En este artículo se analiza la naturaleza de las campañas negativas llevadas a cabo en Méxicoen dos elecciones presidenciales (2000 y 2006). El objetivo es evidenciar que su difundida utilización coincide con el desarrollo de dos procesos electorales peculiares: el de la transición del partido de Estado a otro de oposición (2000) y la de su consolidación como gobierno (2006). Con base en las propuestas teóricas de Shiv (1997), Lau (1999) y Finkel (1998), se describe el desarrollo de las campañas negativas en aquellas elecciones que representaron el punto de inici oy la supuesta culminación de la utilización de este tipo de campañas. Con base en el registro documental de periódicos y el seguimiento de los spots emitidos en televisión en ambas elecciones, se concluye que la elección presidencial del año 2000 evidenció la aplicación de campañas negativas basadas en la crítica al partido oficial, mientras que en la elección del 2006, se instala el uso del spot negativo en televisión.
La Constitución de la República Federal del Brasil de 1988 estableció un conjunto de competencias privativas del Tribunal Supremo Federal para ejercer el control jurisdiccional. Consagra un tribunal competente para decidir las acciones abstractas de inconstitucionalidad contra la mayoría de las disposiciones legales, independientemente de las situaciones específicas a las que se aplican. Este sistema concentrado de control jurisdiccional coexiste con la simultaneidad de los dos modelos tradicionales. El artículo desarrolla la ideología judicial que domina el discurso de la Corte Suprema el cual se mantiene fiel a la imagen de Kelsen de ser un "legislador negativo".
This paper is inspired by Thomas Pogge's book World Poverty and Human Rights. Pogge explores the moral implications of the extent and severity of world poverty for us —the citizens of affluent countries. In doing so, he assumes the familiar distinction between positive and negative duties. As Pogge puts it: There are two ways of conceiving such poverty as a moral challenge to us: we may be failing to fulfill our positive duty to help persons in acute distress; and we may be failing to fulfill our more stringent negative duty not to uphold injustice, not to contribute to or profit from the unjust impoverishment of others. (Pogge 2008 203, italics in original). While negative duties are acknowledged by a vast majority of Western ethical and political thinkers, positive duties are often contested as unjustified or supererogatory. Pogge, in his attempt to argue that eradication of world poverty is morally required, goes on to argue that we are failing to fulfill our negative duties towards the global poor. Thus, his argument is designed to convince adherents of a lot of different schools of thought that action against poverty is necessary. Relying for a start on a common sense understanding of the distinction between negative and positive duties, I will explore Pogge's argument. Then, by looking at various accounts of how the positive/negative distinction could be spelled out, I will show that Pogge's argument fails to establish that the citizens of the affluent countries are violating their negative duties towards the global poor. However unfortunate a result for Pogge's argument that might be, it is not devastating for the case of duties towards the poor. As I will scrutinize the aforementioned accounts of the positive/negative distinction it will turn out that this distinction cannot be upheld. We therefore need a different account of duties, one that will do away with the artificial sharp line between negative and positive duties. I will gesture towards such an account at the end of my paper and suggest that on such an account we will have reason to accept that we do have a duty to help the global poor.
This current article, a result of a historic hermeneutic research, aims to highlight how the indigenous people have been able to, along the path of the modern indigenous movement, take advantage of the political opportunities offered by the context, in order to boost their identity and in it, its mobilization. As in the recovery of their identity, the construction as a collective and political subjects, have gained stature and political muscle by collating their identity with that of other actors and with that of the state, to which they compete for values, rights, and respect, for their identity. They have shaped the social actor of major prominence, as well as the capacity of summon, and this is what places them in the vanguard of the social struggle.
El presente artículo tiene como objetivo primario clasificar la experiencia uruguaya de post - dictadura dentro del esquema teórico de la justicia transicional. Específicamente, busca establecer si en Uruguay puede afirmarse que se implementaron o no mecanismos de justicia transicional. Luego de señalar un grave problema epistemológico asociado con la emergencia del concepto de justicia transicional, se repasa brevemente la extensión de dicho problema, una vez que este enfoque comenzó a aplicarse en América Latina. Acto seguido, se exponen algunas dimensiones de análisis que permiten establecer las condiciones de posibilidad de la justicia transicional en general. A continuación, se estudia el caso uruguayo, mostrando que no puede ser entendido como un caso positivo de justicia transicional. Finalmente, el artículo se cierra con un apartado de reflexiones finales. ; This article aims primarily to classify the Uruguayan experience of post - dictatorship within the theoretical framework of transitional justice. Specifically, it seeks to establish if it can be said that transitional justice mechanisms were implemented or not in Uruguay. After pointing out a serious epistemological problem associated with the emergence of the concept of transitional justice, it briefly reviews the extent of that problem once this approach began to be implemented in Latin America. Then, some dimensions of analysis that establish the conditions of possibility of transitional justice in general are exposed. After that, the Uruguayan case is studied, showing that it cannot be understood as a positive case of transitional justice. Finally, the article ends with a section of concluding remarks.
The courts have been consistently affirmed as politically neutral. The classical division of political power favored it. However, gradually, this situation has come to know a strong impetus for change. The courts acquired an increasing role in the political system in most western countries. After analysis of the nature and evolution of some Constitutional Courts, among others, the Austrian, Italian, Spanish or Portuguese. Proceeds to the distinction, but also the forms of joint concentrated inspection models with diffuse control. For such analyzes the process of establishing the Portuguese Constitutional Court, verifying its competence in legal matters. Finally and in this context, in tension with the principle of separation of powers, verify the existence of decisions that affirm the legislative «character» of a Constitutional Court. ; Los órganos de jurisdicción han sido de forma constante afirmados como políticamente neutros. La clásica división del poder político ha favorecido esta situación. De cualquier modo, progresivamente, esta situación ha venido a conocer una fuerte dinámica de cambio. Los órganos de jurisdicción han alcanzado un creciente protagonismo dentro del cuadro del sistema político en la mayor parte de los países occidentales. Luego de analizar la naturaleza y la evolución de los diversos Tribunales Constitucionales, entre los que constan de sistemas jurídicos como el austríaco, el italiano, el español o el portugués, se procederá a la distinción y a las formas de articulación de modelos de fiscalización concentrada con fiscalización difusa. Para tal, se analizará el proceso de creación del Tribunal Constitucional Portugués, verificando su competencia en materia jurídica. Finalmente, y en este ámbito, en conflicto con el principio de separación de poderes, verificamos la existencia de decisiones que afirman el «carácter» legislativo de este Tribunal Constitucional, como de otros.The courts have been consistently affirmed as politically neutral. The purpose is to establish that the generalized use of negative campaigning concurs with the development of two unusual electoral processes: the transition of the State party into an opposition party (2000), and its consolidation as government (2006). Based on the theoretical claims of Shiv (1997), Lau (1999), and Finkel (1998), the author describes the development of negative campaigns in those elections that represented the starting point and the presumed consummation of the use of this kind of campaigns. With journals' documented records and the monitoring of tv spots of both elections it is established that the 2000 presidential election used negative campaigns based on decrying the official party, while the 2006 election resorted to negative tv spots.
The phenomenon of the extension of markets and companies to world dimensions, called globalization, is by nature an issue that involves markets and companies. However, as it is a trend that affects members of society, it also commits States and governments. Therefore, we are witnessing a process that offers advantages and positive aspects for a few, but which generally entails institutional inconsistencies, negative effects and, of course, resistance of various kinds. ; El fenómeno de extensión de los mercados y de las empresas hacia dimensiones mundiales, denominado globalización,es por naturaleza un asunto que involucra a los mercados y a las empresas. Sin embargo, por tratarse de una tendencia que afectaa los miembros de la sociedad, compromete también a Estados y a gobiernos. Asistimos por tanto, a un proceso que ofrece ventajas y aspectos positivos para unos cuantos, pero que de forma generalizada, acarrea incongruencias institucionales, efectos negativos y desde luego resistencias de diversa índole. El llamado por un mercado más involucrado en la vida pública es en parte una respuesta a la globalización y a la noción de que el gobierno y otros actores tradicionales no pueden diseñar e implementar políticas públicas en un vacío económico y financiero, sin tener en cuenta las empresas y su inversión. Significa que en condiciones de globalización, la relación entre los actores del Estado y del mercado no es adversaria, ya que la gobernanza tiende a desdibujarlas fronteras que alguna vez delimitaron sus funciones.
The return of democracy socially meant the building of a political promise of possible reparation for Argentine society. As a cultural project, it was capable to condense the widespread fantasies of justice and the desires for freedom that were seized by the cruel night of dictatorial terror. But the effects of subjectivation produced by the repressive imaginaries and especially, by their remnant in the public apparatus of political representation will give way to the articulation of underground structures of disillusionment in the margins of the new democratic common. Faced with the silent and shadowed permanence of the repressive power, enraged with the hypocrisy of political duty while distanced from modern utopian projects regarding the transformation of the real, a new matrix of alternative political action was conjugated: a type of sensibility connected with the anarchist heritage that will mostly make use of affects rendered negative like procrastination, grudge, chemical delirium, blasphemy and sexual debauchery as part of its privileged expressive language. The intersectional work of feminists, sex perverts, alcoholic poets, transhumant anarchists, punks, vagrants, sex workers, underground stars and other left melancholics has produced a series of events hitherto little revisited in the historiographies of the post-dictatorial Destape such as The Pagan March (1986) and the Commission in Repudiation of the Pope (1987). This presentation aims to value these experiences as paradigmatic cases in which these expressive languages based on the sensible power of disconformity and dissociation were implemented, operating as strange forms of reverie that rehearsed new affective repertoires for an antagonistic political imagination. ; El retorno de la democracia significó, socialmente, la edificación de una promesa política de posible reparación para la sociedad argentina. Como proyecto cultural, supo condensar las extendidas fantasías de justicia y los deseos de libertad arrebatados por la noche cruel del terror dictatorial. Pero los efectos de subjetivación producidos por los imaginarios represivos y, especialmente, su remanencia en los aparatos públicos de la representación política, darán paso a estructuras subterráneas de la desilusión, pronunciadas desde los márgenes del nuevo común democrático. Frente a la permanencia silenciosa y ensombrecida del poder represivo, entonces, se conjugará una nueva matriz de acción política alternativa; un tipo de sensibilidad conectada con la herencia anarquista, enfurecida con la hipocresía del deber político y distanciada de los proyectos utópicos modernos de transformación de lo real. Esta nueva sensibilidad, principalmente, hará del uso de afectos considerados negativos, como el rezagamiento, el rencor, el delirio químico, la blasfemia y el libertinaje sexual, su lenguaje expresivo privilegiado. This work explores the textual space between fiction, autobiography, political discourse, and historical discourse in the specific circumstances of Chilean colonial texts, where the theme of war functions as a basis for the text and informs its subjectivity. With regard to Francisco de Pineda y Bascuñán's Cautivero Feliz., this piece proposes that the overlap between subjectivity, history, scripture, and war, figures in Chilean colonial dialogues as a "history of consciousness" founded in critical negativity, in such a way that the narrative setting of the War of Chile exposes a story of Modern History. ; Este trabajo explora el espacio escritural existente entre la ficción, la autobiografía, el discurso político y el discurso histórico en las circunstancias específicas de escrituras coloniales chilenas, cuyo tema es la guerra que funda la escritura e informa la subjetividad que escribe. A propósito de Cautiverio feliz… de Francisco de Pineda y Bascuñán, el trabajo propone que la superposición entre subjetividad, historia, escritura y guerra configura en las letras coloniales chilenas una "historia de la conciencia" fundada en la negatividad crítica, de tal manera que la puesta en relato de la guerra de Chile expone una historia de la Historia Moderna.
Este trabajo se plantea como una exploración conceptual de las relaciones entre negatividad y ficción. Se trata de una indagación planteada a modo de comparación entre dos textos precisos de dos de los pensadores que más han pensado la negatividad desde la estética, Julia Kristeva y Theodor Adorno, con el fin de constelar sus propuestas y derivar de ellos una posible aproximación a las relaciones entre literatura y política. ; This paper is intended as a conceptual exploration of the relationships between negativity and fiction. This is a conceptual inquiry proposed as a comparison between two texts of two of the thinkers who have most thought about negativity from an aesthetic point of view, Julia Kristeva and Theodor Adorno, with the aim of making a constellation of their proposals and deriving from it a possible approach to the relations between literature and politics.
This research aims to analyze the degree of insertion of the variables of peace and negative peace (Galtung, 1969a) of each one of the parties during the Colombian Peace dialogue between the National Government and the FARC-EP (2012-2016). The research seeks to fill the gap in the analysis of the peace approaches taken by each one of the parties at La Havana peace dialogues based on the theories of Galtung (1965, 1969a, 1969b, 1971, 1990), Fisas (2005) and Lederach (1995, 2016). The qualitative methodology is based on seven indepth interviews carried out with some of the negotiators as well as two interviews with the international actors. The analysis developed using the Fuzzy Sets Theory concludes that the National Government was oriented towards a negative peace, while the FARC-EP was oriented towards a positive peace. This work is part of a growing field in the research of the Colombian peace accord as a guarantee to a transition towards a peaceful society. ; Esta investigación busca analizar el grado de inserción de las variables de paz positiva y negativa (Galtung, 1969a) de cada una de las partes durante el diálogo de paz colombiano entre el Gobierno nacional y las Fuerzas Armadas Revolucionarias de Colombia (FARC-EP), entre 2012 y 2016. La investigación espera llenar el vacío existente en el análisis de las posturas y visiones de paz de cada una de las partes en los diálogos de La Habana. Con base en los trabajos teóricos de Galtung (1965, 1969a, 1969b, 1971, 1990), Fisas (2005) y Lederach (1995, 2016), la investigación se centra en la paz positiva y negativa, y en el proceso de diálogo. La metodología cualitativa utilizada consiste en siete entrevistas en profundidad realizadas con algunas de las personas que hicieron parte de las delegaciones de paz, así como dos entrevistas con actores del componente internacional. El análisis, desarrollado a partir de la Teoría de Conjuntos Difusos, concluye que la delegación del Gobierno nacional se orientó hacia una paz negativa, mientras que las FARC-EP se orientaron hacia una paz positiva. La investigación es parte de un campo creciente dedicado al estudio del Acuerdo de Paz colombiano como garantía para la transición hacia una sociedad en paz.
This article is intended to analyze Benjamin's interpretation of Kafka from the perspective of tradition. The revision of the said concept is here studied whithin the context of Benjaminian late works. The notions of aggadah and halacha are then central for the structure of his reflections. Thus, this paper aims at tracking the elements involved in the elaboration of a political theory that allowed Benjamin to recover Kafka for his political renewal of the concept of humanity. ; El presente artículo se propone analizar la interpretación benjaminiana de Kafka tomando como eje central el problema de la tradición y su resignificación política en el contexto de producción tardío. Son relevantes en este sentido, los conceptos de hagadá y halajá con los que Benjamin estructura sus análisis. El objetivo es entonces rastrear los elementos que en la elaboración de una teoría política permiten recuperar al narrador checo para la revisión de un concepto de lo humano.
