu, ilk etapta temsilde adalet açısından olumlu bir düzenlemeymiş gibi görünmektedir. Buna karşılık ittifak kurumunun büyük ittifakların d'Hondt sisteminden faydalanarak daha fazla aşırı temsil elde etmesi ve ittifak içinde bulunmayan küçük partilerin adaletsizliğe uğrayabilmesi gibi olumsuz sonuçları da olabilecektir. Sonuç olarak bu makalede ittifak kurumunun temsilde adalet ilkesi açısından gerçekte nasıl bir anlam ifade ettiği inceleme altına alınmaktadır. ; In Turkey, the d'Hondt system is applied in the parliamentary elections since 1961. There is also ten percent national election threshold in parliamentary elections. In Turkey, the d'Hondt system generally benefits to large parties. In addition, ten percent national election threshold provides environment for overrepresentation of large parties by prevents small parties from entering parliament. For these reasons, an injustice occurs between the results of the general elections and the arithmetic of parliament. Justice in representation hasn't provided for many years in Turkey. On the other hand, as a result of 24 June 2018 election which is the first elections following the new regulation known as the "Alliance Law', justice in representation in parliament is almost fully achieved. The alliance paves the way to enter parliament for small parties which has got under ten percent of vote to. Therefore, at first view, the alliance seems to be a positive regulation in terms of justice of representation. On the other hands, the alliance causes large parties in large alliances gain more overrepresentation by using of advantages of the d'Hondt system. And in the new election system, small parties which isn't in any alliance can't enter the parliament, so the "Allience Law" causes to injustice between parties within an allience and not within an alliance. As a result, this article examines what the alliance actually means in terms of the principle of justice in representation.
Gelişen dünyada uluslararası ilişkiler ve etkileşimler artmıştır. Bunun bir sonucu da yabancılık unsuru içeren uyuşmazlıkların ortaya çıkması olmuştur. Kural olarak yerel bir uyuşmazlık, uyuşmazlığın çıktığı ülkenin yargı organlarınca çözüme kavuşturulur. Ancak yabancılık unsuru içeren bir uyuşmazlık ulusal bir yargı organınca çözülse bile yargılama sonucu tesis edilen hükmün uyuşmazlığın tarafı olan kişilerin ülkelerinde de etki doğurması artık zorunlu bir hal almıştır. Yabancı yargı organlarınca tesis edilen kararların başka bir ülkede hukuki sonuç doğurması ise ancak o ülke makamlarınca tanıma ve tenfiz prosedürü işletildikten sonra mümkün olmaktadır. Bu tanıma ve tenfiz prosedürünün şartlarını ise kararın etki doğuracağı ülkelerin kendileri belirlemektedir ; In the developing world, international relationships and interactions have increased. Geri Kabul Anlaşmaları son dönemde, özellikle 2015 yılında Avrupa'ya doğru yaşanan düzensiz göç akını nedeniyle gündeme gelmiş olmasına rağmen Avrupa Birliği uygulamasında elli yıldan uzun bir geçmişe sahiptir. Avrupa Topluluklarının kurulduğu ilk yıllardan bu yana önceleri Üye Devletler arasında daha sonra Üye Devletlerle üçüncü ülkeler arasında ve nihayet Avrupa Birliği ile üçüncü ülkeler arasında geri kabul anlaşmaları imzalanmıştır. Avrupa Birliği'nin Amsterdam Antlaşması ile göç konusunda yetki kazanması ile birlikte AB'nin bu alandaki çabaları yoğunlaşmıştır. Bu çalışmada önce geri kabul kavramının çıkış noktası ve uluslararası hukuktaki yeri değerlendirilecek, daha sonra tarihsel süreç içinde geri kabul anlaşmaları dönemler halinde ele alınacaktır. Bu bağlamda son dönem geri kabul anlaşmaları detaylı bir şekilde ele alınacaktır. Son bölümde ise Türkiye ile Avrupa Birliği arasında imzalanan geri kabul anlaşması ve bu anlaşmanın Türk vatandaşları ve üçüncü ülke vatandaşlarının geri kabulüne ilişkin hükümleri incelenecek, anlaşmanın yürürlüğe girdiği tarihten itibaren yaşanan gelişmeler irdelenecektir. ; Although Readmission Agreements became main topic of conversation during the irregular migration flow towards Europe especially in 2015, they have a history of more than fifty years in EU practice. Since the foundation of the European Communities, readmission agreements have been concluded first between the Member States, then between the Member States and third countries and later between the European Union and third countries. The EU' effort in this field intensified after the Amsterdam Treaty where the EU was empowered with competences in migration issues. This study will focus on first the starting point of the readmission concept and its place in international law, later examine readmission agreements in the historical process. Within this context latest term readmission agreements will be analysed in detail. Last part will be focus on the readmission agreement between Turkey and the EU. The provisions regarding to the readmission of Turkish nationals and third country nationals will be analysed in detail together with the developments during the implementation of the agreement.
AB vize politikası 1957 tarihli Kişilerin Serbest Dolaşımına ilişkin Anlaşma çerçevesinde Avrupa Konseyi üyesi ülkeler arasında visesiz seyahatin gerçekleşmesi ile başlamıştır. AB vize politikasının gelişimi ise Schengen Anlaşması, vize taşıması gereken üçüncü ülke vatandaşlarına ilişkin Avrupa Konseyi'nin 539/2001 Sayılı Vize Tüzüğü ve Avrupa Konseyi'nin 1683/95 Sayılı Tek Tip Vize Tüzüğü ile olmuştur. AB vize politikası ortak bir vize (Schengen Vizesi) uygulaması ile de entegrasyon seviyesine ulaşmıştır. Avrupa Konseyi bünyesinde oluşan 1957 tarihli Kişilerin Serbest Dolaşımına ilişkin Anlaşmaya Türkiye de taraftı. Hem Türkiye hem de Avrupa Topluluğu üyesi ülkeler 1957 tarihli Kişilerin Serbest Dolaşımına ilişkin Avrupa Konseyi Anlaşmasına taraf olduğundan, söz konusu Anlaşma çerçevesinde vizesiz seyahat uygulaması her iki tarafın vatandaşları için de geçerliydi. Bu anlamda çalışmada, AB'nin olumsuz tutumuna karşı Türkiye'nin tercih edebileceği alternatif politika önerileri değerlendirilmektedir. ; European Union's visa policy started with abolution of visa requirements between the member states of the Council of Europe within the framework of the Council of Europe Agreement on Free Movement of Persons in 1957. The development of the European Union's visa policy has been with Council Regulation (EC) No 1683/95 of laying down a uniform format for visas, Council Regulation (EC) No 539/2001 of listing the third countries whose nationals must be in possession of visas and Schengen Agreement. In addition to this, European Union's visa policy with a common visa (Schengen Visa) has reached the level of integration. Turkey also was bound to the Council of Europe Agreement in 1957 governing Free Movement of Persons between Member States of the Council of Europe. Because both Turkey and the member states of European Community were parties to the Council of Europe Agreement on Free Movement of Persons in 1957, visa free travel application within the framework the agreement was valid for nationals of each sides. In this context, there was free movement of persons between Turkey and the EU until 1980. However the member states of European Union suspended the application of the agreement with regard to nationals of Turkey. In this context, in the study are examined the rights of Turkish nationals arising from Additional Protocol providing rules on the implementation of the Ankara Agreement relating to visa-free travel and are argued that EU's practices against Turkish nationals are contrary to association law. In addition to this, in the study are examined EU and Turkey relations relating to visa issues and are questioned to effect on Turkey's EU accession negotiations of the EU's negative attitude. In the study are evaluated the alternative policy recommendations Turkey might prefer against the EU's negative attitude.
İlk toplumların oluşmasından günümüze kadar değişen şekillerde hep var olan sosyal güvenlik, 19. yüzyılda toplumların sanayi toplumlarına dönüşmeye başlaması ile birlikte zorunlu bir kavram olarak karşımıza çıkmıştır. Ancak, II. Dünya Savaşı'ndan sonra bir insan hakkı olarak uluslararası ve ulusal belgelerde yer alarak gün geçtikçe önemi daha da belirginleşmiştir. 1970'li yıllarda meydana gelen ekonomik krizlerin sonucu olarak gündeme gelen neo-liberal düşünceler ve küreselleşme olgusunun sosyal güvenlik hakkının uygulanmasında meydana getirdiği değişim ve dönüşümler, ülkemizde de sosyal güvenlik reformu yapılmasını gündeme getirmiştir. Özellikle, 1990'lı yılardan itibaren sosyal güvenlik sisteminin bütçe açığının artması nedeniyle reform tartışmaları yoğunluk kazanmış, 2005 yılından itibaren ise sosyal güvenlik reformuna ilişkin yasal çalışmalara başlanmış, 2008 yılı itibariyle sosyal sigortalara reform ilişkin çalışmalar tamamlanmıştır. Bu çalışma konusunun seçilmesinin nedeni, bir insan hakkı olarak sosyal güvenlik reformu nedeniyle oldukça fazla tartışılmaya başlanan sosyal güvenlik hakkının kavramsal çerçevesi ile gelişimi; bu hakkın uluslararası belgelerde ve mukayeseli hukukta nasıl yer aldığı; son olarak da Türk hukukunda sosyal güvenlik hakkı ve bu hakkın uygulama araçlarını ortaya koyacak bir çalışma yapmaktır. Bu bağlamda, sosyal güvenlik reformunun sosyal güvenlik hakkına etkisi ayrıca tartışılacaktır. Bu çalışma, üç bölümden oluşmakta olup, birinci bölümde, sosyal güvenlik hakkının kavramsal çerçevesi ve gelişimi; ikinci bölümde, uluslararası belgelerde ve mukayeseli hukukta sosyal güvenlik hakkı; üçüncü bölümde ise, sosyal güvenlik hakkının Anayasal temelleri ve uygulama araçları incelenecektir. ; Social security, which we have faced with a compulsory concept when communities were transformed to the industrialized communities at 19 th century, has been existed with the different forms from formation of first communities to today. Besides, its importance got crystallized by taking part in national and international documents as a human right after World War II. Transformation and changes of neo liberal taught, which became on an agenda as a result of economic crises occurred at nineteen seventies, and globalization fact on application of social security right has forced to make social security reform in our country too. Especially from nineteen nineties discussions on reform had increased because increasing budget deficit of social security system. Legal studies related to the social security system had started at 2005 and the studies about social security reform completed at 2008. The reason of choosing this topic is making studies on and to explain; conceptual framework and progress of social security right as a human right which has started to be discussed more because of the social security reform, how is this right take parts in international documents and comparative law, and lately social security right in Turkish Law and its application tools. This study consists of three chapters. In the first chapter, the conceptual framework of social security right and its progress; in the second chapter, social security right in international documents and comparative law; in the third chapter, constitutional bases of social security right and its application tolls are being debated.
ÖZET Bu tez ; Türkiye ile Yunanistan ilişkilerinde Ege Sorununu ele almaktadır. Birinci bölümde Yunan milli hedefi olan Megali İdea incelenmiş, Ege Sorunu ile ilgili yönleri ortaya konmuş ve son olarak da Türk Ulusal Hedefi ile Yunan Milli Hedefi (Megali İdea) karşılaştırılmıştır. İkinci bölümde deniz alanına ilişkin sorunlar kıta sahanlığı ve karasuları olarak ikiye ayrılarak incelenmiş her iki ihtilafında tarihsel gelişimi anlatılmış, tarafların tezleri ele alınmış ve tarafların tezlerinin uluslararası hukuka uygunluğu tartışılmıştır. Üçüncü bölümde adalara ilişkin sorunlardan ilk olarak egemenliği tartışmalı adalar sorunu ele alınmış ve Kardak Kayalıkları'nın aidiyeti ile ortaya çıkan egemenliği tartışmalı adalar meselesinin karasuları sorununun çözülmesi üzerindeki etkileri ortaya konmuştur. İkinci olarak adaların silahsızlandırılması meselesi ele alınmış ve Türkiye'nin güvenliği üzerindeki olası olumsuz etkileri ele alınmıştır.Dördüncü bölümde hava sahasına ilişkin sorunlar hava sahası meselesi ve flight information regions (uçuş bilgi bölgeleri) olarak ikiye ayrılarak incelenmiştir. Yunanistan'ın hava sahasını genişletme çabalarının uluslararası hukuka uygunluğu tartışılmıştır. Beşinci bölümde Ege'de NATO komuta kontrol sorumluluklarının paylaşılmasına ilişkin sorunlar (Rogers Andlaşması) ele alınmıştır.Sonuç bölümünde genel bir değerlendirme yapılarak Ege sorununun gerek günümüzde gerekse de gelecekte ülkemiz üzerinde etkileri incelenmiştir.ABSTRACTThis present thesis deals with Aegean Problem existing between relations of Turkey and Greece.In first chapter, Megali Idea that is Greek National Target was studied and examined. And in this chapter aspects related to Aegean Problem were put forth and finnally, Turkish National Target and Greek National Target (Megali Idea) has been compared.In second chapter, problems related to sea field have been divided into two sections, namely as continental shelf and territorial waters and studied and examined and thesises of concern parties have been dealt and thesises of concern parties have been discussed about being in compliance with international laws.In third chapter, problem of islands of which domain and sovereignty of islands being primary problem related to islands has been dealt and sovereignty emerged with belonging state of Kardak rocks has been put forth about disarmament of islands have been discussed as well as possible adverse effects on security of Turkey has been dealt.In fourth chapter, problems related to air field have been studied and examined by dividing into two sections as Air field and Flight information regions respectively. Attempts about extension of air field by Greece have been discussed whether being in compliance with international law or not.In fifth chapter, problems related to sharing command control responsibility of NATO in Aegean region (Rogers Convention) have been dealt.In conclusion chapter, general assessment has been made and effects of Aegean problem on our present time and also in future or our country have been studied and examined.
Tarihte devlet kavramı toprak parçası üzerinde egemenliği ifade etmiştir. Tarihler boyunca insanların sahip oldukları bencil duygular toplumları güç savaşına itmiş, ihtiyaç duyulan gücü ve toprak parçasını elinde bulundurmak isteyen toplumlar devleti kurmuştur. Devlet, belli bir toprak parçasında egemenlik sağlamış toplumların üstün güç olmak için insan, ülke ve egemenlik unsurlarının birleşmesinden oluşmuştur. Hukuk kurallarının belirlenmesiyle de kurulmuş olan devlet kendine kimlik kazanmıştır. Devletler tüzel kişilik kazanmaları ile hiçbir devletin müdahalesine uğramadan kendi belirlemiş olduğu kurallar ile sürekliliklerini sağlamıştır. Modern devlete can veren egemenlik anlayışının temelleri ise ortaçağ ve yeniçağın başlarında atılmış ve egemenliğin oluşmasına neden olan birçok tarihsel olayı içine almıştır. Toplumlar devlet kavramı etrafında oluşan zıt teoriler ve değişik ideolojileri tasvir eden filozoflar sayesinde devlet kavramı gerçekleştirmek istedikleri amaca ulaşmak için bir araç olarak değerlendirmiştir. Farklı siyasal felsefe akımlarına sahip olan filozoflar savundukları görüşler bakımından zıtlıkların oluşmasını sağlamıştır. Bu sebeple devletlerin siyasi, ekonomik ve hukuk sistemlerinde farklılıklar ortaya çıkmıştır. Sonuç olarak devletler, devletsiz toplumlardan kent devletlerine, imparatorluklardan modern devlet anlayışına, gelişen siyasal iktidarlara ve devletlerin ulusal üstünlüğüne doğru iktidar yapılanmaları açısından tarihsel değişim ve gelişimlere sahip olmuştur. Devletlerin egemenlik açısından gelişimi ele alındığında da siyasi iktidarın sahip oldukları meşrutiyet ideolojisinden teokratik meşruluğa ve ondanda demokratik meşruluğa yönelen bir değişimlere sahip olmuştur. Bu da devletlerin eski varlıklarını tüm değişimlere uyum sağlayarak varlıklarını devam ettirdiğini göstermiştir. Böylece devlet gücü oluşmuş ve sınırlı egemenlik anlayışı uygulanmasıyla toplumların hakları devlet içinde korunmuş devletler üstün konumları sayesinde varlıklarında güçlü hale getirilmiştir. ; The consept of State expresses the sovereignty on piece of land in the past. Self- centeredness of people causes power struggle throughout history and the societies wishing to have the power and the piece of land establish a state. The State consists of human, country and sovereignty of people who to be a superior power on a certain piece of land. The State has gained an identity by determining the rules of law. Thanks to the legal entity, the States have maintained their continuity by their own rules without any state invervention. The basis of the concept of sovereignty that ensouls the modern state was founnded at the beginning of the middle age and the new age and covered many historical events that led to the formation of sovereignty. The societies have evaluated the consept of State as a means to achieve their wishings thanks to the philosophers describing the contradictory theories and the dfferent ideologies related to this concept. The philosophers who have different Political philosophical movements create opposing views about the State. Therefore, there are differences in the Political, economic and legal systems of the States. Consequently, the States have historical developments with regard to the power structures towards the Political power and the national state supremacy from the societies to the city states, from the emprires to the sense of modern state. When the development of State in terms of sovereignty is taken into consideration, it is seen that the consitutional monarchy of Political Powers changes from theocratical to democratic legitimacy. This situation indicates that the states continue thir existences by adapting to the new developments. Thus, the state has power and the application of the concept of limited sovereignty cause to protect the right of societies within the state and the states have gained strength by their superior positions.
İnsanoğlu geçmişten beri güçlerini birleştirmek için örgütlenme yoluna gitmiştir. Amaç meşru olduğu sürece herkes örgütlenme hakkına sahiptir. Örgütlenme bu anlamda doğal bir ihtiyaç olup, gerek ulusal ve gerekse uluslararası hukukta temel bir hak olarak güvence altına alınmıştır. Ancak çalışmamızın konusu olan örgütler, amacı meşru olan örgütler değil; suç işlemek amacıyla kurulan, kamu barışı ve güvenliği üzerinde ciddi bir tehlike oluşturan suç örgütleridir. İki bölümden oluşan çalışmamızın ilk bölümünde suç örgütleri, kavramsal ve tarihsel olarak ele alınmış, akabinde benzer kavramlarla ilişkisine yer verilerek, özellikleri ve ayırıcı kriterleri ayrı ayrı açıklanmıştır. İkinci bölümde ise suçun maddi ve manevi unsurları ile özel görünüş biçimleri açıklanarak, cezayı kaldıran veya azaltan bir sebep olarak etkin pişmanlık hükümlerine yer verilmiştir. ; Mankind has resorted to be organized to join forces since old times. Everyone has the right to organize as long as the purpose is legitimate. Organization is a natural need in this sense and it is guaranteed as a fundamental right in both national and international law. However, organizations that are the subject of our study are not legitimate organizations. They are criminal organizations established for felon intent and constitute a serious danger to public peace and security. In the first part of our work, which is composed of two parts, the criminal organizations are discussed conceptually and historically, then their relation with similar concepts is given and their characteristics and distinctive criteria are explained individually. In the second part, the material and spiritual elements of the crime and special appearance forms are explained, and effective remorse provisions are included as a reason for removing or reducing the penalty.

The State should be interested in looking after the national society inside its own borders as well as in the larger societies existing outside wherein it should be sustainable its existence. The State takes the administration within its borders into its own monopoly. Such a situtation is a trend to create a common political culture being shared by all the citizens.The nation-state can be defined as a State having the right of employing any legal power inside a piece of o the land the borders of which have been demarcated and aiming to the integration to enliven the radical myth through the traditions by creating the common culture, symbols and values, all of which will homogenize the people under its administration. What the nation ? state is to centralize the state or poltical power , and standardize the culture, and provide the equality in law and the integration in economy.The understanding of sovereignity today in the world is defined, in general, as the right of any State for employing its powers of administration upon the country?s lands. This concept has a lawful meaning as well as a political meaning; and these two meanings are interchangeable with each other. Sovereignity represents the power of the State. As long as the nations enter into collaboration with each other, the sovereignity comes into question.Globalization is a concept containing the issues being connected with each other such as the development of economic, social and political relationships among the countries, and the better understanding the beliefs and expectations of the nations? cultures, and the intensification of international relationships. The process of globalization diminishes the power and efficiency of the governments being within the structure of nation-state; so such governments have difficulty in controlling the flow of economic objects, technological innovations, informaton, news and ideas, and the possibility of the nation-states for following up their national economic policies decrease gradually. The phenomenon of globalization puts the fact that the countries participate in the organizations guarding and protecting their common intersets and benefits at a supranational level into foreground in one hand, and makes new models of governance compulsory at both national and also supranational levels in the other hand.Today in the world, there are many forces challenging to the established models and practices of the state dominance. Such forces are globalization and internationalism. The European Union is a sui generis ınternational restructuring with its organizational structure being formed in line with both its goals and also with reaching such goals, which cannot be observed in any international organization. The most important feature making the European Community sui generis and distinguishing from other organizatons is to try to reach the goals thus determined through the formed structural (constitutional) and permanent bodies instead of the inter-governmental attempts.The tasks, authorizations, powers and responsibilities of the institutions of the European Union have been determined within the scope of the constitutive treaties. The institutions which such treaties give the authorization of making the supranational arrangement, application and judgement (such as Council, Commission, Committee, the European Community Court of Justice) can be also evaluated as the supranational authorities among the nations being included in the European countries Likewise, in the same way, both the law of treaties constituting such institutions and also the law which it has made have the same effect in the member states, and the fact that such laws cannot be changed and do away with unitalerally by the member states has developed the approach that the law of the European Union is supranational.Despite the European Union does not duly shelter the main elements of a state one to one within its own structure, it has been employing some powers similar to the ones being applied by any state state, and particularly by any federal state, and trying to form a constitutional citizenship. It has separated the powers of legislation, execution and judgment from each other within the framework of the division of powers, and created the separate bodies for each of such powers, and tied the functionality and operation of the same to the constituent treaties and law principles with the constitution. It gives its individuals the freedom of using the fundamental rights as well as of seeking such rights within the context of the Condition of the European Union Fundamental Rights. It has made the share of powers and authorizations with its member states, and included the same in the text of the constitution.

Gerek terorizm gerek kuresellesme tum boyutlariyla irdelendiyse de asil olarak uluslararasi terorizm ve kuresellesme ile etkilesimi uzerine odaklanilmistir.Tarihinde ideoloji din milliyetcilik gibi bircok sebepten meydana gelmis olan teror dunya capindaki hizli gelismeler ve teknoloji nedeniyle esitsizlik adaletsizlik tatminsizlik ve kuresellesme karsitligi gibi nedenlerle ortaya cikmaya baslamistir. Bunun sebebini aciklamak amaciyla terorizm ve kuresellesme oncelikle iki ayri tanim olarak ele alinarak tanimlanmistir. Dunyanin modernlesme teknoloji iletisim ve ulasimdaki kolayliklar nedeniyle kuculmesiyle terorun de yayginlastigi kuresellestigi siddetini ve sikligini arttirdigi gorulmektedir. Bu calismanin amaci terorizm ve kuresellesmeyi aciklayarak aralarindaki somut ve kuvvetli bagi gostermek ve terorle savas icin kuresellesmenin de yardimiyla uluslararasi ve sureklilik arzeden bir birligin kurulusunun onemini vurgulamaktir. ; This thesis analyzes the concept of terrorism in the age of globalization. Despite both concepts, globalism and terrorism, being studied by its all aspects, mainly the relationship between international terrorism and globalism is concentrated on. Terrorism, which has been motivated by ideological, religious and national reasons all through its history, has added issues to its concern like inequality, injustice, dissatisfaction and anti-globalist movements. In order to clarify this shift in the policies, the concepts of terrorism and globalization are first explained as distinct issues. Terrorism has become global because of modernization, developments in technology, communication and the ease in transportation. Thus, globalization has started to serve terrorism. At the same time, with its positive effects it became helpful in the fight against terrorism. The connection of globalization and terrorism has been explained in this respect. As the previous tools of diplomacy and military measures started to lose their validity, international cooperation and law have emerged as the tool to fight against terrorism. Since terrorism is a phenomenon that cannot be totally abolished, the best way to minimize terrorism is the use of international law, with necessary organizations established to form cooperation at the international level. The main aim of this thesis is to point out to several facts like there being a directly proportional relationship between globalization and terrorism concepts, furthermore continuous, determined international efforts and cooperation is a must and most important tool while fighting against terrorism.
Yüksek denetim kavramı, Sayıştaylar tarafından yürütülmekte olan dış denetim faaliyetini diğer dış denetim organları tarafından yapılan denetimlerden ayırt etmek için kullanılmaktadır. Ülkemizde "yüksek denetim (supreme audit)" literatürde fazla yer almayan bir kavram olmakla birlikte, uluslararası literatürde yaygın bir kullanıma sahip olduğu bilinmektedir. Türkiye'de; kaynağını Anayasadan alan, meslek mensuplarının yasal güvencelere sahip olduğu, kurumsal bağımsızlığı olan, millet meclisi adına mali denetim faaliyetini yürüten yüksek denetim organı Sayıştay'dır. Bu çalışmanın amacı, Osmanlı devletinde ve Türkiye Cumhuriyetinde yüksek denetim uygulamalarının ve kurumlarının (Sayıştay) gelişim sürecinin ortaya konulmasıdır. Çalışmada bibliyografya (kaynak taraması) yöntemi kullanılmıştır. Çalışmada kullanılan kaynaklar, Başbakanlık Osmanlı Arşivlerindeki belgelerden, yurt içi ve yurt dışı ilgili kitap, makale, bildiri ve araştırmalardan oluşmaktadır. Elde edilen bulgular tarihsel sırayla kaleme alınmıştır. ; The concept as supreme audit is used for separating the external audit which is performed by courts of accounts from the ones performed by independent external audit organs. Although the term as "supreme audit" is not a concept which is frequently met, it is widely used in international literature. Sayıştay is the court of accounts in Turkey, of which members of profession took their authority from the constitutional law in Turkey having legal assurance in an institutional independence, and it performs the activity as financial audit being a supreme audit organ, on behalf of the National Parliament. The aim of this study is to determine the development process of supreme audit procedures in Ottoman Empire and Republic of Turkey, showing the same for the institutions (Sayıştay: the court of accounts in Turkey.). Bu tezin amacı çevresel güvenlik ve iklim değişikliği çerçevesinde devletlerin Arktik bölgesindeki iddialarını analiz etmektir. Çalışmada elde edilen ilgi ve verilere göre devletlerin Kuzey Kutbu'ndaki fosil enerji kaynaklarına sahip olmak için hak iddia etmelerinin yanında bölge kaynaklarının paylaşımında uzlaşmaya varma durumlarında bile bu fosil enerji kaynaklarının kullanılmasıyla mevcut durumda yüksek olan salınımı daha da fazla arttıracaktır. Dolayısıyla devletlerin hak iddiaları çerçevesinde bir silahlı çatışmaya sürüklenmesi engellense bile, küresel ısınmanın dünya için yıkıcı etkilerinden kurtulmak mümkün olmayacaktır. Çalışmanın ilk bölümünde çevresel güvenlik, Arktik bölge özelinde çevresel güvenlik adına atılan adımlardan biri olan Arktik Konseyi, küresel ısınma ve sera etkisi, buzulların erimesi, küresel ısınma ile ilgili 19.yüzyıldan itibaren yapılmış olan tahminler, bilimsel araştırmalar ve son olarak Arktik bölgesinin ekonomik ve stratejik önemine dair genel çerçeveyi çizen bilgiler verilmiştir. İkinci bölümde küresel ısınmanın uluslararası bir boyut kazanmasıyla birlikte Birleşmiş Milletler öncülüğünde yapılan Hükümetler Arası İklim Paneli (IPCC) ve ortaya koyduğu raporlar, Birleşmiş Milletler İklim Değişikliği Çerçeve Sözleşmesi (UNFCCC) ve Birleşmiş Milletler Deniz Hukuku Sözleşmesi resmi belgelerle incelenmiş, devletlerin bu girişimlere karşı tutumu analiz edilmiştir. Üçüncü bölümde ise Arktik'teki buzulların erimesiyle ekonomik ve ulusal güvelik kaygıları artan beş Arktik ülkesinin (Rusya, ABD, Kanada, Norveç ve Danimarka) bölgedeki hâkimiyet iddiaları yine devletlerin resmi raporları ve basına verdikleri demeçler aracılığıyla Birleşmiş Milletler Deniz Hukuku Sözleşmesi çerçevesinde incelenmiştir. Küresel ısınma Arktik bölgesi başta olmak üzere tüm dünya üzerindeki tüm canlı yaşamını tehdit eden önemli bir sorundur. Ancak bu çalışmada da görüleceği gibi bölge ülkeleri ekonomik çıkarları ve ulusal güvenlik kaygıları adına bu faktörü görmezden gelmektedir. Birleşmiş Milletler'in küresel ısınmayı yavaşlatmak için yaptığı çalışmalar ülkelerin bu isteksiz tutumundan dolayı beklenen etkiyi sağlamakta yetersiz kalmaktadır. Bu çalışmada elde edilen bilgi ve verilere göre devletlerin iddia ettikleri bölgeleri ele geçirmeleri ve buradaki fosil kaynakları kullanmaları durumunda küresel ısınmanın daha hızlı bir şekilde artacağı, ekonomik ve siyasi tehditlerin yerini çevresel tehditlerin alacağı ortaya konulmuştur. ; The aim of this thesis is to analyze of the states' claims in the Arctic region within the framework of environmental security and climate change. According to the information and data obtained in the study, even if the states reach a consensus in the sharing of regional resources, the use of these fossil energy resources will further increase the current high emissions. Therefore, even if states are prevented from being dragged into an armed conflict within the framework of their claims, it will not be possible to get rid of the devastating effects of global warming for the world. The first part of the study is an explanation about environmental security, Arctic Council which is one of the steps taken in the name of environmental security in the Arctic region, global warming and greenhouse effect, melting of icecaps, information about research made since the 19th century on global warming, and finally the economic and strategic aspects of the Arctic region. In the second part, the Intergovernmental Panel on Climate Change (IPCC) led by the United and its reports, the United Nations Framework Convention on Climate Change (UNFCCC) and the United Nations Convention on the Law of the Sea have been examined with official documents. In the third part, the claims of sovereignty in the region of five Arctic countries (Russia, USA, Canada, Norway and Denmark), whose economic and national security concerns increased due to the melting of the Arctic glaciers, are examined within the framework of the United Nations Convention on the Law of the Sea. Global warming is an important problem that threatens all life on Earth, especially in the Arctic region. However, as can be seen in this study, countries in the region ignore this factor at the expense of their economic interests and national security concerns. The efforts of the United Nations to slow down global warming are insufficient to achieve the expected impact due to the countries' reluctance. According to the information and data obtained in this study, it is revealed that global warming will increase faster if the states take over the claimed areas and use the fossil resources there, and environmental and economic threats will be replaced by environmental threats.
Bu çalışmada Kırgız Cumhuriyeti'nin güvenlik alanında uluslararası örgütlerle olan işbirliği ve bu işbirliğinin pespektifleri ele alınmıştır. Kırgız Cumhuriyeti, bağımsızlığını elde etmesiyle beraber acil ve etkili bir çözüm gerektiren bir takım sorunla karşı karşıya kalmıştır. Bağımsızlığını yeni kazanmış olan Kırgız Cumhuriyeti'nin gündemindeki en önemli sorunlardan biri de ülkenin güvenlik sorunu olmuştur. Bunun da nedeni, SSCB'nin dağılmasından önce var olan uluslararası, bölgesel ve iç güvenlik mekanizmalarının ve sistemlerinin, ulusal çıkarlarını koruma konusunda zengin bir tecrübeye sahip olmayan Kırgızistan gibi yeni uluslararası aktörleri tehdit eden çağdaş sorunların çözümünde etkisiz kalmasıdır. Böyle bir durumda Kırgız Cumhuriyeti kendi ulusal güvenliğinin korunmasını sağlayabilmek için yeni mekanizmalar aramak zorunda kalmıştır. Bu bağlamda, Kırgızistan için ulusal güvenliğin korunmasını amaçlayan kendi sisteminin oluşturulmasına yönelik ana mekanizmalardan biri, güvenlik alanında çeşitli uluslararası ve bölgesel örgütle yapılan işbirliği olmuştur. Uluslararası ilişkilerin ve uluslararası hukukun gelişiminin bugünkü aşamasında uluslararası örgütlerin rolünün önemli ölçüde arttığını ve güçlü bir işbirliği merkezi haline geldiğini söylemek mümkündür. Hükümetler arası ve uluslararası birçok sivil toplum kuruluşu, resmi ve gayri resmi kuruluşun Orta Asya bölgesinde ve Kırgızistan'daki güvenlik, barış ve istikrar konularında Kırgız Cumhuriyeti ile işbirliğinin gelişmesine ciddi bir önem gösterdiğini de belirtmek gerekmektedir. Bu da büyük ölçüde, Kırgızistan'ın bölgedeki istikrarsızlık merkezlerinin (örneğin Afganistan) ve bunun yanı sıra Rusya ve Çin gibi büyük uluslararası oyuncuların yakınında yer alan jeopolitik konumundan kaynaklanmaktadır. Kırgızistan da, dünya topluluğunun pek çok ülkesi ile yakınlaşmaya, karşılıklı fayda çerçevesinde işbirliği yapmaya ve kurmuş olduğu kapsamlı ve adil ilişkileri geliştirmeye çalışmaktadır. Böylece, uluslararası işbirliği ve güvenlik konusuyla alakalı olarak uluslararası kuruluşlara olan aktif katılım Kırgızistan'ın yeni jeopolitik stratejisi haline gelmiştir. Bu bağlamda, çalışmanın ana amacı çeşitli uluslararası örgütlerin Kırgız Cumhuriyeti'nin ulusal güvenliğini oluşturma süreci üzerindeki etkisini incelemek, bu işbirliğinin etkinliğini değerlendirmek ve Kırgızistan'ın çeşitli uluslararası örgütlerle güvenlik alanında işbirliğinin geliştirilmesine yönelik beklentileri değerlendirmektir. ; This paper is devoted to the analysis of cooperation and its perspectives established by Kyrgyz Republic with international organizations in the field of security. Since declaring independence, Kyrgyz Republic has been faced with a myriad of problems that require urgent and effective solutions. One of the main issues on the agenda of the new independent state was the problem of security. The reason lied in the fact that the international, regional and internal security mechanisms, which existed before the collapse of the USSR system, became ineffective in dealing with the current problems that threatened new international actors such as Kyrgyzstan, which did not have enough experience in protecting their national interests. Thus, Kyrgyz Republic needed to establish new mechanisms with the purpose of protecting its national security. In this respect, cooperation with various international and regional organizations in the field of security has become one of the main strategies for the formation of a new system in protecting national security for sovereign Kyrgyzstan. Indeed, at the present stage as far as the development of international relations and international law is concerned, the role of international organizations has significantly increased, and they have become centers of cooperation on many global and regional issues. It is also worth noting that many international, governmental and non-governmental organizations have shown significant interest and displayed initiative in the development of cooperation with Kyrgyz Republic on the issues of security, peace and stability in the country and in the Central Asian region. This is largely due to the geopolitical position of Kyrgyzstan, which is located near precarious regions (for example, Afghanistan), as well as major international players as Russian Federation and China. Kyrgyz Republic, in turn, strives for closer and mutually beneficial cooperation with most countries of the world with a view to establish comprehensive and equitable relations with them. Thus, international cooperation, active participation in international security organizations became the new geopolitical strategy of Kyrgyzstan. In this context, the aim of this study is to investigate the influence of various international organizations in the process of forming national security for Kyrgyz Republic at different levels, to evaluate the effectiveness of this cooperation as well as to consider the prospects of further development.
