In diesem Beitrag wird keine theologische Selbstaufklärung anhand des Virtualitätsbegriffs betrieben, so reizvoll das sein mag. Der Virtualitätsbegriff soll hier auch nicht in systematischer Abgrenzung von einem wie auch immer zu fassenden Realitätsbegriff entwickelt werden. Virtualität sei im folgenden vielmehr ein Wort für das Interdependenzverhältnis von medialen Referenten und ihren außermedialen Referenzen. In einem doppelten medienhistorischen Cursus soll es zunächst um dieses Interdependenzverhältnis gehen. Es wird im medienhistorischen Zusammenhang zu fragen zu sein, wie die Spezifika des Digitalen Zeitalters sozialethisch anzusprechen sind. Die These lautet, daß diese Spezifika mit ihren ungeahnten Kommunikationsmögichkeiten nicht nur dem Marktprinzip nützen, sondern auch für das normative Konzept einer marktkorrektiven Netzwerkgesellschaft interessant sind. Was sich hinter dem Begriff Netzwerk verbirgt, muß allerdings eigens geklärt werden. Dann gilt es, die medien- und die gesellschaftstheoretischen Befunde miteinander zu korrelieren, um die eigentliche These des Beitrags zu begründen, für welche der Begriff Cyber Policy Networks (CPNs) steht: Marktkorrektive Politik kann künftig nicht mehr nur über territorialhierarchische Rahmenordnungen implementiert werden. Sie verlangt weltweite, horizontale interdependente Netzwerke, die erst im Cyberspace des Internet ihre ganze Wirksamkeit entfalten.

Dieser Aufsatz beschäftigt sich mit den Problemen allgemeingültiger Effektivitskriterien bei Policy-Netzwerkevaluationen. Dabei wird zuerst auf die tieferen theoretischen Dimensionen eingegangen. Anschließend erfolgt eine Kritik an der Neuen Institutionenökonomik (NIÖ), die des Öfteren explizit als theoretischer Bezugspunkt von Policy-Netzwerken gesetzt wird, durch die deutlich wird, das sie nicht nützlich ist zur Ableitung allgemeingültiger Effektivtätskriterien. In einem nächsten Schritt wird dann die NIÖ ersetzt durch pragmatistische axiomatische Überlegungen für Policy-Netzwerke, aus denen sich regelhafte Effektivitätskriterien ableiten lassen. Bei diesem Aufsatz handelt es sich um eine Auskopplung eines Kapitels aus meiner Dissertation. ; This essay deals with problems of universal criteria of effektivity occuring by evaluations of policy-networks. At first it dwells on the deeper theoretical dimensions of the problems by effektivity. Than follows a critique of the german called Neue Institutionenökonomik (a general term for transaction cost, property rights and the principal agent theory), which appears regurlary as theoretical basic of policy-networks. With the critique it goes clear that the Neue Institutionenökonomik isn`t useful to create universal criteria of effektivity. In a next step the Neue Insitutioneökonomik gets replaced with thoughts of pragmatical axiomatics. With these it goes possible to derive some principled criteria of effektivity. This essay is a uncoupling chapter of my dissertation.
Lokale Politiknetzwerke werden sowohl in der öffentlichen Sozialstaatsdebatte als auch in der sozialwissenschaftlichen Forschung als vielversprechende Instrumente zur Optimierung von Wohlfahrtsmärkten propagiert. So auch in der Diskussion um den deutschen Pflegemarkt und seine Steuerungsdefizite. Im Gegensatz zu den mit dem Steuerungsinstrument Pflegekonferenz verknüpften Erwartungen, sind dessen genaues Steuerungspotential und mögliche Erklärungsfaktoren bisher jedoch nicht systematisch untersucht worden. Den methodologischen Kern dieser Arbeit bilden eine strukturelle Politikfeldanalyse des deutschen Pflegemarktes in Kombination mit einer empirischen Einzelfallstudie zu den Steuerungsleistungen einer Pflegekonferenz. Grundlage ist ein spezifisches Analyseraster auf Basis des akteurzentrierten Institutionalismus, welches die Aufmerksamkeit in der Analyse der Erklärungsfaktoren auf die Kombination der Koordinationsinstrumente Markt und Netzwerk sowie die Ausgestaltung des institutionellen Rahmens durch Gesetzgebung und Selbstverwaltung lenken soll. Im Rahmen der empirischen Erhebung konnten kaum direkte und nur wenige indirekte Steuerungsleistungen nachgewiesen werden. Als Ergebnis der Analyse lässt sich festhalten, dass lokale Politiknetzwerke im Umfeld des deutschen Pflegemarktes grundsätzlich mit erheblichen Herausforderungen hinsichtlich ihrer Steuerungsfunktion zu kämpfen haben. Dies lässt sich zum einen darauf zurückführen, dass ein gemeinsames Steuerungsinteresse der Akteure nur in wenigen Bereichen vorhanden ist, da die Grundbedingung der Interdependenz selten gegeben ist und auch nur sehr eingeschränkt innerhalb von Pflegekonferenzen entwickelt werden kann. Zum anderen sind die steuerungsrelevanten Handlungsressourcen oftmals lokal nicht verfügbar, wodurch erschwerend die Steuerungsmöglichkeiten eingeschränkt werden. Je nach Steuerungsbereich sind diese Faktoren jedoch verschieden ausgeprägt, sodass sich unterschiedliche Steuerungspotentiale ergeben. ; In the public and scientific welfare state debate local policy-networks are propagated as suitable means for strengthening the governance of welfare markets. The same applies to the debate on the German long-term care market and its deficiencies. In contrast to its prominence in the discussion, neither the governance-potential of so-called "care conferences" nor its explaining factors have thus far been systematically analyzed. At the heart of this thesis lies a structural policy-analysis in combination with an empirical single-case study, whereby the institutional design of the German long-term care market is used to explain the performance of a best-practice care conference. An analytical framework based on the actor-centered institutionalism serves as a basis for the analysis. Attention is thus focused on the combination of market and network modes of coordination as well as on the design of the institutional framework of the policy field through legislation and self-government. The evaluation of the care conference showed hardly any direct network-governance and only few indirect governance-results. In the course of the analysis this could be explained by a lack of common interest in collective governance, as the precondition of interdependence between the network-actors is often lacking and difficult to develop within the conferences. Furthermore the collective capability to govern local long-term care markets is in many cases limited, as the necessary institutional resources are seldom locally available. Depending on the area of governance, the influence of both factors varies so that care conferences offer differing governance-potentials. In conclusion care conferences struggle with their governance-function, since the institutional framework and the market leave little room for local network-governance.
To overcome economic injustices and spatial disparities inherited from the apartheid era, the Namibian government pursues regional development in the Zambezi region. Two popular policies are applied that build on the commodification of nature via wildlife tourism: growth corridor policy is envisioned to enable the coupling into global production networks (GPN) via increased connectivity and targeted investments into tourism. Similarly, community-based natural resource management (CBNRM) schemes are designed to attract foreign investments in the safari and hunting tourism sector to benefit rural communities. Despite the hopes that are set on international tourism, GPN theory indicates three threats connected with global market integration: first, emerging social inequalities and disarticulations in the host region, second, the appropriation of value by central nodes of the GPN and therefore limited value capture at the production stage and third, the alteration of human-environment relations at the production stage. Notwithstanding this, a conceptualisation of nature's integration into GPNs is still pending. Therefore, the aim of this dissertation is to scrutinise the commodification of nature through wildlife tourism and growth corridor policy effect on regional development. To this end, value capture among the actors and localities of the tourism GPN was examined, the role of infrastructure for nature-based GPNs assessed and the mechanisms that lead to the integration of nature into GPNs revealed. A single case study approach was applied that comprehensively studied the effects of tourism development policies connected with the Walvis Bay-Ndola-Lubumbashi Development Corridor (WBNLDC) in the Zambezi region. A mixed-methods approach combined qualitative interviews, archival research and the review of existing scholarly and grey literature with a business survey, a traffic census and the analysis of quantitative data, inter alia a household survey. Findings reveal that infrastructure development and the expansion of nature conservation territories led to increased value creation from tourism in the region, but traffic census data indicates that extra-regional actors are able to capitalise on these opportunities. Nevertheless, conservancies as local institutions are able to capture roughly 20 % of the value, while tourism accrues to only 5.5 % of the income of rural households. Lastly, the institutional configuration on the local and national scale is crucial for determining how wildlife is economically utilised and who benefits from it. These findings highlight the role of local institutional actors in value capture, confirm the necessity to study the territoriality of GPNs and the role of infrastructure therein and call for a closer look at social-ecological relations at the production stage, since they are decisive for regional development.
The digital domain, technological innovations, and Big Data analytics increasingly shape the lives of millions of individuals, groups, organisation, and societies. This cyber age calls for effective governance to protect the basic interests and needs of individuals and groups. Simultaneously, the very nature of governance is changing. Increasingly policy-making moves away from top-down governance by the state towards more horizontal modes of governance. This paper argues that network in the term network governance needs to be taken seriously in order to reconceptualize power and responsibily in networked societies. Therefore, we combine the literature on governance with social network theory to conceptualise governance in the Cyber Age. It will be argued that dominant modes of governance are inadequate to govern the Cyber domain. Therefore, a novel networked mode of governance is proposed based on the regulation of new power relationships between Cyber actors and civil society.
This paper presents empirical and theoretical findings about the endogenous dynamics of interorganisational knowledge networks. Based on a qualitative study of intercommunal knowledge networks in local employment policy a model of knowledge network life cycles is outlined, empirically illustrated, and theoretically explained. It is argued, that the interdependence of knowledge, power and trust plays a central role for the internal dynamics of networks. The paper also aims to show why network innovation and creativity is often closely linked to internal conflicts. The results have consequences for a dynamical concept of network governance. ; Im Mittelpunkt des Papiers stehen empirische und theoretische Befunde zu den endogenen Dynamiken interorganisatorischer Wissensnetzwerke. Die Analyse basiert auf einer qualitativen Studie interkommunaler Wissensnetzwerke der lokalen Beschäftigungspolitik. Dabei wird ein Lebenszyklusmodell interorganisatorischer Wissensnetzwerke skizziert, empirisch illustriert und theoretisch erklärt. In dieser dynamischen Perspektive zeigt sich, dass die Interaktion von Wissen, Macht und Vertrauen für die Entwicklung und Koordination von Wissensnetzwerken eine zentrale Rolle spielt. Zudem wird deutlich, warum Netzwerkinnovationen häufig in Verbindung mit Konfliktereignissen stehen. Die Ergebnisse leisten einen Beitrag zu einem dynamischen Konzept von Netzwerkgovernance.
1. Problemstellung Die Liberalisierung von Netzindustrien stellt eine volkswirtschaftliche Problematik dar, die einerseits eine Vielzahl theoretisch ungelöster Fragen aufwirft und für die andererseits nunmehr auch in Deutschland wirtschaftspolitische Erfahrungen vorliegen. Die Ursachen der ökonomischen Probleme sind dabei nicht nur in bestimmten Branchenbesonderheiten der Netzindustrien zu suchen, sondern auch in einer verfehlten ordnungspolitischen Sonderbehandlung der netzgebundenen Wirtschaftsbereiche in der Vergangenheit. Entgegen den für eine marktwirtschaftliche Ordnung charakteristischen Prinzipien Wettbewerb und Privateigentum wurden Netzindustrien traditionell als wettbewerbliche Ausnahmebereiche behandelt und zumeist in Form öffentlicher Unternehmen geführt. Die Folge dessen waren (staatliche) Monopole, die eine relativ hohe Ineffizienz aufwiesen. Die ordnungspolitische Konsequenz dieses Befundes lautete daher Liberalisierung von Netzindustrien durch Privatisierung und Marktöffnung, d. h. ein Abbau von Marktzutrittsschranken durch Deregulierung. Wettbewerb stößt in Netzindustrien jedoch an Grenzen, weil die zur Produktion netzgebundener Dienstleistungen erforderliche Infrastruktur typischerweise ein nicht-angreifbares, natürliches Monopol darstellt, das sich in der Hand eines im Markt eingesessenen, vertikal integrierten Anbieters befindet. Daraus ergeben sich weitreichende Möglichkeiten zur Diskriminierung von Konkurrenten, die wettbewerbspolitischen Handlungsbedarf nach sich ziehen. Diesen gilt es in der vorliegenden Arbeit zu analysieren und alternative Lösungsansätze der Diskriminierungsproblematik zu diskutieren. 2. Besonderes Forschungsziel Die vorliegende Dissertation widmet sich der Liberalisierung von Netzindustrien aus ökonomischer Sicht, wobei insbesondere die Interdependenzen zwischen der Eigentums- und der Diskriminierungsproblematik berücksichtigt werden. Gleichwohl bildet die wettbewerbliche Öffnung der Märkte für netzgebundene Dienstleistungen aus volkswirtschaftlicher Sicht das Kernproblem und somit auch den zentralen Untersuchungsgegenstand dieser Arbeit. Die theoretische Analyse bleibt dabei nicht auf einen Forschungsansatz beschränkt, sondern es werden mehrere Facetten der Liberalisierung von der Ordnungs- über die Netzökonomik bis hin zur politischen Ökonomie betrachtet. In empirischer Hinsicht haben die in Deutschland in verschiedenen Netzindustrien realisierten Marktöffnungen bislang zu unterschiedlich intensiven Wettbewerbsprozessen geführt. Daher wird ein problemorientierter, intersektoraler Vergleich der Reformen und eine wettbewerbs-politische Beurteilung anhand der drei Marktmerkmale Marktstruktur, Marktverhalten und Marktergebnis vorgenommen, um die Liberalisierung in einzelnen Netzindustrien zu bewerten. Die Telekommunikation gilt dabei als Musterbeispiel für eine erfolgreiche Liberalisierung, weil die Deregulierung hier durch eine sektorspezifische Marktmachtkontrolle begleitet wird, wofür eigens eine Regulierungsbehörde geschaffen wurde. Vor diesem Hintergrund wird der mangelnde Wettbewerb in der Strom- und vor allem in der Gasversorgung sowie im Schienenverkehr häufig auf das Fehlen solcher Institutionen zurückgeführt. Aufgrund dessen werden hier die Eisenbahn, die Telekommunikation im Festnetz und die leitungsgebundene Energieversorgung als empirische Analyseobjekte ausgewählt, um die im Laufe der Untersuchung gewonnenen theoretischen Erkenntnisse exemplarisch an diesen Netzindustrien aufzuzeigen und die im Folgenden formulierte Arbeitshypothese zu überprüfen. 3. Methodik Die Arbeit gliedert sich in einen theoretischen und einen empirischen Teil. Die theoretisch zu untersuchende Frage bei der Liberalisierung von Netzindustrien lautet: Welcher institutionellen Arrangements bedarf es in Netzindustrien, um vormals monopolistisch organisierte in kompetitive Märkte zu überführen und darin nachhaltig einen effektiven Wettbewerb zu etablieren? Auf der Grundlage der erarbeiteten ordnungs- und wettbewerbsökonomischen Erkenntnisse wird nach allgemeingültigen Kriterien gesucht, um daraus einen Bewertungsmaßstab für den intersektoralen Vergleich von Liberalisierungsprozessen in verschiedenen Netzindustrien zu entwickeln. Als Arbeitsthese der empirischen Überprüfung im zweiten Teil dient die aus verschiedenen ökonomischen Blickwinkeln gewonnene und theoretisch zu fundierende Vermutung, dass es zur wirksamen Marktöffnung in Netzindustrien einer materiellen Privatisierung sowie einer effektiven und effizienten Marktmachtkontrolle im Bereich des Zugangs zur Netzinfrastruktur bedarf. Anhand dieser These werden die Liberalisierungsprozesse in den Netzsektoren Schienenverkehr, Telekommunikation sowie Energieversorgung in der Bundesrepublik Deutschland aus volkswirtschaftlicher Sicht beurteilt, und es wird auf verbleibenden ordnungspolitischen Reformbedarf hingewiesen. Die theoretischen Ergebnisse sind indes auch auf ähnliche, hier nicht dargestellte Infrastruktursektoren übertragbar. ; The liberalisation of network based industries represents an economic problem, which raises on the one hand a multiplicity of theoretically unresolved questions and for which exist now on the other hand experiences in economic policy in Germany. The causes of the economic problems are not only to be found thereby in certain industry characteristics of the network based industries, but also in a missed special treatment of the network based economic sectors in the past by the economic policy. However, competition pushes in network based industries at borders, because the infrastructure necessary for the production of network based services typically represents an non-open to attack, natural monopoly in the hand of an established, vertically integrated supplier. From it extensive possibilities for the discrimination of competitors result, the competition political action need draw. It applies to analyze these in the available work and to discuss alternative solutions of the discrimination problem.
Dieser Beitrag fasst die Ergebnisse der 2. OANA-Veranstaltung am 21.01.2015 im Palais Harrach in Wien zusammen. Das "Open Access Network Austria" (OANA) ist eine "joint activity" unter dem organisatorischen Dach des Fonds zur Förderung der wissenschaftlichen Forschung (FWF) und der Österreichischen Universitätenkonferenz (UNIKO) mit dem Ziel Open Access Aktivitäten in der österreichischen Forschungslandschaft zu koordinieren. Nach einer ersten OANA-Informationsveranstaltung im November 2013 wurden fünf Arbeitsgruppen zu folgenden Themen gebildet: Open Access Policy, Finanzierung von Open Access, Rechtliche und politische Rahmenbedingungen, Publikationsmodelle und Einbindung von WissenschafterInnen. Im Rahmen der zweiten Informationsveranstaltung wurden die Ergebnisse bzw. Fortschritte der fünf Arbeitsgruppen präsentiert. Mit der Weiterführung von OANA sollen zukünftig einige der genannten Bereiche vertieft sowie um neue Themenfelder ergänzt werden.
Die nichtmedizinische Primärprävention gilt heute als zentrales Aufgabengebiet der Gesundheitsressorts auf allen Verwaltungsebenen. Zunehmend mehr Programme sollen die Gesundheit der Bevölkerung fördern und es bildet sich ein Netzwerk spezifischer Finanzierungs- und Projektträger. Wachstum und Konsolidierung dieser Strukturen können als die Reifung eines Politikfeldes angesehen werden. Die gegenwärtigen Präventionsprogramme des Staates sind eine Momentaufnahme dieses Prozesses auf der inhaltlichen Ebene. Sie sind ein Konglomerat mehrerer gesundheitswissenschaftlicher Innovationen. Eine Inhaltsanalyse der Dokumente zeigt auf, dass sich einige Empfehlungen der Wissenschaft in der staatlichen Programmformulierung wiederfinden. Es kann angenommen werden, dass sich im Politikfeld Lernprozesse vollziehen. ; Today, non-medical primary prevention is a central part of the responsibility of health departments at all levels of government. An increasing number of programs is promoting the health of the population. The network of specific sponsors and implementing organizations is expanding. The growth and the consolidation of these structures can be viewed as the maturing of a policy subsystem. The current programs of health promotion are a snapshot of the state of this process on the level of content. They are a conglomerate of several scientific innovations in public health. A content analysis of documents shows that some of these recommendations are reflected in the government's policy formulation. This fact speaks for an ongoing process of political learning.
Discourse analysis is gaining attention in transition studies. This paper uses discourse network analysis (DNA) to study how discourse coalitions, and the storylines they mobilize, change over time. Drawing from archival data of two daily newspapers, we analyze the struggle over coal phase-out in Germany (2000–2020). We identify an anti-coal discourse coalition, which was stable and ideationally congruent over time. It used climate change as the dominant storyline to delegitimize coal. The phase-out policy decision in 2020 can be interpreted as the success of this coalition. The pro-coal coalition, in contrast, was more dispersed and less consistent in their arguments. Nonetheless, it was able to institutionalize some of its key storylines in the final policies. We argue that DNA is a powerful tool we can mobilize in sustainability transitions research for the study of politics and beyond.
Im Zuge von Digitalisierung und Politisierung des Urheberrechts ist in jüngerer Zeit ein erhöhtes Aufkommen an Reformen sichtbar, dessen Einordnung der bisherigen Literatur nicht widerspruchsfrei gelingt. Eine breite, sozialwissenschaftliche Debatte über Probleme, Folgen und Erklärungsfaktoren ist jedoch auf ein valides, reliabel und verallgemeinerbares Verständnis von Politik und Wandel in der deutschen Urheberrechtspolitik angewiesen. Zentral sind in diesem Zusammenhang einerseits aktuelle Fragen über die Durchsetzungskrise aufgrund der allgegenwärtigen, digitalisierten Kunst und Kultur sowie die Kopplung mit einer eventuellen Netz- und Digitalpolitik. Andererseits lassen sich mit dem Punctuated-Equilibrium-Modell (PE) langfristiger, regulatorischer Politikwandel sowie Wandeltrends von Governance- und Regulierungsmodi bisher unbeachtete Prozesse untersuchen. In einer deduktiv-induktiven Dokumentenanalyse von 146 Gesetzen, Verordnungen und ihren Novellierungen von 1870 bis 2019 wird der Politikwandel qualitativ und quantitativ untersucht. Besondere Aufmerksamkeit gilt der transparenten Ausführung und bruchlosen Integration von individueller Kodierung und statistischer Auswertung. Entlang des orthodoxen Konzepts der Policy Dimensionen von Hall und dessen Weiterentwicklung von Howlett, wird ein bottom-up-Vorgehen deskriptiver Wandel- und Politikfelderhebung vorgeschlagen, welches Interdependenzbeziehungen bei Zielen, Instrumenten und Implementationsstrukturen sowie Feedbackbeziehungen einbezieht. Die Kalibrierungsebene wird entlang der Indikatoren des Dichte-Intensitäts-Ansatzes (Knill) vorgenommen, während im zentrale Ziel-Instrumenten-Bereich mit Rückgriff auf Salamon ein Doppel-Item aus Zielgruppen und Aktivitäten entwickelt und erhoben wird. Politikwandel wird in den Kategorien des historischen Institutionalismus und mit den Konzepten Stretching, Patching, Thickening und bricolage eingeführt. Mit Bezug zur Governance-Literatur wird der Wandel von Steuerungsmodi sowie die Einbettung in ein Multi-Level-System untersucht. Empirisch lässt sich dadurch Urheberrechtspolitik als Policy mit ausschließlich Layering-Wandelsprozessen aufgrund beständigen Regelwachstums charakterisieren. Dieser Wandel findet meist nicht punktuell wie 1965, sondern in Wandelsperioden in den 1870er, 1900er sowie den 1930er statt. Seit 1990 hat eine beständige Wandelsperiode begonnen, die einer erwarteten Krisendynamik nur mit Qualifizierung entspricht. Relevanter ist jedoch der Restrukturierungsprozess, der sich seit 1965 und verstärkt seit der Jahrtausendwende abzeichnet: Zu den üblicherweise beachteten Urhebern mit ihren vertraglich handel- und gerichtlich durchsetzbaren Verfügungsrechtem treten neue Zielgruppen der Industrien und Nutzergruppen, neuen Vergütungsziele, finanz- und informationsbasierte sowie prozedurale Instrumente und schließlich neue Implementeure, die Verwertungsgesellschaften. Dadurch wandelt sich das Politikfeld von meta- zu einer erzwungene Selbstregulierung einerseits und in seinem Steuerungsmodus von Wettbewerb hin zu Verhandlungen. Damit Messungen von Urheberrecht nicht idiosynkratisch bleiben, müssen Indizes daher bei Implementeuren, Vertragstypen und statt bei der Regelstrenge bei den regulierten Konstellationen ansetzen. Der Policy-Forschung kann die Erweiterung des PE-Modells sowie ein Bottom-Up-Verständnis der Hauptitems von Public Policy als interdependent und vor allem die Zielkategorie als empirische Frage, ob Zielgruppen oder Probleme im Zentrum stehen, zu formulieren, empfohlen werden. ; Since the digitization and politicization of copyright law, an increased number of reforms could not be classified without contradictions. A broad, social-scientific debate about problems, consequences, and explanatory factors, however, depends on a valid, reliable, and generalizable understanding of politics and change in German copyright policy. Central in this context are, on the one hand, current questions about the enforcement crisis due to the omnipresent, digitized art and culture as well as the coupling with a possible network and digital policy. On the other hand, the Punctuated Equilibrium Model (PE) can be used to examine long-term, regulatory policy change and change trends in governance and regulation modes that have previously been ignored. In a deductive-inductive document analysis of 146 laws, ordinances, and their amendments from 1870 to 2019, the political change is examined qualitatively and quantitatively. Particular attention is paid to the transparent execution and seamless integration of individual coding and statistical analysis. Along the orthodox concept of policy dimensions by Hall and its further development by Howlett, a bottom-up approach of descriptive change and policy field survey is proposed, which includes interdependent relationships in goals, instruments, and implementation structures as well as feedback relationships. The calibration level is carried out along the indicators of the density-intensity approach (Knill), while in the central target instrument area with recourse to Salamon, a double item consisting of target groups and activities is developed and recorded. Political change is narrowed down in the categories of historical institutionalism and with the concepts of stretching, patching, thickening and bricolage. With reference to the governance literature, the change of control modes as well as the embedding in a multi-level system is examined. In this way, copyright policy can be empirically characterized as a policy with exclusively layering change processes due to constant rule growth. This change usually does not take place in one go, as in 1965, but rather in periods of change in the 1870s, 1900s and 1930s. A constant period of change has begun since 1990, which corresponds to an expected crisis dynamic only with qualifications. More relevant, however, is the restructuring process that has been emerging since 1965 and increasingly since the turn of the millennia: In addition to the creator who are usually considered with their contractual and legally enforceable exclusive rights, there are new target groups of industries and user groups, new remuneration targets, financial and information-based as well as procedural instruments and finally new implementers, the collecting societies. As a result, the policy field is changing from meta- to forced self-regulation on the one hand and in its control mode from competition to negotiations. So that measurements of copyright law do not remain idiosyncratic, indices must therefore start with implementers, contract types and, instead of the strictness of rules, with the regulated constellations. Policy research can be recommended to expand the PE model, to use a bottom-up, interdependent understanding of the main items of public policy, and especially to reformulate the policy goal item as an empirical question, whether target groups or problems are the focus. ; 2021-09-29
In verschiedenen Politikbereichen wird das Problem des Wandels von Politiknetzwerken bzw. ihrer Resistenz gegen Veränderungen diskutiert. Die rasche Einbeziehung neuer Themen und Akteure ist insbesondere für die Forschungs- und Technologiepolitik von Bedeutung, deren Ziel die rasche Umsetzung wissenschaftlicher Entdeckungen in ökonomisch nutzbare Produkte sein muß. Dieses Papier befaßt sich mit der Reaktion des deutschen Supraleitungspolitiknetzwerkes auf einen Durchbruch in der Supraleitungsforschung, die Entdeckung von Höchtemperaturspupraleitern (HTSL). Es zeigt, wie und warum das etablierte Netzwerk das neue Thema in einer sehr spezifischen Weise aufgriff, wie und warum ein externer Akteur - mit Erfolg - versuchte, in das Netzwerk einzudringen, und wie sich die Struktur und die Politik des Netzwerks veränderte. Die Analyse zielt darauf ab, diese Transformation des gesamten Netzwerkes und die Formulierung des HTSL-Politikprogramms als das Ergebnis der Überlagerung von Akteurstrategien und neuen Möglichkeitsstrukturen zu erklären, die durch wissenschaftlichen und technologischen Wandel entstanden sind. ; The problems of change and inertia in policy networks have been widely discussed in various fields of public policy making. The question of how new issues and actors can be quickly integrated into networks is especially relevant in the case of research and technology policy which must react quickly to scientific discoveries so that firms can translate new knowledge into profitable methods and products. This paper examines how the German superconductivity policy network reacted to a sudden breakthrough in superconductivity research. It shows first why and how the established network included the new issue - ceramic high-Tc superconductors (HTS) - in its agenda in a very specific way. And it shows second, why and how an actor from outside tried to enter the networ~ why he succeeded and how this event shaped the structure and policy of the network. The analysis deals with the transformation of the whole policy network and the formation of an HTS policy programme as a consequence of the intersection of actor strategies and new opportunity structures that were offered by scientific and technological change.
During the nineties of the last century, several formerly monopolistic markets (telecommunication, electricity, gas, and railway) have been deregulated in Germany based on European directives and theoretically inspired by the theory of contestable markets. The original contestable market theory implied three assumptions necessary to be satisfied to establish potential competition: Free market entry, market exit possible without any costs, and the price adjustment lag exceeding the entry is shows that if the incumbent reduces its prices slowly (high adjustment lag) and the market entry can be performed quickly (low entry lag), a new competitor will be able to earn back sunk costs. Therefore it is not necessary that all three conditions are complied with for potential competition to exist. Applying this 'revised' contestable market theory to the deregulated sectors in Germany sections, natural monopolies can be identified in telecommunication local loops and local/regional connection networks, in the national electricity grid and the regional/local electricity distribution networks, in the national and regional/local gas transmission/distribution sections, and in the railroad network only. These sections are not contestable due to sunk costs, high entry lags expected and a probable short price adjustment lag. They are identified as bottlenecks which should be regulated. The function of system operators in energy and railroad are closely related to the non contestable monopolistic networks.
During the past three decades there has been an obvious modernization of gender relations. The intensification of gender politics in many countries as well as in the international political arena has been a key factor for this change. At the same time that public policy that has affected women's lives and opportunities has gained legitimacy in political practice, policy research in the area of women and politics has gained legitimacy as well. Globalization has contributed to this development, especially political globalization. It has opened up new opportunities and options to new political actors such as NGOs in various policy arenas including women's rights, environment, and peace. Women's networks have developed as an increasingly important form of organization for mobilization by gender equality actors within and across national boundaries. Several questions can be asked about these networks. First, how do these networks develop? Second, what are the shared organizational characteristics that facilitate mobilization on gender equality? Finally, what are the possibilities and limitations that these organizational networks have as mechanisms for furthering democracy? This book intends to answer these questions by looking at the case of Japanese women's networks since the 1970s. Gender equality actors in Japan developed a new international orientation and consciousness and accordingly initiated mobilization on various women's issues within and across borders. These actors, who were primarily women and committed to changing the existing gender order, formed networks in the process of mobilization. These networks were based on transnational interaction and communication with actors both inside and outside Japan. The origin of these contemporary Japanese women's networks can be found in Japanese society, but their formation is embedded in the global and regional context of the present era, in which a new form of politics – and thus new gender politics – has developed.
