For the settlement of peace, UN applies principally peaceful solutions, if this is not possible, UN might be obliged to use armed forces. Turkey's contributions in Kosovo, Bosnia-Herzegovina and Afghanistan where UN has obliged to use armed forces will be examined. These contributions which are being sufficient in general framework will be explained in our thesis.
This article offers a critical review of the few existing scholarly attempts to conceptualize & theorize the study of peacekeeping operations. It reveals that even though the study of peacekeeping operations is burgeoning, most of the available literature is idiosyncratic & atheoretical. Although some authors have recently utilized various concepts from international relations theory for analysis of peacekeeping operations, the potentially diverse international peacekeeping theories are yet to be fully integrated into international relations theory. After inspecting future research agendas outlined by the leading experts in the field, the author critiques the recent calls for a "macrotheory" of international peacekeeping. Birleşmiş Milletler (BM)'in barışı koruma misyonu kuruluşundan itibaren günümüze kadar gelen süreçte uluslararası barış ve istikrarın sağlanması konusundaki en önemli araçların başında gelmiştir. 1950'li yıllarda ilk örneklerinin görüldüğü barışı koruma misyonları Soğuk Savaş sonrası dönemde değişime uğramıştır. İnsani müdahale ve devlet egemenliği kavramları çerçevesinde yeniden değerlendirilen barışı koruma misyonları uluslararası barış ve güvenliğin sağlanmasındaki en önemli araçlardır. In the 1950s the first examples of peacekeeping missions were seen and have been transformed in post Cold War era. After re-evaluated through humanitarian intervention and state sovereignty the peacekeeping missions are the most important instruments in ensuring international peace and security. War conditions cause favorable stituations for the destruction of human development. It has caused widespread corruption in political, economic and cultural fieldand confronted society with various problems. However, in contrast to war condition, peace serves the needs of everybody in the best possible way and raises human development cycles to high levels. Throughout history, Afghanistan has been regarded as the battlefield of the colonial countries of the world. This rivalry between colonial countries has harmed Afghanistan and prevented Afghanistan from building its own future. This process, which was ongoing from British intervention to invansion of Soviet Union created political contitions that hinder the development and triggered çivil war in Afghanistan. In addition to the attacks of colonial countries, Afghanistan has always been a victim of ethnic politics. Besides, In Afghanistan, ethnic politics have a lot of negative consequences. However, it is possible to say that the most destructive one is the national identity crisis. Ethnic politics in Afghanistan have been partially successful. This stiuation interrupts relations between to-days Afghanistan ve its past that base on glorious civilization of Aghanistan. Afghanistan needs to seek rational and peaceful means to overcome these challenging crises. In these cases, it would be more consistent to resolve Afghanistan's internal problems by using influential elements such as diplomacy. Diplomacy plays a very important role in ensuring peace and stability in Afghanistan. Nükleer teknolojinin "iki yüzlü" doğası gereği, barışçıl nükleer enerji programları çerçevesinde nükleer enerji üretme amacından sapan ülkelerin nükleer silaha sahip olabilecekleri de bilinmektedir. Bu bağlamda, devletlerin nükleer teknolojinin kontrol edilmesi amacıyla uluslararası alanda bir düzenleme arayışlarının en somut meyvesi olarak karşımıza 1970 yılında yürürlüğe giren Nükleer Silahların Yayılmasının Önlenmesi Anlaşması (The Treaty on the Non-Proliferation of Nuclear Weapons- NPT) çıkmaktadır. Taraf devletleri "nükleer silah sahibi devletler" (nuclear weapons states) ve "nükleer silah sahibi olmayan devletler" (non-nuclear weapon states) olarak kategorize eden NPT, nükleer silahsızlanma amacının yanı sıra, nükleer teknolojinin bahsi geçen çift kullanımlı yapısını kontrol etme amacı taşıyan maddeler de içermektedir. Bu çalışma, nükleer teknolojinin barışçıl amaçlar dışında kullanımını önleme ve bu teknolojinin barışçıl amaçlarla kullanımı sağlama çabalarını NPT müzakereleri ve üç sütunlu yapısı kapsamında değerlendirmeyi amaçlamaktadır. Çalışmada öncelikle nükleer teknolojinin çift kullanımlı yapısı hakkında teknik bilgi verilerek, NPT'nin yürürlüğe girdiği tarihe kadar geçen süreç içerisinde bu teknolojinin kontrolüne yönelik çabalar özetlenecektir. Daha sonra, NPT'nin üç sütunlu yapısı açıklanarak, Anlaşma müzakerelerinde barışçıl kullanım konusunun ne şekilde yer aldığı değerlendirilecektir. Son olarak, bu konunun İran ile Birleşmiş Milletler Güvenlik Konseyi üyesi beş devlet ve Almanya (P5+1) arasında sonuçlandırılan Kapsamalı Ortak Eylem Planı (KOEP) çerçevesinde değerlendirmesi yapılacaktır. ; It is known that, due to the "dual use" nature of nuclear technology countries can divert their nuclear energy programs from peaceful uses to nuclear weapons programs. In this regard, with the aim of controlling nuclear technology we see the Treaty on the Non-Proliferation of Nuclear Weapons (NPT) as the most substantial fruit on the international level. NPT which categorizes its parties as the nuclear weapon states (NWS) and non-nuclear weapon states (NNWS) includes wide range of articles from achieving nuclear disarmament to controlling dual use structure of nuclear technology. This study aims to assess the efforts to prevent non-peaceful use of nuclear technology as well as the efforts to enable it peaceful use in the framework of NPT negotiations and three-pillar structure. Firstly, it provides a technical background regarding the dual use structure of nuclear technology and summarizes the attempts to control it during the period until the Treaty came into force. Departing from this point, it evaluates the status of peaceful use issue in the Treaty negotiations and in the three-pillar structure of the NPT. Finally, it assesses this issue in the light of Joint Comprehensive Plan of Action (JCPOA) which was concluded between permanent members of the United Nations Security Council and Germany (P5+1 countries) and Iran.
Bu tezin temel amacı uluslararası sistemde meydana gelen yapısal değişime eşlik eden normatif değişimi mümkün kılan koşulları ortaya çıkarmak ve bu süreçte hangi faktörlerin belirleyici olduğunu incelemektir. Çin'in uluslararası sistemde devam eden değişimi yönetebilme yeteneği, akıllı güç kombinasyonuna dayanan stratejik tercihleriyle yeni bir düzen inşa edebilmesine bağlıdır. Bu çalışmada analitik eklektisizm yöntemine başvurularak, güç geçişi ve güç yayılımı modelleri teorik bir inşa olarak birleştirilmiştir. Bu perspektiften bakıldığında uluslararası sistemdeki değişim, yükselen güçlerin ABD hegemonik düzenine karşı direniş stratejileri geliştirmelerine imkan sağlamaktadır. Gücün normatif yayılımı maliyet dayatan stratejiler izleme iradesini pekiştirirken, gücün materyal dağılımı bunun yapılabilirliğini belirlemektedir. China's capability to manage the proceeding change in the international system basically depends on its ability to construct a new order by its own strategic preferences which are derived from the combination of Chinese smart power. By applying to the analytical eclecticism as a methodological perspective, both power transition and power diffusion models are combined as a theoretical construction. Whereas the normative diffusion of power ensures the will to follow the cost-imposing strategies, the material distribution of power confirms the practicability of them. Besides, the Chinese smart power leads to have an exceptional status among the other new rising powers. The combination of Chinese smart power, directly reflects three elements: its Foreign Coherence provided by the increasing influence in the international institutions, Comprehensive National Power projection combined as the ideational, economic, and military power dynamics, and Strategic Identity improved largely with its increasing self-confidence. Furthermore, China's search for a new order aims to create its own jeopolitical norms and practices expedient to its national interests by primarily at regional level. Peaceful development strategy, on the one hand serves to counteract the doubts and concerns of other states about the rise of China, but it provides also on the other to make installations that shape the future conditions of international system. Thus China's contemporary international posture is identified by both its diplomatic influence based on the five principles of peaceful coexistence and by the order making role expediently undertaken. Although the multiple lines of strategic action take place within its diplomatic influence, the fixed principle stance recently displayed by China provides to gain legitimacy in the eyes of developing countries as well as other actors.
Uluslararası toplumda ortaya çıkan uyuşmazlıkların tarafları dikkate alınarak incelendiğinde, uluslararası hukuk kişileri arasındaki uyuşmazlıklar ve uluslararası hukuk kişileri ile özel hukuk kişileri arasındaki uyuşmazlıklar biçiminde bir tasnif yapılmaktadır. Diplomatik uyuşmazlık çözümü, uluslararası hukuk kişileri arasındaki uyuşmazlık çözümünü konu edinmekte özel olarak ise uyuşmazlık taraflarından en azından birinin devlet olduğu uyuşmazlık çözüm yollarını ifade etmektedir. Uyuşmazlıkların diplomatik yollarla çözümü gerek tarihsel açıdan bakıldığında gerekse çağdaş uluslararası toplum düzeni incelendiğinde en çok tercih edilen ve tüm uyuşmazlıkların konu itibarıyla sınırlandırılmadan çözülebileceği yolları bünyesinde barındırmaktadır. Bu çalışmada uyuşmazlıkların tanımlanmasından başlanarak uyuşmazlıkların diplomatik yollarla çözülmesinin incelemesi yapılacaktır. Öncelikle bir uluslararası uyuşmazlığın yargı içtihatları çerçevesinde belirlenmesi ve tasnifi için öngörülen kıstasların değerlendirilmesi yapılacaktır. Ardından uyuşmazlıkların barışçı çözümü yükümlülüğünün içeriği kişi, konu ve nitelik itibarıyla işlenecektir. Diplomatik müzakereler, dostça girişim, arabuluculuk, soruşturma ve uzlaştırmadan oluşan yerleşik diplomatik uyuşmazlık çözüm yolları, hukukî dayanakları çerçevesinde temel vasıfları açıklanmak suretiyle değerlendirilecektir. Bu yolların tercih nedenleri ve hangi durumlarda işletildikleri incelenirken somut örneklere yer verilerek anlatım zenginleştirilecektir. Devam eden kısımda ise uluslararası ilişkilerde meydana gelen değişimlerin bu yolları nasıl etkilediği ve ne tip yönelimlerin diplomatik uyuşmazlık çözümünü etkilediği ele alınacaktır. Bu değişimlerden yola çıkarak diplomatik uyuşmazlık çözümünün geliştirilmesi adına dikkate alınabilecek tavsiyeler dile getirilecektir. ; The disputes that rise in the international community can be classified as the ones between intenational law persons and the ones between international law persons and private law persons when they are studied by the charecter of parties. The subject of diplomatic dispute settlement is the disputes that are between intenational law persons and specifically the disputes which at least one of the parties is a state. Diplomatic dispute settlement contains the most preferred and comprehensive means that can settle all disputes without any limitations on subject matter both historically and in contemporary international community. In this study, dispute settlement with diplomatic means will be reviewed by describing disputes at the beginning. Firstly international disputes and criterions used in classfication of disputes will be determined within the scope of case law. After that, the obligation of peaceful dispute settlement will be handled by characteristics of obligation including ratione personae and ratione materiae. The established means of diplomatic dispute settlement which are diplomatic negotiations, good offices, mediation, inquiry and conciliation will be studied within the frame of legal basis of these means by stating their fundemental characteristics. When preferability and most suited conditions of these means examined the subject will also be enriched by concrete examples. In following part, the effects of changes in international relations to diplomatic means and what kind of tendencies can be observed will be discussed. Based on this discussion recommendations on enhancing the diplomatic dispute settlement will be stated.
This article discusses the growing role of China in UN peacekeeping operations since 1989. First, the reasons for the non-engagement of China after its admission to the UN and its Security Council in 1971 are described to stress the difference of the Chinese behavior after the end of the Cold War. Second, the increasing Chinese activity in UN peacekeeping is shown by describing China's gradually changing behavior in three areas: voting in the Security Council, personnel contributions to peacekeeping operations and financial contributions to the UN peacekeeping budget. In the end, the article suggests that China's growing role in UN PKO could be understood as an important part of China's peaceful rise policy. Adapted from the source document.
UN peacekeeping operations are viewed as a relevant instrument of conflict resolution in the post-Cold War era. A significant part of them operates in Africa, the place with the largest "demand" for conflict resolution. Why are some operations successful, while others not? What are the determinants of their success? The author focuses on six determinants relevant for the outcome of peacekeeping operations: support of the UN Security Council, a clear & feasible mandate, equipment & size of the operation, duration of the operation, will of the belligerents to end the conflict peacefully & support of an African regional organization. Based on case studies representing ten UN peacekeeping operations in Africa, the author evaluates the determinants of success & thus shows the difficult striving of UN peacekeeping for success. This article offers a comprehensive analysis of the perils & benefits of peacekeeping privatization by approaching two key questions. Firstly, can private military companies (PMCs) take on peacekeeping functions consistent with the UN Charter's primary objective "to save future generations from the scourge of war?" And secondly, is peacekeeping privatization really an option for bridging the UN's peacekeeping capabilities-expectations gap? PMCs' past performances here offer no clear-cut answers for the first question. Critics have doubted their cost-effectiveness, accountability & legitimacy, while proponents have argued their cost-effectiveness, feasibility & professionalism over their UN and/or regional counterparts. On the second question, PMCs posses many capabilities necessary for peacekeeping operations that the UN often lacks. Yet the question remains how far privatization should extend, with the danger of it going too far too fast, causing PMC peacekeeping to become a substitute for, rather than an enhancement of, UN action. This article provides an analysis of the of United Nations (UN) peacekeeping, one of the hottest topics in international politics of the post-cold war era. Numerous books, articles, and Ph.D. thesis have already been written about UN peacekeeping operations. Although differing vastly in their scope and quality, most of the recent critiques have pointed out the pressing need to re-define and strengthen the cold war era concept of UN peacekeeping so that it becomes a viable conflict resolution method in the 21st century. Some scholars have, however, expressed serious doubts about the actual conflict resolution capabilities of UN peacekeeping operations. They argue that premature, short-tenn and under funded UN peacekeeping operations may well do more damage than good. One of the few things the majority of conflict resolution scholars and practitioners can nowadays agree on is that no UN intervention can bring peace to a place where it is not wanted.This article aims to enrich the current peace research by introducing an alternative analytical approach to the study of the UN peacekeeping. It is divided into seven sections. The introduction is followed by a theoretical section where I briefly summarize two basic theoretical approaches to the study of the UN peacekeeping (Conflict Management & Conflict Resolution). The third section provides an analysis of the changing nature of armed conflicts in the post-cold war period. The fourth section deals with the adjustments that were made to the concept of UN peacekeeping operations in reaction to the changes in the nature of current armed conflicts. The analytical concept Capabilities versus Expectations Gap is introduced in the fifth chapter, followed by the core section of this article -- the analysis of the United Nations peacekeeping using the analytical concept Capabilities versus Expectations Gap. The analytical concept Capabilities versus Expectations Gap was first introduced by Christopher Hill in 1992 as a handy tool for analyzing the evolving European Common Foreign and Security Policy (CFSP). The unique advantage of this concept is that it provides a sensible assessment of both the actual and potential UN capabilities. By comparing these with the existing UN expectations, the Capabilities versus Expectations Gap analysis of UN peacekeeping enables us to sketch a more realistic picture of what the UN is capable of doing in the area of conflict resolution than that presented either by its more enthusiastic supporters or by the demanders among the UN Member States. Consequently, building further on this realistic picture of the UN conflict resolution capabilities, I attempt to answer the key research question of this article: Is the UN, with the current level of its conflict resolution capabilities, capable of providing high quality treatment to as many conflicts as it nowadays attempts to provide? Based on the findings of the Capabilities versus Expectations Gap analysis of the UN peacekeeping problematic, I argue that since the end of the cold war, the UN has several times attempted to carry out more peacekeeping operations than it was capable of performing well in light of the current level of its conflict resolution capabilities. In other words, the most important conclusion of this article is that there is a gap between the UN capabilities and expectations in the area of conflict resolution and that the only option how to bridge this gap in the foreseeable future is to decrease the excessive UN expectations to meet the currently available UN capabilities. As paradoxical as it may sound, in practical terms this means that the United Nations is nowadays more likely to succeed in meeting its basic function ("to save succeeding generations from the scourge of war") by carrying out fewer but high quality peacekeeping operations. The aim of the paper is to examine interconnections between the process of state-building and the process of nation-building during a period of post-conflict reconstruction. The specific case of the current reconstruction process in Kosovo is exceptional due to extensive international support expressed through political and economic means. Regardless of efforts towards reform made by powerful members of the international community, future sustainability may be questioned. An alternative to the currently favoured institutional approach is provided by the work of Barry Buzan on the state, which puts an emphasis on the idea of the state, assuming integration between territorial, societal and political aspects. The conclusion presented in this article might be used as a lesson learnt from previous mistakes in work dealing with ethnically divided societies, for which it is not sufficient to provide institutional structures without an adequate socio-political reconstruction of existing conditions. If a society is not adequately adapted to the newly-established situation, the institutional structures will not be able to fulfil their key functions completely. Furthermore, it has to be clear that any possible reconstruction of institutional bases must be attempted only with a deep consideration of specific local conditions; otherwise its sustainability is doubtful. ; The aim of the paper is to examine interconnections between the process of state-building and the process of nation-building during a period of post-conflict reconstruction.
