From there, it is inferred for the right to be so important Constitutional, since the principal branch is the public right insofar as you participate at all of the own it stratums juridical and specially of the structure of the status like base of all institutional political organizing, reason for which to get along well like the discipline of the right entrusted of the conceptual studies of the social standings of right, the surging of the Political Constitution is vital so much seemingly as of his interpretation, from the study of his foundations to the assimilation of one hermeneutical juridical that you lead to all the governed for the standard of standards. According to the concept previously indicated, to appraise the reach of the Constitutional Interpretation in the general context of the Magna Carta making the judicial exegesis easy and his critical contents getting to an explanatory connection of any juridical and extra-juridical problem becomes necessary. ; El Estado colombiano es un Estado social de derecho (así lo define el Artículo 1º de como de su interpretación, desde el estudio de sus fundamentos hasta la asimilación de una hermenéutica jurídica que encamine a todos los gobernados por la norma de normas. A judicial decision must solve a conflict of interests, yet not in any way as judges must provide reasons to ground the solutions adopted in each case. Not all the reasons given by judges, though, carry the same argumentative value: there are decisive reasons, which make up the holding or ratio decidendi, as well as non-decisive ones, which are usually categorized as obiter dicta. In this paper we set out to analyze the "Einaudi" decision and we will strive to show how Argentina's Supreme Court of Justice makes an obiter dictum argument work in a peculiar way there: a. Without explicitly using the phrase obiter dictum; b. Not to provide supplemetary arguments within the bounderings of a specific, concrete case; and c. In order to announce and ground projectively a subsequent decision, which is both general and abstract and therefore extra-jurisdictional: Decree28/2014, of regulatory nature. ; La sentencia judicial debe resolver un conflicto de intereses, pero no de cualquier modo, ya que los jueces deben dar las razones por las que adoptan la solución de cada caso. Ahora bien, no todas las razones proporcionadas por los magistrados tienen igual valor argumentativo: las hay dirimentes -aquellas que conforman el holding o ratio decidendi- y las hay no dirimentes -aquellas que suelen ser categorizadas como obiter dicta-. En este trabajo analizaremos el fallo "Einaudi", y procuraremos demostrar cómo la Corte Suprema de la Nación Argentina hace funcionar allí de modo peculiar un argumento obiter dictum: a- sin el uso explícito de la expresión obiter dictum; b- no para argumentar en forma accesoria dentro de los límites del caso específico y concreto; c- para anunciar y para fundamentar proyectivamente una resolución posterior de carácter general y abstracto y, por ende, extrajurisdiccional, la acordada N° 28/2014, de carácter reglamentario. Studying conducted by the Indonesian Child Protection Commission (KPAI) depicts that illegal marriage is one of significant factors causing the neglect of children in the country. The government attempts to solve the problem through the way of isbath (the legal procedure to register a marriage in the governmental authority) and stating a legalisation of the parental origin of the children. This way is important in order to get recognition by the state and the people, as well as to save children born from illegal marriage. In fact, however – as this article finds out – not all the courts have granted the request of making legalisation of the parental origin of the children as happened in the case No. 0136 / Pdt.P / 2016 / Pa. Kab. Kdr. The judges' decidendi ratio (legal hermeneutics) at considering the case, is implementing the Law No. 1 (1974) on Marriage, Article 3 (2) and 4. The legal decision made by the judges has had direct implications for the children such as weakening the legal standing of children, discrimination and violating the basic human rights of the children.

O Código de Processo Civil de 2015 adotou o uso dos precedentes judiciais, almejando que as decisões proferidas pelos tribunais superiores sirvam de referência vinculante no ordenamento jurídico. No entanto, seguindo o sistema de precedentes, um precedente judicial não poderá ser aplicado de maneira infundada, há a imposição de se comparar o caso concreto com a decisão paradigma. Para tanto, cumpre analisar o elemento que compõe o precedente e que opera a eficácia vinculante às decisões judiciais, a razão que enseja à decisão (ratio decidendi). Primeiramente, a análise será em face da sua definição e, num segundo momento, como ocorre a aplicação ao caso concreto, especialmente, quando necessário o uso da técnica da distinção (distinguishing), a fim de recusar o uso do precedente.
