Dottorato di ricerca in Memoria e materia delle opere d'arte attraverso i processi di produzione, storicizzazione, conservazione, musealizzazione ; Il lavoro di ricerca è rivolto al fenomeno del 'ritorno al mestiere', nell'intento di precisarne i contorni all'interno del più ampio orizzonte culturale del Ritorno all'Ordine, di cui costituisce uno dei principali cardini ideologici. Partendo dall'articolata riflessione condotta da Giorgio de Chirico nell'omonimo saggio Il ritorno al mestiere nel 1919, che ha il suo coronamento nel Piccolo trattato di tecnica pittorica del 1928, viene innanzitutto analizzata la fortuna della tecnica a tempera nei primi anni Venti, delineando un excursus che la vede passare dalla pittura da cavalletto alla pittura murale all'inizio degli anni Trenta. Contemporaneamente viene indagato lo sviluppo dell'interesse per l'antica tecnica dell'encausto, connesso all'enfasi generata dalla ripresa degli scavi nei siti archeologici di Pompei ed Ercolano, che dà luogo tra la fine degli anni Venti e i primi anni Trenta a un dibattito dalla doppia valenza teorica e pratica. In quest'ambito l'indagine si concentra sulla ricerca e la sperimentazione operate in particolare da Ferruccio Ferrazzi e Corrado Cagli. In un confronto che coinvolge le fonti scritte, le testimonianze orali e le indagini correlate ai restauri delle opere di alcune figure-chiave del periodo tra le due guerre mondiali, si ripercorre perciò lo sviluppo del recupero 'novecentesco' di queste tecniche del passato, rivelandone gli approcci talora fantasiosi e poco filologici, nelle loro interconnessioni con il dibattito artistico del periodo e con la politica culturale del regime fascista che si va affermando. Un'analisi da cui affiora un approccio 'etico' nei primi anni Venti, che accomuna il recupero dechirichiano della 'tempera grassa' a quello operato da altre figure di artisti (Felice Casorati, Carlo Levi, Gianfilippo Usellini, Alberto Savinio, Corrado Cagli, Afro Basaldella) fino all'aprirsi degli anni Trenta, poiché inteso come recupero della purezza dell'arte dei 'primitivi' in tutti i suoi aspetti (cioè non solo stilistico-formale ma anche tecnico-esecutivo), in un clima di superamento delle avanguardie storiche e di 'ricostruzione' dei valori dell'arte. Si mette dunque a fuoco come il 'ritorno al mestiere'] pervenga successivamente ad un approccio più ideologico, soprattutto a partire dai primi anni Trenta con il dibattito sulla 'rinascita della pittura murale', che coinvolge sia l'uso della tempera (intesa come 'tecnica italiana' da Savinio) che dell'encausto, da molti ritenuta erroneamente la tecnica della pittura pompeiana, quest'ultima anche in connessione con il recupero dell'idea di romanità operato dalla cultura di regime. ; This study examines the "Return to Craft" phenomenon within the wider cultural horizon of the Return to Order of which it represents one of the principal ideological aspects. The success tempera enjoyed at the beginning of the 1920s is analysed through an initial consideration of Giorgio de Chirico's extensive reflection on the subject in his 1919 essay by the same name, Il ritorno al mestiere (Return to Craft), a theme he developed definitively in his Piccolo trattato di tecnica pittorica (Small treatise on painting technique) in 1928. Additionally, the subsequent transfer of tempera from easel to mural painting, which occurred at the end of the 1920s and the start of the 1930s, is taken into consideration. The growing interest for the ancient painting technique of encaustic, inspired by the recommencement of excavations in Pompei and Ercolano, is also investigated, as well as how this interest gave way to a debate on the subject which dealt with both theory and practical aspects at the end of the 1920s and beginning of the 1930s. In this perspective particular attention is afforded to Corrado Cagli and Ferruccio Ferrazzi's research and experimentation. The material examined in this study includes written sources, oral testimony and research correlated to the restoration of artworks of a number of key figures from the period between the two World Wars. The study reveals a rather inventive and unphilological approach within the early Twentieth Century's recuperation of these ancient techniques in relation to the artistic debate going on at the time and to the increasingly dominant Fascist political cultural policy. At the start of the 1920s, an approach that can be defined as "ethical" is common to both Giorgio de Chirico's recovery of oil tempera emulsion and that of other artists (Felice Casorati, Carlo Levi, Gianfilippo Usellini, Alberto Savinio, Corrado Cagli, Afro Basaldella), insomuch as it was intended as a revival of the purity found in Italian Primitive Art. This recuperation continued until the start of the 1930s and comprehended not only stylistic and formal elements but also technical and operative aspects, in a cultural climate where the historic avant-garde was being surpassed and Art's values "rebuild". Focus is put onto how the "Return to Craft" succeeded an initially ideological approach, especially at the beginning of the 1930s with the debate regarding the "resurgence of mural painting" which involved both the use of tempera (which Savinio called "Italian technique") and encaustic painting, which many erroneously believed to be the technique used for the Pompeian wall paintings. The recuperation of encaustic painting is also examined in relation to the recovery of Roman ideals undertaken by the cultural regime.
Il presente lavoro riflette in prospettiva sociologica,sulla riscoperta degli aspetti etici del consumo. I cosiddetti consumi critici, sostenibili e responsabili, che presuppongono un agire sociale dotato di senso, rappresentano una pratica di acquisto tesa al ben-vivere. Il consumo da vicario della produzione -qual' è stato per un lungo periodo- è diventato uno dei principali, se non il principale, punto di snodo della società in cui ci muoviamo. I consum-attori postmoderni, tecnicamente più preparati e in grado di esprimere richieste al mondo della produzione e della distribuzione, sono consapevoli che l'atto di acquisto è diventato uno strumento per esprimere impegno e responsabilità nella sfera pubblica. Tale pratica contribuisce all'affermazione e alla determinazione di nuovi modi di essere e di agire dove confluiscono nuovi valori simbolici legati all'emergere di nuove abitudini di spesa. Partendo da tale ipotesi, la parte empirica del lavoro affronta un'analisi qualitativa prendendo in esame lo sviluppo del farmer's market, il mercato degli agricoltori, forma ed espressione della filiera corta. Si osserva un caso di studio nella Regione Molise allo scopo di comprendere cosa si cela dietro l'atto di acquisto e perché si predilige un atteggiamento alternativo al sistema della grande distribuzione. Il farmer's market è un luogo di convivialità dove è possibile fermarsi, parlare, consumare qualcosa in compagnia. E' un'occasione in cui vengono accorciate le distanze fisiche, economiche e soprattutto sociali, in cui diventa sempre più lontana l'idea della spesa intesa come atto funzionale ed alienante tipico dell'homo consumericus. Concezioni, abitudini e atteggiamenti che propongono il passaggio da un modello di consumi in cui l'elemento fondante è rappresentato dal benessere soggettivo -componente primario della felicità personale anche dal punto di vista identitario ed espressivo - ad un modello in cui i consumi restano fondamentali, ma come ingredienti di una migliore qualità del vivere. La prima parte del lavoro a valenza introduttiva, ripercorre con un excursus sulla letteratura, le teorie dei classici e dei contemporanei del pensiero sociologico, tentando di fornire una definizione di consumatore postmoderno. A questa, seguono i temi della sostenibilità ambientale e responsabilità sociale che mirano ad opporsi alle logiche proprie dello spreco-consumo, radici della crisi ambientale, del degrado e del rischio globale. La questione ecologica diventa, economica e politica, e ancor più una questione sociale, frutto di una nuova logica organizzativa in materia di consumo. La seconda parte affronta la ricerca sul campo riportando tra gli altri, i dati sulle motivazioni alla base di tale pratica di consumo e successivamente esplorando il ruolo del produttore/venditore attraverso l'attribuzione di credibilità che gli viene conferita. Il concetto di comunità, ambito tutt'oggi aperto nel dibattito sociologico, conclude il percorso di ricerca ponendo attenzione alla riscoperta del localismo. ; This thesis focuses on the rediscovery of the ethical aspects of consumption. Principal consumption that is both sustainable and responsible presupposes what Weber termed a rational social action and represents an aspiration to live well. Vicarious consumption - which has existed for a long time – has become one of the principal if not the principal turning point in the society in which we live. Post-modern consumers, technically more prepared and able to express their wishes to the world of production and distribution, are aware that shopping has become an instrument with which to express commitment and responsibility in the public domain. Shopping has contributed to the affirmation and the determination of new ways of being and behaving, which converge with the new symbolic values tied to the emergence of new shopping habits. Using this hypothesis as a starting point, the empirical part of this thesis engages with a qualitative analysis of the development of the farmers' market, the embodiment of a short distribution chain. It examines a case study in the region of Molise, with the aim of understanding what is concealed behind the act of shopping and why there is now a preference for an alternative way of thinking that goes against the model of mass production. The farmers' market is a place of conviviality, where it is possible to stop, talk and consume something in company. It is an occasion in which physical, economic and above all social distances are diminished, where the idea of food shopping as merely an essential and alienating act, typical of the homo consumericus, is remote. Conceptions, habits and attitudes now promote a move away from a model of consumption founded on the principle of subjective well-being – a primary component of personal happiness, even when seen from the point of view of identity and expression – to a model in which consumers remain fundamental, but are now the main players in the quest for a better quality of life. The first part of the thesis, as an introduction, reviews the literature and discusses both classic and contemporary sociological theory, with the aim of producing a definition of the post-modern consumer. This is followed by a discussion of environmental sustainability and social responsibility, two concepts that are set in opposition to the logics of wasteful consumption, something that can be seen at the heart of the global environmental crisis. The ecological debate has become not only economic and political but social; the fruit of a new organisational logic in the field of consumption. The second part of the thesis deals with the field work, presenting amongst other things, data concerning the motivation at the heart of this new model of consumption. This is followed by a detailed exploration of the role of the producer/seller by focusing on the attribution of credibility which has been conferred upon them. A discussion of the concept of community, a concept still wide open in sociological debate, with a particular emphasis on the rediscovery of localism, concludes this research. ; Dottorato di ricerca in Sociologia e Ricerca Sociale (XXIV ciclo)
Mediante l'inserimento, all'interno della fattispecie di infedeltà patrimoniale, della previsione normativa dei vantaggi compensativi la tematica dei gruppi di società ha ricevuto una dignità espressa anche nel settore del diritto penale dell'economia. La scelta di politica legislativa, che si inserisce più genericamente nell'obiettivo politico criminale del legislatore novellante di costruire un diritto penale societario minimo, permeato dal necessario rispetto dei canoni di concreta offensività, è stata salutata con favore dalla letteratura penalistica la quale, all'indomani della novella, ha rinnovato l'interesse per il tema. La disciplina dei gruppi, infatti, oltre a rivestire primario interesse per la sua notevole applicazione, costituisce anche un importante banco di prova per verificare la coerenza delle soluzioni legislative rispetto al piano del dover essere della legislazione penale; per verificare, cioè, in un ottica di stampo teleologico, la conformità della disciplina settoriale, rispetto ad un sistema assiologicamente orientato. Sotto tale profilo, il rapporto tra la disciplina civile dei gruppi e quella penale, consente di evidenziare come la normativa penale sia effettivamente conforme al volto di un sistema penale orientato dai valori di sussidiarietà ed extrema ratio, in quanto la portata empirica della fattispecie penale risulta arretrata rispetto ai presidi risarcitori di ordine civilistico: la attribuita rilevanza ai vantaggi fondatamente prevedibili, ai fini della esclusione della responsabilità penale, e la loro irrilevanza, per converso, ai fini della esclusione della responsabilità civile, fa sì che nella tutela del patrimonio sociale la fattispecie di diritto penale societario occupi uno spazio solamente residuale. Se tali sono i profili di pregio della disciplina penale dei gruppi di società, non pochi sono, tuttavia, gli spunti critici che lascia aperti all'interprete. Sul piano della bontà delle scelte legislative, residuano margini di dubbio sull'opportunità di una scelta di carattere settoriale, che pone il rischio di limitarne la portata applicativa alla sola fattispecie di infedeltà patrimoniale, unica per la quale risulta espressamente prevista; creando, così, non poche distonie applicative nell'ambito dello stesso sottosettore del diritto penale dell'economia. Di non poco rilievo appaiono, poi, le censure da muovere alla 'disciplina penale dei gruppi' sul piano della determinatezza della fattispecie penale dovute al mancato coordinamento della riforma dei reati societari con quella del diritto societario. Mentre il legislatore societario è stato capace di creare una disciplina armonica e idonea a perseguire gli obiettivi di tutela, occupandosi dei gruppi tanto nella patologia, quanto nella fisiologia, l'approccio del legislatore penale è stato ben più approssimativo e minimalista: sul versante penale societario, infatti, all'abuso di direzione unitaria non si è collegata una ipotesi di responsabilità né degli organi amministrativi della holding, né della controllante con il d.lgs. 231/2001. Di qui la necessità di provare a recuperare la responsabilità penale del vero centro decisionale (gli organi della holding), attraverso l'applicazione delle clausole generali di estensione della tipicità di cui agli artt. 110 e 113 c.p., tanto per la responsabilità concorsuale delle persone fisiche, quanto per quella amministrativa da reato delle persone giuridiche. ; By inserting, in the case of infidelity sheet, the legislative provision of compensatory benefits to the thematic groups of companies has received a dignity expressed also in the field of economic criminal law. The legislative policy choice, which is part of more general political objective of the criminal reform legislature to build a corporate criminal law at least, permeated by the need to respect the canons of concrete offensiveness, was welcomed by the criminal law literature which, at day after the news, has renewed interest in the topic. The discipline of the groups, in addition to covering the primary interest for its remarkable application, is also an important test to verify the consistency of legislative solutions to the plane having to be the criminal law, to verify, in an optical teleological mold, compliance with the legislation, and compared to a value-free system oriented. In this respect, the relationship between the discipline of civil groups and the penal, it highlights how the criminal law is actually conforms to the face of a criminal justice system-oriented values of proportionality and last resort, because the scope of the empirical case is criminal back with respect to a compensation order statutory safeguards: the importance attributed to the benefits legitimately expected, for the purposes of exemption from criminal liability, and their irrelevance, conversely, for the purposes of the exclusion of liability, means that the protection of the assets case of corporate criminal law occupy a space only residual. If these profiles are the valuable discipline of criminal groups of companies, many are, however, the critical insights that leaves open the interpreter. In terms of the goodness of legislative choices, remaining margin of doubt regarding the appropriateness of the choice of a sectoral nature, which poses the risk of limiting the scope of application to the single case of infidelity sheet, only one for which is expressly provided, creating, thus, not a few dystonias application within the same sub-sector of economic criminal law. Of no little importance appear, then, the complaints to be moved to the 'rules of criminal groups' in terms of determination of the criminal case due to lack of coordination of the reform of corporate crimes with that of corporate law. While the legislature company was able to create a harmonious and appropriate discipline to pursue the objectives of protection, taking care of both groups in pathology, as in physiology, the approach of the criminal legislature was much more rough and minimalist: on the side of corporate criminal, in fact, the abuse of centralized management is not connected to a theory of liability or administrative bodies of the holding company or parent of the Leg. 231/2001. Hence the need to try to retrieve the criminal liability of the real center of decision (the organs of the holding company), through the application of the general conditions of the typicality of the extension of articles 110 and 113 c.p., the responsibility for the insolvency of individuals, and for the administrative offenses by legal persons. ; Dottorato di ricerca in Diritto ed economia: interessi rilevanti e tutele (XXIV ciclo)
The Human Rights topic is increasing its relevance in the field of legal studies and in the agenda of inter/transnational actors. The Sociology of Law is deeply engaged in this dialogue, but some of its contributions seem to share a common lack of concern about the dimensions of cultural legitimacy and politics of imagination. Refusing the "simplistic" vision of «legal transplants», the approach in term of regionalization and the genealogical theories (i.e. the so called generations of human rights), the thesis aims to outline a multidisciplinary frame, trying to merge the anthropological and the socio-legal knowledge to shed light on the «anthropologies of human rights». The use of the plural suggests several orders of realities: firstly, it reflects the high fragmentation which characterizes the epistemological and methodological debate of contemporary anthropology, as a disciplinary field. An "internal" multiplication of points of view which becomes even more striking in its interactions whit the HR subject and its own kind of internal dissemination. Secondly (and consequently), it enlightens that the "pluralisation" of human rights discourse could be better understood as a proliferation of world-visions and axiologies. In this second meaning, the summoned «anthropologies» have to be intended in term of theories on human beings, on social reality and social order, shaped by cultural assumptions, taken-for-granted and (shared) symbolical repertoires. Deeply merged within every manifestation of the «humanitarian transnational narration», these world-versions need to be studied as sources of influence and inspiration for legal claims, texts and declarations that build the corpus of international humanitarian law. Lastly, this plurality which stems from the relationship between the macro-narrative of the International Bill of Human Rights and its situated appropriations points out the potentiality of a cultural analysis of the social life of (human) rights in avoiding the dichotomist models (universalism versus relativism, global versus local and so on) in favor of a representation in term of narrative encounters between different conceptions of human dignity, human beings, normative orders and social realities. To grasp this mutual and multilayered overlapping, the first part of the thesis builds an analytical framework destined to be applied, in the second part, to the specific context of the «African system of human rights». This choice was dictated by the peculiarities which seem to distinguish it from others regional systems: amongst these features, the African Charter on Human and Peoples' Rights deserves a special place, considered its aspects of relevant innovation and creativity as well its signs of criticism and its lack of real efficacy. In the first chapter we start from the general liaison between Law and Culture, looking for a «relational paradigm» which rejects determinist or reductionist presentations of this organic link. Adopting a pluralist point of view (centered on the idea of «normative pluralism» preferred to the classical one in term of «legal pluralism»), we borrow some insights from early anthropological researches on «primitive law» and on the co-existence of plural normative orders in colonial settings. The second chapter deals with the concept of «legal culture», trying to discuss a cardinal notion of sociology of law that often pretend to exhaustively grasp the complexity of law/culture nexus. We explore the richness and the pitfalls of influent theorizations about this topic, sorting out three dimensions which seem to require a deeper engagement: the power, the (construction of the) collective identities and the pluralism. In strict dialogue with the studies on «legal consciousness» and «legal socialization», we move towards a textual description of culture. The third chapter sketches a theory of culture in term of cognitive and normative interface between men and the meaningful world they try to create (and to live in). Borrowing from Clifford Geertz the fundamental ideas about the «social traffic of meanings», the textual dimension of cultures and the law as a way of world-making – or better, of imaging the reality –, we keep developing our model in a more comprehensive perspective which dismisses the "literary" constraints entrenched in the idea of «text». The forth chapter deals with some assumptions of the so-called «narrative paradigm», trying to "dissolve" the persisting rigidities of the textual frame into a larger and (more) universal human ability: the narrative competence. We examine the coalescence between narrative attitude and normative attitude, stressing the similarities and the constitutive power of both of them. Starting from narration as a meta-model for the social construction of reality, we move towards the specificities of «legal narration» as expression of the legal construction of social reality. This narrative standpoint can be synthesized as follow: the human skill to produce, to understand and to manipulate tales (and other sources of narrative production) is the key that ensures the transmission and the socializations of cultural meanings, representations and symbols. Trough the narrativization of culture it becomes easier to conceive the narrativization of legal cultures as shared, contested, polyphonic repertories of legal and social ideas. In the fifth chapter we start applying our theoretical framework to the human rights topic. We begin with a preliminary set of issues regrouped under the label of «spatial problematic». It underlines the paradox of the Universalist project, with its claims of cultural independence and planetary applicability on the one hand, and the need of cultural resonance and local relevance on the other. We explore critical contributions about the «globalization talk», which stress some traps of this overriding way of representing social and socio-legal phenomena in the contemporary world. Aiming to reject monodimensional explanations, we merge the «rhetoric of flaws» with the sensibility for «friction events» generated by and trough the encounters between transnational narratives and specific local (and cultural) settings. The concept of «vernacularization» helps us to conceive these interactions/intersections between global flows and punctual frictions. The sixth chapter introduces the main elements of the African context, starting from a sketched portrait of what we define its «radical normative pluralism». In order to cope with the complex reality of the African human rights system, we outline a historical (and political) description of the events that preceded the creation of the Organization for the African Unity, the institutional body which had the main responsibility in the consolidation of the system itself. We also examine various "legal" precedents (the so-called Lagos Law, the Universal Declaration of the Rights of Peoples and so on) which influenced the elaboration of the African Charter with their moral and political authority. Whit the seventh chapter we finally land the heart of our topic: the narrative analysis of the African Charter of Human and Peoples' Rights. After a quick identification of the focal features of the document, we approach the meaningful core of the Charter: the organic/holistic relationship between individual human rights and collective dimension of peoples' (human) rights. We split our investigation in two different but related paths: the individual/people pole and the rights/duties pole, assuming they are two dissimilar strategies to arrange this underlying "cohabitation". We also draw to several pronunciations of the African Commission of human and peoples' rights exploring the potential meanings of people and peoples' rights to clarify the official/institutional position on the subject. Anthropological and sociological studies on the ongoing modifications of collective frames of reference (the family, the ethnic group and other strategies of kinship allegiance) in contemporary Africa are employed to complete our inquiry. In the eighth chapter we (temporary) leave the African Charter in favor of other documents and protocols produced by the African system, strictly related to the «culture variable»: the Pan-African Cultural Manifesto, the Cultural Charter for Africa and the Charter for African Cultural Renaissance. After that, we approach three other texts more engaged on the promotion and protection of human rights for specific categories of people: the African Charter on the rights and welfare of the child, the Protocol to the African Charter on human and peoples' rights on the rights of women in Africa and the African Youth Charter. Our aim is to show how cultural assumptions about the subjects concerned shape or influence the normative prescriptions designed to protect them. The ninth chapter, finally, outlines a general evaluation of our analytical model trough the exploration of its weakness and its points of strength. It shows the hermeneutical advantages provided by the «gius-narrative» key, which enabled us to trace and emphasize the links between myths and foundational narratives of social groups and theirs normative constructions. It also stresses the need for a cultural study of social life of human rights, to (try to) grasp the many faces that the struggle for human rights is showing in its continuous spread around the world.
THE TITLE OF MY THESIS IS THE ROLE OF THE IDEAS AND THEIR CHANGE IN HIGHER EDUCATION POLICY-MAKING PROCESSES FROM THE EIGHTIES TO PRESENT-DAY: THE CASES OF ENGLAND AND NEW ZEALAND IN COMPARATIVE PERSPECTIVE UNDER A THEORETICAL POINT OF VIEW, THE AIM OF MY WORK IS TO CARRY OUT A RESEARCH MODELLED ON THE CONSTRUCTIVIST THEORY. IT FOCUSES ON THE ANALYSIS OF THE IMPACT OF IDEAS ON THE PROCESSES OF POLICY MAKING BY MEANS OF EPISTEMIC COMMUNITIES, THINK TANKS AND VARIOUS SOCIOECONOMIC CONTEXTS THAT MAY HAVE PLAYED A KEY ROLE IN THE CONSTRUCTION OF THE DIFFERENT PATHS. FROM MY POINT OF VIEW IDEAS CONSTITUTE A PRIORITY RESEARCH FIELD WHICH IS WORTH ANALYSING SINCE THEIR ROLE IN POLICY MAKING PROCESSES HAS BEEN TRADITIONALLY RATHER UNEXPLORED. IN THIS CONTEXT AND WITH THE AIM OF DEVELOPING A RESEARCH STRAND BASED ON THE ROLE OF IDEAS, I INTEND TO CARRY ON MY STUDY UNDER THE PERSPECTIVE OF CHANGE. DEPENDING ON THE DATA AND INFORMATION THAT I COLLECTED I EVALUATED THE WEIGHT OF EACH OF THESE VARIABLES AND MAYBE OTHERS SUCH AS THE INSTITUTIONS AND THE INDIVIDUAL INTERESTS, WHICH MAY HAVE INFLUENCED THE FORMATION OF THE POLICY MAKING PROCESSES. UNDER THIS LIGHT, I PLANNED TO ADOPT THE QUALITATIVE METHODOLOGY OF RESEARCH WHICH I BELIEVE TO BE VERY EFFECTIVE AGAINST THE MORE DIFFICULT AND POSSIBLY REDUCTIVE APPLICATION OF QUANTITIVE DATA SETS. I RECKON THEREFORE THAT THE MOST APPROPRIATE TOOLS FOR INFORMATION PROCESSING INCLUDE CONTENT ANALYSIS, AND IN-DEPTH INTERVIEWS TO PERSONALITIES OF THE POLITICAL PANORAMA (ÉLITE OR NOT) WHO HAVE PARTICIPATED IN THE PROCESS OF HIGHER EDUCATION REFORM FROM THE EIGHTIES TO PRESENT-DAY. THE TWO CASES TAKEN INTO CONSIDERATION SURELY SET AN EXAMPLE OF RADICAL REFORM PROCESSES WHICH HAVE OCCURRED IN QUITE DIFFERENT CONTEXTS DETERMINED BY THE SOCIOECONOMIC CHARACTERISTICS AND THE TRAITS OF THE ÉLITE. IN NEW ZEALAND THE DESCRIBED PROCESS HAS TAKEN PLACE WITH A STEADY PACE AND A GOOD GRADE OF CONSEQUANTIALITY, IN LINE WTH THE REFORMS IN OTHER STATE DIVISIONS DRIVEN BY THE IDEAS OF THE NEW PUBLIC MANAGEMENT. CONTRARILY IN ENGLAND THE REFORMATIVE ACTION OF MARGARET THATCHER HAS ACQUIRED A VERY RADICAL CONNOTATION AS IT HAS BROUGHT INTO THE AMBIT OF HIGHER EDUCATION POLICY CONCEPTS LIKE EFFICIENCY, EXCELLENCE, RATIONALIZATION THAT WOULD CONTRAST WITH THE GENERALISTIC AND MASS-ORIENTED IDEAS THAT WERE FASHIONABLE DURING THE SEVENTIES. THE MISSION I INTEND TO ACCOMPLISH THORUGHOUT MY RESEARCH IS TO INVESTIGATE AND ANALYSE INTO MORE DEPTH THE DIFFERENCES THAT SEEM TO EMERGE FROM TWO CONTEXTS WHICH MOST OF THE LITERATURE REGARDS AS A SINGLE MODEL: THE ANGLO-SAXON MODEL. UNDER THIS LIGHT, THE DENSE ANALYSIS OF POLICY PROCESSES ALLOWED TO BRING OUT BOTH THE CONTROVERSIAL AND CONTRASTING ASPECTS OF THE TWO REALITIES COMPARED, AND THE ROLE AND WEIGHT OF VARIABLES SUCH AS IDEAS (MAIN VARIABLE), INSTITUTIONAL SETTINGS AND INDIVIDUAL INTERESTS ACTING IN EACH CONTEXT. THE CASES I MEAN TO ATTEND PRESENT PECULIAR ASPECTS WORTH DEVELOPING AN IN-DEPTH ANALYSIS, AN OUTLINE OF WHICH WILL BE PROVIDED IN THIS ABSTRACT. ENGLAND THE CONSERVATIVE GOVERNMENT, SINCE 1981, INTRODUCED RADICAL CHANGES IN THE SECTOR OF HIGHER EDUCATION: FIRST CUTTING DOWN ON STATE FUNDINGS AND THEN WITH THE CREATION OF AN INSTITUTION FOR THE PLANNING AND LEADERSHIP OF THE POLYTECHNICS (NON-UNIVERSITY SECTOR). AFTERWARDS THE SCHOOL REFORM BY MARGARET THATCHER IN 1988 RAISED TO A GREAT STIR ALL OVER EUROPE DUE TO BOTH ITS CONSIDERABLE INNOVATIVE IMPRINT AND THE STRONG ATTACK AGAINST THE PEDAGOGY OF THE 'ACTIVE' SCHOOLING AND PROGRESSIVE EDUCATION, UNTIL THEN RECOGNIZED AS A MERIT OF THE BRITISH PUBLIC SCHOOL. IN THE AMBIT OF UNIVERSITY EDUCATION THIS REFORM, TOGETHER WITH SIMILAR MEASURES BROUGHT IN DURING 1992, PUT INTO PRACTICE THE CONSERVATIVE PRINCIPLES THROUGH A SERIES OF ACTIONS THAT INCLUDED: THE SUPPRESSION OF THE IRREMOVABILITY PRINCIPLE FOR UNIVERSITY TEACHERS; THE INTRODUCTION OF STUDENT LOANS FOR LOW-INCOME STUDENTS AND THE CANCELLATION OF THE CLEAR DISTINCTION BETWEEN UNIVERSITIES AND POLYTECHNICS. THE POLICIES OF THE LABOUR MAJORITY OF MR BLAIR DID NOT QUITE DIVERGE FROM THE CONSERVATIVES' POSITION. IN 2003 BLAIR'S CABINET RISKED TO BECOME A MINORITY RIGHT ON THE OCCASION OF AN IMPORTANT UNIVERSITY REFORM PROPOSAL. THIS PROPOSAL WOULD FORESEE THE AUTONOMY FOR THE UNIVERSITIES TO RAISE UP TO 3.000 POUNDS THE ENROLMENT FEES FOR STUDENTS (WHILE FORMERLY THE CEILING WAS 1.125 POUNDS). BLAIR HAD TO FACE INTERNAL OPPOSITION WITHIN HIS OWN PARTY IN RELATION TO A MEASURE THAT, ACCORDING TO THE 150 MPS PROMOTERS OF AN ADVERSE MOTION, HAD NOT BEEN INCLUDED IN THE ELECTORAL PROGRAMME AND WOULD RISK CREATING INCOME-BASED DISCRIMINATION AMONG STUDENTS. AS A MATTER OF FACT THE BILL FOCUSED ON THE INTRODUCTION OF VERY LOW-INTEREST STUDENT LOANS TO BE SETTLED ONLY WHEN THE STUDENT WOULD HAVE FOUND A REMUNERATED OCCUPATION (A SYSTEM ALREADY PROVIDED FOR BY THE AUSTRALIAN LEGISLATION). NEW ZEALAND CONTRARILY TO MANY OTHER COUNTRIES, NEW ZEALAND HAS ADOPTED A VERY WIDE VISION OF THE TERTIARY EDUCATION. IT INCLUDES IN FACT THE FULL EDUCATIONAL PROGRAMME THAT IS INTERNATIONALLY RECOGNIZED AS THE POST-SECONDARY EDUCATION. SHOULD WE SPOTLIGHT A PECULIARITY OF THE NEW ZEALAND TERTIARY EDUCATION POLICY THEN IT WOULD BE 'CHANGE'. LOOKING AT THE REFORM HISTORY RELATED TO THE TERTIARY EDUCATION SYSTEM, WE CAN CLEARLY IDENTIFY FOUR 'SUB-PERIODS' FROM THE EIGHTIES TO PRESENT-DAY: 1. BEFORE THE 80S': AN ELITARIAN SYSTEM CHARACTERIZED BY LOW PARTICIPATION RATES. 2. BETWEEN MID AND LATE 80S': A TREND TOWARDS THE ENLARGEMENT OF PARTICIPATION ASSOCIATED TO A GREATER COMPETITION. 3. 1990-1999: A FUTHER STEP TOWARDS A COMPETITIVE MODEL BASED ON THE MARKET-ORIENTED SYSTEM. 4. FROM 2000 TO TODAY: A CONTINUOUS EVOLUTION TOWARDS A MORE COMPETITIVE MODEL BASED ON THE MARKET-ORIENTED SYSTEM TOGETHER WITH A GROWING ATTENTION TO STATE CONTROL FOR SOCIAL AND ECONOMIC DEVELOPMENT OF THE NATION. AT PRESENT THE GOVERNMENT OF NEW ZEALAND OPERATES TO STRENGHTHEN THIS PROCESS, PRIMARILY IN RELATION TO THE ROLE OF TERTIARY EDUCATION AS A STEADY FACTOR OF NATIONAL WALFARE, WHERE PROFESSIONAL DEVELOPMENT CONTRIBUTES ACTIVELY TO THE GROWTH OF THE NATIONAL ECONOMIC SYSTEM5. THE CASES OF ENGLAND AND NEW ZEALAND ARE THE FOCUS OF AN IN-DEPTH INVESTIGATION THAT STARTS FROM AN ANALYSIS OF THE POLICIES OF EACH NATION AND DEVELOP INTO A COMPARATIVE STUDY. AT THIS POINT I ATTEMPT TO DRAW SOME PRELIMINARY IMPRESSIONS ON THE FACTS ESSENTIALLY DECRIBED ABOVE. THE UNIVERSITY POLICIES IN ENGLAND AND NEW ZEALAND HAVE BOTH UNDERGONE A SIGNIFICANT REFORMATORY PROCESS SINCE THE EARLY EIGHTIES; IN BOTH CONTEXTS THE IMPORTANCE OF IDEAS THAT CONSTITUTED THE BASE OF POLITICS UNTIL 1980 WAS QUITE RELEVANT. GENERALLY SPEAKING, IN BOTH CASES THE PRE-REFORM POLICIES WERE INSPIRED BY EGALITARIANISM AND EXPANSION OF THE STUDENT POPULATION WHILE THOSE BROUGHT IN BY THE REFORM WOULD PURSUE EFFICIENCY, QUALITY AND COMPETITIVENESS. UNDOUBTEDLY, IN LINE WITH THIS GENERAL TENDENCY THAT REFLECTS THE HYPOTHESIS PROPOSED, THE TWO UNIVERSITY SYSTEMS PRESENT SEVERAL DIFFERENCES. THE UNIVERSITY SYSTEM IN NEW ZEALAND PROCEEDED STEADILY TOWARDS THE IMPLEMENTATION OF A MANAGERIAL CONCEPTION OF TERTIARY EDUCATION, ESPECIALLY FROM 1996 ONWARDS, IN ACCORDANCE WITH THE REFORMATORY PROCESS OF THE WHOLE PUBLIC SECTOR. IN THE UNITED KINGDOM, AS IN THE REST OF EUROPE, THE NEW APPROACH TO UNIVERSITY POLICY-MAKING HAD TO CONFRONT A DEEP-ROOTED TRADITION OF PROGRESSIVE EDUCATION AND THE IDEA OF EDUCATION EXPANSION THAT IN FACT DOMINATED UNTIL THE EIGHTIES. FROM THIS VIEW POINT THE GOVERNING ACTION OF MARGARET THATCHER GAVE RISE TO A RADICAL CHANGE THAT REVOLUTIONIZED THE OBJECTIVES AND KEY VALUES OF THE WHOLE EDUCATIONAL SYSTEM, IN PARTICULAR IN THE HIGHER EDUCATION SECTOR. IDEAS AS EFFICIENCY, EXCELLENCE AND CONTROL OF THE PERFORMANCE BECAME DECISIVE. THE LABOUR CABINETS OF BLAIR DEVELOPED IN THE WAKE OF CONSERVATIVE REFORMS. THIS APPEARS TO BE A FOCAL POINT OF THIS STUDY THAT OBSERVES HOW ALSO IN NEW ZEALAND THE REFORMING PROCESS OCCURRED TRANSVERSELY DURING PROGRESSIVE AND CONSERVATIVE ADMINISTRATIONS. THE PRELIMINARY IMPRESSION IS THEREFORE THAT IDEAS DEEPLY MARK THE REFORMATIVE PROCESSES: THE AIM OF MY RESEARCH IS TO VERIFY TO WHICH EXTENT THIS STATEMENT IS TRUE. IN ORDER TO BUILD A COMPREHENSIVE ANALYLIS, FURTHER SIGNIFICANT FACTORS WILL HAVE TO BE INVESTIGATED: THE WAY IDEAS ARE PERCEIVED AND IMPLEMENTED BY THE DIFFERENT POLITICAL ELITES; HOW THE VARIOUS SOCIOECONOMIC CONTEXTS INFLUENCE THE REFORMATIVE PROCESS; HOW THE INSTITUTIONAL STRUCTURES CONDITION THE POLICY-MAKING PROCESSES; WHETHER INDIVIDUAL INTERESTS PLAY A ROLE AND, IF YES, TO WHICH EXTENT.
"O weary Champion of the Cross, lie still": così Christina Rossetti apre un sonetto del 1890 intitolato Cardinal Newman, composto in occasione della dipartita del cardinale e dedicato alla memoria di uno dei più influenti pensatori, teologi e uomini di lettere dell'epoca. L'accorato canto di Rossetti sottolinea la potenza del pensiero newmaniano assimilando le azioni e gli scritti del cardinale all'impeto delle acque di marea, metaforizzandoli poi in un'alluvione che va a sconvolgere il tranquillo corso di un ruscelletto: "Thy tides were springtides, set against the neap/ Of calmer souls: thy flood rebuked their rill (7-8). La metafora acquatica impiegata da Rossetti sintetizza in modo efficace le qualità trasformatrici proprie della lunga parabola esistenziale di John Henry Newman (1801-1890), la quale lascia profondi solchi nel tessuto ideologico e storico di quello che gli studiosi hanno identificato come "very long nineteenth-century". Gran parte di questi solchi sono stati tracciati da Newman percorrendo una strada faticosa e mai lineare, che lo studioso oggi può seguire attingendo al voluminoso corpus delle opere e all'altrettanto ricco apparato critico e biografico andato formandosi negli anni a commento dei suoi scritti. Assieme a John Keble e Hurrel Froude, Newman fondò le basi di quello che passa alla storia come Oxford Movement, un'esperienza intellettuale nata fra i Colleges dell'Università di Oxford che mirava a ricostruire le basi cattoliche della Chiesa Anglicana, in un contesto di generale inquietudine nei confronti dell'istituzione ecclesiastica e dei modi da questa adottati per declinare la professione di fede all'interno del tessuto sociale dell'epoca. Gli uomini del Movement concentrarono i propri sforzi teorici nella stesura e pubblicazione di numerosi Tracts for the Times, nei quali si affrontavano i temi ecclesiologici più disparati, col fine di attivare un dialogo riformatore in seno alla Chiesa d'Inghilterra. La pubblicazione dei Tracts fu di breve durata (1833-1845) ma foriera di importanti conseguenze per la società inglese e per l'esistenza di Newman, coincidendo la sua conversione al cattolicesimo con la cessazione delle pubblicazioni (1845). La conversione di Newman fece enorme impressione sull'opinione pubblica, specie per il forte sentimento antiromano che circolava nelle fila dell'establishment inglese. Il motto "No Popery" costituiva un refrain udibile in molte delle produzioni culturali dell'epoca e in special modo nei romanzi a tema religioso, fra le cui pagine il cattolico si muove come personaggio intriso di caratteristiche negative proprie del villain: "a spy, a secret agent, suave, supercilious and satanically unscrupulous, laying his cunning plots for the submission of England to 'Jesuitocracy'". Falsità, propensione all'inganno, sete di potere, assenza di scrupoli erano tutti connotati che l'immaginazione protestante associava alla Chiesa di Roma: la conversione procurò a Newman accuse dello stesso segno che il futuro cardinale cercò di dissipare nei suoi scritti, impegnandosi ad arrivare a una fetta di pubblico il più vasta possibile mediante due romanzi e la celebre autobiografia spirituale Apologia Pro Vita Sua (1864). Le opere letterarie di Newman conobbero un dilagante successo, intrise com'erano di istanze culturali associate alla vita religiosa e di elementi autobiografici che andavano a soddisfare la curiosità del pubblico per la vicenda personale di uno degli uomini più in vista del regno di Vittoria. La peculiare intersecazione fra la determinante storico-culturale e quella autobiografica nella testualizzazione letteraria newmaniana è l'oggetto di studio qui proposto. La ricerca prende il via da un iniziale progetto su biografia e romanzo in relazione alla cosiddetta "crisi religiosa" che caratterizza gli anni vittoriani. Nel considerare i vari aspetti della questione assieme al mio tutor Prof. Enrico Reggiani, si è constatato come non fosse opportuno inscrivere la figura di Newman in uno studio tematico e pluritestuale, metodologicamente orientato a una prospettiva storico-culturale: l'influenza del cardinale sulle lettere di derivazione anglofona appare caratterizzata da un'imponente, multilivellare pervasività che echeggia sia nelle pratiche artistiche dell'epoca, ossia nell'opera della già citata Rossetti, nell'estetica della Pre-Raphaelite Brotherhood, nella poesia di Gerald Manley Hopkins, che in quelle novecentesche, come il sistema testuale joyciano. Se il ruolo determinante del pensiero newmaniano è riconosciuto e analizzato dalla critica nel dettaglio dei suoi aspetti teologico-religiosi, altrettanto non può dirsi dei suoi scritti più specificamente letterari: il lavoro qui presentato sarà da intendersi pertanto come un dispositivo di avvicinamento a questi aspetti dell'opera di Newman. A tal fine si è deciso di concentrare lo studio sulla close-reading di uno dei due romanzi newmaniani, Loss and Gain (1848), la cui testualità sarà investigata mediante un selezionato apparato metodologico afferente in primis al macrotesto dell'autore e in secundis a più recenti formulazioni teoriche di taglio narratologico. ; In an 1890 composition dedicated to the memory of John Henry Newman, Christina Rossetti metaphorized his legacy into "springtides, set against the neap/ Of calmer souls: thy flood rebuked their rill". She so sought to synthesize the transformative qualities of Newman's existence (1801-1890) in the context of the "very long nineteenth century", as defined by Margot Finn. Along with John Keble and Hurrell Froude, Newman founded the Tractarian Movement, an Oxford-based intellectual movement intending to rebuild the Catholic foundation of the Anglican Church, which at the time was facing an ever growing disquiet on behalf of its affiliates, for both ecclesiological and political reasons. In order to ignite a reformative dialogue within the Church of England, the Tractarians published a relevant number of Tracts from 1833 to 1845, when Newman converted to Catholicism. Newman's conversion sparked a huge controversy within the public opinion, catholics at the time being subjected to a heavy cultural stigma within the establishment. Falsity, a propension to deceit and thirst for power connoted the catholic character in numerous religious novels in the Victorian period, thus prompting Newman to defend himself from similar allegations in various writings such as the Apologia Pro Vita Sua (1864). Newman's literary writings were extremely successful, since they put on display a peculiar intersection between religious cultural issues and his own autobiography. Such intersection is the object of my thesis, which will articulate around a close-reading of Newman's novel Loss and Gain (1848) in order to highlight the main features of the Cardinal's literary theory and practice in relation to his overall theological views, and to project them on a synchronic and diacronic perspective to attest Newman's legacy on Eighteenth and Nineteenth century literature.
In Italy, Protection System for Asylum Seekers and Refugees (SPRAR) manages the second reception of forced migrants. This organization was founded by the Bossi-Fini law n. 189/2002 and is composed by the network of local governments, which uses the available resources of National Fund for Asylum Policies and Services provided by Government finance law and managed by the Ministry of Interior. Its principal goal is to realize integrated reception projects for refugees, asylum seekers, subsidiary and humanitarian protection holders in order to ensure their socio-economic inclusion within local contexts in cooperation with voluntary and third sector organizations. On 10th July 2014, local governments were signed an agreement between national and regional executive to create a national reception system to face the growing number of people who have arrived on the Italian coasts. The main goal of this system is to overcome only a material reception (food and lodging), in order to offer a "widespread reception" within urban areas. The strategy is to create an individual project and an accompaniment to ensure the integration of each person in the local community. The services provided consist in inclusion of migrants in the national health and scholastic system, orientation and access to other local services, professional training, job placement, legal assistance and social and housing integration . Indeed, it is crucial to emphasize that the Italian reception system is characterized by extreme fragmentation. Only SPRAR provides these services with the goal of enabling social and economic inclusion of hosted people in local context, which is why we talk about second reception centres. In Italy, there are, however, many different types of first and extraordinary reception centres for migrants . They are managed by the prefectures and differ in terms of goals, structural characteristics, services and receptive capacity. Only 18.7% of migrants are hosted in the SPRAR structures, while the remainder incurs the possibility of carrying out the entire procedure of the asylum application in the centres of first and extraordinary reception (IDOS, 2017). In recent years, the Italian reception structures have undergone a reorganization and redenomination phase, in which the SPRAR should have become a reference standard. In fact, this system has positively distinguished itself for its objectives, the structuring of his interventions and many best practices. This did not prevent bad reception occurrences even within SPRAR structures, as well as a large number of violent and verbal conflicts, some of which carried out by Italian citizens to the detriment of asylum seekers and owners of a status of international protection. These episodes, exacerbated by a political and media discourse that represents migrants as a threat (Battistelli et al., 2016), are the consequence and symbol of the fragmentary and contradictory reception policies adopted at a European level, in the individual countries and at a local level (IDOS, 2016). Instability and political, economic and social uncertainty, rulers in this historical period, are manifested in an emergency approach that is characterized by insufficient planning and a lack of coordination between the reception agencies. This orientation, supported by many and incongruent legislative changes, deprives the system of a strong structure and facilitates the overturning of the same principles of "widespread reception" of migrants in local communities. Moreover, this facilitates the affirmation of nationalist, xenophobic and localist drifts, as well as reception situations in which human rights are violated and which do not provide real opportunities for inclusion in the territories in a safe and dignified manner. Therefore, the conceptual distinction of the terms danger, risk and threat, used as the interpretative line of this work, appears fundamental to understand why subjective responses, in terms of perception and actions, differ according to the situations, as well as to manage the effects that derive in a consistent manner (Battistelli e Galantino, 2018). In order to realize the analysis, I decided to use an ethnographic approach that is traced back to the constructivist philosophical paradigm, where the vision of facts is investigated locally. Ethnographers, indeed, study subjects, artefacts and actions in their interactions, from an interpretative-dialectical point of view, without the claim of absolute objectivity of the results (Piccardo and Benozzo, 1996). Then, I have chosen to use focused narrative interviews because they turn to individuals, they aim for their "understanding", and this is part of the renewed interest in the subject's centrality and in the "deliberately intentional" social action (Weber, 1922). It is also an approach that allows investigating deeply the phenomena. It is very interactive, flexible and able to empathize in the perspective of the subject being studied. This makes it easier to interview marginal subjects neglected by "official knowledge" and to rediscover the social function of research, which is "giving voice to those who do not have it" (Crespi, 1985, pp. 351) In addition, observation and fieldwork are supported by a strong theoretical basis that offers its help to the researcher for the understanding of the social world, providing an order that supports they in their critical analysis of the facts. So, empirical work and theory support each other (Silverman, 2002). Then, narrative approach is highly adaptable to the study of organizations and to analyse the collected data. In fact, this approach is characterized for attention given to concrete situations and not to general theorizations (Czarniawska, 2000). Hence, the empirical research carried out in 2016-2018 can be summarized in the following phases: 1- Analysis of secondary data and documents produced by European and national statistical institutes, private associations, protection bodies and by SPRAR itself. 2- Participant observation in: - a political protest demonstration against the opening of a SPRAR centre in XIII Town Hall, on the north-western suburb of Rome; - nine meetings of social operators working in SPRAR network of Rome and in the national CARA and CAS reception centres; - a SPRAR centre (20 reception places increased to 40 in the south-eastern suburbs of Rome, VII Town Hall). One year of observation and shadowing of operators: 16th January 2017 – 22th January 2018; - a SPRAR apartment (14 reception places for families in the residential area of Monte Sacro neighbourhood, Town Hall III). Five days of observation and shadowing of operators in January 2018; - a seminar of reflection organized by SPRAR and ANCI on the reception system in Lazio, focused on the role of the Regions and Municipalities. 3- Forty-one narrative focused interviews: - Twenty-four SPRAR operators working in SPRAR centres of Rome; - Seventeen asylum seekers and refugees from SPRAR centre observed in Town Hall VII of Rome. The intent behind this ethnographic research started in a restructuring phase aimed to make the SPRAR a reference standard of reception for all asylum seekers who came to our country. But it was characterized, as still today, by speculative situations, the high presence on the territory of large collective reception centres and managing bodies without the necessary experience (Olivieri, 2011; Lunaria 2016). Therefore, the analysis of the risk management and the operators perception of the SPRAR of Rome has the objective to unveil and analyse the contradictions and weaknesses that may arise within this model due to a reckless management that produces specific factors of risk. The hypothesis underlying the case study is that, although the SPRAR has been recognized as an ordinary model, it can also be reproduced in a distorted manner, not respecting the reference guidelines. The alteration between SPRAR in books, the theoretical expression of a principle, and SPRAR in action, its implementation (Pound, 1910), is caused by specific factors that can cause significant effects from several points of view. To bring to light these aspects, closely related to the risk management and the perception that its operators have, I achieve a classification of the risks that I applied to three different types of SPRAR structures (large, medium and single apartment). Then, I identified a series of outcomes involving the people hosted, the operators, the local community and the SPRAR organization itself. The decision to draw the case study at the SPRAR of the city of Rome is driven by the complexity that distinguishes this territory on a social, cultural and political level. In fact, I believe it can bring out the contradictions of the model as new forms of confinement compared to territories with reduced complexity. However, allowing a glimpse of a reception of asylum seekers and holders of a protection status also possible within urban and metropolitan areas. The empirical survey shows that an increase in the distortion compared to the assumptions of an integrated and widespread reception in the territories corresponds to a greater possibility that specific risk factors are produced. Which in their turn, crystallizing into unhealthy forms, can involve the people hosted, the operators, the local community and the SPRAR organization itself. The case study and the application of the risk classification, which I achieved based on the evidence revealed from the field, reveal how the identified risk areas (socio-spatial context, production of the service, recipients) and the corresponding categories, do not produce in itself a negative result. However, this can occur if a short-sighted management acts on these aspects and does not align with the proposed guidelines. Therefore, this classification appears to be a useful tool to identify problems and to develop preventive measures, aimed to improve the management of SPRAR centres in metropolitan cities such as Rome (and other contexts), by intervening on the identified risk categories and reducing the factors that eventually emerge. The analysis, focused on three different types of SPRAR structure (large, medium, single apartment) of the Capital, shows how this alteration occurs in a disruptive way in the large collective centres, the most represented in Rome. Meanwhile, greater adherence to the model is shown, with a modality proportional to the size, in the medium-sized structure and in the apartment. The distortion detected in the large SPRAR collective centres of Rome and partly also in the medium-sized centre, reflects the ambivalence of the general reception system. It promotes on the one hand the principles of a good reception that respects human rights and the autonomy of people and by another implements foreclosure practices and new forms of borders (Vacchiano, 2011; Van Haken, 2008). The field research shows that this happens on different levels due to specific material factors (location and capacity of the centres, management of internal spaces, activation of the services provided, etc.) and through the daily practices of the operators who, in a more or less assenting, controlling and disciplining the people hosted, shape their conduct. Therefore, in the daily life of the structures in which the situations described are involved, the principles of freedom, inclusion and autonomy supported by the rhetoric of reception system are governed by a neoliberal logic of citizenship that suggests the criteria to distinguish, in the same integration paths, who is more worthy than other beneficiaries (Van Haken, 2008). Although the case study highlights strong contradictions and weaknesses that come to life in the implementation of the SPRAR model, it also shows the realization of a good reception. That which, despite being included in an extremely complex context such as Rome, attempts to oppose the "logic of large numbers and profits" of large cooperatives and which implements functional inclusion paths to achieve the objectives. Alignment and consistency with the guidelines and the SPRAR operating manual, in fact, allow the construction of a real project of individualized socio-economic integration for the person hosted. Only by acting in a widespread manner on the territory, in apartments or small centres, the genesis of new forms of borders beyond those already present is avoided. In fact, through this management most of the risks identified are eliminated or at least reduced, precisely because the "trajectory of opportunities" of risk (Reason, 1997) towards unfavourable outcomes generally develops within large collective centres. Tese de doutoramento em Estudos Clássicos, no ramo de Filologia Clássica, apresentada à Faculdade de Letras da Universidade de Coimbra ; The research work is divided into two basic parts: the translation and commentary of some sections of the book Regum et imperatorum apophthegmata by Plutarch. In particular they have been taken into consideration the Dedicatory epistle to Trajan and the sections dealing with Agathocles, Antipater, Aristides, Alcibiades, Iphicrates, Timotheus, Phocion, Teleclus, Lysander and Pelopidas. The translation was prepared on the basis of the Latin translation by Xylander, the Italian ones by Adriani and Pettine, the English one by Babbitt, the Spanish one by Lόpez Salvá and the French one by Fuhrmann. For each anecdote the different interpretative proposals of the translators have been highlighted in the footnotes. The commentary has been developed along two lines, the former intratextual, the latter intertextual. In the first istance, the attention was paid to the study of the words used by the author, which helped to identify the frequency of some fundamental themes of ethical and political thought of Plutarch, such as the need for the governor not to be tormented by lust for wealth, not to be led astray by private interests and friendships in the management of public affairs, to be able to evaluate flexibly critical circumstances that occur from time to time, shaping the policy and operational positions to them and avoiding fruitless and stiffness intransigence. Before the eyes of the reader the author slides the long series of anecdotes, inviting them to consider which are the virtues, but also the vices that led eminent people to prosperity or to ruin. And what emerges consistently from each short story is the importance of reflection and pondering every time you are about to perform an action or reply to a question not without insolence. It is recommended and appropriate learning to tame irrational forces of the soul through the exercise of λόγος; in fact they cannot be eradicated completely. It is because of this constant and gradual exercise of self improvement that energy, which man has, can be harnessed and directed to noble deeds for those who make them and fruitful for those who benefit them. The policy ultimately cannot be separated from ethics; a politician, who is not persistent in improving his mind and free it from all forms of selfishness, will not benefit at all to those who are subjected to his command. In many cases it is possible to find in the text the words which introduce explicitly the above issues, as, for example, φιλοπλουτία, ἀδικία, δίκη, τóλμα, θάρσος, ἀργία; in other cases it can be deduced from the meaning of the anecdote which category of values the author is referring to. The presence of the terms relating to each theme, in the commentary of the individual anecdotes, are then summarized in a synoptic table in order to allow an immediate comparison of the characters and the vices/virtues attributed by the author. Another aspect investigated thoroughly is the author's appeal to rhetorical devices to give the apophthegms incisiveness, especially when the author summarizes episodes which are more extended and articulated in the Lives and other plutarchian books. In the Apophthegmata you can find especially the chiasmus, which the author often uses to contrast the thinking and acting of the character to that of his detractors; the etymological figure and the polyptoton, with which the main theme of the plutarchian reflection is repeatedly drawn inside the anecdote. It was further highlighted that in the collection of apofthegms there are two types of anecdote; there is, in most cases, the presence of apophthegmata placed at the conclusion of a synthetic context, outlined with rapid hints; but it also notes the introduction of a specific episode of war and customs of characters, devoid of judgment in the epigraph, which are also designed to emphasize an ethical feature and behavior of the character in question. The second line, that we proceeded in the research work, was the comparison of each anecdote with versions of the same occurring in other works by Plutarch. The comparison showed that in some cases the versions coincide almost entirely in the vocabulary and meaning, but on many occasions the perspective, from which the story is presented by the author, varies slightly and sometimes considerably. It has been noted in fact that some details of the anecdote are eclipsed or modified by the author based on the context in which they are placed; the same story is then molded according to the theme that the author is dealing with. In general it was found that in Apophthegmata the presentation of the characters tends to be more positive than in other works by Plutarch, operation where the author comes removing from anecdotes details that could negatively connote the character. At the base of the anecdotes they could hypothetically be the so-called ὑπομνήματα, ie raw notes that Plutarch would be recorded in the course of its various readings and which he would use in the composition of his works. It is given adequate account about this problem in a specific chapter of the thesis, which examines the theories proposed in particular by Van der Stockt, Van Meirvenne, Pelling, Städter and Beck on the nature of ὑπομνήματα. According to some of them the content of the clusters, which are groups of ὑπομνήματα, would mainly philosophical in nature, according to others mainly historical. Furthermore on the one hand it is believed that the Apohthegmata constitute a drafting stage intermediate between the hypothetical sketched ὑπομνήματα and anecdotes as are processed in different works by Plutarch. On the other hand however the collectionof apophthegms is considered complete and independent from the drafting of the Lives and Moralia, theory that appeared to me more convincing on the basis of the rhetorical and stylistic analysis that I developed. The anecdotes do not appear to a stage of stylistic poor structuring and the use of a certain category of rhetorical devices and the tendency to obscure incriminating details for the characters seem to respond to a specific purpose of the author. Another chapter is devoted to the presentation of the debate on the problematic attribution of the work to Plutarch. In this chapter we review the opinions expressed in particular by Xylander, Wyttenbach, Benseler, Volkmann, Schmidt, Sass, Weissenberger, Hartman, Babbitt, Ziegler, Flacelière, Fuhrmann and Beck, noting that the most recent studies, particularly those of Beck, the scholars tend to recognize the paternity of the collection of anecdotes. According to him and other scholars the conciseness of anecdotes than the versions, which are read in the other works by Plutarch, would not be valid indication of inauthenticity; instead it would respond to the specific needs required by the type of the literary genre.
L'affermazione delle cosiddette "democrazie costituzionali" dotate di costituzioni rigide, ha portato a compimento un complesso processo storico ed ha condotto alla realizzazione quasi completa del "costituzionalismo", dove la legge, per la prima volta, viene sottoposta ad un giudizio di tipo assiologico. In tale contesto è di notevole importanza il complicato e delicato lavoro del giudice costituzionale, il quale deve interpretare la Costituzione, nel cui tessuto sono introdotti direttamente una serie di principi contenenti valori etico-politici , la cui applicazione non assume più la forma classica sillogistica della sussunzione, bensì della ponderazione. Le più note teorie giuscostituzionaliste e dell'argomentazione giuridica hanno dedotto che i principi sono delle norme di ottimizzazione che descrivono un valore da realizzare il più possibile, con riguardo a quanto risulta effettivamente realizzabile, sia sotto il profilo fattuale che giuridico, talché il loro adempimento non dipende soltanto dalle possibilità reali, ma anche da quelle giuridiche, oltre che da regole e da principi controversi. Nell'interpretazione costituzionale, seguendo il metodo argomentativo, la gerarchia assiologica, la scala di priorità tra i principi costituzionali diversi si rende necessaria, perché essa si riferisce a particolari tipi di norme date da una stessa fonte del diritto, ossia la Costituzione: nel balancing test tra diritti concorrenti la Corte Suprema americana parla di preferred position per taluni diritti riconducibili ad un valore costituzionale primario, come la libertà di espressione e di associazione, la libertà religiosa, i diritti della personalità e di partecipazione politica. Ma anche la nostra Corte Costituzionale è continuamente costretta a scegliere nel caso da decidere, con ragionevolezza e proporzionalità, non solo nell'ipotesi di giudizi di eguaglianza, alla luce dell'art. 3 della costituzione, ma anche quando, nel reperire la norma parametro, deve scegliere tra principi, diritti e valori contrastanti, come ad esempio tra diritto di libertà individuale e diritto alla salute o tra diritto di proprietà e di impresa e riconoscimento del valore "primario" del paesaggio. La difficile ricerca di una gerarchia tra i valori costituzionalmente tutelati esige un'opera continua e incessante di ridefinizione e di ri-armonizzazione dei principi costituzionali sulla base degli elementi specifici forniti dai casi da decidere. Gli enunciati costituzionali debbono perciò tener fermo un nucleo identificativo del valore originariamente tutelato, domandando, nel contempo, attraverso una ragionevole varietà di interpretazioni e di applicazioni, di essere continuamente rimodellati ed adeguati alla storia e alla politica, nonché al mutare delle assunzioni di senso e dei significati sociali. I principi che si trovano alla base delle costituzioni, e attorno ai quali i documenti costituzionali si sono formati, con l'aprirsi di nuovi orizzonti e di nuovi problemi, debbono continuamente essere aggiornati, rielaborati e ricomposti in un insieme dotato di senso. Essi hanno bisogno di rinnovata giustificazione da un interprete dotato di un peculiare ed elevato habitus giuridico, idoneo a rendere un giudizio complesso e articolato come quello di costituzionalità. . Dal punto di vista della metodologia ermeneutica, l'habitus del giudice costituzionale corrisponde alla precomprensione critica, attraverso la quale si può individuare se il giudizio costituzionale sia stato effettuato da un giudice privo di habitus e invalidare tale giudizio, anche a prescindere dalla corretta motivazione del giudice stesso. Se poi si tiene presente che la Costituzione è essa stessa il risultato dell'interpretazione dei principi costituzionali, risulta di tutta evidenza l'importanza di un "circolo ermeneutico" tra i principi conformatori della società e valutazioni della società stessa. Nel giudizio costituzionale la circolarità ermeneutica è molto accentuata, infatti, tra il giudice interprete, la collettività e la Costituzione, oggetto interpretato, si instaura un intimo rapporto circolare diacronico, dal momento che la Costituzione contiene dei principi e dei valori appartenenti alla società della quale lo stesso giudice costituzionale fa parte. Nell'attività giudiziale della Corte costituzionale italiana è possibile riscontrare l'accezione scettica dell'interpretazione giuridica, tipica dei sistemi di common law: laddove, sul piano della creatività, le sentenze interpretative di rigetto, sentenze additive e sentenze manipolative sono tutte varianti suggerite o imposte dalla necessità nei singoli casi di un unico modello di pronuncia del giudice delle leggi, che in presenza di determinate condizioni, consente di superare i confini prestabiliti dai canoni legali dell'interpretazione giudiziaria per addentrarsi verso una funzione che non è solo etero-integrativa del diritto ordinamentale e costituzionale, ma anche suppletiva del potere legislativo. L'utilizzo dell'ermeneutica giuridica, come metodo d'interpretazione, trova particolare rilievo dinanzi alle Corti de-statalizzate operanti in ambiti giuridici ad ordinamento pluristatale come la Corte di Giustizia dell'Unione Europea e dinanzi alle Corti Costituzionali di diversi Stati, riconoscendo l'attività creativa ed etero-integrativa da parte del giudice costituzionale di civil law. Tramite la precomprensione critica e la circolarità tradica e diadica, l'ermeneutica giuridica si pone sempre più come metodo interpretativo indispensabile per l'interpretazione dei principi fondamentali, preesistenti al testo Costituzionale, e per la costruzione e l'impiego dei cosiddetti "parametri non scritti", utilizzati, a volte, dai giudici costituzionali italiani, al di là dei limiti tracciati dal metodo giuridico argomentativo: dove il punto di partenza del ragionamento deduttivo-assiologico dovrà sempre esser il testo scritto, dal quale l'interprete potrà denotare il valore del principio. Pur riconoscendosi nell'alveo delle teorie scettiche dell'interpretazione giudiziale, la metodologia ermeneutica offre una valutazione della decisione di costituzionalità capace di non lasciare alla discrezionalità del giudice uno spazio illimitato, dal momento che precomprensione critica e circolarità ermeneutica, dalle quali discende la canonistica ermeneutica, garantisce un metodo per la controllabilità del giudizio, senza che possa sfociare in decisioni arbitrarie o di opportunità politica. Dopo la riforma del titolo V, con il novellato art.117, primo comma, della Costituzione, la dottrina giuscostituzionalista ha parlato di una possibile estensione della legalità costituzionale, qualora i principi discendenti dal diritto comunitario-europeo ed internazionale andrebbero ad integrare i parametri ermeneutici utilizzati nel giudizio di costituzionalità: nel caso in cui il giudice a quo, in via incidentale, e lo Stato e le Regioni, in via diretta, sollevassero la questione di costituzionalità, per violazione del suddetto articolo della Costituzione. L'estensione della legalità costituzionale, tuttavia ha, anche, il suo risvolto "inverso", nel caso in cui fossero i principi esterni a ledere i principi fondamentali dell'ordinamento Costituzionale Repubblicano. Nel contemporaneo costituzionalismo europeo, che accomuna più vicende ordinamentali diverse, risulta essere di peculiare interesse l'esperienza giuridica della Svezia, una delle più solide ed efficienti democrazie mondiali, caratterizzata da un' antica tradizione costituzionale e da una lunga vaganza del controllo di costituzionalità delle leggi. Quest'ultime, fino a poco tempo fa, venivano interpretate dalle Corti nell'assoluto rispetto e subordinazione alla volontà storica del legislatore. Ultimamente, con l'entrata della Svezia nell'Unione Europea, a seguito delle recenti riforme costituzionali ed attraverso l'introduzione di un controllo di costituzionalità diffuso, le corti svedesi stanno gradualmente cambiando i loro tradizionali criteri interpretativi, per una più ampia ed efficace tutela dei diritti umani, nell'ambito giuridico costituzionale ed europeo. ; The claim of so-called "constitutional democracy" with rigid constitutions has completed a complex historical process and has led to the almost complete implementation of "constitutionalism", where for the first time the law is submitted to a value judgment. In this context, it is of great importance to the complicated and delicate work of the Constitutional Judge, who must interpret the Constitution, whose tissue directly holds a set of principles containing ethical and political values, and whose application does have the classic syllogistic form of subsumption, but that of weighting. Most of the Laws are rules, i.e. require something to run to the occurrence of specific conditions, and, therefore, one can refer to them as "conditional rules". In addition, rules can take a categorical form, such as total ban on access. If the rule is valid and applicable, it is absolutely crucial to impose the exact performance means that the rule prescribes. If this happens, one can determine whether the provisions were complied with or not. For the theories of constitutionalism and of the legal argumentation, principles, however, are rules that require that some value shall be fully accomplished with regard to what is actually feasible, both at the legal and factual levels. Consequently, principles are "rules of optimization", thus characterized by the fact that these can be viewed in differing degrees, and because the measurement of their performance depends not only on real possibilities, but also on legal ones, as well as issues on rules and principles. Following the method of the legal argumentation, in the constitution interpretation, hierarchy, the priorities among the various constitutional principles, is necessary so that it refers to specific types of norms laid down by the same source of law, the Constitution: in the balancing test between competing interests, the U.S. Supreme Court talks about preferred position for certain rights related to a primary constitutional value, such as freedom of expression and association, religious freedom, personal rights, and political participation. But even Italian Constitutional Court is constantly forced to choose according to what is being decided on, not only in the event of equality judgments according to Article 3 of the Constitution, but also when, in raising the standard parameter, it must choose - for example - between the right to individual freedom and right to health, or between property and company rights and recognition of the value of "primary" value of the context. The difficult search for a hierarchy of constitutionally protected values requires constant work and constant redefining and re-harmonizing of constitutional principles on the basis of the details provided by the cases to be decided upon. The statements should therefore take constitutional firm identification of an originally protected core value, requiring at the same time, through a variety of reasonable interpretations and applications, to be continually reshaped and adapted to history and politics, and to the effect of changing assumptions and of social meanings. The principles that lie at the heart of constitutions and upon which constitutional documents were formed, with the opening of new horizons and new challenges, must be continually updated, revised and put back together reasonably. They require renewed justification by judge with particular juridical habitus and critical pre-understending: he/she must have acquired, throughout his/her legal career, technical skills needed to make appropriate assessments in constitutional judgment. From the prospective of hermeneutic methodology, the habitus of the Constitutional Judge corresponds to critical pre-understanding through which one can identify whether the constitutional judgment was conducted by a judge lacking a habitus and invalidate that judgment, even regardless of proper motivation presented by the Judge. If one bears in mind that the Constitution itself is the result of the interpretation of constitutional principles, the importance of a "hermeneutic circle" between the principles in accordance with assessments of society and society itself is quite evident. In Constitutional judgement, hermeneutic circularity is highly stressed, in fact, between the court interpreter and the Constitution, the subject interpreted; it establishes a circular diachronic relationship, since the Constitution contains the principles and values belonging to the society which the constitutional Judge is part of. In the activity of the Italian Constitutional Court, it is possible to find the skeptical conception of legal interpretation, typical of common law systems: where, in terms of creativity, the Constitutional Court, through the "manipulative decisions", exceeding the legal boundaries of legal interpretation, integrates the constitutional law and carries a substitute function of the State legislature. The use of the "juridical hermeneutic" as a method of interpretation is particularly relevant before de-nationalized courts operating in legal fields having multi-state regulations, as the Court of Justice of the European Union and before the Constitutional Courts of several countries, recognizing the creative activity by the constitutional judges of civil law. Through the pre-comprehension and the circularity triadic and dyadic , the juridical hermeneutic, has became an indispensable element for interpretation of fundamental principles and for the construction and use of so-called "unwritten parameters" used, sometimes, by Italian constitutional Judges, leaping the methods based on logical argumentation techniques, for which the judge-interpreter must begin his/her legal reasoning always from the written text, to denote the value of the principle. Although the methodology hermeneutic belongs to the skeptical theory of the judicial interpretation, it provides an assessment of constitutional decision without leaving unlimited space to the will of the Judge, since hermeneutics secures a method for the controllability of the interpretive process, to prevent to the judgment of constitutionality is arbitrary or political. After the constitutional reform of 2001, the doctrine has spoken of a possible extension of constitutional legality, because the new Article 117, first paragraph, of the Constitution allows the principles descendants from European Union law and international conventions of integrate parameters of the constitutional control on the State laws. The extension of constitutional legality could have its inverse implication in the case some international law violates the fundamental principles of Italian Republican Constitution. In the contemporary European constitutionalism, that unites various juridical cultures, it appears to be of particular interest the juridical experience of Sweden: one of the most solid and efficient democracies in the world, characterized by an old constitutional tradition and a long absence of a control of constitutionality over state laws. Until recently, all the laws were interpreted by the swedish courts in full compliance and subordination to the will of the historical legislator. Lately, with the entry of Sweden in the European Union, following the recent constitutional reforms and through the introduction of a more stronger "widespread" control of constitutionality, the Swedish courts are gradually changing their traditional interpretation criteria for a more comprehensive and effective protection of human rights. ; Dottorato di ricerca in Persona, impresa e lavoro: dal diritto interno a quello internazionale (XXVIII ciclo)
L'ermeneutica filosofica di Hans-Georg Gadamer – indubbiamente uno dei capisaldi del pensiero novecentesco – rappresenta una filosofia molto composita, sfaccettata e articolata, per così dire formata da una molteplicità di dimensioni diverse che si intrecciano l'una con l'altra. Ciò risulta evidente già da un semplice sguardo alla composizione interna della sua opera principale, Wahrheit und Methode (1960), nella quale si presenta una teoria del comprendere che prende in esame tre differenti dimensioni dell'esperienza umana – arte, storia e linguaggio – ovviamente concepite come fondamentalmente correlate tra loro. Ma questo quadro d'insieme si complica notevolmente non appena si prendano in esame perlomeno alcuni dei numerosi contributi che Gadamer ha scritto e pubblicato prima e dopo il suo opus magnum: contributi che testimoniano l'importante presenza nel suo pensiero di altre tematiche. Di tale complessità, però, non sempre gli interpreti di Gadamer hanno tenuto pienamente conto, visto che una gran parte dei contributi esegetici sul suo pensiero risultano essenzialmente incentrati sul capolavoro del 1960 (ed in particolare sui problemi della legittimazione delle Geisteswissenschaften), dedicando invece minore attenzione agli altri percorsi che egli ha seguito e, in particolare, alla dimensione propriamente etica e politica della sua filosofia ermeneutica. Inoltre, mi sembra che non sempre si sia prestata la giusta attenzione alla fondamentale unitarietà – da non confondere con una presunta "sistematicità", da Gadamer esplicitamente respinta – che a dispetto dell'indubbia molteplicità ed eterogeneità del pensiero gadameriano comunque vige al suo interno. La mia tesi, dunque, è che estetica e scienze umane, filosofia del linguaggio e filosofia morale, dialogo con i Greci e confronto critico col pensiero moderno, considerazioni su problematiche antropologiche e riflessioni sulla nostra attualità sociopolitica e tecnoscientifica, rappresentino le diverse dimensioni di un solo pensiero, le quali in qualche modo vengono a convergere verso un unico centro. Un centro "unificante" che, a mio avviso, va individuato in quello che potremmo chiamare il disagio della modernità. In altre parole, mi sembra cioè che tutta la riflessione filosofica di Gadamer, in fondo, scaturisca dalla presa d'atto di una situazione di crisi o disagio nella quale si troverebbero oggi il nostro mondo e la nostra civiltà. Una crisi che, data la sua profondità e complessità, si è per così dire "ramificata" in molteplici direzioni, andando ad investire svariati ambiti dell'esistenza umana. Ambiti che pertanto vengono analizzati e indagati da Gadamer con occhio critico, cercando di far emergere i principali nodi problematici e, alla luce di ciò, di avanzare proposte alternative, rimedi, "correttivi" e possibili soluzioni. A partire da una tale comprensione di fondo, la mia ricerca si articola allora in tre grandi sezioni dedicate rispettivamente alla pars destruens dell'ermeneutica gadameriana (prima e seconda sezione) ed alla sua pars costruens (terza sezione). Nella prima sezione – intitolata Una fenomenologia della modernità: i molteplici sintomi della crisi – dopo aver evidenziato come buona parte della filosofia del Novecento sia stata dominata dall'idea di una crisi in cui verserebbe attualmente la civiltà occidentale, e come anche l'ermeneutica di Gadamer possa essere fatta rientrare in questo discorso filosofico di fondo, cerco di illustrare uno per volta quelli che, agli occhi del filosofo di Verità e metodo, rappresentano i principali sintomi della crisi attuale. Tali sintomi includono: le patologie socioeconomiche del nostro mondo "amministrato" e burocratizzato; l'indiscriminata espansione planetaria dello stile di vita occidentale a danno di altre culture; la crisi dei valori e delle certezze, con la concomitante diffusione di relativismo, scetticismo e nichilismo; la crescente incapacità a relazionarsi in maniera adeguata e significativa all'arte, alla poesia e alla cultura, sempre più degradate a mero entertainment; infine, le problematiche legate alla diffusione di armi di distruzione di massa, alla concreta possibilità di una catastrofe ecologica ed alle inquietanti prospettive dischiuse da alcune recenti scoperte scientifiche (soprattutto nell'ambito della genetica). Una volta delineato il profilo generale che Gadamer fornisce della nostra epoca, nella seconda sezione – intitolata Una diagnosi del disagio della modernità: il dilagare della razionalità strumentale tecnico-scientifica – cerco di mostrare come alla base di tutti questi fenomeni egli scorga fondamentalmente un'unica radice, coincidente peraltro a suo giudizio con l'origine stessa della modernità. Ossia, la nascita della scienza moderna ed il suo intrinseco legame con la tecnica e con una specifica forma di razionalità che Gadamer – facendo evidentemente riferimento a categorie interpretative elaborate da Max Weber, Martin Heidegger e dalla Scuola di Francoforte – definisce anche «razionalità strumentale» o «pensiero calcolante». A partire da una tale visione di fondo, cerco quindi di fornire un'analisi della concezione gadameriana della tecnoscienza, evidenziando al contempo alcuni aspetti, e cioè: primo, come l'ermeneutica filosofica di Gadamer non vada interpretata come una filosofia unilateralmente antiscientifica, bensì piuttosto come una filosofia antiscientista (il che naturalmente è qualcosa di ben diverso); secondo, come la sua ricostruzione della crisi della modernità non sfoci mai in una critica "totalizzante" della ragione, né in una filosofia della storia pessimistico-negativa incentrata sull'idea di un corso ineluttabile degli eventi guidato da una razionalità "irrazionale" e contaminata dalla brama di potere e di dominio; terzo, infine, come la filosofia di Gadamer – a dispetto delle inveterate interpretazioni che sono solite scorgervi un pensiero tradizionalista, autoritario e radicalmente anti-illuminista – non intenda affatto respingere l'illuminismo scientifico moderno tout court, né rinnegarne le più importanti conquiste, ma più semplicemente "correggerne" alcune tendenze e recuperare una nozione più ampia e comprensiva di ragione, in grado di render conto anche di quegli aspetti dell'esperienza umana che, agli occhi di una razionalità "limitata" come quella scientista, non possono che apparire come meri residui di irrazionalità. Dopo aver così esaminato nelle prime due sezioni quella che possiamo definire la pars destruens della filosofia di Gadamer, nella terza ed ultima sezione – intitolata Una terapia per la crisi della modernità: la riscoperta dell'esperienza e del sapere pratico – passo quindi ad esaminare la sua pars costruens, consistente a mio giudizio in un recupero critico di quello che egli chiama «un altro tipo di sapere». Ossia, in un tentativo di riabilitazione di tutte quelle forme pre- ed extra-scientifiche di sapere e di esperienza che Gadamer considera costitutive della «dimensione ermeneutica» dell'esistenza umana. La mia analisi della concezione gadameriana del Verstehen e dell'Erfahrung – in quanto forme di un «sapere pratico (praktisches Wissen)» differente in linea di principio da quello teorico e tecnico – conduce quindi ad un'interpretazione complessiva dell'ermeneutica filosofica come vera e propria filosofia pratica. Cioè, come uno sforzo di chiarificazione filosofica di quel sapere prescientifico, intersoggettivo e "di senso comune" effettivamente vigente nella sfera della nostra Lebenswelt e della nostra esistenza pratica. Ciò, infine, conduce anche inevitabilmente ad un'accentuazione dei risvolti etico-politici dell'ermeneutica di Gadamer. In particolare, cerco di esaminare la concezione gadameriana dell'etica – tenendo conto dei suoi rapporti con le dottrine morali di Platone, Aristotele, Kant e Hegel – e di delineare alla fine un profilo della sua ermeneutica filosofica come filosofia del dialogo, della solidarietà e della libertà. ; The philosophical hermeneutics of Hans-Georg Gadamer – one of the cornerstones in the 20th century philosophy – certainly represents a compound, prismatic and articulated thought, i.e. a philosophy made up of several different dimensions entwined with each other. A simple look at Gadamer's major work Wahrheit und Methode (1960) can already clarify this point, since the book displays a theory of understanding which takes account of three different dimensions of human experience – art, history and language – obviously conceived as mutually related. But this picture gets a lot more complicated if one takes into consideration the many books and articles Gadamer wrote before and after his magnum opus which testify the presence of other interests and topics in his thought. Nevertheless the complexity of Gadamer's philosophical hermeneutics has not always been recognized by his interpreters, who often concentrated only upon Wahrheit und Methode (in particular upon the problems of the Geisteswissenschaften) and gave no attention to other subjects (in particular the ethical and political dimension of his hermeneutical philosophy). Moreover it seems to me that many interpreters didn't pay enough attention to the fundamental unity – which of course doesn't mean "sistematicity" – that reigns in Gadamer's philosophy despite its pluralist and heterogeneous character. My point is that the many dimensions of Gadamer's philosophical hermeneutics – aesthetics and human sciences, language philosophy and moral philosophy, dialogue with the Greeks and critical confrontation with modern thought, reflections upon anthropological problems and observations concerning our actual sociopolitical, scientific and technological condition – actually represent the different sides of one thought centered on what we could define the malaise of modernity. In other words, it seems to me that the whole of Gadamer's philosophy originates from the consciousness raising of the critical situation in which our world finds itself today: a deep crisis which, according to Gadamer, branches out into manifold directions and various dimensions of human life. My interpretation tries then to give an account of both the pars destruens and pars costruens of Gadamer's philosophy, namely of his attempt to investigate and take a hard look at this critical dimensions of human existence in order to let out the point at issue and propose remedies, alternatives and possible solutions. In the first section – entitled Phenomenology of modernity: the various symptoms of the crisis – I explain how a great part of the 20th century philosophy has been concerned with the idea and the feeling of a crisis of our culture and our civilization. In my view Gadamer's hermeneutics too takes part in this global philosophical discourse. I try then to show and illustrate the various symptoms of this crisis analyzed by Gadamer, such as: socioeconomic pathologies of our bureaucratic societies; world-wide growth of the Western way of life to the detriment of other cultures; crisis of our values and beliefs (and consequent spread of relativism, skepticism and nihilism); growing inability to have meaningful relations with art, poetry and culture; finally, problems concerning the proliferation of weapons of mass destruction, the risk of an ecological crisis, and the disturbing, unpredictable consequences of some recent scientific discoveries (above all in the field of genetics). Once outlined Gadamer's critical view of our age, in the second section – entitled Diagnosis of the malaise of modernity: the spread of instrumental and techno-scientific reason – I try to show how, according to Gadamer, a common root lies at the base of the many symptoms of the crisis, namely the birth of modern science and its close, intrinsic relationship with technique and with a specific form of rationality that Gadamer – with reference to the analysis developed by such thinkers as Max Weber, Martin Heidegger and the so-called Frankfurt School – calls «instrumental reason» or «calculating thinking». I try then to give an account of the gadamerian conception of techno-science, meanwhile highlighting some aspects: first, how Gadamer's philosophical hermeneutics should not be interpreted as an antiscientific thought but rather as an antiscientistic thought (which of course is something quite different); second, how Gadamer's reconstruction of the malaise of modernity never ends up in a "totalizing" critique of reason, nor in some sort of negativistic and pessimistic philosophy of history centered on the idea of an inescapable course of the events guided by a polluted, "irrational" rationality; third, how Gadamer – despite all the inveterate interpretations that read his philosophy as a form of authoritarian, traditionalist and antienlightenment thought – never aimed to reject the modern scientific Enlightenment tout court but rather to "correct" some of its tendencies and so to regain a wider and more comprehensive concept of reason. After having analyzed in the first two sections the pars destruens of Gadamer's philosophy, in the third and last section of my work – entitled Therapy of the crisis of modernity: the rediscovery of experience and practical knowledge – I take into consideration the pars costruens of his thought, which according to my interpretation consists of a rediscovery of what he calls «a different kind of knowledge», i.e. of a rehabilitation of the all those forms of pre- and extra-scientific experience that constitute the «hermeneutical dimension» of human life. My analysis of Gadamer's conception of understanding and experience – seen as forms of «practical knowledge» different in principle from theoretical and technical knowledge – leads then to a global interpretation of philosophical hermeneutics as practical philosophy, i.e. as a philosophical elucidation of the prescientific, intersubjective and "of commonsense" reasoning which characterizes our «life-world» and our practical life. But obviously this analysis also implies a special consideration of the ethical and political implications of Gadamer's thought. In particular, I try to examine Gadamer's conception of ethics – taking account of his relation with Plato's, Aristotle's, Kant's and Hegel's moral theories – and finally I sketch an outline of his philosophical hermeneutics as a philosophy of freedom, dialogue and solidarity.
Housing tenure structures differ considerably across OECD countries. Typically, the share of owner-occupied housing is very high in Southern European countries (Spain, Italy, Greece), while relatively low in Austria, Germany, France, the Netherlands and in some Nordic countries such as Sweden, Finland and Denmark (see Catte et al. [2004]). This share has increased in most OECD countries during last two decades. Italy, Spain, Portugal, the Netherlands and Belgium registered the largest increases from the eighties to the mid of the first decade of the century. In the UK, the homeonwership rate increased steadily up to 2005, then dropped sharply in the last few years. High homeownership rates and their increments have been in part determined by pro-ownership policies implemented throughout most OECD countries. Such policies can take the vest of tax reliefs for mortgage interest payments, exemptions for capital gains taxation applied to residential property, or generous subsidies for low-income families to reduce the costs of homeownership. Although the orientation of several governments, particularly in Europe, has been to promote homeownership, economists have raised several concerns about the consequences of large homeownership shares on the functioning of the labour market. The analysis of the relation between the housing tenure and the labour market dates back to mid-nineties, when Andrew Oswald pinned on high homeownership rates the blame for the high unemployment rates in Europe (Oswald [1996], Oswald [1997], Oswald [1999]). Making use of aggregate data, Oswald found a strong positive statistical association between the two rates at the international and regional level. Thus, his receipt to reduce unemployment was strikingly at odds with the prevailing political wisdom: "We can put Europe back to work . . . by reducing homeownership" (Oswald [1999])1. Oswald identified five mechanisms that drive the positive impact on unemployment. These are mostly related to the idea that the mobility constraints imposed by homeownership introduce frictions in the labour market which harm its efficiency. The first and most important, is a direct effect. Owner occupiers incur higher transaction costs for selling home and moving to a new accommodation, which can be even higher whenever capital gains for houses are taxed and there are no exemptions. The other four mechanisms can be thought as externalities of homeownership. Second, where the rental market is thin, everyone, regardless of the housing tenure, can have difficulties in finding the accommodation close to the job they aspire to, so that efficient job matches are hindered. This is the case even for mobile people who would be happy to move for job reasons, such as young still living in the family-home in a kind of free-rent status. Third, owning the accommodation hampers also job-to-job changes and prolong poor job matches hence harming the whole economic system efficiency. Fourth, owner-occupiers are more likely than renters to lobby for deterring entrepreneurs from investing in their residential area. Fifth, since owners commute much more than renters, and over longer distances, higher homeownership rates in the area lead to higher transport costs and possibly to congestion costs, which make getting to work more costly for everyone and act as a sort of unemployment benefits in increasing the relative attractiveness of not working. Although the argument underlying a positive relationship between homeownership and unemployment originates from macroeconomic evidence, its theoretical foundations are mainly microeconomic and a vast part of the empirical research carried out subsequently has been based on micro data. The typical test of the so-called "Oswald thesis" consists in estimating the homeownership effect on the duration of the unemployment spell or, less often, on the probability to be unemployed. The expected sign is positive, along the main idea that higher mobility costs due to property holding reduce the willingness to accept job offers which require a residential move. Fewer studies, and only recently, have focused on the employment duration, testing whether homeownership can reduce job finding rates also for people already employed. Generally, empirical tests on micro data find no support for the Oswald hypothesis, and in most cases even that homeowners have shorter unemployment spells and lower likelihood to be unemployed, which are exactly counter-Oswald results. However, homeownership seems to increase job stability by hampering job-to-job changes for people already employed. As regards unemployment outcomes, the existing literature has put forward two possible reasons for the falsification of the Oswald hypothesis. The first one looks at the different effect of mobility costs on job search behavior in the local and in the non-local labour market. In fact, homeowners may have higher reservation wages for jobs which require a residential move (nonlocal market), but also lower reservation wages for jobs which do not (local market), so that job finding rates for the latter may be as high as to offset the lower rates for jobs in a distant area. Thus, whether the total job finding rate is lower for homeowners or for renters is just an empirical matter which depends on the magnitude of these two opposite effects. The second explanation points out the need for a refinement in the definition of the residential status. On the one hand, one should distinguish between owners who have to comply with mortgage payments and outright owners, as housing financial commitments can bear higher pressure to return to work or to keep on with the current job. For mortgage-holders, these financial constraints can counteract the effect of the reduced mobility due to ownership. On the other hand, unemployment outcomes can be different also for private and social renters. In fact, below-market rent, long waiting lists, security of tenure and the restricted transferability within social housing, can harm the relative performance of social renters. In this work, we aim at investigating the validity of the "Oswald thesis" taking into account the recent refinements by following both a theoretical and an empirical approach. The focus will be on UK micro data. In particular, we will make use of the two leading UK Surveys, the UK Quarterly Labour Force Survey and the British Household Panel Survey. In the first chapter, we investigate the relation between job search effort of unemployed and housing tenure. We test this relation focusing on the impact of the UK Jobseeker's Allowance reform introduced in the UK in October 1996, whose main aspect was a strengthening of search requirements for eligibility to the unemployment benefit. We revisit a simple model of search in which we introduce moving costs and housing costs to capture the two channels through which the degree of attachment to the accommodation influences search behaviour. Our theory suggests that a tightening in job search requirements, as implied by this reform, raises movements off benefit of non-employed with low search intensity and that this effect should adjust in size depending on the different housing tenure. We draw a dataset from the Labour Force Survey for the period 1995-1997, and by means of a Difference-in-Differences approach we analyze the impact of the reform on the claimant outflow. Average Treatment Effect estimates suggest that the impact of the reform is related to housing tenure. Specifically, renters account for a major portion of claimants who were crowded out of the benefit without finding a job, while the effect on outright owners and mortgagers is lower. Empirical evidence from our dataset clearly confirms that mortgagers search for a job more intensively than renters, as our model predicts. This latter finding is consistent with a higher estimated treatment effect for renters, since a high initial search intensity seems the key to insulate oneself from the impact of the tightening of search requirements. In the second chapter we attempt to reconcile the empirical evidence with the argument in favour of a negative effect of homeownership on exit rates from unemployment. Taking into account some likely reasons for the falsification of the Oswald's thesis, we provide evidence which supports it. At first, in a theoretical model of endogenous job search adapted to distinguish between local and non-local labour markets, we show that homeowners higher moving costs imply unambiguously lower search and lower job finding rates, even though an opposite effect works for jobs which do not require a move. Then, in the empirical analysis we make use of data drawn from the British Household Panel Survey to compare job search intensity measures by housing tenure. In defining the residential status, we distinguish between outright owners and mortgage-holders, and between social and private renters. We find that, controlling for housing costs and for the four-fold tenure definition, non-employed outright owners have definitely a lower attachment to the labour market than renters, and that this effect is even more evident when we compare them to private renters. In the third chapter, we analyse the impact of the housing tenure on labour market outcomes using individual data from the UK labour Force Survey. We estimate both a binary model for the probability to be unemployed and a hazard model for exits out of unemployment. In both models we test for endogeneity of housing tenure. In the binary model, exogeneity is rejected so we perform endogenous multinomial treatment effects estimates. In the hazard model, we find no evidence of unobserved heterogeneity thus estimates are performed assuming exogeneity. Results show that mortgagers have the lowest probability to be unemployed and the highest job finding rates, while social renters exhibit the worst performance. Whether private renters perform better than outright owners is a matter of debate: while we have no evidence in favour of this claim, the evidence in favour of the opposite is only modest.
2009/2010 ; Lo scopo di questa ricerca di dottorato è l'analisi geopolitica di una regione transfrontaliera dell'Asia centrale: la valle del Fergana. Tre anni di ricerca sul campo: l'analisi delle frontiere di questa regione attualmente divisa politicamente tra Uzbekistan, Tagikistan e Kirghizistan, la cartografia analitica, le osservazioni, le interviste alla popolazione e agli esperti, la ricerca nelle biblioteche della regione, nella capitale dell'Uzbekistan, Tashkent (presso l'Istituto Francese di Studi sull'Asia centrale – IFEAC) e la ricerca svolta in Francia principalmente presso l'Istituto Francese di Geopolitica (IFG) e la Biblioteca Nazionale di Francia (BNF), sono gli strumenti che hanno permesso lo studio di questo territorio. Il principale obiettivo del lavoro è l'analisi delle rivalità di potere della valle del Fergana. Grazie alla sua fertilità e alla sua importante posizione strategica all'interno del contesto geopolitico centrasiatico, il bacino del Fergana è stato e continua tuttora ad essere una posta in gioco ambita da differenti attori territoriali. La rivalità di potere tra i diversi attori si gioca soprattutto sullo scenario transfrontaliero della regione. Il secondo scopo di questa ricerca è la presentazione e la valutazione di un particolare attore territoriale della valle, il Regionalismo culturale. La parte introduttiva della ricerca si concentrerà su una presentazione del contesto centrasiatico e sulle peculiarità derivanti dalle sue frontiere. In seguito verrà introdotta la "posta in gioco" Fergana con le sue risorse fisiche ed economiche al fine di legittimare l'importanza del territorio. Infine l'introduzione si concluderà con la teoria geopolitica: il perché della scelta della scuola di geopolitica del geografo francese Yves Lacoste per questa ricerca e una prima analisi dello spazio Fergana come regione divisa tra confine e frontiera. Il lavoro è strutturato in due grandi parti. La prima, più teorica, è relativa all'analisi dei tre attori territoriali. Le rappresentazioni dei differenti attori che verranno presentate, non seguiranno un ordine cronologico, ma un ordine concettuale: eventi simultanei verranno dunque analizzati non nello stesso momento, perché relativi a rappresentazioni differenti del territorio Fergana. Il primo capitolo è consacrato all'attore Nazione. Con questa espressione si intende non solo l'attore Stato-Nazione in sé, o meglio gli Stati-Nazione (Uzbekistan, Tagikistan e Kirghizistan), ma anche la Nazione come idea, come politica nazionalistica applicata ad un territorio. La valle del Fergana è diventata una regione transfrontaliera da quando, negli anni '20, fu divisa tra i tre Stati, allora all'interno della Unione delle Repubbliche Socialiste Sovietiche (URSS). Negli anni '90, in seguito alla caduta dell'URSS, il Fergana divenne una regione divisa da frontiere non più interne ma internazionali. Questo capitolo ha come scopo l'analisi di tutte le rappresentazioni dell'attore Nazione per quanto riguarda il contesto Fergana, dalla sua nascita (anni '20) fino all'indipendenza delle Repubbliche (anni '90). Sicuramente la rappresentazione più importante da analizzare è quella della creazione delle sue frontiere. L'attore Nazione è senza dubbio l'attore geopolitico più importante anche perché quello più legittimato in questo contesto territoriale. Il capitolo approfondirà anche le relazioni tra i differenti Stati-Nazione che rappresentano allo stesso tempo: un unico attore (contro la Religione e il Regionalismo culturale) e tre attori differenti quando competono tra loro per il territorio Fergana. Il secondo attore è la Religione. La valle del Fergana è una delle aree centrasiatiche più credenti e praticanti e la religione islamica ha sempre avuto un ruolo importante nella gestione della società ferganiana. Verrà proposta un'analisi di tutte le rappresentazioni della religione nel Fergana: il sufismo autoctono con un'analisi sulla geografia sacra dei luoghi ferganiani importanti per questa corrente dell'Islam; l'Islam tradizionale del periodo sovietico, divenuto un'arma legale utilizzata da Mosca per combattere l'ortodossia religiosa sufi del Fergana; il fondamentalismo wahabbita degli ultimi anni importato dall'Afghanistan, dal Pakistan, dall'Arabia Saudita, come conseguenza dell'invasione sovietica dell'Afghanistan del 1979 e dunque in seguito all'incontro tra i musulmani sovietici e i mujaheddin afgani. In seguito verrà analizzato come le differenti varianti dell'attore Religione si sono opposte, negli anni, all'attore Nazione per il controllo del potere e delle risorse del territorio Fergana. Un fenomeno particolarmente analizzato sarà la politicizzazione dell'attore Religione e come questa politicizzazione ha portato l'attore in questione ad essere l'elemento protagonista di numerosi eventi nel Fergana. Il terzo attore è il Regionalismo culturale. Con questa espressione si fa riferimento all'identità geo-culturale di questo insieme regionale che persiste nonostante le pressioni nazionalistiche e religiose. La valle del Fergana è sempre stata un insieme geografico, politico, sociale, malgrado negli ultimi secoli la sua popolazione si è sempre distinta per il suo alto livello di multietnicità e di disomogeneità linguistica. Questo però, non ha impedito un'amalgamazione sociale di tale popolazione che ha sempre considerato la multietnicità come la normalità e ha sempre attribuito ad ogni "etnia" un ruolo sociale integrato all'interno del sistema Fergana. Popolazioni di lingua e cultura persiana e sedentaria e popolazioni di lingua e cultura turca, sedentaria o nomade hanno sempre condiviso, ognuna con il proprio ruolo sociale, una vita comunitaria all'interno della regione e questa è sicuramente la caratteristica principale del Regionalismo culturale del Fergana. Questo equilibrio cambiò con la perdita di sovranità politica della regione, con l'istituzione dei nazionalismi e la conseguente spartizione della regione tra tre dei cinque nuovi Stati nazionali dell'Asia centrale sovietica. In questo capitolo verranno analizzate le principali rappresentazioni nel tempo dell'attore Regionalismo culturale e come esso si sia opposto agli altri attori territoriali, soprattutto all'attore Nazione. La seconda parte di questo lavoro è stata dedicata all'impatto che gli attori territoriali hanno oggi nella valle del Fergana, soprattutto nelle sue aree di frontiera. Questa parte è il risultato delle interviste e delle osservazioni sul campo effettuate in Asia centrale e in particolare nel Fergana nelle spedizioni del 2007, 2009 e del 2010. Nel primo capitolo verrà analizzata la frontiera di questa regione dal punto di vista teorico, in particolar modo con l'analisi del Fergana come" prima o ultima linea di difesa". Nel secondo capitolo, all'interno di un contesto di base: la differenza tra la frontiera all'epoca sovietica e all'epoca dell'indipendenza, ci sarà un approfondimento della definizione di frontiera centrasiatica, l'esame della burocrazia di frontiera, del posto di blocco e dei documenti del soggetto transfrontaliero. Saranno trattate, inoltre, le tematiche relative alle relazioni commerciali transfrontaliere, come i "tre" Fergana riescono ancora ad interagire malgrado la crescente rigidità delle frontiere e verranno studiate le relazioni sociali transfrontaliere sempre all'interno del panorama ferganiano di oggi. In questo contesto, verranno considerate le interviste svolte nel Fergana, le opinioni riguardo le difficoltà di passaggio e di comunicazione nella valle ed analizzeremo la presenza dei tre attori geopolitici che tuttora giocano un ruolo fondamentale nelle relazioni e nei conflitti di frontiera. Il terzo capitolo sarà dedicato ai centri urbani del Fergana; la loro storia, il rapporto dei ferganiani con le città e soprattutto le rappresentazioni interne ed esterne che i centri urbani hanno assunto all'interno di una regione oggi del tutto transfrontaliera. Il quarto capitolo si concentrerà sulle evoluzioni demografiche della popolazione: il Fergana, che durante gli anni zaristi e sovietici era terra di immigrazione, con l'indipendenza e dunque con la concretizzazione delle frontiere, si ritrova terra di emigrazione. Il quinto capitolo sarà dedicato al Fergana delle infrastrutture: come la strada ferrata e la rete stradale influiscono e sono influenzate dalle mutazioni frontaliere di questa regione. Il sesto capitolo riprenderà degli interrogativi teorici posti all'inizio del lavoro, con un analisi conclusiva sull'odierno "Fergana delle frontiere". La conclusione di questa ricerca, in realtà, è una vero e proprio capitolo di analisi, dove si farà il punto della situazione e si constaterà la persistenza dell'attore Regionalismo culturale, la sua evoluzione e il suo rapporto attuale con gli altri attori geopolitici. Un punto di arrivo fondamentale della ricerca è il fatto che la regione Fergana è cambiata, sotto differenti punti di vista e la popolazione ferganiana ha nuovi punti di riferimento culturali, politici e sociali. Differenti forme politiche e nuove strutture culturali hanno portato la popolazione del Fergana, nel tempo, a mutare la propria immagine e la propria identità: "russa, musulmana, ferganiana", in seguito "sovietica, uzbeca (o tagica o kirghiza), atea, ferganiana" e infine "uzbeca (o tagica o kirghiza), laica, ferganiana". Il territorio, le sue frontiere e la società che lo abita sono cambiati, ma vedremo che, nonostante i forti ostacoli posti dall'attore Nazione, il Regionalismo culturale riuscirà a sopravvivere, adattandosi alle nuove tendenze e ai nuovi modi di interpretare il Fergana. Come ultimo studio sul territorio, faremo degli esempi riguardanti gli eventi più recenti concernenti il Fergana (massacro di Andijan nel 2005, scontri ad Osh nel giugno 2010) ed analizzeremo questi fenomeni alla luce delle rivalità di potere geopolitiche che ancora persistono nella regione. ; Cette thèse de Doctorat propose une analyse géopolitique d'une région transfrontalière de l'Asie centrale, la vallée du Ferghana, aujourd'hui divisée entre les Républiques d'Ouzbékistan, du Tadjikistan et du Kirghizistan. Des séjours sur le terrain répartis sur trois ans ont constitué la base de la recherche, au travers de l'analyse des frontières, de la cartographie analytique, d'entretiens qualitatifs avec experts et habitants, et de recherches bibliographiques dans le Ferghana ainsi que dans la capitale ouzbèke Tachkent – notamment près l'Institut Français d'Etudes sur l'Asie Centrale (IFEAC). Ces périodes de terrain ont été complétées par un séjour de recherche en France, articulé principalement autour d'un approfondissement théorique à l'Institut Français de Géopolitique (IFG) de l'Université Paris VIII-Vincennes et de recherches bibliographiques à la Bibliothèque Nationale de France. L'objet de ce travail est donc l'analyse des rivalités de pouvoir entre les acteurs territoriaux sur l'enjeu territorial de la vallée du Ferghana, bassin fertile à la position stratégique dans le contexte géopolitique centrasiatique élargi. Si le Ferghana a toujours constitué un enjeu disputé par différents acteurs territoriaux, les rivalités des acteurs actuels jouent aujourd'hui surtout au niveau frontalier et transfrontalier. Ce faisant, cette thèse introduit un nouvel acteur dans le schéma d'analyse géopolitique classique: le Régionalisme culturel. Le Régionalisme culturel en tant qu'acteur territorial y fait donc l'objet d'une présentation approfondie ainsi que d'une évaluation de son importance passée et actuelle. Concentrée d'abord sur le contexte centrasiatique et les particularités qui découlent de ses frontières, l'introduction présente ensuite « l'enjeu » Ferghana et ses ressources physiques et économiques, qui expliquent l'importance de ce territoire. Elle se poursuit sur un rapide point théorique sur la géopolitique et la justification du choix de l'école de pensée géopolitique de Yves Lacoste comme cadre théorique de cette recherche, avant de s'achever sur une première analyse de l'espace Ferghana à l'aune des catégories de frontières et de confins. La thèse est structurée en deux grandes parties. La première, à dominante théorique, analyse à tour de rôle les trois acteurs territoriaux qui rivalisent pour le pouvoir sur le Ferghana: il s'agit de la Nation, de la Religion, et du Régionalisme culturel. La présentation des acteurs, de leurs différentes incarnations et de leurs représentations respectives du territoire ferghanien sont ainsi abordés selon un ordre conceptuel ; des évènements s'étant produits simultanément ne sont ainsi pas analysés chronologiquement mais séparément, en tant qu'ils se rapportent aux acteurs évoqués. Le premier chapitre est consacré à l'acteur Nation. Par cette expression nous entendons non seulement l'entité effective Etat-Nation et ses trois incarnations (Ouzbékistan, Tadjikistan, Kirghizistan), mais aussi la Nation comme idéologie qui agit sur le territoire au travers de politiques nationalistes. La force de légitimation de l'acteur Nation n'est pas étrangère à l'accroissement de son importance sur ce territoire, qui l'a sans aucun doute mené au sommet de la hiérarchie des acteurs géopolitiques dans cette région. Ce chapitre analyse les représentations du Ferghana définies et mises en oeuvres par l'acteur Nation depuis son apparition dans les années 1920. La vallée du Ferghana est en effet devenue une région transfrontalière à cette époque, avec son intégration à l'Union des Républiques Socialistes Soviétiques (URSS) et sa partition entre trois des cinq Républiques Socialistes Soviétiques nouvellement créées en Asie Centrale. Dans les années 1990, avec la chute de l'URSS et l'indépendance des trois Républiques, les frontières qui divisaient le Ferghana ne sont plus simplement internes, mais deviennent bel et bien internationales. Parmi les représentations majeures qui font l'objet d'une étude dans ce chapitre, une attention particulière est portée aux frontières nationales, leur création et leur évolution. Le chapitre s'intéresse également aux relations entre les différents Etats-Nations, qui constituent un acteur unique lorsqu'ils rivalisent contre les autres acteurs territoriaux – la Religion et le Régionalisme culturel – mais aussi trois acteurs différenciés lorsqu'ils se disputent le territoire Ferghana entre eux. Le deuxième chapitre est consacré au deuxième acteur territorial, la Religion. La vallée du Ferghana est l'une des régions d'Asie centrale les plus croyantes et pratiquantes, et la religion islamique y a toujours eu un rôle important dans la gestion de la société. Ce chapitre propose d'abord une analyse des représentations de la religion dans le Ferghana : le soufisme autochtone et la "géographie sacrée" des hauts lieux de ce courant de l'Islam dans le Ferghana ; l'Islam traditionnel de la période soviétique, devenu une arme légale utilisée par Moscou pour combattre l'orthodoxie soufie du Ferghana ; le fondamentalisme wahabbite récemment apparu, importé d'Afghanistan, du Pakistan et d'Arabie Saoudite à la suite de l'invasion de l'Afghanistan par les Soviétiques en 1979 et de la rencontre qui s'en est ensuivie entre les musulmans soviétiques et les moudjahiddines afghans. Ensuite est examinée la manière dont les différentes variantes de l'acteur Religion se sont opposées, au cours des années, à l'acteur Nation pour le contrôle du pouvoir et des ressources du territoire Ferghana. Nous y voyons comment la rivalité géopolitique entre deux acteurs varie du tout au tout selon que l'on parle de l'acteur Nation au cours de la période Soviétique ou bien au cours de l'ère ayant succédé à l'indépendance. Une attention particulière est portée au phénomène de politisation de l'acteur Religion et à la manière dont cette politisation a amené la Religion à assumer un rôle de protagoniste dans de nombreux évènements du Ferghana. Le troisième acteur est le Régionalisme culturel. Avec cette expression nous faisons référence à l'identité géo-culturelle de cet ensemble régional, qui persiste malgré les pressions nationalistes et religieuses. Car aussi loin que remonte son existence en tant que lieu, la vallée du Ferghana a toujours constitué un ensemble géographique, politique et social à part entière. Bien que sa population se soit distinguée au cours des derniers siècles par une grande multiethnicité et hétérogénéité linguistique, cela n'a pas empêché un amalgame sociétal de cette population qui a toujours considéré la multiethnicité comme normale, et toujours a attribué à chaque « ethnie » un rôle social déterminé au sein du système Ferghana. Qu'elles soient de langue et de culture persane et sédentaire, de langue et de culture turque et sédentaire, ou bien de langue et de culture turque et nomade, ces populations ont toujours partagé, chacune dans son propre rôle social, une vie communautaire au sein de la région, et ce phénomène est la caractéristique principale de ce que nous appelons le Régionalisme culturel du Ferghana. Cependant, cet équilibre change avec la perte de souveraineté politique de la région, l'avènement du nationalisme sous l'action de l'URSS, et la partition de l'espace entre trois Etats nations de l'Asie centrale soviétique. Ce chapitre analyse ainsi les principales représentations de l'acteur Régionalisme culturel au cours du temps, et comment il s'est opposé aux autres acteurs territoriaux, en particulier à l'acteur Nation. La seconde partie de ce travail est dédiée aux manifestations actuelles des acteurs territoriaux dans la vallée du Ferghana, plus spécialement dans ses zones de frontière. Cette partie est le résultat des entretiens et des observations de terrain réalisés en Asie centrale et dans le Ferghana au cours de séjours en 2007, 2009 et 2010. Le premier chapitre analyse la frontière de cette région du point de vue théorique, à la lumière notamment des catégories géostratégiques de "première ligne de défense" ou "dernière ligne de défense". Dans le contexte d'une modification de la frontière entre l'époque soviétique et celle de l'indépendance, le deuxième chapitre approfondit la définition de frontière centrasiatique, au travers principalement de l'analyse de la bureaucratie de frontière, des postes de contrôle et des documents requis pour le passage de la frontière. Les thématiques liées aux relations commerciales transfrontalières y sont examinées : comment les "trois" Ferghana parviennent encore à interagir malgré la rigidité croissante des frontières, quelles relations sociales transfrontalières subsistent au sein du Ferghana d'aujourd'hui. Les entretiens qualitatifs réalisés dans le Ferghana jouent un rôle majeur pour recenser les difficultés de passage et de communication dans la vallée et déceler, dans les descriptions et jugements recueillis, la présence des trois acteurs géopolitiques qui toujours jouent un rôle fondamental dans les relations et conflits de frontière. Le troisième chapitre est dédié aux centres urbains du Ferghana : leur histoire, le rapport que les Ferghaniens entretiennent avec eux, et surtout les représentations internes et externes que les centres urbains assument au sein d'une région désormais tout à fait transfrontalière. Le quatrième chapitre se concentre sur les évolutions démographiques de la population. Jusque là terre d'immigration tout au long des années tsaristes et soviétiques, le Ferghana est devenu une terre d'émigration avec l'indépendance et la concrétisation des frontières. Le cinquième chapitre s'intéresse au Ferghana des infrastructures, notamment les réseaux ferré et routier, et leur rapport d'influence réciproque mutations frontalières de cette région. Le sixième chapitre reprend les interrogations théoriques posées dans l'introduction et développe une analyse conclusive sur le Ferghana des frontières aujourd'hui. La conclusion de cette recherche dresse le bilan actuel du Ferghana et des rapports entre les différents acteurs géopolitiques, et observe la persistance de l'acteur Régionalisme culturel. Force est de constater l'existence de changements dans la région Ferghana à différents points de vue. La population ferghanienne dispose de nouveaux cadres de référence culturels, politiques et sociaux qui ont pris une importance majeure. Des nouvelles formes politiques et de structures culturelles ont eu un impact sur son image d'elle-même, sur son identité: "russe, musulmane,ferghanienne", puis "soviétique, ouzbèke (ou tadjike ou kirghiz), athée, ferghanienne", et enfin "ouzbèke (ou tadjike ou kirghiz), laïque, ferghanienne". Cependant, bien que le territoire, ses frontières et la société qui l'habite aient changé, et malgré les obstacles forts posés par l'acteur Nation, que Régionalisme culturel a réussi à survivre, en s'adaptant aux nouvelles tendances et aux nouveaux modes d'interprétation du Ferghana. La conclusion s'achève sur les évènements les plus récents du Ferghana; massacre d'Andijan en 2005 et affrontements à Osh en juin 2010, qui sont analysés à la lumière des rivalités de pouvoir géopolitique qui persistent encore dans la région. ; This PhD dissertation proposes a geopolitical analysis of a centrasiatic transborder region, the Ferghana Valley, which is today divided between the Republics of Uzbekistan, Tajikistan and Kyrgyzstan. A basis of the research, field trips spread over the past three years enabled the development of instruments such as border analysis, analytical cartography, qualitative interviews with experts and inhabitants, and bibliographical research in the Ferghana as well as the Uzbek capital city Tashkent – noticeably at the French Institute for Central Asian Studies (IFEAC). As a complement to the field trips in Central Asia, a research period in France permitted both a consolidation in geopolitical theory at the French Institute of Geopolitics (IFG) of the University of Paris 8-Vincennes, and additional bibliographical research at the French National Library (BNF). The topic of the research is hence the analysis of power rivalries between "territorial actors" over the "territorial stake" of the Fergana Valley, a fertile basin of strategical location within the larger geopolitical context of Central Asia. Always a stake disputed by various territorial actors over time, the Fergana Valley now experiences power rivalries from contemporaneous territorial actors first and foremost on the border and transborder levels. By doing so, the dissertation introduces a new actor in the classical geopolitical pattern of analysis: the cultural regionalism. The dissertation hence offers a detailed presentation of the cultural regionalism as well as an evaluation of its past and current importance. First focusing on the centrasiatic context and the peculiarities which stem from its borders, the introduction presents the "stake" Fergana and its economic and physical resources which explain its importance as a territory. A rapid summary of the theory of geopolitics follows, with the justification of the choice of the French Lacostian school as the theoretical frame of this work. The introduction closes on a first analysis of the Fergana as a space of border or frontier. The thesis is structured in two main parts. The first, more theoretical, analyses each of the three territorial actors which aim for power over the Fergana: the Nation, the Religion, and the Cultural Regionalism. The presentation of the actors, of their respective embodiments and of their manifestations within the ferganian territory is organised according to a conceptual rationale; events that occurred simultaneously are thus not considered following a chronological order, but separately, according to their respective relations with the actors evoked. The first chapter focuses on the actor Nation. By this word we understand not only the effective entity of the Nation-State, and its three embodiments (Uzbekistan, Tajikistan, Kyrgyzstan), but also the Nation as an ideology which acts upon the territory through nationalistic policies. The force of legitimation of the actor Nation did certainly not have a neutral role in the rise of this actor in the Ferganian landscape, a process which led the Nation to the top of the geopolitical actors' hierarchy in the region. This chapter also analyses the representations of the Fergana which are defined and implemented by the actor Nation since its birth in the 1920s. In fact, the Fergana valley first became a transborder region only in these years, through its integration to the Union of the Socialist Soviet Republics (USSR) and its partition between three of the five newly created Socialist Soviet Republics in Central Asia. In the 1990s, following the fall of the USSR and the independence of the three Republics, the borders which divided the Ferghana stopped being only internal, but became real and proper international borders. Among the main representations that this study looks at, a particular attention is devoted to the study of the national borders , their creation and their evolution. The chapter also looks at the relations between the different Nation-States, which form a unique actor when they rival against the other territorial actors – the Religion and the Cultural Regionalism –, but three well different ones when they rival among themselves. The second chapter concentrates upon the second territorial actor, the Religion. The Fergana valley is one of the most pious and practicing region of Central Asia, and the Islamic religion always played a major role in the society's administration and organization. The chapter proposes first an analysis of the religion's representations in the Fergana: the autochthonous sufism and its sacred geography within the Fergana valley ; the traditional Islam of the soviet times, which became a legal weapon used by Moscow to fight the sufi orthodoxy in the Fergana ; the recently appeared wahabbite fundamentalism, imported from Afghanistan, Pakistan and Saudi Arabia following the Soviet invasion of Afghanistan in 1979 and the encounter it induced between the soviet muslims and the afghan mujaheddins. It is then examined how the different variations of the actor opposed themselves to the actor Nation, over the years, for the control over the power and the resources of the Fergana. We look at how the geopolitical rivalries vary dramatically from the soviet era to that of the independence. A special attention is devoted to the phenomenon of politization of the actor Religion and the way this led the Religion to endorse a role of protagonist in many of the Fergana's events. The third actor is the Cultural Regionalism. It is hereby referred to the geo-cultural identity of this regional entity, which persists in spite of nationalistic and religious pressures. In fact, as long as the Fergana has existed as a place, it has always constituted a geographical, political and social whole. Although its population has been characterized during the past centuries by high levels of multiethnicity and linguistic heterogeneity, this did not prevent the societal amalgamation of populations which always held multiethnicity as normality, and always attributed to each "group" a specific social role within the system Fergana. Be they of language and culture persian and sedentary, turk and sedentary or turk and nomadic, these populations always shared, each in its own social role, a common life within the region. This very phenomenon is the main characteristic of what we call the Cultural Regionalism of the Fergana. However, this equilibrium changes with the loss of political sovereignty of the region and the rise of nationalism under the soviet sovereignty. This chapter analyzes the main representation of the actor Cultural Regionalism over time, and how it took stand against the other territorial actors, especially the Nation. The second part of the dissertation as dedicated to the current manifestations of the territorial actors in the Fergana valley, particularly in its border zones. This part results from the interviews and field observation undertaken in Central Asia and the Fergana in 2007, 2009 and 2010. The first chapter analyzes the border of this region from a theoretical point of view, especially in the light of the geostrategical categories of "first line of defence" or "last line of defence". In the context of a transformation of the border from the soviet era to that of the independence, the second chapter explores the definition of the centrasiatic border, mainly through the analysis of border bureaucracy, control posts and documents required to cross the border. The chapter looks at themes connected to the commercial transborder relations : how the "three" Fergana still manage to interact despite growing border rigidity, which social relationships subsist today. The qualitative interviews led in the Fergana are a major source in this process of reviewing the difficulties of passage and communication within the valley, and of tracking the actual presence of the three geopolitical actors which play a major role in the border relations and conflicts. The third chapter focuses on the Ferganian urban centres: their history, the relations that the Ferganians have with them, et above all the internal and external representations of these centres in a now fully transborder region. The fourth chapter concentrates on the demographical evolutions of the Ferganian population. Up until then a land of immigration, the Fergana became a land of emigration following the independence and the materialization of the borders. The fifth chapter deals with the Ferganian infrastructures, especially the rail and road networks, and their relationship of reciprocal influence with the mutation of the borders in the region. The sixth chapter builds on the theoretical interrogations evoked in the introduction of the dissertation and develops a conclusive analysis of the Fergana of the borders nowadays. The conclusion of this research depicts the current Fergana, the relations between the different geopolitical actors and underscores the persistence of the actor Cultural Regionalism. It establishes the existence of tremendous changes in the region Fergana from various viewpoints: the Ferganian population has new frames of cultural, political and social reference whose importance increased dramatically ; new political forms and cultural structures influenced its self-image, its very identity: "russian, muslim, ferganian", then "soviet, uzbek (or tajik or kyrgyz), atheist, ferganian", finally "uzbek (or tajik or kyrgyz), secular, ferganian". However, although the territory, its borders and inhabitants changed, and despite the strong obstacles set by the actor Nation, the cultural regionalism succeeded in maintaining itself, by adapting to the new tendencies and ways of interpretation of the Fergana. The conclusion ends with the most recent events of the Fergana, the Andjian massacre in 2005 and the Osh clash in 2010, which are both analysed in the light of the geopolitical power rivalries which persist in the region. ; XXIII Ciclo
La ricerca si propone di definire le linee guida per la stesura di un Piano che si occupi di qualità della vita e di benessere. Il richiamo alla qualità e al benessere è positivamente innovativo, in quanto impone agli organi decisionali di sintonizzarsi con la soggettività attiva dei cittadini e, contemporaneamente, rende evidente la necessità di un approccio più ampio e trasversale al tema della città e di una più stretta relazione dei tecnici/esperti con i responsabili degli organismi politicoamministrativi. La ricerca vuole indagare i limiti dell'urbanistica moderna di fronte alla complessità di bisogni e di nuove necessità espresse dalle popolazioni urbane contemporanee. La domanda dei servizi è notevolmente cambiata rispetto a quella degli anni Sessanta, oltre che sul piano quantitativo anche e soprattutto sul piano qualitativo, a causa degli intervenuti cambiamenti sociali che hanno trasformato la città moderna non solo dal punto di vista strutturale ma anche dal punto di vista culturale: l'intermittenza della cittadinanza, per cui le città sono sempre più vissute e godute da cittadini del mondo (turisti e/o visitatori, temporaneamente presenti) e da cittadini diffusi (suburbani, provinciali, metropolitani); la radicale trasformazione della struttura familiare, per cui la famiglia-tipo costituita da una coppia con figli, solido riferimento per l'economia e la politica, è oggi minoritaria; l'irregolarità e flessibilità dei calendari, delle agende e dei ritmi di vita della popolazione attiva; la mobilità sociale, per cui gli individui hanno traiettorie di vita e pratiche quotidiane meno determinate dalle loro origini sociali di quanto avveniva nel passato; l'elevazione del livello di istruzione e quindi l'incremento della domanda di cultura; la crescita della popolazione anziana e la forte individualizzazione sociale hanno generato una domanda di città espressa dalla gente estremamente variegata ed eterogenea, frammentata e volatile, e per alcuni aspetti assolutamente nuova. Accanto a vecchie e consolidate richieste – la città efficiente, funzionale, produttiva, accessibile a tutti – sorgono nuove domande, ideali e bisogni che hanno come oggetto la bellezza, la varietà, la fruibilità, la sicurezza, la capacità di stupire e divertire, la sostenibilità, la ricerca di nuove identità, domande che esprimono il desiderio di vivere e di godere la città, di stare bene in città, domande che non possono essere più soddisfatte attraverso un'idea di welfare semplicemente basata sull'istruzione, la sanità, il sistema pensionistico e l'assistenza sociale. La città moderna ovvero l'idea moderna della città, organizzata solo sui concetti di ordine, regolarità, pulizia, uguaglianza e buon governo, è stata consegnata alla storia passata trasformandosi ora in qualcosa di assai diverso che facciamo fatica a rappresentare, a descrivere, a raccontare. La città contemporanea può essere rappresentata in molteplici modi, sia dal punto di vista urbanistico che dal punto di vista sociale: nella letteratura recente è evidente la difficoltà di definire e di racchiudere entro limiti certi l'oggetto "città" e la mancanza di un convincimento forte nell'interpretazione delle trasformazioni politiche, economiche e sociali che hanno investito la società e il mondo nel secolo scorso. La città contemporanea, al di là degli ambiti amministrativi, delle espansioni territoriali e degli assetti urbanistici, delle infrastrutture, della tecnologia, del funzionalismo e dei mercati globali, è anche luogo delle relazioni umane, rappresentazione dei rapporti tra gli individui e dello spazio urbano in cui queste relazioni si muovono. La città è sia concentrazione fisica di persone e di edifici, ma anche varietà di usi e di gruppi, densità di rapporti sociali; è il luogo in cui avvengono i processi di coesione o di esclusione sociale, luogo delle norme culturali che regolano i comportamenti, dell'identità che si esprime materialmente e simbolicamente nello spazio pubblico della vita cittadina. Per studiare la città contemporanea è necessario utilizzare un approccio nuovo, fatto di contaminazioni e saperi trasversali forniti da altre discipline, come la sociologia e le scienze umane, che pure contribuiscono a costruire l'immagine comunemente percepita della città e del territorio, del paesaggio e dell'ambiente. La rappresentazione del sociale urbano varia in base all'idea di cosa è, in un dato momento storico e in un dato contesto, una situazione di benessere delle persone. L'urbanistica moderna mirava al massimo benessere del singolo e della collettività e a modellarsi sulle "effettive necessità delle persone": nei vecchi manuali di urbanistica compare come appendice al piano regolatore il "Piano dei servizi", che comprende i servizi distribuiti sul territorio circostante, una sorta di "piano regolatore sociale", per evitare quartieri separati per fasce di popolazione o per classi. Nella città contemporanea la globalizzazione, le nuove forme di marginalizzazione e di esclusione, l'avvento della cosiddetta "new economy", la ridefinizione della base produttiva e del mercato del lavoro urbani sono espressione di una complessità sociale che può essere definita sulla base delle transazioni e gli scambi simbolici piuttosto che sui processi di industrializzazione e di modernizzazione verso cui era orientata la città storica, definita moderna. Tutto ciò costituisce quel complesso di questioni che attualmente viene definito "nuovo welfare", in contrapposizione a quello essenzialmente basato sull'istruzione, sulla sanità, sul sistema pensionistico e sull'assistenza sociale. La ricerca ha quindi analizzato gli strumenti tradizionali della pianificazione e programmazione territoriale, nella loro dimensione operativa e istituzionale: la destinazione principale di tali strumenti consiste nella classificazione e nella sistemazione dei servizi e dei contenitori urbanistici. E' chiaro, tuttavia, che per poter rispondere alla molteplice complessità di domande, bisogni e desideri espressi dalla società contemporanea le dotazioni effettive per "fare città" devono necessariamente superare i concetti di "standard" e di "zonizzazione", che risultano essere troppo rigidi e quindi incapaci di adattarsi all'evoluzione di una domanda crescente di qualità e di servizi e allo stesso tempo inadeguati nella gestione del rapporto tra lo spazio domestico e lo spazio collettivo. In questo senso è rilevante il rapporto tra le tipologie abitative e la morfologia urbana e quindi anche l'ambiente intorno alla casa, che stabilisce il rapporto "dalla casa alla città", perché è in questa dualità che si definisce il rapporto tra spazi privati e spazi pubblici e si contestualizzano i temi della strada, dei negozi, dei luoghi di incontro, degli accessi. Dopo la convergenza dalla scala urbana alla scala edilizia si passa quindi dalla scala edilizia a quella urbana, dal momento che il criterio del benessere attraversa le diverse scale dello spazio abitabile. Non solo, nei sistemi territoriali in cui si è raggiunto un benessere diffuso ed un alto livello di sviluppo economico è emersa la consapevolezza che il concetto stesso di benessere sia non più legato esclusivamente alla capacità di reddito collettiva e/o individuale: oggi la qualità della vita si misura in termini di qualità ambientale e sociale. Ecco dunque la necessità di uno strumento di conoscenza della città contemporanea, da allegare al Piano, in cui vengano definiti i criteri da osservare nella progettazione dello spazio urbano al fine di determinare la qualità e il benessere dell'ambiente costruito, inteso come benessere generalizzato, nel suo significato di "qualità dello star bene". E' evidente che per raggiungere tale livello di qualità e benessere è necessario provvedere al soddisfacimento da una parte degli aspetti macroscopici del funzionamento sociale e del tenore di vita attraverso gli indicatori di reddito, occupazione, povertà, criminalità, abitazione, istruzione, etc.; dall'altra dei bisogni primari, elementari e di base, e di quelli secondari, culturali e quindi mutevoli, trapassando dal welfare state allo star bene o well being personale, alla wellness in senso olistico, tutte espressioni di un desiderio di bellezza mentale e fisica e di un nuovo rapporto del corpo con l'ambiente, quindi manifestazione concreta di un'esigenza di ben-essere individuale e collettivo. Ed è questa esigenza, nuova e difficile, che crea la diffusa sensazione dell'inizio di una nuova stagione urbana, molto più di quanto facciano pensare le stesse modifiche fisiche della città. ; The research aims to define guidelines for the preparation of a plan that deals with quality of life and well-being. The reference to the quality and well-being is positively innovative, because imposes to organs of the government to relate with the subjectivity of active citizens and, at the same time, makes clear the need for a broader and transversal approach to the city and a more close relationship of technicians/experts with the leaders of political and administrative bodies. The research investigates the limits of modern town-planning theory in front of the complexity of new needs expressed by contemporary urban populations. The demand for services has changed significantly compared to that one of the Sixties, not only on the quantity but also and especially in terms of quality, because of the social changes that have transformed the modern city, from the point of view of the structure and the cultural request: the intermittent citizenship, so cities are increasingly experienced and enjoyed by citizens of the world (tourists and/or visitors, temporarily present) and popular citizens (suburban, provincial, metropolitan); radical transformation of the family structure, so the family-type consisting of a couple with children, solid benchmark for the economy and politics, is now minority; the irregularity and flexibility of calendars, diaries and rhythms of life of the population active, and social mobility, so individuals have trajectories of life and daily practices less determined by their social origins of what happened in the past; the elevation of the level of education and thus the increase in demand for culture; the growth of elderly population and the strong social individualism have generated a demand for the city expressed by the people extremely varied and diverse, fragmented and volatile, and in some aspects quite new. Close to old and consolidated requests - the city efficient, functional, productive, accessible to all - there are new questions, ideals and needs such as beauty, variety, usability, security, the ability to amaze and entertain, sustainability, the search for new identities, questions that express a desire to live and enjoy the city, to fell good into the city, questions that can no longer be satisfied through a welfare simply based on education, health, pension system and social security. The modern city or the modern idea of the city, based only on the concepts of order, regularity, cleaning, equality and good governance was handed over to the past history turning into something very different hard to represent, describe, tell. The contemporary city can be represented in many different ways, both on town-planning way and social way: in the recent literature there is the obvious difficulty of defining and enclose within certain limits the subject "city" and the lack of a strong belief in the interpretation of political, economic and social transformations that have invested society and the world in the last century. The contemporary city, beyond the administrative areas, territorial expansion and urban structures, infrastructure, technology, functionalism and global markets, is also a place of human relations, representation of the relationship between individuals and urban spaces where these relationship move. The city is both physical concentration of people and buildings, but also variety of uses and groups, it's the place of dense social relations where processes of cohesion or social exclusion occur, a place of cultural norms that govern behaviour and identity, expressed physically and symbolically through public spaces of city life. It's necessary a new approach to study the contemporary city, made up of cross-contamination and knowledge provided by other disciplines such as sociology and human sciences, which help to build the image commonly known of the city and the territory, landscape and environment. The representation of the urban social life varies according to what it is considered, in a specific historic moment and in a given context, a situation of well-being. The modern town-planning aimed at maximum level of well-being for individuals and communities, modelling on "real needs of people": in the old urban systems manuals appears a "Plan of services" as an appendix to the master plan, which includes services distributed on the surrounding areas, a sort of "social master plan" to avoid neighborhoods separated by segments of population or classes. In the contemporary city globalization, new forms of marginalization and exclusion, the advent of the so-called "new economy", the re-definition of the production base and the labour market are urban expression of a social complexity that can be defined trough transactions and symbolic exchanges, rather than trough processes of industrialization and modernization towards which the historic city, adopted modern, was oriented. All of this questions are the expression of that complex of matters which are currently described as "the new welfare", opposed to the one essentially based on education, on health, on the pension system and on social assistances. The research has therefore examined the traditional tools of town-planning and territorial programming in their operational and institutional dimension: the main destination of these instruments is the classification and accommodation of services and urban containers. It's evident, however, that in order to answer to the many questions of complexity, needs and desires expressed by contemporary society the actual allocations to "make city" must necessarily overcome the concepts of "standards" and "zoning" that are too rigid and unable to adapt to a growing demand for quality and services and at the same time inadequate to manage the relationship between collective space and domestic space. In this sense it is important to consider the relationship between housing types and urban morphology and hence the environment around the house, which establishes the relationship "from the house to the city" because it is in this duality that it is possible to define the relationship between private domestic spaces and public spaces and contextualize questions of roads, shops, meeting places, accesses. After the convergence from the wide urban scale construction to the architectural scale, the attention moves from the architectural scale to the scale of urban constructions, since the criterion of well-being goes through the different scales of habitable space. Moreover, in territorial systems with a widespread well-being and a high level of economic development there's an emerging awareness that the very concept of well-being is no longer linked only to the ability of collective and/or individual income: today the quality of life is measured in terms of environmental quality and social inclusion. Thus the need of an instrument of knowledge of the contemporary city to be attached to the Plan, containing criteria to be observed in the design of urban spaces in order to determine the quality and well-being, in the meaning of "quality of feeling good", of urban environment. Obviously, to reach quality and well-being it is necessary to satisfy macroscopic aspects of social functioning and living standards, through the indicators of income, employment, poverty, crime, housing, education, etc., and also first needs, basic and elementary, and secondary, cultural and changing, moving through the welfare state to a general feeling of well-being, to wellness in a holistic sense, all expressions of a desire for mental and physical beauty and a new relationship of the body with the environment, then real expression of a need for an individual and collective wellbeing. And it is this need, new and difficult, which creates the widespread feeling of a starting new urban season, much more than physical changes of the city could represent.
Il lavoro è volto a mettere in luce le problematiche connesse all'attività delle imprese multinazionali e alla sussistenza in capo alle stesse di una responsabilità sociale internazionale (RSI). Nell'attuale panorama economico e politico mondiale, caratterizzato dalla globalizzazione e dalla stretta interdipendenza dei mercati, dalla sempre più frequente internazionalizzazione dei processi produttivi e aziendali e dalla contestuale operatività delle società in più Paesi, dalla accresciuta consapevolezza del consumatore circa il rispetto, nei processi produttivi, di istanze ritenuti fondamentali dalla società civile, come i diritti fondamentali dell'uomo e dei lavoratori o la protezione dell'ambiente, l'impresa multinazionale assume un ruolo fondamentale sia nell'indirizzare i trends economici globali (si pensi al fatto che alcune società hanno profitti superiori al PIL di buona parte degli Stati della comunità internazionale); la configurazione di una responsabilità sociale in capo a tali società vuol dire mescolare la libertà di impresa e il libero mercato con l'etica. La necessità di inserire la questione dell'etica negli affari nasce, dunque, dalla convinzione - sempre più diffusa in ambito internazionale e nazionale - che l'attenzione dell'impresa verso le istanze sociali, ambientali ed etiche delle comunità umane costituisca una condizione imprescindibile per uno sviluppo durevole e sostenibile. In tale prospettiva, dunque, il concetto di responsabilità sociale d'impresa richiama le imprese a considerare attentamente - nella definizione della propria strategia, nell'articolazione delle politiche e nelle procedure gestionali quotidiane - gli interessi diffusi della collettività, nonché l'impatto delle proprie attività, non solo in termini economici, ma anche sociali, ambientali ed etici. La responsabilità sociale rappresenta, quindi, per l'impresa uno strumento utile ed efficace per rispondere alle istanze e alle esigenze della società civile. Con la RSI nasce quindi una teoria di impresa che vede la produzione di beni non solo come strumento di profitto ma anche come occasione di realizzazione del benessere sociale; lo stesso operato dell'impresa inizia ad essere valutato globalmente non solo in rapporto ai risultati economici della stessa ma anche in base alla qualità del prodotto, alla qualità dell'ambiente lavorativo e alle istanze ambientali, seconda i dettami di quella scuola di pensiero del cd. business ethics per cui le imprese sono chiamate a compiere azioni che contribuiscano ad eliminare e prevenire le iniquità sociali e a promuovere lo sviluppo della collettività. Tale necessità è stata anche consequenziale a comportamenti ed abusi messi in atto dalle società transnazionali che hanno arrecato gravi danni alle comunità umane degli Stati ospiti delle attività produttive. Gli abusi commessi dalle imprese, non sempre riconducibili a precise violazioni degli ordinamenti nazionali, sono stati progressivamente interpretati e costruiti come violazioni o mancanze nei confronti di un complesso di principi definiti come appartenenti ad una ampia sfera di responsabilità sociale internazionale dell'impresa, che implica la perdita di reputazione e, quindi, la possibile riduzione delle sue quote sul mercato qualora gli stakeholders più interessati riescano a mobilitare l'opinione pubblica su larga scala. Fin dagli anni '70, diverse organizzazioni internazionali hanno iniziato ad occuparsi della regolamentazione dell'attività delle imprese transnazionali, evidenziando il ruolo che le imprese multinazionali sono chiamate a rivestire nei processi di tutela dei diritti umani e dell'ambiente che emergono nello svolgimento delle loro attività economiche; appare evidente come sia basilare, nel piano dell'opera, definire l'impresa multinazionale, analizzando i diversi strumenti adottati dalle organizzazioni internazionali e i contributi dottrinali in materia, alla luce dei quali sembra potersi dire che il carattere di "multinazionalità" o "transnazionalità" è dato dalla presenza di diverse unità operative, dislocate in più Paesi, che si trovano sotto il controllo (azionario o di gestione) di un'unica società holding; tale distinzione tra unità operative si estende fino al profilo giuridico, in quanto le singole consociate sono autonomi soggetti di diritto sottoposti, relativamente ai profili della regolamentazione e della costituzione, all'ordinamento giuridico dello Stato di nazionalità. Ciò spesso comporta che le società scelgano come sede un Paese sulla base della convenienza che ciascuno di essi offre in relazione al trattamento fiscale, al costo della manodopera e delle materie prime, alla regolamentazione in materia di protezione dell'ambiente. Sembra quindi necessario un tentativo di regolamentazione da parte di organismi sovranazionali, a fronte del numero sempre maggiore di imprese operanti in più mercati (più di 80.000 società con circa 900.000 società sussidiarie), al loro peso economico e occupazionale (si stimano circa 80.000.000 di posti di lavoro) e a seguito di numerosi episodi che hanno coinvolto tali imprese dagli anni '70 ad oggi, come nei casi della Drummond o della Del Monte, accusate di gravi repressioni dei diritti sindacali e sociali dei lavoratori, o della Chevron/Texaco e della Union Carbride, responsabili di disastri ambientali tra cui quello di Bophal, in India, fino al caso, recentissimo, del disastro ambientale causato dalla piattaforma Deepwater Horizon al largo delle coste della Florida e della Louisiana tra il 2010 e il 2011, o i casi di violazioni dei diritti umani e commissione di crimini internazionali (arresti arbitrari, torture, violenze sessuali, trattamenti inumani e degradanti), commesse da società transnazionali operanti nel settore estrattivo e minerario in Africa e nel Sud Est Asiatico, commessi direttamente o a mezzo di milizie assoldate per la protezione degli impianti. L'attività delle Organizzazioni internazionali, a partire dagli anni '70, si è focalizzata sul tema; l'OCSE, l'Organizzazione internazionale del lavoro, la Camera di Commercio internazionale hanno adottato in quegli anni raccomandazioni e dichiarazioni rivolte agli Stati membri e alle imprese per l'adesione a certi principi e diritti già sanciti da altri strumenti convenzionali; le Nazioni Unite, prima attraverso l'attività della Commissione sulle imprese multinazionali e poi della Sottocommissione per la protezione e promozione dei diritti umani, si sono occupate della materia, giungendo alla elaborazione di un Codice di condotta per le imprese multinazionali (mai adottato) e di Norme sulla responsabilità delle imprese multinazionali e altre imprese in relazione ai diritti umani, che si affiancano alla partnership pubblico-privata del Global Compact. Ancora, anche altre organizzazioni internazionali, come l'Organizzazione mondiale della sanità, l'OMC, la Banca mondiale, l'International Standard Organisation, hanno adottato atti che invitano le imprese a svolgere la propria attività produttiva nel pieno rispetto dei diritti fondamentali della persona, delle comunità locali e dell'ambiente, e quindi prendendo in considerazione non solo interessi e diritti dei soci ma di tutti i soggetti a vario titolo coinvolti o toccati dall'attività aziendale. In ultimo, è il lavoro del Rappresentante Speciale del Segretario Generale ONU John Ruggie ad elaborare un quadro normativo (denominato Protect, Respect, Remedy) generale relativo al rapporto tra business e diritti umani. La caratteristica degli strumenti analizzati è la loro natura non vincolante, quindi meramente esortativa e ad applicazione volontaria. Tale situazione si ricollega sostanzialmente a due ragioni: la discussa soggettività internazionale delle imprese multinazionali e le opposte visioni dei Governi in materia (con evidenti difformità di vedute tra Paesi in via di sviluppo e Paesi industrializzati). Riguardo alla soggettività delle imprese multinazionali, ovvero lo status di essere titolari di diritti e obblighi nascenti dal diritto internazionale, la dottrina internazionalistica è fortemente divisa. Secondo un primo orientamento, le IMN non sarebbero soggetti di diritto internazionali in quanto sono solo destinatarie di norme, e quindi "oggetto" del diritto internazionale; sarebbero soggette solo alla giurisdizione dello Stato, e vincolate dal diritto internazionale solamente in virtù del richiamo da parte dell'ordinamento giuridico interno. Dagli anni '60, inizia a farsi largo un diverso filone dottrinale che, partendo dal noto parere della Corte internazionale di giustizia Reparations for Injuries, considera l'impresa quale soggetto di diritto internazionale, in virtù di una serie di diritti e obblighi che le vengono attribuiti dal diritto internazionale, soprattutto in materia di investimenti e di contratti internazionali (tra tutti, il diritto di adire un'istanza arbitrale o giurisdizionale a carattere arbitrale). Inoltre, la costante attenzione per l'attività delle IMN da parte delle Organizzazioni internazionali, potrebbe testimoniare la nascente opinio juris di conferire una, seppur limitata, soggettività internazionale alle imprese. Dall'analisi della prassi internazionale si sono tratte conclusioni provvisorie, in particolare che l'impresa, soprattutto nel settore del diritto economico e degli investimenti, possegga una personalità giuridica internazionale limitata e soprattutto derivata dalla volontà degli Stati, ma soprattutto funzionale, poiché contenuta nei limiti stabiliti dal trattato internazionale (BITs) o del contratto internazionale che stabilisce diritti e obblighi per la stessa. Negli ultimi anni anche l'Unione Europea ha iniziato a promuovere una adesione delle imprese ai valori fondamentali dei diritti dell'uomo, dei lavoratori e dello sviluppo sostenibile. A partire dal Libro Verde del 2001, l'UE ha elaborato progressivamente una strategia europea per la responsabilità sociale di impresa, qualificata come adozione spontanea di prassi volte a contribuire al miglioramento della società e alla qualità dell'ambiente. La strategia dell'UE si caratterizza per avere una dimensione sia interna all'impresa, stabilendo una serie di programmi d'azione e l'adozione di sistemi di gestione dei processi produttivi, sia esterna alla stessa, prevedendo il coinvolgimento di comunità locali, partner commerciali, clienti, fornitori, ONG, autorità statali. A tali fini, l'UE lanciò una serie di iniziative, quali i sistemi EMAS e ECOLABEL di certificazione ecologica e di audit ambientale, il Multistakeholders' forum, per formare un quadro giuridico regolamentare in materia di appalti pubblici e sostenibilità ambientale, di tutela del consumatore, di pubblicità ingannevole, nonché l'adozione di codici di condotta settoriali, ispirato ai principi della RSI. L'attività di regolamentazione della RSI ha ricevuto un contributo dalle stesse imprese multinazionali, nel senso di una autoregolamentazione delle proprie attività, attraverso dei codici di condotta autonomamente adottati dalla singola impresa in funzione delle proprie strategie e valori. Tali codici si distinguono nettamente dalle linee guida adottate dalle Organizzazioni internazionali perché in essi l'impresa si fa creatrice e destinataria di norme, create non perché la necessità provenga dal diritto, ma dall'interesse dell'impresa (che, in molti casi, si caratterizza per essere meramente reputazionale). Tali codici, di chiara natura volontaristica, garantiscono il rispetto degli standard di tutela e di promozione dei principi in esso contenuti, stabilendo il più delle volte un meccanismo di monitoraggio e controllo del rispetto delle norme in esso contenute, meccanismo che può essere a carattere interno (gestito quindi da un ufficio interno all'impresa) o a carattere esterno (gestito, il più delle volte, da una ONG o da un sindacato). Infine, la ricerca si conclude con l'analisi dei principali temi che riguardano la RSI negli ultimi anni, ovvero quelli relativi ai profili di responsabilità delle imprese per violazione dei diritti fondamentali e per danni ambientali (con particolare riguardo alla disciplina statunitense contenuta nell'Alien Torts Statute), con particolare riferimento agli obblighi internazionali che incombono sugli Stati attraverso la ricostruzione della prassi internazionale. Inoltre, ulteriore profilo di studio è quello che si concentra sulla possibile estensione della giurisdizione dei tribunali internazionali per crimini internazionali alle persone giuridiche, con particolare riguardo ai lavori preparatori della Conferenza di Roma che ha portato all'istituzione della Corte Penale Internazionale. In conclusione, oggetto della ricerca è stato la ricostruzione del concetto di RSI, il quale è un prodotto degli ordinamenti nazionali ed in particolare degli ordinamenti giuridici degli Stati industrializzati, identificando un framework giuridico che include strumenti normativi di varia natura e in svariati settori, come quelli che disciplinano le società commerciali; le normative nazionali di prevenzione e repressione della corruzione; le normative del settore finanziario ed in particolare quelle sulle borse valori; le discipline a tutela del lavoro, dell'ambiente e del consumatore. Negli Stati più avanzati dal punto di vista economico e istituzionale la RSI, dunque, non è codificata in uno specifico settore regolamentare ma rappresenta un sistema complesso di normative che regolano i diversi aspetti di quelle attività di impresa; nei PVS, invece, tali normative sono spesso frammentarie o addirittura assenti: questa situazione ha permesso alle IMN di avvantaggiarsi dei vuoti legislativi o delle regole stringenti presenti in questi Paesi. Appare evidente come la comunità internazionale abbia constatato la necessità di regolare l'attività delle imprese multinazionali, per la promozione e la protezione dei propri valori fondamentali e di uno sviluppo in un'ottica di sostenibilità ambientale, nell'intenzione di creare un quadro giuridico internazionale che permetta alle imprese di perseguire le proprie finalità aziendali senza perdere di vista le esigenze collettive (in particolare dei Paesi in cui operano). Per raggiungere tale obiettivo, appare inevitabile un'evoluzione del diritto internazionale vigente, i cui processi di formazione, gestiti sostanzialmente dai Governi, non possono non tenere conto dell'accresciuto ruolo e peso delle IMN e della società civile. ; In today's economic and political world characterized by globalization and interdependence of markets, by an increasingly internationalization of production processes and by business operations of the company conducted simultaneously in several countries, by an increased consumer awareness regarding compliance of production processes to values that are considered essential by civil society, as fundamental human rights and labour and environmental protection, MNEs have a fundamental role in addressing the global economic trends. In this perspective, then, the concept of corporate social responsibility attracts companies to consider carefully - in the definition of its strategy and in the articulation of policies and procedures daily management - the various interests of the community, as well as the impact of its activities, not only in economic terms but also in social, environmental and ethical issues. Social responsibility is, therefore, a useful tool for the enterprise and effective way to respond to the needs and demands of civil society.With the CSR arises, therefore, a theory of business that sees the production of goods not only as a means of profit, but also as an opportunity for the realization of social welfare, as dictated bythe school of thought of thebusiness ethics, which invite companies to take action in orderto eliminate and prevent social inequities and promote community development. This need was also consequential to the abusescommitted by transnational corporations that have caused serious damage to human communities of their host countries. Abuses committed by companies, not always related to specific violations of national laws, have been gradually interpreted and constructed as a violation or misconduct against a set of principles defined as belonging to a broad spectrum of social responsibility international, which implies loss of reputation and, therefore, the possible reduction of its share on the market where the key stakeholders concerned can mobilize public opinion on a large scale. Since the 70s, several international organizations have begun to deal with the regulation of transnational corporations, highlighting the role that multinational corporations are called to play in the process of protection of human rights and of the environment that emerge in the course of their economic activity. Is fundamental for the work plan, define the multinational enterprise, by analysing the various instruments adopted by international organizations and doctrinal contributions on the subject, the light of which it seems possible to say that the character of "multinationality" or "transnationality" is the presence of various operating units, located in different countries, which are under the control (equity or management) of a single holding company; the distinction between operational units extends to the legal point of view, as the individual subsidiaries are independent legal entities subject, relatively to the profiles of the regulation and constitution, subjected to the legal system of the State of nationality. It often means that companies choose the host country on the basis of convenience that this country provides in relation to the tax treatment, labour costs and raw materials, to the rules on environmental protection. It therefore seems necessary to attempt to regulate multinational enterprises by supranational bodies, in relation to the increasing number of companies operating in multiple markets (more than 80,000 companies with about 900,000 subsidiaries), to their economic and employment (an estimated 80 million job opportunities) and following several incidents involving such companies from the '70s to today, as in the case of Drummond or Del Monte, accused of severe repression of trade union rights and social rights of workers, or Chevron/ Texaco and Union Carbide, responsible for environmental disasters including that of Bhopal, India, to the case of the environmental disaster caused by the Deepwater Horizon rig off the coast of Florida and Louisiana between 2010 and 2011, or cases of human rights violations and commission of international crimes (arbitrary detention, torture, rape, inhumane and degrading treatment) by transnational corporations operating in the mining industry in Africa and South East Asia, made directly or through the militias hired to the protection of plants. The activities of international organizations, from the 70s, focused on the theme, the OECD, the International Labour Organization, the International Chamber of Commerce adopted in those years, recommendations and declarations addressed to the Member States and the companies for adherence to certain principles and rights already provided by other conventional instruments; also the United Nations, first through the work of the Committee on Multinational Enterprises and then through the subcommittee for the protection and promotion of human rights, have dealt with the matter, coming to the elaboration of a Code of Conduct for Multinational Enterprises (never adopted) and rules on the responsibilities of transnational corporations and other business enterprises with regard to human rights, alongside to the public-private partnership of the Global Compact. Still, other international organizations such as the World Health Organization, the WTO, the World Bank, the International Standards Organization (which as a private nature), have taken actions that invite businesses to carry out its production activities in full respect of fundamental human rights, of local communities needs and of the environment, and then taking into account not only the interests and rights of the shareholders but to all those involved in various ways affected the activity or business. Finally, it is the work of the Special Representative of the UN Secretary-General John Ruggie to develop a framework (called Protect, Respect, Remedy) concerning the relationship between business and human rights. The characteristic of the analysed tools is their non-binding nature, then merely hortatory and voluntary application. This situation is linked mainly to two reasons: the disputed international subjectivity of multinational enterprises and the opposing views of Governments on the subject (with obvious differences of views between developing countries and industrialized countries). Regard to the subjectivity of transnational corporations, or the status of being holders of rights and obligations arising from international law, international legal theory is strongly divided. According to one view, MNEs would not be subject to international law as they are only recipients of rules, and then the "object" of international law would be subject only to the jurisdiction of the state, and bound by international law only by virtue of the reference made by the domestic legal system. Since the '60s, a different doctrinal trend began to make his way starting from the known opinion Reparations for Injuries of the International Court of Justice, and then considering the company as a subject of international law, by virtue of a series of rights and duties which are assigned to it by international law, especially in the field of investment and international contracts (among them, the right to appeal an arbitration tribunal or judicial character arbitration). In addition, the constant attention to the activities of MNEs by international organizations, could witness the nascent opiniojuris to give ainternational subjectivity to businesses, albeit limited. An analysis of international practice have taken provisional findings, in particular that the company, especially in the field of economic law and investment, possesses an international limitedlegal personality and mainly derived from the will of the States, but above all functional, as contained in limits established by international treaty (BITs) or international agreement that establishes rights and obligations for the same. In recent years the European Union has begun to promote adhesion of the companies core values of human rights, labour standards and sustainable development. From the Green Paper of 2001, the EU has developed progressively a European strategy for corporate social responsibility, described as spontaneous adoption of practices to contribute to the improvement of society and the quality of the environment. The EU strategy is characterized by having an internal dimension to the company, establishing a series of action programs and the adoption of management systems, processes, and external to it, calling for the involvement of local communities, commercial partners, customers, suppliers, NGOs, state authorities. To this end, the EU launched a series of initiatives, such as EMAS and Ecolabel certification ecological and environmental audit, the multi-stakeholder forum, to form a legal framework to regulate public procurement and environmental sustainability, protection of consumer, misleading advertising, and the adoption of sectorial codes of conduct based on the principles of CSR. The regulatory activities of CSR has received a grant from the multinational enterprises themselves, in the sense of a self-regulation of their activities, through codes of conduct adopted by each company independently according to their own strategies and values. These codes can be clearly distinguished from the guidelines adopted by international organizations because in them the company is the creator and recipient of rules, created not because the need comes from the law, but by the company (which, in many cases, characterized by being merely reputational). These codes, clearly voluntary, ensure compliance with standards for the protection and promotion of the principles contained therein, setting most of the time a mechanism for monitoring and enforcement of the rules it contains, a mechanism that may be internal character (then managed by an office inside the company) or external character (managed, in most cases, an NGO, or a trade union). Finally, the research concludes with an analysis of the main issues concerning CSR in recent years, namely those related to the profiles of corporate responsibility for violation of fundamental rights and environmental damage (especially with regard to U.S. regulations contained in the Alien Tort Statute), with particular reference to international obligations on states through the reconstruction of the international practice. In addition, further study is to profile that focuses on the possible extension of the jurisdiction of international tribunals for crimes under international law to legal persons, with particular reference to the drafting history of the Rome Conference that led to the establishment of the International Criminal Court. In conclusion, the object of the research was the reconstruction of the concept of CSR, which is a product of national law and in particular the legal systems of the industrialized countries, identifying a legal framework that includes legal instruments of various types and in various sectors, such as those governing commercial companies, national regulations for the prevention and combating of corruption; regulations of the financial sector and in particular those on stock exchanges; disciplines to protect labour, the environment and the consumer. In the most advanced in terms of economic and institutional CSR, therefore, is not encoded in a specific sector regulation but it is a complex system of regulations governing various aspects of the business activities, in developing countries, however, these rules are often fragmentary or even absent: this situation has allowed MNCs to take advantage of loopholes in the law or stringent rules present in these countries. It is evident that the international community has identified the need to regulate the activities of multinational enterprises, for the promotion and protection of its fundamental values and development in a sustainable environment, with the intention to create an international legal framework that allows companies to pursue their own business purposes without losing sight of the collective needs (in particular in the countries in which they operate). To achieve this goal, it is inevitable evolution of international law, whose formation processes, managed largely by governments, cannot fail to take into account the increased role and weight of MNEs and civil society. ; Dottorato di ricerca in Persona, impresa e lavoro: dal diritto interno a quello internazionale (XXV ciclo)
