In medieval legal transactions the use of the written word was only one of many ways of conducting business. Important roles were played by the spoken word and by the 'action' of ritual. The relationship between 'rituals' and literacy has been the focus of much recent research. Medieval societies which made extensive use of written instruments in legal transactions have been shown to employ rituals as well. This has ledto investigation of the respective functions of written instruments and legal rituals. What is the nature of legal rituals? If they included oral verbalization, how did the spoken words relate to those of the written instruments that played a role in the same legal transactions? Usually, we only have the written documents to answer these questions, and they are often silent about the rituals and oral elements of the transactions they document

New technologies, climate change, infectious diseases and major crises like the BSE-affair make us realize that our knowledge of risks threatening our society is very limited. The shaping of the responsibilities of our physical safety has to be rethought. The WRR makes a strong case that government, companies and citizens alike should learn to cope pro-actively with uncertainties. This way they can be more aware of the vulnerability of nature, society and the people in it. The council gives suggestions how the government can stimulate this process. - De zorg voor fysieke veiligheid is met steeds meer onzekerheden omgeven. Nieuwe technologieën, maar ook de klimaatproblematiek, nieuwe infectieziekten en grote incidenten zoals de BSE-crisis, doen ons beseffen dat kennis over risico's voor de samenleving beperkt is. De vormgeving van verantwoordelijkheid voor fysieke veiligheid moet daarom op een nieuwe leest worden geschoeid. De Wetenschappelijke Raad voor het Regeringsbeleid bepleit dat overheid, bedrijven en burgers proactief leren omgaan met onzekerheid, om zodoende bewuster te worden van de kwetsbaarheid van mensen, samenleving en natuurlijke omgeving. De raad doet in dit rapport suggesties voor de wijze waarop de overheid dit proces kan bevorderen.

Article 34 of the European Convention on Human Rights prescribes that individual applications must be directed against one of the Convention States. Consequently, private actors involved in proceedings against other private actors before domestic courts must complain about State (in)action in their application to the European Court of Human Rights. In other words, originally 'horizontal' conflicts must be 'verticalised' in order to be admissible. Although such verticalised cases make up a large portion of the Court's case law, the particular nature of these cases, as well as procedural issues that may arise in them, has not received much attention. To fill this gap, this book offers a detailed examination of verticalised cases coming before the Court. The characteristics of and the Court's approach to verticalised cases are explored by means of an in-depth analysis of four types of verticalised cases (cases related to one's surroundings; cases involving a conflict between the right to reputation and private life and the right to freedom of expression; family life cases; and employer-employee cases). On the basis of this analysis, it is argued that the Court's current approach to verticalised cases poses problems for private actors, Convention States and the Court itself. In presenting recommendations for the resolution of these problems, the book concludes with a proposal for a new approach to verticalised cases, consisting of a redesigned third-party intervention procedure.
