The internal selection of candidates is one of the most important routines of the political parties; contrary to the international literature, in Colombia, the internal life of these organizations is studied very little. The selection instrument is intimately related with the nature of the party and it will have a direct incidence with the discipline of the party members facing the party's leadership. It is for this reason that the classification set out by the text for the study of the selection processes is determined by the level of concentration of this decision and it is found at the highest level of centralization: when this decision is concentrated in only one person or on a very reduced group of people; and the highest level of decentralization where the party subjects its decision to consultations and allows for the partici pation of all the electoral census citizens. ; La selección interna de candidatos es una de las rutinas más importantes de los partidos políticos. Al contrario de la literatura internacional, en Colombia, la vida interna de estas organizaciones es muy poco estudiada. El instrumento de selección está íntimamente relacionado con la naturaleza del partido y tiene incidencia directa en la disci plina de sus miembros frente a las cúpulas del partido. The heart of this reflection is the affirmation that "the existence and participation of social movements of which identity goes beyond of particular demands (unions, ecologists, pacifists, of generation or genre), guarantee the advance of strategic demands, in other words, guarantee the construction of a new society, in or out of the government. Crowdfunding is presented as a new private financial resource for parties of political parties by which citizens can participate economically in the structure of these organizations. This paper will set out some legal proposals that seek to adequately incorporate this new resource. First, we will approach the crowdfunding analysis in order to make it easier for the reader to understand this phenomenon. Secondly, it will analyze the current implementation of this tool by political parties at national and international level, pointing out some of the positive and negative aspects that can be derived from the use of this new resource. All this, with the main objective of analyzing the viability of crowdfunding in our current system of financing political parties. This is the main objective that will lead us irremediably to propose the legal reserve that we consider appropriate for this instrument in our legal system. Finally, a constitutional analysis of this new source of private financing will be carried out. Source that we have already advance, today it is prohibited by Article 4.2 (h) of the Law on Financing Political Parties, and this prohibition may entail the unconstitutionality of this precept. En este artículo se expondrán algunas propuestas legales que traten de incorporar adecuadamente este nuevo recurso. Para ello, primeramente, realizaremos un acercamiento al análisis del crowdfunding con el objetivo de facilitar al lector el entendimiento de este fenómeno. En segundo lugar, se analizará la actual puesta en práctica de esta herramienta por parte de los partidos políticos a escala nacional e internacional, señalando algunos de los aspectos positivos y negativos que se pueden derivar del uso de este nuevo recurso. Todo ello, con el objetivo principal de analizar la viabilidad del crowdfunding en nuestro actual sistema de financiación de partidos políticos. Objetivo principal que nos llevará irremediablemente a proponer el encaje legal que consideramos adecuado de este instrumento en nuestro ordenamiento jurídico. Finalmente, se realizará un análisis constitucional de esta nueva fuente de financiación privada. Fuente que ya adelantamos, a día de hoy se encuentra prohibida de facto por el Art 4.2 h) de la Ley Orgánica de Financiación de Partidos Políticos, pudiendo comportar tal prohibición la inconstitucionalidad del mencionado precepto.
ABSTRACT This study departs from the problem of financial assistance policy to political parties in the province of West Java according to the theory of Grindle et al. While the Policy Context consists of the power, interests, and strategies of the actors, compliance, and response of implementers, institutions, and characteristics of the regime that are still not running optimally. The program and policy (content) and policy context are important factors in determining the success or failure of the Implementation of the Use of Financial Aid for DPD PDIP Political Parties and DPD Gerindra Party in West Java Province. RESUMEN Este estudio parte del problema de la política de asistencia financiera a los partidos políticos en la provincia de Java Occidental según la teoría de Grindle et al. Si bien el Contexto de Política consiste en el poder, los intereses y las estrategias de los actores, el cumplimiento y la respuesta de los implementadores, las instituciones y las características del régimen que aún no están funcionando de manera óptima. el programa y la política (contenido) y el contexto de la política son factores importantes para determinar el éxito o el fracaso de la implementación del uso de ayuda financiera para los partidos políticos DPD PDIP y el partido DPD Gerindra en la provincia de Java Occidental.
The Mexican Chamber of Deputies is composed of 500 representatives: 300 of them elected by relative majority and another 200 ones elected through proportional representation in five electoral clusters (constituencies) with 40 representatives each. In this mixed-member electoral system, the seats distribution of proportional representation is not independent of the election by relative majority, as it attempts to correct representation imbalances produced in single-member districts. This two-fold structure has been maintained in the successive electoral reforms carried out along the last three decades (eight from 1986 to 2014). In all of them, the election process of 200 seats becomes complex: Formulas in the Law are difficult to understand and to be interpreted. This paper analyzes the Mexican electoral system after the electoral reform of 2014, which was applied for the first time in 2015. The research focuses on contradictions and issues of applicability, in particular situations where seats allocation is affected by ambiguity in the law and where asymmetrical treatment of political parties arises. Due to these facts, a proposal of electoral reform will be presented. It is intended to be simpler, clearer, and more enduring than the current system. Furthermore, this model is more suitable for producing electoral outcomes free of contradictions and paradoxes. This approach would allow a fair treatment of political parties and as a result an improved opportunity to exercise democracy.
This research paper analyzes the historical development of political parties in Colombia andit reflects on the roles they have played over the years in the Colombian State. This studyis undertaken in order to understand the obstacles and deficiencies that these organizationshave to date. For this purpose, a qualitative research methodology was used. It aimed atdescribing historical events that have been relevant to the development of political parties, asa group of people who seek to influence or be holders of political power in the Colombianstate. The research results indicate a repeated lack of compliance with the political and legalprinciples that are required for the effectiveness of a participatory democracy as, theoretically,the Colombian State is. ; El presente artículo de investigación pretende analizar el desarrollo histórico de los partidos políticos en Colombia y reflexionar sobre los papeles que han jugado con el devenir de los años en el Estado colombiano. Lo anterior con la finalidad de comprender los obstáculos y las deficiencias que las citadas organizaciones presentan a la fecha. Para el efecto, la metodología de investigación empleada ha sido la cualitativa en el marco de la descripción de los sucesos históricos de relevancia para el desarrollo de los partidos políticos como agrupación de personas que pretenden influir o ser titulares del poder político en el Estado colombiano. Los resultados de la investigación indican una reiterada ausencia del cumplimiento de los presupuestos de orden político y jurídico necesarios para la efectividad de una democracia de carácter participativo como lo es, teóricamente, la del Estado colombiano.
Resumen: Aunque sujeta a cambios relativamente frecuentes, alguno muy reciente, la legislación sobre financiación de partidos políticos sigue en España un modelo claramente asentado en las contribuciones públicas, que reciben los partidos en función de varios conceptos y por parte de diversas instituciones, hasta el punto de convertirse en su principal fuente de recursos, sin que, más allá del ámbito electoral, sus gastos sean objeto de límites o incluso de prohibiciones. Sin que quepa imputar este hecho a unas previsiones legales que han tendido a hacerse cada vez más restrictivas, la financiación que reciben por otras vías es mucho menor, tanto en forma de donaciones (legales) como por las cuotas o aportaciones de sus miembros, en un desequilibrio que tiene importantes consecuencias para definir su posición en el sistema político. Se cierra ese modelo con un sistema de control que reposa básicamente en la atribución al Tribunal de Cuentas de la fiscalización de la contabilidad anual y electoral de los partidos, sin que hasta las últimas reformas se haya prestado especial atención a la necesaria transparencia e incluso a la correcta articulación de las sanciones por la infracción de las normas en la materia. Abstract: Although subjected to relatively frequent changes, some very recent, legislation on political parties funding, follow in Spain a model clearly based on public contributions, based on several concepts and from various institutions, to the extent of becoming their main source of income, without their expenses being subjected to limits or prohibitions, beyond the electoral arena. Not being possible to attribute this fact to current legal provisions, which have tended to be increasingly more restrictive, the funding received from other sources is much lower, both in the form of (legal) grants, or from member fees and contributions, creating an imbalance that has important consequences on the definition of their position in the political arena. El presente artículo tiene como principal objetivo realizar un análisis de contenido de las propuestas electorales de carácter rural de los principales partidos que concurrieron a las elecciones legislativas de 2019. Para ello, hemos utilizado el análisis de contenido y el software CAQDAS. Esta herramienta nos ha permitido clasificar las medidas en materialistas/postmaterialistas y productivistas/postproductivistas y determinar los principales términos utilizados. Entre las principales conclusiones del estudio podemos destacar que todos los partidos políticos incluyeron medidas desarrollistas y que la principal diferenciación se produjo entre bloques. The main objective of this article is do a content analysis of the measures aimed at the rural sphere. In order to carry out it we have studied the electoral programs of the main political parties that attended the 2019 legislative elections. We have used the content analysis through a CAQDAS software. This tool has allowed us to classify the measures according to whether they were materialist/postmaterialist and productivist / postproductivist, as well as to determine the main terms used. Among the main ones of the study we can highlight that all the political parties included developmental measures and that the main differentiation occurred between blocks.

This article focuses on the relation between political parties and the state in the Netherlands; a polity where the main actors in the political scene are not even mentioned in the Constitution, and where there is not a specific party act. The authors describe the origins and development of political parties in the Netherlands, and the question of its regulation, together with a general and comparative glimpse to other European democracies. The thesis is that legal regulation took a different route via international law — the ECHR and the CEDAW —, applied by the national courts. ; Este artículo analiza la relación entre los partidos políticos y el Estado en Holanda; un país en el que los principales actores de la vida pública no están regulados por una ley específica, ni se mencionan en la Constitución. Los autores exponen los orígenes y el desarrollo de los partidos políticos en Holanda, y examinan el problema de su regulación, en el marco de una visión comparada con otros sistemas democráticos europeos. The decisions of the Constitutional Court have gradually defined the regimen of the political parties, especially in the last fifteen years. Several areas have been covered by the Court in this matter; however, the approval of the Organic Law 6/2002, on political parties (LPP), and the Organic Law 3/2007, for the effective equality between women and men (LEWM), have led to various decisions considered essential, not only for the regime of the parties, but also for the history of the Constitutional Court. The complexity of the matters addressed and its ideological connotation caused some division within the Court, resulting in a good amount of dissenting opinions, some of which containing strong criticisms against the decisions. It is not surprising either that this complexity and ideological implications stimulate the academic interest, which has been lavished on studies about this constitutional case law. of the Constitutional Court decisions concerning political parties in the last fifteen years and, in turn, assesses the essential lines marked by the Court and the convergent or divergent reactions of the academia. ; La jurisprudencia constitucional en materia de partidos políticos ha sido vital para la construcción del Estado democrático español, contribuyendo de manera decisiva a su configuración actual. Las Sentencias del Tribunal Constitucional (TC) han ido progresivamente delimitando el Derecho de partidos y lo han hecho muy especialmente en los últimos quince años. Han sido diversos los ámbitos tratados por el Tribunal en esta materia; no obstante, la aprobación de la Ley Orgánica 6/2002, de partidos políticos, y de la Ley Orgánica 3/2007, para la igualdad efectiva de mujeres y hombres, han propiciado diversos pronunciamientos considerados claves, no sólo desde el punto de vista del régimen jurídico de los partidos, sino también en el contexto de la historia de la corte constitucional.
