Bearing in mind the distinctive features of prepetition claims and postpetition claims where the former are generally classified as insolvency claims subject to restrictions as per insolvency procedures while the latter as administration claims granted the rights to be paid irrespective of insolvency procedures, one may well assert that the actual amount of realized payment will consequently be different by a significant margin. Thus, it does matter to classify straddle claims before and after the order for relief. In South Korea, the part-fulfillment test(일부구비설) is widely accepted as a common view. In pursuant to the part-fulfillment test, once a particular debt in question is affirmatively established as insolvency claims, other claims that do not fall into the category of insolvency claims but nevertheless fulfill the requirement of administration claims are deemed administration claims. Even if the claims are unliquidated, contingent, unmatured, disputed, they can be classified as insolvency claims when the significant part of the claims are fulfilled prepetition. It seemingly is due to the reception of the Japanese insolvency acts which has eventually resulted in South Korean insolvency frameworks adopting the relevant Japanese legal theories and precedents that developed on the basis of the part-fulfillment test. But the word 'the significant part of the claims' is too vague to establish a clear and consistent criterion. Among the cases of the Supreme Court of South Korea, some cases contradict each other. In Japan, a scholar following the part-fulfillment test even admits that the test has its defects as some cases of the Supreme Court of Japan are inconsistent. The 'theory of deduction(控除説)' in Japan, based on the study of history of theories about classifying claims, criticizes the present common view in Japan, the part-fulfillment test, and suggests that the claims subject to insolvency risks be insolvency claims and the claims free from insolvency risks be administration claims. It may sound like a tautology, but it pinpoints that the present part-fulfillment test is far from realizing the essence of treatment and disposition of claims, using the word 'the significant part of the claims'. However, the theory of deduction also leaves much to be desired to set a clear and consistent criterion. In the United States, timing problems of claims in insolvency have been an important research theme, making use of a substantial balancing test. Thus, the arguments in the United States serve as a good reference. The theories of the United States do not apparently dichotomize, but virtually distinguish contractual claims from non-contractual claims. When it comes to contractual claims, the claimants voluntarily enter the contracts considering insolvency risks, so it is easy to determine whether the claimants bear the insolvency risks in accordance with their intention. In contrast, as of non-contractual claims, the claimants often get the claims involuntarily. It is hard to determine, based only on the claimants' intention, whether they should be burdened with insolvency risks. Therefore, dichotomy is desirable. In case of contractual claims, almost all federal courts of appeals and scholars adopt the performance test in the United States. As of non-contractual claims, there are the accrued state law test, the conduct test, the relationship test, and the fair contemplation test in the United States. Most of federal courts of appeals follow the relationship test, while most of scholars support either the conduct test or the fair contemplation test. For contractual claims, including the ones based on executory contracts, we can accept the performance test as it is. The part contributed to a debtor prepetition by a claimant abandoning exceptio non adimpleti contractus is subject to the insolvency risks and should be treated as insolvency claims. The part induced to do business with a debtor postpetition is beneficial for the estate and thus should be treated as administration claims. For efficiency, prepetition claims should be cut off from post-insolvency as sunk costs, while postpetition claims should receive priority to induce entities to enter new business with a debtor so as to foster reorganization. In case of non-contractual claims, it is hard to tell whether the claims are supposed to bear insolvency risks or not. It is a matter of policy. Unless it is the case where Debtor Rehabilitation and Bankruptcy Act in South Korea excludes explicitly the non-contractual claims from insolvency claims, prepetition claims should be classified as insolvency claims and postpetition claims administration claims. While the meaning of 'claims' for insolvency is defined in a unique sense under the United States Bankruptcy Code so as to put a great weight on that specific point of time, Debtor Rehabilitation and Bankruptcy Act in South Korea yet omits to define the meaning of 'claims' for insolvency, making it unnecessary to be obsessed with as to when a claim arises. For insolvency in South Korea, I hereby propose the relationship test that does not stick to the point when a claim arises. Rather, I suggest a more flexible solution that allows bifurcation of claims. If the part of the claim occurring before the order for relief creates a relationship, such as contact, exposure, impact, or privity, between the claimant and the debtor, then the part of the claim is insolvency claim. At the same time, the purposes of the acts on which the claim is based, the entity benefitted by the expense, and so forth, should be considered. Prepetition claims should be cut off to encourage a fresh start of the debtor, but that does not mean that the debtor is free to commit torts or gain unjust enrichments. Though it is quite theoretical, postpetition claims that the claimant gains involuntarily because the debtor fails to block a relationship between them should be treated as administration claims so that the estate shoulders the expense. As a result, insolvency can proceed with efficiency and equity. The representatives and the social insurance programs for future claimants can satisfy due process concerns. If there is a conflict between insolvency and other public interest policy, mandatory provisions override in case of contractual claims while insolvency takes priority in case of non-contractual claims. ; 채무자가 도산절차에 들어간 경우, 채무자에 대한 채권의 발생원인이 도산절차개시 전후 어느 쪽에 귀속되는지에 따라 도산절차상 취급을 달리하는 것은 전 세계 도산법의 공통적인 특징이다. 일반적으로 도산절차개시 전에 발생한 채권은 도산채권으로서 도산절차상 제약을 받게 되고, 도산절차개시 후에 발생한 채권은 관리채권으로서 도산절차와 상관없이 변제받을 수 있어 실현할 수 있는 변제액에 큰 차이를 가져온다. 따라서 채권발생의 원인이 도산절차개시 전후에 걸쳐 있는 경우 그 채권을 분류하는 작업은 매우 중요한 의미를 가진다. 현재 우리나라의 통설과 판례는 일부구비설이다. 기본적으로 일부구비설에 따라 도산채권이 되는지 먼저 판단하고, 도산채권에 해당하지 않는 경우 관리채권의 요건을 충족한다면 관리채권이 된다는 입장이다. 도산절차개시 전에 채권의 내용이 구체적으로 확정되지 않았다 하더라도, 청구권의 주요한 발생원인이 도산절차개시 전에 갖추어져 있으면 도산채권이 되고, 그렇지 않은 경우는 관리채권이 될 수 있다는 것이다. 이는 우리나라의 도산 관련 법제가 2005. 3. 31. 채무자 회생 및 파산에 관한 법률 제정 전부터 일본의 도산 관련 법제를 계수하면서 일본의 통설과 판례인 일부구비설을 수용한 결과로 보인다. 그러나 '청구권의 주요한 발생원인'이라는 용어는 추상적이고 모호해서 구체적이고 일관된 기준을 제시해주고 있는지에 관해서는 의문이 있다. 우리나라의 대법원 판례 중에서도 결론이 서로 모순되어 보이는 경우가 있다. 일본에서도 유사한 사안임에도 최고재판소 판례가 모순된 결론을 내는 경우가 있다며 일부구비설 내에서도 그 한계를 자인하는 견해가 있을 정도이다. 현재 일본의 통설을 비판하면서 등장한 일본의 공제설은 학설사적 검토를 바탕으로, 채무자의 도산 위험을 부담하여야 하는 채권은 도산채권, 그렇지 않은 채권은 관리채권이 된다는 취지로 주장한다. 동어반복에 불과하다는 비판이 가능하지만, 적어도 '청구권의 주요한 발생원인'이라는 추상적인 용어로는 일부구비설의 본질을 충분히 담아내지 못한다는 문제의식은 경청할 가치가 있다. 그러나 이 역시 구체적이고 일관된 기준을 제시하는 데에는 부족함이 있다. 한편 미국에서는 유구한 도산법의 역사 속에서 실질적인 이익형량을 통해 도산채권과 관리채권을 분류하려는 노력을 계속해왔다. 따라서 그 기준을 세우는 데 미국의 논의는 참고로 삼을 가치가 있다. 미국에서는 명시적으로 논의가 이원화된 것은 아니지만, 사실상 계약상 채권과 비계약상 채권을 나누어 본다. 계약상 채권은 채권자가 채무자의 도산 위험을 고려해 자발적으로 거래에 나선다는 점에서 비교적 쉽게 채권자의 의사를 기준으로 도산 위험의 부담 여부를 가릴 수 있다. 반면 비계약상 채권은 채권자가 비자발적으로 채권자가 되는 경우도 많다는 점에서 채권자의 의사만을 기준으로 도산 위험의 부담 여부를 쉽게 판별하기 어렵다. 따라서 이원화된 분류법은 타당성이 있다. 미국에서 계약상 채권의 경우 채권자의 반대급부 이행을 기준으로 하는 반대급부이행기준설이 통설․판례이다. 비계약상 채권의 경우 연방순회항소법원의 판례는 최종적인 권리 발생을 요하는 권리발생시설, 채무자의 행위를 기준으로 하는 채무자행위시설, 채권자와 채무자의 관계 설정 시를 기준으로 하는 관계시설, 채권자가 채권의 발생 가능성을 숙고할 수 있었던 시점을 기준으로 하는 숙고가능시설로 나뉜다. 주류적인 판례는 관계시설을 따르고, 학설은 주로 채무자행위시설과 숙고가능시설로 양분된다. 계약상 채권의 경우 쌍방미이행 쌍무계약에 기한 경우를 포함해 반대급부이행기준설을 그대로 수용할 수 있다고 생각된다. 채권자로서 가장 강력한 담보인 동시이행의 항변권을 포기하고 도산절차개시 전 채무자의 재산에 공여한 부분은 도산 위험을 부담하는 도산채권이 된다. 도산절차개시 후 채무자의 이행 선택으로 새로이 거래로 유인된 부분은 도산절차개시 후 모든 이해관계인에게 이익이 되기 때문에 관리채권이 된다. 도산절차를 효율적으로 운영하기 위해 도산절차개시 전의 채권은 매몰비용으로 도산절차개시 후와 단절시켜야 하지만, 도산절차개시 후의 채권은 완전 변제를 보장해주어야 채권자가 새로이 거래에 응할 것이기 때문이다. 비계약상 채권의 경우는 도산 위험을 부담하여야하는 지위를 쉽게 구별하기 어렵다. 결국 이는 정책적 결단의 문제인데, 우리나라의 채무자 회생 및 파산에 관한 법률이 명시적으로 비계약상 채권을 도산채권에서 배제하고 있는 경우가 아닌 이상 도산절차개시 전 채무자로 인한 부분은 도산채권, 도산절차개시 후 채무자로 인한 부분은 관리채권으로 보아야 한다. 미국의 경우 연방도산법상 채권의 개념을 달리 정의하고 있으므로 그 시점을 기준으로 하여야 하지만, 우리나라의 경우 채무자 회생 및 파산에 관한 법률에서 채권의 개념을 달리 정의하고 있지 않으므로 시간 좌표에서 점 개념이 아닌 선 개념으로 파악하면 된다. 이러한 견지에서 관계시설을 따르는 미국의 주류적인 판례가 채권자가 채무자와 접촉(Contact), 노출(Exposure), 영향(Impact), 긴밀함(Privity) 등 관계를 설정했는지 여부를 기준으로 하는 것에 착안해 관계설을 제시한다. 물론 이 때 채권 발생의 근거가 되는 법령의 목적, 비용에 대응되는 이익의 향유 주체 등도 고려해야 할 것이다. 도산절차개시 전 발생한 채권은 단절시켜 채무자의 새 출발의 기회를 부여해야 하지만, 도산절차개시가 채무자의 불법행위, 부당이득을 완전히 허용한다는 뜻은 되지 않는다. 다소 의제적이나, 도산절차개시 후 관리인이 채권자와의 접촉 등을 방지하지 못해 새로이 채권자가 비자발적으로 채권을 가지게 된 부분은 관리채권으로 취급하여 이해관계인이 부담할 비용에 포함되도록 하여야 한다. 그럼으로써 도산절차가 효율적이고 공정하게 진행될 수 있다. 적법절차 보장의 문제는 장래 채권자의 이익을 대변하는 대표자를 파견하도록 하고, 그 재원을 일원화하여 사회 보험으로 관리하는 방안을 제안한다. 도산법과 공익적 성격을 가진 다른 법령이 충돌할 때에, 계약상 채권의 경우는 강행규정이 우선하도록 하면 되지만, 비계약상 채권의 경우는 기본적으로는 도산법의 이념이 우선하도록 하는 것이 타당하다고 생각된다. ; 목 차 제 1 장 서 론 1 제 2 장 우리나라의 논의 8 제 1 절 일반론 8 1. 일반적인 경우 8 2. 쌍방미이행 쌍무계약의 경우 9 제 2 절 구체적 사례 12 1. 서설 12 2. 계약상 채권의 사례 13 3. 비계약상 채권의 사례 34 제 3 절 검토 46 1. 사례 유형별 검토 46 2. 일반론 차원의 검토 56 제 3 장 일본의 논의 60 제 1 절 일본의 도산법 개관 60 제 2 절 일반론 64 1. 일반적인 경우 64 2. 쌍방미이행 쌍무계약의 경우 70 제 3 절 구체적 사례 73 1. 서설 73 2. 개별 사례 73 제 4 절 정리 및 시사점 88 1. 정리 88 2. 시사점 92 제 4 장 미국의 논의 94 제 1 절 미국의 도산법 개관 94 제 2 절 일반론 98 1. 판례 98 2. 학설 101 제 3 절 구체적 사례 105 1. 서설 105 2. 비계약상 채권의 사례 106 3. 계약상 채권의 사례 124 제 4 절 정리 및 시사점 136 1. 정리 136 2. 시사점 141 제 5 장 종합적 검토 143 제 1 절 새로운 기준의 모색 143 1. 서설 143 2. 논의의 축 144 3. 도산법이 다른 공익적 성격을 가진 법령과 충돌할 경우 148 4. 적법절차 보장의 문제 150 5. 구체적인 채권의 구별기준 설정 152 6. 적법절차 보장의 문제에 대한 대안 170 7. 소결 178 제 2 절 사례별 해결 179 1. 서설 179 2. 계약상 채권의 사례 179 3. 비계약상 채권의 사례 187 제 6 장 결론 195 참고문헌 199 Abstract 208 ; Master

Objectives: The purpose of this study is to figure out the current state of patient safety research in Korea and to evaluate whether the research fund support project for patient safety research is proceeding in priority order. Methods: Through the literature search, a list of research projects in the field of patient safety in Korea were collected as of January 6, 2017. Four researchers independently evaluated the subject using the priority list of patient safety research derived from the previous study. Results: As of January 2017, a total of 21 research projects were conducted in the Korea Health Industry Development Institute and 42 research studies were conducted in the National Science & Technology Information. The results of the priority evaluation showed that there were no researches that ranked first and second priority. Many of the research topics were �쁀dverse drug events/drug errors,�� �쁇ealth information technology/information systems,�� and �쁋ess relevance.�� Conclusion: Patient safety research projects are not only diverse but also quantitative in Korea. Support for research topics that need to be prioritized is needed, such as developing safety indicators and measuring patient safelty levels, improving communication, and improving patient safety incident reporting systems. ; open

학위논문 (석사)-- 서울대학교 대학원 : 정책학과, 2012. 2. 박정훈. ; 오늘날과 같은 지식정보화 사회에서의 전자정부 구현은 정부경쟁력, 더 나아가 국가경쟁력을 제고할 수 있는 핵심수단으로 여겨지기에 세계 각국과 국제기구에서는 전자정부를 도입하고 발전시키기 위해 재정적, 정책적으로 많은 노력을 기울이고 있다. 그러나 전자정부를 발전시키려는 이러한 노력들에도 불구하고 정부의 효과성, 민주성, 투명성 등 정부경쟁력의 개선은 전자정부 도입 시 기대했던 바에 크게 미치지 못하고 있는 것이 현실이다. 본 연구는 이러한 문제의식에서 출발하여 각 국의 정부경쟁력을 한층 강화시켜 줄 것이라 생각했던 전자정부가 과연 실제 그 효과를 나타내고 있는지에 대한 문제를 제기하고 전자정부가 정부경쟁력에 어떻게 영향을 미치고 있는 실증 분석하고자 하였다. 이를 통해 전자정부 도입 시 본래 달성하고자 하는 바들이 얼마나 잘 달성하고 있는지, 또 서로 다른 부문들로 구성된 전자정부 요소들은 정부경쟁력에 각기 어떠한 영향을 미치고 있는지 살펴보고 향후 전자정부의 연구, 정부정책과 관련한 몇 가지 시사점을 도출하고자 하였다. 본 연구는 151개 국가들을 대상으로 실시하였으며 종속변수로는 UN에서 발표하는 'Global E-government Readiness Report'의 전자정부 준비지수(Global E-government Readiness), 독립변수로는 국제투명성위원회의 부패인식지수(CPI), World Bank의 정부효과성지수(GE), Freedom House의 정치적 권리(PR), 시민의 자유(CL)지수를 시차를 고려하여 다중회귀분석을 실시하였다. 분석결과 각 국의 웹과 정보통신인프라의 발전은 정부운영의 효과성과 시민의 정치적 권리와 자유를 증진시키고 정부부문의 부패를 감소시켜 정부경쟁력 강화에 유의미한 영향을 미치고 있는 것으로 나타났다. 이러한 웹과 정보통신인프라의 효과적인 정부운영 및 부패감소 효과는 OECD국에 비하여 비OECD 국에서 상대적으로 더 큰 것으로 나타났다. 반면 정부의 시민참여 노력정도를 반영하는 온라인참여(E-Participation)변수는 기대와 달리 시민의 정치적 권리와 자유를 증진시키는데 기여하고 있지 못하는 것으로 나타났다. 본 연구는 전자정부 운영 및 연구에 있어서 몇 가지 함의를 시사한다. 첫째 전자정부가 정부경쟁력 강화라는 본래 목표를 달성하기 위해서는 무엇보다 정보통신인프라의 확충과 웹사이트의 발전이 동시에 이루어져야 할 것이다. 둘째, 각 국이 처한 경제, 사회 등 여러 부문의 발전수준과 전자정부 각 요소들을 각 국에 도입했을 때 그 영향들을 고려한 전략적 접근이 전자정부를 성공적으로 이끄는데 하나의 중요한 요소로 작용할 것이라는 점이다. 셋째, 현 시점의 전자정부 뿐만 아니라 이전의 전자정부 수준역시 정부경쟁력에 지속적인 영향을 미치고 있는 것으로 나타났다. 이는 전자정부사업에 대한 성과가 나타나는 시간이 길기 때문에 시차를 고려한 전자정부 사업계획 및 성과평가가 이루어져야 함을 보이는 것이다. 마지막으로 정부의 온라인 국민 참여노력(E-Participation)이 실제 민주주의강화에 이어질 수 있도록 정부의 보다 강한 책임성과 대응성, 법‧제도의 구축이 이루어져야할 것이라는 점이다. ; In the information society, All countries of the world and international organizations have tried to develop E-government, considering it as core means to improve government competitiveness. However, It is true that the results of it fall short of our expectations regardless of our effort in E-government. The results of the analysis are as follows: With awareness of issues above, this study tried to solve research questions: Has E-government which plays a role in improving government competitiveness accomplished its aims? and which components of it have effect on the government competitiveness? In addition, this study aimed to offer proposals related to policies and studies of E-government. In research method, multi-regression analysis was used based on the data : Global E-government Readiness Index reported by UN, Corruption Perceptions Index issued by TI, Government Effectiveness Index reported by World Bank, Political Right and Civil Liberty issued by Freedom House with 151 countries in the world. As a result of analysis, It is verified that Development of Web and Telecommunication Infrastructure have influence on improving Government effectiveness and democracy in society. And Their influence is stronger in OECD countries than non-OECD. On the other hand It is revealed that an effort of government to encourage political participation of nation doesn't contribute to improving level of democracy. The lessons from this study are as follows. First, it is important to expand telecommunication infrastructure for more citizen to get information which is a little bit developing infrastructure highly and improve web site for citizen to get high quality information. Secondly, it is necessary to approach strategically considering a level of economy and society and influence of e-government predicted before planning policies about e-government in order to make e-government business successful. thirdly, It is revealed that not only a level of current e-government but also a level of past e-government have influence on current government competitiveness. It means that time lag has to be considered planning e-government business and evaluating performance of it. Last but not least, More responsibility and responsiveness of government and laws and institutions related to e-government are needed in order that an effort of e-participation each government carries out is connected to reinforcing democracy. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 정치학과, 2012. 2. 신종갑. ; This paper aims to examine the alliance policy of Roh Moo-Hyun (Roh) government by focusing on its strategic flexibility and missile defense. More specifically, this paper argues that Roh government's dependency on the United States is the main variable that describes Roh government's alliance policy. The Bush administration realized the uncertainty of threat and the vulnerability of its homeland security following the September 11 attacks in 2001. The new military security strategy appeared to be coping with the changed international security environment and have maintained the United States' unipolarity. The core of the military security strategy was the war on terrorism and military transformation, and the United States was preparing to consolidate its alliances and partnerships in order to implement these strategies effectively. The United States emphasized Global Defense Posture Review (GPR) and Missile Defense, and demanded the cooperation of its allies. The United States' demands brought about the alliance security dilemma to the Republic of Korea (ROK), a weaker state in the asymmetric alliance. Cooperation with the United States could cause the ROK to become unintentionally involved in the northeast asia conflict and Peninsula conflict, while noncooperation could cause abandonment from the United States in facing the threat of North Korea. In the alliance security dilemma, Roh government gave an opposite decision, that is, the agreement of strategic flexibility and the decision not to participate in missile defense. In the case of strategic flexibility, Roh government recognized that South Korea was superior to North Korea in terms of conventional power. But what Roh government ultimately pursued was not the power to win the war, but the power to deter the war (deterrence). North Korea, as a result of its aggressive military strategies and its strengthening military power, could cause immense damage to South Korea by launching a sudden attack on South Korea. The participatory government judged that South Korea was not equipped for deterrence to prevent North Korea's sudden attack alone. The United States Forces Korea (USFK)'s fighting power (especially counterfire warfare power, intelligence capabilities) contributed to South Korea's deterrence against North Korea immensely, and South Korea realized that it would be difficult to replace USFK's fighting power within a short period of time. A combination of the degree of threat South Korea faced from North Korea, the extent to which the United States could contribute to deterrence and defense against the threat of North Korea, and the limited availability and high cost of alternative means of meeting the threat made Roh government more dependent on the United States. A high degree of alliance dependency led Roh government to perceive the fear of abandonment by the United States as greater than the fear of being involved in unwanted conflicts; accordingly, Roh government agreed to the strategic flexibility of USFK in order to decrease the possibility of abandonment by the United States. In the case of missile defense, Roh government perceived North Korea's weapons of mass destruction as weapons for the purpose of maintaining its regime or having leverage during negotiations rather than for threatening South Korea. Therefore, Roh government sought a peaceful resolution through dialogue. In addition, a missile defense system asked by the United States would not be reliable enough to be suitable for deployment, and was not suitable for the geography of the South Korean peninsula. The perception of a low level of threat and the small amount of security contributions made by the United States to protect South Korea against North Korea's weapons of mass destruction led Roh government to become less dependent on United States' security umbrella. A low degree of alliance dependency led Roh government to perceive the fear of abandonment from the United States as less than the fear of being involved in unwanted conflicts; accordingly, Roh government decided not to participate in a missile defense system in order to decrease its possibility of entrapment. However, in October 2006, North Korea's nuclear testing led Roh government to perceive North Korea's weapons of mass destruction as a 'serious threat'. Therefore, Roh government needed to protect South Korea against North Korea's weapons of mass destruction and then officially declared the need to construct the Korea Missile&Air Defense (KAMD). This paper concluded that a combination of Roh government's threat perception and United States' security contributions had a decisive effect on the decision of USFK's strategic flexibility and missile defense. In other words, while a low level of United States dependency led Roh government to present a strong level of commitment to the United States, a high level of dependency on the United States led Roh government to present a weak level of commitment to the United States. This conclusion shows that asymmetry between allies within an asymmetric alliance differs depending on the case; it also suggests that studies on the ROK-US alliance should overcome limitations of claims that weak states have no choice but to accept strong states' demands. ; 본 논문은 참여정부의 동맹정책을 전략적 유연성과 미사일방어체제 결정사례를 중심으로 살펴보는 것을 목적으로 한다. 보다 구체적으로 주한미군의 전략적 유연성 합의와 미사일방어체제 불참 결정을 비교분석함으로써 참여정부의 동맹정책을 설명하는 주요 변수가 참여정부의 미국 의존성이라는 점을 주장하고자 한다. 부시 행정부는 2001년에 발생한 9․11테러를 계기로 위협의 불확실성과 본토안보의 취약성을 인식하였다. 변화된 국제안보환경에 대응하고 미국 중심의 단극질서 유지를 위해 나타난 것이 새로운 군사안보전략이었다. 군사안보전략의 핵심은 테러와의 전쟁과 군사 변혁(Military Transformation)이었다. 그리고 미국은 전략의 효과적인 수행을 위해 동맹 및 파트너십의 강화를 도모하였다. 미국은 군사안보전략의 구체적 실천에 있어 미국의 전 세계 군사태세의 변화를 의미하는 해외주둔미군재배치계획과 새로운 능력의 구축이자 전쟁수행방식의 변화를 의미하는 미사일방어체제를 강조하였으며, 동맹국에 동참을 요구하였다. 미국의 동참 요구는 비대칭동맹인 한미동맹 내에서 약소동맹국인 한국에 동맹의 안보딜레마를 야기하였다. 각 쟁점에의 협력은 한국이 동북아 분쟁 및 한반도 분쟁에 의도치 않게 개입되는 상황을 야기하는 반면, 미국에 대한 비협조는 북한의 위협에 대한 미국으로부터의 방기를 야기하는 것이었다. 참여정부는 연루와 방기의 딜레마에 직면하여 주한미군의 전략적 유연성 합의와 미사일방어체제 불참이라는 상반된 결정을 내렸다. 전략적 유연성의 경우, 참여정부는 재래식 전력에서 한국이 북한보다 우위에 있다고 인식하였다. 하지만 참여정부가 궁극적으로 지향하는 바는 전쟁에서 승리할 수 있는 전력이 아니라 전쟁 자체를 예방하는 전쟁억제력이었다. 북한의 공세적인 군사전략과 군사력 증강은 북한이 기습적으로 공격을 가해 한국에 막대한 피해를 야기할 수 있었다. 참여정부는 북한의 기습적인 공격을 예방하기 위한 전쟁 억제력을 한국 단독으로 갖추고 있지 않다고 판단하였다. 주한미군이 갖추고 있던 전력, 특히 대화력전 능력과 정보력이 한국의 대북억제력에 지대한 기여를 하였으며, 한국이 이를 단시간 내에 대체하기는 어렵다고 보았다. 북한 위협에 대한 인식과 미국의 안보기여에 대한 고려는 참여정부로 하여금 안보획득을 위해 미국에 보다 의존적이 되도록 하였다. 높은 의존성은 원치 않는 분쟁에 연루되는 위험보다 미국으로부터 버림받는 위험을 더 크게 인식하도록 하였으며, 이에 따라 참여정부는 방기의 위험을 줄이기 위해 미국에 강한 공약, 즉 전략적 유연성 합의를 결정하였다. 미사일방어체제의 경우, 참여정부는 2006년 북핵 실험 이전에는 북한의 대량살상무기를 한국에 대한 위협용이라기보다는 체제 유지용 혹은 협상용으로 인식하였다. 따라서 대화를 통한 평화적 해결을 모색하였다. 그리고 북한의 대량살상무기를 방어하기 위해 요구된 미사일방어체제는 운용 신뢰성이 배치에 부합할 만큼 높지 않았으며, 군사분계선과 서울과의 인접성과 협소한 면적을 특징으로 하는 한반도 지형에는 적합하지 않는 체계였다. 북한의 대량살상무기에 대한 낮은 위협인식과 낮은 미국의 안보기여는 참여정부로 하여금 미국의 안보우산에 덜 의존적이 되도록 하였다. 낮은 의존성은 미국으로부터 방기되는 위험보다 원치 않는 분쟁에 연루되는 위험을 더 크게 인식하도록 하였으며, 이에 따라 참여정부는 연루의 위험을 최소화하기 위해 미국에 약한 공약 즉 미사일방어체제 불참을 공식화하였다. 하지만 2006년의 북핵 실험은 참여정부가 북한의 대량살상무기를 '심각한 위협'으로 받아들이게 하였다. 이는 북한의 대량살상무기 공격으로부터 한국을 보호할 필요성을 야기하였으며, 그 결과는 한국형 미사일방어체제의 공식적 구축이었다. 본 논문은 주한미군의 전략적 유연성 합의와 미사일방어체제 불참 결정에는 참여정부의 위협인식과 미국의 안보기여가 결합된 미국 의존도가 핵심적으로 영향을 미쳤음을 밝혔다. 미국 의존도가 낮을 경우 참여정부는 연루의 위험을 줄이기 위해 약한 공약을 제시하고, 반면 의존도가 높을 경우 방기의 위험을 줄이기 위해 강한 공약을 제시하였던 것이다. 이는 비대칭 내 동맹국들 간의 비대칭성이 쟁점별로 다를 수 있으며, 한미동맹에 대한 연구들이 약소국은 강대국의 요구를 수용할 수밖에 없다는 주장의 한계에서 벗어나야함을 보여준다. ; Master

The study also aimed to explore whether self-efficacy and ego-resilience which are affective characteristics operated as mediating variables. The social support, as a positive resource, obtained by an individual through meaningful interactions with other people plays an effective buffering role in preventing stress and helping adjustment to an environment, Thus it reinforces the ability to overcome frustration and embrace any challenges for solving problems (Sarson, 1991; Sarson et al., 1983). Furthermore, the social support perceived by airmen in the military context can serve as a principal variable that has a significant effect on their adjustment to military life. Bandura (1995) asserted that when people face obstacles and demanding assignments, positive self-efficacy plays a crucial role in enabling people to motivate themselves and to overcome frustration and pain. This implies that the self-efficacy can have a positive effect on task performance and job satisfaction by airmen, and act as a mediating variable of the adjustment to military life. Ego-resilience, a variable that is assumed to arbitrate psychological adjustment by enabling people to employ flexible behaviors and problem solving strategies, faced with circumstantial adversities and stressful situations, can be a factor that predicts and mediates the adjustment of airmen to the military context in which the airmen are forced to face an unfamiliar environment and deal with unaccustomed work. The present study, based on these theories, presents the following research questions. 1. Does the social support perceived by airmen have an effect on self-efficacy, ego-resilience, and the adjustment to military life? 1-1. Does the social support perceived by airmen have an direct effect on the adjustment to military life? 1-2. Does the self-efficacy have an direct effect on the adjustment to military life? 1-3. Does the ego-resilience have an direct effect on the adjustment to military life? 2. Does the social support perceived by airmen have an effect on the adjustment to military life through the mediation of self-efficacy, ego-resilience? 2-1. Does the social support perceived by airmen have an effect on the adjustment to military life through the mediation of self-efficacy? 2-2. Does the social support perceived by airmen have an effect on the adjustment to military life through the mediation of ego-resilience? 2-3. Does the social support perceived by airmen have an effect on the adjustment to military life through the mediation of self-efficacy, ego-resilience? 3. Does the self-efficacy have an effect on the adjustment to military life through the mediation of ego-resilience? In order to investigate the questions above, both preliminary and main questionnaires were conducted on 520 airmen served in ROK Air Force. The validation of the tool was made through the process of both exploratory factor and confirmatory factor analyses on the scale of the adjustment to military life. The model was also analysed by using structural equation model to identify the structural relations among latent variables established in the research model, with the verification of the mediating effect of self-efficacy and ego-resilience. The key findings of the research are summarized as follows: First, it was confirmed that structural model on the structural relationship between the three variables, social support, self-efficacy and ego-resilience and the adjustment to military life, which were based on previous studies and theories, was well supported in the military context. Model test was conducted through TLI, CFI, RMSEA, in which the criteria of model test fit were established, and it turned out that model fit could be acceptable. Thus, it may be seen that research data could be explained relatively appropriately by the research model established in this thesis. Second, it turned out that both the social support and self-efficacy as well as ego-resilience affected the adjustment to military life directly. With regard to the effect size of the variables, they were arranged in the order of self-efficacy, social support, and ego-resilience. Third, the social support had indirect effects on the adjustment to military life through the mediation of self-efficacy and ego-resilience respectively. In addition, the social support affected the adjustment to military life indirectly through the mediation of both self-efficacy and ego-resilience. The effect size was arranged in the order of the mediation of self-efficacy, the mediation of both self-efficacy and ego-resilience, and the mediation of ego-resilience. In particular, self-efficacy turned out to be the primary variable that affected the adjustment to military life both directly and indirectly. The result of the study showed the structural relationship between the three variables, social support, self-efficacy and ego-resilience and the adjustment to military life, those variables turned out to be the ones that can predict and mediate the adjustment to military life. This implies that in establishing effective intervention methods on the adjustment to military life, a systematic and unified approach, based on the structural relationship among various variables and their effectiveness, should be made. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 정책학과, 2012. 2. 권혁주. ; 본 연구는 정책변동(policy change)사례 연구이다. 정책변동은 정책형성(의제설정과 의사결정)을 포함한다는 시각에서 논의를 진행하였다. 정책변동의 성공과 실패의 원인을 찾기 위해 '신행정수도이전정책'의 두 차례 정책변동과정을 분석하였다. 의제설정과정은 Kingdon의 정책흐름모형(policy stream model)을 적용하였고, 의사결정과정은 입법과정을 고려한 거부점(veto point)과 거부권행사자(veto player) 개념을 적용하여 분석하였다. '행정수도이전정책'은 1971년에 최초로 제기되었으나 구체화의 기회를 잡지 못하였다. 시간이 흘러 '행정수도이전정책'은 노무현 정부의 등장과 함께 정책의제가 되고 결정되어 추진되었다. 그런데「신행정수도의건설을위한특별조치법」이 헌법재판소로부터 위헌판결을 받게 되어, '행정중심복합도시건설정책'이 후속정책으로 채택되어 집행되었다. 한편, 이명박 정부는 '교육과학경제도시건설정책'으로 정책변동을 추진하지만 실패하게 되었다. 본 연구는 '신행정수도이전정책'이 좌초된 이후 노무현 정부가 실시한 '행정중심복합도시건설정책'으로의 제1차 정책변동과정과 그 성공을 다루었다. 그리고 이명박 정부의 '교육과학경제도시건설정책'으로의 제2차 정책변동과정과 그 실패에 대하여 분석하였다. 이론적 분석틀은 다음과 같이 구성하였다. 먼저 정책변동을 위한 의제설정과정은 Kingdon의 정책흐름모형에 따라 분석하였다. 정책의 3가지 흐름(정치의 흐름, 정책대안의 흐름, 정책문제의 흐름)을 정리한 후, 각 흐름들이 어떻게 결합되어 정책의 창을 열게 되고, 정책의 창 내에서 자신의 의사를 관철시키고자 하는 참여자의 활동을 해당 정책의 찬성과 반대집단으로 구분하여 살펴보았다. 다음으로 정책변동을 위한 의사결정과정은 국회에서의 입법과정을 중심으로 제도적 맥락에 따라 거부점과 거부권행사자를 구별하여 살펴보았으며, 사후적 거부점으로서 헌법재판소를 포함하였다. ; This is a case study on the policy change. This study have a perspective on policy change that includes policy formation (agenda setting and decision making). In order to find the cause of success and failure of policy change, this research analyzed two cases of the policy change of The New Administrative Capital Relocation Policy. Agenda-setting processes were analyzed on the basis of Kingdon' policy stream model, and decision-making processes were analyzed by applying the concept of the veto point considering the legislative process and veto players. The Administrative Capital Relocation Policy was first raised in 1971, but the policy did not take a chance to be materialized. Over time, the policy was determined by the policy agenda and driven with the advent of the Rho Moo-Hyun Administration. However, The Constitutional Court ruled that The New Administrative Capital Relocation Law is unconstitutional, so Multi-functional Administrative City Construction Policy was adopted as a subsequent policy and implemented. On the other hand, Lee Myoung-Bak Administration was attempts to policy change from the Multi-functional Administrative City Construction Policy to the Education and Science Centered, Economic City Construction Policy but Lee administration was failed to change the Multi-functional Administrative City Construction Policy. This study analyzed the first policy change process to the Multi-functional Administrative City Construction Policy and the success since the failure of the New Administrative Capital Relocation Policy. And then, this study analyzed the second policy change process of the Education and Science Centered, Economic City Construction Policy and the failure. ; Master

학위논문 (석사) -- 서울대학교 대학원 : 사회과학대학 정치외교학부(외교학전공), 2020. 8. 신범식. ; 본 논문은 테러와의 전쟁에서 많은 피해를 입은 미국과 러시아의 테러조직 리스트가 예상과 달리 왜 유사점보다 차이점을 더 많이 가지고 있는가를 밝히고자 하였다. 이를 위해 러시아와 미국이 테러조직을 지정하는 과정을 비교함으로써 양국의 테러조직 지정에 영향을 미치는 요인들을 규명하고자 하였다. 우선 미국과 러시아의 국가 안보전략 문서들을 분석함으로써 양국이 시기별로 중요하게 여긴 관심사와 이러한 관심사에 대한 위협이 무엇인지 분석하였다. 그 다음으로, 미국과 러시아의 대통령들이 1993년부터 2017년까지 발표한 테러 관련 연설문, 인터뷰, 공문서들 가운데 제목이나 본문에 'terror' 및 'террор'라는 어근이 포함된 다양한 형태의 텍스트 자료들을 대상으로 워드분석을 함으로써 양국이 테러를 어떠한 위협으로 상정하는지, 국내외의 어떤 안건들과 연결하는지를 파악하였다. 그리하여 본고는 테러에 대한 역사적 경험과 인식, 안보에 대한 이해, 국제 질서와 상황 파악 등 많은 요인들이 테러조직 지정에 영향을 미치면서 양국이 테러에 대한 기본적인 인식, 즉 초국가적인 테러조직들이 한 국가만이 아닌, 국제사회 전체에 위협이 될 수 있다는 인식 면에서는 시간이 지나면서 비슷해졌지만 양국의 안보개념, 안보와 관련된 국익의 우선 순위, 테러에 대한 인식에 영향을 미친 역사적 경험이 상이하기 때문에 테러조직의 지정에서 유사점보다는 차이점이 더 많이 나타나게 되었다는 결론에 도달하였다. 본고는 일견 미국과 러시아가 테러조직을 공동의 적으로 간주하는 것처럼 보이지만 실제로는 다양한 요인들로 인해 테러와 테러조직의 지정에서 서로 다르게 접근한다는 사실을 보여주었다는 데 그 의의가 있다. ; Russia and the United States have been on the front line of the fight against terrorism for a long time, and at first glance it may seem that they are fighting against the same enemy. However, upon careful comparison of the U.S. Department of State list of Foreign Terrorist Organizations(FTO) and corresponding list of the Russian Federation the distinctions are strikingly obvious. The organizations designated by each country outnumber the ones that were appointed by both. This study aims to examine the factors behind the differences in the approaches that Russia and the U.S. took to defining the enemy. It is argued that the designation method is mainly determined by two broad aspects – the security concept and the perception of terrorism. Through the analysis of the national security strategies from 1997 to 2015, this study investigated several crucial issues: the ways Russia and the United States had been perceiving the international order, their place and role in it, as well as changes in their national interests over time, and most importantly, what constituted the perceived threats to the national security. Supporting this with the examination of the perception of terrorism through the word frequency analysis of Russian and American presidents' speeches, the study concluded that despite the fact that both countries claim terrorism to be their main threat, the approach to defining it is not the same as each country bases it on their own historical experience and national priorities. The United States views terrorism largely as a part of the global security framework, inseparably associated with other issues (such as the threat of WMD proliferation) that are claimed to emanate from rogue states and tyrannies. Consequently, the strategy in the fight against terrorism has been derived from the desire to converse these regimes to democracy. On the other hand, Russia was found to view terrorism as a more direct threat to the country's national security. For Russia, terrorist organizations are separate entities that try to violate the country's constitutional order through separatist and extremist slogans. Unlike the United States, Russia does not view terrorist organizations as an instrument in the hands of tyrannical regimes, therefore it condemns the American unilateral approach that is structured around interference into the internal affairs of other states. These differences are reflected in the formation of the terrorist organizations lists. The list of the United States is more comprehensive and geographically global. The FTO list includes not only the organizations that directly threaten US security, but also the ones that harm the partners and allies of the United States. At the same time, Russia is focused on designating the organizations that directly threaten the security of the country and the nearest region like Central Asia. There are also organizations on the list that do not commit terrorist acts, but undermine the values of Russia's constitutional system through the conduct of propaganda on the Internet. After September 11 and the Beslan school siege in 2004, there is a convergence in the perception of the US and Russia on the rise of terrorist organizations network as a major transnational threat in the 21st century. This explains why there are the same ten organizations on both lists. The vast majority of the organizations that have been designated by both countries are affiliates of al-Qaeda, which are fighting not one specific country, but the entire modern international society. 학위논문 (석사)-- 서울대학교 대학원 : 정치학과, 2012. 2. 권형기. ; 본 연구는 발전국가 이후 한국 자본주의 제도 변화 과정에서 나타난 국가 성격 전환에 관한 연구이다. 구체적인 사례로 하도급 제도를 대상으로 세계화 과정에서 국가 성격의 변화를 경험적으로 밝히고 이의 이론적 성격을 규명하고자 한다. 발전국가의 변천에 관한 기존의 연구는 주로 시장국가 혹은 최소주의적 규제국가라는 단일한 국가 모델로 수렴할 것인가라는 테제를 중심으로 접근해 왔다. 세계화론자들은 자본의 이동이 자유로워지고 자본을 유치하기 위한 경쟁이 치열해지면서 발전국가가 변화하는 세계경제에 부적합하기 때문에 단일한 규제국가 모델로 수렴할 것이라 예측한다. 반면, 신제도주의자들은 각 국가마다 착종된 제도와 문화가 다르기 때문에 "발전국가 이후" 규제국가로의 전환은 발전국가의 개입주의적 성격이 유지되는 경로의존적 제도 변화를 겪게 된다고 주장한다. 발전 경로가 다양할 수 있다는 점에서 제도주의의 입장에 동의하지만 한국의 국가성격 전환에 대한 기존 연구는 발전국가의 유산에만 천착하여 새롭게 재편되는 국가의 역할에 주목하지 못하고 있다. 본 연구에서는 개입주의의 유산을 통해 발전국가의 연속성을 찾는 기존 연구의 문제제기를 벗어나, 시장자유화라는 세계화의 일반적 추세에 따라 한국의 국가 성격 역시 규제국가로의 수렴 과정에 있다는 명제 하에서 한국의 규제국가가 갖는 다양성의 동학을 살피고자 했다. 한국의 발전 모델이 규제국가로 전환된 것은 사실이나 신자유주의적 국가가 상정하는 최소주의적 국가로 변화한 것은 아니다. 오히려 시장질서의 유지를 위한 협치적 개입주의라는 독특한 규제국가 모델을 형성하고 있다. 본 연구는 기존의 국가전환론이 지나치게 정태적인 분석 방법을 사용하여 비교균형론에 머무르는 한계를 지적하고 협치적 규제국가로의 전환을 이해하기 위해 행위자 중심의 이념, 사고, 담론의 정치적 과정을 분석하였다. 한국의 산업화 시기 형성된 발전연합은 공정거래법과 하도급법과 같은 경쟁법의 제도화를 억제했다. 80년대 신자유주의 관료의 등장과 정치엘리트의 정책 기조 전환이 맞물리면서 현재의 하도급 제도의 기원이 형성될 수 있었다. 이후 하도급법의 확대 및 강화를 통해 신자유주의적 규제국가가 아닌 질서 자유주의를 기반으로 하는 규제국가 모델로 재편되는 모습을 보여주었다. 이렇듯 한국의 규제국가가 '최소주의적'인 국가는 아니었지만 불충분한 제도화로 인해 자본의 양극화 문제를 충분히 해소하는 데에는 부족했다. 규제국가의 한계를 인식한 정부는 규제보다 사회적 규범을 통한 문제 해결을 선호했기 때문에 하도급법 강화에 저항적이었다. 이로 인해 중소기업의 불만을 조직하여 대변하는 정치세력의 연동제 도입 노력은 실패로 돌아가고 대신 점진적 개혁이 이뤄졌다. 자본의 패권에 대한 인식과 규제 국가의 능력에 대한 의심에도 불구하고 정부는 탈규제와 시장 방임으로 나아가지는 않았다. 오히려 사회적 규범을 형성하기 위한 사회적 조정을 시도하는 적극적 협치주의를 추구했다. 동반성장위원회는 공정거래위원회와 달리 사회적 합의 기구라는 제도적 조건과 적극적인 정치적 의지로 인해 이익공유제, 업종 적합성 등 중소기업의 불만을 반영한 다양한 대안들을 제시하여 대기업 측을 압박할 수 있었다. 전경련은 집단행동을 통해 이익공유제에 대한 항의를 전달했지만 법제화에 대한 두려움으로 동반위에서의 이탈보다는 강력하게 반대해 온 납품단가 연동제를 수용했다. 결론적으로 한국의 국가 성격은 발전주의 시기 이후 규제국가로의 수렴을 겪었다고 볼 수 있지만 이는 신자유주의 이념에 의한 것이 아니라 질서자유주의에 입각한 규제국가로의 전환이었다. 그러나 규제국가의 딜레마로 인해 강성규제국가보다는 협치적 규제국가라는 타협적 제도화가 이뤄지고 있다. 연성 규범 형성을 위한 협치적 개입주의는 사회적 조정을 통한 제도 변화의 급진성을 가져올 수 있는 새로운 가능성을 보여주지만 강제력의 부재라는 한계 역시 내포하고 있다. ; This study examines how the form of the Korean developmental state has changed in the process of economic liberalization. More specifically, the study analyzes the transformation of the Korean state empirically and theoretically investigating the changes in the subcontracting institutions under the globalization. The main question of the previous research on the tranformation of the developmental state is whether the state develops into one national model, 'minimalist state'. Capital mobility and the competition for capital make the interventionist states insufficiently competitive. Neoliberals predict the convergence of the national diversity under globalization. Institutionalists, on the other hand, insist that although the interventionist state has developed into a regulatory state, the direction of transformation is determined by path dependence. However, the literature on the transformation of the Korean state has paid little attention to the newly constructed role of the state. Unlike the previous literature, this research examines the dynamic process of the transformation of the Korean regulatory state. It is true that although the Korean state has changed from developmental model to regulatory state, it is distinct from minimalist model based on neo-liberal ideology. Rather, a new regulatory model has been formed. State intervention occurs not as a form of transformed developmental intervention, but as a form of governance. In order to understand this transformation, this study analyzes the political process based on the discursive institutionalism. The growth coalition blocked the introduction of the competition law in the era of industrialization. The newly empowered neoliberal bureaucrats and the turn of the policy stance under the new junta regime made it possible to enact the competition law. Since 1980s, the subcontracting law has been gradually reinforced. After enacting the law, the Korean state has developed into the regulatory state based on the ordo-liberalism, not on the neoliberalism. However, it is insufficient for the change to close the widening gap between big businesses and small businesses. The government prefers constructing the governance to strengthening the law in order to resolve the problem. Facing the government's resist, political parties' efforts to rapidly change the law failed. Although the government concerned about the capital mobility, it did not seek de-regulation and laissez-faire policy. Rather, the government tried to form a social norm using the governance. Unlike Fair Trade Commission, the Commission on Shared Growth for largecorporations and Small and medium Enterprises exerted pressure on the big business by proposing alternative plans including profit sharing and lists for SMB business items. Although the Federation of Korean Industries took collective action against the profit sharing plan to adjust the cost of subcontracting to the changes in raw material prices, it had to accept the plan which the FKI had strongly opposed. In conclusion, the Korean state developed into the regulatory state after the "developmental state". However, it does not mean that the role of the state becomes minimal as the neo-liberalsts argue. Nor does it that the state create a new role dependent on the developmental legacy. Using a new-formed governance, the Korean state tried to change the subcontracting institutions. ; Master

"내외 귀빈 여러분, 유라시아 대륙은 세계인구의 약 71%가 살고 있고, 동쪽 끝에서 서쪽 끝까지 12개의 시간대에 걸쳐 있는 세계 최대의 단일 대륙입니다. (중략)···저는 이제 유라시아에 새로운 소통의 길을 열어 협력의 잠재력을 끌어내야 할 때라고 생각합니다. 단절과 고립, 긴장과 분쟁을 극복하고 소통과 개방으로 평화롭게 교류하며 함께 번영하는 유라시아를 건설해야 합니다. 이를 위해 저는 유라시아를 '하나의 대륙', '창조의 대륙', '평화의 대륙' 으로 만들어 가는 몇 가지 방향을 제안하고자 합니다." 라고 하며 '유라시아 이니셔티브' 를 주창하였다. 이처럼 유라시아 이니셔티브는 유라시아 국가들 간 물류, 시장, 문화 등을 통합해 나가는 것을 주요 내용으로 하였으며 핵심은 물류 및 교통의 통합을 통해 유라시아 대륙의 공동번영을 이룸과 함께 한국은 유라시아 대륙의 물류 허브로 거듭나는 것이었다. 다수 전문가들은 유라시아 이니셔티브의 추진에 있어 여러 도시 중에서도 세계적인 항만을 보유하고 있고, 한반도의 기점이자 종점이며 세계 전역으로 뻗어나갈 수 있는 지정학적 위치를 갖춘 부산시의 역할에 주목하였다. 이러한 상황에서 당시 부산시장은 부산시의 도시 비전을 '유라시아 관문도시 부산' 으로 정하고 부산이 주도적으로 유라시아 이니셔티브를 이끌어가야 한다고 주장하였다. 이러한 주장에 기반하여 부산시는 2015년부터 본격적으로 유라시아와 관련한 여러 사업을 추진하였다. 하지만, 대부분의 사업은 일회성에 그치거나 큰 효과를 내지 못하였다. 반면, '유라시아 관문도시 부산' 이라는 부산의 비전을 국내외에 전파하고 유라시아 여러 도시들과의 교류협력을 강화하기 위해 추진한 『유라시아 부산원정대』 사업은 정책결정 과정에서는 사업효과에 대한 의문이 다수 제기 되었으며 일회성 행사에 그칠 것으로 우려 하였으나 2019년 현재까지도 지속적으로 추진될 만큼 부산시를 대표하는 유라시아 관련 정책으로 자리매김 하였다. 따라서 본 논문에서는 『유라시아 부산원정대』의 집행과정을 분석해보고, 어떻게 본 정책이 다른 사업들과는 달리 지속될 수 있었는지에 대해 살펴보았으며 이 과정에서 Mazmanian과 Sabatier의 연구를 활용하여 분석을 진행하였다. 따라서 본 연구의 목적은 다음의 세 가지로 나눌 수 있다. 첫째, 『유라시아 부산원정대』의 집행과정을 분석해보고 집행이 잘된 부분과 그렇지 않은 부분을 찾아본다. 둘째, 정책집행과정의 분석을 통해 어떻게 본 사업이 다른 유라시아 관련 정책들과는 달리 일회성에 그치지 않고 지속될 수 있었는지에 대해 알아본다. 마지막으로, 정책집행 연구에서 빈번하게 활용되는 Mazmanian과 Sabatier의 연구를 분석하여 이론이 담고 있는 함의 및 구체적 내용을 알아본다. 이러한 목적의 달성을 위해 본 연구는 우선 부산시 및 여러 유관기관들의 문헌 자료와 함께 집행과정에 참여했던 주요 행위자들을 면담하여 정책집행과정을 면밀히 분석하였다. 다음으로 Mazmanian 과 Sabatier 가 제시한 '정책집행이 효과적으로 이루어지기 위한 조건'을 활용하여 원정대 사업의 정책집행과정이 해당 조건에 부합하는지 여부를 통해 정책집행이 잘 된 부분과 그렇지 못한 부분을 구분하였다. 연구의 결과는 다음과 같다. 첫째, 『유라시아 부산원정대』의 정책목표는 명확하며 일관성을 갖추었다. 특히, 외교부, 경상북도 등 타 기관이 추진한 유사사업들과 비교했을 때 원정대의 정책목표는 상당히 명확하며 구체적이었다. 둘째, 정책목표의 달성을 위해 부산광역시 차원의 개입이 필요하다는 것은 분명하나, 굳이 원정대라는 수단을 선택해야 하는지에 대해서는 원정대 이외에도 본 정책목표를 달성할 수 있는 여러 가지 다른 방법이 있을 수 있기 때문에, 본 정책목표와 원정대라는 정책수단 간의 인과관계는 명확하지 않았다. 셋째, 정책집행 담당기관이었던 부산광역시 통상진흥과 남북경제협력팀 및 부산국제교류재단은 본 정책과 업무관련성이 매우 높고, 조직원들은 본 사업에 대해 상당히 긍정적인 반응을 보였기 때문에 집행기관은 모두 원정대 사업에 대해 상당히 호의적이었던 것으로 나타났다. 넷째, 부산시 및 부산국제교류재단 모두 원정대 사업에 대한 의사결정 과정은 3단계로 이루어져 공식적으로 정해진 절차에 비해 단순화 되었으며, 의사결정 방식 역시 하향식이며 대체로 시장의 지시에 전적으로 순응하는 편이었기 때문에 빠른 정책집행이 가능했다. 다섯째, 부산시 의회 및 부산시 내 관련 부서 등 정책집행 유관기관과 정책결정자인 부산시장은 원정대 사업에 대해 호의적이었으며 지지를 보냈던 것으로 나타났다. 특히, 부산시장의 경우 원정대에 대해 상당히 높은 관심을 보였던 것으로 파악되었다. 마지막으로 원정대 사업의 집행과정에서 동남권 신공항의 유치 문제가 이슈화 되면서 '유라시아 관문도시 부산' 이라는 비전의 홍보 및 국내외 확산이 더욱 중요해졌고 이로 인해 원정대 사업의 정책목표가 갖는 중요성은 정책결정 시에 비해 더욱 높아졌다고 볼 수 있다. 연구결과를 종합해보면, 『유라시아 부산원정대』의 정책집행과정은 Mazmanian 과 Sabatier가 제시한 정책집행이 효과적으로 이루어지기 위한 조건을 대체로 만족하는 것으로 나타났다. 특히, 원정대 사업은 ① 정책목표가 상당히 명확하며, ② 정책집행기관 및 정책결정자가 사업에 대해 상당한 관심 및 지지를 보내었고, ③ 사회·경제적 조건의 변화로 인해 정책집행과정에서 정책목표의 상대적 중요성이 더욱 높아졌기 때문에 다른 유라시아 관련 사업들과는 달리 정책이 일회성에 그치지 않고 지속될 수 있었던 것으로 나타났다. 다만, 정책목표와 정책수단 간의 인과관계가 불명확하여 정책이 지속되고 집행에 따른 성과가 창출되었음에도 정책이 갖는 효과에 대한 의문이 지속되었던 만큼 이에 대한 보완이 필요한 것으로 나타났다. ; Former President Park Geun-hye delivered her keynote address at the opening of the 'Global Cooperation in the Era of Eurasia' conference in Seoul Silla hotel on October 18 ; "Ladies and Gentleman, Eurasia is the biggest continent in the world which contains 71% of the world's population and 12 different time zones. .Now is the time to open a new channel to Eurasia in order to lift its cooperation potential. We need to revive Eurasia, a geographic area disconnected by the Cold War, as a space for communication, openness, creation and fusion. I would like to propose a new vision, to make Eurasia, one continent of creation and peace." and then suggest her new vision 'Eurasia Initiative'. The main concept of Eurasia Initiative is integrating logistics, market and culture among Eurasian countries and key point is by integrating logistics and transportation we'd like to achieve prosperity of Eurasia Countries and at the same time, Korean peninsula should role as a logistic hub and the gate way of Eurasia continent. Many specialists focused the role of Busan Metropolitan city to achieve the goal of Eurasia Initiative because of it's global port facilities and geographical location which is the origin and destination of Korean peninsula. In this situation, former Mayor of Busan set the city vision as 'The Eurasia Gateway Busan' and stressed that Busan should lead the Eurasia Initiative. Based on this opinion, Busan Metropolitan City implemented many policies from 2015, but most of them were just one time event and failed to succeed. However, the policy 'Eurasia Expedition from Busan' which focused on publicizing the vision of Busan (Eurasia Gateway Busan) and strengthening the cooperation with Eurasian cities is still maintaining in 2019 and becoming the most famous and symbolic policy about Eurasia in Busan eventhough there were lots of doubts about being one time event in the policy decision process. Thus in this study, analyzing the policy implementation process of 'Eurasia Expedition from Busan' and finding the reason how this policy can be maintained unlike other policies by using the Mazmanian-Sabatier model. The goals of this study can divided into three things. First, analyzing the policy implementation process of 'Eurasia Expedition from Busan' and finding the good and bad points of implementation. Second, by analyzing the policy implementation process, how this policy can be maintained unlike other Eurasian policies in Busan. Lastly, analyzing the Mazmanian-Sabatier model which is frequently used in the study of policy implementation, and finding the exact meaning of that model. To achieve these goals, first of all, reviewing much data of Busan Metropolitan cities and other related organizations and also interviewing some people who participated the policy implementation process. Next, using the "Conditions of effective policy implementation which is argued by Mazmanian-Sabatier, analyzing the policy implementation process of 'Eurasia Expedition from Busan' whether it is fit to that conditions or not. The results of this study are as follow. First, the objectives of 'Eurasia Expedition from Busan' are clear and consistent. Especially, comparing with the similar policies which was implemented by the ministry of diplomacy and Gyeongsangbuk-do, the objectives of these policies are very obvious and concrete. Second, to achieve this objectives, it's clear that the intervention of government is necessary, but the causal theory between this policy and the objectives is not clear. Third, both Inter-Korean cooperation team in Trade promotion division of Busan Metropolitan City government and Busan Foundation for International Cooperation which were in charge of implementing 'Eurasia Expedition from Busan' were quite related to this policy and all of members were so much positive to this policy. Thus both organizations are so much favorable to this policy. Fourth, the decision rules of both organizations were in a three stages which was quite simplified than formal steps, and quite top-down ways especially complying the order of mayor thus it can simplify policy implementation process and facilitate effective implementation. Fifth, the related organizations of policy implementation like Busan city council and other divisions of Busan Metropolitan City and the mayor of Busan who is a policy decision maker were favorable and supportive to 'Eurasia Expedition from Busan'. Especially, mayor of Busan gave considerable support to this policy. 학위논문 (석사)-- 서울대학교 대학원 : 행정학과(정책학전공), 2012. 2. 금현섭. ; 본 연구는 국회 법안 심사 소위원회를 분석대상으로 삼아, 국회의 법안 심의가 어떠한 행태를 기반으로 이루어지는지 살펴보았다. 최근의 국회 의사결정에 관한 연구가 대부분 상임위원회 위주였기에 실질적인 법안심의 과정을 살펴보기 힘들다는 한계를 극복하기 위해 500쪽 가량의 소위원회 회의록을 Atlas.ti 프로그램을 이용한 분석을 통해 의원들의 행태를 파악하였다. 법률안 통과에 있어 비교적 큰 차이를 보이고 있는 보건복지위원회와 산업자원위원회를 분석대상으로 삼았는데, 분석결과 두 위원회의 행태적 차이는 예상과는 다르게 크지 않았다. 두 위원회 모두 전문성 범주가 압도적으로 많았으며, 대표성, 타협성, 당파성의 행태로 의사결정의 특징이 나타나 전반적인 차이는 존재하지 않았지만 보건복지위원회는 전문성과 당파성이 상대적으로 높았으며, 산업자원위원회는 대표성과 타협성이 상대적으로 높은 것으로 나타났다. 이러한 분석은 의회의 위원회 의사결정이 정당의 이익을 대변하기 위한 것이라는 정당이익이론과 의원 본인의 정치적 자산을 취득하기 위한 것이라는 이익분배이론과는 조금 다른 결과로 상임위원회라는 회의체가 본회의에 대한 정보제공을 목적으로 이루어지기 때문에 의원들의 의사결정 행태의 바탕이 전문성이라는 정보가설이론이 본 연구에서는 크게 지지되었다. 그리고 이와 같은 행태가 법률안의 의사결정에는 어떠한 영향을 미치는지 실증분석을 통해 살펴본 결과 당파성과 대표성은 법률안의 의결에 부정적인(-) 영향을 미쳤으며, 전문성은 긍정적인(+) 영향을 미치는 것으로 나타났다. 하위범주별로 로짓분석을 수행했을 때, 통계적으로 유의미한 결과가 나온 것은 정부의 정책에 대한 비판과 반대가 높을 때 의사결정이 이루어지지 않는다는 것이다. 의원들은 강한 비판과 반대를 통해 정부를 압박하지만 정부측에서 이를 수용하지 않을 경우, 의안의 의결은 대부분 이루어지지 않았다. 이는 법안 심의에 있어서도 정부의 영향력은 사실상 막강하다는 것을 보여주는 것으로 의원들이 심의하고 결정하는 회의체라 할지라도 실제 집행을 담당하는 정부의 동의 없이는 의안의 통과는 어려웠다. 또한 위원회별로 각 행태요인의 특성이 있는지 상호작용 효과에 관한 분석을 실시하였으나 통계적으로 유의미한 차이는 도출되지 않았다. 결국 의원들의 행태적 특성이 상임위원회가 다루는 정책의 내용에 따라 크게 달라지지 않았다는 것이다. 하지만, 의안 심의에 있어 산업자원위원회보다 보건복지위원회가 훨씬 더 활발한 회의를 진행하고 있었으며, 한 의안에 대한 심의기간과 질의 빈도가 훨씬 높은 것은 확인하였고, 한 의안에 대한 심의기간이 길기 때문에 상대적으로 다루는 의안수가 적을 수밖에 없는 것도 확인할 수 있었다. 결론적으로 17대 국회 법안심의 의사결정이 소위원회 중심으로 이루어지는 것을 확인할 수 있었으며, 일반적인 법안심의에 있어서는 당파성보다 전문성이 훨씬 많이 나타나고 있으며 행정부의 영향이 실제적으로는 크게 미치고 있는 것으로 나타났다. ; This study has investigated the behavioral basis for the congressional deliberation of bills, targeting the congressional subcommittee for the deliberation of bills. In order to overcome the limit in investigating the process of practical deliberation of bills because most recent studies on the congressional decision-making was based on the National Assembly Standing Committee, about 500-page minute of the subcommittee was analyzed using Atlas.ti program and then the behaviors of the members of the National Assembly were investigated. The Health and Welfare Committee and the Industry Advisory Committee were targeted because of comparatively large difference in the passage of the bills between them. As a result of the analysis, the behavioral difference between them were not so different from the expectation. Both committees had overwhelmingly large amount of professional categories, and the attributes of their decision-making appeared as the behaviors of representativeness, compromise, and partiality. Thus, there was no difference in general, but the professionalism and the partiality of the Health and Welfare Committee, and the representativeness and the comprise of the Industry Advisory Committee appeared relatively high. This analysis was slight different from the theory of party's interest, 'the decision-making by the committee represents the party's interest', and the theory of interest distribution, 'the decision-making by the committee is for the member to acquire their own political asset'. Because, the board aims to provide the information for the full-dress session, the theory of information hypothesis, 'the behaviors of the congressmen are based on the professionalism' was greatly supported in this study. And then, as a result of an empirical analysis for investigating how these behaviors influenced the decision-making on the bills, the partiality and the representativeness had a negative effect and the professionalism had a positive effect on the vote for the bills. The statistically significant result was produced when a logit analysis by subcategory was conducted. This implies that the decision is difficult to be made when the criticism and the opposition to the government is strong. When observing the minute of subcommittees, the administrators from the government are likely participated in the subcommittee as attendees not as doers, but they, in general, are more influential than the members. The members of the national assembly oppressed the government through powerful criticism and opposition. However, if the government did not accommodate these criticism and opposition, in most cases, the vote for the bills were not materialized. This implies that the government has an enormous effect on the deliberation of bills. In fact, the passage of the bills was difficult without an agreement by the government in charge of practical implementation, even though the members deliberate and decide in the board. In addition, an analysis of the effect of interaction was conducted to find out whether there were some attributes of each behavioral factors, but no statistically significant difference has been derived. Resultingly, the behavioral attributes of the member did not significantly vary in accordance with the contents of the policies being dealt by the standing committees. However, it was identified that in respect of the deliberation of bills, than the Industry Advisory Committee, the Health and Welfare Committee were proceeding meetings more actively, the deliberation period was longer and the quality of the deliberation were hight and the number of the bills dealt with was comparatively smaller, due to it's long period for the deliberation of bills. In conclusion, it was identified that the decision-making on the bills at the 17th National Assembly was centered on the subcommittees, and in respect of the deliberation of general bills, the professionalism appeared more often than the partiality, and the administration was significantly influential to that. ; Master

학위논문(석사)--서울대학교 대학원 :행정대학원 행정학과(정책학전공),2019. 8. 금현섭. ; 여성의 경제활동 참여와 맞벌이 가구가 증가하면서 육아기 자녀를 둔 부모는 근로권과 부모권의 양립이라는 과제를 안고 있다. 정부는 두 권리의 양립사이에서 발생하는 문제를 해결하고 궁극적으로 여성의 경력단절, 저출산 등의 사회적 문제를 극복하고자 다양한 일ㆍ가정양립제도를 시행하고 있다. 공직사회에서도 여성공무원과 맞벌이 공무원이 증가하면서 일하며 자녀를 양육할 수 있는 환경 조성의 필요성이 커지고 있다. 이에 정부는 그동안 시행해 온 출산휴가, 육아휴직, 유연근무제 등의 일ㆍ가정양립제도 외에 근로시간을 단축할 수 있는 육아시간제를 새로 시행하게 되었다. 육아시간제는 만 5세 이하 자녀를 둔 공무원이 최대 24개월 동안 급여의 삭감 없이 하루 최대 2시간 이내에서 단축근무를 할 수 있는 제도로, 시행된 지 채 1년이 되지 않았기에 제도 정착까지는 일정한 시간과 노력이 필요하다. 따라서 본 연구에서는 육아시간제 사용에 영향을 미치는 요인을 분석하고, 이를 바탕으로 육아시간제의 원활한 사용을 위한 정책적 대안을 제시하였다. 육아시간제 사용에 미치는 영향요인을 분석하기 위해 중앙부처 공무원을 대상으로 설문조사를 실시하였고, 수집된 자료는 STATA를 통해 분석하였다. 또한 설문을 보완하고 개인의 사례 및 제도 사용경험과 현장의 상황을 풍부히 이해하고자 인터뷰도 실시하였다. 분석결과, 업무적 요인인 업무의 상호의존성과 즉흥성은 육아시간제 사용경험에 유의한 영향을 미치지 않는 것으로 나타났다. 조직적 요인의 경우 과업지향적 문화와 비우호적 분위기의 세부지표 중 조직 내 제도 사용자가 드묾만 육아시간제 사용에 유의한 영향을 미치고, 비우호적 분위기의 세부지표 중 상사ㆍ동료의 눈치, 인사상 불이익, 동료에의 미안함은 유의하지 않았다. 제도적 요인의 경우 제도의 규정과 절차의 정비 지표 중 초과근무의 불인정만 유의한 영향을 미쳤고, 재량규정과 산정방식의 불합리함은 유의하지 않았다. 한편 질적연구에서는 각각의 요인들 모두 육아시간제 사용을 결정하는데 영향을 미치는 것으로 나타났다. 종합해보면 제도 대상자들이 육아시간제 사용에 있어 업무적, 조직적, 제도적 요인의 영향을 모두 인식하고 있으나, 제도의 사용을 결정함에 있어서는 조직적ㆍ제도적 측면의 장애를 제일 심각하게 받아들이고 있음을 알 수 있었다. 본 연구결과를 바탕으로 육아시간제 사용을 활성화하기 위한 몇 가지 방안을 제시하였다. 첫째, 육아시간제에 대한 안내와 조직 내 가정친화적 분위기를 조성해야 하고, 둘째, 육아시간제 사용자 확대를 위해 강제적 제도 사용을 위한 인사평가 등의 제도를 개선해야 하며, 셋째, 단축된 근무시간에 맞는 업무량이 주어져야 하고, 마지막으로 현실과 어긋나는 제도 규정을 개선해야 한다. 이를 통해 육아시간제가 잘 정착하여 많은 육아기 공무원의 부모권과 근로권이 조화롭게 보장받기를 바란다. ; With the participation of women in economic activities and the rise of double-income households, child-rearing parents are facing the task of the compatibility of working rights and parental rights. The government has implemented a variety of work-family compatibility systems to solve problems arising between the two rights and ultimately to overcome social problems such as female career discontinuation and low birth rates. In officialdom, the need to create an environment, where female and dual-income civil servants can work and foster children, has grown. In response, the government has introduced a new childcare time system that can shorten working hours in addition to work-family compatibility systems of maternity leave, paternity leave and flexible work system that has been implemented so far. The childcare time system is a system that has been in place for less than a year, and it requires a certain amount of time and effort to settle the system. Therefore, this paper aims to analyze the factors affecting the use of childcare time system and based on this analyze the paper also aims to propose an alternative policy for the smooth use of childcare time system. In order to analyze the factors that have influence on the usage behavior of the childcare system, the central government employees are surveyed and the collected data are analyzed through STATA. Interviews are also conducted to supply the survey and to provide a good understanding of the interviewee`s case and experience. The analysis shows that task`s interdependence and spontaneity, which are work-related factors, do not significantly affect the experience of using childcare time. In the case of organizational factors, among indicators of task-oriented culture and unfriendly atmosphere, unusual institutional users in the organization has significant influence on the use of childcare time system, and among the indicators of unfriendly mood, the look of supervisors and coworkers, personnel disadvantage, and their sorriness to coworkers are not significant. In the case of institutional factors, only the disapproval of overtime has a significant effect on the maintenance indicators of the system's regulation and procedures, and discretionary regulation and the absurdity of calculation methods was is not significant. Qualitative studies have shown that each factor has an effect on determining the behavior of childcare time system use. Overall, people are aware of the effects of work-related factors or organizational and institutional factors in the use of childcare time system, but they take organizational and institutional obstacles the most seriously in determining the use of the system. Based on the results of this study, several measures have been proposed to promote the use of childcare time system. Firstly, guidance on the childcare time system and the family-friendly atmosphere within the organization should be fostered. Secondly, the system should be improved to expand the use of the childcare system by connecting and evaluating the usage, Thirdly, the workload should be given according to the shortened working hours and finally, the system regulations that go against reality should be improved. 학위논문 (석사)-- 서울대학교 대학원 : 행정학과(행정학전공), 2012. 2. 정광호. ; 사회가 민주화되고 가치가 분화됨에 따라 각종 국책사업을 둘러싼 공공갈등이 심화되고 있다. 단순한 이익갈등뿐만 아니라 가치갈등 또는 복합갈등이 빈번하게 발생하고 있으며, 갈등범위도 전국적으로 확대되고 있다. 본 연구는 국책사업 중에서 '세종시 수정안'을 사례로 선정하여 정책결정 과정을 둘러싼 갈등에 대해 분석하고자 하였다. 특히 세종시 수정안 정책결정을 둘러싼 갈등의 배경과 성격은 무엇이고, 그 갈등을 관리 또는 해결하기 위해 정부에서 선택한 의사결정 방안이 적정하였는지 등을 참여적 의사결정 하의 갈등관리시스템의 틀로 분석하였다. 이를 통해 향후 세종시 수정안 추진과 유사한 대형국책사업 추진에 있어서의 성공적인 갈등관리를 위한 시사점을 도출할 수 있을 것으로 기대하였다. 제1장에서는 연구의 목적과 필요성, 연구의 대상과 범위에 대해서 설명하고 연구에서 사용한 사례연구방법과 자료수집방법에 대해 밝혔다. 제2장에서는 공공갈등의 개념과 유형 등 이론적 논의를 한 후, 참여적 의사결정이론을 소개하였다. 이러한 이론적 배경과 선행연구 등을 바탕으로 연구의 분석틀을 설정하였다. 제3장에서는 세종시 수정안 갈등의 발생배경과 갈등의 성격, 갈등의 쟁점과 이해관계자 분석, 갈등시기별 전개과정 등을 살펴보았다. 제4장에서는 연구의 분석틀에 따라 참여적 의사결정 요인과 정치 환경 요인에 따라 세종시 수정안 사례를 분석하였다. 주요 분석결과를 요약하면 다음과 같다. 우선 참여적 의사결정 요인에 따른 분석결과, 세종시 수정안 사례는 전반적으로 참여적 의사결정 방법에 의한 갈등관리가 미흡하였다고 평가할 수 있다. 첫째, '여론수렴 및 정보제공'이 미흡한 것으로 나타났다. 초기부터 여론수렴 및 정보제공 보다는 정부주도의 일방향적인 의사결정 추진 및 설득에 치중함으로써 갈등관리에 부정적인 영향을 미쳤다고 볼 수 있다. 둘째, '참여적 의사결정 활용' 측면 또한 미흡한 것으로 나타났다. 관련분야의 학식과 경험이 풍부한 전문가들을 민간위원으로 포함시켜 '세종시 민관합동위원회'를 구성ㆍ운영하였으나, 인적구성에서 찬성의견과 반대의견에 대한 균형을 이루지 못하여 활동결과에 대한 신뢰도를 저하시키는 원인이 되었다. 셋째, '협력규칙의 적용 여부'를 살펴보면, 우선 참여규칙, 분해규칙 적용 측면에서 미흡하였다. 그리고 자원확대규칙 측면에서는 원안보다 큰 경제적 보상이라는 인센티브를 제공하였으나, 이해관계자들에게 정치적 신뢰를 얻지 못함으로써 큰 효과를 발휘하지 못하였다. 마지막으로 '결과의 공개 및 정책에의 반영 여부' 측면에서 볼 때, '세종시 발전방안'을 언론 브리핑 형태로 발표함으로써 결정결과의 공개 자체는 투명하게 이루어졌다고 할 수 있으나, 수정안 마련 과정이나 발표 이후 국민의견수렴 절차를 거치는 과정은 미흡했다고 볼 수 있다. 정치환경 요인에 따른 분석결과는 다음과 같다. 우선, 여당내 대통령의 리더십이 수정안 찬성집단과 반대집단으로 분절된 결과, 정책의제 설정 및 정책결정과정의 추진력이 약화되었다. 둘째, 야당이 타협의 의사 없이 세종시 수정 추진에 무조건 반대하는 방식으로 진행되어 갈등이 증폭되었다. 셋째, 핵심 어젠다 제기의 정치적 타이밍과 관련, 5년 단임제의 특성을 고려할 때 집권 2년이 다 되어 갈 무렵 세종시 수정이라는 어젠다가 공식 제기됨으로써 유리한 타이밍을 놓쳤다고 볼 수 있다. 이와 같이 불리한 환경적 요인들은 참여적 의사결정에 의한 갈등관리에 부정적인 제약요인으로 작용하였다고 볼 수 있다. 제5장에서는 이와 같은 연구결과를 요약하고, 다음과 같은 시사점을 도출하였다. 첫째, 갈등과 갈등 당사자의 특성, 갈등이슈 유형 등에 따라서 갈등관리방식의 선택 또한 달라져야 한다는 것이다. 특히, 극단적인 대립과 갈등이 예상되고 그 파급효과가 매우 큰 세종시 수정안과 같은 사례일수록, 사전에 갈등영향분석 등을 통해 갈등의 요인을 사전예측ㆍ분석하여 관리대책을 마련하고, 정책의제설정 및 정책결정과정에서 참여적 의사결정 수단의 적극적인 활용이 필요하다고 볼 수 있다. 둘째, 정책대상집단과 이해관계자에 대한 사회적 인식(social construction of target populations)에 따라 갈등관리의 구체적인 수단 또한 달라져야 한다는 점을 알 수 있다. 따라서 향후 유사한 갈등사례에 있어서 정부의 갈등관리 전략 마련시 대상집단에 대한 사회적 인식에 대한 관심을 바탕으로 유ㆍ무형의 인센티브를 적절히 활용하는 것이 필요하다고 할 수 있다. 셋째, 참여적 의사결정기법 활용을 위한 구체적인 법적ㆍ제도적 장치 마련이다. 세종시 수정안 사례에서 전반적으로 참여적 의사결정방법의 구체적인 수단 활용이 미흡했던 것은 이러한 방안을 준비하고 실행할 수 있는 제도적 뒷받침이 부족했던 점에서도 그 원인을 찾을 수 있다. ; As society is democratized and the value is divided, public conflict surrounding the various national projects is growing. Value conflicts or compound conflicts, as well as simple interest conflicts occur frequently, and conflict is expanding nationwide scope. This study selected the case of amendment of Sejong city among various national projects as a case study, and tried to analyze conflict over the decision-making process of the case. Especially, this analyzed over the background and characteristic of conflict on the amendment of Sejong city, and appropriateness of the system of conflict management selected by the government in order to manage or solve the conflict through the frame of conflict management system under participative decision-making. This promotion is similar to the amendment during the next three kinds of large national projects in promoting the success of the implications for conflict management was expected to be drawn. Through this study, it is expected to reach to an implication for the successful conflict management on the similar case of the amendment of Sejong city. Chapter 1 explains the purpose, necessity, range and target of the research, and it defines a method of case study as well as the method of collecting data that are used for the case study. Chapter 2 explains the theory of participative decision making after introducing a theoretical review such as concept and kinds of public conflict, and establishes a framework of the study by referencing previous studies. Chapter 3 reviews the background and nature of conflict on the amendment of Sejong city, conflict issues and stakeholders, and development process of conflict. Chapter 4 analyzes the case by the factors of participative decision making and the political-environmental factors through the framework. The summary of main analysis is as follows: First of all, the case of amendment of Sejong city can be evaluated that the conflict management through participative decision making is insufficient, as a result of analysis by the factors of participative decision making. First, the 'collection of public opinion and provision of information' was insufficient. From the beginning, the government focused on a one-way decision-making and persuasion rather than collection of public opinion and provision of information, and it negatively influenced on conflict management. Second, the 'use of participative decision-making' was also insufficient. Even though various experts participated in the Sejong city committee, the composition was biased. Therefore it was one of the main cause of declining the reliability of the results. Third, 'participating rule' and 'factoring rule' were not sufficiently utilized. In terms of 'resource expanding rule', the government suggested more incentive of amendment plan than one of original plan, but it was not effective because of distrust of the government. Finally, in terms of announcement of the result and feedback of policy', amendment of Sejong city was openly publicized through giving a briefing. However the process of collecting extensive opinions was insufficient. The result of analysis by means of political-environment factor is as follows: First, the leadership of President was divided into supporting groups and opposition groups. Therefore the momentum of agenda-setting and policy-making was weakened. Second, the opposition party opposed to the amendment of Sejoing city without any condition. Third, the political timing of agenda-setting was not timely. The government missed the advantageous timing because the agenda was proposed during second year of a 5-year term of presidency. These adverse environmental factors negatively effected on conflict management of participative decision making. Chapter 5 summarizes the results of these studies, and the following implications were drawn. First, the method of conflict management should be selected according to the nature of conflict and the conflict parties, conflict type of issue. In particular, when the extreme conflict is anticipated and the result of the policy is wide, the government should pre-establish measures of conflict management through conflict effect analysis, and participative decision making should be actively utilized. Second, the specific means of conflict management should be selected by social construction of target populations. Third, the government should prepare the specific legal and institutional means for the use of participative decision making. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 행정학과(행정학전공), 2012. 2. 정광호. ; 국문 초록 본 연구에서는 고구려연구재단과 동북아역사재단의 설립과정을 역사적 사회 환경적 관점, Allison의 정부정치 모형적 관점, 그리고 Kingdon의 정책흐름 모형적 관점에서 비교 분석하여 두 기관의 설립, 두 기관의 제도적 성취 및 역할 범위의 차이를 가져온 요인이 무엇인가를 밝혀보고자 하였다. 일반적으로 조직설립을 다루는 이론으로서 역사적 사회 환경적 관점에서는 조직 환경론, 특히 구조적 상황이론과 조직생태이론이 유용한 분석도구로 활용되어져 왔다. 이러한 이론들은 조직설립이 그것을 둘러싼 맥락 또는 상황에 의존한다는 결정주의적 입장을 취하고 있기 때문에 특정 상황적 요인의 존재 또는 발생으로 조직이 설립되었다는 것을 설명하는 데는 유용한 관점인 것으로 인식되어져 왔다. 하지만, 본 연구에서는 조직 환경론적 관점만으로는 왜 특정 공공조직은 특정 상황 또는 맥락의 존재에도 불구하고 설립 또는 사멸되지 않으며, 왜 유사한 공공조직간 제도적 성취의 차이가 발생하는 가를 설명하는 데는 한계가 있다고 보고 조직설립과 관련된 조직 환경론적 관점의 한계를 적시함과 동시에 준 정부조직 설립과정의 특수성을 감안하여 정부정치모형과 정책흐름 모형을 추가로 적용함으로써 고구려연구재단 및 동북아역사재단 설립과정에 대한 비교분석을 시도하였다. 먼저, 역사적 사회 환경적 관점에서는 구조적 상황이론과 조직 생태이론을 적용하여 두 기관의 설립을 가져온 역사적 배경이 무엇이며, 동북아역사재단 설립과 더불어 이에 흡수 통합된 고구려연구재단의 사멸 요인이 무엇인지를 밝혀보고자 하였다. 동 연구 결과에 의하면, 고구려연구재단의 사멸은 낮은 신뢰성 및 예측가능성, 신생조직의 불리, 작은 조직 규모 및 예산, 핵심적 조직 변화의 시도 및 동북아역사재단의 설립에 기인한 것으로 나타났다. 두 번째로, Allison의 정부정치 모형을 통하여 두 기관 설립을 둘러싸고 벌어진 참여자들의 흥정과 타협을 분석하여 이들의 입장·선호·인식·기대이익 등의 차이가 두 기관의 설립 및 제도적 성취에 어떠한 영향을 주었는가를 설명하였다. 그 결과 두 기관의 설립 및 제도적 성취의 차이 발생은 핵심참여자로서의 대통령과 행정기관의 인식 및 선호의 차이에 의해 크게 영향을 받은 것으로 나타났다. 다시 말해, 고구려연구재단 설립과 관련된 대통령 및 행정기관의 인식 및 입장은 한·중 양국의 외교관계 등을 의식해서 상당히 유화적이었던 반면, 일본의 역사교과서 왜곡 및 독도 영유권 도발로 시작된 동북아역사재단 설립과 관련하여서는 대통령과 행정기관의 인식이 매우 단호하였던 것으로 밝혀졌다. 세 번째로, Kingdon의 정책 흐름 모형을 적용하여, 두 기관 설립을 둘러싼 문제 및 정책의 흐름의 차이가 어떠하였는지를 비교 분석하였다. 먼저, 문제 흐름의 측면에서 고구려 역사 왜곡 문제에 대한 정책 당국자 또는 학계의 인식은 약했으며, 정책의 흐름도 시민단체 주도로 이루어져 일관성 및 강도가 약했다는 것을 확인하였다. 반면, 일본의 역사 교과서 왜곡 및 독도 영유권 도발로 촉발된 동북아역사재단 설립을 둘러싼 문제의 흐름은 강하고 일관성이 있었으며, 정책 흐름 역시 대통령과 행정기관의 주도하에 하향식으로 이루어져 일관되고 강하게 진행되었다. 이러한 두 가지 흐름상의 차이가 두 조직간 제도적 성취의 차이를 가져온 또 다른 설명 요인이었다고 할 수 있다. 본 연구의 결과, 발견된 시사점은 다음과 같다. 먼저, 역사적 사회 환경적 관점만으로는 공공조직 설립과정을 명확히 이해하는 데는 한계가 있다는 것을 확인하였다. 다시 말해, 역사적 사회 환경적 관점은 조직의 구조나 기능을 결정하는 요인으로 특정 환경 혹은 맥락을 강조해왔지만, 동 관점만으로는 왜 특정 환경의 존재에도 불구하고 왜 특정시점에는 조직 설립 또는 사멸이 이루어지지 않다가 다른 시점에 와서야 이루어지는가에 대해서는 명쾌한 해답을 제공하지 못하는 한계가 있다는 것이다. 두 번째, 준 정부조직은 민간조직과는 달리 법적·행정적·제도적 제약 조건하에서 설립되는 경우가 많기 때문에 준 정부 조직의 설립과정을 보다 명확히 이해하기 위해서는 보다 다양한 관점 즉, 정부 정치적 관점 및 정책 흐름적 관점 등을 통한 기존 이론의 보완 또는 대체가 필요하다는 것이다. 특히 우리사회가 다원화된 사회로 진행되어감에 따라 공공조직 설립과정을 이해하기 위해서는 참여자의 정치적 흥정과 타협을 다루는 정부정치적 관점에 대한 고려가 필요할 것으로 본다. 주요어: 역사적 사회 환경적 관점, 구조적 상황이론, 조직 생태이론, Allison의 정부정치 모형, Kingdon의 정책흐름 모형, 준 정부조직 ; ABSTRACT A Comparative Analysis of the Establishment Processes of Two Quasi-Governmental Organizations: The Cases of the Koguryo Research Foundation and the Northeast Asian History Foundation Si Yung Jung Department of Public Administration Graduate School of Public Administration Seoul National University The purpose of this study is to analyze through a comparative approach the establishment processes of the Koguryo Research Foundation and the Northeast Asian History Foundation from the perspectives of historical-social environment, Graham Allison's Governmental Politics Model, and John W. Kingdon's Policy Streams Model in order to clarify the establishment processes of these two organizations and to identify which factors determined their institutional achievements. Generally, both contingency theory and organizational ecology theory have been widely used as tools for analysis of organizational establishment. These theories have strengths for explaining the contingencies and contexts which determine the establishment of organizations. However, these theories have weaknesses in explaining the reasons why an organization fails to be established in the presence of a certain contingency or why there are differences of institutional achievements between certain similar organizations. To further the understanding of organizational establishment and the incidence of differences of institutional achievement between the two organizations, this study adopted the Governmental Politics Model and the Policy Streams Model. In the perspective of the historical-social environment, both contingency theory and organizational ecology theory were adopted as tools for analysis. Contingency theory assumes that the structure or management style of an organization depends on the environment which surrounds the organization. In the perspective of contingency theory, the creation of the Koguryo Research Foundation was initiated by the Chinese distortion of Koguryo history, while the Northeast Asian History Foundation was created by the Japanese distortion of history and sovereignty provocation over Dokdo. The perspective of organizational ecology theory was adopted to explain the reasons why the Koguryo Research Foundation was closed and then merged into the Northeast Asian History Foundation after two and one-half years of activity. Through this perspective, this study found that the closure of the Koguryo Research Foundation resulted from such factors as lower reliability and accountability, the liability of newness, the small size of its organization and budget, the attempt of essential organizational change, and the creation of a new organization, the Northeast Asian History Foundation. In the perspective of the Governmental Politics Model, this study examined how the political resultants, the Koguryo Research Foundation and the Northeast Asian History Foundation, were drawn through bargaining and negotiation by the players involved in the game. This study revealed that the differences in the institutional achievements between the two quasi-governmental organizations resulted from the differences of the players' perceptions, preferences, and stands on the issue. In terms of perception, the perception of key players such as the president of the Republic of Korea and his administration on the issue of the Chinese distortion of Koguryo history was pacificatory, while the perception of the president and the administration on the issue of the Japanese distortion of history and the issue of Dokdo was quite determined. Through this lens, this study also found that the players perceived the issue not only on the basis of national interests, but also on the basis of their organizational interests and personal concerns. Finally, through the viewpoint of the Policy Streams Model, this study examined how the streams of problems and policy alternatives proceeded along the processes of the founding of the two quasi-governmental organizations. According to the analysis, the streams of problems surrounding the founding of the Koguryo Research Foundation were weaker than the streams of problems concerning the Northeast Asian History Foundation. In the perspective of policy streams, those concerning the founding of the Northeast Asian History Foundation were consistent and strong due to the determined stand of the president on the issue, while the policy streams regarding the Koguryo Research Foundation were incremental, inconsistent, and mutated due to the lack of presidential support and the passive attitude of the administration toward the issue. The first implication of the study is that a variety of aspects of organizational establishment should be reviewed to understand the process of organizational founding more clearly. Though organizational environment theories have assumed that environment or context determines the structure or function of the organization, the theories can not clearly explain why the birth or closure of an organization occurred in a specific time in spite of the presence of previous contingencies. The second implication is that policy makers or researchers should consider such factors as politics, administration, and the legality of the issues regarding the establishment of a quasi-governmental organization, because quasi-governmental organizations are governed by legal, administrative, and other institutional constraints unlike private organizations. The third implication is that, as Korea society is growing more pluralistic, the relevance of the Governmental Politics Model is likely to become higher in explaining the establishment processes of quasi-governmental institutions in the Republic of Korea. 학위논문 (석사)-- 서울대학교 대학원 : 철학과(서양철학전공), 2012. 2. 정호근. ; The objective of this thesis is to elucidate the concept of the general will and to make Rousseau's point clear by refuting criticisms which determine the general will as totalitarianism. To this end, I would like to reconstruct the concept of the general will by focusing on Rousseau's paradoxical expression of 'forcing to be free'. Because I think that it is possible to get a correct understanding of the general will through paying attention to this phrase. There are two kinds of 'forcing to be free' in the theory of Rousseau's General will. One is found in the notorious passage arguing that whoever refuses to obey the general will must be forced to be free in the Book 1 chapter 7 of On Social Contract. The other is implicit one in the passage discussing the conditions of the general will in the Book 2 chapter 3 and Book 2 chapter 7(part 4 chapter 8). I would like to examine these problems respectively and try to show that Rousseau's ultimate point consists in not 'forcing' but 'freedom'. Conclusively, the authentic difficulty of interpreting of Rousseau's logic is that nevertheless 'forcing to be free' is necessary to the production of the general will, he permit the possibility of failure of this process in practice. Rousseau's theory of the popular sovereignty argues that the foundation of legitimacy of the state does not consist in the divine or natural foundation but in the autonomous will of the people. Despite this theoretical postulate, the people appear to not only rational and social unity, but also always potentially the multitude as disordered gathering of individuals who are vulnerable to a capricious passion. On the one hand, the people's general will should make a society legitimate, particular deliberation of the people may be contingent and could make an erroneous decision on the other. As a result, Rousseau introduces the legislator or the civil religion which is external to a people in order to transform a multitude into unified people. However, because of the very reason that people are still and always multitude, they consequently could not obey this foreign authority so the problem regarding difficulty of self-ruling of the people remains unsolved. At a glance, Rousseau's theory of popular sovereignty seems to optimistic assertion that the people should and could govern itself. But Rousseau's pessimistic claim that the ideal people cannot be naturally given, but must be constructed by constant effort should not be overlooked as well. Finally, the introduction of the legislator or the civil religion is not contradictory to the principle of popular sovereignty because the success or failure of this heteronomous agency is uncertain and the popular sovereignty keeps still its autonomy. The problems are described as follows: the general will aiming at common good could fell to mere will of all by acquiring of a particular will possessed by some individuals. In the same way, the people who should be unitary and organic are degenerated into a blind multitude and the citizen who must be active and rational in the collective deliberation into a passive, passionate subject. The principle of the popular sovereignty claiming that good law makes a good people but the origin of the good law must be also the people, and the fact that primitive people does not have any capacity to legislate such good law is the source of the circular logic Rousseau engages. It also suggests that the self-ruling of the people is not easily attainable project by the introduction of the legislator or the civil religion because after the initial social contract, passionate, irrational and apolitical properties of the human being who had had those attributes in the state of nature cannot be completely eradicated. So the state of the society in Rousseau is more vulnerable than the traditional reading in that there is always the danger of reemergence of the state of nature. The fact that the sovereignty belongs to the people but the people do not have such capacity to exert the sovereignty is the central ambiguity derived from the theory of popular sovereignty in Rousseau. Rousseau's democracy as self-ruling of the people, therefore, remains always incomplete, contestable and unfinished democracy. This paradox of Rousseau is deduced from the consistent, thorough accomplishment of the principle of the freedom. In other words, Rousseau's premises arguing that the legitimacy of the politics does not have any transcendent and ultimate ground and its source is a unique source of will of the people as free being even permit the freedom to refuse their freedom. That is to say, individual citizens must be forced to be free but also can have the (natural) freedom not to be forced to have (civil and moral) freedom. In short, as though effective denaturalization is necessarily required to make man into citizen, it remains a process without a priori guarantee. Thus, the binary oppositions which support Rousseau's whole system, such as oppositions between the society and nature, the people and multitude and the general will and the will of all always have the possibility of confusion in practice. That danger renders the general will only transient or temporary in the conflictual process of politics. The fundamental problem of politics suggested by Rousseau is that the passage from the state of nature to the state of society is necessary, but is also very difficult and could not be achieved entirely. In conclusion, all these considerations show that Rousseau's political philosophy does not defense the alleged totalitarianism but is the philosophy of 'freedom' in the strict and consistent sense of the word. ; 본 논문의 목적은 을 중심으로 루소의 일반의지 개념의 정체를 해명하고, 이를 전체주의로 규정하는 비판들로부터 루소의 논지를 명료하게 하는 것이다. 이를 위해 나는 '자유롭도록 강제'된다는 루소의 역설적인 표현을 중심으로 일반의지 개념을 재구성하고자 하며, 이 점에 주목할 때 비로소 일반의지 개념에 대한 정확한 이해가 가능하다고 본다. 루소의 일반의지 이론에서는 크게 두 가지의 '자유롭도록 강제됨'이 나타난다. 하나는 일반의지를 거부하는 자들이 자유롭도록 강제되어야한다고 주장하는 1부 7장의 주장이며 다른 하나는 2부 3장 및 2부 7장(4부 8장)에서 일반의지의 성립 조건을 논의하는 대목에서 드러난다. 나는 이들을 각각 살펴보고 루소의 궁극적인 강조점은 강제가 아니라 자유에 있음을 보여주고자 한다. 결론적으로, 루소의 논리를 따를 때 나타나는 진정한 난점은 자유롭도록 강제하는 과정이 일반의지의 산출을 위해 필수적임에도 불구하고, 실천적으로는 이것이 실패할 수 있는 여지를 허용하는 데에 있다. 루소의 인민주권론은 국가 정당성의 토대가 신적인 것이나 자연적인 근거에 있다는 견해를 부정하고 인민의 자율적인 의지가 정치적 권위의 원천이라고 주장한다. 그런데 인민은 항상 이성적이고 사회적인 질서정연한 통일체인 것이 아니라 또한 잠재적으로 정념에 좌우되기 쉬운 개인들의 무질서한 모임으로서 다중으로 현상하기도 한다. 즉 한편으로 인민의 일반의지는 사회를 정당한 것으로 만드는 조건이지만, 다른 한편으로 인민들의 개별 심의는 우연적이며 오류를 범할 수 있는 것이다. 따라서 루소는 다중을 인민으로 만들기 위해서 입법자와 시민종교와 같은 인민 외부의 권위를 도입한다. 그러나 인민은 그들이 다중이라는 바로 그 이유로 이러한 외부적 권위에 복종하지 않을 수도 있기 때문에, 인민이 스스로를 통치하는 것에 관한 난점은 해결되지 않는다. 일견 루소의 인민주권론은 인민이 인민 자신을 통치해야 한다는 낙관적 주장으로 보이지만, 인민은 그 자체로 주어지거나 발견될 수 없으며 다만 이상적 인민으로 구성되어야 한다는 루소의 비관적 주장 역시 간과되어서는 안 된다. 결국 입법자나 시민종교의 도입은 인민주권의 원리와 상충되는 것이 아닌데, 이러한 타율적 장치의 성공 여부는 불확실하여 인민주권은 여전히 그 자율성을 지니기 때문이다. 문제는 공동이익을 지향해야 할 일반의지가 각 개인이 갖는 특수의지의 득세에 의해 한갓 전체의지로 전락할 위험, 통일적이고 유기적이어야 할 인민이 무지몽매하고 개별적인 다중으로 전락할 위험, 집단적인 심의에 있어 능동적이고 합리적이어야 할 시민이 수동적이고 정념에만 사로잡힌 신민으로 전락할 위험에 있다. 좋은 법이 좋은 인민을 만들지만 좋은 법의 출처는 또한 인민이어야 한다는 인민주권의 원리, 그리고 최초의 인민은 그러한 입법을 할 수 있는 역량을 가지지 못하는 다중이라는 상황이 루소가 사로잡힌 순환 논리의 원천이다. 그런데 사회계약 이후에도 인간이 자연 상태에서 갖던 감성적, 비합리적, 비정치적 속성은 완전히 해소되지 않으며, 이는 입법자나 시민종교 같은 장치를 통해서도 인민의 자기통치가 온전히는 달성될 수 없는 난제임을 보여준다. 이처럼 루소의 사회 상태는 항상 부분적으로나마 자연 상태가 돌발할 수도 있는 위험을 갖는다는 점에서 취약한 것이다. 주권은 인민에 속하지만 인민은 스스로를 직접 통치할 수 있는 역량을 결여한다는 것이 루소의 인민주권론이 보여주는 애매성이다. 그러므로 인민의 자기통치로서 루소의 민주주의는 항상 불완전하여 계속해서 갱신되고 수정되어야 하는 미완의 민주주의로 남는다. 루소에서 이러한 역설은 자유의 원리를 일관되게 관철시키게 됨에서 귀결된다. 즉 정치의 정당성에는 어떠한 선험적이고 궁극적인 토대도 없다는 것, 인민은 자유로운 존재로서 그들의 의지만이 정치적 정당성의 유일한 원천이라는 루소의 전제는 그들이 스스로의 자유를 거부할 자유마저도 허용한다. 다시 말해 각 개인은 일반의지의 실현을 위해서 자유롭도록 강제되어야 하지만, 이들은 '자유롭도록'(즉 시민적 자유와 도덕적 자유) 강제되지 않을 수 있는 자유(즉 자연적 자유)를 가질 수도 있다. 요컨대 인간을 시민으로 만들기 위해서는 효과적인 탈자연화가 요구되지만, 이는 보증없는 과정이다. 따라서 루소의 체계를 떠받치는 이항대립, 즉 사회와 자연, 인민과 다중, 일반의지와 전체의지는 항상 실천적으로는 혼동될 위험을 가지며 이러한 위험은 일반의지가 정치의 갈등적인 과정 속에서 단지 일시적으로만 가능한 것으로 만든다. 루소가 보여주는 정치의 근본 문제는 자연 상태로부터 사회 상태로의 이행이 필수적이지만, 동시에 이것이 매우 어렵고 온전히 달성될 수 없다는 것이다. 결론적으로 이러한 탐구는 루소의 철학이 전체주의를 대변하는 것이 아니라 여전히 '자유'의 철학이며, 그것도 매우 일관적인 의미에서 그러함을 보여준다. ; Master

학위논문(석사)--서울대학교 대학원 :행정대학원 행정학과(정책학전공),2019. 8. 우지숙. ; 본 논문은 브라질의 인터넷권리보호법(Marco Civil da Internet)이 어떠한 전개과정을 거쳐서 지금에 이르게 되었는지 고찰한다. 각국이 인터넷의 자유와 규제의 딜레마 속에서 접점을 찾기 위해 노력하고 있는 가운데, 라틴아메리카의 브라질에서는 1990년대 이래 인터넷 규제에 관한 정책의제가 국가 내부에 존속하다가 오랜 논의 끝에 2014년 3월 25일 인터넷 이용자 표현의 자유, 개인정보보호, 망중립성(Net Neutrality) 보장 등을 골자로 하는 세계 최초의 인터넷 권리장전의 제정으로 이어진다. 연구는 '브라질의 Marco Civil은 어떠한 계기로 다른 정책들을 우선하여 정책결정자가 주목하는 주요 의제로 채택되어 제정으로 이어졌는가?'를 질문하고, 이러한 정책변동 사례를 Sabatier의 ACF 모형과 Kingdon의 MSF 모형의 결합모형에 적용하여 체계적으로 답을 모색하였다. 연구의 결과는 다음과 같다. 먼저, Marco Civil 정책은 각각 '평등주의'와 '시장주의'라는 상충하는 신념체계를 가진 찬반 옹호연합으로 분화되어 정책결정과정에서 첨예한 대립을 펼쳤으며, 정책학습의 기회에도 자신들의 신념체계를 견고화하였다. 둘째, 이들 옹호연합은 브라질 사회의 다양한 외적 변수에 직간접적인 영향을 받아 신념체계를 형성하였다. 셋째, Marco Civil은 수차례 입법 지연을 겪다가 Snowden 사건이라는 강력한 외부적 촉발기제에 의하여 정책의 창이 열리고 정책변동으로 이어질 수 있었다. 넷째, Marco Civil 정책결정과정에서 정책중개자와 정책선도자의 역할이 두드러진 것으로 나타났다. 특히 정책선도자인 Lula 대통령과 Dilma 대통령의 적극적인 역할은 Marco Civil 제정에 있어 결정적인 영향 요인이라고 판단할 수 있다. 연구의 함의는 다음과 같다. 먼저 이론적 함의로는 첫째, 연구는 ACF 모형과 MSF 모형의 적용 사례로서 비교적 새로운 분야인 인터넷 규제정책을 연구대상으로 삼았다. 인터넷 정책은 찬반 옹호연합의 첨예한 갈등이 나타나는 정책이라는 점에서 결합모형에 따른 설명력이 높게 나타났다. 둘째, 모형이 개발된 다원주의적인 서구사회가 아닌 권위주의와 엘리트주의가 뿌리 깊게 작용하고 있는 브라질의 사례를 분석함으로써 ACF 모형과 MSF 모형의 유용성을 입증하였다. 셋째, 일반적으로 대통령의 적극적 관심을 가질 경우 빠른 정책 대안의 마련으로 합리적인 대응 방안을 찾아낸다는 합리적 모형으로는 쉽게 설명되지 않는 사례로서, 룰라 대통령의 적극적인 지원에도 불구하고 임기 내 법안 제정에 실패한 원인을 추적할 수 있다. 넷째, 정책의 흐름이 열려 정책산출에 이르는 데 정치의 흐름은 정책의 창을 여는 데 결정적인 역할을 하지는 않았다. 호세프 정부 시기 정치의 흐름은 법안 제정에 부정적인 영향으로 작용하여 Marco Civil 폐지의 위기에까지 갔으나 외부적 초점사건에 의해 제정에 이르게 된다. 정책적 함의는, 먼저 정책선도자의 리더십과 정책 방향의 중요성을 함의한다. 국민의 인권 보장을 위한 룰라 대통령의 일관된 사회정책과 리더십은 우리나라에도 시사하는 바가 많다. 둘째, Marco Civil 법은 국가가 인터넷을 어느 범위까지, 어떠한 방식으로 규율해야 하는가와 관련된 가치충돌적이고 논쟁적인 쟁점을 되짚어보고 추후 유사한 인터넷 권리법 제정 논의에 적용할 수 있는 교훈적인 사례이다. 셋째, 본 정책은 참여민주주의를 실천한 사례로서 정부에 대한 국민적 신뢰를 반영한다. 마지막으로 한국과 브라질은 공통적으로 2006년도 인터넷상 사이버범죄 규제안을 제정하였으나, 한국의 경우 해당 법이 임기만료로 폐기된 이래 의미 있는 논의가 이루어지지는 않은 반면, 브라질은 사이버범죄법 발의라는 '초점사건'이 휘발되지 않고 정책선도자의 적극적인 의지 아래 인터넷권리법의 제정으로 이어진다. 브라질의 인터넷 정책결정과정에 대해 검토하고 구체적인 법안의 추진 동기, 과정, 정책의 결정요인 등을 모색함으로써 우리나라의 인터넷 규제정책이 어떠한 위치에 놓여 있는지 비교해볼 수 있을 것으로 생각한다. ; One of the most significant policy goals in the internet arena in the last decade has been striving to seek a reasonable balance between freedom and regulation of the Internet. Brazil, as Latin America's economic giant, has also spent a long time finding the balance point between creating economic profits and protecting human rights under the pressure of mediating the conflicting values of regulating and protecting users' behaviors from circumstances of the internet. And it is one of the key policy initiatives associated with this shift to pass the world's first Internet Bills of Right which is called Marco Civil da Internet on March 25, 2014 after years of discussion, which calls for freedom of expression for the Internet users, protection of personal information and guarantee of network neutrality. This case study explores the policymaking process of the Marco Civil da Internet in Brazil. It examines specifically how Brazilian internet policy came into being applying the combination frameworks of Sabatier's Advocacy Coalition Framework and Kingdon's Multiple Streams Framework, in order to learn more about the linkages between research and policy. The study began with a relatively simple question, 'On what occasion was Brazilian Marco Civil da Internet adopted as a major agenda for policymakers, prioritizing other public policies and being eventually enacted after long debate' and systemically sought an answer applying the example of this internet policy change through these policymaking process frameworks. The results of the study are as follows: First, the stakeholders in the policymaking of this legislation were divided into the a pro-MCI coalition and an anti-MCI coalition with a conflicting belief system between 'Equalityism' and 'Marketism' and strengthened their own belief system even in the opportunities of policy learning. Second, these advocacy coalitions formed these belief systems, directly or indirectly being influenced by various external variables in Brazilian society. The Snowden event in 2013 worked as a powerful external trigger mechanism of this policymaking process, as a strong variable that opened the window of policy and lead to policy changes after going through several legislative delays. Third, it was indicated that the role of a policy broker and a policy entrepreneur in MCI policymaking process was shown to be outstanding. In particular, the active role of policy entrepreneurs, the two Brazilian Presidents, Lula da Silva and Dilma Rousseff, could be judged as a decisive factor in enacting this legislation. Next, the implications of the study are twofolds. Firstly, the theoretical implications are as follows. First, the study targeted the Internet regulatory policy which is a relatively new field as an example of the application of the ACF and the MSF. The Internet policy might be highly adequate research topic, given that it is a policy that showed a strong conflict between a pro-MCI and an anti-MCI advocacy coalitions. Second, the study proved the usefulness of the ACF and the MSF by analyzing Brazilian case where authoritarianism and elitism have been deeply rooted rather than a pluralistic western society in which these theoretical frameworks were developed. Third, the study could track the causes for failure to enact this legislation within his term, despite President Lula's active support, which is not reasonably explained with a rational model supposing if the president has a active interest, he could find a reasonable and quick policy alternative. Fourth, Political Stream in this policymaking process did not play a crucial role in opening the window of policy. The political stream during the Rousseff administration had influenced a negative effect on enacting the legislation and reached the crisis of the abolition of the MCI, but an external focus event led it to be enacted in the conclusion. Political and practical implications are as follows: first of all, this study implies the importance of leadership and policy direction of policy entrepreneurs. President Lula's consistent social policy and leadership to ensure the human rights of Brazilian people provide a lot of implications for Korean administration. Second, the MCI is an instructive example that could be applied later in the discussion of enacting an Internet Bills of Right in other countries, which reflects on the value-conflicting and contentious issues concerning how the country should regulate the Internet. Third, as an example of practicing participatory democracy, the MCI policymaking process reflects public trust about the government. Finally, although each Korea and Brazil enacted regulations of cybercrime on the Internet in 2006, no meaningful discussion had been made in Korea since the law was scrapped at the end of its term, while Brazil's 'focus event' of trying to introduce the cybercrime law eventually led to the enactment of the Internet Bills of Right under the active will of policy entrepreneurs.
