Artykuł przedstawia zmiany systemowe wprowadzone w Polsce po 1989 r., które umożliwiły przejście z gospodarki centralnie sterowanej do wolnorynkowej. Podjęcie głębokich i szerokim reform o charakterze prawnym, gospodarczym i społecznym pozwoliło na ukształtowanie demokratycznego ustroju po wielu latach sprawowania władzy komunistycznej. Transformacja systemowa była możliwa dzięki znaczącym przemianom podstaw prawnych, począwszy od zmian w ustawie zasadniczej, określającej istotę prawa własności i obowiązek jego poszanowania, poprzez uchwalenie innych aktów prawnych koniecznych do zmiany stosunków własnościowych (takich jak ustawy o komercjalizacji i prywatyzacji przedsiębiorstw państwowych, prawa o działalności gospodarczej czy ustawy o gospodarowaniu nieruchomościami rolnymi). Równoległe reformy systemu bankowego oraz polityki pieniężno-kredytowej umożliwiły napływ kapitału zagranicznego i pozwoliły na rozwój prywatnej przedsiębiorczości. W wyniku przemian ustrojowych, jakie zaszły w ostatnich 25 latach, Polska jako demokratyczne państwo prawa jest członkiem Unii Europejskiej, a polska gospodarka rynkowa staje się coraz bardziej konkurencyjna. Niestety, mimo głębokich przekształceń w sferze własnościowej, Polska przez ostatnie ćwierćwiecze nie rozwiązała kwestii zwrotu prawowitym właścicielom własności przejętej bezprawnie przez władze komunistyczne. ; This paper presents structural changes that took place in Poland after 1989, and which enabled its transition from a centrally planned economy to a market economy. The deep and thorough legal, economic and social reforms undertaken in that period made it possible, after years of communist rule, to shape a new, democratic system. The systemic transformation was possibleowing to some basic amendments to the Constitution, including the articles defining the essence of ownership and the duty to respect it, as well as the adoption of other legal acts necessary to re-define ownership relationships (such as the law on commercialisation and privatisation of state-owned enterprises, or the law on the management of agricultural property). The concurrent reforms of the banking system and the monetary and credit policy enabled inflow of foreign capital and development of private entrepreneurship. As a result of the transformations of the past 25 years, Poland is now a democratic state and a member of the European Union, while Polish economy is getting increasingly competitive. Sadly enough, despite these substantial structural transformations in the ownership sphere, in the last quarter of the century Poland has continued to be unable to resolve the problem of returning to the lawful owners the property taken by the communist regime.

Niniejszy artykuł omawia kwestię własności państwowej w sektorze paliwowo- -energetycznym w kontekście bezpieczeństwa energetycznego na przykładzie wybranych krajów. Przedstawiony rys historyczny pokazuje szerszy kontekst procesów prywatyzacyjnych omawianego sektora zarówno na Zachodzie Europy jak i w byłych krajach socjalistycznych. Następnie poddano analizie stopień kontroli właścicielskiej państwa w poszczególnych, wybranych krajach. Szczególnie przeanalizowano relacje pomiędzy narodowymi (państwowymi) a prywatnymi (globalnymi) koncernami sektora paliwowo-energetycznego, a zwłaszcza sektora gazowo-naftowego. W podsumowaniu wskazano na brak jednolitego modelu postępowania w tym zakresie, wynikający z różnych uwarunkowań geopolitycznych i makroekonomicznych prezentowanych państw oraz na wyzwania wobec polskiego rządu, dotyczące wyboru wzorców najbardziej adekwatnych dla sytuacji naszego kraju i wprowadzenia ich w życie. ; The article discusses a relation in between energy security and state ownership of the enterprises active in energy and fuel sector. A history of privatisation efforts carried out both in Western Europe and in post-communist countries is presented to give background for current state of the governmental involvement in the sector. The main part of the article is devoted to individual analysis of selected countries representing various models of ownership policy, among others: USA, UK, Germany and Russia. These analysis are complemented by a chapter discussing the issue of competition between so called National Oil Companies, owned, or at least controlled by governments and Global Oil Companies, public but almost purely privately owned ones. They indicate a variety of ownership models applied or rather developed due to differences in size and structure of natural energy resources, balance of internal supply and demand, military strength, political position, particular model of free market economy in general, membership in key international organisations. All the factors mentioned have lead to a situation in which a total lack of governmental ownership in the sector's corporation can be attributed only to USA and UK. In all other countries analysed states act as important or even dominant shareholders in key energy companies, trying to pursue, in more or less open ways, their policies. Having understood that their results depend very much on the strength and international presence of state controlled corporations governments promote their business development through adoption of the most advanced managerial practices, research in technology and participation in global cooperation with key players in energy and energy related sectors. Therefore they do not exclude neither a partial participation of private investors nor bringing state controlled companies to, even foreign, stock exchanges. But always governments execute control over activities related to energy security and protect these corporations from hostile takeovers. On the other side governments actively support the controlled companies on various fields for example trying to weaken certain EU regulations, negotiating international agreements considering their presence abroad or granting licences for their own natural resources on preferential terms. In conclusion it is stated that no universal "correct" or "European" pattern regarding neither state ownership in energy companies nor using this tool for protecting energy security exists. Therefore Poland has to select solutions most adequate to it's own situation and apply them in the most effective way.

Regulations of the Act on Protection of Agricultural and Forest Land are treated as a limitation of the right of ownership of the real estate. Unlike civil law regulations, in this Act the legislator defines agricultural land as the subject of obligations specified in the Act, treating them in separation from the issue of ownership relationships. Unlike in civil law regulations, apart from the owner, a number of obligations associated with the protection of agricultural land is also imposed on other entities, which make economic use of the real estate property. According to the Act, the owner of real estate property has a number of obligations, such as prohibition to use land for non-agricultural purposes without having obtained a decision to designate the land for non-agricultural purposes and consent for exclusion of land from production. The owner also has other positive duties, such as the duty to prevent land degradation and devastation. These obligations, however, do not shape the subjective right of ownership, but are external to it, although they should be treated as a limitation to this right. ; Uregulowania ustawy o ochronie gruntów rolnych i leśnych są traktowane jako ograniczenia prawa własności nieruchomości. Odmiennie niż w regulacji cywilnoprawnej prawodawca przedmiotem obowiązków określonych w tej ustawie czyni grunty rolne, których ujęcie abstrahuje od problematyki stosunków własnościowych. W przeciwieństwie do przepisów prawa cywilnego, oprócz właściciela, szereg obowiązków związanych z ochroną gruntów rolnych został nałożony także na inne podmioty, które wykorzystują nieruchomości w sposób ekonomiczny. Właściciel nieruchomości ma zgodnie z regulacją ustawy szereg obowiązków, takich jak zakaz jej nierolniczego wykorzystania bez uprzedniego przeznaczenia terenu na cele nierolnicze oraz bez uzyskania zgody na wyłączenie gruntów z produkcji. Obciążają go również czynne obowiązki, m.in. obowiązek przeciwdziałania degradacji gruntów. Powinności te nie kształtują podmiotowego prawa własności, ale pozostają wobec niego zewnętrzne, jakkolwiek powinny być traktowane jako jego ograniczenia.

Przekształcenia własnościowe przedsiębiorstw państwowych były jednym z elementów transformacji ustrojowej Polski, która rozpoczęła się pod koniec lat osiemdziesiątych XX wieku. Zmiany własnościowe objęły stocznie produkcyjne, które miały wpływ na poziom rozwoju gospodarczego państwa oraz były symbolem wydarzeń politycznych. Przebieg procesu przekształceń własnościowych stoczni był uzależniony od decyzji rządu. Nie bez znaczenia była też sytuacja na światowym rynku stoczniowym oraz przystąpienie Polski do Unii Europejskiej. Z tego też powodu proces ten był przedmiotem szczególnej uwagi wśród polityków, badaczy oraz społeczeństwa, budząc spory i kontrowersje. Celem artykułu jest przeanalizowanie polityki poszczególnych rządów w zakresie przekształceń własnościowych przedsiębiorstw państwowych w przemyśle stoczniowym, ukazując czynniki które miały wpływ na przebieg procesu prywatyzacji stoczni. Przeprowadzając analizę polityki Rady Ministrów w zakresie przekształceń własnościowych stoczni produkcyjnych, dążono do uzyskania odpowiedzi na następujące pytania badawcze: Czy rząd polski wypracował spójną koncepcję przekształceń własnościowych przedsiębiorstw państwowych w przemyśle stoczniowym? Jakie decyzje podejmowały poszczególne rządy w celu prywatyzacji stoczni? oraz Jakie czynniki miały wpływ na proces zmian własnościowych stoczni? W badaniach wykorzystano metodę komparatystyczną, decyzyjną, instytucjonalno- prawną i statystyczną. Szczególną uwagę zwrócono na przebieg procesu prywatyzacji stoczni po wejściu Polski do Unii Europejskiej. Polityka prywatyzacyjna została zaprezentowana na przykładzie stoczni w Szczecinie, Gdańsku i Gdyni. ; Ownership changes in state-owned companies were part of the political transformation that started in Poland in the late 1980s. Ownership changes affected the production shipyards, which influenced Poland's economic development and earlier had been symbols of political importance. The ownership changes taking place in the Polish shipyards depended on the decisions made by Polish governments, but also on the situation on the global shipbuilding market and the fact that later Poland was to join the EU. Therefore, the changes attracted the attention of many politicians, academics and Polish society, arousing emotions, disputes and controversy. The aim of this paper is to analyze the policies of successive governments in terms of ownership changes in the shipbuilding sector. Attention is focused on the factors that affected the privatization of the Polish shipyards. While analyzing the policies of Polish cabinets concerning the ownership changes in the shipyards, we wanted to find the answers to the following questions: did the Polish government work out a coherent concept for changing the ownership structure in the shipbuilding industry? What decisions were made by successive Polish governments in order to reprivatize the shipyards? The study used comparative, decision-based, institutional, legal and statistical methods. Particular attention is paid to the process of reprivatization of the shipyards after Poland joined the EU. The examples of reprivatization in the shipyards of Szczecin, Gdańsk and Gdynia are given.

Przekształcenia własnościowe przedsiębiorstw państwowych były jednym z elementów transformacji ustrojowej Polski, która rozpoczęła się pod koniec lat osiemdziesiątych XX wieku. Zmiany własnościowe objęły stocznie produkcyjne, które miały wpływ na poziom rozwoju gospodarczego państwa oraz były symbolem wydarzeń politycznych. Przebieg procesu przekształceń własnościowych stoczni był uzależniony od decyzji rządu. Nie bez znaczenia była też sytuacja na światowym rynku stoczniowym oraz przystąpienie Polski do Unii Europejskiej. Z tego też powodu proces ten był przedmiotem szczególnej uwagi wśród polityków, badaczy oraz społeczeństwa, budząc spory i kontrowersje. Celem artykułu jest przeanalizowanie polityki poszczególnych rządów w zakresie przekształceń własnościowych przedsiębiorstw państwowych w przemyśle stoczniowym, ukazując czynniki które miały wpływ na przebieg procesu prywatyzacji stoczni. The political and economic reforms in Russia since the beginning of the 1990s have made it possible to build a new economic system. Over more than 25 years, this system has evolved under the influence of, among others, economic and financial crises, which resulted in changes in the role of the state, ownership structure and the specificity of the corporate sector. The main goal of the paper is to identify the key elements and features of the economic system in Russia in the specified stages of its evolution and to indicate the perspectives of changes. To achieve this goal, an in-depth analysis was made of the literature and statistical data. The author puts forward the thesis that there are still some premises of the evolution of the economic system in Russia which resulted from the need for structural changes and the exhaustion of the current model of economic growth. However, in the immediate future, the economic system in Russia will not evolve significantly because of the economic stability and the lack of political will to make significant reforms.

The institution of expropriation is an instrument for public authorities to actuate discharge of public tasks that are important for general needs of society. Substantive conditions of expropriation determine activities of public administrative authorities that reach for this instrument while specifying protection of ownership rights under the Polish legal system. In addition, they guarantee constitutional standards of expropriation that also include expropriation procedures regulated by statutes that protect owners' interests against excessive public legal interference with their rights. Securing rights of expropriated property owners is of paramount importance in the perspective of both standards of democratic rule of law and their compliance with axiology of the provisions of the Polish Constitution. The conclusions reached in this paper will help to assess how they fulfil the constitutional determinants of expropriation. ; Instytucja wywłaszczenia jest narzędziem w rękach władzy publicznej urzeczywistniającym realizację zadań publicznych ważnych z punktu widzenia potrzeb ogólnospołecznych. Materialnoprawne przesłanki wywłaszczeniowe determinują aktywność organów administracji publicznej w sięganiu po ten instrument, będąc jednocześnie dookreśleniem ochrony prawa własności w polskim porządku prawnym. Ponadto stanowią gwarancję dochowania konstytucyjnych standardów wywłaszczenia, przez które rozumie się także ustawowo uregulowane procedury wywłaszczeniowe, w ramach których chronione są interesy właścicieli przed nadmierną publicznoprawną ekspansją w ich prawa. Zabezpieczenie praw właścicieli nieruchomości wywłaszczanych ma ogromne znaczenie z punktu widzenia zarówno standardów demokratycznego państwa prawnego, jak i ich zgodności z aksjologią przepisów Konstytucji RP. Poczynione w niniejszym artykule ustalenia pozwolą na ich ocenę pod względem spełnienia konstytucyjnych determinantów wywłaszczenia.

The article aims to empirically indicate the share and industry characteristics of the largest state-owned enterprises in five selected countries of Central and Eastern Europe. Furthermore, based on the analysis, an attempt is made to answer relevant research questions: Whether and to what extent after almost 30 years of transition have the economies of the analysed countries become similar to the economies of selected developed countries of Western Europe with regard to the scope of state ownership in the economy? If so, to what extend? Could the economies of the analysed countries be seen as an occurrence of growing importance of state-owned enterprises after the financial crisis of 2008–2009, referred to in the literature as the "return of state-owned enterprises"? The analysis of the scope of state ownership in the economy was made using the processed and completed source data contained in the Orbis database. The study consists of three parts. The first part presents methodological assumptions of the analysis, definitions, description of data sources and basic characteristics of the studied set of enterprises. The second part contains data on state-owned enterprises in the analysed countries, divided into the state-owned and statecontrolled with a minority shareholding also includes industry-specific analysis. The third part contains synthetic international comparisons and a retrospective analysis, including the status and characteristics of state-owned enterprises in the surveyed countries in 2009, 2013 and 2017. The conclusions contained in the summary indicate a significant diversification of the scope and importance of state enterprises in the economies of the analysed countries.

The article is partof astudy analysing the development of the state sector inthe economy of the Second Polish Republic before the May coup d'état in1926. The aim is toresolve –inthe light of divergent positions presented inthe literature on the subject –whether during the period of parliamentary democracy the etatist tendency was growing continuously or was subject toperiodic fluctuations. The verification basis is an estimation of the percentage share of state ownership intotal national wealth. The first partof the study covers general issues (concepts, international background, internal conditionings, forms of inter-war etatism) and analysis of the increase instate ownership inthe Second Polish Republic in1918–1923, resulting from the acquisition of economic entities belonging tothe partitioning countries (Austro-Hungary, Germany and Russia) before 1914 and various forms of etatism inthe subsequent periods of: shaping the statehood of the country, during the war for borders, the economy after the war, cyclical and monetary problems, etc. ; Artykuł jest częścią opracowania analizującego rozwój sektora państwowego wgospodarce Drugiej Rzeczypospolitej wokresie przed zamachem majowym 1926 r. Celem jest rozstrzygnięcie –wobec rozbieżnych stanowisk wliteraturze przedmiotu –czy wokresie demokracji parlamentarnej tendencja etatystyczna narastała wsposób ciągły czy podlegała okresowym wahaniom. Podstawę weryfikacyjną stanowią szacunki procentowego udziału własności państwowej wmajątku narodowym ogółem.
