With the arrival of the constitutional State, some discussions have been presented and renewed in front of the theory of law with antagonistic positions and in the key of a dilemma. At one extreme would be a conception that proposes a model of rules, subsumption, separation between law and morality, primacy of legislation over jurisprudence and a science of descriptive law; while, at the other extreme, there would be a conception that defends a model of principles, consideration, right and moral linkage, primacy of jurisprudence over legislation and a science of prescriptive law. These poles are the two paradigms that the national doctrine wants to face as opposing theories of law corresponding to the before and after the 1991 Constitution, when the relationship between the models is not really dichotomous nor exclusive, but rather of continuation and complementation, as it will develop in this article. ; Con la llegada del Estado constitucional se han presentado y renovado algunas discusiones frente a la teoría del derecho con posturas antagónicas y en clave de dilema. En un extremo estaría una concepción que plantea un modelo de reglas, subsunción, separación entre derecho y moral, primacía de la legislación sobre la jurisprudencia y una ciencia del derecho descriptiva; mientras, en el otro extremo, estaría una concepción que defiende un modelo de principios, ponderación, vinculación derecho y moral, primacía de la jurisprudencia sobre la legislación y una ciencia del derecho prescriptiva. Estos polos son los dos paradigmas que quiere enfrentar la doctrina nacional como teorías del derecho contrapuestas correspondientes al antes y después de la Constitución de 1991, cuando realmente la relación entre los modelos no es dicotómica ni excluyente, sino de continuación y complementación, tal como se desarrollará en este artículo. ; Com a chegada do Estado constitucional surgiram e se renovaram algumas discussões diante da teoria do direito com posturas antagônicas e em termos de dilema. This paper aims to explore the functions of the theory of legal argumentation (TLA) on Constitutional States and will especially focus on the political and self-reflective functions of the TLA within the framework of a neo-constitutionalistic legal theory. The first part of the paper includes a definition of the TAL and an analysis of its main functions. At the end of the paper the author provides the bases for the development of a neoconstitutionalistic legal theory.

En este artículo indago acerca de la compatibilidad del modelo de filosofía jurídica de Ronald Dworkin con el neoconstitucionalismo y otras versiones del constitucionalismo. La tesis que defiendo es que el constitucionalismo sustantivo de Dworkin, considerado en el contexto de su teoría del derecho como moral política institucionalizada, es incompatible con las tesis fundamentales que, tanto sus partidarios como sus detractores, atribuyen al neoconstitucionalismo, así como con otros modelos que toman a la Constitución como una especie de justificativo de segundo orden de principios y valores, un puente entre el derecho y la moral o un determinante de la exclusión de las reglas del razonamiento jurídico. ; In this paper I inquire about the compatibility of Ronald Dworkin's legal philosophy model with neo-constitutionalism and other versions of constitutionalism. My point is that the substantive constitutionalism of Dworkin, considered in the context of his theory oflaw as institutionalized political morality, is incompatible with the fundamental theses that both his supporters and his detractors attribute to neoconstitutionalism, as well as other models that take the Constitution as a kind of second-order justification of principies and values, a bridge between law and morality or a determinant of the exclusion of the rules of legal reasoning. ; Facultad de Ciencias Jurídicas y Sociales

The purpose of this paper is to present a brief historical description of the development of migratory flows to Ecuador. In the first part of the work, two well-differentiated historical cohorts are analyzed. First, we analyze Arab, Spanish, Jewish and German immigration at the beginning and middle of the 20th century. Second, there is a description of Colombian and Peruvian immigration at the end of the 20th century and the beginning of the 21st century. This part contains a descriptive work, its contribution consists in grouping the antecedents, development and effects of the different migratory flows in a single article, given that the existing research works are scattered and incomplete. In the second part of the paper, the current legislation and universal citizenship are analyzed in order to reflect on the current migration policy, the exercise of rights within the framework of free human mobility. En la primera parte del trabajo, se analizan dos cohortes históricas bien diferenciadas. Primero, se analiza la inmigración árabe, española, judí­a y alemana a principios y mediados del siglo XX. En segundo lugar, consta una descripción de la inmigración colombiana y peruana a finales del siglo XX y comienzos del siglo XXI. Esta parte, contiene un trabajo descriptivo, el aporte del mismo consiste en agrupar los antecedentes, desarrollo y efectos de los distintos flujos migratorios en un solo artí­culo, dado que los trabajos de investigación existentes son dispersos e incompletos. Resumen: El cambio del siglo XXI en Argentina, Brasil y Uruguay fue un viraje político novedoso ya que accedieron al poder fuerzas políticas con raíces o vínculos históricos con el sindicalismo. En este sentido, el presente escrito busca describir las características que adquirió la relación entre la política y el sindicalismo a lo largo del siglo XX en los tres países, para advertir comparativamente cómo las condiciones de la génesis y los mecanismos de desarrollo y refuerzo positivo del vínculo preanuncian un patrón o sendero hacia esta nueva época; es decir, delinean una estructura de oportunidad política para el acceso al gobierno de fuerzas políticas con bases históricamente en el movimiento sindical. ; Abstract: Abstract: The Lectio brevis made at the beginning of the Academic year in the Faculty of Law (UCA) analyzes, following the decision in "Castillo c/ Ministerio de Educación de Salta", of the Supreme Court of December 12, 2017, two legal-political phenomena of the last decades in the precedent scope of the Superior Courts: on the one hand, via the model of neoconstitutionalism, the judges have taken the task of redefining the current law, departing especially from the literality of the legal text, under paradigms, principles and ideas somewhat alien to the just, to the reality of the legal. On the other hand, this modality has also served to secularize education, even under Constitutions that do not ignore the religious, applying the topic of neutrality. RESUMEN: Los cambios en la nueva concepción del Estado Democrático de Derecho que surgen a partir de la toma de conciencia de la existencia de determinados derechos que se consideran como fundamentales por la comunidad internacional, influyen de modo directo en el diseño de políticas públicas, de creación de normas jurídicas y en el modo de resolver los casos judiciales. Es así que se presenta a la Teoría Neoconstitucional como una nueva teoría del derecho que permite integrar los derechos con sus respectivas garantías, y que se ocupa tanto de las normas como de los principios y los valores de Derechos Humanos y de su internalización en los ordenamientos de los Estados, es decir, se ocupa del fenómeno de mundialización de estos derechos. Dentro de los derechos fundamentales encontramos los que poseen las mujeres en lo que concierne a vivir una vida libre de toda violencia en la que se respete su dignidad y autonomía de la voluntad, amén de que los índices de violencia contra ellas aumentan día a día en todos los países del mundo. De este modo los Estados deberán cumplimentar con las medidas de acciones positivas tendientes a garantizar el efectivo goce de los derechos reconocidos por los Pactos internacionales de Derechos Humanos.ABSTRACT: The changes in the new conception of the Democratic State of Law that arise from the awareness of the existence of certain rights that are considered fundamental by the international community, have a direct influence on the design of public policies, the creation of legal norms and how to solve judicial cases. This is how the Neoconstitutional Theory is presented as a new theory of law that allows integrating rights with their respective guarantees, and that deals with both the norms and the principles and values of Human Rights and their internalization in the legal systems. of the States, that is, deals with the phenomenon of globalization of these rights. Within the fundamental rights we find those that women possess in what concerns to live a life free of all violence in which their dignity and autonomy of the will is respected, in addition to that the indices of violence against them increase every day in all the countries of the world. The general objective that guides the construction and systematization of the ideas that are articulated in this work, aims to highlight the need and relevance as well as to identify contributing and limiting factors regarding the social, legal and political use of constitutional jurisprudence as an instrument of social innovation and development through the justice system, in the context of the institutionalization of the set of paradigms emanating from the Fundamental Text of 2008: the constitutional State of rights and justice, neoconstitutionalism, the constitutionalization of the legal system, the constitutionalization of justice and the constitutional democracy, and subject to the premise with respect to which the Law emerged from the Constitution of Montecristi, which is a law that becomes constitutionalized in its integrality, has an enormous emancipatory potential and is capable, under certain historical conditions. , social and pol ticas, to promote fundamental changes in society. In this line of thought, it is postulated as a central idea that constitutional jurisprudence, elevated to the category of direct source of the national legal order, is an element of social innovation and development if and only if it is given social, legal and social use. Constitutional jurisprudence, in the new constitutional State of rights and justice designed by the Constitution is a powerful social, political and legal instrument in the hands of judges and citizens, to favor the changes and social innovations in democracy that the project entails transforming political content in the Montecristi Charter. ; El objetivo general que guía la construcción y sistematización de las ideas que se articulan en este trabajo, apunta a resaltar la necesidad y pertinencia así como identificar factores coadyuvantes y limitantes acerca del uso social, jurídico y político de la jurisprudencia constitucional como instrumento de innovación social y desarrollo a través del sistema de justicia, en el contexto de la institucionalización del conjunto de paradigmas emanados del Texto Fundamental de 2008: el Estado constitucional de derechos y justicia, el neoconstitucionalismo, la constitucionalización del ordenamiento jurídico, la constitucionalización de la justicia y la democracia constitucional, y con sujeción a la premisa respecto de la cual el Derecho surgido a partir de la Constitución de Montecristi, que es un Derecho que deviene constitucionalizado en su integralidad, encierra un enorme potencial emancipatorio y es capaz, bajo determinadas condiciones históricas, sociales y políticas, de promover transformaciones fundamentales en la sociedad. En esta línea de pensamiento, se postula como idea central que la jurisprudencia constitucional, elevada a la categoría de fuente directa del ordenamiento jurídico patrio, es un elemento de innovación social y de desarrollo si y sólo si se le da el uso social, jurídico y político que entraña el Texto Fundamental. La jurisprudencia constitucional, en el nuevo Estado constitucional de derechos y justicia diseñado por la Constitución es un potente instrumento social, político y jurídico en manos de los jueces y de la ciudadanía, para favorecer los cambios y las innovaciones sociales en democracia que comporta el proyecto político transformador contenido en la Carta de Montecristi.
