The defence of marriage on the part of theorists like Rodrigo Sánchez de Arévalo, Alfonso de Madrigal, «El Tostado» and Alfonso de la Torre, condemning the practice of any form of polygamy is, quite apart from the moral and religious implications, an instrument legitimisation of the ruling government. In this way the theorists of the Spanish renaissance ensured the continuation of the monarchy, and with it the social order of the estates. ; La defensa del matrimonio por parte de teóricos como Rodrigo Sánchez de Arévalo, Alfonso de Madrigal, «El Tostado» y Alfonso de la Torre, denunciando la práctica de cualquier forma de poligamia es, independientemente de las implicaciones morales y religiosas, un instrumento de legitimación del gobierno vigente. En el renacimiento español los teóricos se aseguran así la pervivencia de la monarquía, y con ella el orden social estamental.

El tema de los sistemas de pensiones y su impacto en los ingresos de las personas mayores es crucial en todo el mundo y en especial en los países en desarrollo. Desde 1960 Marruecos había iniciado negociaciones sobre la seguridad social con varios Estados. La necesidad de esos pactos surgió de la importancia de la comunidad marroquí en el extranjero, que creció especialmente después de los años 50 por la demanda de mano de obra por parte de algunos Estados europeos. Esa comunidad evolucionó y se extendió a otros Estados, como España, a finales de los 70 y principios de los 80. Marrueco se inclinó en ese momento como hizo ya en fechas anteriores por la firma de convenios bilaterales, ya que permiten coordinar las legislaciones sociales de los dos países, y garantizan una mayor seguridad jurídica. ; The issue of pension systems and their impact on the incomes of the elderly is crucial throughout the world and especially in developing countries. Since 1960 Morocco had started negotiations on social security with several States. The need for these agreements arose from the importance of the Moroccan community abroad, which grew especially after the 1950s due to the demand for labor by some European states. This community evolved and spread to other States, such as Spain, in the late 70's and early 80's. Morocco was inclined at that time as it did in previous dates for the signing of bilateral agreements, since they allow coordinating the social legislations of the two countries, and guaranteeing greater legal security.

También se debe estudiar cómo se ha insertado en el ordenamiento jurídico, en lo que respecta a la pensión de viudedad, realidades ya integradas en la sociedad como son el divorcio o las parejas de hecho. Y ver cómo la violencia de género influye en esta materia y los efectos de la unión por el rito gitano. Polyaffective Relationships and the Protection of the Family. -- Abstract: We live in strange times, in which we speak of polyamory or polyaffection as an evolution of the society towards freedom and protection of the interests of people involved in this kind of relationship. We say that these are strange times because this system is nothing but polygamy and, therefore, neither modern nor advanced, but quite the contrary, old-fashioned in the Western world, seeing its adoption in primitive and tribal times. It is not denied that in the smallest part of Asia and in some parts of Africa, hence non-Western countries, monogamy as a system of living still does not prevail. Nonetheless, human development index of nations that still embrace polygamy, as well as the impact of the lack of protection of female gender and children in relationships in which there is one man and several women (polygyny) must be taken into account. These ideas disconnected from the reality of countries with similar practices, such as Brazil, will be analysed by this article based on statistical data, which can seem a bit unpleasant at first glance, but, after its reading, will reveal itself as pleasant once it analyses the social reality and the harmful consequences of polyamory. ; Fil: Silva, Regina Beatriz Tavares da. Decimos que estos son tiempos extraños porque este sistema no es más que poligamia y, por lo tanto, nada moderno o avanzado, todo lo contrario, anticuado en el mundo occidental, habiendo sido adoptado en tiempos primitivos y tribales. No se niega que en la parte más pequeña de Asia y en parte de África, por lo tanto, en los países no occidentales, la monogamia como sistema convivencial aún no prevalezca, pero el índice de desarrollo humano de lasnaciones que todavía adoptan la poligamia y la situación de los niños deben tenerse en cuenta. Es con datos estadísticos que estas ideas descomprimidas de la realidad de países de costumbres similares a las brasileñas serán analizadas en este artículo, que pueden parecer poco comprensivos a primera vista, pero, después de la lectura, se vuelven agradables, porque analizan la realidad social y las consecuencias dañinas del poliafecto.

Se suele decir que las escuelas de pensamiento islámico clásico han influenciado a los estados musulmanes en lo que respecta al derecho contemporáneo en general, y a las medidas legislativas referentes al derecho de familia en particular. Sin embargo, ¿cómo se refleja este hecho en el ordenamiento jurídico vigente en Argelia? El derecho argelino, ¿ha conseguido trasladar estos fundamentos islámicos en su derecho positivo actual? Para dar respuesta a esa pregunta, el presente artículo estudiará desde una perspectiva de derecho comparado la institución matrimonial de acuerdo con los principios coránicos del fiqh clásico en contraposición con el moderno código de familia argelino. Las especificidades que se analizarán aquí se basan en los siguientes elementos: la dote, el matrimonio entre parientes, el matrimonio por poderes, el matrimonio interreligioso, la poligamia y, finalmente, los derechos y deberes dentro del ámbito conyugal. ; It is often said that classical schools of thought have influenced Muslim states with regard to contemporary legislation. And this influence is more visible in matters regarding family law. However, have Algerians succeeded in enforcing Quranic principles through their current legislation? Bearing in mind such question, this paper will study the institution of marriage according to Quranic and classical fiqh principles as opposed to those present in modern Algerian family code. We will be analysing the following elements: dowry, marriage between relatives, marriage by proxy, interreligious marriage, polygamy and, finally, marital rights and duties in both Quranic and Algerian family code regulations.

Entre esas dos fechas, destacan otras importantes, como las fundaciones de Buenos Aires (1536 y 1580) y Asunción (1537), que fue repetidamente comparada con un "Paraíso de Mahoma" en el que reinaban la poligamia y los excesos sexuales. Aunque resulte difícil imaginar un harén sin mujeres, estas no tienen suficiente entidad ni en los documentos coloniales ni en la literatura de la etapa independiente. Ante tal paradoja, nos propusimos estudiar la situación de las féminas rioplatenses durante la primera centuria de presencia española. The work makes a chronicle of the manifestations of violence against women detected by the Special Rapporteur on violence against women during her official visits between 2015-2020. The visits cover countries on the five continents and allow us to differentiate two large groups of cases: those of violence that are repeated in all the countries visited and those that are specific to the culture, religion and harmful traditions of a given geographic area. The types of violence that are repeated in all countries are domestic violence, sexual violence, trafficking in women and femicide. Among the particular cases are violence in divorce and inheritance proceedings in Israel, online harassment in the United Kingdom, zina in Afghanistan, polygamy in Palestine, violence within gangs in Honduras, ablation in Sudan, etc. The articleindicates the need for a collective commitment, awareness, education and training work, social, political and economic change, as well as the need of collaboration of all the actors involved, starting with public authorities but continuing with civil society, companies, educational and health centres and families. The measures to be adopted should be of a legislative, administrative, social, educational, economic and political nature to be meaningful. ; El trabajo hace una crónica de las manifestaciones de violencia contra la mujer detectadas por la Relatora Especial de Naciones Unidas sobre la violencia contra la mujer en las visitas oficiales realizadas entre 2015 y 2020. Las visitas cubren países de los cinco continentes y permiten diferenciar dos grandes grupos de casos: los de violencias que se repiten en todos los países visitados y los que son específicos de la cultura, religión y tradiciones dañinas de una determinada área geográfica. Los tipos de violencia que se repiten en todoslos países son la violencia doméstica, la sexual, el tráfico de mujeres y el feminicidio. Entre los casos particulares está la violencia en procesos de divorcio y sucesión en Israel, el acoso online en Reino Unido, la zina en Afganistán, la poligamia en Palestina, la violencia en el seno de las pandillas en Honduras, la ablación en Sudán, etc. El artículo indica la necesidad de un compromiso colectivo, una toma de conciencia, una labor de educación y formación, un cambio social, político y económico así como la necesidad de colaboración de todos los actores involucrados, empezando por las autoridades públicas pero siguiendo con la sociedad civil, empresas, centros educativos y sanitarios y las familias. Las medidas que se adopten deben ser de carácterlegislativo, administrativo, social, educativo, económico y político para ser efectivas.
