The organization of peaceful assemblies is a constitutional right granted to individuals located both in the territory of the Republic of Poland and in Ukraine. This is an important right because it provides the society with the possibility of actual participation in public life by expressing its views or manifesting a specific position. The study was devoted to a comparative analysis of the constitutional regulations on the organization of assemblies in Poland and Ukraine. It was also assumed that the ordering services of assemblies play an important role for the safe and peaceful conduct of assemblies and constitute an example of security privatization in this area.

The article examines peaceful assemblies as one of the tools of environmental political parties and NGOs in the context of their impact on political processes in Ukraine. It is established that the specifics of organizational aspects, slogans and other features of peaceful assemblies of Ukrainian environmental parties and NGOs have changed since the late 1980s and during the years of the independence of Ukraine. In particular, the 1986 Chernobyl disaster was a powerful stimulus for their intensification and peaceful protest rallies. As of 2021, the range of issues that are the cause and reason for peaceful assemblies is very wide. One of the most pressing is the problem of mitigating the effects of negative climate change and adapting to them. The study does not reveal any significant differences between the specifics of the use of peaceful assemblies by environmental parties and environmental NGOs. All significant differences are related to the different status of these organizations and their connection to the electoral process. Instead, the scenarios of peaceful protest-type gatherings (demonstrations, marches, pickets), as well as positive actions (cleaning, landscaping, planting trees, etc.) for environmental parties and NGOs are identical in their characteristics. On the eve and during the election campaigns, there is an intensification of environmental parties and NGOs in holding peaceful assemblies. Their specificity depends on the type of elections: during national elections, such actions are both local and national. During local elections, peaceful assemblies are predominantly local and address local issues. Popular types of actions during the election period are protests with slogans and demands to the government, as in the vast majority of cases environmental parties in Ukraine are in opposition or critically evaluate actions of the government: both at the central and local levels. Environmental NGOs, in accordance with their status, provide advice and formulate requirements to election participants and encourage them to include environmental aspects and commitments in their programs, in particular in the form of an «environmental agenda». ; У статті досліджено мирні зібрання як один із інструментів екологічних політичних партій та громадських організацій в контексті їх впливу на політичні процеси в Україні. Однією із найбільш актуальних стає проблема пом'якшення наслідків негативних змін клімату та адаптації до них. В рамках дослідження не виявлено суттєвих відмінностей між специфікою використання мирних зібрань екологічними партіями та екологічними громадськими організаціями. Всі суттєві відмінності пов'язані із різним статусом цих організацій та їх відношенням до виборчого процесу. Натомість сценарії мирних зібрання протестного типу (демонстрації, марші, пікетування), а також акції позитивного спрямування (прибирання, благоустрій, садіння дерев тощо) для екологічних партій та громадських організацій в своїх характерних рисах є однаковими. Напередодні та під час виборчих кампаній спостерігається активізація екологічних партій та громадських організацій у проведенні мирних зібрань. Їх специфіка залежить від типу виборів: під час загальнодержавних такі акції бувають як локальними, так і загальнодержавними. Під час місцевих виборів мирні зібрання мають переважно локальний характер та присвячені локальним проблемам. Популярними типами акцій у виборчий період є акції протесту із гаслами та вимогами до влади, оскільки у переважній більшості випадків екологічні партії в Україні знаходяться в опозиції або критично оцінюють дії влади: як на центральному, так і локальному рівні. Екологічні громадські організації відповідно до свого статусу дають поради та формулюють вимоги до учасників виборів та закликають їх включити екологічні програми та зобов'язання у свої програми, зокрема у формі «екологічного порядку денного».

This entry outlines the UN jurisprudence of the Human Rights Committee (HRC) on public peaceful assemblies. It compares the protection of the right (freedom of assembly) in the UN system with the protection provided on a supranational/regional level and the domestic (constitutional) level, relying on the landmark cases on each of the discussed themes. The entry aims at exploring the underlying values, scope, and limitations of the right to freedom of assembly in the UN system and the comparative jurisprudence. The underlying values of the right to freedom of assembly explain the rationale for the legal protection of the right. Moreover, the entry examines the scope of the right of freedom of assembly, in order to draw the boundaries of the right and define its content. The analysis of the limitations focuses on the advance notice requirement and permit system, limitations on the time, place or manner of the assembly, and restrictions associated with heckler's veto or having a hostile crowd. The discussion on limitation assesses whether there are historical, societal, and demographic factors that can restrict the exercise of the right to freedom of assembly, or if different regions/States are equally subjected to the same normative principles. Finally, the entry sketches the challenges and normative reflections, regarding the right to freedom of assembly, in light of the Covid-19 pandemic in 2020.

Lebanon, a unique, poly-confessional Eastern Mediterranean country of Arab origin with a long Phoenician history, has seen yet another wave of unrest in the last two years. Around the same period, widespread protests were aroused in two post-soviet countries in Eastern Europe, expressing their outrage at the falsification of vote tallies, corruption, and the political motivation of their governments in the face of a worsening economic situation. The aim of the study was to find out the common and distinctive elements of these civil rallies and assemblies, as well as to predict their possible impact on interregional relations and geopolitical tendencies. The article may indicate some unique features due to the lack of fundamental research studies on the theme rather than analytics and media reports. A concise comparison is made of Lebanon's, Moldova's, and Belarus's situation with respect to their establishment, political and economic crisis, resulting protest actions. Some peculiarities were discovered following the interests of internal and external political groups and their influence. A cautious prognosis was made in order to forecast some further developments in the situation around these countries, including the attitude of the key actors in the region towards the processes inside and outside, trying to tip the scales in their favor.

The paper outlines historical experience of Ukraine on the issue of the protection of peaceful gatherings, as well as the current situation, both in the legislative aspect and in the aspect of legal proceedings. The factors limiting the right to peaceful assemblies, namely place, time and method, are analyzed. The details of such components of the place factor as private property and public institutions are disclosed. As an example, the paper addresses the cases of British and American Supreme Courts, as well as the cases of ECHR. In addition, the article seeks to establish a reasonable timeframe, illustrating, as an example, the cases of the ECHR and the British Supreme Court. The latter factor determines the factor of the method, substantiating its theoretical aspects by judicial practice. In a separate section, the article deduces a three-component test, emphasizing the importance of the three-component test as the only effective mechanism for setting the framework for the regulation of peaceful assembly. At the same time, possible shortcomings of each link of the three-component test are presented separately. The paper concludes that the establishment of specific general restrictions on peaceful assembly is not possible either in terms of place, or in terms of time or method. Therefore, it is important to remember the need for individual consideration of each case and the application of a three-component test in order to balance the right to peaceful assembly.Article received 26.02.2019 ; Статтю присвячено дослідженню питань обмеження права на мирні зібрання. The article is devoted to a theoretical study of the problem of regulating the right to peaceful assembly. We have conducted a comparative analysis of Ukraine's neighbors, taking into account the peculiarities of their legislation, in order to implement the practice of foreign countries in Ukrainian legal regulation. The article identifies the need for further research into the case of reforming Ukrainian legislation. Freedom of peaceful assembly is closely linked to the fundamental principles of democracy and pluralism - freedom of expression and freedom of association. It is not only a criterion for determining the level of democracy in a country, but also an extremely effective way of public control over state institutions. It shows the extent to which citizens can realize their right to freedom of worldview and religion, thought and speech, to free expression of their views and beliefs, the right to free development of their personality and so on. Effective regulation of freedom of peaceful assembly provides citizens with the opportunity to influence the course of political, economic and social life of the country through rallies, pickets or demonstrations. It is important to not only have the formal recognition and constitutional consolidation of these rights and freedoms, but also their actual implementation in various spheres of social life: legal, political, economic, social and spiritual. Restrictions on the exercise of freedom of peaceful assembly may be imposed by a court in accordance with the law and only in the interests of national security and public order: for instance, in order to prevent riots or crimes, to protect public health or to protect the rights and freedoms of others. The right of peaceful assembly has been recognised as a critical component of democracy. In Africa it played a significant role in the liberation of states from colonial oppression, and continues to be used to express dissent. The actual exercise of this right, however, faces significant challenges. Too often, police officers use excessive or indiscriminate force during assemblies, leading to violations not only of the right of peaceful assembly but also, in some cases, of the right to life. Alive to the reality of the threat to life and limb posed by the unlawful use of force by the police during assemblies, over the past decades the African human rights system has developed standards for the use of force during assemblies. This article analyses the legal and jurisprudential developments around the protection of the right to life during assemblies and enquires as to whether they are consistent with international standards and whether they are adequate. It finds that despite progressive legal development on the protection of the right to life in law enforcement, in general, there is limited jurisprudence on the specific protection of the right to life in the context of the policing of assemblies. The dissertation is a comprehensive study of the constitutional right of citizens to assemblies, rallies, marches, and demonstrations in the context of of its implementation, which is executed with regard to the theoretical component and practical dimension. The Unit 1 "Theoretical and legal characteristics of the constitutional right of citizens to assemblies, rallies, marches, and demonstrations" substantiates the provisions involving the complex nature of the constitutional right of Ukrainian citizens to assemblies, rallies, marches, and demonstrations as a multifaceted, social, political and legal phenomenon that covers the subjective constitutional law; a form of direct democracy and a comprehensive legal institution. The Unit 2 "Mechanism for exercising the right to assemblies, rallies, marches, and demonstrations" substantiates the view that the mechanism for exercising the right to peaceful public assembly is always a logically consistent, systematic interaction of various subjects of law to implement human rights regulations, and not a way of exercising rights and obligations exclusively by an individual.
