The protection of health - an expression included in Article 117, paragraph 3, of the Constitution with Constitutional Law no. 3/2001 - has been regulated in our legal system through provisions that, over time, have flanked elements of legal uniformity with others of differentiation, both modulations that can be found in the original constitutional text and in subsequent constitutional and legislative reforms.The territorial repercussions deriving from this system have fuelled a broad debate on the real capacity of health decentralisation to ensure the principles of solidarity and equality and the financial sustainability of the services - issues that weigh on the responsibility of the regional political institutions and that have been repeatedly intertwined with the proposals for a further devolution of competences to the Regions - but they have also offered the opportunity, in the midst of the pandemic emergency, to test the resilience of the models of health organisation and of the form of regional government, putting the relations between the State and the Regions to the test overall. ; La tutela della salute – espressione inserita nell'art. 117, comma 3, Cost. con la l. cost. n. 3/2001 – è stata disciplinata nel nostro ordinamento attraverso disposizioni che nel tempo, ad elementi di uniformità giuridica, ne hanno affiancato altri di differenziazione, modulazioni entrambe rinvenibili nell'originario dettato costituzionale ed in successive riforme costituzionali e legislative.Le ricadute territoriali derivate da tale impianto hanno alimentato un ampio dibattito sulla reale capacità del decentramento sanitario di assicurare i principî di solidarietà e uguaglianza e la sostenibilità finanziaria dei servizî – temi che gravano sulla responsabilità delle istituzioni politiche regionali e che si sono più volte intrecciati con le proposte di ulteriore devoluzione di competenze alle Regioni – ma hanno anche offerto l'occasione, in piena emergenza pandemica, per testare la tenuta dei modelli di organizzazione sanitaria e della forma di governo regionale, mettendo complessivamente alla prova anche i rapporti tra Stato e Regioni.

In Western Europe, at least since the 1960s, the process redefinition of state authority has been occurring, whose manifestation are, inter alia, the ingoing weakening of political parties and the growing importance of international or supranational non-governmental decision makers, such as, at trans-national level, global corporations and powerful international organisations, including the supranational European Union. At a national level, among the most prominet decision makers are interest groups which are replacing political parties as the main intermediate bodies located between individuals and public authorities. Political parties fulfil this role mainly during an electoral campaign. At other times, other entities become representatives of the interests of individuals. The present study is designed to examine, from a legal point of view, selected institutions and methods (i.e. lobbying, public hearings, petitions) used by interest groups in Poland, with particular focus on the recent appliance practice thereof, as well as less known types of interest group such as think thanks and political foundations ; Nell'Europa occidentale fin dai primi anni sessanta del Novecento prende forma il processo di ridefinizione del potere dello stato che si manifesta, tra gli altri, con un continuo indebolimento dei partiti politici insieme alla crescita dell'importanza dei gruppi di tendenza non governativi con caratteristiche soprannazionali e nazionali. A livello sovrannazionale si tratta soprattutto di potenti aziende multinazionali (le corporation) e maggiori organizzazioni internazionali, tra cui la transnazionale per eccellenza l'Unione Europea. Sotto l'influenza della dottrina liberale, prevalente negli stati democratici moderni, la nazione (vista come una comunità etnica fondata sui pilastri sotto forma di grandi gruppi sociali: operai, contadini/agricoltori, la borghesia, proprietari terrieri etc.) è stata sostituita dalla società percepita come un insieme di numerevoli minoranze che stanno alla base di gruppi di interesse e/o pressione autonomi. Questi gruppi si formano e dissolvono parzialmente, frequentemente sovrapponendosi. I loro interessi sono sovente contradditori. Gli individui non sono sempre in grado di individuare i propri interessi nell'appartenere ad un gruppo specifico od ad un altro. La loro composizione viene sottoposta a modifiche continue e dinamiche. Spesso i gruppi rivaleggiano tra loro in una lotta finalizzata ad avere accesso ai vari poteri e/o livelli decisonali. I partiti politici diventano inefficienti nel confronto di una dinamica rapida dei gruppi di interesse. Il ruolo dei cosiddetti "enti intermediari", localizzati tra l'individuo e gli organi del potere, è svolto dai partiti politici principalmente durante la campagna elettorale. Al di fuori di questo periodo il ruolo degli intermediari è acquisito da altri soggetti che riescono in un modo migliore rispetto ai partiti politici a svolgere il ruolo di portavoce degli interessi degli individui. I gruppi di interesse sono diversi dai partiti politici. Essi possono assumere una forma qualsiasi a seconda di vari fattori, come per esempio il tipo di interesse rappresentato, la numerosità del gruppo o il tempo richiesto per conseguire un esito desiderato. Il gruppo ha di solito un carattere temporaneo: esso nasce al fine di conseguire un determinato interesse che congiunge i suoi membri e si scioglie insieme al suo conseguimento, oppure in conseguenza di una sconfitta. La localizzazione fuori dall'area stretta di competizione politica e la mancanza di una dichiarazione obbligatoria su prefenze politiche di un gruppo lo rende immune a cambiamenti politici portati da vittorie e sconfitte elettorali. Un gruppo di interesse non partecipa all'esercizio del potere. Il suo obiettivo principale è invece quello di ottenere risultati concreti congruenti con gli interessi degli individui che ne stanno dietro. Political-institutional responses to the first wave of Covid-19 were more effective in Italy than in other parts of the world. Not so, at least in part, during the second wave. Precisely for this reason, it is urgent to have a greater awareness of the reasons for the success of the collective action to deal with Covid-19 in the first six months of 2020. The essay aims to analyze the "governance" of the first wave, observing four different circuits that had government action as their center: the government-regions circuit; the government-organized interests circuit: the government-experts circuit; the government-media circuit. Given the exceptional nature of the moment, it was not possible to activate the normal parliamentary debate, where, especially in the work of the committees, both territorial and sectoral interests are represented. However, when parliament is inhibited from acting, someone has to assume the responsibility of the decisions, otherwise the latter would be taken without adequate deliberative scrutiny. Cooperative federalism and neo-corporatism seem to have been the two new patterns of decision-making that emerged from this suspension of the parliamentary life. These patterns, which allowed the government action to succeed in the first wave of Covid-19, could nevertheless constitute a possible solution to the evils of our centralism and regionalism. ; Le risposte politico-istituzionali alla prima ondata del Covid-19 sono state in Italia più efficaci rispetto ad altre parti del mondo. Non così, almeno in parte, nella seconda ondata. Proprio per questo è urgente una maggiore consapevolezza delle ragioni del successo nell'azione collettiva di contrasto al Covid-19 nei primi sei mesi del 2020. Il saggio si propone di analizzare il 'metodo di governo' della prima ondata, osservando quattro diversi circuiti che avevano al loro centro l'azione del governo: il circuito governo-regioni; il circuito governo-interessi organizzati: il circuito governo-esperti; il circuito governo-media. Data l'eccezionalità del momento, non era possibile attivare il normale confronto parlamentare, dove, specie nel lavoro delle commissioni, vengono rappresentanti sia gli interessi territoriali sia gli interessi settoriali. Tuttavia quando il parlamento è inibito ad agire, come in situazioni di 'stato di eccezione', qualcuno deve svolgere questo stesso ruolo pena il rischio di decisioni senza adeguato vaglio delibe-rativo. Federalismo cooperativo e neocorporativismo sembrano essere state le due risposte che hanno consentito il successo dell'azione di governo nella fase della sospensione della vita parlamentare. Queste due modalità di decisione, che hanno caratterizzato la gestione della prima ondata del Covid-19, potreb-bero tuttavia costituire una possibile soluzione ai mali del nostro centralismo e del nostro regionalismo.

This chapter examines the conceptual framework boxes and fluxes on "Institutions and governance and other indirect drivers" (Ch. 1, Fig. 1). International and EU governance of relevance for ecosystem services, biodiversity and water is presented. Policy integration, policy coherence, management regimes and stakeholder involvement is reflected upon. The chapter contributes to further understanding of the current and future challenges for sustainable use and conservation of biodiversity and ecosystem services. It provides insights in options for integrating biodiversity and ecosystem services into sustainable development strategies and provides examples of current policy conflicts, along with trade-offs and innovative governance strategies for management of natural resources. Policy-makers need to find ways to handle policy conflicts, improve integration of different stakeholders' perspectives and value dimensions including ILK in policymaking, develop new data collection methods for linking biodiversity and ecosystem services, and develop governance systems that enhance transparency, sustainability and human well-being.

Behovet av forskning om beslutsprocesser rörande investeringar i vägar och banor har uppmärksammats av KFB och Vägverket i slutet av 1990-talet. Denna studie lämnar sitt bidrag genom att redovisa och analysera den beslutsprocess som ledde fram till att ett mitträcke och 2+1 körfält anlades på E4 norr om Gävle. Med hjälp av dokument, pressklipp och intervjuer belyses utvecklingen från Nollvisionens etablering till projektets följder i form av nya mitträcken. Faktorer som problemformulering, sökande efter alternativ och värdering av konsekvenser redovisas. Sättet att organisera processen, externa intressenters inflytande samt deltagarnas roller, aktivitet och attitydutveckling belyses. Processen prövar och realiserar en helt ny utformning av vägar. Kunskapsprocessen står i centrum. Den gäller både undersökning av genomförbarheten, problemet att övertyga skeptiker och vinna acceptans samt upplevelsen av att ha åstadkommit en väsentlig innovation vad avser trafiksäkerhet. Studien lyfter fram både det specifika med detta fall och det allmängiltiga hos planering av vägar och därmed infrastruktur. – Behovet av vidare kunskapsutveckling avseende teoretiskt och empiriskt underlag för kunskap om beslutsprocesser belyses. ; The need for conducting research on decision-making processes as regards investments in roads and lanes has been paid attention to by the Swedish Transport and Communications Research Board (KFB) and the National Swedish Road Administration in the late 1990,s. This study delivers its contribution by accounting for and analysing the decision-making process that resulted in wire railings of central reserves being set up and 2 + 1 lanes being built on the European Highway No. 4 to the north of Gävle. By means of documents, press cuttings and interviews, light is being thrown on the development, from the establishment of the Vision Zero to the consequences of the project in the form of a new type of wire railings. Factors such as formulation of problems, search for options and assessment of consequences are accounted for. Ways and means to organise the process, external interested parties' influence and the participants' roles, activities and attitude development are highlighted. This process submits to testing an entirely new design of roads and puts it into practice. The process of acquiring experiences is in the centre of attraction. It applies to both the feasibility study, including the problem of convincing sceptics and gaining their acceptance, and the experience of achieving a substantial innovation in the road safety area. The study emphasises both the specific aspect of this case and the generally applicable with road planning and accordingly infra structure. The need for further development of know-how as to a theoretic and empiric knowledge bank of decision-making processes is additionally highlighted.

La tesi integra, in una singolo quadro concettuale, i metodi di analisi multicriteri spaziale su GIS con tecniche di crowdsourcing di tipo 2.0, al fine di esplorare nuove forme di partecipazione popolare alle decisioni politiche. Il modello rappresenta un sistema di supporto alle decisioni politiche (DSS) volto ad integrare, in modo appropriato, i punti di vista dei cittadini a livello individuale e nelle loro forme di aggregazione associativa. Lo schema concettuale è applicato al confronto tra il tracciato previsto dalla cd. Variante di raccordo Nord-Est di Pisa del 2011 e il tracciato previsto dal vigente Piano Generale del Traffico Urbano di Pisa del 2002, alla luce dei criteri paesaggio, accessibilità e sostenibilità. Il valore aggiunto della ricerca è dato dall'integrazione dell'analisi multicriteri spaziale su GIS con le tecniche di crowdsourcing per la determinazione dei pesi e la raccolta delle informazioni. The thesis integrates, in a single framework, a GIS based methodology for spatial multi-criteria decision analysis (MCDA) and crowdsourcing tools, based on the web 2.0, in a view to explore new forms of public participation in political decision-making. The model represents a decision support system (DSS), based on the opinions of individual citizens and associations. The conceptual framework is applied to the comparison between the Variant to the North-East ring road of Pisa, and the path traced by the current PGTU of Pisa, according to landscape, accessibility and sustainability criteria. The added value of the research is represented by the integration of spatial MCDA and crowdsourcing techniques for the determination of weights and for the collection of information.

In 1974, Sweden adopted a new Constitution. In Contrast to the previous one from 1809, which was based on ideas of separations-of-powers and which literally defined the monarch as a powerful political actor, the new constitution placed the parliament (The Riksdag) at the center of political decision making and removed the king from political power. At the time, this removed a huge discrepancy between the letter of the constitution and the "living constitution" which placed emphasis on parliamentary sovereignty of the Westminster type. Hut 35 years later, ideas of separation-of-powers and the necessity of control of suspicious politicians have grown stronger. The aim of the present study is to describe and analyze the attitude of local government officials to traffic safety and to their roles in the decisions being made with regard to traffic safety measures. The purpose is also to give an overall picture of the decision-making processes in connection with specific traffic safety measures in two municipal authorities. The study has been divided into two parts. The first part was an interview study in which twenty local government officials in eleven municipal authorities were subject to in-depth interviews. The second part consists of case studies of the planning and decision-making processes with regard to traffic safety matters in two municipal authorities, where the source material in each case consists of written documentation.

What defines a Swedish university college? This is the overarching question in this archival study of the development of the Swedish university colleges during the past 35 years. The objective of the study is to explore the binary elements in the overall unitary Swedish university system. Departing from existing macro level research on the university colleges (UCs), this study focuses on one single UC. Development of the UC was conceptualized as a question of decision-making in the UC in interplay with political decisions. The UC was explored by taking an extensive inductive approach starting from the original Garbage Can Model of Organizational Choice, a perspective on organizations that focuses on the temporal order emerging from decisions, rather than enduring orders. Nine decisions situations in the UC were identified as well as four political reforms. The study shows that the concept "streams" from the model are the phenomena occupying organization members mind over time, thus constituting a recurring element although not an enduring order, tying together the temporal orders. The streams are shared between the UC and political decision-making; the two decision-making entities both take part in forming the streams over time. The streams are: (1) the academic discipline; (2) the vocational education; (3) research as a means to enhance the quality of education; and (4) regional relevance. The study proposes the emergence of a fifth stream, the research profile, which is taken to be a unique stream for the UCs in general, that differentiates them from the universities. The analysis shows that the UC continuously adjusts the law to the organizational conditions rather than implements legislation when new, hence offering a perspective on organizational change as a persistent condition inherent in the organizational body rather than definable events. By using the concept stream the study suggests a conceptualization of the political influence on the UC organizational body as well as a conceptualization of how the UC influence political decisions. This conceptualization provides a novel perspective on the relationship between state and the universities. A perspective that can be explored in future research, focusing on mutual adjustments of the streams.
