The singularity of Seoul is the capacity for the city to combine and manage all the new global urban paradigmatic challenges. Seoul new qualitative development responds does not intend to "continue" or "recreate" the traditional city. A SES implies interactions among its social, economic, and political settings, ecosystem, users, resources, government, and institutions. Since people in Wando had suffered from extreme drought in 2017, their single water resource had dried up. Thus, a water conflict ensued. The lack of polycentricity has prevented the SES in Wando from dealing with external variables in an adaptable manner. There has been no centricity among the county council, users, and local government at the rules-in-use level. The governance and the users, along with the institutions that they formed, has made the water resource unsustainable. The strict, hierarchical, and interdependent relationship between the central and the local governments has not built up an immediate and accurate decision-making process that could contribute to overcoming the crisis. Since the local government should take permission regarding local businesses from the central government before reaching an agreement with the residents, it encounters opposition from the people. While the county council could be the main actor of a change among the institutions related to water management, it only monitors local businesses in a one-time manner. Since climate change effects, like a drought event, has triggered the water conflict between the two islands, this ultimately has showed people's skepticism toward the governance and institutions of the local government. After the Framework Act on Water Management of 2018, the Ministry of Environment has been able to maintain its consistency in water policy. While rules-in-form have been made, it will take a long time to evolve them into rules-in-use. 학위논문 (석사)-- 서울대학교 대학원 : 정책학과, 2012. 2. 권혁주. ; 본 연구는 정책변동(policy change)사례 연구이다. 정책변동은 정책형성(의제설정과 의사결정)을 포함한다는 시각에서 논의를 진행하였다. 정책변동의 성공과 실패의 원인을 찾기 위해 '신행정수도이전정책'의 두 차례 정책변동과정을 분석하였다. 의제설정과정은 Kingdon의 정책흐름모형(policy stream model)을 적용하였고, 의사결정과정은 입법과정을 고려한 거부점(veto point)과 거부권행사자(veto player) 개념을 적용하여 분석하였다. '행정수도이전정책'은 1971년에 최초로 제기되었으나 구체화의 기회를 잡지 못하였다. 시간이 흘러 '행정수도이전정책'은 노무현 정부의 등장과 함께 정책의제가 되고 결정되어 추진되었다. 그런데「신행정수도의건설을위한특별조치법」이 헌법재판소로부터 위헌판결을 받게 되어, '행정중심복합도시건설정책'이 후속정책으로 채택되어 집행되었다. 한편, 이명박 정부는 '교육과학경제도시건설정책'으로 정책변동을 추진하지만 실패하게 되었다. 본 연구는 '신행정수도이전정책'이 좌초된 이후 노무현 정부가 실시한 '행정중심복합도시건설정책'으로의 제1차 정책변동과정과 그 성공을 다루었다. 그리고 이명박 정부의 '교육과학경제도시건설정책'으로의 제2차 정책변동과정과 그 실패에 대하여 분석하였다. 이론적 분석틀은 다음과 같이 구성하였다. 먼저 정책변동을 위한 의제설정과정은 Kingdon의 정책흐름모형에 따라 분석하였다. 정책의 3가지 흐름(정치의 흐름, 정책대안의 흐름, 정책문제의 흐름)을 정리한 후, 각 흐름들이 어떻게 결합되어 정책의 창을 열게 되고, 정책의 창 내에서 자신의 의사를 관철시키고자 하는 참여자의 활동을 해당 정책의 찬성과 반대집단으로 구분하여 살펴보았다. 다음으로 정책변동을 위한 의사결정과정은 국회에서의 입법과정을 중심으로 제도적 맥락에 따라 거부점과 거부권행사자를 구별하여 살펴보았으며, 사후적 거부점으로서 헌법재판소를 포함하였다. ; This is a case study on the policy change. This study have a perspective on policy change that includes policy formation (agenda setting and decision making). In order to find the cause of success and failure of policy change, this research analyzed two cases of the policy change of The New Administrative Capital Relocation Policy. Agenda-setting processes were analyzed on the basis of Kingdon' policy stream model, and decision-making processes were analyzed by applying the concept of the veto point considering the legislative process and veto players. The Administrative Capital Relocation Policy was first raised in 1971, but the policy did not take a chance to be materialized. Over time, the policy was determined by the policy agenda and driven with the advent of the Rho Moo-Hyun Administration. However, The Constitutional Court ruled that The New Administrative Capital Relocation Law is unconstitutional, so Multi-functional Administrative City Construction Policy was adopted as a subsequent policy and implemented. On the other hand, Lee Myoung-Bak Administration was attempts to policy change from the Multi-functional Administrative City Construction Policy to the Education and Science Centered, Economic City Construction Policy but Lee administration was failed to change the Multi-functional Administrative City Construction Policy. This study analyzed the first policy change process to the Multi-functional Administrative City Construction Policy and the success since the failure of the New Administrative Capital Relocation Policy. 학위논문 (석사)-- 서울대학교 대학원 : 행정학과, 2012. 2. 김상헌. ; 중앙정부는 지방정부의 부족한 재원을 지방교부세, 국고보조금과 같은 지방재정조정제도를 통해 보전하고 있다. 우리나라의 경우 지방 재정조정제도의 하나인 지방교부세에 보통교부세와 특별교부세가 있 다. 특별교부세는 보통교부세의 경직적 산정에 따른 배분의 한계를 보완하여 각 지방재정력의 격차를 고려하여 보전한다는 방침으로 행 정안전부에서 운영하고 있다. 그러나 특별교부세는 배분의 기준과 결 정이 모호하고 불투명하여 그 결정이 정치적으로 이루어진다는 문제 점을 지적하는 연구가 있다. 선행연구로 이루어진 특별교부세 배분에 관한 실증분석에서는 배분의 결정에 영향을 미친다고 상정한 정치적 행위자를 국회 행정안전위원회 소속, 지역구 국회의원 수 등 의회의 영역으로만 한정하였다. 본 논문은 정치적 요인에 의회의 행위자뿐만 아니라 정부의 행위자 를 포함시켜 분석하였다. 본 논문은 전국 234개 시‧군‧구의 2003~2006년도 4개년도의 특별교부세 자료를 이용하여 특별교부세 배분의 결정에 영향을 미치는 요인들에 대해 정부 정무직 공직자를 포함하여 실증분석을 시도하였다. 그 결과 정부 정무직 공직자로 상 정한 변수가 배분의 결정에 영향을 미친다고 파악되었고, 정부 정무 직 공직자 중에서도 국무총리와 국무조정실‧차장이 다른 정무직 공직 자에 비해 더 큰 영향을 미친다고 파악되었다. 특별교부세 배분에 정무직 공직자가 자기 출생지에 더 많이 배분하 려 결정 과정에 영향을 미치는 것뿐만 아니라 정무직 공직자가 임기 후 선출직에 출마할 경우 특별교부세 배분의 결정에 더 큰 영향을 미 친다는 것을 보았다. 이로써 특별교부세 배분의 결정에 정부의 정무 직 공직자가 영향을 미친다는 것을 확인할 수 있었다. ; The national government makes up for any shortfall in finance of the local governments by the local finance coordination system, which includes local revenue sharings and national subsidies. The local revenue sharing, as a kind of the local finance coordination system, consists of an ordinary revenue sharing and a special revenue sharing. The latter is introduced to remedy the shortcomings of the former's allocation system caused by the rigidity of its calculation, and is currently operated by the Ministry of Public Administration and Security. There are some literature criticizing the problem that the SRS allocation is decided politically due to the fact that the principles for its allocation are equivocal and the decisions are arbitrary and not transparent. In previous studies analyzing the SRS allocation empirically, the scope of the political actors who are assumed to exert influences on the allocation decision is limited to the legislative area, such as the members of the National Assembly Public Administration and Security Committee and the number of lawmakers in each electoral district. This study presents a further analysis with a new political factor, the government actors, in addition to the existing legislative actors. Specifically, using the SRS data for the period of 2003 ~ 2006 for the entire 234 cities- counties-districts in the country, the present study attempts to analyze the factors, which affect SRS allocation decisions, including the new variable, the government's political masters. The results demonstrate that the new variable indeed affects the allocation decisions and that, among the political masters, prime ministers and directors generals and deputy directors in the Prime Ministers Office are shown to exert greater influences than others. Moreover, it is also shown that they exercise their power in the SRS allocation decision making process to provide more sharings to their places of birth, and in particular, their intervention is even greater when they decide to run for an elective office from their places of birth after the termination of their government offices. As such, this study verifies that the government's political masters exert influences on the SRS allocation decision. ; Master

Game-theoretic approach has been providing a powerful tool in qualitative understanding of macroscopic social phenomena in social sciences, e.g., in economics and political science. Recently, researchers in physics, especially in statistical physics, use these game-theoretic approaches but in more quantitative way and have been producing a variety of interesting results in the new research area called 'sociophysics' by studying human society as a complex system. This work introduces recent works that have tackled combinatorial complexities arising in game-theoretic studies with the aid of simplified assumptions and numerical computations. We first show how cooperation emerges in the prisoner's dilemma game when each player's memory capacity is enhanced and suggest that the intelligent tit-for-tat strategy plays a crucial role in the history of cooperation. And then it is numerically shown that there is a certain case of simultaneous coordination among many players where the system has a high risk of failure when everyone is willing to follow the coordination, which is actually higher than when some are not concerned about it. Lastly, we discuss mathematical treatment of an equilibrium solution for a reverse auction game, which is a variant of the minority game, and its computational approach. ; Artikel på koreanska, abstract på engelska.

학위논문 (석사)-- 서울대학교 대학원 : 정치학과, 2012. 2. 권형기. ; 본 연구는 발전국가 이후 한국 자본주의 제도 변화 과정에서 나타난 국가 성격 전환에 관한 연구이다. 구체적인 사례로 하도급 제도를 대상으로 세계화 과정에서 국가 성격의 변화를 경험적으로 밝히고 이의 이론적 성격을 규명하고자 한다. 발전국가의 변천에 관한 기존의 연구는 주로 시장국가 혹은 최소주의적 규제국가라는 단일한 국가 모델로 수렴할 것인가라는 테제를 중심으로 접근해 왔다. 세계화론자들은 자본의 이동이 자유로워지고 자본을 유치하기 위한 경쟁이 치열해지면서 발전국가가 변화하는 세계경제에 부적합하기 때문에 단일한 규제국가 모델로 수렴할 것이라 예측한다. 반면, 신제도주의자들은 각 국가마다 착종된 제도와 문화가 다르기 때문에 "발전국가 이후" 규제국가로의 전환은 발전국가의 개입주의적 성격이 유지되는 경로의존적 제도 변화를 겪게 된다고 주장한다. 발전 경로가 다양할 수 있다는 점에서 제도주의의 입장에 동의하지만 한국의 국가성격 전환에 대한 기존 연구는 발전국가의 유산에만 천착하여 새롭게 재편되는 국가의 역할에 주목하지 못하고 있다. 본 연구에서는 개입주의의 유산을 통해 발전국가의 연속성을 찾는 기존 연구의 문제제기를 벗어나, 시장자유화라는 세계화의 일반적 추세에 따라 한국의 국가 성격 역시 규제국가로의 수렴 과정에 있다는 명제 하에서 한국의 규제국가가 갖는 다양성의 동학을 살피고자 했다. 한국의 발전 모델이 규제국가로 전환된 것은 사실이나 신자유주의적 국가가 상정하는 최소주의적 국가로 변화한 것은 아니다. 오히려 시장질서의 유지를 위한 협치적 개입주의라는 독특한 규제국가 모델을 형성하고 있다. 본 연구는 기존의 국가전환론이 지나치게 정태적인 분석 방법을 사용하여 비교균형론에 머무르는 한계를 지적하고 협치적 규제국가로의 전환을 이해하기 위해 행위자 중심의 이념, 사고, 담론의 정치적 과정을 분석하였다. 한국의 산업화 시기 형성된 발전연합은 공정거래법과 하도급법과 같은 경쟁법의 제도화를 억제했다. 80년대 신자유주의 관료의 등장과 정치엘리트의 정책 기조 전환이 맞물리면서 현재의 하도급 제도의 기원이 형성될 수 있었다. 이후 하도급법의 확대 및 강화를 통해 신자유주의적 규제국가가 아닌 질서 자유주의를 기반으로 하는 규제국가 모델로 재편되는 모습을 보여주었다. 이렇듯 한국의 규제국가가 '최소주의적'인 국가는 아니었지만 불충분한 제도화로 인해 자본의 양극화 문제를 충분히 해소하는 데에는 부족했다. 규제국가의 한계를 인식한 정부는 규제보다 사회적 규범을 통한 문제 해결을 선호했기 때문에 하도급법 강화에 저항적이었다. 이로 인해 중소기업의 불만을 조직하여 대변하는 정치세력의 연동제 도입 노력은 실패로 돌아가고 대신 점진적 개혁이 이뤄졌다. 자본의 패권에 대한 인식과 규제 국가의 능력에 대한 의심에도 불구하고 정부는 탈규제와 시장 방임으로 나아가지는 않았다. 오히려 사회적 규범을 형성하기 위한 사회적 조정을 시도하는 적극적 협치주의를 추구했다. 동반성장위원회는 공정거래위원회와 달리 사회적 합의 기구라는 제도적 조건과 적극적인 정치적 의지로 인해 이익공유제, 업종 적합성 등 중소기업의 불만을 반영한 다양한 대안들을 제시하여 대기업 측을 압박할 수 있었다. 전경련은 집단행동을 통해 이익공유제에 대한 항의를 전달했지만 법제화에 대한 두려움으로 동반위에서의 이탈보다는 강력하게 반대해 온 납품단가 연동제를 수용했다. 결론적으로 한국의 국가 성격은 발전주의 시기 이후 규제국가로의 수렴을 겪었다고 볼 수 있지만 이는 신자유주의 이념에 의한 것이 아니라 질서자유주의에 입각한 규제국가로의 전환이었다. 그러나 규제국가의 딜레마로 인해 강성규제국가보다는 협치적 규제국가라는 타협적 제도화가 이뤄지고 있다. 연성 규범 형성을 위한 협치적 개입주의는 사회적 조정을 통한 제도 변화의 급진성을 가져올 수 있는 새로운 가능성을 보여주지만 강제력의 부재라는 한계 역시 내포하고 있다. ; This study examines how the form of the Korean developmental state has changed in the process of economic liberalization. More specifically, the study analyzes the transformation of the Korean state empirically and theoretically investigating the changes in the subcontracting institutions under the globalization. The main question of the previous research on the tranformation of the developmental state is whether the state develops into one national model, 'minimalist state'. Capital mobility and the competition for capital make the interventionist states insufficiently competitive. Neoliberals predict the convergence of the national diversity under globalization. Institutionalists, on the other hand, insist that although the interventionist state has developed into a regulatory state, the direction of transformation is determined by path dependence. However, the literature on the transformation of the Korean state has paid little attention to the newly constructed role of the state. Unlike the previous literature, this research examines the dynamic process of the transformation of the Korean regulatory state. It is true that although the Korean state has changed from developmental model to regulatory state, it is distinct from minimalist model based on neo-liberal ideology. Rather, a new regulatory model has been formed. State intervention occurs not as a form of transformed developmental intervention, but as a form of governance. In order to understand this transformation, this study analyzes the political process based on the discursive institutionalism. The growth coalition blocked the introduction of the competition law in the era of industrialization. The newly empowered neoliberal bureaucrats and the turn of the policy stance under the new junta regime made it possible to enact the competition law. Since 1980s, the subcontracting law has been gradually reinforced. After enacting the law, the Korean state has developed into the regulatory state based on the ordo-liberalism, not on the neoliberalism. However, it is insufficient for the change to close the widening gap between big businesses and small businesses. The government prefers constructing the governance to strengthening the law in order to resolve the problem. Facing the government's resist, political parties' efforts to rapidly change the law failed. Although the government concerned about the capital mobility, it did not seek de-regulation and laissez-faire policy. Rather, the government tried to form a social norm using the governance. Unlike Fair Trade Commission, the Commission on Shared Growth for largecorporations and Small and medium Enterprises exerted pressure on the big business by proposing alternative plans including profit sharing and lists for SMB business items. Although the Federation of Korean Industries took collective action against the profit sharing plan to adjust the cost of subcontracting to the changes in raw material prices, it had to accept the plan which the FKI had strongly opposed. In conclusion, the Korean state developed into the regulatory state after the "developmental state". However, it does not mean that the role of the state becomes minimal as the neo-liberalsts argue. Nor does it that the state create a new role dependent on the developmental legacy. Using a new-formed governance, the Korean state tried to change the subcontracting institutions. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 행정학과, 2012. 2. 김동욱. ; 이 논문은 한국과 이집트의 지역사회개발정책을 국가주도성이라는 공통적 측면에 주목하고, 이러한 국가주도적인 지역사회개발정책의 형성 및 발전과정에 따른 경로의존성을 분석하는데 주요한 관심을 둔다. 이를 위해 역사적 사건, 초기경로의 생성 경로의존적 닫힘, 그리고 새로운 경로의 열림으로 구체화 했다. 이러한 과정 하에 역사적, 제도적, 행위자적 요인으로 재분류함으로써 제도 변화의 경로 의존적 요인과 촉진 요인을 보다 면밀히 파악하고자 했다. 이는 기존의 제도적 맥락, 즉 제도 내외의 환경의 영향으로 설명하고자 하는 역사적 신제도주의에 기반하였다고 볼 수 있다. 이 논문을 통해서 지역사회개발정책을 둘러싼 국가 계획은 역사적, 제도적 그리고 행위자적 요인으로 인해 일정기간 지속성을 이끌어가는 요인으로 작용했으며, 한편으로는 역사적 요인에 의하여 단절적인 변화를 경험하기도 했다. 한국의 새마을운동이 적어도 정부가 의도한 바대로 지역사회의 변화를 이끌어내기 위한 의미있는 성과를 가져왔음에 비해, 이집트의 슈르끄 운동을 포함한 일련의 지역사회개혁정책이 지역민의 참여와 자원을 효과적으로 이끌어내지 못한 점을 경로의존성 분석을 통하여 도출해내었다고 볼 수 있다. 이러한 분석결과는 다음과 같이 양국의 지역사회개발정책의 유사성과 상이성으로 나뉜다. 먼저, 유사성으로는 한국과 이집트는 개발도상국으로서의 국가주도 지역사회개발정책을 실시한 경험을 가지고 있다는데 있다. 기본적으로 농경에 바탕을 둔 사회이며, 19세기 외세에 의한 근대화 및 권위주의정권에 의하여 지역사회개발정책이 상당부분 영향을 받았다는 점이 유사하다. 이외에도 개발도상국으로서 공업화 등에 대한 우선적 관심으로 상대적으로 지역사회개발정책과 관련된 자원을 투입하는데 한계가 있었지만, 대통령의 일반적인 관심사가 되었다는 점에서 유사하다. 다음, 상이성으로는 한국의 경우, 새마을운동은 앞선 시기의 여러 사회적, 제도적 및 행위자 요인과 함께 지역사회의 인적 물적 자원을 효과적으로 동원하는 내무부 주도의 제도적요인과 박정희 대통령의 정책에 대한 관심과 거버넌스를 촉진하는 행위자적 맥락 요인이 함께 작용하여 이러한 국가주도적 경로의존성을 지속시켜나갔다. 이러한 국가의 개입은 민간의 참여와 자원을 효과적으로 동원하는 방식으로 나아갔다. 한편, 1980년대 새마을운동은 박정희 정부의 종식과 연이은 전두환 정부의 민간주도 정책으로 인해 기존 국가주도적 경로를 이탈하게 된다. 한국과 달리 이집트의 국가주도 지역사회개발정책의 경로는 국가가 이러한 변화를 주도하는 측면에서는 여전히 경로의존성을 유지하고 있었다. 이는 1980년대 무바라크 정부에서는 슈르끄 사업을 실시함으로써 민간주도로 이행하기 위한 노력을 진행했으나, 현재까지 강한 국가주도적 경로를 유지하고 있다. 국가의 의도를 실현시킬 수 있는 효과적인 집행기관과 지역사회의 참여와 자원을 이끌어낼 수 있는 기제가 마련되어 있지 않는데 원인이 있다. 또한, 실제 지역사회개발정책을 통한 정책효과에 대한 무바라크 대통령의 관심의 부재와 지역사회개발에 참여하는 대지주 및 기업가의 부패문제는 지역사회 참여자의 관심을 이끌어 내지 못함으로써 국가가 대부분의 지역사회개발과 관련된 문제를 독자적으로 해결해나가야 하는 악순환에 처해 있는 것이다. 그러나 2012년 현재 이집트는 쟈스민 혁명으로 일컬어지는 민주화운동에 의하여 새로운 정부 수립을 앞두고 있다. 이렇게 새로이 수립된 정부가 그간 권위주의 정부에 의하여 추진된 농촌 등 지역사회개발정책에 대한 개선책에 대한 기대감이 크다. 새로운 정부의 수립 이후 과거 이집트정부가 추진한 강한 국가주도 지역사회개발정책의 실효성을 강화하는 방향으로 나아갈지 혹은 새로이 민간주도 정책으로 전환하는 주요 결절점으로서 작용할지가 주목된다. 이와는 별개로 정권교체 이후에도 당분간 국가가 주도하여 지역사회개발정책을 수립해나갈 가능성이 크므로 이러한 작업을 위해 이집트 정부는 한국 새마을 운동의 성공요인이었던 내무부 주도, 민간의 자발적 참여와 자원동원을 이끄는 방식을 추진한다면, 지역사회개발의 성공을 앞당길 수 있을 것으로 전망된다. ; Focusing on similarity of the state-led character between both countries, this study aims to analyze its formation and developmental process of Korea and Egypt's rural development policy in terms of a path dependency. For this purpose, this study fall into the four sub-parts, which is historic events, creation of initial path, closeness of path and openness of new path. Under this circumstance, as being reclassified in the basis of historic, institutional, and stakeholder factor, it was able to look into more specifically how the path was proceeded. This based on historical institutionalism to be explained by its environmental circumstances both inside and outside institutions. This study shows the national plan on both country's policies of rural development contributed to keep consistency within a certain periods, but they often experienced several sudden shocks which might be disconnect their paths. The Saemaeul Undong in Korea at least have brought significant outcomes for changes in its rural societies. In comparison, The Egypt's case was not successful at that much because they failed to efficiently attract its rural people's support and securing their resources for their national rural development plans. These result outcomes came from analysis from the perspective of path-dependency and it can be more specifically classified into the two categories, which is similarity and difference of both nation's rural development policies. First of all, Korea and Egypt have a similar experience for conducting their own state-led rural development plans as a developing countries. Besides, when they started to develop rural area, the state mainly relied on agriculture and the rural development plan influenced from the authoritative regimes or the power of a foreign countries. In addition, both countries was more focused to invest their limited resources into the industries, rather than rural development. Next, In Korea, with its prior several social, institutional and stake holder's factors, Saemaeul Undong kept its state-led developmental path as successfully mobilizing its human and material resources with help of deep concern of president Park Chung-hee as stakeholder factor and his ministry of interior as institution factor. Especially, this engagement by the central government was gave more initiatives to private sectors when they obtaining their participation and resources. Meanwhile, in 1980s, the Saemaeul Undong derailed its path due to the facts such as the assassination of president Park Chung-hee or the privatization policy of president Chun Doo-hwan. Different from the Korea case, Egypt's state-led rural development has kept on sustaining previous path until now. There are several attempts such as president Mubarak's Shrouck plan toward private-led rural development. However, it does not seem to be enough for detouring its current state-led development tendency for a new change. This is responsible for lack of effective implementation agency and mechanism which is able to get cooperation from rural society. It hinders them in carrying out their plan not only by president Mubark's lack of actual concerns on rural reforms, but also by business man or large farm owner's corruption problems. Therefore the Egyptian government was caught in a vicious circle in which the central government should exclusively take on whole responsibility for rural development issue. However, as of 2012, Egyptians are facing a new government by liberalization movements which called 'jasmine revolution'. They hope that a reform packages of the new government would be differentiated from that of the previous. it might be a prime concerns whether they are maintaining its state-led path or changing their course toward a more private-led one. Whatever the case it would be, their strong involvement by the central government is more likely to be kept for a while. In these circumstance, if the Egyptian government adopt those successful factors of the Saemaeul Undong, their success for rural development would be advanced by substantial length of time. 학위논문(석사)--서울대학교 대학원 :행정대학원 행정학과(정책학전공),2019. 8. 김순은. ; 국문초록 박근혜 전 대통령은 2013년 10월 18일 서울 신라호텔에서 열린 '유라시아 시대의 국제협력' 컨퍼런스 개막식 기조연설에서 다음과 같이 말했다. "내외 귀빈 여러분, 유라시아 대륙은 세계인구의 약 71%가 살고 있고, 동쪽 끝에서 서쪽 끝까지 12개의 시간대에 걸쳐 있는 세계 최대의 단일 대륙입니다. (중략)···저는 이제 유라시아에 새로운 소통의 길을 열어 협력의 잠재력을 끌어내야 할 때라고 생각합니다. 단절과 고립, 긴장과 분쟁을 극복하고 소통과 개방으로 평화롭게 교류하며 함께 번영하는 유라시아를 건설해야 합니다. 이를 위해 저는 유라시아를 '하나의 대륙', '창조의 대륙', '평화의 대륙' 으로 만들어 가는 몇 가지 방향을 제안하고자 합니다." 라고 하며 '유라시아 이니셔티브' 를 주창하였다. 이처럼 유라시아 이니셔티브는 유라시아 국가들 간 물류, 시장, 문화 등을 통합해 나가는 것을 주요 내용으로 하였으며 핵심은 물류 및 교통의 통합을 통해 유라시아 대륙의 공동번영을 이룸과 함께 한국은 유라시아 대륙의 물류 허브로 거듭나는 것이었다. 다수 전문가들은 유라시아 이니셔티브의 추진에 있어 여러 도시 중에서도 세계적인 항만을 보유하고 있고, 한반도의 기점이자 종점이며 세계 전역으로 뻗어나갈 수 있는 지정학적 위치를 갖춘 부산시의 역할에 주목하였다. 이러한 상황에서 당시 부산시장은 부산시의 도시 비전을 '유라시아 관문도시 부산' 으로 정하고 부산이 주도적으로 유라시아 이니셔티브를 이끌어가야 한다고 주장하였다. 이러한 주장에 기반하여 부산시는 2015년부터 본격적으로 유라시아와 관련한 여러 사업을 추진하였다. 하지만, 대부분의 사업은 일회성에 그치거나 큰 효과를 내지 못하였다. 반면, '유라시아 관문도시 부산' 이라는 부산의 비전을 국내외에 전파하고 유라시아 여러 도시들과의 교류협력을 강화하기 위해 추진한 『유라시아 부산원정대』 사업은 정책결정 과정에서는 사업효과에 대한 의문이 다수 제기 되었으며 일회성 행사에 그칠 것으로 우려 하였으나 2019년 현재까지도 지속적으로 추진될 만큼 부산시를 대표하는 유라시아 관련 정책으로 자리매김 하였다. 따라서 본 논문에서는 『유라시아 부산원정대』의 집행과정을 분석해보고, 어떻게 본 정책이 다른 사업들과는 달리 지속될 수 있었는지에 대해 살펴보았으며 이 과정에서 Mazmanian과 Sabatier의 연구를 활용하여 분석을 진행하였다. 따라서 본 연구의 목적은 다음의 세 가지로 나눌 수 있다. 첫째, 『유라시아 부산원정대』의 집행과정을 분석해보고 집행이 잘된 부분과 그렇지 않은 부분을 찾아본다. 둘째, 정책집행과정의 분석을 통해 어떻게 본 사업이 다른 유라시아 관련 정책들과는 달리 일회성에 그치지 않고 지속될 수 있었는지에 대해 알아본다. 마지막으로, 정책집행 연구에서 빈번하게 활용되는 Mazmanian과 Sabatier의 연구를 분석하여 이론이 담고 있는 함의 및 구체적 내용을 알아본다. 이러한 목적의 달성을 위해 본 연구는 우선 부산시 및 여러 유관기관들의 문헌 자료와 함께 집행과정에 참여했던 주요 행위자들을 면담하여 정책집행과정을 면밀히 분석하였다. 다음으로 Mazmanian 과 Sabatier 가 제시한 '정책집행이 효과적으로 이루어지기 위한 조건'을 활용하여 원정대 사업의 정책집행과정이 해당 조건에 부합하는지 여부를 통해 정책집행이 잘 된 부분과 그렇지 못한 부분을 구분하였다. 연구의 결과는 다음과 같다. 첫째, 『유라시아 부산원정대』의 정책목표는 명확하며 일관성을 갖추었다. 특히, 외교부, 경상북도 등 타 기관이 추진한 유사사업들과 비교했을 때 원정대의 정책목표는 상당히 명확하며 구체적이었다. 둘째, 정책목표의 달성을 위해 부산광역시 차원의 개입이 필요하다는 것은 분명하나, 굳이 원정대라는 수단을 선택해야 하는지에 대해서는 원정대 이외에도 본 정책목표를 달성할 수 있는 여러 가지 다른 방법이 있을 수 있기 때문에, 본 정책목표와 원정대라는 정책수단 간의 인과관계는 명확하지 않았다. 셋째, 정책집행 담당기관이었던 부산광역시 통상진흥과 남북경제협력팀 및 부산국제교류재단은 본 정책과 업무관련성이 매우 높고, 조직원들은 본 사업에 대해 상당히 긍정적인 반응을 보였기 때문에 집행기관은 모두 원정대 사업에 대해 상당히 호의적이었던 것으로 나타났다. 넷째, 부산시 및 부산국제교류재단 모두 원정대 사업에 대한 의사결정 과정은 3단계로 이루어져 공식적으로 정해진 절차에 비해 단순화 되었으며, 의사결정 방식 역시 하향식이며 대체로 시장의 지시에 전적으로 순응하는 편이었기 때문에 빠른 정책집행이 가능했다. 다섯째, 부산시 의회 및 부산시 내 관련 부서 등 정책집행 유관기관과 정책결정자인 부산시장은 원정대 사업에 대해 호의적이었으며 지지를 보냈던 것으로 나타났다. 특히, 부산시장의 경우 원정대에 대해 상당히 높은 관심을 보였던 것으로 파악되었다. 마지막으로 원정대 사업의 집행과정에서 동남권 신공항의 유치 문제가 이슈화 되면서 '유라시아 관문도시 부산' 이라는 비전의 홍보 및 국내외 확산이 더욱 중요해졌고 이로 인해 원정대 사업의 정책목표가 갖는 중요성은 정책결정 시에 비해 더욱 높아졌다고 볼 수 있다. 연구결과를 종합해보면, 『유라시아 부산원정대』의 정책집행과정은 Mazmanian 과 Sabatier가 제시한 정책집행이 효과적으로 이루어지기 위한 조건을 대체로 만족하는 것으로 나타났다. 특히, 원정대 사업은 ① 정책목표가 상당히 명확하며, ② 정책집행기관 및 정책결정자가 사업에 대해 상당한 관심 및 지지를 보내었고, ③ 사회·경제적 조건의 변화로 인해 정책집행과정에서 정책목표의 상대적 중요성이 더욱 높아졌기 때문에 다른 유라시아 관련 사업들과는 달리 정책이 일회성에 그치지 않고 지속될 수 있었던 것으로 나타났다. 다만, 정책목표와 정책수단 간의 인과관계가 불명확하여 정책이 지속되고 집행에 따른 성과가 창출되었음에도 정책이 갖는 효과에 대한 의문이 지속되었던 만큼 이에 대한 보완이 필요한 것으로 나타났다. ; Former President Park Geun-hye delivered her keynote address at the opening of the 'Global Cooperation in the Era of Eurasia' conference in Seoul Silla hotel on October 18 ; "Ladies and Gentleman, Eurasia is the biggest continent in the world which contains 71% of the world's population and 12 different time zones. .Now is the time to open a new channel to Eurasia in order to lift its cooperation potential. We need to revive Eurasia, a geographic area disconnected by the Cold War, as a space for communication, openness, creation and fusion. I would like to propose a new vision, to make Eurasia, one continent of creation and peace." and then suggest her new vision 'Eurasia Initiative'. The main concept of Eurasia Initiative is integrating logistics, market and culture among Eurasian countries and key point is by integrating logistics and transportation we'd like to achieve prosperity of Eurasia Countries and at the same time, Korean peninsula should role as a logistic hub and the gate way of Eurasia continent. Many specialists focused the role of Busan Metropolitan city to achieve the goal of Eurasia Initiative because of it's global port facilities and geographical location which is the origin and destination of Korean peninsula. In this situation, former Mayor of Busan set the city vision as 'The Eurasia Gateway Busan' and stressed that Busan should lead the Eurasia Initiative. Based on this opinion, Busan Metropolitan City implemented many policies from 2015, but most of them were just one time event and failed to succeed. However, the policy 'Eurasia Expedition from Busan' which focused on publicizing the vision of Busan (Eurasia Gateway Busan) and strengthening the cooperation with Eurasian cities is still maintaining in 2019 and becoming the most famous and symbolic policy about Eurasia in Busan eventhough there were lots of doubts about being one time event in the policy decision process. Thus in this study, analyzing the policy implementation process of 'Eurasia Expedition from Busan' and finding the reason how this policy can be maintained unlike other policies by using the Mazmanian-Sabatier model. The goals of this study can divided into three things. First, analyzing the policy implementation process of 'Eurasia Expedition from Busan' and finding the good and bad points of implementation. Second, by analyzing the policy implementation process, how this policy can be maintained unlike other Eurasian policies in Busan. Lastly, analyzing the Mazmanian-Sabatier model which is frequently used in the study of policy implementation, and finding the exact meaning of that model. To achieve these goals, first of all, reviewing much data of Busan Metropolitan cities and other related organizations and also interviewing some people who participated the policy implementation process. Next, using the "Conditions of effective policy implementation which is argued by Mazmanian-Sabatier, analyzing the policy implementation process of 'Eurasia Expedition from Busan' whether it is fit to that conditions or not. The results of this study are as follow. First, the objectives of 'Eurasia Expedition from Busan' are clear and consistent. Especially, comparing with the similar policies which was implemented by the ministry of diplomacy and Gyeongsangbuk-do, the objectives of these policies are very obvious and concrete. Second, to achieve this objectives, it's clear that the intervention of government is necessary, but the causal theory between this policy and the objectives is not clear. Third, both Inter-Korean cooperation team in Trade promotion division of Busan Metropolitan City government and Busan Foundation for International Cooperation which were in charge of implementing 'Eurasia Expedition from Busan' were quite related to this policy and all of members were so much positive to this policy. Thus both organizations are so much favorable to this policy. Fourth, the decision rules of both organizations were in a three stages which was quite simplified than formal steps, and quite top-down ways especially complying the order of mayor thus it can simplify policy implementation process and facilitate effective implementation. Fifth, the related organizations of policy implementation like Busan city council and other divisions of Busan Metropolitan City and the mayor of Busan who is a policy decision maker were favorable and supportive to 'Eurasia Expedition from Busan'. Especially, mayor of Busan gave considerable support to this policy. 학위논문 (석사)-- 서울대학교 대학원 : 법학과, 2012. 2. 권영준. ; 담보제도는 여신금융거래와 밀접한 관계를 가지고 있어서 담보제도의 안정적인 작동은 여신금융거래의 활성화에 기여할 수 있다. 그런데 최근 들어 새롭고 복잡한 금융기법이 등장하고 있는데도 불구하고 대표적으로 이용되고 있는 담보물권의 일종인 저당권은 여신금융거래를 둘러싼 사회적 요구를 충분히 수용하지 못하고 있다. 특히 대규모의 자금이 투입되는 건설사업 등 각종 부동산개발사업을 추진하는 과정에서 이용되고 있는 프로젝트 파이낸싱(Project Financing, 이른바 PF 대출)이라는 금융기법은 막대한 대출금 규모에 비례하는 보다 안전한 담보가 필요하게 되었고, 이와 관련하여 부동산담보신탁은 새로운 담보방법으로 주목받기 시작하였다. 원래 신탁은 영국에서 발달한 제도이고, 현행 우리나라의 부동산담보제도는 대륙법계에서 발전된 제도이기 때문에 신탁을 통한 담보방법의 폭넓은 활용은 용이하지 않았다. 우리나라에서 신탁을 통한 담보방법인 부동산담보신탁의 활용이 관심받기 시작한 것은 불과 20년도 채 되지 않았다. 물론 부동산담보신탁이 완벽한 담보적 기능을 가지고 있는 것은 아니지만, 현행 법체계에서 담보력을 유지하기 위한 강력한 수단이라고 평가받고 있다. 그 이유 중의 하나는 신탁의 도산격리 효과 때문이다. 이것은 위탁자나 수탁자의 파산절차 또는 회생절차에 구속되지 않고 신탁부동산을 독립적으로 취급할 수 있으므로, 채권자인 수익자는 위탁자나 수탁자의 채권자로부터의 간섭 없이 신탁부동산에 대한 권리를 행사할 수 있음을 의미한다. 이러한 도산격리 효과는 신탁제도의 고유한 효과이므로, 부동산담보신탁에서도 동일하게 인정된다. 특히 위탁자에 대한 회생절차가 개시된 경우 수익자로 지정된 채권자는 경우에 따라 위탁자에 대해 가지는 회생채권은 실권될 수 있어도 수탁자에 대해 가지는 수익권은 실권되지 않는다. 이러한 점은 부동산담보신탁을 활성화시키는 강력한 유인이라고 볼 수 있다. 한편 그동안 우리나라에서는 부동산담보신탁에 대하여 신탁의 형식을 빌린 담보제도로 구성하려는 견해가 많았으나. 엄밀히 말하면 부동산담보신탁은 담보제도로 볼 수 없다. 부동산담보신탁에 대하여 형식은 '신탁'이지만 실질은'담보'라는 주장은 물권적 기능을 하는 권리들을 물권법정주의라는 틀에 맞추어 설명하다 보니 부동산담보신탁에서 채권자인 수익자가 보유한 수익권을 일종의 비전형담보권으로 보려고 했던 것이다. 그러나 담보신탁을 통하여 얻게 되는 채권자의 담보취득 효과는 경제적인 측면에서 그러한 것이지 법률적인 측면에서 그러한 것이 아니다. 따라서 부동산담보신탁은 어디까지나 신탁제도의 일종이라고 보아야 하고, 신탁제도 자체의 고유한 법리에 기초한 해석으로써도 부동산담보신탁제도를 충분히 설명할 수 있다고 보아야 한다. 미국에서는 부동산을 담보로 금융을 얻는 방법으로 대륙법계의 저당권이 아니라 'Mortgage'나 'Deed of Trust'를 이용하여 왔다. 이러한 'Mortgage'나 'Deed of Trust'는 담보를 위하여 부동산에 대한 소유권을 이전한다는 점에서는 동일하지만, 전자는 채권자에게 부동산에 대한 소유권을 이전하는 반면에 후자는 수탁자에게 그것을 이전하고 채권자는 수익자로 된다는 점에서 차이가 있다. 캘리포니아 州의 경우 1930년 이후부터'Deed of Trust'와 'Mortgage'를 동일하게 취급하여 'Deed of Trust'의 본질을 매각권이 부여된 'Mortgage'로 보았다. 그러나 이와 같이 'Deed of Trust'와 'Mortgage'에 대한 동일한 취급이 우리나라에서도 수용 가능한 것인지는 재고의 여지가 있다. 왜냐 하면 미국의 도산절차에서는 담보권자의 권리가 감축되지 않으므로 'Deed of Trust'를 매각권이 부여된 'Mortgage'로 취급하더라도 별 문제가 없으나, 우리나라의 경우는 채무자 회생 및 파산에 관한 법률의 회생절차에서 회생담보권자로 취급되면 권리감축의 대상이 되므로 부동산담보신탁을 담보제도로 보게 되면 중대한 문제가 발생할 수 있기 때문이다. 즉 부동산담보신탁에서 채권자인 수익자가 보유한 수익권을 비전형담보권으로 보게 될 경우 논리적으로 회생담보권이 되어 수익자 보호에 취약해질 수 있다는 것이다. 최근 우리나라에서는 신탁법의 전면 개정(2011. 7. 25. 법률 제10924호)으로 담보신탁의 법적 근거가 마련되고, 어떤 측면에서는 기존의 담보제도가 가진 한계를 극복-예컨대 수익증권의 발행이 가능하게 됨으로써 수익권의 유통성이 확보됨-할 수 있게 되었다. 이러한 점들은 앞으로 부동산담보신탁의 활용을 높이는 계기가 될 것이다. 한편으로는 담보신탁의 대상이 단순히 부동산에만 한정된 것이 아니기 때문에 동산, 유가증권, 금전채권 등의 신탁재산을 포괄하는 담보신탁의 활용 가능성에 대한 관심과 연구가 증대되어 궁극적으로 안정적이고 편리한 담보신탁의 활용을 통하여 여신금융거래의 활성화에 기여할 수 있도록 하여야 한다. ; The stable working of the security system can make a significant contribution to revitalizing the loan financial transaction because both of them are intimately associated with each other. Although new and complicated financial methods recently appear, a typically-used hypothec does not accept social needs surrounding the loan financial transaction. Especially the financing method which is called Project Financing needs a safer security in the process of promoting all sorts of the Real Estate Development Business prodigious funds are invested in. In this situation the real estate security trust began to make a mark as a new type of security method. A wide use of Trust as a security method was not easy because it is originated from the United Kingdom and the real estate security system in Korea has been developed from the Continental law line. It is less than 20 years that the real estate security trust has been noted as a new type of security method. Although the real estate security trust does not have perfect functioning of security, it is appreciated as a powerful means for keeping the value of security. One of the reasons is due to bankruptcy remoteness effect in Trust. This means that a creditor as the beneficiary can exercise his or her right about the trusted real estate being free from intervention of truster or trustee. As this bankruptcy remoteness effect is a peculiar one of the trust system, it is equally admitted in the real estate security trust. If a rehabilitation procedure is started, a creditor as the beneficiary can lose his or her rehabilitation credit about truster but can not lose the beneficiary right about trustee. This aspect is a contributory cause in reinvigorating the real estate security trust. Some people tended to regard the real estate security trust as the security system so far in Korea. In other words those who make an assertion that it is 'the trust' in form and 'the security system' in essence think of the beneficiary right as a kind of non-typical security right. But strictly speaking, it is not the security system. Because the security acquisition effect in the real estate security trust is right in a economical aspect and is not so in a legal aspect. So the real estate security trust is a kind of trust system and we can understand it with an explanation based on the peculiar principle of trust system. They have used 'Mortgage' or 'Deed of Trust' as a method for financing with a real estate in the United States. This 'Mortgage' or 'Deed of Trust' is similar in transferring the ownership about a real estate for a security, the former transfers it to a creditor but the latter does so to trustee. In California 'Deed of Trust' and 'Mortgage' are treated equally as the essence of 'Deed of Trust' is a kind of 'Mortgage' that has the right of disposal by sale since 1930. However we must reconsider whether this treatment in California can be accepted in Korea. Although 'Deed of Trust' in California is similar to the security trust in Korea, they are not identical. It is natural that 'Deed of Trust' is treated as a kind of 'Mortgage' which has the right of disposal by sale because the security right is not reduced in the law related to rehabilitation or bankruptcy procedure of the United States. However the law in Korea is different from that in the United States. If we regard the real estate security trust as the security system in Korea, the serious problem comes into existence because the rehabilitation security right is reduced according to the insolvency law of Korea. In other words if they think of the beneficiary right as a kind of non-typical security right, it is logically the rehabilitation security right. In result we can not protect the beneficiary. The Trust Law of Korea was fully revised in 25th July, 2011. It has not only brought about the legal basis of the security trust but also made a kind of the institutional device which can get over a boundary of the past security system-issuing a beneficiary certificate and securing a circulation of the beneficiary right. These points will enhance the use of the real estate security trust. Additionally as the object of the security trust is not limited only to a real estate, we must study the chance of using the security trust which include movable properties, securities, bonds to be paid in money and so on. This leads to making good use of the security trust which is stable and convenient, and so will eventually revitalize the loan financial transaction. ; Master
