The paper examines the relationship of legal normativity and the Russian mentality, its peculiarity and specificity of symptoms. It is emphasized that mentality as a sociocultural phenomenon and a factor of political behavior is determined by the quality and condition of the social environment in which it is inscribed. The authors focus on the fact that the idea of the Russian state is prevailed by specialness, exclusiveness, uniqueness of the Russian way with total passivity and non-involvement of the people in the state affairs, lack of initiative in the creation of civil society. It is noted that the practice of implementation of legal normativity should be combined with observing the law not only by citizens, but also by officials, otherwise the humiliating and helpless feeling of complete lawlessness will dominate at the level of mentality. ; В статье рассматривается взаимосвязь правовой нормативности и российской ментальности, ее особенность и специфика проявления. Подчеркивается, что ментальность как социокультурный феномен и фактор политического поведения определяется качеством и состоянием социальной среды, в которую она вписана. Акцентируется внимание на том, что в идее российской государственности превалирует особость, исключительность, уникальность русского пути при общей пассивности и не включенности народа в государственное дело, безынициативности в вопросах создания гражданского общества. Отмечается, что практика реализации правовой нормативности должна сочетаться с соблюдением закона не только гражданами, но и должностными лицами, иначе в уровне менталитета будет доминировать унизительное и беспомощное ощущение полного бесправия.
The paper features the problem of the interpersonal relations of the civil servants with the different level of social normativity. Harmony / disharmony of the interpersonal relations caused by a social and psychological distance between the interacting subjects prove to be the indicators of personnel risk for the organization. A change of a distance manifests of personnel risk, whereas a disharmony of the interpersonal relations in the business sphere poses a threat of personnel safety. Various empirical researches showed that regulatory civil servants seek to build such an acceptable distance in interpersonal interaction that would provides trust, emotional proximity, and a readiness for joint activity. On the contrary, non-regulatory government employees build a larger distance according to their personal traits. They reveal a deeper trust in themselves than in the partner, a lesser emotional proximity and no compatibility orientation. For regulatory employees, personnel riskis in a narrowing the distance, which may result in mixing the business and emotional relations, e.g. relations without concern for the status of the partner in the team. For non-regulatory employees, risk can manifest in an excessive distancing from colleagues, formalization of the relations, as well as criticism and depreciation of the partner. The empirical data obtained can be used for the development of personal and professional qualities of the civil servants, in particular for formation of flexible skills of a social and psychological distance in interpersonal interaction. It is important to use the principle of the differentiation assuming ability to differentiate forms of relationship and to build new interrelations between them. ; В статье с привлечением эмпирического материала рассматривается проблема межличностных отношений государственных гражданских служащих с разным уровнем социальной нормативности. Показано, что гармоничность / дисгармоничность межличностных отношений, обусловленные социально-психологической дистанцией между взаимодействующими субъектами, являются индикаторами кадрового риска для организации. Изменение дистанции в неблагоприятную для субъектов сторону будет являться проявлением кадрового риска, тогда как дисгармоничность межличностных отношений в деловой сфере – угрозой кадровой безопасности организации. Результаты эмпирических исследований показали, что нормативные государственные гражданские служащие стремятся выстраивать приемлемо сближенную для себя дистанцию в межличностном взаимодействии, которая обеспечивает доверие, эмоциональную близость, желание осуществлять совместную деятельность. Ненормативные госслужащие выстраивают приемлемо удаленную для себя дистанцию, обусловленную их личностными особенностями. В межличностном взаимодействии у них выражено большее доверие к себе, чем к партнеру (коллегам), их отношения отличает меньшая эмоциональная близость и ориентация на совместность. У нормативных служащих кадровым риском может выступать сокращение дистанции, приводящее к смешиванию деловых и эмоциональных отношений. Одним из проявлений этого может являться выстраивание отношений без учета статуса партнера в трудовом коллективе, ситуации, в которой разворачивается межличностное взаимодействие. У ненормативных служащих кадровым риском может стать чрезмерное дистанцирование от других людей, формализация отношений в сочетании с критикой и обесцениванием партнера (его идей и проектов) в межличностном взаимодействии. Полученные в ходе исследования эмпирические данные правомерно использовать в рамках развития личностно-профессиональных качеств государственных гражданских служащих, в частности для формирования навыков гибкого выстраивания социально-психологической дистанции в межличностном взаимодействии с учетом принципа дифференцирования, предполагающего умение видеть, дифференцировать формы отношений и выстраивать между ними новые взаимосвязи.

Рассматривается специфика устава муниципального образования как акта, обладающего высшей юридической силой по сравнению с другими муниципальными правовыми актами. Рассматривается соотношение юридической силы устава муниципального образования и актов, принятых на референдуме и сходе граждан. Анализируются некоторые особенности других актов, составляющих систему муниципальных правовых актов.
In the presented scientific article, the authors consider legal terminology and term creation in the process of preparing normative legal acts in the Kyrgyz Republic. According to the authors, the definitions of a legal term must adequately reflect the essence and content of the defined concept, each normative concept must be assigned its own and strictly unambiguous term, once and for all given to the branches of the law using the corresponding concept. The qualitative optimization of the normative prescription and the effective use of normative legal terminology in the texts of legal acts is considered in legal science and practice as an integral part of the improvement of legislation.
The article investigates the problem of universality of legal principles based on theanalysis of the concept of principles of law and their basic properties, the following questionsare examined: to what extent the principles of law are objective, and what are thecriteria for giving legal status to the ideas of principles of law, whether legislative designof principles is their attribute or due to the understanding of the "spirit" but not the "letter"of the law, they do not need such consolidation, and finally, to what extent the principlesof law are conditioned by the historical continuity of legal regulation. The authors analyzethe basic properties of law principles, allowing to consider them as the universal flexiblemeans which are capable to correlate changes in objective law with the basic law, with itsprimary ideological component, and to provide a balance between objective and subjectivelaw. ; В статье исследуется проблема универсальности правовых принципов в основе анализа понятия принципов права и их основных свойств рассматриваются вопросы: насколько принципы права обладают объективностью, каковы критерии придания правовым идеям статуса принципов права, является ли законодательное оформление принципов их атрибутом или, исходя из понимания «духа», а не «буквы» закона, они не нуждаются в таком закреплении, и наконец, насколько принципы права обусловлены исторической преемственностью правового регулирования. Авторы анализируют основные свойства принципов права, говорить о них как об универсальных гибких средствах, позволяющих соотносить изменения объективного права с основами права, с его идейной начальной составляющей, способных обеспечить реализацию баланса между объективным и субъективным правом.
Attitudes towards various manifestations of human sexual behavior remain one of the actual legal and medical problems for both society and specialists. About forty years ago medical and moral understanding of the norm of sexual behavior was universal and unambiguous, but this situation has changed significantly over the past decades. In some societes, the principle of the so-called social homonormativity – the understanding of same-sex sexual behavior and self-identification as a form of medical and moral norms – has been institutionalized. In societies in which the understanding of the norm of sexual behavior is not based on homonormativity, some political movements and organizations actively pursue their goals to such a change in medical, moral and legal principles, which consolidates any forms of social activity based on homonormativity. One of the claims used by these movements is the assertion that "homosexuality is a kind of norm for humans, because it is common among more than 1500 species of animals". The pitfall with this statement is that it is based on the anthropomorphic interpretation of animal behavior, as well as on the selective transfer of the phenomena of the animal world to human life. In this review article, the authors consistently disprove all aspects of the application of the claim that "homosexual behavior is prevalent in the animal kingdom" in a discussion on the topic of same-sex human behavior. Interpretation of the observed cases of same-sex behavior in animals to assess any medical, moral or legal normativity of the same-sex behavior in human beings is biased, it avoids other forms of non-productive behavior of animals, which, within an anthropomorphic interpretation, can be used as phenomena that justify human incest, child abuse or bestiality.
The article defines the urgency of the cadets' patriotic education and the importance of socioeducational environment in the cadets' patriotic education. It analyzes the normative documents, the literature on the patriotic education. The author justifies the need to integrate the academic subjects' content of civil law disciplines designed with the help of new information technologies. The civil-patriotic values (peace, homeland, duty, honor, dignity, responsibility, patriotism, citizenship, etc.) contributing to the socialization of the cadet's personality were identified. The particular importance was given to the socio-educational environment as a condition for patriotic education. The concept "environment" was analyzed, and the socio-educational environment functions were determined. The paper describes the specific features of the socioeducational environment of the military educational and scientific center of the Air Force "Air Force Academy". Three socio-psychological parameters of the higher school socioeducational environment (active interaction, subject-subject relationship, rigid normativity and authoritarianism) were identified. ; Определяется актуальность проблемы патриотического воспитания курсантов, значение социообразовательной среды в патриотическом воспитании курсантов. Указаны нормативные документы по проблеме. Определены основные направления исследований по проблеме патриотического воспитания, проанализированы позиции ученых на данную проблему. Отмечается необходимость интеграции содержания учебных предметов, в том числе гражданско-правовых дисциплин, воспитательного потенциала специальных курсов, разработанных с учетом новых информационных технологий. Выделяются гражданско-патриотические ценности (мир, Отечество, Родина, долг, честь, достоинство, ответственность, патриотизм, гражданственность и т. д.), способствующие социализации личности курсанта. Особое значение уделено социообразовательной среде как условию патриотического воспитания, проанализировано понятие «среда», выделены функции социообразовательной среды. Определены особенности социообразовательной среды военного учебно-научного центра военно-воздушных сил «Военно-воздушная академия». Выделены три социально-психологических параметра социообразовательной среды вуза (активное взаимодействие, субъект-субъектное отношение, жесткая нормативность и авторитарность).
The article examines three groups of technologies for creating moods in advertising: modeling technology senses the reaction to advertising; Information technology impacts; technology influence through normative value. A detailed analysis of the content of these technologies allows to focus its efforts on the use of special methods of action undertaken within the boundaries of each technology.
The paper is dedicated to the key methodological problems of international and regional studies and the prospects for the formation of a unifi ed, «seamless» methodology. The author's refl ections are illustrated by examples from the collective monograph, ed. by Alexei D. Voskressenski "The Logic of the New World Architectonics and the Strategies of the Powers" (2021). At the fi rst stage, the question of the levels of analysis in international studies is investigated with a special emphasis on the systemic level, as well as the practical diffi culties of decomposition of international political situations, taking into account the high density of social ties. The applied value of network analysis and event analysis is shown. The phenomenon of transregionalism, which is of great importance for international economic relations, is considered from a network point of view. Methodological tools for the analysis of trans-regional institutions are presented as well. Much attention is paid to the organismic concept of the general theory of the system and its adaptation to the IR system. The practical use of this concept in organizing situational analyzes of international processes is shown. The regional level of analysis and the place of the "middle-level powers" in the world system are revealed through the prism of an agent-structural "matryoshka" (nested model) – agent-structural problem at different levels ofanalysis. The limits and possibilities of application of the complexity theory in the analysis of IR are explored. Special attention is paid to the concept of complex interdependence of R. Keohane and J. Nye, which, according to the author, adequately refl ects modern IR and is the key to understanding the formation of zones of infl uence of great powers in world politics. Finally, the work reveals the normative component of IR theory and shows an increasing popularity of non-Western IR theories in the last few years. The normativity in regional studies is explored as well and particular cases of the application of non-Western approaches in regional studies are shown. The necessity of integration of non-Western approaches to IR theory and regional research is declared. ; В данной статье рассматриваются ключевые методологические проблемы международных и региональных исследований и перспективы формирования единой, «бесшовной» методологии. Авторские рассуждения иллюстрируются примерами из коллективной монографии под ред. А. Д. Воскресенского «Логика новой мироустроительной архитектоники и стратегии держав» (2021 г.). На первом этапе исследуется вопрос уровней анализа в международных отношениях с особым акцентом на системный уровень, а также рассматриваются практические сложности декомпозиции международно-политических ситуаций с учетом большой плотности социальных связей. Показано прикладное значение сетевого анализа и ивент-анализа. С сетевых позиций рассмотрен феномен трансрегионализма, имеющий важное значение для международных экономических отношений. Представлен методологический инструментарий для анализа трансрегиональных институтов. Большое внимание уделяется организмической концепции общей теории системы и ее адаптации к системе международных отношений. Показано практическое использование данной концепции при организации ситуационных анализов международных процессов. Региональный уровень анализа и место «держав среднего уровня» в мировой системе раскрывается сквозь призму агент-структурной «матрешки» (агент-структурная проблема на разных уровнях анализа). Исследуются пределы и возможности применения теории сложности в анализе международных отношений. Особое внимание уделяется концепции комплексной взаимозависимости Р. Кохейна и Дж. Ная, которая, по мнению автора, адекватно отражает современные международные процессы и является ключом к пониманию формирования зон влияния великих держав в мировой политике. Наконец, в работе вскрывается нормативная составляющая ТМО и показано повышение популярности незападных ТМО в последние несколько лет. Исследуется нормативность региональных исследований, показаны частные случае применения незападных подходов в регионоведении. Делается вывод о необходимости интеграции незападных подходов в ТМО и региональные исследования.
